said the next meeting was on December 1, 2020, so she wanted to make sure everyone had an amazing Thanksgiving holiday and took into consideration what was going on with the current epidemic.

acknowledged and thanked the veterans. He said the new Holiday Task Force Thanksgiving dinner would be on November 26, 2020, from 10:00 a.m. to 1:30 p.m., curbside and pick-up only, at the Nye Communities Coalition. He then said he wanted to write a letter to the Governor regarding COVID. To those who were affected by COVID he hoped the Governor’s diagnosis showed him the disease could be managed without the mandates. Bradley Richardson informed the Commissioners that Chris Arabia sent his regards but was unable to attend today as he was delivering his closing argument in a trial involving the murder of a three-year-old girl.

Mr. Jones

wondered how someone could access funds from a budget that did not exist and have access to funds when they were never approved. He felt it was financial fraud and needed to be investigated. Bruce Schowenberger spoke of the COVID increase in the community. He asked if there was a tally on where they were coming from such as the jail facility, the Sheriff’s facility or if they were primarily counted there. If so, he asked what that count was. He said he agreed with Commissioner Blundo that there was no need to close down the community as more was known about the disease and there was now a vaccine. 5. Approval of the Agenda for November 16, 2020 (Non-action item)-Reopened. Tim Sutton said items 43 and 44 could also be removed from the agenda.

explained the procedure for this appeal hearing per Nye County Code Title 6. Allene Gundersen, the person handling the dog at the time of the incidents, was present via telephone. said this appeal involved a black lab mix known as Valentine. He asked if the owners of the dog were notified by Lieutenant Thomas Klenczar that he had classified the dog as dangerous. Animal Control Officer Susan Ryhal said that was correct. She was present with Lieutenant Klenczar and Sheriff Wehrly.

asked if the notice provided to the owners of the dog complied with NCC Section 6.20.030, to which Officer Ryhal responded yes.

asked if there was any documentation Officer Ryhal would like to present to the Board regarding the notification and any responses thereto. Officer Ryhal believed back-up was provided with the agenda request.

made a motion to accept the documents from Animal Control and additional back-up; seconded by Commissioner Wichman; 4 yeas. Officer Ryhal said the documents in the back-up included the incident report, photographs taken from two of the videos submitted to the Sheriff’s Office of the dog trying to attack the neighbor, and the letters and certification receipt of signature from the certification letters sent to the dog owner. She advised they responded to three separate incidents of the subject dog named Valentine escaping her owner’s control and running at large on either public or private property and behaving aggressively according to the witnesses. In the third incident the dog actually bit one of the victims while he was driving his gyroplane down a public taxiway causing him to run his plane into the rocks. There was no injury sustained in that incident due to his flight suit being so thick. As to witnesses, Officer Ryhal thought at least three of the victims and one witness to the third incident were on the phone.

Ms. Gundersen

clarified the third incident did not occur exactly the way it was written. She pulled into the back side of her house where the taxiway ran past. She failed to look or hear anything on the taxiway and just nudged her door. The new dog pushed the door open allowing both dogs to enter onto the taxiway. She felt it was not quite stated in that way and the dogs did not attack because they were “dangerous.” The new dog had not lived there very long and was not aware of what he was hearing. As to the first two incidents, Ms. Gundersen said she had tried to establish a rapport with that neighbor since he moved in, but he did not want to be friendly and literally yelled at her one time when she asked to speak with him for a moment before any of the dog incidents. Based on the information he relayed regarding how protective this breed was she felt Valentine was just protecting her. She stated the dogs were never outside the facility without her and the dogs did not remain outside if no one was home. Paul Gundersen, Valentine’s other owner, said Valentine was one of the best dogs they ever had. She was never aggressive toward anyone he was aware of and he was extremely surprised by her behavior now. Her demeanor had changed and he could not explain it. He stated he had not received copies of the videos he requested and he disputed what Officer Ryhal said as he had never seen the dog be aggressive toward anyone or protective in any way, shape or form. If there was something on the video he needed to see he wanted to see it. Mr. Gundersen also did not feel the pictures depicted anything he would classify as dangerous or threatening to the gentleman standing there with guns pointed at his dog, which had now happened twice. Ira Smith said he had been a dog handler for several years and was a certified AKC instructor and evaluator. He was also certified by the Alliance of Therapy Dogs. He said he worked with Valentine when she was younger. He found her to be a very easy dog to work with and felt she was more of an emotional support dog rather than a protector. Mr. Smith believed just from what he had read or seen, although he had also not seen the video, a neighbor’s aggression toward an animal would make a dog more precautious and pretentious when it was in that vicinity. He testified that this particular dog was not dangerous and certainly not a vicious dog by definition. Officer Ryhal felt the statements, the report and photographs of the incidents spoke for themselves. The dog was clearly behaving aggressively and on someone else’s property threatening them.

asked where the video was. Officer Ryhal said the video was submitted into evidence and she explained to Mr. Gundersen how he could obtain that video through a records request. He also had copies of all documents sent to the Board. Leo Fitzgerald said he was the pilot in the gyroplane. He saw the first black dog running at him and he was concerned that they would run into the prop, but as they approached the black dog got ahold of his pants and that was when he swerved off the taxiway. He disagreed with Ms. Gundersen that he was aggressive or not communicating with anyone. He was friends with a lot of people at the airport and was a very good neighbor. He also felt the statement that the dog had never been aggressive was false. Ammie Nelson said labs and pit bulls were known to be protective and people who owned those breeds should be aware this could happen as the dog was the one who suffered. Stan Gorsh said he lived next door to the Gundersens. On the third event he witnessed the dog charging and attacking Mr. Fitzgerald in his gyrocopter.

made a motion to uphold the classification of the dog known as Valentine as a dangerous dog made by Nye County Animal Control based upon the following findings and conclusions that should be entered into the minutes of the Board. The Board finds as follows: 1) notice was given in compliance with NCC Title 6; 2) Mr. and Mrs. Gundersen were the owners of the dog known as Valentine; 3) Valentine did on or about May 30, 2020, August 3, 2020, and September 26, 2020, without provocation behave menacingly to a degree that would lead a reasonable person to defend him or herself against substantial bodily harm and Daryl Governale had to defend himself against Valentine; 4) Valentine was off the premises of its owner or keeper and was not confined in a cage, pen or vehicle on May 30, 2020, August 3, 2020, and September 26, 2020, based upon the testimony presented to the Board and the evidence including the back-up accepted by the Board; 5) no evidence was presented of any exception to the dangerous dog classification as set forth in NCC; 6) this Board orders that the dog and its owner complete a course of obedience or anti-bite training approved by Animal Control and make recommendations to safeguard the health, safety and welfare of the public and of the animal; and 7) once completed the vicious dog classification will at that time be abated and that was ordered to be completed within six months or to return to the Board for review. Tim Sutton confirmed with Commissioner Blundo that the class would be at the owners’ expense. MarIa Zlotek said the dog would also have to register pursuant to the Code they would need to comply with the requirements for possession of a dangerous dog. She suggested including that in the motion.

said she would like to add to the motion the dog had to be muzzled when taken out for a walk until the training was over and to have the dog examined by a veterinarian because she had a dog at one time that did a sudden personality change and it turned out the dog had a kidney infection. She also felt that maybe the personality change was brought about because of the new dog in the house and this dog suddenly felt it needed to protect that dog.

amended his motion to include that until the obedience training was completed and the vicious title had been abated that the animal would have a muzzle when with the owner out of the home and that the animal have a physical at a veterinarian at the owners’ choice and expense to ensure there were no other health concerns that may be agitating the personality of the animal; Commissioner Wichman amended her second; 4 yeas.

Commissioner Blundo

stated he wanted to reject this for two reasons. He believed there was an opportunity to put this back out and bundle a few community projects that would make the County great coming out of the pandemic. By doing that several million dollars would be saved and it would pay for itself by creating those opportunities.

also thought the County could get better funding if options like developer funding was looked at. He had talked with staff and believed it would be on the same timeline, about seven months, so even losing 30 days there were options to make up a little ground. Commissioner Blundo acknowledged the tremendous work and hours the Chairman had put in to moving the shelter forward. If this passed he would make another motion to especially acknowledge Commissioner Koenig and have his name on the shelter when it was built. He asked the Board for their support. said she voted against this originally as she was not happy with the bids. She would be pleased to see this go back out and start over again as she wanted to find more funding to pay for it in advance and believed it may even qualify for some of the money from the CARES Act at this point. Commissioner Cox also wanted to look at some options that became available recently that were not available at the time the bids went out, including the purchase of property other than the site it was at now.

also liked the idea of repackaging and coming up with a combination of things for the money.

pointed out the re-evaluation of the jail bond resulted in a savings of $4.6 million with an interest rate of 1 .93%. The animal shelter itself under the bid awarded to B & H was $3974 million. Commissioner Strickland felt enough money was saved through the refinancing of the jail bond to pay for the animal shelter. If two other projects were going to be talked about she said she would like those disclosed.

said he would like to include the shooter site and the convention center at the south end near the fairgrounds.

said the shooter site was not shovel ready and had no water, sewer or power. The same problem existed with the potential civic center at the fairgrounds, and that particular project was going to be an expensive project to say the least. The County had the ability to get money at today’s interest rate, not seven months from now. She had consulted with other builders, including some of those that

was speaking with, and the price from B & H was a great price for what the County was receiving. Commissioner Strickland stated she had no idea why the Board was at this juncture other than there was another party interested in doing projects in Nye County. She did not know why that person did not step forward at the time of submitting bids and had extreme concerns with how the Board was proceeding.

said he had the same concerns. The interest rate to finance the shelter would probably be about the same interest rate for the jail refinancing, under 2%, and if he got 2% here he would be happy. Also, this was projected to be a 10-year loan. Combining everything else it could be a 20-year loan meaning 10 more years of payments on the shelter. Already 30 days had been lost by putting this off and now more time would be lost by the time plans for every project came in. Commissioner Koenig then talked about the County’s integrity in its bidding process and how doing this would affect that integrity. He did not think this was a good idea. Ammie Nelson stated her opposition to passing this today because when Tail’s End had the shelter and was renting it for $1 .00 it was costing the County under $400,000.00 a year. It had gone from a volunteer situation to a $4 million project which would come from the taxpayers. She thought it was a better idea to just refurbish the building where it was. She also thought the bid was put out too fast before everything was evaluated. Brian Shoemake said he was extremely interested in this topic and supported

Commissioner Blundo’s

motion to postpone this vote because he took a tour of the shelter yesterday and while the volunteers were doing a great job, the building was dilapidated and definitely needed another location. He felt the former Valley’s Edge Country Store location on Bell Vista would be a perfect location for a shelter. Mr. Shoemake had spoken to the owner about it and the price he quoted was $600,000.00 to lease the entire property. When Mr. Shoemake said he was considering it for an animal shelter, the owner said he would give an even better deal. Planning Director Brett Waggoner said the animal shelter was at a shovel ready stage. There was a lot of groundwork to be done with the other projects to get them to the shovel ready stage. He also mentioned the legalities that could be involved if the bid award was taken away from the successful bidder. Savannah Rucker explained when the resolution was created estimates based on the knowledge at the time were used, but the vendor and interest rates were unknown. The resolution had a not to exceed limit of $5 million, the loan would be $4 million, and the rate listed was 4.99%. Commissioner Koenig mentioned rates were at about 2% right now, which would reduce the payment in the resolution to $450,000.00. If this project moved forward this resolution would go to DTAX for review and approval. After that approval the loan would be brought to the Board to execute. As to Commissioner Blundo’s comments about packaging multiple projects together, that could be done, but the projects would need to be ready within a timeframe closer than what it sounded like they would be now. She would need shovel ready projects within six months at the most to deal with funding for all the projects. Treasurer John Prudhont said based on the back-up it looked like this proposal was to be able to put out an RFP for the bond, so it seemed premature to be concerned about the specifics of what the bond looked like. Dwight Lilly said he agreed with Mr. Waggoner and it was time to get the shelter built. Any delays right now to him would just leave the animals and the people working there in the same state they were in now for a longer period of time. Mr. Lilly encouraged the Board to move ahead and get the shelter built. November 16, 2020 10. 10:00 am. clarified the shelter buildings and grounds belonged to the County. The 501(C)3 merely occupied the building. The building was way below standards.

asked Mrs. Rucker to explain what a medium-term obligation bond was.

Mrs. Rucker

said it would go out to bid for a loan, whether a bond or just a traditional financing for a project, for 10 years or less and that was all she had with regard to that portion of the process. This loan would not raise taxes and would be paid out of the capital projects fund which was funded from an existing tax rate. Also, part of the payment would be realized from the savings on the jail bond refinancing.

Commissioner Cox

said she liked Mr. Shoemake’s suggestion as well as looking at the convention center. She did not think there was a rush to do this and she would like to have some more time. She pointed out when this went out for bid it was stated the County would have to find the money. The bidders knew the County might not have the money and may not be able to get the money in time. She thought the obligation was covered and the bidders could not argue with an extra 30 days. That would also cover the integrity mentioned as that information was clearly stated. Commissioner Cox supported Commissioner Blundo’s motion and putting a time limit on it. Commissioner-Elect Frank Carbone said he heard all different timeframes and asked if there was a plan for the items discussed as to how much longer they would be in the process before they were ready for a bid. He would like to get something nailed down that said it would be done because when he took the seat he would ask the questions again. Purchasing and Contracts Administrator Danielle McKee said there was a clause in the contract with B & H Construction that the County had the right to terminate the contract with 30 calendar days written notice, but other than for cause the County shall pay the contractor for part of the work completed. She advised the contractor had already purchased the bond for the project. While she may be mistaken, if Ms. McKee understood correctly contractors pay 10% of the contract for their bond, which would total $397,442.10 the County would have to pay back to the contractor. As to the other two projects, Commissioner Strickland said neither of them were ready and she felt it would be at least a year to a year and a half before the fairgrounds were ready. clarified the bid was not being rejected. The bid was already accepted, everyone knew the cost, and now everyone would just cut their bid. To him that went back to integrity.

said she was torn on this issue, but because it would cost Nye County upwards of $400,000.00 as well as an unknown interest rate in the future against a known interest rate right now she would have to vote nay

felt if the bidder paid for the bond that was on him as the bid specified it was contingent on funding. MarIa Zlotek advised that per the Board’s Rules of Procedure if the chair wished to put forth or second a motion he should relinquish the chair. The action would need to be undone and redone if Commissioner Koenig wanted to second the motion.

said because this was a subdivision and it was close to the new Board coming in as well as the challenge of moving this forward there was a school of thought to put this off. Whether it was approved today or in three months he wanted to make sure that all adjoining roads to the subdivision were addressed. Mason Harvey was present along with Dave Richards from CivilWise Services and Doug Malan from Kempfer Crowell. Mr. Richards explained this was the development agreement required upon the approval of the tentative map and commercial subdivision of the property. They had spent the better part of four for five months negotiating this with County staff to come up with a plan of development that would be covered by this development agreement as to what would be built, who would build it, how things were getting paid for, etc., in an attempt to make sure the County had no outlay of revenues on this project, which he believed this development agreement did. It also laid out the progression of the development and how all the public improvements, including Basin, Lola and Blagg, would be dealt with when development occurred on the site. A master traffic study had to be done at the first phase of development to address the roads and how those would get taken care of before that phase could proceed. As to the drainage plan, Basin was a drainage issue and a master drainage study would do the same thing and be produced prior to the first of phase development to show the Board how all the issues would be addressed.

said he had an issue with the language stating ‘all the dedicated public roadways and curbs within or adjacent to the development would be maintained by the County as required by law” because he wanted it clear that the County would not maintain the streets within the development.

Mr. Richards

clarified that was part of the POA responsibility. The part the County would be responsible for was exactly the same thing on other roads. It was in the County right-of-way and in the County’s control so the County would maintain those improvements. He said there was no development that took on the responsibility of maintaining public right-of-way and public improvements, but they took on the responsibility of building them because their development required that they be built. asked when there would be a public roadway within the proposed development. Brett Waggoner said this was a commercial subdivision and a public roadway within a development would be similar to Mountain Falls and many of the other subdivisions. When roads were offered and dedicated to the County they become public. For this particular project all of the improvements inside would be privately owned by the association and the only part of this project that would become public would be the stuff around the outside.

pointed out it did not sound like that the way it was written with the word “within.”

agreed with that as it would make it clearer.

Mr. Waggoner

advised there was a typographical error in the definition section on page 3 of the development agreement. In the definition for developer the reference to developer meant Pahrump Land, LLC as a limited liability company as developer of the land constituting the property and its successors and assigns or any as permitted under the terms of 12.1 of this agreement. He said section 12.1 did not exist and it should read section 3.8.

referred to the special payments listed in the agreement noting that there was no contribution to the school system.

Commissioner Koenig

said sections 6.2 and 6.3 were kind of open ended, other than a cash contribution to be made prior to completion. He asked what prior to completion meant.

Mr. Richards

explained it was meant to be attached directly to the vertical development of the project. As users came into the project then the contributions would be in effect. There was no contribution to the schools currently proposed because it was not residential. They were proposing a contribution to police and fire services of $20,000.00 each as that was the only thing they saw as pertinent to the project.

asked again about the timeframe.

suggested half of the payment after one year and after three years the other half no matter what happened.

reiterated it was tied to the vertical development of the project. November 16, 2020 11. 10:00 a.m. For Possible Action Public Hearing, discussion and deliberation — — to adopt, amend and adopt, or reject Nye County Bill No. 2020-15-Cont’d. Attorney Doug Malan stated the whole purpose here was to set forth a template and to not load up costs on this developer up front that he then had the burden of for years. The County was not paying a dime. The developer was paying for all infrastructure and everything else and would not receive anything in return until that first phase was pretty much developed and the users were on property. Attorney Malan felt that could probably be discussed and frontloaded a little bit, but if everything was frontloaded it would make it tough to develop 70 acres.

Commissioner Koenig

said his point was when the first phase was done police and fire would be needed, not at the end. It was unfair for the County to shoulder the complete burden and wait until the development was done in ten years. Additionally, once the developer has agreed to pay the $20,000.00 no impact fees had to be paid for police for fire. Attorney Malan said that was incorrect. They were already paying the normal impact fees. The contributions were on top of that.

was fine with the modification of section 3.8 brought by staff. As to Commissioner Koenig’s point, he said to scratch “within.” Regarding the payment,

suggested doing half the payment at the end of phase one and the other half as written. He also wanted to have a $20,000.00 contribution to the animal shelter.

Mr. Harvey

said he was comfortable with the suggestion of half the payment being made prior to the end of the first phase and the balance prior to the end of the last phase. He agreed with Attorney Malan that frontloading that was tough to swallow, however, he would agree with it. He did not have any concern with removing the word “within” in section on 3.8. As to the police and fire, Mr. Harvey knew impact fees were being paid as well as property taxes and asked at what point did the police and fire services become more involved with the development. They thought the first two years of development would not have a need for that and volunteered $20,000.00 for each for potential equipment to help service the site.

He said the additional impact to the fire and Sheriff was going to happen immediately upon any equipment or materials hitting that site. Attorney Malan wanted to make sure Mr. Harvey was okay with the animal shelter contribution as it was never discussed and did feel like a bit of a strong arm right now.

asked about the signature verification threshold being used.

said she did not use software for that, although the larger counties did. Her office used in-person verification. Not only did she have guidelines from the Secretary of State but her office had a practice as well. The worker had to scan the ballot to see if it was a registered voter. That person validated the signature and if they had any question they called over another staff member. That validation could take up to three staff members and if they could not agree they called on her. Mrs. Merlino said usually the first and last letters were looked at because those were usually close, but there was no threshold because software was not used.

asked how many total votes were processed in this general election.

said there was a total of 25,427.

said no and that actually the mail-in went really well. The biggest challenge was the same day registration. said he was asked when someone went to vote how easy it would be for someone to say the address showing was theirs, but it was not that individual. He asked what level of checks and balances existed.

explained if there were ten Tom Smiths in the system the worker would pull up the first Tom Smith. The worker saw the same thing the voter saw and asked if this information was correct. Right then the voter would say no, that was not them, so the worker would look up the next one and so on until the correct voter was found.

asked how many votes there were from individuals from a different state that only voted for president and vice president.

Mrs. Merlino

thought there were only three or four and explained they were considered new residents, not out of state. There were two types of presidential ballots one for non-fixed residents which had been around forever and another for new residents who had been in Nevada for less than 30 days.

asked if it had been verified that no deceased individuals voted.

Mrs. Merlino

believed there was one individual who voted and then indication was received later from Vital Statistics that the voter had passed away, but the ballot was signed prior to the individual passing away. She said there had been no other indicators that anyone had passed. She added only active voters were sent mail-in ballots, not inactive.

asked her to speak to the Dominion Voting System situation.

Mrs. Merlino

advised the whole State started using the system in 2004 under the name Sequoia. It then switched to Dominion, but she could not recall what year. The whole system updated in 2018 with the touch pad screens. She had dealt with Dominion since 2004 and there had never been an issue. Pre-tests and post-tests were done and she had several checks and balances she had to do. She had to check the firmware before and after the election; do a hash calculation; re-run a specific set of ballots not only on the touch screens but also the scan the paper ballots went through; and a certain test deck had to be run through both of those before and after to make sure everything stayed the same and everything was being counted. Mrs. Merlino encouraged everyone to go to Dominion Voting Systems and read their press release. Dominion did the programming based on what she gave them and then she tested everything as well as her staff.

asked Mrs. Merlino to explain how a candidate at 9:00 p.m. could have 10,000 votes and then at 10:30 p.m. the number changed and he had 90,000 votes. November 16, 2020 32. said she could not speak for other states and other state laws and there were different Dominion systems, but Dominion’s press release said that did not happen. She then read a portion of that press release stating Dominion did not serve all of the counties in Pennsylvania.

asked Mrs. Merlino on the night of the election when the votes were being counted if there was a time when the vote counting was stopped and then continued the next day or the next Monday.

explained there were two different ways the votes were counted. One was from the touch screen, which were on USB5 and done immediately on both ends of the County at the same time. As to the mail ballots, according to AB4 those could start being processed on October 19, 2020, because of the volume. That process started on October 19, 2020, and the last ballots were counted on November 13, 2020, which was the deadline for counting any late ballots postmarked by Election Day.

said she was told votes were not being counted on Wednesday and would start on Thursday.

Mrs. Merlino

said there were drop boxes in Round Mountain, Amargosa, Beatty, Duckwater and Pahrump and all those ballots had to be brought back, the board had to gather again to process the ballots, and then they had to be counted. The majority of everything was counted by November 16, 2020. Last week 13 ballots trickled in and were counted on November 13, 2020 and the provisionals and same day registrations were reconciled on Thursday.

asked if all the machine votes were counted right away on election night and Mrs. Merlino did not have to go back into the machines after that, to which

asked when the paper ballots were received via mail if those were put into a machine or counted manually.

Mrs. Merlino

explained they were scanned and there was a board that sat with her staff to observe the process. It was not a hand count.

asked if the machine counts were mixed in any way with the original counts on the night of the election or if they were separated so it was known which were done that night and which were done later.

pointed out the summary showed mail, early voting and Election Day. The mail was everything counted between October 19, 2020 and November 13, 2020. asked if the machines in Tonopah and Pahrump communicated through the internet or the intranet.

said he could talk to IT on how that worked, but it was a secured line between Tonopah and Pahrump over the internet. Ammie Nelson said people were not aware that they needed to contact the Clerk and advise that they had moved out of state. People were also getting ballots for deceased family members.

Mrs. Merlino

agreed people did not notify her office. The good thing about the mail-in election was because 3,000 ballots were returned as undeliverable with forwarding addresses notices were being sent to those voters advising her office wanted to cancel them. Robert Thomas asked if there was a Dominion update within a 10-day period before the election, to which Mrs. Merlino responded no.

asked if any machine with Dominion software was connected to the internet, to which Mrs. Merlino responded not the voting machines.

expressed his concerns with removing funding from the Commission and Admin budgets. He said he did not want to make changes to those two budgets and asked Mrs. Rucker where the difference would come from.

pointed out these were just adjustments to services and supply. Her department was asked to review those services and supply budgets and determine which departments were over-allocated and which were under-allocated. This was a result of that work. As to where the difference would come from, she did not have an answer for that question right now. She explained she generated a formula and applied it to all departments.

said deductions were made from the Sheriff’s Office and Miscellaneous, but there was a big general balloon increase.

Mrs. Rucker

said the column with the negative number affected all departments. That was the 7.5% reduction the Board approved during the budget approval process as a means to reduce the services and supply budgets. There were costs that the 7.5% reduction could not be applied to such as contractual obligations. Based on her calculation she was presenting to the Board that both of those departments needed additional funding to pay the requirements.

noted the summary showed a shortfall of almost $400,000.00.

said part of that was taken care of when the augment for the marijuana revenues was done.

wondered where the $387,000.00 would come from. He understood a program was used to calculate the numbers and he was guessing the program went through past years.

advised seven years of data was reviewed and the extreme highs and extreme lows were excluded. Additionally, it was not a computer program. It was Excel and she and a staff member went line by line through each budget to see what happened in each fiscal year. November 16, 2020 35. referred to the section regarding small businesses putting in for PPE and staff would pay back the lender. He did not want staff to call various banks for one individual to pay off their debts. He asked the Board to entertain paying the individual back and they could check a box stating they were paying it back to the lender and perhaps submit proof of that later. Grants Administrator Samantha Kramer said the working capital program could be utilized to cover any working capital from March, 2020 through December, 2020. The reason the rental program specified delinquent rent and payment directly to the landlord was to make the program easier for applicants. The information they provided in that program was a profit and loss statement showing losses due to COVID and the delinquent payment. The same process applied if a payment was being made on a loan.

said that made sense to her because it allowed for administration and oversight by the County.

felt the people would be held accountable by having them sign a declaration and provide a receipt later. That would also take the burden off of staff.

said he would not have a problem with that if a receipt was provided within so many days after they were given the money. He added that if staff did not have a problem doing this then he did not know why the Board did.

stated she did not want the County held responsible because of a business that received money and then closed its doors.

advised under the working capital program they were issuing grant agreements which outlined that information. The reason the rental assistance program was done this way was to make it easier for the applicant. She then provided updated application figures which now totaled $1 .060 million.

stated he wanted to simplify each program by having an individual sign an affidavit they were paying it back, submit the receipt and then move on.

agreed with that on the PPE, but not the others.

Savannah Rucker added an animal shelter would not qualify for COVID dollars because the animal shelter did not mitigate COVID in any way, shape or form. It was the intention to bring back future budgetary items in December to ensure the County could use these dollars for COVID mitigation and help relieve some of the burden in the general fund with the dollars not used by the public.

advised Linda ranged from $32,022.00 up to $71,160.00 between all three bids. He explained it was optional because the County had to obtain right-of-way. He said he tried to work with the three private property owners who contacted him. All of them liked the way the road was right now and did not agree with the other property owner that wanted to chip seal so they chose to not donate or designate any right-of- way for the County. Mr. DahI had started to prepare an application to the BLM to obtain right-of-way from them, but he did not believe that could be obtained in time to do this contract.

said Commissioner Blundo had every reason to expect her vote on item 10 would be to hold up on the medium term financing because she spoke with him last night and agreed he had a great idea and concept. However, after listening to the comments of her colleagues, the staff and public, several things came to November 16, 2020 47. The first was the current interest rates versus future rates. The second was the contractor had every reason to expect the County to move forward. He would still move forward on the convention center because coming out of the pandemic he saw the southern Nye County redevelopment project that would put Pahrump and Nye County on the map.

said the brothels asked him to send a letter to the Governor begging him to allow them to reopen. The letter was written, but he was trying to get his mind around whether this was really a great time to send a letter like that. The County was spiking like crazy, as was the whole country, and he did not know what the Governor would do next. He would call some of the brothel people tomorrow to get their thoughts on it. If they still wanted it sent he would send it and he offered to send it to the other Commissioners if they wanted to write a letter as well. If the Board wanted an agenda item they should get with staff and have that done. Sam Merlino told Commissioner Blundo she ran a summary and there were 37 under votes and 12 over votes in the presidential race, which came to a total of 25,427. County Clerk / Deputy PUBLIC COMMENT FOR NOVEMBER 16, 2020 NYE COUNTY BoCC MEETING I ask that this statement be included as part of the minutes of this meeting. This is a follow up to statements made at the meeting last Tuesday associated with agenda item # 31, specifically the properties acquired by the Town of Belmont in 2013. At the BoCC meeting, the secretary for the Belmont Town Advisory Board made comments insinuating that my partner, Ms. Janice Berard, participated in a town board meeting and was party to a decision to pay the delinquent taxes to acquire the aforementioned properties. The truth of the matter is really this: 1. Yes, my partner, Ms. Janice Berard was a member of the Belmont Town Advisory Board in 2013 and participated in a meeting were the subject properties were discussed. 2. The minutes of that meeting, as reported by the Town Board secretary, show that a motion was made, by the Town Board secretary, to ask the BoCC to pull the subject properties from the tax auction, and, according to the motion, the debt of penalties and interest shall be forgiven. There was never any mention of any need to purchase the properties or pay the delinquent taxes as was required by Nye County policy. 3. More importantly, there was never any motion, discussion, or approval by the Belmont Town Advisory Board for any person to access funds to pay these delinquent taxes. 4. The minutes of that Town Advisory Board meeting are attached to this statement. 5. The secretary for the Town Board stated at the BoCC meeting last Tuesday, that the delinquent taxes were paid from the budget for Belmont supplied by Nye County. A budget that Nye County has repeatedly stated does not exist because we do not have a tax rate in Belmont. 6. How can someone access funds from a budget that does not exist, but more importantly, have access to these funds when it has never been approved? 7. The act of paying these delinquent taxes, without any authorization from any governmental body constitutes financial fraud. The secretary for the Belmont Town Advisory Board sat in the BoCC meeting last Tuesday and waived around a piece of paper claiming it was a document to support her statements. Unfortunately, this document only shows the financial fraud that has occurred in Belmont. Maybe that is why the document is not submitted so that the public can actually see what has occurred. At the meeting last Tuesday, the Deputy District Attorney stated that the investigation into “the source and tracing of the funds for payment is beyond the assignment to the District Attorney.” The financial fraud that has occurred related to the payment of funds for the Town of Belmont to acquire these properties needs to be investigated.
