Commissioner Wichman

provided an update on the naval air station upgrade where they were coming into Nye County. In the comments sent through one of the things that was hammered on was to have them include in their analysis for the EIS all of the cumulative impacts to Nye from military actions or military withdrawals in the County. Yesterday during a conference call with many of the representatives Mary Ellen Giampaoli and Commissioner Wichman were informed all of the cumulative impacts would be included.

said the Pahrump High School Band was invited to the 75th remembrance of Pearl Harbor. They had been getting private donations but still needed $60,000.00, so he would bring an item forward at the next meeting for the Board to consider helping with money from the town.

told Dwight Lilly there was no special aquifer so there would be no report at the next meeting. TIMED ITEMS

thought it should be dovetailed into a new shelter. John Bosta thought that since there was a sole source aquifer where 100% of the water for drinking purposes came from the EPA needed to be asked to review all federal grants that might affect the groundwater. Dwight Lilly liked the idea of the low cost spay/neuter clinic but he wondered what low- cost was and who qualified.

said she was working on a couple of other applications to bring forward at the Pahrump meeting. Regarding a new shelter, Commissioner Schinhofen asked staff to identify the property and possible costs and said he had thought of the Sheriff’s impound yard. August 7, 2018 PUBLIC PETITIONER

made a motion that in accordance with Nye County Code 17.04.860 L-N the County Commission found a condition constituting a menace to the health, safety and welfare of the residents of the Pahrump Regional Planning District on the above-described parcel and ordered the same to be repaired, abated and/or removed within 30 days with all costs being levied and collected with other taxes in the assessment roll in the same manner as other County taxes; seconded by Commissioner Schinhofen. Lynnette Sandquist, the daughter of the owner of the house, felt this whole thing had been blown out of proportion and that this was a way for Animal Control and the Sheriff’s Office to get back at her because of things she had done. She stated the house was not as dirty as they said it was and she could not clean up the yard because she was kicked out of her house. There had been five break-ins since she was in jail and a lot of things had been stolen. She said she was in the process of getting stuff done, but was waiting on the insurance.

understood why Planning and Zoning did what they did, but the structure was fine and just needed some repair. Ms. Sandquist did contact the insurance company, which was supposed to come out sometime this week or next week. Commissioner Cox thought the majority of the problem was cleaning up and replacing the flooring. She felt at this point that the house was uninhabitable, but it was not a nuisance to the neighborhood, just to those who would live on the property in the state it was now. The main situation here was the dogs that pretty much ruined the carpet, and with both Ms. Sandquist and her father being disabled they had a hard time staying on top of things. said that was correct from a compliance standpoint since they handled all of that as well as from a fiscal management standpoint, but there was some liability on the County regarding submitting deferrals and making sure it followed their processes.

assumed the Chair of the Board of Highway Commissioners. August 7, 2018 10. General road report by Public Works Director Public Works Director Tim DahI advised there would be a couple of bid openings on Thursday for northern county roads as well as Pahrump Valley Boulevard, and Homestead Road was currently ahead of schedule. He also told Commissioner Wichman that he had spoken with Mr. Brown to identify the culverts he referred to. Staff was up there cleaning those and should be done by the end of the day.

mentioned a phone call regarding a washout of an RS2477 road. She said Stretch had been contacted and they just needed County approval.

Commissioner Borasky

asked Mr. DahI to send someone to the Mankins Subdivision between Manse and Thousandaire as he had received several complaints about potholes. There were also a couple of big potholes opening up on Thousandaire between Vicki Ann and Homestead. He then asked if there would be an apron put on the entrance to the Heritage Church.

said no as a turn lane was not planned for that. It would be 38’ wide with 5’ by- planes and there would be plenty of room for people to traverse.

asked Mr. DahI to please get a cost for that as the church was interested in doing it.

Commissioner Schinhofen

clarified that Commissioner Borasky would like to have part of Heritage paved so when people came up to the stop sign at Homestead they were not spinning in the gravel.

said he would look into it.

Commissioner Cox

said she had a complaint from Tiptop that the trenches needed to be graded and the same problem existed on River Plate. There was also a big pothole coming at the corner of Unicorn and Deerskin and Jacaranda was falling apart and needed to be resurfaced.

advised he was getting some additional cold mix to grind out the intersection at Dandelion and Unicorn similar to Blagg and Bell Vista.

pointed out there was less than a half mile on Senita Court Road that was not paved. She recently sent Commissioner Schinhofen an e-mail and asked him to put a request before the RTC. Since Mr. Dahi was going to be out in that area already she asked if he could look to see if some of the extra material could be used.

asked if Mr. DahI would restripe the area by the Commissioners’ chambers like the parking lot by Planning and Zoning.

commented the agenda said everything was in compliance for Sheri’s and it was the recommendation that the licenses be renewed, but now it was going down a different road.

explained she received the information while on vacation and had not had a chance to look at it, but this was an ongoing dilemma with Sheri’s. There was an ongoing request for required information, but they had their license while working through this whole thing and had passed the inspections with flying colors. Sheriff Wehrly said she would like to discuss the information at a future meeting because she felt if a conclusion could be reached between now and the next meeting it should work out fine.

made a motion to talk with Sheri’s Ranch and Mr. Connot about the information he had not provided to date, give them a license just as they had a license for the last six or eight months, and at the next meeting determine whether Mr. Connot had provided the information and if not go for a show cause hearing.

made a motion to give Pahrump Homestead Partners LLC dba Sheri’s a 30-day temporary license and set a date for a show cause hearing for September 18, 2018, in Pahrump, however, if they submitted everything the Sheriff needed by the date then the show cause would be cancelled; seconded by Sheriff Wehrly. Ronni Boskovich asked the Sheriff to explain exactly what was being requested.

clarified some she did not have at all and she could not use Xerox copies. She needed originals and in some instances electronic copies.

said some of the owners were out of the country and some had been severely ill or passed away so those were situations where it was nearly impossible to get them into the Sheriff’s Office for an original.

disagreed because as the Board pointed out before they could go to almost any sheriff’s office or law enforcement agency that used Life Scan or something similar and provide her with electronic data.

said since Mr. Hof was not present due to medical reasons and neither were his representatives, and since it did state that everything was looking good for them and approval was recommended, she would like to hold this item until the next meeting in Pah rump so they had a chance to speak for themselves. She did not believe it was fair to take any action at this time.

said according to 9.20.120.E, untrue statements of material fact would also disqualify him for a renewal. pointed out that the Code she read did not say the Board “may” enforce. It said “shall” enforce. She was curious as to when the Sheriff’s Office would enforce the ruling as it should be enforced immediately. said there were a couple of new liquor licenses and name changes. He cautioned the folks that the Board was charged with strict enforcement. He had asked one of them to move a trailer mounted sign, which they did by putting it somewhere else. Commissioner Schinhofen asked everyone who had a privilege license to please read the Codes and see what they were agreeing to. If they were not going to agree to it then tell the Board and it would not be renewed.

pointed out that again when she got the back-up it contained a social security card. She said at no point ever should the people in charge of the licensing allow any sensitive material to leave their possession for any reason unless they had a written explanation from the owner of that sensitive information. She stated if she saw it again she would go for a State action, meaning charges would be brought.

explained action was not necessary on this item as the Board named her as the point of contact, but she wanted it on the agenda so everyone could see what the comments were. said this was her request, not a request of the Friends of the Belmont Courthouse. She explained the Belmont Courthouse was a County asset and as it began to deteriorate internally it created a County risk. The Friends of the Belmont Courthouse had been extremely diligent in doing fundraisers to get a structural engineer August 7,2018 21. For Possible Action Discussion and deliberation regarding providing funding up to $50,000.00 to Friends of the Belmont Courthouse for the use of stabilization and rehabilitation of the historical Belmont Courthouse-Cont’d. to determine what was needed to make it safe. asked what fund this would come from. Savannah Rucker said there were a couple of options. She would bring forward an item at the next meeting to set up a donations department funded from contingency so this would be funded from contingency.

said there was funding available in contingency, but per NRS the County could not spend out of contingency so setting up the donation department would allow use of the funding.

explained the first one was advertised in the paper and the Board just fixed that one. The second one was advertised, but was wrong because they advertised the one Mr. Cottingim was just put in. It was re-advertised and would be re agendized for the next meeting in Pahrump. He said anyone who applied for either of those advertisements did not need to apply again.

advised he was pulling the fire district one. Lorina Dellinger said as of right now there was just the one for autopsies and the Sheriff had an update on her findings.

wanted to do something about the election process. Currently if one party was in the primary they won no matter what which disenfranchised the other parties and Independents, but he heard NACO was carrying that.

Commissioner Wichman

asked that some background for the BDRs be included in the back-up or who the champion of an item was so the Board knew who to talk to about it.

Commissioner Schinhofen

said he still wanted to get rid of government unions.

Commissioner Cox

advised she had employees actually support getting rid of the union so she would support that as a BDR, but she also had several people approach her about a BDR to split the County.

noted that would take an amendment to the Constitution.

cautioned that the Pahrump area being sucked into Clark County would be the most likely result.

Commissioner Wichman

explained if the voters did not approve a constitutional change then the Legislature would have to offer an opportunity to do something different. Any county that shared a boundary with Nye would have to be considered in doing that. If the initiative to create an eighteenth county failed, the only other choice was to consider all of the other counties around Nye and their boards would have to unanimously agree to do so. If this Board voted 5-0 to change the County’s boundaries and Clark voted to accept it then the southern part of Nye could be moved into Clark. The only other option, which had already been tried and refused, was that Esmeralda, Lander, Eureka or White Pine would have to agree to incorporate northern Nye into their boundaries.

said she was not personally trying to do this, but the only alternative she saw was to create an eighteenth county because she was sure no one wanted to go to Clark County and knew Esmeralda County did not want any part of Nye. 26. For Possible Action Discussion and deliberation regarding a request to: 1) Set a date, time and location for a Public Hearing on Nye County Bill No. 2018-1 4: A Bill proposing to amend Nye County Code Title 2 Administration and Personnel, by adding Chapter 2.88, License Department; establishing provisions for the License Department; and providing for the severability, constitutionality and effective date thereof; and other matters properly relating thereto; and 2) Read the title of the Bill into the record.

believed this was for improvements to Thousandaire Road. Tim Dahl said this was for both Hafen Ranch Road fronting the property and Thousandaire fronting the property. This was an opportunity for the developer to not have money out of their pocket today yet the County got an agreement for future improvements.

explained there was one purpose in establishing a district and that was to collect tax money to support an effort. Unfortunately with the position Nye was now in it could no longer tax because it was at the cap. When she established the hospital district she had to get help from the Tonopah Town Board, the Tonopah Library District and Round Mountain to give up some of their taxes and withdraw requests for more.

I s Let me put on the record this is NOT Political, this is pure business of the people: According to Nye County Code (NCC) 9.20.130.C4 states.... “No signs may be placed anywhere in the county advertising the brothel or associated businesses on the same property. No print advertising is allowed anywhere in the county with the same restrictions of other businesses on the same property”. I have come before you before you on these same issues, yet we continue to have to deal with Dennis Hof the Owner of several properties not complying with the NCC and laws of Nye County. Please find attached copies of Hof placed an Ad in the Pahrump Valley Chamber of Commerce 2018 Community Visitor & Relocation Guild, which I may add, will be mailed all over the country to people who might be looking to relocate to the Pahrump and Nyc County areas as well to all local residents. Also find attached a photo of a sign on the North End of Pahrump with clear advertising for the Bunny Ranch” a Northern Nevada Brothel, and there are more signs just like this one around Nye County. Hof also has a large black SUV with his brothel advertising on both sides of the rear side windows. You can see it all over Pahrump and Nye County doing sign up-keep for Hofs political campaign. We don’t see these blatant violations in the counties around Nye County because Hof knows they will not stand for it. The counties up in Northern Nevada are looking at kicking him because he fails to follow the codes and laws there. We have other Brothels here just outside of the Pahrump Town limits and they don’t do as Hof does. They obey the NCC and our laws and they are good community partners. I ask you county commissioners to take immediate action to revoke his privilege licenses for his many brothels and his liquor licenses as well in Nyc County for violating, with many infractions, the NCC and Nye County Laws. You were elected to represent the people of Nyc County “All The People” notjust some of the people. Please stand up and shut 1-lof’s businesses down for not following the rules.
