said if it the County had to pay DWR’s bill she would recommend taking it out of the NCWD funds.

mentioned the overturning of Roe v. Wade and the justification in New York to get a concealed weapons license permit.

said Cles Saunders’ celebration of life would be today at the Bob Ruud Center from 6:00 p.m. to 10:00 p.m.

wondered if the County would do better going self-insured. Lorina Dellinger said staff was directed by the Board last year to look at self-insured. She had been working with Mr. Rossi and his team and comparisons were in the back up. This was not an action item to take regarding self-insured, but whether or not the Board approved the POOL renewal would determine what staff would do.

Commissioner Cox

agreed with self-insurance, but she noted the County may have a couple of lawsuits in the future that would be pretty extensive and she did not know if POOL/PACT would cover those. She wondered if this could be held to another meeting or if there was a deadline.

Mr. Rossi

said he talked with Samantha Tackett about any claims that were not tendered. Any time coverage carriers were switched any claims before the effective date would be aggregated and any notice of loss would be sent to the TPA to accommodate the July 1, 2022, expiration date.

Commissioner Strickland

wondered if the Board would consider self-insuring for item 8, the Town of Pahrump, and see how it worked before doing it for the County.

Mrs. Dellinger

advised it did not make sense to go self-insured for the Pahrump policy because it was minimal and there was a very low claims experience. The recommendation was to continue with POOL for the Town of Pahrump policy.

Mr. Rossi

added the premium for the town was quite low and the retention would be above where the current premium was. The deductible was also low and the cost was not as substantial as it was for Nye.

Commissioner Strickland

asked how the current insurance carrier would say the County was performing with this policy given the capped liabilities. Mr. Rossi

explained at the loss ratio the County currently had the response was an increase from a $1 .2 million premium last year to $2.041 million this year. The response on the open market between Liberty and Berkley was a not to exceed premium of $1 .297 million. As they continued to refine their quote that was the absolute cap on the premium, but it may deliver below that number as well.

Commissioner Jabbour

was not in favor of self-insuring. He said insurance was a huge risk factor for any business and this was about employees. The amount of claims over the last ten years was significant and that was why the premiums were going up. He thought a better job of training the employees was needed starting from the top.

Commissioner Jabbour

then advised he had requested a report to dissect the why and he had not received anything. Tim Sutton said loss run reports had been received for a while, but they contained confidential information so staff would try to redact that to provide something for the Board. He knew POOL and Mr. Rossi were working on a report that would be a little more legible to identify specific departments and claims that kept re-occurring to learn how to target responses to those.

Mr. Rossi

advised that report was complete. He thought it was at the County and he would make sure it was provided.

Commissioner Blundo

did not feel all of the relevant information was provided to the Commissioners and he did not think he had enough information to make a decision today.

Commissioner Carbone

pointed out this decision had to be made by July 1, 2022, or else the County would go self-insured. Bradley Richardson cautioned the Commissioners about taking action to self-insure as it was not on the agenda.

asked what caused the policy to go up so high. explained it was purely off the loss ratio over the last several years. There was an increased frequency and increased cost of claims. Since the loss ratio was over 100% the only option available this year was the $50,000 deductible, and within the actuary that generated a premium of $2,041 ,1 72.00.

Commissioner Blundo

asked if there was one department that specifically drove the losses.

Mr. Rossi

said law enforcement liability was the large driver of it at this point.

Commissioner Blundo

asked Mr. Rossi to go through a couple of years of what the premiums and claims had been. Alan Kalt, CFO for POOL/PACT, said in the current fiscal year the total incurred claims as of May 9, 2022, were $1 .872 million with a net POOL premium of $1.1 million. For every $100.00 of incurred claims the POOL had paid out $159.70 without any operating costs. In 2021 the total was $1 .6 million and the net revenue paid to the POOL was $81 7,000.00, and for every $1 00.00 the County paid it incurred claims of $1 95.90. Both of those numbers were well in excess of 100%. In FY2020 the ratio was 76%, so it was better. In FY19 it was $1 53.60, FYI 8 it was $73.01, FYI 7 it was $1 19.30, FY16 it was $95.80, and FY15 it was $141.60. In looking at those eight years the County was well in excess of what it paid into the POOL. Mr. KaIt said in order to pay Nye County claims money paid by other members was used. There were frequency and severity issues on the claims, which drove the premium up.

Commissioner Cox

asked how much the County paid into POOL versus what they paid out in claims.

Mr. Kalt

said the County paid $7.5 million and the POOL had incurred costs of $8.8 million, so about $1 .3 million exceeded the net POOL premium.

Commissioner Jabbour

said the trend of the last ten years pointed to an increasing frequency of claims along with an increase in severity. He could not say what would happen in the next year, but the data indicated the trend would continue.

pointed out one item said agent compensation. He asked if that was traditionally 9% and if it was included in the premium.

Mr. Rossi

explained POOL paid a given percentage of just under 7%. This year they decided to do it completely separate and cap it at a lower number. It was not included in the premium because they requested the quotes to be net of commission to discuss the premiums.

Commissioner Blundo

asked when the Board would find out the total cost of the premium.

Mr. Rossi

said they combined Pahrump, Nye, and the workmen’s compensation and set the final fee at $1 00,000.00 for everything, which was about $30,000.00 lower than last year.

. John Koenig thanked Commissioner Jabbour for the motion as he thought that was the only way to go. If the losses continued on trend the $2 million would be paid out anyway if the County was self-insured. Mary Fisher hoped the Commissioners made the right decision. Assessor Sheree Stringer did not think the County had any other choice but to go with POOL at this time. She thought a catastrophic accident would bankrupt the County if it was self-insured.

said he was on the fence. He understood both sides and wanted to give POOL one final opportunity. As far as comparison between the two options, Mr. Rossi stated POOL was providing the County a contained cost in that it had a lower deductible. As far as frequency of claims, that would generate less back to the County and more paid up front. The option of self-insuring was more of a risk. The County would take on much lower costs at the beginning and build back into a program to arrive at a total cost. Looking at where the County had been historically and what the carrier paid out, the claims were capped at the retentions given. In a self-insured model that was $250,000.00 instead of $50,000.00. From an actuarial standpoint they were looking at the trend. The real difference between the two was the County would finance less on the self-insured side and take more of that authority on and when taking authority more could be done in- house.

Commissioner Cox

asked what the limit was that POOL paid out on each accident and each person involved.

Mr. Rossi

advised the per incident limit was $10 million with a $10 million aggregate.

Commissioner Cox

said if the County went self-insured then there would be $2 million to start with and more attorneys could be hired to do it. Lorina Dellinger advised regardless of how this item moved forward, a corrective action plan would be brought forward. The report would also be restructured to provide to the Commissioners so they could review them quarterly and bring forward any department/office responsible for the claims to the Board.

said staff was not recommending going self-insured right now as the deductibles would be higher. The cost of the program staying with POOL made sense for Pahrump at this time.

agreed with Commissioner Cox to do it for both.

advised the current structure of the program for the town was a maintenance deductible of $2,000.00 with a $1 52,000.00 premium. If the town was self-insured one loss would cost more than $100,000.00. The premium was probably too low to look at a self-insured structure for the Town of Pahrump.

Commissioner Cox

asked what the limit was on this per accident per year.

Mr. Rossi

said with the POOL program it was also $10 million per occurrence and $10 million aggregate per year.

Commissioner Jabbour

asked if Mr. Rossi was able to give the Board any numbers on claims for Pahrump for the past five years, more specifically last year.

Mr. Kalt

said in 2017 the total incurred was $2,871 ,00.00; in 2018 it was $131,862.00; in 2019 it was $16,399.00; in 2020 it was $13,402.00; and in 2021 it was $22,501.00. He did not have a loss run through the current year.

Commissioner Cox

asked how much the County had paid for the program over the five years.

Mr. Kalt

said he did not have that information, but in 2021 it was $147,000.00. This year it was projected at $163,000.00. He speculated that it had been at least $100,000.00 each of those years and thought the increases had usually been 5% plus or minus based on exposures.

asked everyone to keep in mind that claims were not the only factor when the premium was established. Mrs. Merlino

advised those would be turned over to the Secretary of State’s Office for investigation, but in most instances it was just not understanding how things worked. There were 53 same day registrations, which were new registrations, and 161 registration updates, the majority of which were all change of party. Lastly, Mrs. Merlino addressed the issue with precincts 1 7 and 22. When the redistricting was done there were five households with eleven people not moved into the correct precinct, It was caught, but unfortunately there were five individuals who voted in the incorrect precinct. The same thing happened from precinct 29 to precinct 19. The system had two different spellings of Loreli so ten households did not get moved, but only four votes were cast in the incorrect precinct. All voters had been moved now.

Commissioner Carbone

asked how many voters that were previously classified as inactive voted.

Mrs. Merlino

said she did not have the answer to that because that was usually rectified and those reports ran after the vote history was done and they had not gotten to that point yet. She advised that even after all of the clean-up and redistricting there were June 24, 2022 18. For Possible Action Pursuant to NRS 293.387 (1), Canvass of the returns of the Primary Election held on June 14, 2022-Cont’d. still over 1,000 ballots returned as undeliverable because people just moved and there was nothing her office could do about it. Her office would send notices to those addresses and start the process of cancelling them or updating the address.

thanked the Clerk and her staff for everything they did for the primary.

thanked her staff who worked a lot of long hours as well as the election workers.

Commissioner Cox

mentioned Joey Gilbert said he was going to protest and asked what effect that would have on the Board’s ability to certify the election.

Mrs. Merlino

said by law the canvass had to be done today. He had a certain time period to file a contest or to file for a recount so it depended on what he did. A recount would be statewide and would affect all counties. In a contest she did not know if he would have to do it in each county. Mrs. Merlino said she had also heard there would be a challenge or contest.

Commissioner Blundo

asked about undervotes.

Mrs. Merlino

said it was not necessary that she include that, but in each contest a voter could choose to not vote for anyone, which was an undervote.

Commissioner Blundo

asked why it did not add up when he did the math.

Mrs. Merlino

explained there was also such a thing as an overvote, which there were a lot of, meaning they selected more than one candidate in a race so it threw out the whole contest. It could not be done on the machines, but it could be done on a mail-in ballot.

Commissioner Jabbour

asked if someone voted for more than one candidate in a particular race on the ballot if the entire ballot was thrown out or just that particular race.

Mrs. Merlino

said just that particular race.

Commissioner Blundo

asked what was done with the ballots that were still out there.

Mrs. Merlino

said the election was over and it was pretty common to receive ballots that were voted after the fact. They were date stamped and sealed up with everything else as it was too late to do anything with them. June 24, 2022 18. asked if it could be pushed back two days so it was on a Friday because pushing it forward made it August instead of July.

advised the Commissioners’ meeting was the following day so it would end on its own terms and then it could be someone new or an extension of it if the Board so chose.

pointed out as of today he was done and had to leave the office as the Board voted to keep him until June 24, 2022. Maria Zlotek advised the agenda item as written would allow the Board to make the motion until July 31, 2022, to extend the appointment, and anything deviating from that date could cause a violation of Opening Meeting Law. The Board was committed to that date of July 31, 2022, per the agenda item.

said if the Board passed the motion as it was and extended his term through July 31, 2022, an item could be on the July 19, 2022, meeting.

Mark Kampf thought the Board could handle any legal paperwork on Friday. The revocation of his office would be one legal document, which would be easily handled. July 31, 2022, was also the end of the pay period. Brian Kunzi commended Mr. Kampf for being willing to step up and take responsibility, but he thought continuing with an interim Treasurer was not in the best interest of the County. The one finality that was known was Raelyn Powers was the next Treasurer and he thought it would be appropriate to let her step in now as ultimately it would be her responsibility to get the office into the direction it needed to go. Mr. Kunzi urged the Board to respect the vote of the people. Assessor Sheree Stringer agreed with Mr. Kunzi’s comments. A new tax year was starting July 1, 2022, and there were so many things that could go wrong if the right person was not in there. She was not saying Mr. Kampf could not do it, but Mrs. Powers had been through this procedure and she was qualified to complete the task at hand. Mrs. Stringer recommended the Board reinstate Mrs. Powers into the office immediately. Commissioners Cox and Strickland were not present.

thought the Board spoke clearly in the past. Assistant Planning Director Steve Osborne stated this position was needed because there were two Code Compliance Officers with about 300 cases, mostly property maintenance code cases, and that took up all of their time. There was no one to focus on marijuana facility compliance, dust compliance, and the Pahrump business license requirements. This position would focus on those things.

did not see the necessity for Code Compliance on top of the Cannabis Compliance Board (CCB) and the Sheriff. He asked why the County would look at the Pahrump stuff. June 24, 2022 21. For Possible Action Discussion and deliberation to: 1) Approve the FY23 funding structure split for the planning department to support an unbudgeted Senior Code Compliance Officer position resulting in no budget impact to General Fund 10101; and 2) Approve an unbudgeted Senior Code compliance Officer position within the Planning Department to be funded partially from Nye County General Fund 10101 and Building Fund 10254-Cont’d.

Mr. Osborne

explained they reviewed all of the business license applications to make sure the building was in the proper zoning, which was a County function, not a town function. It was also to make sure they were in compliance with fire codes. Code Compliance Officer Mark Gancarz added dust control issues were called in daily and they had to take care of those calls. Included with that were track-out calls at construction sites. He believed the marijuana and the jails were all quarterly reports that needed to be done so they had to visit them quarterly. The administrative part of the job took time away from the compliance officers, and the complaints had exploded, which also took away from the administrative duties, or vice versa. This position would be more administrative.

Commissioner Carbone

asked why a senior position.

Mr. Osborne

did not know the answer, but he thought it was because this position could then help supervise the two Code Compliance Officers as well. There was no senior officer right now.

Mrs. Rucker

explained the idea was to create the position and allow for internal and external applicants and hire someone in. If it was an internal promotion then the vacancy would be filled.

Commissioner Jabbour

asked for clarification on the 300 cases as a report was given a couple of months ago and it was nowhere near that.

Mr. Osborne

said in 2019 there were 260 total cases received and processed, in 2020 there were 313 cases, and in 2021 there 342 cases. Currently each Code Compliance Officer had 130 to 150 cases they were handling.

Commissioner Jabbour

said that was approximately 25 issues per month, which equated to one and one-half a day they would have to make contact with.

Mr. Osborne

said each case required multiple actions to be taken as well as several letters done.

Mr. Gancarz

added each case was different. With some cases one letter went out and they came into compliance. Other cases had multiple letters, then went to citation, and then a report of investigation had to be done if it was going to the District Attorney’s Office. Then there were days in court, some days two to three hours and some days June 24, 2022 21. Some of the cases went away, but for the most part people did not want to comply and they had to go the full gambit, which could go to six months of having that case open and they had to do their part every 30 to 40 days to send letters and reassess the property.

Commissioner Jabbour

said he had trouble wrapping his head around the justification when the position would be administrative. He asked what was generated annually from citations or if they were just a sticker put on the door.

Mr. Gancarz

did not have that information.

Commissioner Carbone

asked about if they went through the court.

said the judge would order the fines.

Commissioner Cox

asked Mr. Osborne if he was running things from an administrative point of view.

said he was the Assistant Planning Director.

said she was in the Planning Office yesterday. She noticed a lot of people had been hired and she asked how many.

Mr. Osborne

explained vacant positions were filled when people left.

Commissioner Cox

said the cars there had increased as well. There used to be four people, and now there were 14, which she were all administration. She had concerns about hiring too many people because it was done once before when things were good and they had to be let go when the bottom fell out. She also did not understand why Mr. Gancarz was not being promoted to this position and another person hired on a temporary basis to get through the tough time.

Commissioner Carbone

said the idea was to get the position, move someone into it, and move someone into the lower position.

asked how many people worked in the office, Planning and everything, to which Mr. Osborne responded ten. June 24, 2022 21. suggested giving the marijuana inspections to the Sheriff’s Office and let the EPA handle the dust problems.

asked the Board to not make a motion and let the item die. Tim Bohannon said a lot of discussion he heard was there was a backlog and potentially selective enforcement. From a budget standpoint, he asked what the budget for the department was as well as its cash position because he was concerned about adding to it before there was a financial consistency. As to the dust and dig permits, Mary Fisher assumed when it became an issue the more senior people in the department would address those locations. As far as hiring a new person to basically go out and take photographs and return them to the office, she thought the County would be better off hiring someone maybe on a part-time basis with a list of things to do and then they could also work at McDonald’s. She did not think it was a good time to hire. Assessor Sheree Stringer said on May 26, 2022, there was a budget meeting and quite a few people had their budgets taken off of the agenda. There was $750,000.00 to spend and the Commissioners filled what they thought were critical positions, which she understood. However, all of the departments and department heads were asked to wait until after July 1, 2022, to see what type of income could be realized and then bring the positions back. She thought that was what should be done.

Mr. Gancarz

stated there were two people who recently retired and those positions were just replaced. Nothing was added. This item died for lack of a motion.

said this weekend the Shoshone Tribe would hold their powwow which they had cancelled the last couple of years. Also this weekend in Tonopah the VFW would have a special ceremony starting at 10:00 am. for the proper retirement of flags. The colonel of the Nellis Air Force Base would be present to make a flag presentation to the Town of Tonopah and the VFW. There would be barbeque, music, food, and entertainment, as well as Red White and Booze festivities. He then reminded everyone to protect their children, conserve their water, and spay and neuter their pets. Seeing how the vote went, Commissioner Blundo said he would like to have an item come before the Board to have a third party handler for self-insurance. Tim Sutton said the Board gave direction for staff to pursue self-insurance several months ago, which they did. Given the vote today staff would move forward with what was presented today.

asked who would do the third party.

Mr. Sutton

said there were multiple different carriers. Lorina Dellinger added staff was still waiting for a couple of other options, but the third party at this point would have no financial impact so they were going to move forward with that administratively. LP Insurance could provide a list of who they contracted with.

asked what would happen if the Board did not want to use those people.

Mrs. Dellinger

said it could be solicited, but the policy went into effect July 1, 2022, so she did not think there was time to solicit.

asked Mr. Sutton for a timeline on supplying the report

Mr. Sutton

said he would have to look at it, but probably about a month.

asked Savannah Rucker about the ARPA policy and when it would come to the Board.

Mrs. Rucker

said she spoke to the external auditor yesterday. There were a couple concerns they had been looking into, but those had been resolved and they had language they thought would help them move forward more effectively.

asked Tim Sutton to bring a policy to the Board to alleviate the Planning Department’s burden and make it more streamlined. He then said during the ____________day June 24, 2022 23. wanted to look into an item to have it done in a public meeting with proper notice. He asked Mr. Sutton to look up that process and provide it to him.

asked how he went outside of his authority.

said he never should have sent the e-mail to begin with.
