about moving the County seat was removed within 24 hours of him putting it on the bulletin board. He posted it again, where it had remained, but now the bulletin board had been taken down. Mr. Alberti asked that his written comments along with his response to Commissioner Schinhofen be made part of the record today as an addendum to the Commissioners’ minutes. Wade Hinden thanked the Basin 162 Groundwater Management Advisory Committee members for everything they had done, but he thought it was time for new blood and that they should be dismissed to get some fresh ideas in there. Richard Goldstein, appearing on behalf of Boy Scout Troop 651, advised that on November 7, 2015, they held a food drive to benefit the VFW veterans’ food bank and collected over 1,500 pounds of food. Also, last week they held a flag retirement for the VFW and retired 2,500 flags. He thanked everyone who supported both events. Amy Nelson discussed the recent terror attack in Paris and reviewed the history of Muslim attacks across the world. She requested the Board ask the Governor to not allow any more Muslims in the State of Nevada. Dan Moral addressed some of the water issues, specifically the attacks on the salt cedars. He discussed an article written by Melissa L. Lamberton entitled “The Thirsty Tree: Confronting the Invasive Salt Cedar” which he thought the Commissioners should read.

was present. Victor Fuentas from Ash Meadows Camp asked the Commissioners to make an official visit to their camp to see the devastation caused by Fish and Wildlife through the diversion they did in 2010. Their property was flooded in 2010 due to that diversion and it happened again in October with the rain.

advised he and Commissioner Schinholen did go for the first flood and they walked a twelve inch wide plank over a raging rivet to look at it. He said he would be back out and asked Mr. Fuentas to leave his phone number. November 17, 2015

directed Amy Nelson to the State’s Web site for the Governor’s address and felt that her thoughts and feelings going to the Governor would be more effective than any organization. Regarding statements made about ideas brought forward from the community, there were 22 months of public meetings for that groundwater management planning group and 180 total ideas were memorialized through that whole process and would be reviewed. Additionally, Commissioner Wichman advised that Commissioner Schinhofen was representing the County in Louisiana today before the ECA.

said he would bring forward a copy of the process used in Clark County for cleaning up properties.

advised he had been working on and off with Commissioner Carbone on town hall meetings to discuss with well owners their opinions and concerns about what the Basin 162 Committee was working on. Commissioner Carbone was working on one at the Bob Ruud Center, but Commissioner Borasky said he would like to have at least two more and alternate them between day and night with at least one on a weekend. He then asked Pam Webster about the status of getting the lights repaired around the Eye.

explained Buildings and Grounds went out and tried to find the broken wire that was somehow cut when work was being done out there. They had not been able to find anything. They were trying to get an instrument that would measure the wiring underground and she would follow up on it.

asked when the animal ordinance would come back.

said it would be on the December 1, 2015, agenda.

asked if Mrs. Webster got a hold of the Sheriff on the brothel signs that were all over town. He had sent pictures to Mrs. Webster of at least three that were advertising for brothels one way or the other, which violated NRS and probably the liquor code.

said he received an e-mail this morning from the Department of the Interior talking about nine species that were already being impacted by climate change. His response back to them was when they were going to start thinking about humans instead of critters. He was kind of anxious to see what kind of response he got back on that. November 17, 2015 7. Ms. Zlotek

advised that since 1982 Nye County had received 40 grant awards totaling over $3 million. All projects had been completed except for two. One was awarded July 1, 2014, for RNDC single housing rehabilitation and that was expected to be completed by December 31, 2015. The other was awarded July 1, 2015, for the Gabbs swimming pool renovation project, which was currently being done and anticipated to be completed by December 30, 2016. Ms. Zlotek said Nye County encouraged input for any ideas for the upcoming program year as well as public input on past or potential projects and would offer assistance to anyone who would like to submit an application. Trevor Dolby, Amargosa Fire Chief, said he was delighted to find out they did not have to make their presentations today and was very happy there was $2 million available. Alice Lubbers, representing the Veterans Advisory Committee, suggested restroom facilities attached to the multi-purpose building at the cemetery as there were currently no restroom facilities.

said she should discuss that with Ms. Zlotek. Diane Southworth wondered what had happened with the airport. She thought that could be a national issue in case something ever happened to the Las Vegas airport. Small planes could land there and could also have been helpful during the big fire. It would also be good for tourism. Timaree Koscik, representing the Senior Nutrition and Transportation Program, said they had submitted a preliminary application to Ms. Zlotek to purchase two new vans for their long distance medical services out of Tonopah. With the hospital closing their clientele had increased and their drivers drove approximately 33,000 miles last quarter taking seniors and Medicaid clients to and from their doctor appointments out of town.

letter and my response, item by item. Schinhofen statement Tom Waters had open letter number 385 (or something like that) in the PV Times last week and decided that my facts were wrong. Why he didn’t mention that the board unanimously decided not to put moving the county seat on the ballot mystifies me. He only takes issue with my statements even when another commissioner repeated my statements. Wrong Fact Repeat an untruth often enough and it can remarkably become a trueism, but still not the truth. Can you say third largest aquifer in the country? Schinhofen statement As stated, there is an NRS that shows how to get this issue before the people and if these people who think moving the county seat is a panacea, then by all means get the petition up and bring it to the county commission. Before you sign it you may want to understand better what I did or did not say and why I think it is a bad idea. Dan is Wrong.. Fact Commissioners have the power to place a referendum on the ballot. There is plenty of time for the issue to be discussed, evaluated, financials presented and questions answered. Then a fully informed electorate will judge the issue. As it stands now, your Commissioners want you to believe they have done all of this. All they have done in public is tell us they know better and who the hell do we think we are anyway. Schinhofen statement Tom stated that population should determine where the county seat is and that usually state capitals are in the center of the state. Carson City is by no stretch of the imagination the middle of our state. While Tonopah, constantly being referred to as “north”, is actually better defined as in the center of the county. Above Tonopah is a lot of land mass and many towns, like Round Mountain, Sunnyside, Belmont, Gabbs, Smoky Valley (upper and lower) Railroad Valley and more. Dan is Wrong.. Fact The issue is financial first. There are two larger counties than Nye. They both have their center of government in the population centers. They do not travel anywhere for their regular meetings. The Counties of San Bernardino and Riverside meet in their main city. There are over 3,000 counties in the United States and you commissioners are so intellectually gifted above them that you believe the center of government should Page 1 of 6 be as far from the population as possible. Schinhofen statement Population he says should determine county seats and names a few examples. I grew up in Orange County and Anaheim is now more populated than Santa Ana, but Santa Ana remains the county seat. Dan is Wrong... again Fact I lived in Orange County and was active on their Republican Central Committee Assembly district 70. Orange County extends south all the way to Dana Point. Their Seat of government is in almost the northern most part of the County in Santa Ana which I might add has a very large population. Schinhofen statement The county seat should only be moved if it would save money or if the town hosting it were going under. lone and then Belmont quickly became ghost towns and so were replaced by Tonopah. Tonopah is not going under and in fact has a few new businesses to boast of. Fact So they are not in need of being the County seat. Did it ever occur to you that consolidating government and lowering costs that there just might be a benefit to all citizens of the County, including Tonopah? Schinhofen statement As for revenue and population: better than 50 percent of our revenue comes from “the north” while 80% of the population is down here. (And demand for services.) Dan is Wrong. .some more Fact The revenue he refers to is County revenue, not Tonopah revenue. In fact it is generated in Round Mountain which is in Round Mountain, County territory, not Tonopah. The County Comissioners decide how to best allocate this money for the benefit of the entire County. Dan and Lorinda Wichman would have you believe that because revenue is derived from a certain locale that the county should allocate all of that funding back to its source. It doesn’t work that way and if it did, the Round Mountain taxes would all go back to Round Mountain, Not Joni Eastley’s buds in Tonopah Schinhofen statement If we continue to make an issue of ‘North and South” it is very likely that the people in the upper portion of this county could petition to split the county. If that were to happen they could afford it and we couldn’t so what would the state most likely do? Well, creating another county would require a constitutional amendment and creating a bankrupt county would never happen so I hope you like Clark County because that is where we are most likely to be headed. (Be careful what you ask for.) Wrong again.. Fact This comment is a repeat of Joni Eastly’s comment when she was a Commissioner and the citizens pushed to disband the town board for acting outside of the citizens best interest. In fact this particular statement sounds very much like Ex Page 2 of 6

wrote it. Didn’t he just make a comment about north and south in his statement on revenue? Schinhofen statement Without showing any facts Tom and his friends think moving the county seat would save money. Wrong again..! Fact oh this is so wrong. .We do have facts but the commissioners did not want to heat or see them. All you have to do is watch the meeting on Granicus. Here is an example. Since the County seat is in Tonopah the law does not mandate that the County jail be located there. It has a capacity for 80 inmates. It has only 40 beds in an 80 person capacity jail and is there to serve a population of about 5,000 citizens. You are lucky if there are 20 of those citizens in that jail. In fact they used to shuttle prisoners from Pahrump to the Tonopah jail when we didn’t have enough space in Pahrump. With the new Pahrump jail this is not necessary. The last figure I have for operating the Tonopah jail was $1.2 million. Now they have decided to use the Tonopah jail as a holding facility and budgeted $400,000. Commissioners Schinhofen or Wichman should tell us how many prisoners are currently housed in the Tonopah jail as of August 01, 2015. In fact why not give out jail population figures for the past four years along with the operational costs including meals, Deputies, clerical staff, maintenance, inmatemedical, etc. That would be so interesting!Here is the actual law... NRS 211.010 County to maintain county jail; location; agreements for detention of prisoners. 1. Except as otherwise provided in subsection 2, at least one county jail must be built or provided in each county, and maintained in good repair at the expense of the county. The county jail required by this section is not required to be located in conjunction with the office of the sheriff that is maintained at the county seat if the board of county commissioners determines that a different location in the county would better serve the needs of the county. Upon such a determination, the county jail may be located at any place in the county. 2. The board of county commissioners of a county, with the concurrence of the sheriff, may enter into an agreement with any other county or city in this State, in accordance with the provisions of NRS 277.080 to 277.180, inclusive, for the construction, operation or maintenance of a jail or the detention of the prisoners of the county... Schinhofen statement How would it do that since we have already cut staffing levels up there to the bare minimum and moved the finance department down here to Pahrump? Even the jail has been cut down to a holding facility. Services would still need to be provided for the people north of Tonopah and so I see no savings there. Wrong some more... Fact Like the proverbial Ostrich Dan has his head buried in the sand so he doesn’t have to look at the facts. Again watch Granicus. He and Lorinda along with the entire board have not given any opportunity for deliberation on this subject. They just told us flat out that only they know the truth and we should trust them. Commissioners you should read the Nevada law known as the NRS, short for Nevada Revised Statutes. Page 3 of 6 The purpose in governing is very specific in its definitions. To do the peoples business and at your public meetings to deliberate and discuss before you decide. At the meeting when we presented our proposal there was no deliberation on any issues to move the County seat. Maybe it’s just this “us and them” thing or the prIde of saying, T live in the county seat” that appeals to them. It doesn’t take much imagination to see that if this did become the county seat the “incorporation” crowd would be back telling us we need to be a city. (No wonder Tom supports it.) Wrong again.. This is so absurd it shouts of desperation. Schinhofen statement Finally, Tom praises a commissioner for not going to the Tonopah meetings and in the same breath tells you all that the commissioners are “county” positions and once again tries to make his point that Pahrump has no local representation. Wrong.. Fact The Commissioner should know better. As I heard it with both of my own good ears. The original reason for not going to Tonopah for meetings was for security, safety and self preservation, It’s a long stretch of unlit deserted road for anyone, especially a woman alone, to be placed in jeopardy at night on that highway. Schinhofen statement First, four of the five of us live in Pahrump, so we are local. Second, driving to Tonopah once a month to check on issues that, as “county” commissioners, we should be aware of is not a waste of money it’s part of our job. Wrong Fact The reason there is a Commissioner for each district is for representation. Lorinda Wichman as the Commissioner for District 5 can easily present issues for her district to the other four Commissioners for consideration. It is unnecessary for four other Commissioners to joy tide to Tonopah monthly so they would understand the needs in District five. Those trips are not free, the taxpayers are paying for it. Many feel that unpopular decisions affecting Pahrump are made away from the main population there. Schinhofen statement I often meet with voters up there and check into items of concern like the slime wash, (which is now being worked on) sidewalk fixes and animal shelter issues, just to name a few. The “savings” by not traveling is overshadowed by the inattention to those citizens not living in Pahrump and the inconvenience of not all being in the same room while we deliberate the issues. (How many times have we had internet issues and delays because we choose not to all be in one place.) If the “northern” commissioner didn’t show up in Pahrump but once a year I am sure this same group would not be praising her for saving money, but rather excoriating her because she didn’t care about the south. Wrong again Page 4 of 6 WOW! Did he just admit that he goes in to another commissioners district of responsibility to meet with citizens alone? Isn’t Commissioner Wichman able to do this? I’m sure she is quite able to meet with her constituents or are you suggesting another reason they need to talk meet with you? Schinhofen statement (The other reason to travel to Tonopah once a month? ft is where the meeting is being held by NRS.) Correct Dan. .This is exactly the point. Four Commissioners traveling atong with staff such as County manager, District Attorney, Public works etc is also additional cost versus one Commissioner, Lorinda Wichman, traveling to Pahrump, which she does anyway. When I say cost, t mean taxes, the taxpayers money, not yours. The NRS needs to be revised to place the location of the County seat at the population center, Pahrump. Schinhofen statement His argument about not having to have the second meeting of the month in Tonopah if we moved the county seat really took a lot of space up. We have, in the past, held our second meeting in Beatty, Amargosa and other places. When we did, people in Pahrump were mad because we didn’t hold them here. We could hold the second meeting in any other town if we moved the county seat to Pahrump, but with Tonopah centrally located, why would we choose Sunnyside or Gabbs for the second meeting? (No disrespect intended to those towns )There is only one mandated location for county meetings. The County seat. . . Schinhofen statement So while Tom says that I was being “footloose and fancy-free” with my facts, I am still waiting for any facts that would make me want to move the county seal The fact that still does not seem to make it through to Tom is that while we may not be called a “town board” we are the governing board for the town of Pahrump as the people voted for and the town did not go away, as Tom asserted more than once that it would. Arguably, it is now running better and saving money. Right.. Remember Joni Eastley warning we will not be happy if the County takes charge of the town? Things ate running better in Pahrump now, or so he says. Who woulda thunk it. Schinhofen statement (I think I hear open letter 386 being written.) Right once more. .Yes you do and this may be it. Finally, finally, we have maintained this huge land mass of a county for mote than 150 years without having to split it up because of its size. With the computer age now in full swing I think it would be a big mistake to throw up our hands now and declare our county is too large to handle. If they could make it work in the last two centuries then why in the world, with all the advantages we have now, can’t we?

. .We are the only County in the entire United States operating in this fashion. Either they all have ft wrong or you do. I’ll close with a comment made by Commissioner Schinhofen at a meeting of the Republican Party here in Pahrump. He got up in front of the assemblage and urged them to stop speaking bad about things that go on in Nye county. It makes us look bad. At that point I rose up and informed him that if the County would stop doing those bad things we would stop talking about them.
