made a motion to approve the tentative budget for the Northern Nye County Hospital District; seconded by Commissioner Borasky; 5 yeas.

made a motion to ratify the final budget as it was May 29, 2015; seconded by Commissioner Carbone; 5 yeas. 3. For Possible Action Discussion and deliberation regarding the acceptance of the proposed tax rate for the Northern Nye County Hospital District to be voted on by the Tonopah Town Board, Tonopah Library District Board, Round Mountain Town Board, the Smoky Valley Library District and the Board of County Commissioners sifting as the governing body of the Towns of Manhattan and Gabbs, in accordance with NRS 361.455.

did a roll call of members present from each board.

Commissioner Carbone

made a motion to accept the hospital district tax rate of the $0.20; seconded by Commissioner Schinhofen. The Round Mountain Town Board passed the motion with 3 yeas. The Smoky Valley Library District Board passed the motion with 3 yeas. The Tonopah Town Board, voting also for the Tonopah Library District Board, passed the motion with 3 yeas. The Nye County Board of County Commissioners, voting for Nye County and the Towns of Manhattan and Gabbs, passed the motion with 5 yeas. James Eason, Tonopah Town Manager, advised his board asked him to submit a couple of items to the Clerk’s Office. The first was their agenda item regarding the enlarging of the Tonopah taxing district to overlap the Tonopah Library District, which was pulled from the County Commission agenda on Tuesday. Mr. Eason said the town was moving forward with that and it would be on their next board meeting. He also June 19, 2015 3. For Possible Action Discussion and deliberation regarding the acceptance of the proposed tax rate for the Northern Nye County Hospital District to be voted on by the Tonopah Town Board, Tonopah Library District Board, Round Mountain Town Board, the Smoky Valley Library District and the Board of County Commissioners sifting as the governing body of the Towns of Manhattan and Gabbs, in accordance with NRS 361 .455.-Cont’d. provided two CDs of the Tonopah Town Board meeting yesterday when it discussed reducing its $.020 from $0.60 to $0.40. Mr. Eason read the motion made by Duane Downing to accept the reduction in the operating tax levied for the Town of Tonopah from $0.6081 to $0.4082 for fiscal year 2015/2016 pursuant to the creation of the Northern Nye County Hospital Taxing District as authorized and established by the Nye County Board of County Commissioners contingent upon the approval of the Board of County Commissioners and all entities attending the meeting of June 19, 2015. If not approved through those channels the town would revert back to the tax rate of $0.6081. The motion was seconded by Tom Seeley and passed with a vote of 4-0-1. One town board member abstained because they were a former employee of the hospital. The members of the Tonopah Town Board, Smoky Valley Library District Board, and the Round Mountain Town Board were no longer present.

Commissioner Wichman

pointed out it had been the decision of this Board in the past to put a resolution in place stating the County said no to the BLM. However, in situations like this where it would affect mostly the Town of Tonopah the County needed to have a place at the table. She added that item 5.B.6. of the MOU stated “maintain the confidentiality of the documents and deliberations during the period prior to the public release by the BLM of any project related work products including but not limited to drafts, proprietary information, the plan of operations or plans of development, sensitive resource data and location, baseline reports and other EA related documents.”

Commissioner Wichman

believed by putting a statement at the end of that stating “within the bounds of the Open Meeting Law” the County would be fine, but she said everyone needed to understand these were proprietary in nature of the mining company.

Commissioner Schinhofen

made a motion to become a cooperating agency in the environmental impact statement process for the 3 Hills Mine Project and it is within the bounds of the Open Meeting Law of the State of Nevada; seconded by Commissioner Ca rbone.

Commissioner Carbone

asked if the County did not do this if the mine would not happen. June 19, 2015 6. For Possible Action Discussion and deliberation regarding an invitation from the Bureau of Land Management Tonopah Field Office to become a Cooperating Agency for the duration of the Environmental Impact Statement process for the 3 Hills Mine Project.-Cont’d.

Commissioner Wichman

said the mine would happen but the County would not have any say in how it happened. Tim Sutton corrected that the addition by Commissioner Wichman regarding the governing law was the Public Records Act, not the Open Meeting Law.

Commissioner Schinhofen

amended his motion to reflect that.

said she would leave it up to the District Attorney’s Office to make that clause tight. Joni Eastley, Assistant County Manager, explained the mine itself was located in Esmeralda County, but was so close to the Town of Tonopah as to be contiguous with some of its properties and most of the socioeconomic impacts would be felt in that community, not Goldfield. Therefore it was important to have a seat at the table as a cooperating agency to be aware of those impacts and plan accordingly.

Commissioner Carbone

asked who would represent the County on this team.

Commissioner Wichman

guessed it would be her but said any other Commissioner was more than welcome to represent the County with this MOU.

Mrs. Eastley

reminded Commissioner Wichman that she was the Board’s representative for the cooperating agency on the Gemfield project so she would also be available.
