Commissioner Carbone

stated the reason for this was to look at and review the possibility of making this a private shelter versus what they have today. They were going to need time to get into a new RFP/RFQ for that type of contract.

Commissioner Carbone

made a motion to approve the First Amendment to the Animal Shelter Service Contract for Tails End and to execute the First Amendment for a month to month term and to allow the County Manager to sign the month to month contract without coming back before the Board for each month; seconded by Commissioner Schinhofen. March 27, 2015 3. For Possible Action Discussion and deliberation to: 1)approve, amend and approve or reject First Amendment to Animal Shelter Services Contract between Nye County and Tails End, Inc. amending the term of the contract from a period of 1 year with an option to renew to a month to month term; and 2) execute the First Amendment to Animal Shelter Services Contract. Commissioner Borasky

said that they removed the animal shelter funding of $220,000 per year so he asked if this was just to allow them to go forward without a budget. Pam Webster, County Manager, explained that they couldn’t shut it down and there was no provision for the town to take it over. They have no employees in place and no provision to assume it at this point. The plan, as they start the transition actions, is to convert this to a shelter that is privately run, not subsidized by anyone. In a case where animals that are being held as evidence or under some legal action, the community in which that action was brought would pay for that stay in that private shelter. This was the option they were looking at but had not reached out to all the communities yet.

Commissioner Carbone

stated it also allowed them to get out of the fee structures and set up their own processes and procedures. Mrs. Webster agreed that it would not be public entity run, but would be a private shelter that ran on its own fees.

Commissioner Wichman

clarified that this would remove the annual contract and amend it to a month to month contract in order for them to transition to what they already voted to do. Mrs. Webster stated with the contract expiring it didn’t give them enough time to do what they needed to. She hoped to be done within 60 days.

Commissioner Wichman

stated this expired April 1st and she asked why they weren’t putting it into the town of Pahrump so they could pick up and pay those month to month fees and back charge those other communities like a business or charge the County for what they have in there for evidence. Mrs. Webster said they didn’t have anything set up with any of the entities to do that at this time. Angela Bello, District Attorney, stated this would need to go onto the agenda for the Town of Pahrump for approval to take over the shelter.

Commissioner Wichman

stated they had made cuts to some very important programs throughout Nye County and she was willing to take the beating for voting for these cuts but they were looking at keeping this contract going. The money was coming from the County to pay this on a month to month basis. This was also the Pahrump Town Board and they could put this on the agenda and it could be identified where that money was going to come from. If they hold animals for the other towns or the county it could be billed back. Commissioner Carbone stated that was what they were trying to do with the new contract, make it a private shelter. What they were doing also included taking care of what was going on in Tonopah. March 27, 2015 3. Ms. Bello

stated she was trying to clarify to put it back on the agenda for Pah rump to take over.

Commissioner Wichman

was concerned that if they approved this contract to come out of the County coffers the contract would not come back next month or the month after that.

Commissioner Schinhofen

stated if Commissioner Carbone amended his motion to put this on the April 7th agenda to identify that it would be the town funding this month to month they could do that.

Mrs. Webster

stated they were transitioning all of the programs that were voted on at that meeting and they have not shut down anything. This was part of the transition for this piece of it.

Commissioner Wichman

stated they would see all of those programs that were cut back on the agenda for some sort of clarification and some sort of a transition period. She would like to see this month to month contract come back on the agenda to identify a funding mechanism.

Commissioner Cox

asked if it would be legal to amend this to ask them to reimburse the County for the contract and put it in the motion. Ms. Bello stated it had not been voted on by the town to do anything so they could not do that.

Commissioner Carbone

amended his motion to include bringing this back on another agenda at some point in time as they try to close all the other contracts and other activities that they eliminated; Commissioner Schinhofen amended his second.

Commissioner Carbone

restated his motion to amend the First Amendment of the Animal Shelter Service Contract between Nye County and Tails End to amend the terms of the contract from a period of time of 1 year with options for renewal for one month for a month to month with executing the First Amendment for the Animal Shelter Contract and to include that they would bring back this item along with all the other items they were transitioning on another agenda in the near future or as soon as possible; seconded by Commissioner Schinhofen; 5 yeas.
