said before he was a Commissioner he was a member of PBICA, a contractors organization that got a little uptight with the way the County was changing rules and regulations. He advised the organization was going to reform and come in front of the Board to vent their frustration on things like the four day work week.

said she would have an item at the next meeting to ask the Board to approve a letter to the naval air station out of Fallen as well as Nellis concerning the expansions that would allow the County to have comments on the record before the deadline date. assumed the Chair of the Board of Highway Commissioners. If. For Possible Action General road report by Public Works Director Tim Carlo, Public Works Director, said crews were pothole patching last week and pumping water as the Gamebird/Barney job was flooded out. Stretch Baker also had crews out in northern Nye as the rains flooded it out over the weekend.

said she was looking forward to seeing Mr. Carlo in Manhattan for the final inspection on the road.

Commissioner Schinhofen

commented the Manhattan road was very nice now. He asked Mr. Carlo to pass on to his guys they do a great job as he could have taken any vehicle over the miles of dirt roads maintained up north.

Commissioner Carbone

thanked the crews doing pothole repairs and said he would talk to Mr. Carlo off line about some other areas. John Bosta said this morning he came over Bell Vista Road and noticed the only piece of equipment Left was a tractor with a drill. He wanted to know when the speed limit would be put back up and if it could be increased to 60 mph.

Mr. Carlo

advised it would go back to 55 mph and the work zone would be removed today, but he was hesitant to go above 55 mph because of the curves and the low shoulders.

asked if Mr. Carlo was planning to do paving to the transfer station in Belmont.

Pam Webster said the Board had the two packages discussed at the last meeting to be requested by the County, one for the blighted property renovation and one lot a hangar at the Beaffy airport for economic development opportunities there. She advised the County had already been contacted for potential drone activity at that airport and a hangar would be a huge asset to promote and entice that kind of activity there. There were also a couple of projects being requested by the public. Regarding the Beaffy airport, Commissioner Borasky said he was never given a clear picture of how many planes landed there on a regular basis, but the amount of money that had gone into that airport over the years was phenomenal. It was a little too much to encourage him to ask to put any more money into it.

Commissioner Schinhofen

said ‘he was all for the performing arts center, but not purchasing additional property to put it on. Tim Carlo said they were looking at up to a 10,000 square foot hangar. There had been interest in Beatty from NIAS partnered with COED looking at large drone activity, and helicopter companies had called asking for hangar space or if they could house helicopters there so they could do tours of Death Valley National Park. Additionally, as recently as six months ago a movie studio called to use a hanger to house airplanes.

pointed out all work at the Beaffy airport had been FAA funded through the ACIPs.

asked if this grant would allow the County to build a hangar and possibly rent out that space.

Mr. Carlo

said if someone did not need the full 10,000 square feet it could house several airplanes.

Mrs. Webster

added there were approximately 84 operations a month at the Beafty airport.

Commissioner Wichman

noted it was part of the emergency services for the entire country as the airports were on the maps as emergency landing spots for any plane that got in trouble. Trevor Dolby from the Amargosa Town Board advised that about 2:00 a.m. this morning he dropped an application in Savannah’s basket, so it was probably not in the back-up. The project was a satellite fire station and was justified by recent hazmat incidences and the town not having a hazmat equipped truck. A barn was the first step to put a hazmat truck in, maybe even a two bay barn so they could have another water truck. The station location was six miles from U.S. 95 and six miles from the hazmat spill that happened two or three years ago. Mr. Dolby said they were asking for $160,000.00.

asked if Station 51 responded to the spills.

Mr. Dolby

said Amargosa responded, Pahrump Valley Fire/Rescue responded to one or two of them, and Station 51 responded, but it was kind of a hodgepodge of who showed up. Loretta Lindell from the Pahrump Arts Council reviewed their CDBG project for a Center for the Arts. The vision was that with a Center for the Arts along with the Pahrump Community Library the area would become an arts district for Pahrump, encouraging further economic development in the area and providing an additional destination for tourists. She added they were bringing $50,000.00 to the table.

Commissioner Carbone

said he could really go for that if it was on County property.

Mrs. Webster

thought that was an’ amazing application for economic development and that it was important for the County to have something of this nature. She mentioned the Valley Electric transmission line sale and possibly having a $5 million donation to an events center. They had talked about selecting a committee of stakeholders in the community to sit down and talk about the best application of that $5 million and coupling and leveraging it with grants. Mrs. Webster would love to see this effort combined with something along that line if appropriate and potentially use the land they had identified to be made available on Highway 372 next to Valley Electric, which was land they would donate to this project.

Ms. Lindell

advised this was an existing building which was occupiable and they could start on this quickly because they had $50,000.00 in a building fund dedicated to that. Their thought was also that the Pahrump Community Library was an anchor in the community and they could build around that.

noted that most of the property around the library was dedicated for the cemetery. was not adverse to the property next to Highway 372, but he did not think the road would be that good.

Mrs. Webster

asked if a traffic study had been done at that location.

Ms. Lindell

said no because of the roundabout going in there, which would make it difficult to assess, but it was a very wide road.

Commissioner Cox

thought an arts council was a great idea. She asked about the blighted area around the Eye and if it would be able to part of this issue.

Mrs. Webster

said one of the things suggested was looking at labor studies throughout Pahrump to find neighborhoods that might be low to moderate income because the town was not. If an area with several blighted properties was found that might be the focus of an LMI project.

Commissioner Cox

fully supported the blighted area idea, but wondered if those would become County properties.

Mrs. Webster

said her plan would be to head straight for the Treasurer’s trust rolls and find properties for immediate sale as that would be the quickest return on the grant. She wanted to be able to treat the grant as seed money and continually fund it.

Commissioner Cox

also agreed on the VEA issue. She knew a lot of people voted yes because they wanted to have a community center and she asked the community to put pressure on them if this passed. She had a concern about parking and noted the property near the library was only about a half acre and there was not a lot of room for expansion. Commissioner Cox said she supported the arts council and would like to see the finishing of the County’s one stop shop second.

Mrs. Webster

stated she did not know how to promote the economic development aspect of it, but she had a plan to get that one stop shop established. She reminded the Commissioners that they really needed to choose a project that progress could be shown on in a year.

said her first priority would be the airport in Beaffy and then

said she would like to see an overall plan and how to utilize and leverage other grant sources, but she would not be able to get it in this grant cycle. There might be another opportunity to apply in March or April.

Commissioner Borasky

asked if there was some reason the County’s communication problem was not thrown into the mix to try to rectify the problems between Pahrump and Tonopah.

Mrs. Webster

advised that was a unique problem to the County’s communications, but it was not an economic development opportunity. She also confirmed for Commissioner Borasky that the Coalition did not come forward.

Commissioner Cox

asked if the Beatty airport could be held and voted on mid-year.

Mrs. Webster

said sure. She then advised there was some confusion interpreting the e mail from GOED on this. She asked the Commissioners to rank the four before them and staff would determine today if the County could submit more than two and then get as many of the executive summaries done as possible.

made a motion to put forward the blighted properties, the Beatty Airport, the performing arts center, and a hazmat substation for Amargosa, with the understanding that if the County only had two staff would work with the Pahrump Arts Council to get everything ready to try to set it here or at the VEA for the next round; seconded by Commissioner Wichman; 5 yeas.

opened the public hearing. Dwight Lilly thought the amount of liability insurance should be increased because there was a recent balloon festival where balloons caught on fire and people lost their lives. He suggested a rider up to $5 million. Pam Webster thought the insurance was just to cover the County property, not their liability, but she was confirming that.

thought if a catastrophe like that happened $5 million would not cover it. His only concern was that they did not charge the public to park.

made a motion to approve the outdoor festival permit providing they were not charging the public to park; seconded by Commissioner Wich man.

Mrs. Webster

advised the insurance requirements were to cover County property to ensure against any damage they might cause and the County did not restrict or limit what they had to have for their personal liability.

opened the public hearing. Judge Kim Wanker advised she had spoken with Judge Lane and their concern was that Category II peace officers not be included since by statute they were under the direction of the district court as were the bailiffs. She added they were not given a copy of this even though it concerned the folks that fell under their authority.

Commissioner Carbone

closed the public hearing. On page 4 under 2.84.050.a, it stated citizen complaints against a peace officer shall be submitted to the County Manager or department head. Commissioner Schinhofen thought department head needed to be taken out and it all should go through the County Manager. He also thought the flow of this could be ponderous and wanted that changed. In addressing the judges’ concern, Commissioner Schinhofen asked if the bailiffs were included. Pam Webster advised there were justice court and district court bailiffs. November 1, 2016 10. 10:45 For Possible Action Continued Public Hearing, discussion, and - — deliberation to: 1) Adopt, amend and adopt, or reject Nye County Bill No. 2016-1 0- Cont’d. Angela Bello added as it was written all peace officers were encompassed. Judge Wanker stated the problem was that the Justices of the Peace had bailiffs that belonged to a union, but the district court bailiffs did not. Several employees of the district court were lumped into the ordinance and that was a separation of powers issue between the judicial and executive branches.

said the Board could exclude whoever it wanted, but the question was whether the Board could include them.

made a motion to approve, striking “or the department head” on page 4 under 2.84.050 and to exclude district court bailiffs and juvenile probation; seconded by Commissioner Carbone.

stated one of the things the Sheriff presented to the Commissioners in the beginning when she was restructuring this was she was going to make it less top heavy and put more feet on the ground. Commissioner Wichman believed this was loading the top again and she did not see the justification in it. Pam Webster explained this was not adding a new administrative position but diverting one to another.

Commissioner Schinhofen

saw it as filling a supervising Sheriff administrator, which he thought was part of Commissioner Wichman’s concern. Danelle Shamrell believed there was a sergeant working in the front office, so the intent would be for the administrative support that the sergeant was providing to the Sheriff to be diverted to this position. She advised the NCEA and the County had not agreed on November 1, 2016 24. For Possible Action Discussion and deliberation to fill a vacant Admin Tech I Grant Administrator Position #15006-001 in the Sheriffs Office with a new position Supervising Sheriff Administrator position #16005-001 effective November 17, 2016 due to an employee retiring August 12, 2016.-Cont’d. the grade to be attached to this based on the duties. It was anticipated to be a 16, but that was not locked in yet and if it was higher the budget savings would be reduced.

made a motion to fill the admin tech grant/administrator position.

Mrs. Webster

noted there was a grants administrator position in Finance. She explained one of the issues was moving these grants over to be managed there, which was the Sheriff’s intention, so this position could be put in to supervise the administrative staff in place and the grants administration would be put back where it would be good to have it.

Commissioner Schinhofen

said what was confusing him was the supervising Sheriff’s administrator.

Mrs. Webster

said that just meant it was in the Sheriff’s Department. With that clarification, Commissioner Schinhofen made a motion to approve as written; seconded by Commissioner Carbone. Dave Stephens commented the Sheriff should be here to decide some of this stuff.
