was still looking for the cookies. He asked for an update from the District Attorney and thought everyone should get an update from County Manager. A community convention center needed to be built and they needed to be a part of that like they committed.

Commissioner Strickland

said she had a joyous heart about the Fall Festival and how great it was. She then displayed the nine medals she won at the Nevada State Championship for ladies’ single action shooting as well as the belt buckle she won for being the fastest woman in Nevada. Treasurer John Prudhont reminded everyone the second installment payment of taxes was due. He also advised he had two new employees. October 5, 2021 2. Commissioner Blundo

acknowledged former Commissioners Butch Borasky and John Koenig who were present in the audience. Chris Arabia stated he would discuss the VEA issue with the County Manager. He noted last Friday was October 1 and told the people in Tonopah who were there that night that they were in his thoughts and prayers. He then provided updates on the second-degree murder case and the possible death penalty cases. Mr. Arabia stated his office was short-handed like everyone else and he gave a shout out to his team and the dedicated people he had.

Commissioner Carbone

referred to him at the end of the meeting as “this person.” Mr. Prudhont was sure he knew his name, so he encouraged Commissioner Carbone to use his name when referring to him instead of a non-entity which showed respect. Mr. Prudhont then said the last meeting was horrendous and what happened should not have happened. Article 9 of the NCEA contract specifically barred the conduct revealed at the last meeting. Carolene Logue spoke in support of the public library. She thought the community had become complacent with the operation of the Pahrump Community Library and asked the taxpayers to attend the next library board of trustees meeting as much of what the taxpayers had taken for granted was being challenged.

Commissioner Strickland

asked Ms. Logue to speak on item 20. Robert Adams advised a solar project developer wanted to build a 2,000-acre solar generating plant right on Pahrump’s doorstep. Public comment was just beginning and the PPLAC will take it up at their next meeting scheduled for Tuesday at 5:00 p.m. at the Bob Ruud Community Center. Melissa Blundo told Pat Minshall the County Manager’s review was supposed to be public per NRS. Also, Commissioners could not address any staff other than the County Manager. Mrs. Blundo thought the public was appreciative of what was brought out and if speaking the truth was bullying then Ms. Minshall needed to look at what bullying was. Regarding the last meeting, Tim Bohannon said as an observer and a member of the public the tone was disheartening. The IMs also bothered him. Ron Boskovich talked about the CARES money noting that $180,000.00 went literally right to Commissioner Blundo’s company, which was only open part-time. There was no oversight and Commissioner Blundo voted on it. Mr. Boskovich wondered if that was not picked up by the Attorney General because Chris Arabia and Aaron Ford were friends. He stated those two people were the most corrupt people he had ever seen. October 2021 5, 4. GENERAL PUBLIC COMMENT (up to three-minute time limit per person.) Chris Arabia stated he was not friends with Aaron Ford, but he knew him in a professional relationship. Mr. Boskovich was making stuff up and living a paranoid fantasy that Mr. Arabia was doing corrupt stuff with Commissioner Blundo. Karen Williams spoke about the previous meeting and the County Manager item. As a member of the public, she appreciated finding out what Tim Sutton and his staff thought about the Commissioners and members of the public who spoke. If she had an employee who publicly disparaged her and encouraged her staff to also do so, she would not want them as an employee anymore. That behavior was not appropriate for a person in that position. 2. Commissioner Jabbour

said something was mentioned last meeting by his fellow Commissioner that he was involved in the IMs as well. Commissioner Jabbour clarified that since he had taken his seat, he had never logged onto the lM system and was not involved with it or the back and forth of messaging, so the comment addressed to him during the presentation to the public was misleading and false. He had seen the IMs and they were taken out of context. Transparency was very important, but so was the truth. Commissioner Jabbour said, as he had said many times before, that everybody deserved dignity and respect and the Commissioners were here to help the County move forward and do great things. What had been happening needed to stop immediately.

Commissioner Blundo

said the comments were about Commissioner Jabbour and he was not indicating Commissioner Jabbour was involved in the messaging back and forth. Commissioner Blundo said that kind of disparaging behavior about the public and the Board needed to stop, and he hoped that was the big take away from the situation.

said she had concerns because the buy-back program did not look as lucrative as it had previously. She was happy with the research done and having it brought back.

Commissioner Cox

asked where the motor graders would be located. October 5, 2021 24. For Possible Action Discussion and deliberation to: 1) Approve, amend and approve, or reject a contract with Cashman Equipment to utilize Sourcewell Contract #032119 for the purpose of the purchase of three current model articulated diesel-powered tandem drive motor graders, Caterpillar 150-1 5; 2) Approve the purchase from Cashman Equipment Company in the amount of $963,142.95; 3) Execute the Contract; and 4) Fund from 10205 Roads-Cont’d.

Mr. Boiling

said there would be one in the southern district and two in the northern district. He explained there was an enormous amount of road grading done in the northern district with almost 1 400 miles of just gravel roads. Two good machines that could be depended on were needed up there.

made a motion to approve the contract for Cash man Equipment, contract #032119, for the purpose of purchasing three current models of a diesel-powered tandem drive motor grader, Caterpillar 150-15: 2) approve the purchase of the equipment in the amount of $963,142.95; 3) execute the contract; and 4) fund from Fund 10205, Roads; seconded by Commissioner Jabbour; 5 yeas. Commissioner Strickland

asked the Board to consider the Pahrump valley applicants one at a time. Joseph Burdzinski said based on information from the 2020 census some of the district lines would have to be redrawn. The back-up showed there were concerns that District I might be too big and redoing districts might cost too much money, which were legitimate concerns that needed to be addressed. However, if boundaries needed to be changed, Mr. Burdzinski said he would support that as long as it was equitable and there was equal representation. He also thought it was important people on the October 5, 2021 21. For Possible Action Discussion and deliberation to: 1) Appoint eleven (II) members to the Nye County Redistricting Advisory Committee-Cont’d. committee committed to attending the meetings and having their input. Mr. Burdzinski said he would be honored and would like the opportunity to serve on the redistricting committee. He also thought it was important for County Clerk Sam Merlino be involved with the committee because she had the expertise and the history of the voting in Nye County.

Commissioner Strickland

noted Mr. Burdzinski’s background appeared to be very high in districts being that he had worked closely in the election process in the past. She asked how he felt that would help him in helping the County.

Mr. Burdzinski

said being involved with the community and the different districts he had a perspective some other people may not have that could benefit the committee, which would also benefit the Commissioners so they could make the final decision. Sean Hastings said he was honored to be able to submit his application for this committee. He had been a member of the community for a little over 16 years and raised his family here. He felt like he as a good voice of reason and was able to add a fresh take on things. Mr. Hastings currently served as a trustee on the Nye County School District Board and felt that he had a good solid understanding of how these meetings should take place as well as making sure good, solid decisions were made.

Commissioner Blundo

asked if the redistricting committee would be redistricting the School District. Sam Merlino believed the School District had to do that, but they would be involved in the process so lines that encompassed seven school areas and five Commission districts could be drawn. She also clarified the committee could only recommend. The School District would adopt their redistricting boundaries and the Board of County Commissioners would adopt the Commission boundaries.

Commissioner Strickland

said she was concerned talking about the Nye County School District applicants. There was one applicant who was a current member of the board of trustees and the second applicant, Cameron McRae, did not appear to be with the School District in any way.

Mrs. Dellinger

said that was correct. Mr. McRae’s application was submitted by Ray Ritchie, the School District’s financial officer, and she believed that was based on Mr. McRae’s participation in the last redistricting.

Commissioner Strickland

asked the Board to take that into consideration as she hoped to have someone who was a representative currently. October 5, 2021 21. For Possible Action Discussion and deliberation to: 1) Appoint eleven (11) members to the Nye County Redistricting Advisory Committee-Cont’d. Eddie Williams said he applied because he felt he could bring a lot of energy and good decision making. He was a firm believer in election integrity. He had a lot of experience in being a communfty and civic-minded person and could bring in different ideas as well as ensure the districts were reapportioned according to the law. John Koenig said during his term as Commissioner he visited probably every town in the County, so he was very familiar with the County. The committee would probably have to move some boundaries, but not knowing what the last count was he could not be sure. The committee needed to be careful if the boundaries had to be moved because his house could fall into District I instead of District II. The committee could not just arbitrarily draw lines. He also had plenty of time to devote to this as well as the knowledge.

Commissioner Blundo

asked Mr. Koenig what his thoughts were about the report that did a broad brush through the County and sliced it into five pieces and how would he determine how to move a line.

Mr. Koenig

said theoretically it was easy to draw lines. Last time District I came down to Pahrump and then made a turn. Neighborhoods needed to be looked at to decide how that could be done. Carolene Logue said she wanted to support the constitutional right of all citizens to vote in an election that was fair and available for all voters. She worked during the 2020 census and took classes on how to get a complete census count. She was an informed voter who understood the NRS laws and regulations, knew how to research and find answers to questions regarding the process of redistricting, and the importance of having correct district maps. Ms. Logue had a BS degree in business administration as well as many years as a volunteer. She said she was willing to give her time and commitment to the advisory board. Kameron Mitchell said he had a family business for 30 years and was a retired Lieutenant Commander of the U.S. Navy. He was also a retired computer programmer and systems analyst, so he was very logical. He would have to read the NRS5 involved with redistricting, but he would do it logically and according to the law.

Commissioner Blundo

said he was concerned that the Commissioners were missing some applications. He was going to cut it down to a seven-member board to keep it an odd number, but there were no applications received from individuals outside of Pahrump. He also felt if it was kept at seven then they would be able to get the business done in a timely manner. He would like to put the Clerk on the committee, but since she had so much information and had been through the process twice

thought she may be of more value by being able to work with everyone instead of being a voting member. October 5, 2021 21. For Possible Action Discussion and deliberation to: 1) Appoint eleven (II) members to the Nye County Redistricting Advisory Committee-Cont’d. Pat Minshall said unfortunately this was advertised mostly in the Pahrump Valley Times and very few people she knew in Amargosa got that. Also, the information did not get out to the general public. She would like to see it readvertised for outside of the Pahrump valley and wondered if it could be separated that way. Erika Gerling wondered what the reason was to take the advisory board from eleven to seven members. Sam Merlino said she was absolutely fine just being in an advisory position. She did the redistricting back in 2001 and asked for a committee in 2011 because she thought it was fair to have everyone involved and not just her. As to the issue about eleven members and readvertising, Mrs. Merlino explained she had to publish the offices up for election about the first week in December, so she was on a very short timeframe. Once the committee made the recommendations, the School District adopted theirs and the Board of County Commissioners adopted theirs, her office had to move every single street file into new precincts and send out voter cards. She did not recommend putting this off for any reasons and whether seven or eleven the business needed to get done. Tim Bohannon thought seven was reasonable and nine would be as well. He said one thing to consider was appointing someone in the other area if that was known and an application was completed. For practicality and transparency, he felt that there needed to be a balance as far as the parties.

made a motion to make the following appointments: Nye County School District, Cameron McRae; Amargosa Valley, John Bosta; from the Town of Tonopah, Mark Grigory; from the Beatty Town Board, Randy Reed; and from Pahrump, Joe Burdzinski, Kameron Mitchell, and Brian Shoemake; seconded by Commissioner Cox.

pointed out Mr. McRae was not sitting on the Nye County School District Board. While he was very instrumental, there were specific criteria.

agreed. She asked Commissioner Blundo if he would amend his motion to appoint Sean Hastings since he sat on the Nye County School District Board and appeared today.

asked if this committee would influence the lines Mr. Hastings was in.

Mrs. Merlino

said even though this was a difficult process, the basics were very easy. It was purely by population. No party or elected official became involved, It was strictly drawing lines along the population in those five districts. As to the School District, she October 5, 2021 21. explained Mr. McRae contacted him and was inquiring. The documents the Commissioners received came from Mr. McRae. It made no difference to Commissioner Blundo if it was Mr. Hastings or Mr. McRae.

stated she could not support the nominations in general, which was why she hoped this could be done one at a time instead of in a big chunk.

asked how many machines would be placed at the locations. Louis Sposato, the applicant, said there would be 15 machines at both locations.

Commissioner Cox

asked approximately how long this process had taken from day one until now to get approval.

Mr. Sposato

said it probably started a year ago July. They actually took control of the Grill Room at Mountain Falls last August.

Commissioner Carbone

clarified the question was how long it took it Mr. Sposato to do the process through the County.

Mr. Sposato

thought Sean Holmes would be the better one to ask that of, but he remembered personally filling out the application in July, 2020.

Mrs. Tackett

explained the gaming application for the Grill Room was turned into the Sheriff’s Office on August 25, 2021. She worked with Mr. Holmes on that process. They waited to formally submit with the County until they went through the process with the State, which was taking quite a while on gaming. For Roadhouse, they submitted their application at the end of August, 2021, had everything to the Sheriff’s Office by the beginning of September, 2021, and they started the process with the State. She said it had only taken a few months for both applications to go through the County’s process.

Commissioner Jabbour

asked the applicant when the install would take place.

Mr. Sposato

said they were presently working on the install and hoped it would be completed in a couple of days. Once his partner got back in town, they would make sure the pay tables and slot machines were properly portrayed and operational. In Mr. Sposato’s opinion they hoped that they would be turned on by Monday. October 5, 2021 9. Tom Boiling discussed the changes made to the general road report. He updated the Board on the activities of the crews in the County, including the Tonopah sidewalk project, the pavement preservation list roads, and the flood damage in Pahrump. He said he was doing research on a Pahrump ordinance to not allow engine brakes in town.

Commissioner Strickland

said she was not sure if a valley wide or district wide ordinance would work for that. She was worried people would not be able to stop their trucks as fast as they needed to without that component.

Commissioner Cox

suggested limiting it to residential areas only.

Commissioner Blundo

did not believe anything should be done about jake brakes because of the potential danger if a vehicle could not stop.

Commissioner Cox

said she had three complaints from people living on Charleston Park. The problem was the person who made the deliveries to the Dollar Store there was going so fast that he had to use a jake brake. She did not want to turn it into a costly thing, which was why she suggested putting signs up like in other communities. October 5, 2021 8. She just wanted the company to be told to not do that in that area. commented jake brakes were a problem all over town and a nuisance to a lot of people.

suggested asking the Family Dollar for their vendors list, then call those companies and ask them to not use the jake brake while they were driving in town. Tim Bohannon said he would like to see future projects on the list. As to the jake brakes, if someone was bringing in a truckload of horses and went into a half residential and half commercial area after midnight it was going to make a lot of noise and wake the neighbors. They took measures to address that, and he thought Dollar General could do the same thing. Something could also be done to slow things down on 372 and 160.

said from his conversation with Public Works Director Tim DahI they could not discern on page 3 of the back-up the 25 mph from the original document. However, from Blagg on Basin to Highway 160, that big portion was 45 mph because it was 45 mph prior to that and only slowed down to 25 mph around the park. Tom Boiling believed it said from Highway 160 to the end of the park was 25 mph and from there it went to 45 mph. October 5, 2021 11. 10:00 am. made a motion to amend and adopt Pahrump Town Bill No. 2021-01 with the following changes: Wilson Street from Highway 160 to Blagg Road to be 45 mph; on East, West, First, Second, Third and Fourth to be 35 mph; on Basin Street from 160 to the west boundary of the community arena property to be 35mph; and Basin from Blagg to the community arena property to also be 45 mph; seconded by

said based on the motion Wilson Street would be removed as it was 45 mph, Basin Street from State Highway 160, the first and last, would be removed from the ordinance because it would stay with what was stated in A, and then change the 25 mph to 35 mph to satisfy the motion. said off of BoIling Street they had received a lot of complaints about people going through there at 35 mph and 45 mph. Maria Ziotek stated her concern with the Open Meeting Law was this agenda item was discussed, read, a motion was passed this morning, and there were numerous people in the audience who had an interest in this item. It was now being brought back after it had been concluded from the morning and those people that may have had an interest in this item would be denied that opportunity. She recommended it be re-agendized for a future meeting.

said a Round Mountain Town Board member was completely left out. She just wanted to add that because she did not want them to be shorted, and she wanted to add Sam Merlino. She was making no other changes.

Commissioner Blundo

said how to choose people should have been looked at differently. He knew Commissioner Jabbour wanted to represent everyone up in the north, but the effort had been so disconcertingly over-representing the north there would be six individuals from the north compared to the south, which was the smallest district at this time. He looked for a fair and equitable way to manage the situation.

stated there was no current open agenda item for discussion.

made a motion to appoint Dee Mounts to the unexpired term to end March, 2022; seconded by Commissioner Cox. Carolene Logue, speaking on behalf of the Pahrump Community Library, said she believed people of the community had become complacent to the operations of the library. In the past 20 years there was a very competent library director and committed staff as well as a knowledgeable and committed board of trustees. A new board was now seated, a new director was being hired, and several qualified people were not appointed or considered in the process of placement on the board of trustees or the position of director. Ms. Logue said the usual time and date for the board of trustees meeting had always been the second Tuesday of each month, but the board changed that date for the next meeting to October 20, 2021, at 10:00 am. She asked that all concerned citizens and taxpayers attend future library board meetings. John Shewalter, the Pahrump Community Library chair, agreed with Ms. Logue. He said the Board needed to appoint the most appropriate and ethical people. There had been some changes, which came with growth, and he encouraged everyone to come to the meetings. He also stated his support of Ms. Mounts as the newest board member.

made a motion to approve the tentative map for B Avenue Estate Subdivision creating 40 residential lots ranging in size from 7,222 square feet to 14,789 square feet on property located in Beatty, Nevada, in the vicinity of Revert Avenue and B Avenue, Assessor’s parcel numbers 018-591-10, 018-591-11, 018-591- 20, 01 8-591-21, and 018-592-22; seconded by Commissioner Carbone. Michael DeLee spoke in in favor of the project and said he was available for questions. Erika Gerling stated the Beatty Town Advisory Board supported this project.

Is this the reason that Samantha resigned, if so what a loss to this county, in fact to all of us that she impacted in so many ways, especially with all the grants she was working on for all of us. Your bullying fit’s (I believe) NRS 116.31184 & the Nye County HR manual pages 18/19 2.1.2. Commissioners might not come under the HR County manual. I know that possibly you and several others took petitions out to “Fire County Manager Tim Sutton”, to various meetings, one of my friends signed the petition and when I asked her why it was because of her “anti masking & vaxing” stance. She has never attended a BOCC mtg., never called in to a meeting and admitted she knew nothing about Tim Sutton. How many others like her signed, many I would imagine. AUACHMENT 1 I agree that IM’s should not have gone out about you during meetings, but this should have been handled in a closed session. You “aired” dirty laundry and attacked people which should never be done in front of others in any situation. I couldn’t believe the “chairman” did not stop you and also the DA. The really sad thing Commissioner Blundo is that we all could see how much you enjoyed the attacking and the bullying so we all saw what kind of man you are and it wasn’t a pleasant picture.
