asked Commissioner Cox to take a look at it and let him know if there was anything he could do to help. Tom Waters advised Art Jones passed away and his funeral would be at 1:00 p.m. today at the Trinity Church, 750 Big 5 Road. Wendy Barnett, president of the Great Basin Water Company, discussed the main break that occurred Sunday night on the corner of Homestead and Highway 160. It was a 17 foot split in a pipe that fed up to the Winery district and almost 100,000 gallons of water were lost with three customers out of water. As a precaution a boil water notice was issued, but nothing was ever contaminated. Ms. Barnett said a lot of people were misinformed and she thanked the media for its help in getting the word out. She advised repairs should start about December 1, 2017.

said in the past people complained about their general public comment time being eaten up when the Commissioners answered their questions, so he had been asked to not do that. He said he took notes and answered them under Commissioners’/Managet’s Comments.

Commissioner Wichman

advised NACO’s workshop series had started for the upcoming year with the first one being Understanding Medicaid to learn about the roll the counties played in that program, how it affected budgets, and potential opportunities. That would bean December 1,2017, from 10:00 a.m. to 12:00 p.m. and would be video conferenced. Commissioner Wichman then discussed the document developed by the Emeritus Committee, Becoming a County Commissioner, which explained a lot of the details of what a commissioner had to do and some of the misconceptions about the job.

Commissioner Borasky

asked for an agenda item to place a plaque on the wall for Art Jones next to the one put up for his wife Opal. Also, Commissioner Borasky said he would provide the funding if it was okay with Mr. Jones’s family to put a banner up on his behalf. Regarding the horse issue, Commissioner Cox explained it was 90,000 horses and they intended to take them to slaughter if one could believe what was on Facebook. She knew someone very involved with the issue and would meet with her in a day or so and find out if it was true. She also expressed her support of Commissioner Borasky’s desire to put a plaque up for Mr. Jones. TIMED ITEMS

said she believed at the next NDOT workshop one of the items that would be on the wish list was to replace the emergency signs on all the State highways coming into Nye County that said 911 with something more akin to “Travel At Your Own Risk” or “Limited 911” and NDOT was willing to put those up.

stated he owned property in Pahrump and the State Engineer did not provide any service to his property through the artesian well contract. He felt every property owner in town was paying the bill for the water rights people, but many of the water rights were owned by the utility companies. He thought they should be paying their own bill and not charging people who received no water whatsoever. November21, 2017 21. For Possible Action Approval to accept Amended Notice of Subaward from the State of Nevada, Department of Health and Human Services for the Community Services Block Grant (CSBG) and assurances to provide assistance for Nye County’s very low to low-income population in the amount of $131 ,143.00, which includes Carryover monies. believed the town board was left thinking that Mr. Dahi was going to help with the repairs and invoice them to pay the County back.

said he drove Homestead every day and was okay with 25 mph, but he had been behind people going 10 mph and he thought that was a little slow. He suggested setting the minimum at 25 mph. TIMED ITEMS-Cont’d. 8. 10:45 For Possible Action 4th Community Development Block Grant (CDBG) — — Public Meeting: 1) Discuss eligible projects based on CDBG decisions for Fiscal Year 2018; and 2) Prioritize applications for submission.

made a motion to prioritize the applications for submission in the following manner: apply for the fairgrounds flood control study first, second would be the Beatty Airport fueling station, and then sponsor the two items of the Beatty Airport hangar followed by the Amargosa Tech water lines; seconded by Commissioner Koenig.

said she would like to see the items for Beatty put together and the airport get taken care of as to her those were a priority above the others. She did not know which two to pick as being one and two, but she thought the fairgrounds could be funded by other means and should come last.

said her motion remained the same and explained she looked at items on this list that may have potential to be destructive to property or people. Flood control in her opinion would always rise above replacing water lines and additions to the Beatty Airport.

asked if that was the document the Commissioners were just given. Samantha Tackett explained what was in the back-up was between the Town of Pahrump and HGAC Buy, and the contract between Rocky Mountain and HGAC Buy was in the process of making its way to the County.

amended her second to the motion. In response to questions from Commissioner Cox, Fire Chief Scoff Lewis advised the last ambulance was purchased in 2012. Right now they had four front-line and two reserves, but the two reserves had over 400,000 miles on them and would be departing the fleet. One of the front-lines also had almost 400,000 miles on it. As far as recouping any funding through auction, Chief Lewis said historically when they did the refurbishing process the previous ones were traded in as part of the cost savings on that.

asked if this was going to be a marijuana or auto repair place. Darrell Lacy, Planning Director, said the RPC recommended approval. He explained the initial site was the former auto shop that Jesse Rock had. The building had been torn down, but the foundation was still there. Mr. Lacy said all understandings were it would be an auto shop.

said she knew about the situation with Jesse Rock and she was not going to support this as she felt it was totally unfair to him what happened. There was some reason why after he got the building up people wanted to change the zoning which kept him from opening a business. If an auto repair shop was not allowed then she felt it should not be allowed now.

asked Commissioner Cox to do some research on that. He did not think Mr. Rock was discriminated against in any way, shape or form. He just did not pay the property owner and the property owner said get out.

stated that he could not open his business because the zoning was changed on him, and that was what Jesse himself told her.

asked if the bank did not commit by tomorrow then staff would go ahead with the warrant and get this done.

asked if this would be adopted to do it on the internet to save the $1 5,000.00 to print it in the paper. Assessor Sheree Stringer explained for the last two years it was published in the newspaper and placed on the Web site. The newspaper cost $4,800.00 and it had to be published four times. As far as she knew there was no additional $1 5,000.00 anymore.

said he would rather see it once or twice in the paper and on the internet because in 2015 the Legislature amended NRS 361.300 to allow for the option of publishing the list on the internet so it no longer had to be in the newspaper.

made a motion to amend Nye County Resolution No. 201 7-86, a resolution directing the County Assessor to prepare a list of the taxpayers on the 2018- 2019 secured tax assessment roll in Nye County, Nevada, to print this in the newspaper twice and to also publish it on the internet Web site maintained by the County to fulfill the requirements of NRS 361.300; seconded by Commissioner Cox.

repeated that the $1 5,000.00 was no longer an issue as the listing was no longer printed in the newspaper. What was printed in the newspaper were the four announcements so every taxpayer was aware of how their assessments were done and how they could dispute their values, which cost $4,800.00 total.

asked why his agenda item said a quote was received from the Pahrump Valley Times for $15,000.00. Samantha Tackett explained a template was used because this was a routine item, but if it was incorrect she suggested pulling the item, getting the proper information and bringing it back on December 5, 2017. Angela Bello agreed with that so she could review and make sure they were in compliance with the law.

made a motion to choose option A and adopt Resolution Nos. 2017-81 and 2017-85; seconded by Commissioner Cox. Louis DeCanio said when Ron Kent resigned his position as Pahrump Justice of the Peace the County Commission had two legal options: either appoint a qualified Pahrump resident or hold an election to fill the vacancy until the term expired. The law also stated the boundaries of Pahrump were permanent and to be a Pahrump Justice of the Peace one must be a Pahrump resident. Mr. DeCanio alleged the District Attorney illegally manipulated the rules and procedures to appoint a non-Pahrump resident to fill the position. He suggested the Board follow the battle law and interview Pahrump residents and appoint qualified Pahrump residents to fill open positions. Angela Bello pointed out that the Attorney General’s opinion was very clear that the Board did have the third option of merging the two townships into one thereby eliminating the vacancy. They recognized that was what the County did and that this Board had the power to change boundaries. There was nothing illegal.

Ms. Bello

advised the lieutenants had the legal right to unionize, but the question was whether a union already existed with which they shared an interest and whether or not they could go in that union. The prohibition under the law was that supervisors could not be in the same union as those they supervised, and whether they met the definition of that was not quite clear. Ms. Bello said one lieutenant believed he was not a statutory supervisor under the law and could go in the other NCLEA, but the NCLEA refused to allow them to come in voluntarily. She had looked at the job description and did not believe they met the definition either, but that would likely be challenged if the Board refused to accept it and it would go before the Employee Management Relations Board (EMRB). Ms. Bello advised the Board could recognize them as a lieutenants union as a matter of policy and it could be taken to the EMRB for them to make a decision.

Commissioner Schinhofen

said he was concerned with having an undersheriff in a union when he would take over the duties of the sheriff.

Ms. Bello

said if the Board recognized this union at this point it would only be for lieutenants as there was no one in the other positions and she did not think it was right for lieutenants to bargain the future of different ranks. She added she had spoken with the Sheriff who would like to see recognition of a new union if only as a matter of policy, as would Human Resources.

made a motion to recognize them and have the District Attorney work on the details of that and the negotiations if there were any; seconded by

. Detective David Boruchowitz from the Sheriff’s Office, sitting in his capacity as the informal elected president of the newly requested recognized association, explained the promotions to lieutenant were done with specific language that the promotion was to a non-statutory supervisor position per NRS 288, so any discussion or confusion as to whether they were or not was addressed when those promotions occurred. Mr. Boruchowitz said their request to be recognized was founded on the decades’ old practice in Nye County that the upper supervisors of the Sheriff’s Office had their own November21, 2017 31. For Possible Action Discussion and deliberation to: 1) consider recognizing the Nye County Association of Sheriff’s Supervisors as the collective bargaining unit for Lieutenants and above in the Sheriffs Office; and 2) direction to the District Attorney to negotiate a collective bargaining agreement with this unit if recognized.-Cont’d. association as their subordinates had an uncomfortable time participating in union business when their bosses were in the same association. He said they were simply requesting to reopen that as intended when the promotions were approved by the Board contingent on negotiating with a new association.

said she distinctly remembered the Sheriff saying there would be no lieutenants and she would use that money to put certified individuals on the street.

thought government unions were a bad idea, but said he had to follow the law.

did not know why they could not either be united into one or none at all because they were really breaking the County in a lot of ways. She also did not think it was good for government to be involved in unions.

said if the Board refused to recognize it then it would go to the EMRB to determine if one union was sufficient.

Presentation regarding the budget status through October 2017 for Nye County Fiscal Year 2018 budget projections. Savannah Rucker directed the Board to the second page, which was the budget to actual revenue report for FYI 8 showing 33% of the fiscal year had elapsed with revenues received to date at 29.7%. The next four pages were the department expenditure breakdowns and any lines projected to be over budget were highlighted.

had answers for all of those departments, which she reviewed.

Ms. Rucker

explained the 33% was for services and supplies. Payroll was a little different because there were a specific number of payrolls in a fiscal year and there were ones that posted between fiscal years. The projection was 100.7%, but only 32.9% had been spent at this point in the year.

Ms. Rucker

then advised that there were changes to legislation that would have significant effects on the Public Guardian budget. She would take care of it during the budget augmentation, but she was watching it for a couple of months first. Finally, Ms. Rucker said she as paying close attention to the Sheriffs Office as their services/supplies was projected to close out at 112%. She was looking to see if those costs could be reduced as well as whether there were some possible accounting errors.

stated Ms. Rogers needed to speak with the District Attorney then, not the Commissioners in a public forum. Trevor Dolby advised last week there was a resignation from the Amargosa Valley Town Board. He had not reviewed the procedures, but the way he had seen this handled in the past was the Board of County Commissioners made an appointment to fill the vacancy. Mr. Dolby said he filled out an application and thought the Board needed to put it on the agenda for the next meeting as there was a short board in Am a rgosa. Horace Carlyle asked that his comments be recorded in the minutes. He thanked

and the County Manager for their participation at the Tonopah workshop on November 16, 2017. Commissioner Wichman was able to provide financial information on the management and disbursement of income and revenue for Nye County Emergency Services. He said there was a presentation by Commissioner Wichman and Vance Payne about a year and a half ago and at that time it became very clear additional funding was needed. They were looking at the unincorporated towns or other people, but the other unincorporated towns had no way to sustain emergency November21, 2017 services on the scale they needed to be financed long-term. Mr. Carlyle sugges ted Nye County review it, work with Mr. Payne and the towns, and possibly have a ballot measure for a parcel tax rather than having a skull and crossbones on NDOT signs for death for traveling. Mr. Carlyle encouraged the Commissioners to review closely the Tonopah workshop minutes for comments made by Life Guard and the Tonopah volunteer fire chief. He said he did not want to point fingers because he though t there were great people involved, but there was a crisis in all areas outside of the Pahrum p township. He thought if the Board looked at it as well as the County Manager then a better mousetrap could be created. Nye County Emergency Services could not sustain itself, could not buy the equipment it needed, and could not fund the rural outlyin g areas. Therefore, as a property owner and taxpayer in northern Nye County, Mr. Carlyle said he would be happy to pay $20.00 for his parcel with no questions asked if it saved his neighbor or people traveling through his community Cart Bottorf, chief nurse of Flying ICU/Life Guard International, wished everyone a Happy Thanksgiving and reminded everyone they continued to provide a paramedic free of charge in Tonopah. They also supported the volunteers in Tonopah and wanted to lend all the support they could. He asked the Commissioners to contact the Sheriff’s department to set up some signs that said to slow down as it was not safe for people to go 55 mph on Vicki Ann. Mr. Lilly also suggested a public service announcement about people riding bicycles in dark clothing. Herman Lewis added to Mr. Lilly’s comments by advising there was a group of young people with dirt bikes and quads going 60 mph or 70 mph down Vicki Ann, doing wheelies and not wearing safety equipment. He thought that was illegal and that they should be on the side of the road. He suggested the Commissioners let the Sheriffs Office know about that too. 6. said there were many times she received e-mails to a whole bunch of people, but the e-mails themselves were not addressed to a person and she did not feel it was her place to respond. She suggested that if someone wanted an e mail responded to it should be addressed to one individual and then that individ ual could respond accordingly through staff. November21, 2017 6. Commissioner Koenig

told Trevor Dolby that the vacancy on the Amargosa Valley Town Board would be advertised in the paper. Sam Merlino explained the process to fill a vacancy, which included publishing the vacancy and noticing the Secretary of State that the elected position was open. It would be published for a couple of weeks, so Mrs. Merlino said Mr. Dolby could get the application and turn it into her office. Her office would put it on the agenda and work with the town board for a recommendation.

Commissioner Wichman

said as an elected Board of County Commissioners this Board could not direct any other elected official. If someone had issues about miles per hour, etc., they should address the Sheriff themselves.

Commissioner Borasky

stated that after reading the history books of Nye County and all the crazy things that happened, he had a gut feeling that three individuals might have his number. If he should disappear, get hit in the head with a brick, get run off the road, or any other function to take his life away from him he would ask that they talk to Mr. Dennis Hof, Mr. Don Cox, and Mr. Joe Burdzinski of the so-called Nye County Republican Central Committee. Commissioner Borasky said he would put that in writing to all departments, all sheriffs, and a whole bunch of other agencies.
