Yvonne Smith, a 4-H leader for twelve years, felt the Extension and 4-H were important to the community and should be kept open. Patricia Scharf begged the Board to continue to fund the 4-H program as it helped the children grow into adults and leaders in the community.

Commissioner Wichman

assumed the comments on 4-H were due to the Cooperative Extension funding the County had chosen not to participate in as the Cooperative Extension had a duty to rural America. She explained that several years ago the County had a robust 4-H program in Tonopah, but over the last couple of years that had diminished to the point that the only activity through the Cooperative Extension was in Pahrump, which was ignoring 17,933 square miles of Nye County. Commissioner Wichman advised she had two conversations with the chancellor in the last month and had also communicated with Eric Killian. She was encouraged by those conversations, but she was not yet willing to ask her colleagues to change their minds until she saw the proof.

Commissioner Cox

announced there would be another water and well owners meeting at the Bob Ruud Community Center on January 9, 2016, from 10:00 a.m. to 12:00 p.m. Comm issioner Borasky commented there was a good town hall water meeting a while back. He thought there was lot of good input and was glad they were being put on.

Commissioner Wichman

advised she would not be available January 11 and 12, 2016. On February 18, 2016, she would attend the conference in Washington D.C. for the legislative session and would be back on February 25, 2016.

Commissioner Schinhofen

said in the next month or two there should be an agenda item to look at some of the medical marijuana rules that needed to be put in place for disposal. Additionally, he may be at an Energy Community Alliance conference the second week of February and would confirm that at the next meeting.

Commissioner Borasky

said he would be working on a resolution to the State telling them enough was enough with the things that they sent down to the County to pay for and administer.

Commissioner Cox

stated the letter to Fish and Wildlife for the Fuentas lawsuit and flooding was ready and would be sent within a very short time. TIMED ITEMS

Commissioner Wichman

said she had been working with the County Manager, the District Attorney and Larry Trilops on this agreement. The District Attorney had gotten some notes back to her which Mr. Trilops had not had a chance to review, although there were no glaring differences in her opinion. Commissioner Wichman said she would have staff provide him with a copy of it.

Commissioner Wichman

made a motion to pursue it and get it signed because all of the substantial information needed in an agreement was there and doable and no one was complaining about the removal of words.

Commissioner Wichman

discussed section 2.1.2 which said on or before March 1. She did not mind leaving that in there if it came back sooner, but if it put everything off until March she would like to put in to provide the services as soon as possible.

Mr. Trilops

stated the plan was before March 1 and their team members were there today installing telemedicine equipment. On the primary care provider front, Mr. Trilops indicated they still did not have a primary care provider and the plan was to possibly accelerate urgent care services, but they were pushing ahead and he thought they had to keep things moving for things to happen.

Commissioner Schinhofen

seconded the motion to pursue it and get it signed with the amendment to commence services no later than March 1. Angela Bello stated she made quite a few changes to the contract and forwarded them to Renown’s counsel who was on vacation.

Commissioner Wichman

thought the word “designated” could be removed from the first Whereas clause.

Commissioner Carbone

asked the District Attorney if the Board should go forward with this the way it was written with the modifications talked about or if she wanted to hold this until a little later in the agenda.

Ms. Bello

thought there would be a couple more changes done before it was finalized, but she understood the urgency and suggested a special meeting to just approve the final version.

pointed out the motion on the floor was to pass it in concept as everything was wordsmithing. January 5, 2016 22. For Possible Action Discussion and deliberation regarding a Professional Service Agreement between the Northern Nye County Hospital District and Renown Medical Group to provide professional primary and urgent care services.-Cont’d.

felt one of the things they may get stuck on was maintenance of the building and she needed to get that clarified with their counsel.

withdrew her motion; Commissioner Schinhofen withdrew his second.

Commissioner Wichman

made a motion to pursue this between the District Attorney and Renown’s counsel and get all the language worked out as soon as possible and call a special meeting for final approval; seconded by Commissioner Schinhofen. Dwight Lilly was concerned that the agreement did not reflect how the money from the hospital district would cover Renown’s deficits as well as repay the note the County took out with the previous operator. There were also no provisions in the agreement to address the $3 million owed to the County. Mr. Lilly wondered if there was any liability going forward with the bankruptcy that took place and did not see anything that absolved the County of any legal responsibility. If the hospital district could not pay the loan back and did not have enough funds to covet Renown’s deficits, then Nye County would be on the hook for any of the excess expenses.

Commissioner Wichman

explained the resolution that created the Northern Nye County Hospital District stated that the provisions of NRS 450.550 to and including 450.760 relating to the county hospital districts were adopted. Although Mr. Lilly had brought up over and over again that this hospital district was created simply to pay back money,

stated it was not created for that. The purpose of the district was to operate a hospital district that would provide for medical services in an underserved area. As far as concerns about the money coming back, Commissioner Wichman asked Mr. Lilly to please stay up to the date with what was happening with the loan as it was no longer $3 million. By the County receipting the equipment the debt had been reduced by $727,000.00. Additionally, Commissioner Wichman reminded everyone that this was an agreement between Renown and the hospital district that had nothing to do with the bankruptcies or the interworkings of the hospital.

Commissioner Cox

said she understood Mr. Lilly’s concerns as she was also concerned about how it would be paid back, but this was totally between Renown and the hospital district. She noted that she had not received a copy of the contract with the District Attorney’s proposed changes and had a few minor corrections she would like made January 5, 2016 22. noted it was not in the guidelines to provide funding for chaperones. Teresa Sullivan said she understood that but hoped it would be considered as well. Steven Sullivan, a math teacher at Beatty High School and a former graduate, said the Commissioners funded his participation in the Close Up Program. They were memories and experiences he still cherished today and he wanted to keep the 30 year tradition alive as those were experiences the kids would never get on their own.

said the County had been hit with a lot of issues regarding funding and right now the accounts used to fund this were empty. Joni Eastley said she checked with Mrs. Webster before the meeting and there was zero funding available for this.

Commissioner Wichman

noted that Erika Gerling’s son has set up a GoFundMe account that she helped with, but she did not remember seeing anyone else and suggested the other children follow suit. said they would absolutely accept donations and noted that they had raised $11,000.00 on their own.

suggested asking the waste disposal facility to see if they would help them with a local Beatty project.

said they had and had also done several fundraisers on their own. They were at the point now where they needed outside help.

Commissioner Schinhofen

said there were a lot of new businesses in the south part of the County that he would approach this week, If they were still short $1,000.00 or $2,000.00 he would like the opportunity to bring it back.

advised the full amount had to be paid by February 11, 2016.

opened the public hearing and noted that this was not eliminating the services as the services were being provided by the Veterans Administration.

opened the public hearing. January 5, 2016 14. 1 0:45 For Possible Action Public hearing, discussion and deliberation to: — — 1) adopt, amend and adopt, or reject Nye County Bill No. 2015-17-Cont’d. Robert Adams suggested considering making some use of it at this point, especially with the upcoming release of the final draft of the RMP revision for southern Nye County as well as the Battle Mountain plan. He thought with staff cuts this could be advantageous. Mr. Adams suggested postponing this while figuring it all out.

asked if part of this was for lack of participation.

Commissioner Wichman

said yes. Joni Eastley said this was her agenda item. She explained she had been attempting to clean up the ordinances and the Public Lands Advisory Committee to her knowledge had not existed for many years. Additionally, many functions of this commission had been taken over by the tn-county group that Commissioner Wichman was a member of.

Commissioner Wichman

stated the tn-county group met on a regular basis and represented Lincoln, Nye and White Pine Counties with participation from Eureka and Lander Counties. She agreed with Mr. Adams, but pointed out that the County has had to go outside of Nye County to get the help needed.

Mr. Adams

commented that the reason for non-involvement was nobody knew about it.

Mrs. Eastley

said this Public Lands Advisory Commission was born during the Dick Carver days of the sage brush rebellion. There was an interest in the group at that time, but the necessity and need for it kind of went away after the tn-party agreement that came from the federal court.

Commissioner Wichman

added the tn-party FIA met quarterly by court order in Tonopah. That was not an open public meeting, but the participants were herself and representatives from the BLM and the Forest Service.

made a motion to approve; seconded by Commissioner Wichman. Deborah Beatty, Recorder, said she hoped to get a start date of February 10, 2016. She explained her employee took her leave on November 3, 2015, and her accruals were complete by November 6, 2015. The employee did not give her resignation until December 1, 2015. Ms. Beatty said she had three and a half weeks to open the position now with a start date of February 10, 2016, and the cost savings would be the same. Danelle Shamrell, Human Resources Manager, added the employee was in a no pay status for a little over three weeks.

stated she realized that and would modify staff and her budget.

said everyone had been asked to justify their requests for additional folks, but the Sheriff’s justification for several of these items was the same, that no one could cover what they were doing. If no one else could absorb those duties

wondered who had been doing it since June.

said they were using a lot of overtime.

advised that should be in the justification.

explained that everything they asked for was due to people who left or had been promoted into positions of people who had left. They were not asking for anybody new. Up to this point they had been using up overtime to fill in those positions and they could not continue to do that.

was concerned that everyone had to wait for accruals and he did not know why someone needed to be promoted into the sergeant positions right January 5, 2016 38. Dave Fanning, Public Works Director, updated the Board on the Calvada street lighting. They went out a week ago and did some locating. They found a broken or hit line and would meet with some electrical contractors next week to ascertain a price to fix the problem. Within the next couple of weeks it would be back on.

asked them to also check the street light out in the last parking lot right off of Calvada.

said they had a meeting with Buildings and Grounds last week and they would come in and look at that light. Regarding the power from the first island by the fountain, Commissioner Schinhofen said if it was more expensive to go across the road maybe powering it from that box could be looked at.

advised NDOT was trying to do the gap project from the fountain to Homestead and beyond. They were working with Valley Electric to try to light up a new crosswalk that would go across Highway 160 to help pedestrians. January 5, 2016 19. asked when they would start Homestead Road.

advised they were working through the right-of-way on the southeast corner of Gamebird and Homestead. They were reviewing the analysis for buyout and getting something ready for the Board if they wanted to buy out the property or take it.

said they were also still working out the drainage area from Homestead down to Manse and would be on the ground staking within a month and a half.

Commissioner Borasky

asked if the water flow would come off of Gamebird and down Homestead on the east side. Mt. Fanning stated no. He was talking about everything that came over Homestead as it did today, which dealt with all the flows coming out of the west. The drainage would take into consideration the flow that Commissioner Borasky was talking about.

Commissioner Wichman

said she passed on some information from NDOT since the federal highway funding was approved. Also, she saw an e-mail from Wendy Seeley on the Manhattan project.

Mr. Fanning

advised that BLM had not seen one stitch of what was promised to move the Manhattan project forward.

noted the back-up mentioned a reduction. Vance Payne explained that under the terms of this particular grant it normally required a 10% match. They had successfully in the past requested reduction using census information and had been able to reduce it to 5%. Additionally, because of the broad spectrum of people this would cover, including the Sheriffs Department, the Sheriff had committed to half of that.

said under the section called development standards it was not cleat if it pertained to the entire County or just Basin 230 and Basin 162. Darrell Lacy, Planning Director, stated 16.20 applied to the rest of the County. They were just trying to clarify what applied Countywide and what applied to just Basin 230.

reiterated there was nothing specific in the development standards.

advised he had been in discussions with folks in Amargosa. He thought he understood their concerns and had a change that should make them happy.

thought Mike had done a great job with this. He was thought of well in the industry and had produced a product well received in dispensaries in Las January 5, 2016 45. Commissioner Schinhofen noted Nye County’s dispensary received final approval from the State yesterday.

wanted to know how many full-time employees there were versus part-time and said he would be asking this question of each of the marijuana people.

said the last he heard there were 25 employees at this facility, but he did not know the breakdown of full- and part-time.

thanked her colleagues for putting up with her as Chairman as she enjoyed it.

said he would send his request for liaison positions to the Chairman.

stated at the next meeting he would request all those positions. Sam Merlino advised her Pahrump office would have limited access on Friday due to new carpeting being installed and if people could avoid the office that would be great. 49. ADJOURN
