stated on Thursday May 7th, at 10:00 a.m. at the Nugget they would be celebrating the National Day of Prayer. He also reminded everyone about the 4th of July Independence Day Parade at 9:00 a.m. They were still trying to get a flyover. There would also be a pancake breakfast.

stated as far as the outhouse race they gracefully lost but did a good job.

stated they have not called in the bounty hunters as a Board. There have been people who have offered. They also had two or three dogs killed in the last week. Commissioner Schinhofen stated he was not inclined to have moving the county seat on the agenda. Tonopah was more in the center of the county and there would still have to be services there. As far as Title 6, Animals, they had been throug h a lot. He didn’t know how they could take it any more seriously. He encouraged the public to look at those cases when they go to court. agreed with Commissioner Schinhofen and thanked him for his comments on the county seat. The only thing that would change would be that the first meeting of the month would be in Pah rump and the second in Ton opah.

stated there had been a rash of compliments for fixing potholes and responding to information requests. They were also complimented on cleaning up the nuisance on Savoy.

Commissioner Carbone

stated the Savoy nuisance was a lengthy process. Beth Lee was very instrumental in this process. Working together with folks in the county and town can get things done. Commissioner Carbone stated there were a lot of issues to be looked at in Title 6. Those issues were dear to their hearts. ASSESSOR

stated this was on the agenda before and now they were formalizing it. He asked Eileen Christensen to give a history of work EEC Environmental had done for the county.

Ms. Christensen

stated they had been working with Nye County since 2002. She stated they prepare grants for environmental oriented projects and have done just over 5 million dollars. In addition they do a lot of leveraging programs for economic development. The Brownfields projects led to identification of Nye County as being best solar resource in the country. Ms. Christensen stated they also handle lease support at Tonopah Airport.

asked if Nye was the lead county. Pam Webster stated this was grant funded and Nye County administers the grant and would lose it if not properly May 5, 2015 24. She explained that if something went wrong it would be by negligent work actions of EEC and then they wouldn’t be entitled to payment.

stated if the grant went away the project was done.

asked if EEC would charge the county personally for writing the grant if they didn’t get it.

explained the process. She stated this particular contract was for doing the work. In the past they have charged the County for writing the grant whether it was successful or not.

asked if this had gone before the towns. Angela Bello stated they had a lot of questions and they were still in negotiations. The bulk of the work was due to the dissolution of the elected town board of Pahrump so they would pay the lion’s share and the other towns may want to opt out. She was asking the county to contribute something so her office can do non-mandated things for the towns. If the county could contribute $10,000 the attorney would not just be a town attorney but the work could be spread to all the deputies. Ms. Bello stated their obligation to the unincorporated towns was only to defend and bring lawsuits on their behalf. The towns could hire outside counsel.

stated he saw the value of this. He stated at one time they had an attorney that reported to the County Manager.

Cont’d Darrel Lacy, Planning, recalled a few years ago that the District Attorney had approved the county to hire outside counsel to answer to the County Manager as a special assistant to the County Manager.

stated she could see how it would be an advantage to the District Attorney, but she was trying to avoid public perception that the towns would pay for an attorney who works for the county.

stated they needed to get an opinion from the Attorney General. She reviewed the matter.

made a motion to approve funding an attorney who would deal with the towns’ issues and report to the County Manager contingent upon the Attorney General not having an issue with it and to authorize the county manager to execute the necessary agreements.

asked him to put in his motion upon approval of the towns.

restated his motion to hire an attorney to deal with these towns’ issues contingent upon their approval and contingent upon the Attorney General having no issues with it and to authorize the County Manager to execute the agreements; seconded by Commissioner Borasky. Dwight Lilly, Pahrump, asked about billing hours and crossing over to have the towns pay for services they may not be receiving. As a citizen he didn’t want any town funds paying for county services. It sounded like a bookkeeping nightmare to him. Horace Carlyle, Tonopah Town Board, stated he had continuous discussions with the prior District Attorney on the unincorporated town law. He discussed NRS 269. He stated it was not a simple question. He only had one challenge and that was that the Town Manager or the town would have no authority to spend money for an employee in the District Attorney’s Office.

recommended they proceed with filling the position until an Attorney General’s opinion is rendered and recommended amending the motion.

expressed her concerns that now they would charge the towns for services they provided in the past.

stated up until three years ago they had three civil attorneys and now they have two and have taken on the legal services for the town of Pahrump. She would be happy to provide the services if they could. It is very narrow what the District Attorney is required to do for the towns. Only the town of Pahrump could not hire its own attorney. Further discussion was held.

stated it was inappropriate for her to hire someone temporarily until they get an opinion.

restated his motion again to approve funding an attorney for the towns contingent upon the towns’ approval and contingent upon an Attorney General’s approval, to temporarily house the attorney in the District Attorney’s Office until they have an AG’s opinion and to authorize the County Manager to execute the necessary agreements. He questioned if they wanted the temporary issue in there or not.

stated they just need to make sure they don’t mix monies together. Dwight Lilly clarified that they were hiring a multi-town attorney. Richard Goldstein stated his was confusing. They wanted to hire an attorney with approval from the towns. He felt it was a conflict of interest for the county to hire an attorney on behalf of the town of Pahrump. May 5, 2015 19. stated there was a lawyer prior this that was costing the town approximately $300,000 a year. He stated he thought they were getting a deal for the town. Amy Nelson stated Angela Bello’s department needed another civil attorney so now they were going to the towns for money. She stated Pam Webster handled many things and commended her for doing a lot of things the Commissioners could be doing.

clarified that this would not cause a tax increase. This would take some of the funds the town had from paying the town attorney. She asked if anyone asked Mrs. Webster if she wanted to take this on and did Ms. Bello have a problem with this being under the County Manager. Towns have to have representation. The town of Pahrump was not broke and this wouldn’t hurt the town. She also stated she though t it should fall under the District Attorney’s Office and not the County Manager.

stated Mrs. Webster was over the town of Pahrump but questioned if the towns would agree to have Mrs. Webster oversee this person and where would this person be housed. She wished she could continue to provide the towns with the services they have in the past.

opened the public hearing. Dan Peart, Phantom Fireworks, stated he appreciated the opportunity to inhabit the fairgrounds and allow a legal and safe avenue for people to shoot off fireworks. Dave Caudle, Pahrump, stated he was speaking for several residents that would be affected and asked the Board to consider the ramifications of a shooting site at the fairgrounds. They should look into the health hazards. Fireworks create toxic fumes and metal residue which would contaminate residential areas. Richard Goldstein, Pahrump, asked about a regulation that prohibited hazardous materials from being on BLM land. He asked if that regulation would affect this and could they legally shoot fireworks off on this land. Commissioner Schinhofen stated they had spoken to BLM and they didn’t have a problem with it. He stated this was for limited weekends and would have the towns’ agreement as well. This just set up the framework. Dwight Lilly, Pahrump, stated he wanted to make it clear if there would be an onsite safety person and agreement with the Sheriff’s Department to be down there.

stated this would all be addressed. They have had many meetings with the Sheriff and Fire Dept.

stated an operational agreement would come before the Board for approval from the association of the fireworks businesses and the town of Pahrump between now and the next meeting.

asked if the gentlemen from the fireworks businesses could address some of Mr. Caudle’s concerns. stated they were moving ahead with the Calvada Blvd reconstruction from the fountain to the Eye. The holdup was some broken equipment for recycling pavement, but once fixed they would be doing the reconstruction and putting out the bidder award for Wulfenstein. May 5,2015 13. thanked Mr. Fanning for Blagg and Calvada. She informed him of a pothole on Lost Creek that was overlooked. She also mentioned that the corner of Unicorn and Falcon had a big chunk of pavement missing. Mrs. Cox asked if Public Works handled the dumpsters around town for people to clean their yards up so people won’t have to go out to the dump. Mr. Fanning explained that it was done in the past as part of the town cleanup. Commissioner Carbone stated they could get with Mr. Shea and Mike Smith to find out what they could do for them.

stated there had also been a lot of illegal dumping because of the landfill hours. Mr. Fanning stated the hours were regulated by the County. The hours had always been the same but they would take a look at it.

Commissioner Borasky

stated he had a lot of compliments at church regarding the work on the intersection of Calvada and Blagg.

Commissioner Carbone

commented on speed zones and parking signs they have around Pahrump. They were going to have to look at the real speed zones and the Pahrump Town Ordinances to see if they could get those adjusted. They needed to make sure they do this properly.

Mr. Fanning

stated he was getting the streets indexed and would bring to the Board of Commissioners at the next board meeting to actually adopt a speed limit in the Pahrump valley. He needed to get an opinion from the District Attorney on how to read the street index into the record. They may just want to work on the major arterials and move through it that way. Commissioner Carbone agreed they should take a piece at a time. Commissioner Schinhofen stated if the cost was anything like it was before he was okay with 25 mph and 45 mph.

Mr. Fanning

stated they were currently working on the Pahrump Town Ordinances and no parking signs and would be requesting an opinion from the District Attorney for clarification on some items that may not be enforceable. They would make sure the speed limits and parking signs were legal and enforced. Richard Goldstein asked about the painted orange lines marks on Linda and Basin and when they would start the project. He also mentioned that there were potholes on Upland Street. Mr. Goldstein also asked how long it would drag on to fix Homestead where the water line collapsed. Mr. Fanning stated work on the UICN Issue at Homestead and Hacienda should start within the next month. Tim Carlo, Public Works, stated the orange marks on Linda and Basin were utilities. They were marked so they remove and replace that intersection. They pothole patched Comstock yesterday and it was in the works to do a skin patch. Mr Carlo also stated May 5, 2015 73. For Possible Action General road report by Public Works Director the super pave was complete at Calvada and Blagg and then they plan to squeeze in Calvada reconstruction project. Amy Nelson, Pahrump, stated there were potholes on Prospector Lane by Woodchips.

stated the public could go to the Nye County website and there was a link to public works. They can fill out a document right there.

Mr. Fanning

Mrs. Webster

stated the formula was in the backup but she wanted to expand on it. She explained that the state’s formula is to take the total parcel the easement is found on and calculate from the taxable value the value of the easement based on taking it to some dollar value to some measureable value and applying that value to the easement portion. Then they put on a 10% escalation factor and also set a minimum of $250.00 per easement.

made a motion to approve; seconded by Commissioner Carbone. Gary Bayer, director of Network Operations for Nevada Broadband Telemedicine and e-Care Nevada, was present and thanked the Board. He stated they planned to pay the back taxes on the easements. Mrs. Webster stated it should be under $3,500.00 per year.

stated this week she was informed that the Department of Taxation conducted an audit on Round Mountain Gold and there was a 3.9 million dollar invoice that will go to Round Mountain Gold payable within 45 days and would happen in the May 5, 2015 25. For Possible Action Discussion and deliberation regarding the budget status for Fiscal Year 2075, budget projections and possible reductions for Fiscal Year 2076. 2075 fiscal year. There was also an impact from an audit conducted by Dan McArthur on assessed valuations and they expect to get an adjustment in fiscal year 2015. Mrs. Webster also informed the Board that Sheriff Wehrly had a potential revenue stream for a services contract that would be sustainable for many years into the future, It would impact the general fund as well as other areas. The impact would be a minimum of 7.6 to 3 million dollars and the maximum could be more.

stated at the time she would not recommend any reductions. She would have more firm details at the budget hearing on May 1 They may be able to resolve the 2016 fiscal year as well. Commissioner Carbone commented that as long as it was something they could do and sustain it was okay. Mrs. Webster said she would not make the statement if she didn’t feel this could be sustained. She believed it would have a long term effect. Dwight Lilly, Pahrump, stated he was glad to hear they came up with money for the deficit. He also commented on property taxes and Treasurer properties. Mrs. Webster stated there would be a whole analysis on the 1 8th, H/R AND RISK MANAGEMENT 27.
