mentioned she saw something on Facebook which she had not verified . A doctor said if someone had gotten flu shots during the past 10 years they would test positive for the Wuhan strain of the COVID-19 flu .

said Serenity Health had been doing most of the testing and on Monday Gaby Cruz , who ran Serenity, was named Hero of the Day for the State .

said he would like an agenda item at the first meeting in June suggesting the Board of County Commissioners take a 2.25% cut in pay for the next year , which was the same as the employees were being asked to do .

announced John Walker, the individual providing water and showers to the homeless , would have a free food and clothing giveaway at the Bearded Lady Saloon on Saturday from 10:00 a.m. to 12:00 p.m . She said she would like to see the Board recognize Mr. Walker for his service over the last several years.

asked for an agenda item at the first meeting in June to also discuss the County Manager's 5.25% increase he received when the Board found he was performing satisfactorily.

Danielle McKee, Contracts Admin istrator, outlined the relevant dates of bid solicitation, opening , review , select ion, bid protest , and the back-up items. David Perez said according to NAC 624 .150 , Class ification A-1 stated an A license must be held to perform the following work on airports: the construct ion, alteration and repair of airports , includ ing any navigational equipment, lights , beacons , markers , taxiways , runways , hangars and terminals .

asked Mrs. McKee after hearing evidence and argument made by the NDL Group if there was any testimony to be offered regarding the violation set forth by the NDL Group.

introduced Brian Fitzgerald from Atkins North America , the County 's engineer and airport consultant.

Mr. Fitzgerald

said he was employed by Atkins North America as a project manager and was cons idered the airport consultant for Nye County. He said he did not believe the NAC referred to by Mr. Perez had the word must in it so he did not believe that was a requirement at this time . For prior airport projects in Nye County the State Contractor's Board indicated an A-1 license was not required for specialty work as it precluded a specialty contractor from bidding as a prime . Additionally, NRS 624.215 indicated that a specialty contractor who entered into an agreement could provide any work , materials or equipment incidental or supplemental thereto . Mr. Fitzgerald explained the work performed for this contract was considered an electrical item with supplemental tasks May 19, 2020 9. 10:00 a.m. - For Possible Action - Public Hearing, discussion and deliberation to: 1) Hear Bid Protest submitted by NDL Group regarding request for Bid 2020-07 for replacing a beacon and tower at the Tonopah Airport; 2) Uphold or Reject the bid protest; and 3) If rejected, direct the DA office to pursue a claim against 't he bond in the amount equal to the expenses incurred due to the bid protest-Cont'd. such as concrete and erection of a pole not necessar ily to be used as a communication tower or for transmission of electrical lines.

asked Mr. Fitzgerald to address NAC 624.450 and that classification.

explained that would be a sub-classification license and a general A license covered all sub-classes as well. An A-1 license would be an additional license a contractor could receive to do work on an airport , but it was a burdensome requirement to have and not necessary on specialty projects.

asked if being a general contractor qualified as the A license and if Silver Sabre held the same .

Mr. Fitzgerald

said yes, it would qualify , but Silver Sabre held a C-2 electrical license.

Commissioner Strickland

stated she had a general contractor's license and would recuse herself. When Commissioner Wichman asked if she benefited from this contract in any way,

said no, but she heard the statement that was made that the NRS did not say the word must. She was not aware of that, but if the County had allowed general contractors to build at airports without having a specialty license she would like to research that further . Bradley Richardson asked Mr. Fitzgerald if it was his testimony the C-2 electrical license held by Silver Sabre would allow them to perform the scope of the work as detailed in the bid, to which Mr. Fitzgerald responded yes.

Mr. Perez

advised he spoke with the Contractor's Board. An A license was required and a C-2 was not a specialty license . It was an electrical license . Once there were three or more trades involved a general contractor must be hired. He pointed out this was demolition, erection of a fuel tower , structura l concrete , electrical, and underground conduit and a C-2 electrical contractor could not do it. Mr. Perez suggested the Commissioners ask the Contractor's Board for a letter of determination and they could say whether or not it was properly licensed.

Mrs. McKee

said the State Contractor's Board advised they could not make a decision during a bid protest and since the bids were already opened they could not make a determination. A request would have to be made ten days prior to the bid opening . believed she had an e-mail from Mr. Fitzgerald outlining that information, which was not in the back-up. She would submit it.

thought this needed to be held and looked at a little closer. She knew from being in construction that Mr. Perez was correct about needing different licenses. Nathan Schweigart from NDL Group said an A license was required to work on the airport and a C-2 was not a specialty license. It was an electrical license . The law was clear that if there were more than three trades there had to be a general contractor.

Commissioner Wichman

remembered from the last legislative session there were changes made in order to provide the rural counties a fighting chance of getting some bids done so there were concessions made on the strict adherence to laws. She thought maybe the District Attorney's Office was familiar with that. Marla Zlotek agreed there were quite a bit of changes made in NRS 332 and NRS 338, but she could not recall one which would be relative to the issue at hand , which was what license was required to perform the scope of work of this bid.

Commissioner Cox

said the big question seemed to be if they needed to have an A license or if a C license was good enough . Since this project was more work than just electr ical she believed they were right and a bid needed to go out separately for each trade. Commissioner Cox asked to either hold this for the District Attorney's Office to investigate further or communicate with the Contractor's Board and try to get the opinion from them in writing .

asked what would happen if the Board decided to uphold or reject the protest .

Mrs. McKee

explained if the Board upheld the protest then during the next agenda item all bids would be rejected and direction would be taken . She said the problem right now was grant applications were due to the FAA by June 21,2020 , otherwise the project would be pushed to around this time next year . If the protest was rejected then the bid would be put on the agenda to award. Bradley Richardson believed there was always an option available to the Board to reject all bids .

advised that was correct , but the Board could only reject or uphold this bid protest today and another agenda item would be needed to reject all bids . Comm issione r Blundo made a mot ion to uphold the protest filed by NDL Group on May 6, 2020 , based on the following findings and conclusions which wou ld be entered into the minutes of the Board . The Board finds as follows : On April 20 , 2020 , the bid period closed and four bids were received . On Apr il 29 , 2020 , a notice of intent to award the bid was sent. On May 6, 2020 , NDL Group submitted a bid protest. On May 8, 2020 , a notice of publ ic hearing on the bid protest was sent to NDL Group . The scope of work to be accompl ished required a contractor to hold an A license. Silver Sabre held a C-2 electr ical license, which did not allow for the scope of work deta iled in the bid. Mesquite Electr ic, LLC, held a B-2 and a C-2 electrical license, which do not allow for the performance of the scope of work as detailed in the bid. NDL Group held an A license. Based on the Board 's findings the Board concluded an A license was required to perform the work as set forth in the bid documents and no bidder who submitted a bid response held an A license except NDL Group ; seconded by Commissioner Cox.

asked that the Contractor's Board be contacted before this went back out to bid.

made a motion to reject all bids and instruct staff to put it back out to bid with direction to modify the qualifications to bid and ask the Contractor's Board for advice first; seconded by Commissioner Cox ; 4 yeas . She explained that usually bid award items included rejection of the bid, but not on this item . asked why this was needed. Danielle McKee explained this task was for Atkins to provide construction management. Once the construction happened they would be the construction manager and hold weekly meetings, summaries, collect and review prevailing wage reports, etc. This contract would not start until construction started and it was required by the FAA for design, construction and engineering services.

added Atkins also provided all oversight on the contracts that were let for this job .

made a motion to refund $375.00 as had been done in tile past citing that Karl Mitchell was a 100% disabled veteran and these were Mr. Mitchell's emotional support animals; seconded by Commissioner Cox.

said she would like to consider waiving only the $200.00 as $175.00 had been spent.

asked if the money was spent the first time this was approved .

said once they filed the paperwork to get the permit they started spending the money.

believed the law stated he did not have to pay a fee. Attorney Arlette Newvine, representing Karl Mitchell, cited U.S. Code 3604 , which outlined reasonable accommodations. She said she could make the arg ument that demanding the fee up front was essentially in violation of the law, but she had not taken it that far. They were just asking for the refund of the money spent as they did last year and she felt they were entitled to a refund of the full amount. May 19,2020 48. For Possible Action - Discussion and deliberation to consider Karl Mitchell's request for refund of the $375.00 Nye County Code Title 17 Conditional Use Permit application and noticing fees-Cont'd. Planning Director Brett Waggoner said to his knowledge the Code did not have anything that gave the Planning Department or any other department the authority to arbitrarily waive fees adopted by the Board. If the application was accepted the fees had to be taken.

said the public petitioner felt if the Board gave it to Karl Mitchell it should be given to him too as they did a lot of stuff for the County with large cats and animals as they were the only licensed people .

said she had heard they were compensated but she did not know that for a fact.

knew of one time some animals were removed from Jackie Freeman's property and several of the big cats were taken to REXANO's . They charged $15,000.00 but ended up with $20,000.00 for the time they kept those animals impounded .

said she had heard that also but never saw any paperwork and could not testify if that was true. Savannah Rucker advised the County paid them $18,000.00 for housing of seized animals in FY17.

Comm issioner Koenig said in the past he had seen special requests to keep a business operating which essentially let them go around licensing by using special events.

said there were also situations with people trying to get a license for over six months. The licensing .was moved to Admin to streamline the process, but the licensing department seemed to be held up while waiting for the Sheriff Office background checks , who blamed that on the State . The background check consisted of wants and warrants and was not a federal background check . said he put in a request for over 14,000 gallons of oil. The oil was not quite ready yet, but it should happen within a week .

asked for an update on Blosser Ranch Road and the request Steve Johnson had put in.

Mr. Dahl

advised he had revisited the area and looked at the maps , but he could not find a right-of-way to get to Mr. Johnson 's property . There was right-of-way in front and on both sides of his property . Mr. Dahl explained it would probably cost the County $100,000.00 to rent a piece of equipment to knock down the hills and make a road out of it. He pointed out there was a route established from Mesquite, Kitty Hawk and Blosser Ranch that emergency services could use at any time to access those properties .

asked Mr. Dahl to take a look at Kitty Hawk because it was full of washboards and ripples from Mesquite almost to the corner of Blosser Ranch Road.

thanked Mr. Dahl for the K-rails along Gamebird and Pahrump Valley Boulevard and asked for an update on the yellow flashing left turn signal for Homestead traveling north.

said she was an appointed member of the Indigent Defense Services Board (IDSB) and was aware of the nuances around the public defender services. Since that appointment was an unpaid position she did not think it would affect her ability to vote on this item.

referred to the Sixth Amendment regarding the right to a fair trial and the right to have the assistance of counsel for defense. He believed it was within the purview and authority of this Board to select the most qualified applicants .

thought the motion was premature as he would have liked to have heard from the applicants first. He also thought the Board needed to break away from just giving contracts.

Commissioner Wichman

said there were qualified applicants right now and she did not think the indigent clients would agree with changing it up just for the sake of changing it up as it could take nine months for those people to transition to another public defender. Randall Pike, an attorney in southern California, said he served as the assistant department head for the Clark County special public defender's office for the last ten years and was now an administrator for that office . He had handled death penalty cases since the 1980s and supervised the Family Defense Project in Clark County. As far as time to transition , Mr. Pike said it could take up to nine months for the complicated cases like murder and sexual assault. As to wanting someone different, he felt it was because people got used to the same type of practices and said if the Board wanted the best affordable constitutional attorney it required some change at some time .

said she spoke with staff yesterday about the recommendations and they said they did not have any complaints against any of the people. She thought the people who lived here should be given first choice and the money needed to be kept in the County. She would support the motion.

said the Board did not not seem to have a problem giving nine months the last go around when things were changed up and a contract was taken away from an individual with 25 years experience and given to an individual with a few months experience in the courtroom. He felt this was a serious situation about the Constitution and liabilities and he could not support these individuals at this time . May 19,2020 28. explained many of the properties listed on the auction for sale in Manhattan were County roads and a pipeline for the water system as well as properties that had something to do with County infrastructure. For public purpose they needed to be held in the County's name so they were not showing on the auction every year .

asked what would happen to the taxes that were owed. Samantha Tackett advised the back taxes would be paid as the NRS did not allow non­ payment for these types of uses even though it was a public use. Tim Sutton added there were certain instances where back taxes could be waived , but there were very narrow exceptions as in most cases taxes were paid to other entities besides the County. John Prudhont clarified the taxes would be removed from the record, not paid. In her opinion Mr. Joerger was very abrupt and rude but did his job defending his clients . She felt that other attorneys with more experience should have been considered . Justice of the Peace Kent Jasperson did not believe the judges were asked their opinion of the current public defenders. He also had an e-mail from the County Manager regarding why two public defenders were appointed to represent one defendant who was not entitled to have two and the waste of taxpayer dollars to do this . The e-mail said he checked with Judge Lane who said he appointed the two public defenders because they could be ready in time for trial and although they were young and inexperienced he believed they could handle it together. Judge Jasperson said if two public defenders had to be appointed because of their inexperience that meant more taxpayer dollars being wasted to accomplish the mission of the courts.

disclosed she was a well drilling contractor and brokered in water rights . Under water resources the Yellow Pine Solar Project said they would haul water to the site in the area of 600 acre feet. Multiplying that by the acre foot number and 5,000 gallons a truck equaled 39,000 trips to get water and she was not happy with that. She wondered why they were not making a water facility on-site.

explained the Tonopah Museum had a County employee so there was a considerable amount budgeted for Tonopah instead of Pahrump, but there was no longer a County employee there . She also drew everyone 's attention to where May 19, 2020 39. For Possible Action - Discussion and deliberation related to the segregation of the Museum fund tax rate between the two County museum funds: Pahrump Museum Fund (10214) and Tonopah Museum Fund (10215)-Cont'd. the money came from to pay for this and what services were being offered in Tonopah. If it was less than 50% of the revenues some of those services would be lost. There were opportunities in Pahrump to get some of the services the rural areas did not have access to. Add itionally, the Tonopah Museum was used by people from all over the country as a research facility and was one of the top research facilities in the entire State. Commissioner Wichman said she would hate to see it suffer because of a 10% reduction in revenue when they were already struggling to make ends meet.

said she was the liaison for the Pahrump Museum and what she saw was the Central Nevada Museum had foot traffic of about 4,000 people annually and the Pahrump Museum had 8,897. Also , the Central Nevada Museum brought in 41% of the proceeds and the Pahrump Museum brought in 59% . She realized at times different things needed to be subsidized, but she made the motion because the visitor numbers were so different.

adv ised he had a discussion with Mrs. Rucker about using room tax money to further subsidize museums and he would like her to look at that. Comm issioner Wichman said one thing distinctly different between the visitors in Pahrump and Tonopah was Tonopah had visitors that came and spent a week in that facility doing their research and that counted as one visitor. Ammie Nelson said if the researchers were staying a week and being counted every day they came in that might contribute to higher foot traffic than there really was in Tonopah . Ms. Nelson also pointed out to Commissioner Wichman that Pahrump was rural as well and had foot traffic from allover the world also . Alan Metscher, co-founder of the Central Nevada Museum 45 years ago, said he was involved in the formation of the museum from the day the doors were opened . Now he was the president of the Central Nevada Historical Society. Mr. Metscher stressed the importance of the Central Nevada Museum to Tonopah , the County, the State, and the United States based on the amount of requests they received as well as the compliments on the museum itself. He felt blind sided and stated they had been conservative with their money and it seemed like they were being penalized for that. Marilyn Davis , the museum director for the Pahrump Valley Museum, said they were not trying to penalize Tonopah or the Central Nevada Museum. She said Commissioner Wichman told them in December, 2016, to reach into their pockets and come up with money from the community . Ms. Davis said she took that to heart and provided back-up to the Commission showing what income above and beyond the County money they had been able to raise. She pointed out that as of today the Pahrump Museum had May 19, 2020 39. asked if use of the room tax to make this whole could be investigated a little further before a decision was made on what to put in the accounts .

suggested a friendly amendment to the motion . She suggested putting it at 50/50 and do some investigation on how to subsidize this with other sources and get more funding for Pahrump.

said she would prefer to hear it another day rather than make that motion change. She asked if there was a way to rollover funds not used year to year to encourage frugalness.

explained that was the purpose of setting up the two separate funds so the museums were in charge of their own ending fund balance and whatever rolled over year to year was for that museum's use .

said she would like to let the motion stand and have another item brought back regarding subsidizing the museums with the room tax .

did not know where the room tax would come from and did not support raising the room tax for this which meant it would be taken away from something else. He said he would be willing to fluctuate the split for a few years.

said Governor Sisolak called him on Friday to make sure the County did not need any additional help because of the earthquake . Sam Merlino advised her office had received approximately 5,000 voted ballots in the mail. She encouraged everyone to return them by mail or drop them off at the office. There were 3,800 ballots returned as undeliverable for people who had moved and not notified her office . Mrs. Merlino said those would be addressed after the election as she could not by law do anything with them now.

said she also received a phone call from Governor Sisolak, which she thought was commendable. The Attorney General had contacted her as well and said if the County needed any help to give him a call and he would send whatever he could.

This is a follow up to the public comment I submitted at the May 11,2020 BoCC meeting in reference to the lack of a budget for the Town of Belmont. Per the Unincorporated Town Government Law, in the creation of the Belmont Town Advisory Board, the County Commissioners are required to "solicit the advice of the town board in the preparation of the tentative budget for the town affected." This is not an option, this is required. Why is the BoCC shirking this responsibility? This tentative budget is to be submitted to the Nevada Department of Taxation for approval. In the nearly 25 years since their creation, this has never been done and therefore no audit has ever been done on the records of the Belmont Town Advisory Board. The Belmont Town Advisory Board claims the Town of Belmont owns property in Belmont. How can an unincorporated town or its town advisory board own property? That is to be a County provided service. These properties they claim to own do not show up on the official secured assessment roll for Nye County. In a hastily called special teleconference meeting of the Nye County Commissioners on April 24, 2013 , Nye County Resolution 2013-17 was presented and adopted. This resolution was the only item on the agenda of a meeting that lasted 1 minute and 47 seconds, including the pledge of allegiance. This resolution granted title to three parcels in Belmont from the Nye County Treasures Trust to a non-existent, phantom local government entity of the "Town ofBelmont". This Town of Belmont has a different mailing address than does the Belmont Town Advisory Board. Nobody knows who this non-existent phantom local government consists of. This Town ofBelmont entity did not have to pay the $7,391 in delinquent taxes for these parcels and does not have to pay property taxes on these parcels because the County improperly granted this non-existent phantom local government tax-exempt status. From where I sit, these failures to abide by State law smack of defrauding the Government of taxes and revenue. Therefore, I have asked the State to investigate these transgressions. NRS 269 .590 and Nye County Code § 2.20.050 state that the board of County Commissioners "shall: Solicit the advice of the town advisory board in the preparation of the tentative budget for the town . .. " Presently, the County Commissioners (BoCC) is in the process of putting tentative budgets together for FY 20-21. Documenting a budget for the unincorporated Town of Belmont is not being included in this BoCC process. This is unacceptable. The BoCC has been questioned why this is not occurring, but deferred to the County Comptroller. During the May II , 2020 BoCC meeting, the Nye County Comptroller stated that Belmont does not have a budget, because the State has not established a tax rate for the town. Her explanation failed to tell the whole story. How would the Nevada Department of Taxation (DTax) establish a tax rate if there is not a tentative budget for this town? Is DTax clairvoyant to the undocumented needs of unincorporated towns ? Which comes first , the tentative budget or the State tax rate? According to NRS 354 .578, the tentative budget must be established first. The unincorporated town of Belmont and the BTAB have never had a budget. No audit (NRS 269.615) of any of its records has ever been conducted either. Yet, the unincorporated town of Belmont annually requests, and receives, reimbursements, funds and materials from Nye County for supplies, maintenance and upkeep, etc. as they relate to expenditures designated for the community of Belmont. As an example, as noted in the BTAB meeting minutes of April 6 and June 22 , 2019 , the BT AB just requests money from the BoCC if they need something for the town. Or , they purchase materials and seek reimbursement. There are no records of the BoCC officially documenting these requests. Please see these minutes of the BT AB meetings, attached, pages 4-9. Despite being law, Nye County does not solicit the advice of the BTAB in any preparation of a tentative budget for the Town ofBelmont. Nor does the BTAB hold public meetings to discuss any budget requirements with the community, taxpayers or to share with the County Commissioners. In response to a public records request, even though the BoCC sits as the governing body of the unincorporated Town of Belmont, Nye County Administration, through their Public lnfonnation Office, stated: "The Belmont Town Board is a separate government body not overseen by Nye County and is custodian of their own records." Please see attached (pages 10-11) letter from Nye County Public lnfonnation Officer, dated March 13,2019. This information is incorrect. First, Belmont does not have an elected 'Town Board' but a 'Town Advisory Board" . Second , this advisory board is overseen by Nye County. Thus the Belmont Town Board serves only as a I liaison between the community and Nye County. The Unincorporated Town Government Law notes that unincorporated town government is an adjunct of county government. The Belmont Town Advisory Board claims the town owns several parcels of land in Belmont. The BT AB acts as if they are the owners of these lands and can do with them as they see fit. These parcels (A .P.N. 004-555-06, 004-577-06 and 004-591-03) are shown to have been sold by Nye County to the Town of Belmont, not the Belmont Town Advisory Board. Please see parcel information sheets and quitclaim deeds (documents 818272, 818273 and 818274) for each of these parcels, attached, pages 12-26. According to Nye County, the mailing address for the Belmont Town Advisory Board is P. 0. Box 1432, Tonopah, NV 89049 According to the parcel information, the mailing address for the Town ofBelmont is P.o. Box 153, Tonopah, N V, 89049 These aforementioned parcels do not exist on the official Nye County Assessors secured assessment roll of parcels, dated December 31 , 2019. Thus the y are not being taxed or generating any required revenue. Clearly the Town of Belmont is not a legitimate local government entity and therefore has no authority to conduct business as they have. Neither does the BTAB. According to Nye County Resolution No . 20 13-17(attached, page 27), Nye County claimed " the Town of Belmont (hereinafter "Town") is authorized to acquire property held in trust by Nye County Treasurer, by making application according to the provisions ofNRS 361.603". This property is to be used for public purposes . NRS 361.603 states that " ... any local government. .. may make application to the board of County Commissioners for permission to acquire the property." This resolution was presented and adopted at a special teleconference meeting of the BoCC on April 24 ,2013. Not at a regular meeting as required in NRS 269.580 According to NRS 361.603 delinquent taxes need not be paid on these properties if these properties are for use as "open-space real property" as designated in a city, county or regional comprehensive plan. "Open-space real property" has the meaning ascribed to it in NRS 361 A.040 . No such comprehensive plan (planning or zoning) exists for such properties in Belmont. Therefore, neither the Town ofBelmont nor the Belmont Town Advisory Board can meet the criteria to be granted the tax-exempt status the County has claimed. On these properties, the delinquent taxes and subsequent property taxes need to have been paid by the property owners . The Town of Belmont nor the Belmont Town Advisory Board has ever been taxed for these properties. Neither do they have budgets nor any means to generate the revenue to pay for the taxes associated with these properties. There are no rec ords to show that at any time the Belmont Town Advisory Board , held a public meeting, put on a agenda, to discuss, vote or approve for any person or entity to apply to the County Commissioners to acquire any property. The meeting minutes of the BT AB 2013 meetings are attached, pages 45 - 48. According to the agenda item for the County Commissioners meeting of April 24, 2013 , the application to the commissioners came from an individual , not a local government. This individual was not acting under the authority of the 2 Belmont Town Advisory Board and did not have the legal power to make any application to acquire these properties. Nye County has allowed this individual, without any documentation, to fraudulently apply and then obtain title to these properties for either a non-existent phantom local government entity or a local government entity in which they were not authorized to act or represent. Please see backup material for Nye County Resolution 2013- 17, attached , pages 32­ 48. Thus the government has been defrauded of the delinquent property taxes and subsequent assessed propert y taxes for these parcels. The public has been defrauded as well who depend on the government services that are paid from these taxes Had there ever been an NRS 269.615 audit of the records of the Belmont Town Advisory Board, maybe these violations of law could have been found and corrected at the time they occurred. This fraudulent activity has been allowed to continue by Nye County's and the Belmont Town Advisory Board 's refusal to abide by the laws that have been put in place by the state of Nevada with respect to tentative budget and audits. It has become apparent that the Belmont Town Advisory Board, the unincorporated Town of Belmont and its governing body, Nye County are operating under highly questionable circumstances and under another set of rules that are contrary to the Unincorporated Town Government Law of the State of Nevada. They are also acquiring monies and real property through Nye County that is not being properly documented and followed according to State law. Thus I am requesting that the Nevada Department of Taxation fully investigate this situation and provide a written explanation to the taxpayers as to why this is allowed to happen and how it will be rectified. I am also requesting that Nye County be immediately instructed to determine a tentative budget for the Town of Belmont in accordance with State law. These actions will then finally provide an environment of accountability by document ing how monies and real property are being handled in the Town of Belmont. The budget and audit information the County is required to provide to the Nevada Department of Taxation will obviously be incomplete and any certification of their accuracy and completeness should be questioned. They stated they are going to apply for a grant to do fire breaks. Buddy suggested a fire break from Larry Marshall's house to the rock. The Forest Service would like to do a fire break all around the town. They would stay at lease Y. mile or more from private property. They would also be cleaning weeds and pine needles out from under the trees . Sam commented that we need fire breaks so we don't have major fire problems like other towns have had. This should be no cost to Belmont. Tay made a motion to encourage and support the Forest Service to provide fire protection through brush removal as they deem necessary to protect our fair city . Possible chipping from the top of the hill to connect with the other paving. Discussed asking RTC and Commissioners for overlay of entire road. Stretch says we would be better to wait and let them continue to do the patching on the entire road. Will put this item on the next meeting agenda if repairs to the road has not been done. 7 2. For Possible Action - Discussion and Decision: Possibility of taking the 40 acres below town given to Belmont Town by Nye County and turning it into a park . Tay requested this item be put on the agenda. His suggestion was to turn this area into a "Day Park" with picnic areas and hiking trails. Donna pulled the deed and the property is vested into the name of the Town of Belmont. Donna also printed a small map to show where this property sits and who owns the property around it. Buddy stated that there is a piece of property that goes through the middle of our property that is privately owned. Our part should be 32 acres. There are concerns about if we do this who is going to pay and maintain. If we have picnic tables, should have port a potty. There are also neighbors around that property that are opposed to having the park done. It is a good idea to do a fire break on that property. Stretch stated that once the brush is pulled, the ground could be sprayed to help with future growth. We should definitely work towards getting a fire break around the property. Stretch suggested having the county surveyor survey and mark with pins as to the property lines. Tay made a motion to contact Commissioner Wichman and County Road Supervisor Tim Dahl to request that we have this parcel of land (Parcel # 004­ 591-03) surveyed and marker pins put in. Present : Bud Perchetti, Donna Motis, Janice Berard. General Public Comment: None Minutes from December 1,2012 are available for the public. A motion was made by Bud to approve the minutes of December 1,2012 and seconded by Janice. The motion was approved by all. Reports - (I) State Parks: The Chimney caps for the courthouse have all been installed and they also repainted the cupola. Senate Bill 121 transferring the ownership of the Courthouse from State Parks to Nye County has been introduced to the Legislative committee as of February 13,2013. (2) Information /Update from Commissioner - None. Old Business - Update on Cemetery Progress: Janice gave three more sets of lumber to the Conservation Camp to be cut into pickets for the cribs. Neil has put together another crib. The cribs are almost done. Janice talked to Nick Bradshaw about branding Unknown on the headstones and he stated that the one he did, did not come out very well. It was discussion about installing the wooden headstones and doing the branding at a later time . Present: Bud Perchetti, Donna Motis, Janice Berard, Dana Holbrook, Tay Schuff. General Public Comment: The Tonopah Elks Foundation made a donation to Belmont Town of three solar lights to be attached to our flag poles. John Terras has installed these lights on the flag poles at the fire house, cemetery, and flag pole by the B & B. We thank the Tonopah Elks for their generosity. Tay stated that we will once again begin having church services at the Belmont Church on the second Sunday of each month at 12:00 noon from May to October. John Terras stated that the Treasurer's property sale has parcels that could benefit Belmont if we can get them transferred to Nye County for town use. They are parcels 04-577-06, 04-555-06 and 04-591-03 . Minutes from February 16, 2013 meeting are available for the public. A motion was made by Tay to approve the minutes from February 16, 2013 and seconded by Janice. The motion was approved by all. Reports: (1) State Parks: The ownership transfer of the courthouse from State Parks to Nye County is proceeding nicely through the legislature with no oppos ition and we hope the bill will be signed by the Governor very soon. Neal asked about the mortar mix reports that are to be sent to the county. Per Joni the county has not received the reports yet but she will call Marc and remind him. (2) Commissioner update: Lorinda discussed legislative updates regarding permits on public lands for events and a bill to transfer federal lands to state lands. Old Business: (2) Update on Parks & Rec grant: The benches have been installed and the cabana has been built. We are in the process of getting the prep work done to pour cement pads under all the tables and under the newest cabana. New Business (2) Donna made a motion to purchase four yards of concrete from our Belmont town services & supplies county account to finish up the table pads project for an approximate price of $450.00. Motion was seconded by Bud and approved by all. (1) Weed control: Tay met with the people from Tri County Weed Control to discuss how to eliminate the musk thistle throughout town and stinging nettles in the creek. The Tonopah Conservation District will do a cost sharing - they pay 75% of the cost and property owners pay 25% - to have these noxious weeds sprayed so they will not continue to spread all throughout the town. The musk thistle is very hard to eliminate once it starts to grow. Tri County charges a total of $125 .00 per hour and cost of chemicals and they said they could do Belmont in approximately twenty hours . Tay made a motion to apply for Tri County Weed Control maintenance on the musk thistle and stinging nettle and to also work with the Tonopah Conservation District to get this done. The motion was seconded by Donna and approved by all. Tay & Donna will work with them to do any paperwork that needs to be done. Old Business (1) Update on Cemetery: Janice & Neal have all the cribs done, they just need to be taken to the cemetery and installed. The cribs look great. Janice stated that the fence around the cemetery needs to be tightened . General Public Comment (second) : Tay stated that when he attended the Open Meeting Law training in Pahrump, at the end of the meeting several people were talking about BLM providing fire protection for Belmont. The county has an agreement with BLM and Forest Service for fire protection around Belmont, but there is no way they would ever be able to respond to a fire in town due to the actual time it would take them to get here from Austin or Battle Mountain. Janice stated that she has been unable to obtain Open Meeting Law training in the Reno area and will have to go to Tonopah to watch the video the county has.
