Commissioner Cox

asked how many deaths there were recently. Chief Lewis said there were three in the past two weeks and five in the last month, but the numbers had been increasing over the last several months. August 3, 2021

Commissioner Strickland

advised she was the one who asked that the chambers be closed given the conditions on Wednesday. The agenda had to be made in advance because of the Open Meeting Law and chambers was still being cleaned up. She had also heard more storms were coming over the weekend, but that did not happen.

said she wanted to be in the Pahrump chambers today to tell the public that and she took responsibility for making that decision as the Chair of the Board.

Commissioner Blundo

thanked the County Manager for the emergency declaration and asked when it would be on the agenda. He then cautioned the public about driving through running water. Tim Sutton thought the emergency declaration was going to be on this agenda. He would get it on the next one.

Commissioner Jabbour

thanked County staff and the volunteers who assisted in the clean-up.

Commissioner Carbone

also thanked the crews who worked to make people safe although they were working in a dangerous situation. Treasurer John Prudhont thanked Buildings & Grounds who were quick to be on site for the flooding in his Pahrump office as well as his staff who worked through the situation. Chris Arabia said he had hoped to be in Tonopah, but he stayed in Pahrump because of a hearing in a murder case that they were considering seeking the death penalty in. Fire Chief Scott Lewis advised they had been working with the State since the first day of floods and high winds. There were two separate property assessment teams from the State in town and assessments were done every day. He said not only were they impressed that most of the culverts were being put back in place, but also that driveways were being repaired to get people in and out of their homes. Public Works Director Tim DahI and his crew worked tirelessly. They were out immediately and working to get the County up and running as was Buildings & Grounds. Tim DahI said their primary concern was providing emergency access and they worked diligently to do that. He had a great team that did a great job. Tim Sutton also expressed his gratitude for staff who came together.

Commissioner Carbone

noted there was a lot of damage beyond the government complex. He said the County had discussed with BLM several times the work that needed to be done on the mountain to divert water in certain areas. Commissioner August 3, 2021 3. Carbone thought the County should sue over the damage as that may get BLM’s attention. Chris Arabia said that was an interesting idea. He would discuss it with his civil team and follow up with Commissioner Carbone later in the week.

said Spring Mountain Raceway was already working on an agreement for a detention pond prior to their facility which could probably be duplicated.

Commissioner Jabbour

said the issue was not new. It existed when he moved to Pahrump in 1994 and to his knowledge years prior to that as well. A family in construction born and raised in Pahrump offered to help BLM divert the water with their heavy equipment and they were repeatedly turned down. Commissioner Jabbour felt the people of Nye County, especially in Pahrump, had been put in danger from Highway 160 to the fan.

asked Ms. Kindred to speak on item 6. August 3, 2021 5. GENERAL PUBLIC COMMENT (up to three-minute time limit per person.) Judith Holmgren reviewed information about prototype vaccines and human trials distribution and asked that it be included in the public record [see Attachment 1]. Joe Burdzinski talked about the storm damage and complimented the County workers. Laura Larsen said the PCR test was not validated and the CDC had recalled the test as it was not effective. She stated forcing or mandating this experimental MRNA vaccine was against the Nuremberg Code and medical mandates were against the citizens’ civil liberties. Ms. Larsen said it was her body and her choice. Pamela Clark said everyone needed to read the Bill of Rights. The governors did not have the right to change that or the Constitution. Sam Jones said the Constitution was the supreme law of the land. Governors could not make law, only legislatures and Congress. He asked the Commissioners to follow the principles that they took an oath to do as well as the principles of the Republican party and the Constitution. Helene Williams, representing the private well owners, said Senator Catherine Cortez Masto introduced the Southern Nevada Economic Development and Conservation Act (SB567). The act moved 2 million acres of public land for conservation and recreation while allowing Clark County to develop affordable housing and responsibly plan for population growth projections adding another 880,000 residents by 2060 by developing 30,633 acres south of Las Vegas toward Primm. The Southern Nevada Water Association (SNWA) strongly endorsed the bill because it helped secure the water resources and facilities that SNWA needed to provide quality, safe water to their customers for decades to come. Ms. Williams felt the bill needed to be tracked and constantly reviewed because of the affect it would have on Basin 162. Melissa Blundo talked about Power to Parent, which was a group that did not believe the Department of Education should be co-parenting children. A protest would be held on August 11, 2021, at 6:00 p.m., at 5100 W. Sahara Avenue. Frank Fondo said he was a retired marine and totally disabled and had no way to leave his home yet the Commissioners were talking about taking away the call-in system. He wondered where that would leave him. He felt it was a tiny expense and it was not fair to keep people from participating in the meeting. Joey Gilbert said there were treatments for COVID-19 with 100% efficacy that worked better than the vaccine. Until the vaccine had been put through all trials he discouraged anyone getting it since it was entirely experimental. Kristi LaBelle pointed out 110 deaths was less than 1 % of the County’s population. Tim Bohannon talked about the floods. He felt a sound basin plan, a reservoir system, BLM acquisition, and use of FEMA money could solve the problems in Pahrump. He was also concerned about floods cutting off access to the hospital. Brian Wulfenstein thanked the Board for their efforts during the recent traumatic events in the community. He wanted the Board to know the Wulfenstein Family was committed to the Board to bring about the proper things in the community. Misha Allen thanked the men and women she proudly served with in response to the pandemic. She felt it was an exceptional example of government and community organizations coming together to serve the people.

was not present. Brittany Marich said she had two children in Nye County schools. She thought a majority of people were not 100% against masks, but the parents should have that choice for their children. She understood the health risks with wearing masks and contracting COVID, and she also knew wearing a mask had higher risks than COVID. August 3, 2021 6. Mrs. Marich

felt the kids needed to be in school to interact socially and they were being harmed by not being able to see and show expressions. She wanted the right to choose and parent her kids 100% and did not want to co-parent with anyone. Priscilla Lane said she was against masks and people should have the choice. Joey Gilbert said 47 studies had confirmed the ineffectiveness of masks against COVID and 32 confirmed their negative health effects. Wearing masks could also create an unsafe work environment due to the drop in oxygen levels. Cindy Lake asked the Board to find out how a case was determined, how much money there was for the hospital for a case, and how much the Governor was getting personally for the mask mandate. She pointed out if the masks worked then this discussion would not be happening. Nicole Stritenberger said she had three children in the County school system. She believed it was the parents’ right to choose to mask their children and themselves. She felt the same for vaccinations. She advised she had COVID, and she had to fight it, which was her choice. No one should be forced to take extreme measures for COVID since those measures were not taken for cancer, the flu, etc. Mrs. Stritenberger hoped the Board took into consideration what everyone said today. Mark Kampf said the agenda item was to determine whether to adopt the CDC guidance and any other guidance from the CDC. It had been made clear that masks were ineffective and there was plenty of information proving that. Lockdowns were also counter-productive to people’s livelihood. Rich Bushart urged the Commission to not modify the existing mask mandate policy. People lived in an ocean of viruses and this one would also pass through the human population like the others. Tammy Brant agreed with people making choices for themselves and that the masks did not work. Amanda Revert said she had two children that would go to the Beatty school, but if there was a mask mandate she would not have her children in school. People should be able to make their own decisions and she hoped the Board would support the people of Nye County in doing that. was present. Tim Bohannon described what he had to go through when he traveled overseas from mask wearing and blood draws to having to be tested before he came home. Laura Larsen noted cloth and paper masks would not filter out COVID as stated on the package of the mask. Masks had been found to contain bacteria which caused respiratory problems. They had also been proven to reduce the oxygen levels and increase carbon dioxide. Masking children in school would reduce their oxygen levels, affecting the brain and reducing their ability to learn. Vanessa Skinner said she had nine children who she home schooled. She felt a lot of families were put in the position to home school because of the masks. Sherry Brian supported the parents who were standing up for their right to choose whether to have their children wear masks. She asked the Board to vote in a way that was for the people and their choices. Rosemarie Johnson said the kids were not being protected and if the masks were pushed she would pull her daughter out of school. She did not trample on anyone’s rights and did not want her rights trampled on.

Mr. Cummings

said masks did not work and had no effectiveness at all. He also knew zinc killed COVID so there was no pandemic. Tina Trenner strongly believed the frustration in the voice of America was heard and some strong choices had to be made, which laid with the Commissioners right now. Kay LaPointe advised the next School District meeting was on August 1 8, 2021, at 5:30 p.m. in Gabbs. She hoped the facilities in Pahrump would be open and people would be able to participate in that meeting. She did not know the status of masks at the schools right now and suggested people contact their local school. Ms. LaPointe felt people needed to keep their right to wear a mask or not and get the vaccine or not. Diane Southworth said she disagreed with everything that had been said. She told the Commissioners to be aware that there were people who knew the information was correct. Lorina Derimow talked about how many times her first grader’s education was interrupted because of issues with her mask. She felt it should be the parents’ decision August 3, 2021 6. Regan Mitchell asked the Board to fight for the children and make masks a choice for parents to make, not the government. Karen Williams urged the Commissioners to not rubber stamp Governor Sisolak’s garbage about the mask mandate. Many people stood up and told them the guidance by the CDC were just recommendations, not laws, and people needed to take personal responsibility for themselves as to whether to wear a mask or take a vaccine. She asked the Commissioners to do nothing on this and let it ride as their previous vote was still in place. Constance Baredziak talked about how her children needed to be in school and asked the Board to not mandate masks as it should be a choice to wear them. Sam Jones felt the Commissioners used common sense in lifting the mandate for Nye County and hoped they continued to do that as governors could not make law. He suggested the Board send a letter to every business in the County advising the mandate had been lifted. Suzanne Wulfenstein felt everyone in the room had COVID whether they knew it or not. She then read a letter written by her husband stating his opposition to mandating children wear masks in school. He hoped the Board would stand up for the children and their right to choose. Janice Cullen noted the mask packages stated it would not keep out particles, but people were scared and followed what the government said. She asked that the Commissioners keep the kids safe and give them the freedom adults had as children. Greg Christensen said the Commissioners needed to do what was right as the kids were the future. Mary Fischer disagreed with masks. Eric May did not believe the masks were necessary as they did not work. Melissa Blundo, speaking as co-founder and chair of the No Mask Nevada Pact, advised the Board that the recent recommendation from the CDC came from a single study in India which was rejected in peer review, but the CDC used it anyway. She said she would continue the fight against the mask mandates along with the other members August 3, 2021 6. Derrick King said he had two children in school and asked that the Commissioners uphold their rights as American citizens. Sonya Sanchez said masks would not save lives. Helene Williams said she became a citizen by choice and she could not be prouder to be a citizen today to see what the people of this community had done by stepping forward. She hoped in the future when there were concerns in the community that they stepped forward then. Yolanda Magley said when the Governor ignored the Constitution then the Governor should be ignored.

asked the Commissioners to let the item die and have the County go on as it had been.

agreed with that, but he felt things needed to be clarified with the schools.

asked to have a resolution to end the state of emergency brought to the Board as well as a resolution against vaccine passports and a resolution that this Board was against critical race theory. He felt the forced mask mandate was a way to control people and take away their constitutional rights.

Commissioner Cox

said the Governor needed to be held responsible for any damage done to anyone due to the mandates. She advised the Board was not responsible for the School District so the people should demand an emergency meeting regarding the masks before the first day of school. Tim Sutton was an elected member of that board and he may be able to help with that.

Commissioner Jabbour

asked why this was even on the agenda when the Commissioners passed what they passed three months ago. Tim Sutton said he was asked by the District Attorney’s Office to put it on the agenda. Michelle Nelson explained the matter was brought to the attention of District Attorney’s Office when the Governor issued the new mandates by a question from the County Manager as to what would be the best way to proceed. The recommendation was to August 3, 2021 6. Public Information Officer Arnold Knightly said he lost a colleague yesterday, Tony Ilea, who was the Public Information Officer for NDOT. Part of Mr. Knightly’s job was made easier by Mr. Ilea as he took a lot of videos and sent them to him as well as arranged visits to areas.

Chief Lewis said no because the mileage on this ambulance far exceeded any other reserve or frontline ambulance. He added that there were ambulances in Amargosa, but they did not have the service yet.

asked what the estimated value was. Fire Chief Scott Lewis said probably several thousand dollars. It was a 1988 chassis and parts could not be found for it. Also, the axles would have to be rebuilt to make it NDOT approved and to rebuild the axles far exceeded the value of the truck.

suggested donating it to an organization so it could be in parades or possibly donating it to the museum.

mentioned it may need some additional work to keep it on the road. He asked who would do the maintenance and what the expense would be to get the vehicle to good working order. Fire Chief Scott Lewis said the vehicle was in running order. He explained this chassis was not designed to carry the weight of the water at the time. It was refurbished in 2002 and the utility body was put on it. The maintenance crew in the County said they liked it as they did not have to take the best care of it but could use it to its fullest. They approached PVFRS about the vehicle.

Commissioner Carbone

made a motion to approve FM-201 9-000009, approval of a Unit 5 final map for a subdivision containing 138 single-family lots of 31 .4 acres gross; seconded by Commissioner Blundo. Helene Williams, representing the private well owners, said she would like to see the developer reduce the number of homes per acre as that would be in everyone’s best interests. She understood they had the previous Board’s support for the housing development in that project area, but the water issues today did not exist then. She did not want to see the County forced into a building moratorium. Mark Fiorentino, representing the applicant, was present to answer questions.

Commissioner Cox

said this was an awful lot of houses for the size of the lot. While they may have enough water rights to cover this, there needed to be some consideration as the problems were not realized when the project was first planned. For the sake of the rest of the valley Commissioner Cox would like to see them come back with lesser houses per acre.

Commissioner Carbone

asked Mr. Fiorentino if there would be a chance to change the design for less homes per lot.

Mr. Fiorentino

said he could not say anything officially. This was just a map of continuation of a current phase of development, but that did not mean there was not flexibility in the future.

Commissioner Jabbour

confirmed with Mr. Fiorentino that the water had already been allotted for this development so water really was not an issue or factor in this item.

Commissioner Carbone

made a motion to approve the Improvement Maintenance and Warranty Agreement lA-2020-000022 for the subdivision improvement on parcel number 045-021-71; seconded by Commissioner Jabbour. August 3, 2021 43b. For Possible Action — Discussion and deliberation on IA-2020-000022-Cont’d. Helene Williams, representing the private well owners, expressed her gratitude to the Board for the agenda item, but she was frustrated as to why the number of homes per parcel could not be reduced now rather than down the road. All that would do was compound the water issue considerably. She thought respect toward the community by the developer was to give a little and everyone work together in the best interest of the County.

Commissioner Carbone

asked what changes were made in this agreement versus the ones prior.

Mrs. Strozzi

said to her knowledge the last time a cooperative agreement of this nature was done was in 2008 and there was no information sharing agreement to go along with it. This agreement was the first of its nature and was approved last year. She noted a similar agreement was done with the census.

Mr. Waggoner

added this was the first agreement the County had with FEMA of this nature, but this was not an information sharing agreement for the County to provide information for them but for them to provide the County with information and this was to keep that information confidential. Tim Bohannon wondered if this was limited to one person and if there was a back-up.

Mr. Waggoner

indicated there was.

Commissioner Jabbour

made a motion to 1) approve the contract between the Department of Homeland Security, Federal Emergency Management Agency (DHS/FEMA) and Nye County for the purpose of documenting the safeguarding requirements for personally identifiable information datasets shared by FEMA in support August 3, 2021 44. said she had a request from the Amargosa Town Board through John Bosta that they wanted to have this heard at their meeting in August, 2021, and would like the Board to schedule this for the end of September, 2021, so they could make a recommendation.

asked if a date change would affect anything. Brett Waggoner said not necessarily, but he was confused because the town boards had been asking for this.

said maybe Mr. Bosta was confused and thought another marijuana facility was going somewhere. August 3, 2021 47. For Possible Action Discussion and deliberation regarding a request to: 1) Set a date, time and location for a Public Hearing on Nye County Bill No. 2021 -09- Cont’d.

Commissioner Blundo

wondered why the Amargosa dysfunctionality would be brought into the County Code. He also wondered when the Board was sitting as the Pahrump Town Board if they would have to hear an item again as the Board of County Commissioners. He suggested maybe just doing this for the outlying areas.

Commissioner Strickland

said the people in Amargosa could come to the meeting on the date in the motion to discuss it with the Commissioners.

Commissioner Cox

pointed out Amargosa had a legitimate town board and had been complaining about being cut out of the process. Since it was in the Town of Amargosa she did not think what they were asking was too much.

thought this bill may conflict with the marijuana laws and that should be looked at.

noted the back-up indicated the budget allocated for this project was $400,000.00. He asked if the grant would cover the rest of the cost.

said that was correct.

Commissioner Carbone

asked if this item needed to re-agendized. MarIa Zlotek advised the motion could be made on the agenda item. The clarification was on the agenda form and she thought it had been thoroughly explained. At Commissioner Jabbour’s request, Captain David Boruchowitz explained when inmates were in crisis and trying to self-harm the padded cell was utilized to ensure they were not able to do so. There was one in Tonopah, but Pahrump did not have one and there had been instances in the past of inmates cracking their skulls open on the block wall. Captain Boruchowitz stated a padded cell was necessary to reduce liability and to prevent harm and injury to the inmates and the staff.

Commissioner Cox

was concerned with the whole thing and thought it should go out to bid again. She thought there may be legal issues in the future if it was not done right.

Commissioner Carbone

asked if this was a not to exceed contract. August 3, 2021 31. For Possible Action Discussion and deliberation to: 1) Discuss the bid proposals received for Bid 2020-11 Pahrump Jail Booking Area and Padded Cell Construction-Cont’d.

Mrs. Strozzi

said that was their original proposal, but she could not speak to what unforeseen circumstances may occur. Sam Jones wondered if a padded cell and jail booking area was needed in the new jail why it was not included when the jail was built. He was concerned with how the County kept spending money. Tim Bohannon felt the item was unclear and wondered if there was a scope change. He agreed with bringing it back with more clarity. Captain Boruchowitz did not understand Commissioner Cox’s concern as to what was not done properly. He thought putting it out to bid would put it off for months and the County would risk losing almost $200,000.00 in grant funds to help with the costs of this project.

Commissioner Blundo

thought it should be rejected and put back out to bid again to address the concerns of the Commissioners and the public.

Commissioner Carbone

asked if their bid was good up to a certain date. Captain Boruchowitz advised that date already came and went. Both bids were expired by the time the grant was approved. Grants Administrator Samantha Kramer said she could follow up with the granting agency to see if she could get a no-cost extension of the grant.

was not present. FINANCE 38. For Possible Action Discussion and deliberation regarding the budget status for June 2021 for Nye County and all sub-entities for fiscal 2021. Savannah Rucker said A/P would be open for the next ten days and the GIL would be open until the end of August, 2021, for posting of revenues. At this point all action that could be taken had been taken on the FY21 budget and there were no departments projected to end the year over budget. John Prudhont said his department came in within budget and had to re-distribute their services/supplies budget to cover overtime and comp time. His FY21 budget was reduced in services/supplies by $14,000.00 and was reduced again this year by $9,586.00. Mr. Prudhont explained they had and would continue to have issues regarding overtime and he was concerned with having to cover that with the services/supplies budget again this fiscal year. To help his office, Commissioner Strickland asked what the best way was for people to make tax payments mail, walk-in or on-line.

Mr. Prudhont

said people should come in and pay by check or cash as it would take less time for his office. Tim Bohannon expressed his concerns with no funding in fund 10231, forensic services; the sustainability of grants; and the low expenditures in both the economic development fund and the arena fund. August 3, 2021 39. For Possible Action Discussion and deliberation regarding the Debt Management Policy Statement and Capital Improvement Plan for Nye County for Fiscal Year 2021 -2022 pursuant to NRS 350.013. Savannah Rucker said in the back-up was the debt management policy and capital improvement plan for Nye County. It was more extensive because the County had more debt than the entities the Board approved plans for previously. 40. For Possible Action Discussion and deliberation to adopt, amend and adopt, or reject Nye County Resolution No. 2021-29: A Resolution authorizing the Nye County Treasurer to transfer funding from Nevada State Bank to Zion Bank. Savannah Rucker explained this was the request of the Public Works Department on an annual basis. The landfill trust funds were assessed for the value within them to deal with post-closure and it came up short this year. The request was to ask the Treasurer to transfer the funds out of the Nevada State operating bank account into the Zion trust paying for the landfill. John Prudhont said he had one change he would like made to the resolution. The money did not need to go to Zion Bank as it was a holding company. Wealth and Fiduciary Management was the investment side of Zion Bank. He was concerned with the item stating to send it to Zion when it was going to Wealth and Fiduciary Management.

asked that Zion also be identified because the statement did say Zion all over it along with ten other banks.

Samantha Kramer said the status update was in the back-up. There was an approved PSA out for signatures for accountants to help applicants come into compliance. If the applicants did not solicit help in 30 days their applications would be turned over to the District Attorney’s Office.

Commissioner Jabbour

said he had asked for a list of recipients of CARES Act money in District I. He contacted a couple of people and was satisfied with their information stating they had been in contact with the Finance Department and things were getting clarified. 42. For Possible Action Presentation, discussion, deliberation and possible amendment of the 2021 Nye County COVID Relief Program and Policy to provide financial assistance to the public, small businesses, non-profits, and government agencies located within Nye County affected by the COVID-19 Pandemic health emergency. Samantha Kramer said the status update and updated figures were in the back-up. The current liability of undocumented use of grant funds was $969,606.05. There was an approved PSA out for signatures for accountants to help the businesses come into compliance. If the applicants did not solicit help in 30 days their application would be turned over to the District Attorney’s Office. The pending small business grant applications had been kept open in the event future funding was allocated to the program. If the Commissioners would not allocate additional funding Mrs. Kramer said she would like to close the remaining 31 pending applications listed on the second page of the back-up which were not approved due to lack of funding.

Commissioner Strickland

said she did not want to continue funding someone who was not complying and would like to close the program out.

Commissioner Cox

asked if the public rent, mortgage and utilities program was strictly for people who owned businesses as she knew someone who had been denied.

Mrs. Kramer

said no. That was a public program for individuals who needed assistance with payments and it was still open.

Commissioner Jabbour

asked if there was funding left in the program.

Mrs. Kramer

said there was $116,160.86 remaining in contingency and the Commissioners could reallocate to other programs as needed. August 3, 2021 42. For Possible Action Presentation, discussion, deliberation and possible amendment of the 2021 Nye County COVID Relief Program and Policy to provide financial assistance to the public, small businesses, non-profits, and government agencies located within Nye County affected by the COVID-19 Pandemic health emergency-Cont’d.

said he would hate to punish businesses, owners and residents if there was still money available because of people who had not complied.

Mrs. Kramer

advised the public assistance administered by non-profits, riot for profits, and charities had a negative balance of $251 .57. There was an administrative cost for verifying documentation submitted and she suggested adding additional funding to administer that program in-house.

assumed the Chair of the Board of County Commissioners.

made a motion to close out the small business grants portion of this program; seconded by Commissioner Jabbour.

confirmed for Tim Bohannon the entire program was not being closed out, just the small businesses portion.

felt it should be kept open until exhausted. As far as the individuals who were not compliant, he understood CPAs were supporting and asked if they were getting the job done.

then request an amendment to the public rent, mortgage and utility assistance program to add unemployment verification and that the small business affidavit must be updated on either a monthly or quarterly basis.

explained these were verbal updates for items that came to her attention after back-up was submitted.

added it did not have to be on the agenda because the item said possible amendments of the policy. August 3, 2021 42. Commissioner Carbone

said he went to the property recently and it was not in huge chaos like it was before. He did not go to the back of the property and still believed the front of the property was an HOA issue.

Commissioner Jabbour

said when he owned properties in Las Vegas there were very strict CC&R rules and if people did not comply they were fined directly by the authority of the area he lived in. He wondered why that did not happen here and why the County Commissioners were seeing this. Brett Waggoner explained there was an HOA in place as well as CC&Rs. Nye County did not enforce those, but it did enforce the Code. Regardless of an HOA or CC&Rs being present if a complaint came in it was addressed through Code Compliance. Mr. Waggoner’s understanding was the HOA had addressed this in the past and went all the way to foreclosure proceedings. The woman was able to stall the process by making a payment of the fine or something to that effect and they had to start the process all over. Richard Hopper said the State agency that regulated the HOA was in trouble. The woman he spoke with said once the County Commission took the case it was the County’s exclusively and the HOA could not do anything. The Board voted on August 20, 2020, to abate the nuisance and part of the nuisance was human feces, containers of urine, cat feces, and just regular household garbage. Mr. Hopper stated it was a nuisance and at this point the County was in violation of not enforcing its own codes or decisions on abating the nuisance. He said the time had come for the Commission to take action on this as soon as possible.

felt the County got involved in something it should not have gotten involved in. If the previous Board made a decision that said the County would clean up the property he wanted to know why it had not been done. August 3, 2021 46. For Possible Action Discussion, deliberation, and direction to staff regarding the abatement status of Code Compliance Case Number CC-20-000108 for the subject property, located at 5908 E. Badlands, Pahrump. Assessor Parcel Number 046-011-13. Property Owner— Moseley, Jorja Faye ShrouderTrust-Cont’d.

Mr. Waggoner

explained the way it was stated the property owner was given seven days to clean up the trash. Within that time Code Compliance was to go back out for a reinspection, but the homeowner had been completely unresponsive and they had not been able to gain access to do another inspection other than the one done on June 1 5, 2021, which was done by looking over the fence from neighboring properties.

Commissioner Carbone

said he also did not understand why backyards were being looked at as that was people’s private property.

Mr. Waggoner

said because the photographs showed potty pads and jars of urine.

Commissioner Cox

said she never agreed with this because she believed the County overstepped its bounds. She thought the Code needed to be changed so that HOAs were responsible to see that properties were cleaned up as they had the power to fight it and could take the homes away. She also felt it was an invasion of privacy for people to hang over someone’s fence and take pictures. Commissioner Cox asked if anyone had checked the ownership since the last time the Board discussed this the woman said the house was up for sale and she thought she had a buyer.

Mr. Waggoner

said they had checked on that and she was still the owner. The property was on the last Treasurer’s trust auction list for a little over $5,000.00 in past due taxes which was paid by the property owner days before the auction.

Commissioner Cox

said she would like to give direction to staff to update the Code to state that if there was an HOA involved it was their responsibility to take care of it.

The letter explains each finding as it relates to the biology of COVID-19 vaccines, including interactions with the immune system. Taken together, the letter warns that these new pieces of evidence force all physicians administering COVID-19 vaccines to re-evaluate the merits of COVID-19 vaccination, in the interests of their own ethical standing, and their patients’ safety and health. They alter the entire landscape of the COVID-].9 pandemic, and they force us to reassess the merits of vaccination against SARS-CoV-2. Summary Rapid and efficient memory-type immune responses occur reliably in virtually all unvaccinated individuals who are exposed to SARS-CoV-2. The effectiveness of further boosting the immune response through vaccination is therefore highly doubtful. Vaccination may instead aggravate disease through antibody-dependent enhancement (ADE). Discovery 1: SARS-CoV-2 spike protein circulates shortly after vaccination SARS-C0V-2 proteins were measured in longitudinal plasma samples collected from 13 participants who received two doses of Moderna mRNA4273 vaccine [1]. With 11 of the 13, jl the SARS-CoV-2 spike protein was detected in the blood within only one day after the first vaccine injection. Significance. Spike protein molecules were produced within cells that are in contact with the bloodstream—mostly endothelial cells—and released into the circulation. This means that a) the immune system will attack those endothelial cells, and b) the circulating spike protein molecules will activate thrombocytes. Both effects will promote blood clotting. This explains the many clotting-related adverse events—stroke, heart attack, venous thrombosis—that are being reported after vaccination. Discovery 2: Rapid, memory-type antibody response after vaccination Several studies have demonstrated that circulating SARS-CoV-2-specific lgG and IgA antibodies became detectable within 1-2 weeks after application of mRNA vaccines [1-3]. Significance. Rapid production of lgG and IgA always indicates a secondary, memory-type response that is elicited through re-stimulation of pre-existing immune cells. Primary immune responses to novel antigens take longer to evolve and initially produce 1gM antibodies, which is then followed by the isotype switch to lgG and gA. A certain amount of 1gM was indeed detected alongside IgG and IgA in some studies [1,4]. Importantly, however, lgG rose faster than 1gM [4], which confirms that the early IgG response was indeed of the memory type. This memory response indicates pre-existing, cross-reactive immunity due to previous infection with ordinary respiratory human coronavirus strains. The delayed 1gM response most likely represents a primary response to novel epitopes which are specific to SARS-CoV-2. Memory-type responses have also been documented with respect to T-cell-mediated immunity [5-7]. Overall, these findings indicate that our immune system efficiently recognizes SARS-CoV-2 as ‘known” even on first contact. Severe cases of the disease thus cannot be ascribed to lacking immunity. Instead, severe cases might very well be caused or aggravated by pre-existing immunity through antibody-dependent enhancement (ADE, see below). Discovery 3: SARS-CoV-2 elicits robust adaptive immune responses regardless of disease severity Serum antibody profiles were reported for 203 individuals following SARS-CoV-2 infection [8]. 202 (>99%) of the participants exhibited SARS-CoV-2 specific antibodies. With 193 individuals (95%), these antibodies prevented SARS-CoV-2 infection in cell culture and also inhibited binding of the spike protein to the ACE2 receptor. Furthermore, CD8+ T-cell responses specific for SARS-CoV-2 were clear and quantifiable in 95 of 106 (90%) HLA-A2- positive individuals. Significance. This study confirms the above assertion that the immune response to initial contact with SARS-CoV-2 is of the memory type. In addition, t shows that this reaction occurs with almost all individuals, and particularly also with those who experience no manifest clinical symptoms. The goal of the vaccination is to stimulate production of antibodies to SARS-CoV-2, but we now know that such antibodies can and will be rapidly generated by everyone upon the 12 slightest viral challenge, even without vaccination. Severe lung infections always take many days to deielop, which means that if the antibodies generated by the memory response are needed, they will arrive on time. Therefore, vaccination is unlikely to provide significant benefit with respect to the prevention of severe lung infection. Discovery 4: Rapid increase of spike protein antibodies after the second injection of mRNA vaccines lgG and IgA antibody titres were monitored before vaccination and after the first and the second injection of mRNA vaccines [3]. Antibody titres rose with some delay after the first injection, then plateaued, but rose again very shortly after the second injection. Significance. Even though the antibody response to the first injection is of the memory type, the small time lag after the injection may mitigate adverse reactions, because the abundance of spike protein on the cells in the blood vessel walls and in other tissues may have already passed its peak when the antibodies arrive. The situation changes dramatically with the second injection. Then the spikes are produced and protrude into the bloodstream that is already swarming with both reactive lymphocytes and antibodies. The antibodies will cause the complement system [9,10] and also neutrophil granulocytes to attack the spike protein-bearing cells. The possible consequences of all-out self-attack by the immune system are frightening. Antibody-dependent enhancement of disease As described, memory-type immune responses ensure the rapid rise of antibody titres after initial exposure to SARS-CoV-2, rendering the benefit of vaccine-induced antibody response exceedingly doubtful. Regardless, we should not assume that high antibody titres against SARS-CoV-2 will always improve the clinical outcome. With several virus families—in particular with Dengue virus, but also with coronaviruses—antibodies can aggravate rather than mitigate disease. This occurs because certain cells of the immune system take up antibody-tagged microbes and destroy them. If a virus particle to which antibodies have bound is taken up by such a cell, but it then manages to evade destruction, it may instead start to multiply within the cell. Overall, the antibody will then have enhanced the replication of the virus. Clinically, this antibody-dependent enhancement (ADE) can cause a hyperinflammatory response (a ‘cytokine storm”) that will amplify the damage to the lungs, liver and other organs of our body. Attempts to develop vaccines to the original SARS virus, which is closely related to SARS CoV-2, repeatedly failed due to ADE. The vaccines did induce antibodies, but when the vaccinated animals were subsequently infected with the virus, they became more ill than the unvaccinated controls (see e.g. [11]). The possibility of ADE was not adequately addressed in the clinical trials on any of the COVID-19 vaccines. It is therefore prudent to avoid the danger of inducing ADE through vaccination and instead rely on proven forms of treatment [12] for dealing with clinically severe COVID-19 disease. Conclusion The collective findings discussed above clearly show that the benefits of vaccination are highly doubtful. In contrast, the harm the vaccines do is very well substantiated, with more 13 than 15.000 vaccination-associated deaths now documented in the EU drug adverse events database (EudraVigilance), and over 7.000 more deaths within the UK and the US [13]. In this latest interview, Dr. Hoffe states that the blood clots that are being reported in the corporate media as being “rare” are anything but rare, based on his own testing of his own patients who had recently received one of the shots. The blood clots we hear about which the media claim are very rare are the big blood 1 clots which are the ones that cause strokes and show up on CT scans, MRI, etc. The clots I’m talking about are microscopic and too small to find on any scan. They can thus only be detected using the D-dimer test. Using this test with his own patients, Dr. Hoffe claims that he has found evidence of small blood clots in 62% of his patients who have been injected with an mRNA shot. He states that these people are now permanently disabled, and they will no longer “be able to do what they used to do.” These people have no idea they are even having these microscopic blood clots. The most alarming part of this is that there are some parts of the body like the brain, spinal cord, heart and lungs which cannot re-generate. When those tissues are damaged by blood clots they are permanently damaged. On April 2, 2021 Health Canada acknowledged the presence of graphene nano particles inside the Face Mask allegedly to protect our health as well as prevent the spread of the “deadly virus”. According to Health Canada: “Face Masks whicfl contain Graphene Oxihe May Pose Health Risks”. It took more than a year for Health Canada to acknowledge that certain unnamed hrands of the face mask contain graphene nano-particles: “There is a potential that wearers could inhale graphene particles from some masks, which may pose health risks.” This is an ambiguous statement. There is ample evidence regarding the health impacts of graphene: “A number of individuals have come forward in Quebec reporting breathing problems, headaches, skin complaints and other adverse effects from the ‘healfiber’ masks,” they said at the time in a memo urging people to stop using them or any otner mask that contains graphene. (emphasis added) The face masks were carefully designed. The specifics of the face mask were then outlined. Producbon under contract was then outsourced to manufactunng entities including several Chinese companies. The Shandong based Shengquan Group is a major supplier, selling hundreds of millions of face masks Worldwide. Can Graphene Nano-Particles Enter the Body? Who designed the face mask containing graphene particles? Not the Chinese manufacturer Can these particles enter the body? “Warnings of potential “early pulmonary toxicity” associated with graphene-containing face masks raise serious questions”. One would expect that Health Canada (back in March 2020) would have been involved directly or indirectly in reviewing and identifying the Face Mask brands containing graphene nano-particles prior to their sale and mass distribution. Who approved the production of a face mask which contains a poisonous substance? I in an earlier March 2021 unpublished memorandum to the province’s and territories, Health Canada recommended users to stop purchasing and using face masks containing nanoform graphene”(guoted in a study by Andrew Maynard) Visibly this March 25, 2021 memorandum was amended. No brand names are mentioned in Health Canada’s April 2, 2021 advisory. Health Canada has ordered the removal from sale and distribution (Solely) of face masks which are explicitly labelled “contain graphene or biomass graphene”. The advisory does not apply to face masks brands (containing graphene) which do not display an explicit acknowledgement on the product label. According to Health Canada: Graphene is a novel nanomaterial (materials made of tiny particles) reported to have antiviral and antibacterial properties. Health Canada conducted a preliminary scientific assessment after being made aware that masks containing graphene have been sold with COVID-19 claims and used by adults and children in schools and daycares, Health Canada believes they may also have been distributed for use in health care settings. Novel nano-material? Nonsense Graphene was first isolated in 2004 at the Physics Department of the University of Manchester by Andre Geim and Kostys Niovoselov: Nobel Prize for Physics in 2010. Graphene is by no means ‘novel. Moreover, the impacts on human health are amply documented “In recent years there have been a number of comprehensive reviews on the potential toxicity of graphene, including this 2018 paper by Bengt Faded and colleagues, and this one by Vanesa Sanches and colleagues. Despite the scientific evidence, Health Canada does not consider Graphene as “a health risk”. Case closed. The earlier pro formna restriction on graphene (a poisonous substance if it enters the body) has now been lifted. Ironically, Health Canada acknowledges that they “did not find evidence that biomass graphene provides any added antimicrobial, or antiviral protection”. If graphene does not protect Canadians from the virus, what on earth is the purpose of having graphene no no-particles in the face mask? It would appear that there are “divisions” within Health Canada regarding the alleged “positive effects” of the graphene particles as an instrument of ‘anti-viral protection”. Who pressured Health Canada to lift the restriction on Graphene? And why is graphene contained in face masks sold and distributed Worldwide? Who is calling the shots? Is there an unspoken agenda? Ltd., from the market. Health Canada has reviewed the available scientific literature along with data provided by Shandong Shengquan New Materials Co. Ltd., related to the biomass graphene contained within its four models. The review found that biomass graphene particles are not shed from these masks in quantities that are likely to cause adverse lung effects. Health Canada also determined that the filtration performance of these masks meets the performance standard listed on the label. The Department did not find evidence that biomass graphene provides any added antimicrobial, or antiviral protection. As a result, given the evidence supporting the safety and effectiveness of these products, Health Canada is permitting the sale of the four Shandong Shengquan New Materials Co. Ltd. mask models to resume in Canada (see models listed below). No other graphene face masks are currenily permitted for sale in Canada.
