said she had thoroughly enjoyed working with all of the Commissioners and she would miss them.

asked what the term was and when it would balloon. Savannah Rucker advised the term was ten years. Key Bank provided the lowest interest rate at 1.51% and that was the bank the County would move forward with if this was approved.

felt this was just a $4.1 million band-aid for a problem because people just did not care enough to go pick up their animals. pointed out the 1.51% interest rate over ten years would pay for the animal shelter and it will only cost the County $319,000.00 in interest to get it done. She said she was proud of staff for making these changes to the County.

Commissioner Koenig

also thanked staff because 1 .51% interest was almost free money and the County never would have gotten that kind of rate in six or seven months.

made a motion to adopt Nye County Bill No. 2020-23; seconded by Commissioner Strickland.

Commissioner Cox

noted it said the money would be for the purpose of acquiring, constructing, improving and equipping building projects in the County including an animal shelter. She asked what the other projects were going to be as well as how much money was for them and how much was for the animal shelter.

Mrs. Rucker

said there were no other projects. This bond was specifically for the shelter project and all construction costs associated with that project.

Commissioner Cox

said the agenda item was not worded that way and felt it should be brought back. She had heard rumors it was going to go to the fairgrounds property.

amended his motion to adopt Nye County Bill No. 2020-23 with an effective adoption date of January 18, 2021; Commissioner Strickland amended her second.

said he understood Commissioner Cox’s question. He explained previous discussions were to do several projects and his thinking at the time was if he could do multiple projects and bundle them together then he could reduce the cost and the contractor would make a profit one time instead of on every single project. He confirmed with Mrs. Rucker this money would be strictly earmarked for the animal shelter.

asked why the County was paying interest on a $4.1 million loan when she knew the bid did not come in that high.

Mrs. Rucker

advised the bid came in at $3974 million. The reason for a $4.1 million bond was because of issuance costs as well as unanticipated costs. That would give the County latitude to use the difference for those costs. There was also capital fund set aside for furnishing of the facility once it was constructed.

Commissioner Blundo

pointed out on page 180 charges for services was shown as $1 .865 million. He asked if that was a typographical error as the math did not work.

said it was.

said the Tonopah jail employee benefits was shown as $849,000.00 and asked where the difference was.

Mr. McArthur

explained those columns just gave the difference between budget to actul.

Commissioner Blundo

referred to other post-employment benefits budgeted at $100,000.00, but there was no actual number shown. Savannah Rucker explained FY20 was the first year the jail fund was set up and there was a delay in timing in getting inmates in the jail and billing ICE. She held off on the OPEB transfer out of this fund to help the fund stabilize and sustain in future years.

asked about the $121,520.00 for accrued payroll and benefits.

Mr. McArthur

explained that represented payroll paid after the end of the year but earned before the year ended.

pointed out the Chairman opened item 10, but Mr. McArthur’s comments were limited to the Nye County audit.

assumed the Chair of the Board of County Commissioners. SITTING AS THE GOVERNING BODY OF THE UNINCORPORATED TOWN OF PAHRUMP 11. For Possible Action Discussion and deliberation to approve, amend and approve, or reject a rate adjustment to be determined for Pahrump Valley Disposal, Inc. to account for: 1) State legislative mandates; 2) Increased participation in recycling coupled with rising costs; 3) Escalating equipment and labor costs; and 4) Unsustainable rates in the current CPI index regarding fees collected for elective waste and recycling services provided to Town of Pahrump citizens to reflect the outcome of increased participation, changing market conditions and associated costs.

said based on past history and PTO 43, which stated the town board may consider and approve a method for adjusting rates which was not based on changes to the CPI, it was his opinion that a simple motion to do that was all that was needed.

. Michelle Nelson advised legal research was not completed as there was a delay in getting information from staff. PTO 43 was specific as to the process that needed to be December 30, 2020 11. For Possible Action Discussion and deliberation to approve, amend and approve, or reject a rate adjustment to be determined for Pahrump Valley Disposal, lnc.-Cont’d. completed in order to make a rate adjustment increase. Doing that would be off the agenda as this item did not provide for those steps. Ms. Nelson’s strong recommendation was to consider waiting for a legal opinion before taking any further action on this item.

asked how much more time the District Attorney would need.

Ms. Nelson

said she had been waiting on information from staff for about a week and a half. Her big concern was some of the e-mails and information she received from Pahrump Valley Disposal’s counsel was not complete and accurate. As soon as she received the information it should take her no longer than a week or two, so the end of January no later than February, but she would prefer the Pahrump meeting in February.

Commissioner Cox

asked that the motion and second be removed and this be brought back in another month to avoid legal issues.

felt PTO 43 was clear and gave the Board permission to do what he just did.
