stated she was a sitting County Commissioner and owner of Strickland Construction, T&M Group Realty and Lakeside Storage. They partake in the selling of water rights and the drilling, drilled wells and installed septic tanks. She did not see any conflict of interest on the agenda today. She also disclosed her husband was a certified hemp grower.

Commissioner Blundo

asked for a moment of silence for Dusty Parks. He then asked the County Manager for an update on the items he brought up at the last meeting. Tim Sutton said he would talk with Commissioner Blundo after the meeting.

Commissioner Strickland

Commissioner Koenig

discussed what he was doing trying to open the bars in Nye County. He was presently trying to convince the team and the Governor that there was no difference between a bar that sold food being allowed to serve liquor versus a bar that did not sell food and was not allowed to sell liquor as food did not contribute to people catching COVID. He suggested people send their pleas to the Governor as the Board of County Commissioners did not close the bars and could not open them. As an aside, Commissioner Koenig said whether he agreed with the Governor's mandates or not it made no sense at all to stick the bear.

Commissioner Cox

did not see any difference in being allowed to go to a restaurant without a mask on but she could not sit at a public function or meeting without a mask on although she had a medical excuse. That should also go for the bars. 3. Presentation by the Director of Emerqencv Management regarding the status of the COVID-19 outbreak. Emergency Management Director Scott Lewis said in general terms there was good news. The COVID trajectory had begun to level off with less cases coming in per day, but there were two additional deaths. There were now 469 cases and 29 deaths since last meeting as well as over 410 recovered status patients as of last week. Hospitalizations also appeared to be stabilizing and while testing continued, the interest in testing was slightly diminished. Chief Lewis said the jurisdictional plan prepared by Tim Button was met with success and opened the County in rural areas. He was working with the County Manager and the Chairman to work with the State to reopen the businesses in Pahrump. He also advised he was preparing training requests for emergency personnel to become trained in the vaccinations so there was no lag time when those became available. He then reminded everyone of the unprecedented heat wave starting this week and going through the Labor Day weekend.

Commissioner Cox

said the CDC yesterday released figures that said the actual count of people who had died from COVID was 10,000 out of 160,000 that died.

Commissioner Blundo

asked if the County Health Officer was involved.

Mr. Sutton

advised his contract was terminated and he was working on an item for a replacement which would come to the Board shortly.

said he wanted agenda items for the State meetings so they could be discussed and he stressed the need to reopen.

Commissioner Koenig

stated he was doing everything he could with the State to convince the Governor to let the County reopen and suggested Commissioner Blundo call them. September 1, 2020

for fighting to open the County up. He also said all members on the water board should resign except Helene Williams because the water board was not a friend of the citizens. Kelli Sater, owner of the Bearded Lady Saloon, said she opened in December, 2019, and was closed three months later. She reopened on May 29, 2020, and was forced to close again. The previous SBA loans she received were enough for the first closure, but not the second one. There were no other relief funds out there that she could find to help this closure. She and her employees were not eligible for unemployment as they had not worked long enough. If she did not open soon she would not be able to open again and her employees would be unemployed. Ms. Sater asked the Board to do whatever was in their power to get the businesses back open. She also felt it was unfair that small businesses had to be closed while casinos could be open. Helene Williams asked Fire Chief Scott Lewis to clarify the correct way to wear a mask as she believed the nose needed to be covered. She said if people did not comply the businesses that were opened now could be closed down the road by OSHA, who was heavily fining businesses if people who came in did not wear a mask. Carol Flues spoke on behalf of Christina McKnight who could not attend the meeting.

Ms. McKnight

was currently the manager of Tumbleweed Tavern and she discussed the impact the shutdown was having on the gaming portion of her establishment. Ms. McKnight asked the Board to let the establishments reopen and get the economy back on track. Matthew Burg talked about cloud seeding and the benefits of having two programs running at the same time. Amber Lopez, a bartender in town, said on March 17, 2020, the Governor decided it was in the best interest of the State to close businesses down. She did not receive unemployment funds until June and got further and further behind in her bills. She was now jobless with no income and no way to support her children. She said her bar did open at the beginning of June, but it was shut down again a month later. Kalif Gordon said the only solution he saw was to move forward to put Pahrump on the map and say the citizens were not going to stand for this anymore. He was sure there September 1, 2020 6. Darrell Lackey said he had a solution to end homelessness in Pahrump. He said 1/48 of the $2.4 million Pahrump was thinking about spending on the ball field would be sufficient for him to start his program. He felt the program should be started to turn homeless into taxpayers. Sherry Mills, a worker at the Hideaway Bar, said when she reached out to the Board via e-mails her concerns were brushed off and she was told to look for employment in Beatty or Amargosa. She pointed out they had their own small communities and the bartenders there had the same concerns. Small bars in Pahrump were essential to the locals as was keeping her home and paying her bills. If she did not get back to work soon everything in her iife was in jeopardy. Ms. Mills asked the Board to reconsider opening the local establishments.

Commissioner Strickland

said the Board's hands were tied and everyone who spoke today should send their concerns to the Governor. Debbie Cullen said the people realized the Board of County Commissioners did not have the ability to reopen the bars, but they were hoping that by presenting the individual stories as to how the shutdown had affected them it may persuade the State to reconsider reopening. Ms. Cullen then talked about how the shutdown was affecting her financially, physically and emotionally. Tiffany Seeback said she was running for State Senate in District 19. She said the County had to reopen otherwise the community would not make it. She felt the bars were essential because they employed a lot of people and gave back to the community.

stated she would fight for Pahrump when she was in the Senate. Bruce Hamburg stated his support of the bars reopening. Mike Toews, representing the Tatuado Wild Side Tavern, said they took note of some of the mandates from the Governor and were the first bar to implement plexiglass between the gaming machines. The Gaming Board visited and was impressed with the partitions. Mr. Toews stated they were doing their part and striving to ensure that everybody including employees wore masks and attempted to maintain social distancing. While they knew there was nothing this Board could, Mr. Toews said the Governor needed to be told there were many placing striving to comply and people needed to get back to work.

said they mentioned on the call the other day that next week the State would have their site open to get money back to businesses that were closed and September 1, 2020 6. Nye County's site was up right now. Elizabeth Payton, a bartender at Who's Dunes, read a letter from Dean Hendriz, the owner, describing the emotional and financial impacts the shutdown was having. Ms. Payton said being out of work had almost ruined her life as bartending was the only thing she could do due to her physical limitations. Her husband was out of work also. Debra Felix said she was currently the general manager and wife of one of the partners of the Phoenix Bar aka The Office. After a fire in October, 2019, they completed extensive remodeling and were able to open the restaurant side on March 16, 2020, but at midnight they had to close. The income was not enough to pay the mortgage, insurance and monthly bills associated with the business and they could no longer use their own money to support it. Only with the bar open and gaming would they survive and Ms. Felix asked the Board to please help open Nye County and Nevada. Melanie Everett wished the community and the country opened up while staying safe. She talked about how the shutdown had affected her mentally and emotionally. Robin Asaph, one of many displaced bartenders in the County, noted the bars were some of the first to close and had yet to reopen. She asked for steps and protocols so everyone could get back to work. Melissa Blundo disagreed that the Board's hands were tied. Lander County stood up and said no to the Governor and set aside funds in case any of the businesses were fined. She was disgusted Nye County could not do what Lander County did and tell the Governor no. Tom Laskowski, the other half of Deb Felix, the owners and proprietors of the Phoenix Bar, reaffirmed everything Ms. Felix said as well as everyone else. He stated if the bear had to be poked he was ready. Melissa Fay commented on how the only one she saw fighting for the community was

pointed out that Round Mountain was the only community in the County that collected its own gas tax. There was a plan started by the former town manager, who was pretty convinced the town could take care of its own roads. She asked Ms. Olmedo if the County could find a way to help with the road situation if the town board would have an appetite to turn that gas tax back over to the County.

Ms. Olmedo

said she put the project into the hands of administration until a solution could be found. She said an average of $60,000.00 was not enough to even have a proper road department. She came to the Board today hoping for grant money to help a situation and to entice the Board to take over some roads that were in better shape.

Commissioner Wichman

commented she had an issue with the town not wanting to take the money from its coffers but it could come to the County asking for help. September 1, 2020 9.10:00 a.m.- For Possible Action - 3rd Community Development Block Grant (CDBG)Public Meeting: 1) Presentation of potential projects: and 2) Invite the public to participate by providing ideas, comments and suggestions concerning the proposed projects-Cont'd. Kalif Gordon presented his project for development of a retail gun shop with an indoor range at the old DMV building for a cost of $850,000.00. He said the grant would be used for the expansion to get more community involvement, to provide jobs, and to carry out the meaning of the Second Amendment. Captain David Boruchowitz, president of the Pahrump Disability Outreach Program (PDOP), presented his Pahrump Disability Outreach Rehabilitation and Education Center project for a cost of $395,000.00 for the land, the building and furnishing of the building. PDOP was a non-profit support group serving disabled children and adults in the County. There was no organization or facility in the County providing vocational rehabilitation or employment training for individuals with disabilities. They were currently renting a small office without sufficient space or resources to provide those services. The purpose of this project was to construct a permanent location for the Pahrump Disability Outreach Rehabilitation and Education Center to provide services to the community.

Commissioner Wichman

asked if this program would work with other communities in the County as well for transportation to and from the center. Captain Boruchowitz said he would have to work on that. The long-term goal was to have a housing section so people could have a sense of independence. The proposed location was the same plot of land the prior speaker talked about. If that location was no longer available then Captain Boruchowitz said they would find a similar location.

Commissioner Cox

suggested looking at some of the properties the County had available. John Bosta said on July 21, 2020, he suggested the Board look at the Brownfields grant in Amargosa Valley which was turned down because the County took the property. He asked if that was considered on today's agenda.

Commissioner Wichman

asked if the proposals today had been approved through the program yet.

Ms. Kramer

said no. The projects had to be presented to the Board in order to be submitted to CDBG for eligibility.

Mr. Bosta

said there was still glass, etc., on the property he talked about and Brownfields never it cleared up. It had been fenced and there was a water tank on it. He had asked the Board on July 21, 2020, to consider reinstating that Brownfields project. said she thought that was not a CDBG project but rather a Brownfields project.

agreed and said she would reach out to Mr. Bosta at a later time to discuss it. Herman Lewis stated his support of Captain Boruchowitz's project. Robert Adams asked if Captain Boruchowitz's project was duplicating what Nye Communities Coalition already did.

Commissioner Strickland

advised from her knowledge he was currently leasing from Nye Communities Coalition. Ammie Nelson thought Captain Boruchowitz's project was a tremendous program for the entire County. Melissa Fay said she was looking to put in an application on behalf of Miracles of Madness, Inc., to open a diner style soup kitchen by donation concept only. She felt it was needed in the community for everyone. They had not chosen a location and was going to ask the County for property or a building. They would also look at renting.

mentioned the potholes on Elderberry and Ranger. She had also received complaints again about the turnoff at Highway 160 and LIS-95 because it was so dark.

Commissioner Strickland

asked if the materials were available yet for the light at Highway 160 and Homestead to make it a double turn lane or at least a longer light to allow time to turn.

Mr. Boiling

advised they were still waiting on the manufacturing of the software for that.

Commissioner Blundo

encouraged the public to use the on-line method to report road issues and mentioned the new link for general road repair requests. He said he would like to finish Cabo and Quail Run by the end of summer. Ammie Nelson commended Commissioner Blundo for getting a number of issues addressed since he became the Chair of the Highway Commission. Pat Minshall from the Amargosa Town Board said at the last town board meeting several comments and complaints were made about Farm Road just east of Valley View. The speed limit there was 55 mph and someone said that there had been a sign there stating 35 mph, which would be appropriate since it was coming into a residential area. She had e-mailed Tim Dahl about it. She then asked in the Lewis and Brushwood area if that was taking out trees or just cutting them back.

asked why another roundabout was being entertained. Public Works Director Tim Dahl explained this offer of dedication was for a development at the corner of Basin and Blagg and for right-of-way that would allow an opportunity to include another roundabout in Pahrump in the future. This intersection was originally slated for a signalized intersection and since so much had been learned about how the roundabouts were significantly safer and required less maintenance they would like to continue to put roundabouts in the community. Mr. Dahl said there were approximately 32 conflicts in a signalized intersection and only eight conflicts in a roundabout. Considering that decrease he felt it was safer for the public. The offer of dedication would still be needed even If the Board decided to put a signal there in the future.

Commissioner Koenig

wanted to be sure this would not lock the County into doing a roundabout.

Mr. Dahl

thought it would be in the citizens' best interest to get the Board's blessing for another roundabout.

pointed out the Board was not asking for anything else from this development like traffic controls and it would remain a stop sign. September 1, 2020 32. said for the moment that was correct. They were still responsible to do improvements that were recommended by the traffic engineer. As far as improvements on Basin, there was a capital improvement plan to do improvements there from Highway 160 to Blagg within the next couple of years.

Commissioner Koenig

said he was hearing a reluctance on the word roundabout. Since the County needed the offer of dedication and the drainage easement, he said he would make a motion to accept all of this and mention in the motion that future roundabouts would have to come back to the Board for discussion.

Mr. Dahl

said if the County did not get the roundabout right-of-way today it may have to pay for that tomorrow. He feared that might entail having to move permanent improvements that would add additional costs to the taxpayers to obtain that right-of- way that the County was getting today for zero cost.

Commissioner Strickland

made a motion to accept the offer of dedication and to accept the offer of dedication for drainage with no stipulation as to how those dedications would be utilized; seconded by Commissioner Wichman.

wanted a caveat that this would come back to the Board before any project moved forward.

did not see a reason to say how to use the easements. The County just needed the easement for the future and it would always come before the Board. Planning Director Brett Waggoner added the offer of dedication was a condition that was part of the CUP approved by the RPC. He agreed that if the County asked for this later it would have to pay market value for the property, which would be quite a cost difference. Ammie Nelson said she had not heard anything about the buses from the schools that stop and go at that intersection. As far as a roundabout, she felt a four-way LED light would be just as effective and did not support any more roundabouts. September 1, 2020 32. said when he went to the NACO Web site they were putting stuff out there and they asked for a lot more information. He asked what challenges there September 1, 2020 30. For Possible Action - Presentation, discussion and possible amendment of the Nve County CARES Act Policv-Cont'd. were as to why what the Board voted on last go around was not reflected in this regarding working capital and eligibility determination. He said financials were being asked for and Commissioner Blundo thought the County was not going knee deep on people. Savannah Rucker said that was absolutely right, but after reviewing this program with several other entities, NACO and the auditor, proper eligibility needed to be determined and the eligibility needed to be associated with the business for the funding. Without doing due diligence the Treasury could audit the County and find that the money needed to be returned.

Commissioner Blundo

said he would like to discuss moving $500,000.00 out of the Nye category and create a separate sub-category in case anyone got sued so the County would be able to help with those legal bills. Tim Button said he would have to look, but he believed one of the things the money could not be used for was legal fees and OSHA fines may fall under that.

Commissioner Strickland

said she was happy with the document and thought it was simple to qualify.

Commissioner Blundo

disclosed he held a Nye County privilege license as well as a Town of Pahrump business license. Having those licenses and a pecuniary interest in the Town of Pahrump and Nye County would not preclude him from participating in this item.

Ms. Kramer

said the working capital grant application was available on-line for preview and would open on Septembers, 2020. John Bosta asked what the total amount of the policy was, to which Mrs. Rucker responded $8.4 million.

encouraged any business owners who were interested to preview the application as it was first come/first served.

asked if it was one grant per company.

Mrs. Rucker

explained for working capital yes, but they could apply for PPE and working capital and rental assistance. She said the policy was built on best practices for ensuring the County was sufficiently covered for the liability associated with this. The dollars were basically being granted to businesses and the County needed to make sure those business met the criteria so if audited the County did not have to cut the check back to the federal government. said he did not feel the eligibility determination would properly address people who were self-employed. Ammie Nelson said she was reminded of the bar that spoke this morning that had not been open long enough to show any losses but had lost their life savings. She did not know if those kinds of businesses were out there, but this could make a difference in other businesses she had heard about not being open long enough to show the profit versus the loss. Ms. Nelson also suggested a stay on business licenses to help them out. Melissa Fay advised her cleaning company could not go into homes and she claimed it as self-income. explained a lot of problems being seen with the CARES funding was the guidelines were similar between all programs. Unfortunately for businesses that were not qualified for another program that utilized CARES funding it was very similar to the funding received for CARES.

said one thing that worried him was everyone got stimulus money and spent it so the CTAX was great. He thought they bought everything they wanted so now they were in a position where they spent the money, had no jobs, and still had rent, car payments, insurance, etc., so there would be nothing left to spend on extravagant stuff. Tim Sutton added he had an e-mail about several utility accounts that had not been paid and they could not be shut off so those would have to be rectified. PUBLIC PETITIONER

made a motion to re-appoint Midge Carver and Joni Eastley as both of them were founding members of the group, in addition to having Commissioner Strickland as the Board's representative; seconded by Commissioner Blundo. Ammie Nelson thought Commissioner Strickland would be great, but she wondered if it was a conflict since she was the liaison to the NCWD.

said no. In person voting was done on Election Day. In person drop-off for ballots was also done by 7:00 p.m. on Election Day.
