pointed out there had been two hearings held on the fire, one in Beatty and one in Amargosa.

Commissioner Borasky

stated there may be a visit from one of the presidential campaigners in Pahrump in the middle of November, but he could not release any other information at this time. Richard Goldstein advised that Community Group 651 of the Boy Scouts would hold a food drive this Saturday at Smith’s from 8:00 a.m. to 3:00 p.m. to benefit the VFW veterans’ food bank. Also, on the Tuesday before Veteran’s Day they would put flags on the Veterans Memorial at the Chief Tecopa Cemetery and on November 14, 2015, they would do a flag retirement at the VFW. Mr. Goldstein said they had about 2,500 flags to retire and if anyone had one they could bring it there, drop it off at the town, or try to find him. Jon Pawlik, Chairman of the Nuclear Waste and Environmental Committee, thanked everyone who came out for the town clean-up prior to the fall festival. They would focus next on the town graffiti. Further, their Earth Day event would be April 23, 2016, at the Ian Deutch Park and Mr. Pawlik advised they would come to the town for some matching funds to put on the event. Danelle Shamrell, Human Resources Manager, pointed out next week was a short payroll window so they would send an e-mail later this week asking everyone to get their time in and approved by the end of the day on Friday so payroll could be done by the end of the day on Monday.

advised there would be some answers for Dwight Lilly in the next couple of weeks on the fire in Beaffy. He then directed a question to the District Attorney regarding appeals. He wondered what the next step was if the Board denied an appeal and the person did not go to court. Finally, he wondered if one of the other boards was looking at the light issue at the skate zone.

Commissioner Schinhofen

indicated that was on the Parks and Recreation Advisory Board agenda last time. He was not aware of what happened at that meeting but was sure they would report it.

Commissioner Borasky

advised he attended the meeting and asked them to continue it because the gentleman and his wife who were working on it were not there. He wanted to call them and make sure they were at the next meeting so hopefully there would be a report next time.

Commissioner Schinhofen

noted every state and federal agency helped in Beafty. They were looking to the State to give a full and complete accounting of what was there, but the testing done to date had not shown any radioactive material on the surface or in the air.

Commissioner Borasky

advised Pam Webster of more complaints about the debris on Savoy as a result of the lot clean-up. He asked if there was any potential funding to complete that project.

Mrs. Webster

advised she had a statement of work that would go out to get twa quotes to get itwrapped up.

Commissioner Borasky

asked about the joint meeting with the judges, the Sheriff’s Office, the District Attorney and the Board.

said she had not had a chance to set that up but would this week.

Commissioner Borasky

then warned everyone about the latest scam involving an e-mail stating the person must appear in court and directing them to “click here.” He said to not do that and if the District Attorney had a problem with that to let him know and he would retract his statement.

stated she wanted the “In God We Trust” sign in Tonopah taken down and made smaller so it could be placed in an arch like the one in Pahrump.

assumed the Chair of the Board of Highway Commissioners.

Commissioner Schinhofen

pointed out how well the retention basins had been doing at the raceway and wondered if a place could be identified on the fairgrounds to put a retention basin in along with a few other areas. He asked Mr. Fanning to bring back a cost and benefit analysis.

Mr. Fanning

explained the current plan that the Board accepted in 2009 did have a small retention basin on the fairgrounds, but it was all the way on the west side and would not do much until inner roads were built. He said there were a couple of other areas that could be turned into an additional basin.

commented that the families that lived on White Boulevard in Crystal would be grateful when Public Works got around to them.

Commissioner Carbone

advised there were conversations recently with BLM about using some gravel pits and allowing the County to go across their properties to open up some canals. That conversation would continue and hopefully BLM would see the benefits of that.

Commissioner Schinhofen

stated he was told that BLM had not received anything for Squaw Valley yet and asked Mr. Fanning to move that forward.

Mr. Fanning

explained they found some information that no one else found regarding patented property. The use of a right-of-way was recorded back in 1900 or the late 1 800s which they were trying to clarify. He apologized for the delay, but said this information was going to be extremely helpful and may change how the County did things with BLM in the future. Regarding the gas tax, Mr. Fanning stated January, 2016, would be the first time the County saw any of it because of the timing of the Board vote to increase it and the procedures that had to be followed. assumed the Chair of the Board of County Commissioners. SITTING AS THE GOVERNING BODY OF UNICORPORATED TOWNS OF BEATTY, BELMONT, GABBS, MANHATTAN, PAHRUMP, AND RAILROAD VALLEY PAHRUMP 9. For Possible Action Discussion and deliberation regarding a Memorandum of Understanding between the Town of Pahrump on behalf of the Pahrump Valley Fire Rescue Services (PVFRS) and the Board of Regents Nevada System of Higher Education on behalf of the College of Southern Nevada (CSN) for the purpose of CSN administering on behalf of PVFRS, written testing to determine qualifications of recruit candidates as they relate to requirements established by PVFRS. This item was removed from the agenda. 10. For Possible Action Discussion and deliberation regarding amending the Fireworks Safety Site Management Agreement to include: 1) Attachment A — Prod uct Testing; and 2) Attachment B Customer Demonstrations. Pam Webster said she had a small revision to Attachment B.

Mrs. Webster

explained the amendments to the agreement with the association were to enable additional days of use at the shooter site which would be for product testing to ensure the quality of the product purchased, which would be a private use by the members of the association. There would also be customer demonstration days which would be open to the public and supported by town staff, the fire department and the November 3, 2015 10. For Possible Action Discussion and deliberation regarding amending the Fireworks Safety Site Management Agreement to include: 1) Attachment A — Product Testing; and 2) Attachment B Customer Demonstrations.-Cont’d. Sheriffs Office. The change to Attachment B was just from the fact there were only five days. Each member of the association got one, so there was no need for a distribution, and in item 4 the actual members of the association would pay the fees, not the association itself.

expressed his concern with item 3 as this was seasonal in his mind. He did not know why it needed to go to 10:00 p.m. in the winter months as it was pitch black at 5:00 p.m. and would like it split for summer/spring and fall/winter.

. Casey Steinhart, representing the association, indicated they had no problem with the changes. One change he wanted to suggest was on Attachment A, item 1, to make it read that each licensed permit holder would be allowed three days for product testing, which may be at any time during the calendar year and on a first come/first served basis.

amended his motion to add each licensed permit holder as requested by Mr. Steinhart with 9:00 p.m. being the time to stop the fireworks shooting during the fafl and winter months along with the amendment from Mrs. Webster on Attachment B; seconded by Commissioner Schinhofen. Michael Sullivan, Finance Director for Pahrump, asked for section 4 to be amended to read “on or before the day of the event” to track with section 2 that the payment would be made ten working days prior to the customer demonstration so that when they made their reservation ten days beforehand they made the deposit also.

Mrs. Webster

explained the reason she did not connect the two was the payment may have to be done by phone rather than in person. She was also concerned with Mr. Steinhart’s requested change in that town staff was not going to keep track of who had used what days. It was not their responsibility and she did not want to get into bookkeeping of usage of the site between the association members.

Mr. Steinhart

indicated someone from the association could monitor that.

asked Michael Sullivan where he was at in the process of looking at the differences between private and public.

Mr. Sullivan

thought the process needed to involve Vance Payne and the fire chief as he could not make recommendations on those things and had asked through Pam Webster to have Mr. Payne be part of this team. From the financial standpoint, Mr. Sullivan stated the numbers spoke for themselves in the audit and conversion of ambulance service had a lot of public safety issues that were unrelated to the audit. He stated privatizing was a generic term and did not in his mind include response from 911. Additionally, the use of a private ambulance service for transportations was really a hospital-related issue, not a town issue.

Commissioner Carbone

asked again to have this pulled together and if Mr. Sullivan was not getting any help from anyone he wanted to know.

Commissioner Borasky

pointed out there were 16 other counties that faced the same problems and he had always been a strong advocate of contacting them to see if how they did it was better.

Commissioner Wichman

asked Mr. Sullivan to provide an update at the next meeting.

Commissioner Schinhofen

said adjustments to the fees on the Ruud Center had been made for non-profits, but the rental of the park had never been addressed. He though t it was a worthwhile event and the fees brought in were very small.

Commissioner Carbone

asked if the fees had ever been waived for other events. Michael Sullivan advised the town adopted a policy that staff was not able to waive any fees so it had to be done by the town board. To his knowledge all of those had paid their fees because they were operated by some other group, not the town. Paula Elefante stated they were a 501(c)3 and this was the seventeenth annual poow. Mr. Sullivan

said there was no waiver for non-profits. He noted they had faced this issue several times at the arena for non-profit groups and the Arena Board put them on a year’s notice that at the end of the year all non-profits would be required to pay the fee. Pam Webster stated she was also not aware of any waiver provisions, but she did not believe any of the other non-profits had requested relief. She thought this had been done in the past for this particular event so there was nothing that could prevent it from happening, but all of these events raised money and her only concern was the fees to use the park were to offset staff costs and those did not go away when the fees were waived.

made a motion to waive half the fee for this event.

Ms. Elefante

said the park guys did come out and move bleachers for them and some of the heavy cables. The powwow provided all their own trash bags and picked up the trash either by renting a dumpster or hauling it out. As far as profit, Ms. Elefante said they were lucky to end the event with $500.00.

seconded the motion to waive half the fee for this event.

was concerned that $250.00 would not cover the cost of the power used by the vendors.

Commissioner Cox

thought the County could donate a little back in order to attract attention and people and did not think much power was used in three days.

Ms. Elefante

said that depended on the weather and they had shut the vendors down by the time it was dark as people would not come out if it was cold and rainy. She indicated she could charge the vendors a power fee, but stated this was a gathering, not a profit making event.

was concerned about not giving the property owner an opportunity to come forward in a public hearing.

said this property was already two years delinquent on taxes and would go on the tax rolls in April, 2016. He asked if the County would be doing this to itself at some point in time.

said the complaint was made against the mobile home, but the whole property needed to be abated. She wondered if the Commissioners would address this strictly as a mobile home complaint or an all property complaint.

Ms. Ziotek

said the directive and the notice to the landowner by the District Attorney would be based upon the matter as it was set forth in the complaint. The point was compliance so the letter could be phrased as such based upon what was submitted in the complaint.

inquired about the monthly conversations. Amy Fanning, Comptroller, stated they had not had meetings yet, but they had corresponded via e-mail. She was also in communication with the auditor to learn the status of fiscal year 2015 to make sure the reconciliation process was being completed as she was told by the Treasurer it was.

For Possible Action Discussion and deliberation regarding a policy for posting documents on bulletin boards located in County buildings. Pam Webster explained there was a bulletin board in Pahrump that had gradually over time been taken over with public advertisements and notices so she took it down temporarily. She would like to put it back up but limit it to official use only.

asked if the County was stepping on anybody’s freedom of speech by not allowing them to post on the bulletin board since it was in a public building. Maria Ziotek recommended letting the District Attorney explore the First Amendment issues.

withdrew his motion to give the District Attorney time to look into the legality of this and said they should also cast an eye to people pulling up slanderous items. November 3, 2015 27. suggested bringing it back in a month. Sam Merlino stated her office was usually tasked with monitoring that board. Many times the public would put things up over the official documents and her office would like a nice set of rules. She suggested that maybe there could be a public board and an official board for the agendas.

Commissioner Borasky

withdrew his second. Anthony Greco said there was enough room for two boards. One could be marked for official use only and if something was posted by the general public it could be removed and thrown away. Dwight Lilly was concerned because the original testimony was that Pam Webster pulled the board down. He asked if it was true that Mr. Schinhofen was offended and claimed he was slandered and was involved in removing the board. He felt this was a violation of the First Amendment. JUSTICE(S) OF THE PEACE 24. For Possible Action Discussion and deliberation regarding a request for the administrative assessments and court facility fees continue to be retained for the ongoing and exclusive use of the Tonopah Justice Court.

made a motion to approve; seconded by Commissioner Schinhofen. Jennifer Kiapper, Tonopah Justice of the Peace, said her court was actively trying to be compliant with all County policies and financial policies as well as with NRS. In an effort to be sure that everything was streamlined and everyone was on the same page she felt it was important to recognize this issue as well.

asked why Point and Pay, which was used all over the County, was not being used here. Jennifer Kiapper explained Judge Maslach had contracted with this company several years ago and it had not come up for renewal. This was their first opportunity to realize it had not been approved by the District Attorney or the County in writing.

Commissioner Schinhofen

thought one of the valid issues was people with mobile trucks pulling up on private property, as well as other people stopping on private property, and the private property owner now having the liability for all of that. Whether November 3, 2015 29. For Possible Action Discussion, deliberation and direction to staff concerning the possibility of establishing a permanent Food Court location for Mobile Food Vendors within the Pahrump Regional Planning District.-Cont’d. a food court was the answer he did not know, but he thought staff was not looking to waste a lot of time on a project that this board had no interest in doing. He did not see a food court as a viable solution to the issues with the mobile food vendors.

mad a motion to not move forward with a food court; seconded by Commissioner Borasky.

Commissioner Borasky

said he could not see penalizing mom and pop operations for something like this. He did not know how many complaints there were about the mobile food venders, but he pointed out there were illegal used car lots all up and down Highway 160 sitting on the gravel which violated County codes.

Commissioner Wichman

added she also received a couple phone calls and heard complaints about private property, which could be resolved by calling the Sheriffs Office rather than changing the rules in the entire County.

Commissioner Carbone

thought this should be sent back to the RPC.

Commissioner Cox

was not sure where the complaints were coming from, but she did not think an ordinance was needed for this.

Commissioner Schinhofen

understood this was to help enhance the Beatty airport. This project was over $500,000.00 and the County’s share was $35,000.00, which was identified in the funds in the budget.

made a motion to submit a grant pre-application to the Federal Aviation Administration for design and construction of a taxiway turnaround for runway 34 at the Beatty airport and approve the contract with Atkins to provide design, bidding and construction management services for the taxiway turnaround for runway November 3, 2015 30. asked who used the airport and what it was designed for. Dave Fanning explained it was a small general aviation airport with the capacity to land up to 35,000 pounds of wheel weight. The airport was used a lot by the brothel in the area, the mining, tourists that went to Death Valley, local people and glider groups, totaling about 84 landings per month.

Commissioner Borasky

commented that this grant would be available again next year and with the County’s budget woes the $35,625.00 match may be better used somewhere else. He pointed out the number of flights a day were estimated and there was no way to define that.

Mr. Fanning

said this came to the Board in the new fiscal year and was a part of the five year AICP plan.

APROVED this ATTEST: Of , 2015. p C air Ny Cou1ty Clerk I Deputy 1 NYE COUNTY RESOLUTION NO. 2015-35 2 A RESOLUTION DIRECTING THE COUNTY ASSESSOR TO PREPARE A LIST OF THE 3 TAXPAYERS ON THE 2016-2017 SECURED TAX ASSESSMENT ROLL IN NYE COUNTY, NEVADA AND DIRECTING DISTRIBUTION OF THE SAME. 4 5 WHEREAS, pursuant to NRS 36 1.300 the County Assessor is required to prepare a list of 6 all property owners and the total value of property owned within the County prior to December 1st of the current fiscal year; and 8 WHEREAS, the list of property owners and the total value of the property owned by each 9 individual has been compiled for the tax year beginning July 1, 2016 to June 30, 2017; and 10 WHEREAS, Section 36 1.300(3) of the Nevada Revised Statutes requires notification on or before January 1st of the fiscal year to each taxpayer in the County of the total valuation of his 12 property; and 13 WHEREAS, Section 36 1.300(3) permits notification through publication in a newspaper 14 of general circulation in the County, or by delivering or mailing the appropriate notice to the 15 taxpayer, or by publishing on the internet website that is maintained by the county assessor, or if 16 the county assessor does not maintain an Internet website, on an internet website that is 17 18 maintained by the county. 19 NOW THEREFORE, BE if RESOLVED, that the Board of County Commissioners of 20 the County of Nye, State of Nevada, directs the County Assessor is hereby required to prepare 21 and to cause such list and valuations to be published once on or before January 1, 2016 on the 22 internet website that is maintained by the county assessor or, if the county assessor does not 23 maintain an Internet website, on an Internet website that is maintained by the county, the names 24 of all taxpayers on the secured roll within the County and the total valuation of property on 25 which they severally pay taxes for the tax year beginning July 1, 2016 to June 30, 2017 and to cause such list and valuations to be ResoLution 20 15-35 Tax Assessment Roll Distribution 1 1. Posted in a public area of the public libraries and branch libraries located in Nye County; 2 2. Posted at the office of the county assessor; and 3. Published on an Internet website that is maintained by the county assessor or, if the county assessor does not maintain an Internet website, on an Internet website that is 5 maintained by Nye County. 6 BE IT FURTHER RESOLVED, that the Board of County Commissioners directs the 7 County Assessor: 8 1. To make not fewer than 10 copies of such list and valuations available to the public free 10 of charge during normal business hours at the main administrative office of the county for 11 at least 60 days after the date on which the list and valuations are made available to the 12 public; and 13 2. To provide notice in a newspaper of general circulation in the county four times each 14 year which: 15 a. Indicates that the list and valuations have been made available to the public on the 16 internet website maintained by the county assessor or the county; 17 b. Provides the address of the internet website on which the list and valuations may 18 be accessed or retrieved; 19 c. Is displayed in the format used for advertisements and printed in at least 10-point 20 bold type for font; 21 22 d. Provides an explanation of how property tax rates are determined; 23 e. Provides an explanation of how property tax abatements are applied and how tax 24 relief may be obtained; 25 f. Provides information on how to file an appeal to the County Board of Equalization and the State Board of Equalization; g. Provides due dates for payments;2 Resolution 2015-35 Tax Assessment Roll Distribution 1 h. Provides an explanation of exemptions and how to apply for an exemption; and 2 i. Includes a statement of certification by the assessor that the roll is complete and accurate.
