Commissioner Blundo

asked what the vaccination allocation from Johnson & Johnson looked like. March 2, 2021 2. Presentation by the Director of Emergency Management regarding the status of the COVID-19 outbreak-Cont’d. Chief Lewis advised it would be received this week and he believed the allocation was 200. They were looking for recommendations and guidance from the CDC and the State as to who should receive those.

Commissioner Carbone

mentioned there were people who were still having issues getting rides. He asked if it had been confirmed that VSP or other transportation companies would need to get those people. Chief Lewis said the hope was the receipt of a single dose vaccine would help alleviate the travel requirements as they only had to get out for first doses.

Commissioner Carbone

asked if it was possible to use some of the COVID funds to help people get rides. Chief Lewis said yes and not only was a plan being formulated for people to come to the vaccination site but also a plan for emergency responders to go to them.

Commissioner Blundo

encouraged reaching out to the transportation groups working out of the senior center as they got a lot of help through the RTC.

Commissioner Jabbour

acknowledged the passing of Marianne Czarevitch, who spent almost her entire career working for the Nye County Sheriff’s Office in Tonopah.

said the New Holiday Task Force was working to do an Easter dinner.

said he wanted to do a workshop for Title 6.

Commissioner Strickland

advised Order 1293 was upheld by the State Engineer. She found it scary how much power the State Engineer and the Division of Water Resources had. Tim Sutton said the County was making inroads with combating the virus and the offices that were closed in whole or partially to the public would be reopened to the public on March 1 5, 2021, except for the courts who said they were not ready so there may be an order coming on that.

asked if the fences there were being pulled back.

Mr. Dahi

explained as a condition for them to dedicate that property he agreed to move all of the fences and trees as well as shut down the well on the property. He then advised he would get more durapatcher oil to start working in Amargosa and Beatty when the weather got warmer. He talked about the chip seal and pavement preservation project. They were preparing a couple of roads in Beatty for an overlay along with the other chip seal program in Pahrump. As to the Pahrump courthouse parking lot, they had durapatched the large cracks and since then he had received a couple of quotes to fill in the rest of the cracks. A slurry seal would then be laid and the parking lot would be re-striped. The parking lot at the Beatty courthouse would be crack sealed. Lastly, Mr. Dahi mentioned Vicki Ann and Thousandaire had been a challenge for Public Works to keep maintained. They would try to do a cold mix overlay on the intersection of Thousandaire and Vicki Ann to bandaid it until funding could be moved around to take care of it.

Commissioner Cox

said the intersections of Mount Charleston Boulevard at Rodeo and Calvada were getting bad. She spoke about Mesquite and SRi 60 at the last meeting. While that meeting was going on an accident occurred there and there had been a couple more since then. There had been so many there since the prison was built she thought it would justify doing something there, even just a light, although Commissioner Cox thought a traffic count should be done with the traffic going in and out of the prison. March 2, 2021 9. asked if NDOT mentioned the money for the light would come from another source of funding.

Mr. DahI

believed it was one of NDOT’s priorities as the director was aware of the situation at that intersection.

Commissioner Carbone

mentioned potholes at Quail Run from Leslie to Bannavitch, and there were still items on Blosser from SRi 60 down to Bannavitch that did not get done. He asked if there was an accident study done on Mesquite and SRI 60 showing justification for something there.

Mr. DahI

said he did not know of any results of any safety intersection improvement study done and would ask NDOT.

Commissioner Cox

wondered if a reduction in the speed limit there would help. She also felt CCA should pay for the light.

Commissioner Blundo

asked Mr. DahI to keep thinking about taking care of the rest of Farm Road. Ammie Nelson talked about the tires collecting in the County. She heard they could be shredded and used for roadways that would last forever. She thought the asphalt grinder could grind up some tires. Regarding Mesquite, Mike Lach said if the County stopped letting people sell stuff on the corner who pulled in and out in an area that people were not used to it would clean it up a lot. Pat Minshall said every two or three weeks the western part of Farm Road was being patched over and over again. The areas the durapatcher was used on in the fall were doing great and she hoped that equipment got back out there soon. She asked for a speed study on Farm Road and Valley View. She then repeated the request that the speed limit going east and west on Farm Road be reduced to 35 mph as it was a school bus stop and that school bus signs be put on the east and west sides of Farm Road as the buses stopped there.

Mr. DahI

explained there had been some struggles with the traffic consultant and there was now another consultant on board. Mr. DahI went over the traffic study with him that was needed on Amargosa Farm Road. One he received those results he would bring them to the Board. Mr. DahI advised school bus stop signs were not typically used on March 2, 2021 9. said he supported the signs to make traffic more aware of the bus stops.

Mr. Dahi

Commissioner Blundo

made a motion to approve the project to construct an outdoor public shooting range, continue to discuss the estimated budget projections, and fund as identified at this time to move forward; seconded by Commissioner Jabbour.

Commissioner Carbone

asked if the Board was just looking to put a project in place so if a location was found the County could move forward.

Commissioner Strickland

said correct. There were potential sites and the funding was driven by the sites.

Commissioner Jabbour

was not sure if Bell Vista was being considered, but he did not think there was infrastructure like water and sewer there.

Commissioner Blundo

explained the County was working through Congressional Delegation to get the land, otherwise the County would have to spend the money to clean the land up.

Commissioner Carbone

told Commissioner Jabbour it was BLM land, not County-owned property.

Commissioner Strickland

added the BLM had not had disposable use for the County since 1998. The request through this particular agenda item was the County could build March 2, 2021 16. For Possible Action Discussion and deliberation to: 1) Approve, amend and approve or reject the project to construct an Outdoor Public Shooting Range in Pahrump; 2) Discuss the estimated budget projections; and 3) Discuss possible funding sources-Cont’d. a site that would last 20-30 years and it would never be outgrown if 40 acres could be found.

Commissioner Carbone

said discussion had been had about this not having to be a Commissioner. He felt the Board needed to look at a person’s abilities.

Commissioner Strickland

pointed out the recommendation had to be made prior to July 1, 2021, so the person could begin their term in August, 2021. She thought recruitment would be the way to go.

Commissioner Blundo

said he had a personal interest in serving in this capacity, but he was not opposed to recruitment. Chris Arabia advised the statute did not specify qualifications, but it should be compromised of people from the criminal justice system and the mental health and treatment communities. He thought it was a good idea to try to get someone in the business.

Commissioner Cox

noted it specifically said it should be someone with experience in the fields. She did not think they were looking for a County Commissioner as most would not have the qualifications. She also thought it should not only be advertised in the newspaper but a notice should be sent to organizations that had those qualified people working for them now.

Commissioner Jabbour

said he knew there were qualified individuals in the County for this position and agreed with advertising it extensively. Ammie Nelson commented there was a court system with numerous people in need of not only drug rehabilitation but mental health treatment as well. She felt targeted mailing for the positions should be sent to the mental health facilities. March 2, 2021 17. For Possible Action Discussion and deliberation to appoint an individual from the criminal justice system, and mental health and treatment communities to serve a two-year term on the Nevada Local Justice Reinvestment Coordinating Council (NLJRCC); or discuss recruitment opportunities-Cont’d. Michael Lach agreed that someone should be found that had a criminal justice and/or mental health background and there were people in the County who had that. He felt this was an important position because it would allow the Board to have their say on behalf of their County. Also, someone from within the County would have a different approach when speaking on behalf of the County than someone from Las Vegas.

made a motion to put out an application for people to apply for this particular position; seconded by Commissioner Jabbour; 5 yeas. SHERIFF

Commissioner Blundo

made a motion to approve, accept the fee schedule, execute the agreement and fund from 10101, General Fund; seconded by Commissioner Carbone. Ammie Nelson thought Las Vegas was being used for this already and questioned paying Washoe County for services that should be in Nye. Purchasing and Contracts Administrator Danielle McKee explained this agreement was for cases which occurred in northern Nye County where it would be more beneficial to transport them to Washoe County rather than to Las Vegas.

made a motion to accept Nye County Proclamation No. P2021- 02, a proclamation recognizing the month of April, 2021, as National County Government Month; seconded by Commissioner Blundo; 5 yeas. FINANCE

made a motion to adopt the budget transfer of appropriations between the functions within Nye County Jail Fund 10236; seconded by Commissioner Jabbour; 5 yeas.

Commissioner Blundo

disclosed he was a Nye County business owner and had been for 15 years. He participated in the prior CARES Act Program as both a business owner and a resident of the County. He received County CARES funds, but he did not believe that precluded him from participating in the item. In an abundance of caution, although he disagreed, Commissioner Blundo said he would abstain from voting, step down from the dais, and would participate as a member of the public in his own personal capacity. Grants Administrator Samantha Kramer said the policy had been updated to include guidance received during the workshop. During today’s meeting the Commissioners would establish the funding allocation plan for each item. The first update she wanted to make was on page 3 of the back-up, the small business program. Discussion had March 2, 2021 22. For Possible Action Presentation, discussion, deliberation and possible amendment of: 1) The 2021 Nye County COVID Relief Program and Policy utilizing remaining Federal CARES funding effective January 1, 2021 for the purpose of continuing financial assistance to the public, small businesses, non-profits, and government agencies located within Nye County affected by the COVID-19 Pandemic health emergency; and 2) Presentation and direction to staff regarding the current and future financial condition of Nye County as related to the COVID 19 outbreak-Cont’d. been had that publicly traded companies were ineligible and she wanted to change it to businesses owned by publicly traded corporations would be ineligible, but small business franchisees were eligible. All Commissioners agreed with that change.

Mrs. Kramer

then referred to page 5 of the back-up, the rent, mortgage, and utility assistance program. There was a typographical error in the title that she would fix at the next meeting. She said she wanted to prioritize working with utility companies under the direct utility assistance program before adding utility assistance to the public program. Once the applicant was caught up they could ask for assistance for utilities starting April 1, 2021, under the public rental, mortgage, and utility program. All Commissioners agreed with that change.

Mrs. Kramer

advised she was asked if the program could cover retired individuals with prescription costs who were no longer able to pay their rent or mortgage. She asked if the Board wanted to include that in the policy.

Commissioner Carbone

said he was under the impression it did not matter if they were retired or not and did not think it would be an issue.

Mrs. Kramer

explained her idea would allow the individuals to still request rent or mortgage assistance. It would need to be verified that they were no longer able to pay their rent or mortgage due to increased prescription costs. She asked the Commissioners what kind of documentation would be needed to verify their inability to pay.

Commissioner Carbone

asked the District Attorney how that would be done.

Commissioner Strickland

commented she did not know COVID was affecting medication costs. Chris Arabia said it could. If someone had a pre-existing condition it could be exacerbated due to COVID. To try to verify that would obviously be intrusive on people. On the other hand, it could open the door to fraud. He thought it could be done, but March 2, 2021 22. His office could take a closer look at it if the Commission wanted. All Commissioners agreed to allow the District Attorney to review that issue.

said she wanted to discuss the funding allocation plan, which was page 2 of the back-up.

Commissioner Carbone

thought the Commissioners discussed not having a specific pot for each of the programs, just one pot of money to draw from until the money was gone. All Commissioners agreed to that. Savannah Rucker said the only concern she saw was that time was of the essence and she worried issues could be encountered where all the funding was gone in the first month and only one month could be allowed for assistance for utilities.

Commissioner Carbone

made a motion to accept the changes to the 2021 Nye County CARES Relief Program Policy, including the breakout for the funding for the small business program; seconded by Commissioner Jabbour. Mike Truesdell said he would like more information as this was the first he had heard of it. He had two businesses, one of which was devastated by COVID. Hunter DeMarais said $1.9 million was not a lot of money and while he was an advocate of small business, he thought the amounts needed to be reduced for the size of the businesses. He also suggested no double dipping and to separate out how much an individual could get for their utility or mortgage bill because small businesses would compete against the local people. Robin Rose Yaeger asked for clarification on the number of employees and how they were determined.

Commissioner Strickland

suggested she speak with staff regarding that.

Ms. Yaeger

said some business owners had barely kept afloat during COVID-1 9 and had to reduce employee hours so they no longer counted as full-time employees. If March 2, 2021 22. She was concerned how that situation would affect the employee count.

Mrs. Kramer

advised it would be the total employee count, both full- and part-time. Tim Bohannon cautioned the Board about HIPPA and not being too invasive in gathering information. Leo Blundo said he was speaking in his private capacity and had been a business owner in Pahrump for over 15 years. He thought it was great to have a program serving the community as a lot of businesses were struggling. He suggested maybe an 80/20 split of the money because people were still waiting on DETR or had their hours reduced. Ammie Nelson said she liked the idea of reducing the disbursements to help more people. Melissa Blundo suggested using a small amount of money and advertising this program better than the County CARES Act was.

Mrs. Kramer

asked for the programs that required affirmations, affidavits and agreements to go into effect on March 17, 2021. That would allow them to have District Attorney review of all agreements before the program started as well as advertise the programs properly.

Commissioner Strickland

thought that should be an agenda item for March 16, 2021, as the launch date was not part of this agenda item. Tim Sutton advised this was a discussion of the CARES Policy which included the start date so he felt it fell in line with the agenda.

Commissioner Carbone

withdrew his motion; Commissioner Jabbour withdrew his second.

made a motion to accept the 2021 Nye County COVID Relief Programs with the changes noted during the meeting and include the launching of the March 2, 2021 22. For Possible Action Presentation, discussion, deliberation and possible amendment of: 1) The 2021 Nye County COVID Relief Program and Policy utilizing remaining Federal CARES funding effective January 1, 2021 for the purpose of continuing financial assistance to the public, small businesses, non-profits, and government agencies located within Nye County affected by the COVID-19 Pandemic health emergency; and 2) Presentation and direction to staff regarding the current and future financial condition of Nye County as related to the COVID 19 outbreak-Cont’d. program by the date specified by staff, March 17, 2021; seconded by Commissioner Jabbour. Mike Truesdell said he had two businesses, but he was only interested in the one that had zero employees, just himself.

said he would qualify as zero.

disclosed he was a Nye County business owner and participated in the prior CARES Act Program in the capacity of a business owner and a resident of the County. He was a recipient of County CARES funds; however, he did not believe that would preclude him from participating in this item. In an abundance of caution, he wanted to make everyone aware of that and he felt he could participate with that disclosure. Savannah Rucker said this was an application made with the prior funding from the federal government. Under the CARES sub-entity program, funds could be used for the modification of medical facilities. This application could not be approved under the CARES Program due to the federal procurement requirements associated with the federal dollars. She asked if the Commission wanted to review the application and assess if it could be funded through the new Nye County COVID Relief Program. If approved, this funding would not reduce the $1.9 million available in that program. March 2, 2021 23. For Possible Action Discussion and deliberation to: 1) Consider approving a pending application submitted under the CARES Sub-entity Program for the modification of medical facilities to be funded under the Nye County COVID Relief Program for the Northern Nye County Hospital District (NNCHD) in the amount of $803,683.14 for the total renovation costs of the NNCHD Clinic which included additional costs due to the COVID-19 Pandemic; and 2) Fund $803,683.14 from 10340 Grants-Cont’d.

Commissioner Blundo

thought the hospital district would best be served if they looked for public/private partnerships and he recommended denying this. The money had already been earmarked and now something else could be done with the $800,000.00 to assist them rather than constrain them to that program. That program also closed on December 31, 2020, with reporting requirements already. Commissioner Blundo also wondered why the Board would approve an application when all other applications were reviewed and approved by staff.

Commissioner Cox

felt public/private partnerships did not work well especially if it ended up going sideways and someone was sued. The private party could mess up and take the County with them so to her it was out of the question. She was not thrilled with giving them the money, but she realized the northern part of the County really needed medical care. Commissioner Cox said she would like to look into this a little bit more.

Commissioner Carbone

said he understood this application came about to refund something that was done to support COVID.

Dr. Russell

Pillers said that was correct and the wording on the agenda item was a little off. This expenditure came about because the new healthcare delivery vendor moved into the clinic to begin delivering services. At that point they discovered the building itself would not pass Health Code and needed to be addressed. At that same meeting the COVID issue had arisen and it was determined that the extent of the renovation to address COVID was going to be much more than what was originally envisioned, which drove the numbers. Dr. Pillars knew it seemed extensive and although there was discussion of renovating the clinic, the district was never able to determine how little could be done to become certifiable by the Health Department. The money was spent out of the hospital district’s budget, but the district did not expend that money at the time expecting reimbursement. They saw it as a duty they had to the community to get this done. Later the availability of COVID relief funding showed up and they were asked if they would be willing to put in an application to cover what they saw as COVID-related expenses. Everything on the list of money spent was all due to support COVID in one shape or another.

Commissioner Carbone

asked how many applications the hospital district turned in for the prior CARES Act Program. Samantha Kramer said two. This was the first one and then an additional one was submitted for PPE. March 2, 2021 23. For Possible Action Discussion and deliberation to: 1) Consider approving a pending application submitted under the CARES Sub-entity Program for the modification of medical facilities to be funded under the Nye County COVID Relief Program for the Northern Nye County Hospital District (NNCHD) in the amount of $803,683.14 for the total renovation costs of the NNCHD Clinic which included additional costs due to the COVID-19 Pandemic; and 2) Fund $803,683.14 from 10340 Grants-Cont’d.

Commissioner Jabbour

stated it was imperative that the northern part of the County have and continue to have medical facilities, doctors, and nurses. He knew that this was a lot of money and there were concerns about utilizing the money in a different way to help Tonopah and the surrounding areas, but right now this was what Tonopah had and was trying to sustain. Michelle Nelson advised there were significant concerns from the District Attorney’s perspective regarding this matter and the items that were purchase pre-COVID. The concerns initially did not pass legal review for this item. The District Attorney’s Office had received additional back-up which was not included in the Commissioners’ information. She suggested that either Mrs. Rucker or Mrs. Kramer chime in or that this item be continued so the District Attorney’s Office could provide the Board with a little more clarity.

thought staff just needed to be directed to move forward on the item. Lorina Dellinger said that would be sufficient, but the petitioner was present if the Board wanted to hear about the project. Mike Truesdell said the back-up contained what he wanted to do. The area was a driving range at one time, but was never completed, and he would like to utilize the property and erect something people could use as there was nothing to do in Tonopah. He felt it would be great for the community and tourism.

Commissioner Strickland

said the Cavalry Chapel of Pahrump made lunch for everyone, which was in the breakroom. __day March 2, 2021 27. apologized for missing the last meeting due to health reasons and thanked everyone for their good thoughts and prayers. Jaynee Reeves thanked the church for providing lunch for staff.

said the vaccine was working well and he did not want people to lose faith. Local control was coming to the counties and he looked forward to supporting businesses being open in Nye.
