Commissioner Borasky

said he was never given back-up as to where these areas were so he could not vote on this in a positive way without knowing that. January 29, 2014 3. For Possible Action Discussion and deliberation to approve a letter to the Bureau of Land Management fBLM) supporting Nye County’s use of public lands for mitigation in the Desert Tortoise Habitat Conservation Plan (HCP). and endorsing the four identified mitigation areas as likely viable Reserve Units. Mr. Lacy

advised there was a map in the office they had used for at least a year and staff had evaluated the sites. He described the locations, which were all public land parcels. Levi Kryder added that he did not know if the mitigation areas had specifically been put before the Board in the past, but they had been discussed with the Desert Tortoise Habitat Advisory Board and the County asked for them to be included in the RMP process.

Commissioner Carbone

made a motion to approve; seconded by Commissioner Cox. Tim Hafen commented he had not seen the map and could not identify what was being talked about. The general description he just heard did not include Pahrump Valley East and he asked where that was.

Mr. Lacy

stated that was totally outside of the private land that had been developed with streets.

Mr. Hafen

said a workshop was held a few years ago to discuss this and he made the statement that the best way to protect the tortoise was to move it out of harm’s way and put it somewhere where it could survive, but now tortoises were being put right out in that very area. He did not agree with the science of the matter. He asked if this bound the County in anyway and if it would be presented to the HCP Advisory Committee.

Mr. Lacy

said at this stage the County was just getting into the evaluation process, but it would be presented to the advisory committee.

Commissioner Carbone

noted the County did sign a letter that it was not for spending money on tortoises.

Commissioner Cox

asked how much this would cost the County. Mr. Kunzi advised this would be set up like an enterprise account. The County would set the rates once it took the system over and the users would pay for the operation of the system. There was no expense involved with the actual acquisition of the system as it would be built at the developer’s expense and gifted to the County upon completion.

Mr. Lacy

added that one of the advantages of doing this project was the County could potentially provide water and sewer services for the fairground in the future.

Commissioner Cox

said she did not agree with the County going into the utility business with a private developer and felt this would set a precedent.

Commissioner Schinhofen

asked how many systems the County currently ran. Mr. Osburn said there were 19 water systems and two wastewater systems.

Commissioner Borasky

made a motion to approve; seconded by Commissioner Carbone; 3 yeas. Commissioner Cox voted no.

Mr. Kunzi

asked for a motion to have a resolution prepared based upon the determination made by the Board and authorize the Chairman to execute it. January 29, 2014 4. For Possible Action Discussion and deliberation regarding a resolution to obtain the water and sewer utility at the Spring Mountain Raceway new project. Cont’d.

Commissioner Carbone

made a motion to authorize the resolution to be signed by the Chairman of the Board of County Commissioners; seconded by Commissioner Borasky; 3 yeas. Commissioner Cox voted no.

Commissioner Schinhofen
