Commissioner Wichman

reported on the recent Board of Directors meeting for NACO where the Silver Flume business portal was discussed. It might be worth checking out because it could be beneficial to the counties. She discussed NDEP’s presentation on small public water systems and how they can assist small struggling systems with safe drinking water standards. She stated as far as the Governor’s task force for the regulation and taxation of marijuana, Dagny Stapleton had been appointed as the co chair for the working group and it would be very helpful. She also mentioned SB 245 the Treasurers technology bill along with AB 207 a bill making changes to the jury lists. It needed to be watched closely because it is expected to have quite an impact on the counties. She stated SB 8 would move them more closely with Clark County regarding pre-sentence investigation reports. She mentioned AB 43, AB 218 regarding an electronic means to publish required public notices and AB 366 creating a regional mental health policy board which has Nye County as part of Clark and Lincoln. SB 345 would allow counties more input on granting of more partial tax abatements for economic development. SB 5 was creating an advisory board to approve allocations of private activity bond caps to the Nevada Department of Business and Industry. There were additional bills including one that would allow counties to impose an additional 5% tax on diesel. One amendment was to tie it to population. She would keep them updated as things move forward.

spoke on the diesel tax. They don’t get a cut of diesel at this point.

Mrs. Webster

asked if there was an update on the bill to increase the fees on cell phone tax for the 911 System. Commissioner Wichman stated there was quite a bit of conversation that took place on this bill and it was for body cameras. She heard it was going to pass but didn’t know if it would be amended. Many people are still confused how the 911 funding will work. It should pay for retrieval and storage. Sam Merlino, Nye County Clerk, mentioned that there were 20 some odd election bills that could have a fiscal impact on the county if passed.

stated he is on the outdoor cultivation working group. He was in Carson last week for CNRWA and they discussed quite a few of the important bills they are supporting. April 4, 2017 5. stated she received notification from the Department of Taxation that must be recorded into the minutes by announcing the medium-term financing not to exceed $200,000 on the airport FBQ through the revolving loan fund was approved and it was approved affective March 1 Qth SITTING AS THE BOARD OF COUNTY COMMISSIONERS CONSENT AGENDA ITEMS These are items that Staff recommends for approval. The Board reserves the right to move any consent agenda item to the regular segment of the agenda should issues arise that need to be addressed. stated on Bell Vista there were some big chuck holes and they were getting bigger by the minute. Mr. Christensen stated some of the roads were deteriorating mote daily. stated as far as Homestead, they were still just waiting for the final from the engineer hydrologist on Homestead. Manse to Gambird has been approved and the RTC has approved the Pahrump Valley one so there are a couple that eventually they will not have to keep filling the potholes.

stated next week they would get more material from Wulfenstein to do some overlaying so maybe it will hold up longer.

Commissioner Wichman

asked Mr. Christensen to make a note for Tim Carlo to include the progress on the Belmont Road on the road report in the future. There is almost one entire pothole for 19 miles.

stated they were doing a great job. He wished they would take a look at Harris Farm road and fill the cracks. They were getting worse.

stated Mr. Carlo asked him to look at some of the roads and come up with a plan to present to the RTC. PUBLIC WORKS

made a motion to award the contract to A & K Earth Movers contingent upon FAA approval, authorize the County Manager to submit the grant application to the FAA to obtain funding for the project, and authorize the County manager to execute the grant offer when it is received from the FAA; seconded by

questioned the time of completion. He stated on the third page the time of completion was within 28 calendar days from the date and on the page next to the last page it says 30 calendar days. He wanted to know if it was 28 or 30 or if they should be the same.

Commissioner Wichman

stated this was with the FAA and they have certain standards they have to follow. They have 28 days to complete from the day they start, however, April 4, 2017 24. For Possible Action Discussion and deliberation regarding a request to: 1) award a contract to A & K Earth Movers in the amount of $149,000.00 for rehabilitating the unpaved runways at the Gabbs Airport contingent on Federal Aviation Administration (FAA) approval; 2) authorize the County Manag to er submit a grant application to the FAA to obtain funding for the project; and 3) authorize the County Manager to execute the grant offer when it is received from the FAA. Cont’d there is a 30-day window for natural disasters or things that happen. She thought it was perfectly reasonable but it might be odd.

made a motion to adopt; seconded by Commissioner Wichm an. Pam Webster personally extended her appreciation for dispatchers and what they do. It is a relentless area to work in. The Board concurred and suggested each dispatcher be sent a copy of the proclamation.

For Possible Action Discussion and deliberation to: 1) approve a request from the Pahrump Park and Recreation Advisory Committee for an amount not to exceed $15,000 for the Pahrump Movies in the Park event that can be funded from Fund 25223 Pahrump Room Tax Fund; and 2) execute an agreement with Entertainment Concepts to provide services for presenting the movies in the event.

made a motion to approve the request for an amount not to exceed $1 5,000 and to execute an agreement with Entertainment Concepts; seconded by Commissioner Cox.

stated the cost keeps going up. Mrs. Webster stated it was the same price as last year and previous years. Commissioner Cox stated it might behoove them to purchase the equipment themselves and in 3 years it might pay for itself.

stated it should start with the recreation advisory board.

Mrs. Webster

stated they would also need an entertainment license and she would look into it.

Commissioner Cox

stated she would bring this up to the recreation advisory board at their next meeting. Dwight Lilly asked if there was a commissioner assigned to the advisory board to oversee this. He asked if it was the same company used as last year. He also stated he did a search to verify the workers compensation coverage and there had never been workers comp for this company. He was concerned about the safety of his fellow Pahrumpians and would like to see this tabled until they see if workers comp and insurance is in place. J.D. Webb, co-chair of Pahrump Parks and Recreation Advisory Committee, stated there was a fee to watch the moves so they have the ability to show them. April 4, 2017 9. stated contractors have to provide all of their insurance. Administration follows up to make sure they have all of their certificates.

made a motion to approve the Sheriff’s fiscal 17/18 spending plan for the Pahtump PSST money; seconded by Commissioner Wichman.

clarified that she would have budget for padded cells next year.

stated the second highest amount was for surveillance cameras in Manhattan’s high crime area. Sheriff Wehrly stated they have had people complain about thefts up there. Commissioner Wichman stated the cameras would disappear and the residents would complain more once they feel their privacy is being invaded.

stated she was working with White Pine County to get this on the agenda. Sheriff Wehrly stated she would like them sworn in by the Sheriff.

reviewed the matter. They would leave it up to local communities to zone. He suggested not having it in the PRPD and consult with local governing communities. Discussion was held regarding 24 hour security guards and cameras as well as fences.

Commissioner Koenig

stated he didn’t think they should allow it anywhere in Nye County. If someone is going to grow marijuana on a 50 acre parcel a fence is not going to stop anyone from getting in. He didn’t think it should be grown outside and in discussions with Darrell Lacy they should put this discussion off for a few months. April 4, 2017 19. agreed with Commissioner Koenig that marijuana needed to be grown inside.

Sheriff Wehrly

also agreed and didn’t believe it should be grown outside. If they do grow outside there should be 8 foot fence with tamper alarms and 24/7 armed security. She is adding people out to the rural areas, but the best thing is just not to allow it. Darrell Lacey, Planning, reviewed the proposals by the committee. There were multiple bills in in the Legislature.

stated they never know what is going to come out of the Legislature. She suggested trailing this and getting periodic updates.

Mrs. Webster

asked if they have looked at other states. Commissioner Wichman stated there have been stories shared with the Legislature from other states. Dave Stephens, Pahrump, stated they should not grow it at all. It causes brain damage. This was nothing but a travesty. 20. For Possible Action Discussion and deliberation on the approval of a letter of support for A.B. 40 An act that makes an appropriation to assist with construction of a new courthouse in White Pine County.

stated the reason this request was put before the state is because there is a high security prison in White Pine County and the courthouse is used for their appeals etc. They are asking the state to pony up and pay for some of the new construction on the courthouse for the sake of security.
