2. GENERAL PUBLIC COMMENT (up to three-minute time limit per person)

Commissioner Schinhofen

explained at this time that this was a quasi-judicial hearing. There would be no comments unless the person was a witness and sworn in.

3. Ex Parte communications and conflict of interest disclosure statements.

Commissioner Borasky

assumed the Chair of the Licensing and Liquor Board.

4. For Possible Action Discussion and deliberation regarding an Order to Show

reminded everyone that if they had any questions to address the Chair to be recognized as this was a quasi-judicial hearing, not the standard Board of County Commissioners meeting.

opened the show cause hearing. Attorney Marc Risman was present on behalf of Dennis Hof and his businesses.

Sheriff Wehrly

was recognized at this time. She explained the notice of violation was issued based on an inspection conducted at the Area 51 Death Valley Cathouse on February 11, 2017. Upon further review of the facts and circumstances she believed it would be appropriate to amend the notice of violation to only one violation for failure to comply with the signage requirements in NCC 9.20.130.D.8.

made a motion that the Board accept the amendment; seconded by

Commissioner Schinhofen

; 4 yeas.

Sheriff Wehrly

then stated her understanding that Mr. Hof would stipulate that on April 19, 2017, he was put on legal notice of the violation of NCC 9.20.103.D.8. occurring at the Area 51 Death Valley Cathouse and to a $500.00 fine for that violation, provided such penalty was suspended for six months and if no further violation was found during that period the penalty would be dismissed. Further, if during the next six months this Board found any further violations of NCC 9.20 as currently written or amended in the future that regardless of the Board’s action on any such future violation the $500.00 penalty suspended today would automatically become immediately due and owing.

Mr. Risman

confirmed that his client was willing to so stipulate and said Mr. Hof had informed him that the violation was corrected within a 24 hour period and they were in compliance at this point.

made a motion to accept the stipulation; seconded by
