Commissioner Wichman

explained there was a proposed regulation of the Board of Indigent Defense Services currently under review. Existing law required that board to adopt regulations establishing requirements for specific continuing education and experience for attorneys who provide indigent defense services pursuant to NRS 180.320. Sections 33-39 of the proposed regulation established provisions related to the training, education and qualifications of such attorneys. While those regulations were a draft at this point, she believed Nye County would be best in line with the proposed regulations and ensure compliance for when they are in place. She pointed out the ACLU was watching the County very carefully. Even though the regulations had not been approved by the Board of Indigent Defense Services, as a member of that board and knowing intimately what was being proposed Commissioner Wichman said her motion would be to direct staff to notice the vacancy for another 30 days. She appreciated the person applying, but she did not believe the experience was there or that he would meet the requirements and it would be a steep upward climb at this point for him.

made a motion to re-notice and continue for 30 days; seconded by Commissioner Blundo.

confirmed that this application would still be for consideration when this came back in 30 days. He then asked when this contract would expire. Lorina Dellinger advised the contract would expire June 30, 2021, just like the other contracts.
