Commissioner Wichman

read from the agenda regarding public comment. Ted Thompson, Tonopah, stated he was present today as the NCEA President. He stated recently the employees had been portrayed as the bad guys. The last cost of living raise they had was back in 2008. He commented on the voluntary furloughs and loss of PERS contributions the employees had taken over the last few years and the County continued to spend. Nye County employees had been compared to other Class 3 counties and they were at the lower end. He stated furloughs would only be a temporary fix and most employees would like to see a long term fix. Bill Nolan, Trinity Services Group, Inc., discussed the contract meal services for the jail. He met with the Sheriff in March regarding the budgetary challenges and presented some options. He stated they were very competitive and would remain open to discussion. April21, 2015 3. GENERAL PUBLIC COMMENT (Three-minute time limit per person.) Action will not be taken on the matters considered during this period until specifically included on an agenda as an action item (first). Cont’d Wade Hinden, Pahrump, made a statement regarding metering. He thought they should bring it up to the vote of the people. Ginger Stumne and Barb Jorgensen were present from Advanced Resource Method Solutions. Ms. Stumne stated they were a new non-profit organization who directs people in need to various resources free of charge. They do accept donations. Dave Boruchowitz, President Nye County Law Enforcement Management Association, stated their Association was concerned. The Commissioners were giving a management employee an exemplary rate increase while cuffing others. He also commented on county spending and Social Security. The Nye County employees haven’t had a cost of living increase since 2008. With the furloughs and concessions they were actually below the wages from 2007. They were appalled that on one hand the Board was asking for concessions and on the other hand they were trying to disband them. They considered this a slap in the face when they have given up these concessions. Mr. Boruchowitz stated they were still willing to discuss legitimate fixes. Joy Belonga, Extension Educator with Cooperative Extension, stated she wanted the Board to revisit their tax rate. She stated it wasn’t part of the general fund and was considered a special fund. Adding an additional % was not taking anything away from the General Fund. lithe money wasn’t collected it would be a lose-lose situation and would affect many of their programs. This could have a domino effect in the long run if these services are not provided. On behalf of children, youth and families she asked that they reconsider this. Gary Marchinke, Pahrump, stated he would like everyone to join him this Sunday to remember Ian Deutch. It had been five years and he thought it was important to remember him. The event was planned for Sunday, April 26” at 8:00 p.m. at the Ian Deutch Memorial Park. Speakers would include Sheriff Wehrly, Eric Murphy and Congressman Cresent Hardy.

stated there were three committees he was overseeing. He felt the Youth Advisory Committee would be better served under Nye Communities Coalition. The Arena and Events Committees could probably do better without being any kind of board where they have to follow the open meeting law. They were working on a project right now, a walk through chart on how to plan an event.

Commissioner Carbone

stated the Veterans Memorial Committee was in good shape.

Commissioner Cox

stated the Public Lands Advisory Board was fine but would find out what they would like to do.

Commissioner Schinhofen

stated they had these boards to make recommendations to the governing board. He had been unable to get to any Nuclear Waste and Environmental meetings! but he had been to Parks and Recreation meetings. He thought they could meet bi-monthly rather than every month. He wasn’t sure why they needed a Nuclear Waste & Environmental Board but they did schedule an Earth Day celebration.

stated she would be unavailable until after April 27th She also received a letter addressed to elected officials dated April 10, 2015 regarding preparations for Jim Butler Days. The letter asked for raffle donations.

gave congratulations Tom Saitta for 50 years in business. He stated Frazier Furniture also celebrated a 25th anniversary. Earth Day was April 25th at Ian Deutch Park. April21, 2015 5. Announcements (first) — Cont’d Pam Webster stated April 14-20 was National Public Safety Week and she would like to acknowledge and personally thank all of the public safety employees for their services day in and day out.

Commissioner Borasky

stated the Blue Grass Festival was scheduled for May 1-3. A twenty mule team was scheduled for Saturday morning and it should be a very good event. He also reminded everyone of the 4th of July parade that would kick off at 9:00 am. Richard Goldstein, representing Community Group 651 in Pahrump which is a Boy Scout Troop, stated they were selling tie dyed t-shirts at Sunflower Fashions on May 2nd and it benefits the scouts. On Memorial Day they would be puffing up the flags at the cemetery. Amanda Connor, Attorney for IGIG, stated on May 16 there would be a gathering of The Grove in the parking lot at 1541 East Basin. It would be informational and there would be a lot of people present to answer questions. 6. For Possible Action Emergency Items Removed from the agenda. 7. Commissioner Schinhofen

stated there were a couple of items to comment on. He stated they do appreciate all of the concessions the employees have given and he would like to know who has received exemplary pay raises. Also, he was not aware that anyone has taken the pay cuts yet. It has taken them a long time to figure out how to get to that point. Commissioner Schinhofen stated they have steadily been declining and they have lost the Yucca Mountain funding. It was not something they took lightly. They do provide services with much less and he doesn’t know how they can provide services with anything less than what they have now.

stated on the next agenda he would like to have a comparison of food costs and have the Sheriff show them her options. When they do have this on the agenda everyone is welcome to present their items. He also asked to send a letter through the Board liaison to present at the PUC meeting in June that when they consider another increase they strongly advise that they should not add legal fees into those costs and no increase be allowed. They have already doubled their rates.

Commissioner Borasky

commented on Social Security. He stated it was something the Federal Government controls. It was not the way his philosophy went to keep raising taxes to raise money. Nye County was community-minded and gives back but he didn’t April 21, 2015 7. He took a cut in pay and makes a lot less than the Sheriff’s Office or employees.

had asked the Dispatch Supervisor, Natalie Carson, to bring back some stats and now she would also like stats on the turnover rate, field training and how much of a cost savings there has been. Commissioner Wichman also stated the 10% she was going to give up was going to be less than $3000 and was less than the managers but it was a gesture.

Commissioner Carbone

stated he wanted to know why the Treasurer’s Report didn’t show any more than .19 cents in the stabilization fund. Mrs. Webster stated she would address this all at once.

Commissioner Cox

stated she voted no on the budget cuts and the employee cuts not because she didn’t think they were needed but because of the way it was done. She knows staff has done the best they can and know they have not collected as much in assessments. She also mentioned the Social Security increase. It wasn’t fair to compare it to employee wages. She would like to see them take another look as far as the budget is concerned. Maybe they should quit giving away money to the Federal Government and the State. TIMED ITEMS 8. 10:00 Presentation of certificate and/or plagues to ten (10) employees honored for their years of service. The Board presented plaques for 5 years of service to Anita Lockhart and Deborah Woodland; 10 years of service to Amy Fanning and Susan Jackson; 15 years of service to Kenneth Hunt and Kathleen Medina; 20 years of service to Wade Christensen and Don Skalicky; and 25 years of service to Marie Becht and Shelley Rogers. This Agreement will remain valid for one year from the date signed. — Cont’d Vance Payne, Emergency Services, stated animal control receives about 5000 calls a month. In past years they have never had anyone physically bitten by a coyote but small animals were being victimized. He stated there was a very little know faction of the Department of Agriculture consisting of two guys whose only job was to hunt coyotes, bobcats, and mountain lions causing harm to humans or livestock. They either trap or exterminate the animals. They really have to substantiate there is harm to people or animals before coming out as they are not into prevention. Mr. Payne stated the $7500.00 and MOU would cover the whole year and they wouldn’t come out unless they get paid.

Commissioner Carbone

asked if the $7500.00 was just to take care of a period of time or a certain amount of animals. Mr. Payne stated it was for their time. Commissioner Carbone asked if they were chasing the animals to another area that they may have to handle. Mr. Payne stated yes.

made a motion to approve; seconded by Commissioner Wichman.

Commissioner Cox

stated there were hunters that would handle this, It wasn’t illegal to hunt coyotes. She stated coyotes do try to avoid people. They were not a good thing to have but they were a part of Mother Nature. Commissioner Cox stated she did not like the use of leg traps. She would like to see if they can get people in here to do it for the pelts and they could save the $7500.00. This may only pay for one trip and one coyote. She would like to see more cost definition. John Bosta, Amargosa Valley, stated he knew people in White Pine County that trap the coyotes. He asked why they didn’t consider a bounty where they pay so much per hide.

Commissioner Wichman

stated that was a Nevada Department of Wildlife Issue. Kenny Bent, Pahrump, stated in Oregon they had some heavy coyote areas. The idea of paying $7500.00 for one coyote was ludicrous. The idea of a bounty was a good idea. Greg Dann, Pahrump, stated he was bitten by a coyote when he tried to feed him some lunch. It was his doing. Mr. Dann stated because of the extent of the problem in his yard, his wife caught a pup from a den and turned it into animal control. He stated they chew through drip lines and jump over fences five feet or less. They also dig holes. Eddie Jim, Pahrump, stated he hasn’t had a problem but once the streams dry up, they will. They have to put up the appropriate fence, It was a part of life out here. April 21, 2015 13. stated they would not pay more without it coming back to the Board. Michael Sullivan, Pahrump, asked if the coyotes just move if one is trapped. He discussed the contract and stated it was a very expensive and he didn’t see the need, It was an interface between an urban and rural area. They don’t have the money and would be spending government money for private concerns. He thought they needed to table this to see what the numbers show.

stated he has had many calls and a lot of personal experience. Doing nothing was not appropriate. This would address some of the concerns of some of their constituents. Our government helps with health, safety and welfare.

Commissioner Carbone

commented that he was concerned about the plan.

Mr. Payne

this would happen only after a very close interaction. There had to be something to activate this.

Commissioner Carbone

stated if they could get this done without costing that would be preferable.

Commissioner Borasky

stated it was taxpayer money but would like to see more information. Dwight Lilly, Pahrump, stated he saw a coyote standing in someone’s yard. He would like to know the Sheriffs response if they have the right to defend their property. If a person was going to defend their property was that a problem with law enforcement.

Sheriff Wehrly

stated there was a law on the books that a person could defend his property.

stated he had to wait until they came onto his property to do anything, not while they were standing outside of his fence.

stated they needed to be clear and deny the appeal and force him to take the sign down.

Mr. Lacy

stated maybe they needed to address the ordinance regarding code enforcement.

Commissioner Carbone

stated there was an agreement and when someone signs a contract, they sign a contract. Dan Simmons, Pahrump, reviewed the history of the mailer and stated at the time the applicant was forced to sign this he had everything ready to go. He was unaware of the code at the time. The Chairman of the RPC has asked that it be brought back to the RPC. He would like to ask them to put this aside until after it is heard and they review the master plan. John Koenig, RPC Chairman, they were going to look at the part of the master plan that addressed this. His opinion was if he looked at the property today he would decide on the merits whether it should stay or go. It would not be coming back to the RPC. The plan was a guideline and not a code.

stated if they considered this signed under duress than all conditional use permits were signed under duress. April 21, 2015 41. Highway 160, Pahrump. Appellant Andy Jordan. AP# 42-391-05. Cont’d — — Dwight Lilly, Pahrump, stated he attended the RPC meetings the last couple of times and he researched this. The owner was granted two zoning changes. He put the sign up and rented it out but it had been going on for ten years. He signed another agreement to change and have a new tenant on his signs. It has been a year ago that this agreement ran out. He would suggest that the signs be removed if that was what needed to be done. An agreement was signed but it was not kept. He would like to have the Commissioners enforce this and have the signs removed.

asked Mr. Lacy if there were other signs and would they be asked to remove them. Mr. Lacy stated yes they would. Commissioner Cox asked if the sign could be relocated on the property. Mr. Lacy stated this parcel was pretty well built out and close to an existing structure. There were new laws that apply to billboards.

Commissioner Cox

asked if he could move it to someone else’s property. Mr. Lacy stated there was a process they had to go through. Commissioner Cox stated she would like to see improvements along the highway. Maria Zlotek, Deputy District attorney, stated the burden should be placed upon the appellant and they needed to consider what was presented as part of the appeal.

reviewed the findings. The waiver was consistent with the other retail businesses in the area. Angela Bello, District attorney, reminded the board to follow the code.

restated his motion to limit it to the size that is currently there with the recommendations and findings of staff and consistent with other businesses in the area for purposes of consistency; seconded by Commissioner Carbone and as stated by the District Attorney. Amanda Connor, Agent, stated all establishments were required to have approved logos and signs. She stated having the long and short would not allow for the logo and specific measurements. They had an approved shape so they would either have to make it very small or they needed a taller sign.

stated she met with the departments that had actions; Senior Nutrition, Juvenile Probation, and the Sheriff’s Office. Notices had been sent out to affected employees. She also stated the Sheriff’s Office had done a fairly extensive April21, 2015 29. Update regarding action taken at the March 3, 2015 meeting to remedy the revenue shortfall Fiscal Year 2015 and Fiscal Year 2016. Cont’d reorganization and Mrs. Shamrell had met with the collective bargaining associations. They were all coming back with questions and there was some discussion for concessions on both sides.

informed the Board she was setting a special meeting on April 28th at 10:00 a.m. to review the budget status and take final action. 27. For Possible Action Presentation by staff on the update to the 2004 Nye County Water Resources Plan. Discussion, deliberation, and direction to staff regarding the Board’s perspective on several matters therein.

asked Mr. Kryder to change the meeting schedule due to the possibility of snow. Levi Kryder, Natural Resources, stated they were in the process of updating the water resources management plan. He gave a presentation.

Commissioner Borasky

stated there was other water underground but everyone only wanted to talk about the first aquifer. He asked why they didn’t go further.

stated there were a lot of questions to be answered.

was concerned who would do this if they cut Natural Resources. Mr. Kryder stated the Water District would have to handle it. Commissioner Schinhofen stated he appreciated all the work Mr. Kryder did. Mr. Kryder stated his time was paid for by the Water District as well as MaryEllen Giampaoli.

stated they had a good framework other than updated demographics and a future plan. stated it looked like an item they have had for quite a few years. Chief Lewis stated it handled the wild land season. It was a standard agreement and had been approved by the District Attorney.

asked if they received the draft MOU from the volunteer maintenance group in Amargosa Valley. Mr. Fanning stated he did not but they did get one from Gabbs.

stated there were four bidders; three responsive and one that was the lowest but non-responsive. They had three responsive bids but they exceeded substantially the money allocated to that project.

stated it would be rebid in 2016. Jim Wulfenstein, Wulfenstein Construction, he respectfully disagreed that the board could not consider the bid. They failed to list themselves as the paving contractor. He stated he was told he had 48 hours after bid was awarded to change list of contactors.

stated the park was named as a thank you to the Blosser Ranch folks.

stated he had been working on this for awhile. He was unable to talk to the Blosser family but thought maybe a field could be named after him.

stated maybe they could hyphenate the name. Richard Goldstein stated the Veteran’s Advisory Committee talked about renaming the multi-purpose room after Butch Harper if there was a problem naming the park after him. Commissioner Borasky asked Mr. Goldstein to look into that. Eddie Jim stated he was fortunate to know the Blosser family. They had a park and a street named after them. He was totally against changing the name as they had put in a lot of work into this town and it was a legacy for their kids. Greg Dann stated he also knows the Blossers and was opposed to renaming the park. April 21, 2015 18. For Possible Action Discussion, deliberation, and direction to staff to proceed with exploring options to buy out the reversionary interests regarding the land patent for the fairgrounds property located at 3100 S. Hwy 160 in Pahrump, NV.

stated the fairgrounds property was in the name of the town. Buying out reversionary interest would get the ELM out completely.

This grant will be administered out of Fund 10340 Grants, and there is no match required.

For Possible Action Approval to apply for a State of Nevada, Office of Traffic Safety for a Limited Fixed Deliverables grant to outfit each deputy in Nye County with an electronic handheld device & printer. This grant will be administered out of Fund 10340 Grants. A 20% match is requested, however, the grant allows for this match to be in-kind and will be met by having NCSO staff train new users and administer the program. They should put it on the ballot or think about a phone survey. Further discussion was held regarding the affect on staff with the change of time.

stated she liked the 10:00 a.m. start time as it gave more time to get everything up and running. Also, she stated the Clerk’s Office performs other functions and many times she had to sign in trial jurors at 9:00 a.m. and it would be difficult to manage if the meetings started at 9:00 a.m. John Bosta, Amargosa Valley, stated as a citizen who has to drive it was more comfortable to come at 10:00 a.m.

sated she just couldn’t see this when they may be laying people off. She would like to see them wait until the meeting on April 28th Angela Bello stated this vacancy was due to someone who was leaving. It hadn’t been vacant for some time. The last option for her would be to cut people. She would ask her deputies to take a cut. Sharon Wehrly, Sheriff, stated they had not seen the plan she was bringing forward yet.

asked how much Nye County received on rental of their towers. Milan Dimic, IT, stated he didn’t know at this time but they had seven or eight contracts out.

stated there might be some confusion with the $500.00 regular monthly rate. It would actually be a total of $600.00 for now.

expressed his concerns that they were conducting an experiment. The nuisance was to remove the compost based on their process. Mr. Settlemeyer stated he could not start the process in a week.

stated he needed a solid waste permit to move it off site.

stated it was their responsibility if in fact there was a public nuisance on this property. There may be a private nuisance. Further discussion was held regarding the process for making the compost.

asked who was dumping what, who owns the truck and product, and is there a chemical analysis or MSDS on it or a bill of lading.

made a motion to extend this for 30 days at which time Mr. Settlemeyer needed to continue efforts and bring back the bill of lading or MSDS of the material, information on the owner of the material and the process used for making the compost: seconded by Commissioner Carbone.

Ms. Zlotek

stated since the motion included a chemical analysis on the sprayed material, why not have Mr. Settlemeyer agree to pay for the chemical analysis that was gathered from the Town Board since there was the possibility the material could be substituted. Further discussion was held regarding testing of the materials.
