commented on how tragic the violence in the country was, but said the Second Amendment was the most important thing along with the right to bear arms and the right to free speech. While allowed those, people needed to take their fellow man into consideration.

Commissioner Blundo

said Sam Jones from Flash Gordon would be at Hypno Comics on Saturday from 3:30 p.m. to 6:00 p.m. and the Catholic Church would have their fish fry starting at 4:00 p.m. on Friday.

made a motion to rescind the e-mail sent by the Commissioner on February 22, 2021; seconded by Commissioner Blundo; 5 yeas.

made a motion to ratify, approve the District Attorney’s Office to continue to assist, and approve the District Attorney’s Office to assist in an appeal in the Nevada Supreme Court in the case; seconded by Commissioner Carbone. Bradley Richardson asked that the motion include the case numbers.

restated his motion to ratify the assistance of the District Attorney’s Office in Fifth Judicial District Court Case No. CV37459, approve the District Attorney’s Office to continue to assist in Case No. CV37459, and approve the District Attorney’s Office to assist in an appeal before the Nevada Supreme Court in Case No. 82515; Commissioner Carbone restated his second. March 24, 2021 7. For Possible Action Discussion and deliberation to: 1) Ratify the assistance of the Nye County District Attorney’s Office in Fifth Judicial District Case No. CV 37459 titled In the Matter of the Guardianship of the Person and Estate of Deyan Lyon Sheldon as requested by the Nye County Public Guardian’s Office pursuant to NRS 253.215; 2) Approve the Nye County District Attorney’s Office to continue to assist in that same Case No. CV 37459 as requested by the Nye County Public Guardian’s office; and 3) Approve the Nye County District Attorney’s Office to assist in an appeal before the Nevada Supreme Court in Case No. 82515 titled IN RE: GUARDIANSHIP OF SHELDON as requested by the Nye County Public Guardian’s Office-Cont’d.

Mr. Richardson

explained in 2007 there were substantial changes made to the guardianship statutes. A new provision was added in NRS 253.215 providing that the Public Guardian, in addition to paying the services of private counsel, could utilize the services of the District Attorney’s Office to assist the Public Guardian in cases, but it required the approval of the County Commissioners. Since 2007 the District Attorney’s Office had been assisting with the approval of the Commission, but an attorney in this case indicated to the Nevada Supreme Court that they thought the District Attorney’s Office may not have had that approval. Mr. Richardson said this was a housekeeping matter to ratify the actions of the District Attorney. The Public Guardian should have an agenda item on April 6, 2021, to re-authorize the District Attorney’s Office to assist the Public Guardian’s Office in cases. The attorney involved in this case was appealing Judge Wanker’s decision regarding his fees. Public Guardian Karyn Smith confirmed she would have an item on the April 6, 2021, agenda.
