said she drove the new road on Gamebird and Barney and was concerned about lumps and bumps on Gamebird from Winchester going toward Homestead.

explained those were due to a lack of maintenance. When the water starts to infiltrate the pavement surface and get into the clay it starts to heave and move. They would probably have to profile mill it and do an overlay on it

asked about the curves on Red Rock. There had been a lot of accidents on a couple of those curves and there were no speed limit signs out there. She wondered if there was a precautionary thing that could be done to let people know curves were coming up.

said chevrons or advanced warning signs for that curve could be looked at.

Pam Webster advised that input from the businesses was considered along with the County impact and input from the Sheriff as well as other parties in the preparation of this.

noted $385.00 needed to be corrected to read $385,000.00. Mark Connot, appearing on behalf of Sheri’s Ranch, asked if this was to simply make the business impact statement prepared by the County part of the record with further deliberation and discussion later. Angela Rello advised Mr. Connot that he could comment on the ordinance itself at the time of the ordinance consideration and if he wanted to comment on the business impact statement now would be the time.

Mr. Connot

stated he did have issues with the business impact statement, in particular NRS 237.080(3) which mandated the governing body, in this case the County, if they determine it was likely to impose a direct and significant economic burden upon a business or directly restrict the formation, operation or expansion of a business, the governing body shall consider methods to reduce the impact of the proposed rule on businesses, including without limitation simplifying the proposed rule, establishing different standards of compliance for a business, or modifying the fee or fines set forth in the rules. It was Mr. Connot’s opinion that there was no attempt made to comply with that NRS in the business impact statement prepared by the County. Richard Hunter, Media Director for Dennis Hof and speaking on his behalf, said their particular concerns about this proposal were twofold. First, it would disproportionately affect brothels with the smaller licenses like the two they had in the County. Second, if the fees were going to be increased on business licenses in Pahrump they would ask why it was not being considered for any business in Pahrump.

pointed out the brothel fees had not been raised in over 20 years and asked both gentlemen how many times they had raised their fees at their establishments over the last 20 years.

Mr. Hunter

stated they did not have set fees as they had contractors.

Mr. Connot

acknowledged the bar/restaurant area fees had been raised, but that was a nominal part of the business. The independent contractors set their own fees. He said they had taken the position since the initial ordinance was introduced last summer that they were prepared to do a reasonable fee increase, but this was more than a reasonable fee increase. Mr. Connot thought these fees would put the brothels out of business as it would cost each business $100,000.00 per year with nothing to evidence May 16, 2017 33. He stated it was an attempt to require and impose additional, unnecessary and wholly unreasonable fees on these businesses and that was their concern with it.

stated this was a specialty license and very few people in the State had them. If they thought they were really being hammered that hard he would be glad to sit down and go line by line through whatever part of the fee increases that they felt would put them out of business.

Ms. Bello

asked everyone to stick to the business impact statement and not discuss the ordinance.

Mr. Connot

said he disagreed because the two could not be unraveled. There were various onerous, unnecessary requirements in the ordinance that had a direct economic impact on the businesses involved. Dave Stevens thought these people paid plenty of money. Don Cox felt the Board of County Commissioners was trying to price the brothels out of business. Dwight Lilly said he did not want the County to get the reputation of running businesses out of town because of personal moral feelings about it. This was a legal business operating within the County which had the right to sustain itself and not be driven out of business by unnecessary, overbearing taxes and regulations that had nothing to do with the safety of the public at large.

said she did not want to consider putting anyone out of business. 34. For Possible Action — Discussion and deliberation to ratify the selection of IT Director. Pam Webster explained a public recruitment for this position was done and she introduced Carl Bundy. His resume was in the back-up. Mrs. Webster said he brought a strong knowledge of technical skills to the County and asked the Board of County Commissioners to ratify her decision on this position.

made a motion to adopt Bill No. 2017-12 with an effective date of May 25, 2017; seconded by Commissioner Koenig. Darrell Lacy, Planning Director, explained that the May 25, 2017, adoption date was a little shorter than the normal period of time, but they were attempting to get this done before May 31, 2017, which was when the State was accepting their licenses. Basically this said anyone operating an establishment for cultivation, production or retail sales of medical marijuana would be able to apply and get a license for recreational marijuana. The one-time approval would be done administratively to get it done between now and the end of the month and anybody new would come to the Board.

opened the public hearing. Darrell Lacy explained this was trying to make it friendlier to home-based businesses but maintain the residential character of the property. Brett Waggoner, representing Great Basin Utility Company as well as himself as a citizen, said he was not for or against this but thought Nye County and the utility companies in the valley all had to conform with NRS 445A and NAC 445A in regards to cross contamination. He wanted to make sure provisions for backflow devices for things like salons and food production were considered.

Mr. Lacy

stated this ordinance did not attempt to conflict with any State law so Mr. Waggoner’s comments about any activity that might trigger the need for backflow devices under State law would have to follow that. He noted they may have to work with UICN to make sure they were given proper notice when approvals were given.

Mr. Waggoner

said that would help, but when it came to a domestic well the concerns would be the same if not greater of something going back into the ground. Another issue was the MSDS information on the chemicals. He then asked if the utilities would have an opportunity to be notified if there was any change of use from residential to any type of business activity along with possibly a sign-off opportunity for anything that might require backflow protection. Robert Adams shared item 13 from the April 18, 2017, RPC meeting where nuisance odors was to be added to what was listed under B. When Commissioner Schinhofen asked him if the RPC adopted that, Mr. Adams stated he had suggested that nuisance odors be added and it somehow slipped.

advised that in discussing the types of businesses people would have ongoing, there might a plumbing business or something like that that used that home as the business office, but on small lots they were not supposed to be parking trucks and having employees show up to work at that location. said if it was a hobby it was not a home-based business and this would not affect those people.

said no and explained what was included in the back-up today reflected only the boards who had attendees in the April training, not all of the boards total.

asked if the individuals were sent some sort of a notice that they had not complied and asking them to comply within a certain amount of time.

instructed staff to notify those who had not complied. Pam Webster said they would put an agenda item on each agenda coming up as advisory and notification of the members on each board who had not met the requirements.

stated that letter should say they had not complied, but another one would be on July 19, 2017, and if they did not attend they would be removed from the appointed boards. Sam Merlino cautioned that for some of those boards there would not be any new applicants.

For Possible Action Presentation of the April 5, 2017 and April 19, 2017 Open Meeting Law training participation.-Cont’d. Lorina Dellinger advised the directive came from the Board of County Commissioners as an action item to requite CML training annually for every public body appointed by the Board of County Commissioners. FINANCE 36. Presentation regarding the budget status through April 2017 for Nye County Fiscal Year 2017 budget prolections. Savannah Rucker said in the back-up was the budget to actual revenue report for FY2017 through April 30, 2017, which showed an increase of $950,000.00 compared to this point last fiscal year. CTAX received for February in the month of April was budgeted at $850,000.00 and about $980,000.00 was received. She said the County was consistently seeing revenues in excess of budget which would continue stabilizing the County. She noted that licensing and permits was below average, but she anticipated a jump in revenues for licenses and permits toward the end of the fiscal year. Ms. Rucker said the projection was to close the fiscal year about $2 million in excess of what was budgeted for revenues. The second page of the report was the department breakdown of expenditures. Ms. Rucker noted the following: • The Comptroller would be over due to a $50,000.00 invoice for a service fee for the financial system that was not budgeted initially. • IT was showing overages on salary/benefits due to having a temp for a while. Services and supplies would also likely come in 1 % over budget because of additional service invoices that were not budgeted. • The Public Guardian would likely need to be augmented because the most cases in the history of the Public Guardian were being seen. • Emergency Management was pending receipt of a grant for a portion of the Director’s salary which had been delayed by the federal government. • The Assessor’s Department had a $50,000.00 contract with a company called TMA to audit the personal property tax for a few accounts, which was an unanticipated expense. However, the revenue generation forecasted for the general fund was $160,000.00 alone so they were keeping their eyes on it to make sure the return on the investment was there. • Other Judicial showed encumbrances of $259,000.00 which were being researched, but at a glance Ms. Rucker said it looked like all the payments were May 16, 2017 36. Presentation regarding the budget status through April 2017 for Nye County Fiscal Year 2017 budget projections.-Cont’d. • made in FY17 and those encumbrances should be in FY18. The department should finish the year at 90% by moving those. • The Sheriff Office’s salaries were projected to be 104%, which was due to overtime to cover the open positions as well as comp time now being charged as it was earned instead of when the employee vacated the position. Their services and supplies budget was being reviewed as it was 113% of budget, which was significantly over budget. • For Public Works, Ms. Rucker explained a portion was allocated out based on historicals, but there were more expenditures for employees who worked under the general fund so this department would need to be augmented. • Under Miscellaneous Overhead, Ms. Rucker believed the retirees’ health care coverage was under-estimated and an augment would be needed.

For Possible Action Discussion and deliberation to direct the Nye County Treasurer to sell at auction property, after giving notice of sale, for an amount of taxes, costs, penalties and interest legally chargeable against the property.- Reopened. Lorina Dellinger said the property could be included in the auction when the time came and the Treasurer’s Office just needed that direction in order to proceed.
