Commissioner Cox

talked about the Remote Area Medical event. As to the dogs being returned, the County did not have control over it. The owner wanted 22 of them back because he had them sold. If people had complaints, she suggested they let Judge Lane know. As to the special events board, Commissioner Cox said there was a tourism board and she thought it would be a good idea to have them get involved in the events.

said the courts currently had a warrant amnesty program. As to solar, if they wanted to come to the community and use the people, he wanted to see a 50% solar subsidy on the bill.

said the new slide he was able to secure was back ordered and hopefully would be here in October or November.

said the Town of Pahrump advisory committees would have a booth at the Fall Festival.

said he had a good time doing the veterans Forget Me Not campaign. He asked Tim Sutton to make sure things were okay in the Public Administrator’s world due to the recent murder in Clark County and have a conversation about what may need to be done there. When it came to balloons, Commissioner Carbone told Mr. Dubin that he hoped Planning had given them a map so they knew the areas where they could ascend and descend.

made a motion to continue this item to January 17, 2023, at 10:00 am.; seconded by Commissioner Ccx. Allen Sanders stated the people in the community did not want this. It was an eyesore and would not benefit them at this time. When they did the survey they said they looked at all the endangered species, but they did not check with the people. Ammie Nelson asked everyone to not give up and to not lose interest in this solar farm. The profits would go somewhere else and she did not think the taxes would be a real benefit to the community. The dust alone would be harmful to her. Helene Williams, chair of the Nye County Water District Governing Board (NCWD), said everyone needed to realize that not one project on solar that had come to the community had ever discussed the amount of water use. They never submitted a plan for the water during or after the development. She asked the Board to develop some kind of process so when these companies came to the Board they notified everyone of the amount of water they were going to use. Bruce Herman said he lived on the corner of Gilmore and could view it from two different directions. He bought the property to watch the mountains, not metal signs that were going to be tagged by the kids. The value of his house would go down 7% to 10%, so he would never be able to sell it. Mr. Herman stated there was plenty of land to put a solar panel on that was not in the middle of a development. Dee Mounts said a lot of misinformation was going around. This private solar farm was not recommended to the Board. She asked Commissioner Carbone for the change in the PRPD code for a protection halo around the County so the solar farm companies could not put them in residential areas. She would like to make sure everything was transparent on the solar agenda items. Herman Lewis suggested any project that required water be given to the NCWD. John Shewalter advised the Commissioners to be sure they knew who they were crawling into bed with. Con Ed had a long history of major accidents, prosecution for bribery, etc. Pat Minshall said evidently the panels were not recycled and were only good for 20 to 25 years. She asked how would they be stored or destroyed. Maury Wiggins pointed out water could be contaminated with the lead that came off the panels. William Lee said the reason so many of his neighbors were at the meeting was because they thought this would be the last hearing, but a lot of people would be at the next meeting. There was also a demonstration planned in front of the Con Edison headquarters.

explained the items were being moved because the contractor wanted it moved to January and the Board was not changing what the RPC already determined. Clay Jensen with Energy Project Solutions, representing Con Edison, said when this application was originally brought before the town board this Commission, acting on behalf of the town board, sent a very clear message to the applicant that they needed to go to the community and find out what they thought about the project. Their feelings were clear. He explained the request to postpone it to January was one last opportunity for the applicant to consider substantial modifications to the project and see if it made sense to even bring it back to the Board. They did not want to go forward with an application that received this kind of community response. September 20, 2022 8. 10:00 am. Robert Thomas said he installed a solar array in his backyard five years ago based on the representations made that seemed reasonable at the time, but the benefits had not accrued as promised. He invited the Commissioners between now and January 17, 2023, unless the item was totally withdrawn, to have a CPA take a look at their numbers cost to benefit.

asked Mr. Jensen if solar was such a great deal why not just do a program for rooftops or in people’s backyards.

explained there were struggles with trying to represent the solar industry in general, and that was not his role here. There were so many nuances it would take an hour to answer that question.

said since they would use the County’s people, water, land and resources, he did not want to have a conversation about solar unless the applicant entertained a 50% solar subsidy on the bill since this would be in the people’s backyards. Since they had an agreement with Clark County, Commissioner Cox suggested Con Ed take all of their projects to Clark County. She did not want to continue this as she felt nothing would change between now and January 17, 2023.

. Michael Selbach and Jason Gettle were present. Mr. Selbach thanked Mr. Osborne for his help. They had removed 17 junk vehicles, a 40 yard dumpster of garbage plus another seven 3-yard dumpers, and 10 truckloads. The parcel Ms. Hargiss talked about was his property. There were three vehicles there and Mr. Selbach got two out, but there was still one Scout sitting there. They were trying to contact the owner, but if they could not they would have it taken to the junk yard. Mr. Selbach then pointed out this has been a mechanic shop since 1994. When they were told they were out of compliance they asked what they had to do to get grandfathered in and were told they could not do that. He was told at the RPC meeting the reason it could not be done was it was not a licensed business. In 2020 it was Spring Mountain Auto and Air and Mr. Selbach had the license in his hand, which expired right in the middle of COVID in 2020.

Mr. Selbach

did not think they got a fair shot with the grandfathering so he would take the zone change, but he was asking that it be grandfathered in.

Commissioner Strickland

explained a grandfather was granted to the owner and ran with the owner unless the owner was an LLC or corporation, then it would last forever. When Mr. Selbach bought the property the grandfather went away.

Mr. Osborne

clarified if something was grandfathered in it did run with the land. The owners could change, but it would still apply. He thought that had been looked at which was the reason for the zone change because it did not qualify for a grandfathered use.

Mr. Selbach

could make an application to have Planning look at it again.

Commissioner Blundo

referred to pages 6 and 7 of the back-up which listed special conditions of approval for the zone change. He suggested conditions two through twelve be removed as he felt everything was covered in condition one.

said he would rather not approve this at all and allow them to go back and apply for the grandfather.

Mr. Selbach

said he would like to hear from the Planning Director as to whether it was worth pursuing. Planning Director Brett Waggoner said he had discussed this many times with Mr. Selbach. There was no grandfather and just because there was a business t was not automatically grandfathered. If Mr. Selbach wanted to have the grandfathered use reinstated, it would still require a CUP. Additionally, Mr. Waggoner said the conditions

explained the conditions Commissioner Blundo was speaking about were special conditions for the CUP. This was the zone change and conditions one through three pertained to it. The rest were final action by the RPC and Mr. Waggoner did not believe the Board could go back and undo what the RPC did without an appeal from the applicant wanting to change those conditions.

recommended Mr. Selbach appeal the RPC decision as anything the Board did would set precedence.

explained it was a national standard for cemetery plots to have a period of time things needed to be removed by.

pointed out it was leaving the estate and going into the trust, which was the house which had to be sold. She suggested Commissioner Cox come into the office and look through the file as this was a huge case. COUNTY MANAGER

noted the cost was $7,965.71 for a twelve-month period. She thought the cost in operations needed to be considered because each of the staff members were here longer than they should be.

asked if it was possible to use the system the Commissioners used when they called in to a meeting and it would be free. Samantha Tackett said there was the option to take away the teleconference system and transfer one person at a time into the chambers. That was not recommend for the public because there was no control as to whether they were in or out or on or off. It would also be cumbersome as they would call into the Pahrump office and then be transferred into chambers.

asked what caused the changes in costs from month to month.

explained the County paid about four cents per minute per caller. The costs went up when the meetings were long or there were more people on September 20, 2022 38. thought the people who could not attend the meetings appreciated having the system. Tim Bohannon said he was a heavy user of the phone call dial-in as well as on-line and was in favor of keeping the system. Ammie Nelson said she was a big user of the system now that she had her health issues and it was the only way she had to communicate. She felt it was a necessary tool for the public. Pat Minshall agreed with Ms. Nelson. Ms. Minshall had to call into a meeting once and she appreciated being able to do that. She felt it was important to keep the system. Ron Boskovich said the last thing that needed to be done was impeding on anybody’s desire to chime in and participate. He thought it was a very small cost for the benefit received. John Koenig advised the system came during COVID and it worked. He thought it should be kept for the public. Helene Williams pointed out staff used the system often and she had used it as well. A lot of boards and organizations had teleconference systems now and she supported staying with teleconferencing. Dee Mounts said she was using the system right now as she was on the phone. There were people who could not attend the meetings and felt they would not be able to voice their opinions. She thought the County should keep the system. Herman Lewis thought the teleconference system was the best resource that brought accessibility to the meetings during COVID. If there was another pandemic in the future it would be a good thing to already have in place. Erika Gerling said she would like to see the County keep the system in place.

For Possible Action Discussion and deliberation regarding the budget status for June 2022 for Nye County and all sub-entities for fiscal year 2022. Elizabeth Enriquez from Finance presented the budget status through June 30, 2022, which was in the back-up. Revenue was in line with what was budgeted for FY22. There were also a few departments showing over in services/supplies and Finance was working with them, but there were no budgetary issues found that would affect the audit. Tim Bohannon assumed the pre-audit checklist was being done. He liked the feedback that there were no red flags at this time, but he would like to see more forecasting with the budget. Savannah Rucker advised her team forecasted every single fund either quarterly or monthly depending on the fund. 40. For Possible Action Discussion and deliberation for approval of the Nye County American Rescue Plan Act (ARPA) Policy to provide written guidelines for the administration of ARPA funds to the public, small businesses, non-profits, and government agencies located within Nye County.

disclosed she had several small businesses within the community, but she would not participate in any of the funding and saw no reason to recuse herself.

disclosed he had businesses in the community as well and he did not see anything that would preclude him from participating in this item at this time. Savannah Rucker and Contracts and Grants Manager Stephani Elliott presented the ARPA Policy contained in the back-up. They asked the Board what timeframe they wanted to set for the application process. Ms. Elliott was thinking 45 days to give businesses an extra two weeks to get the paperwork in.

made a motion that the application process b 45 days and the review process be an additional 45 days; seconded by Commissioner Jabbour. Tim Bohannon asked if it really took 45 days for the businesses to complete it or if it was because of the content or because they did not know what they were doing. If it was the latter, good instructions upfront would help clarify and reduce that timeline. He said 90 days total seemed like a long time.

reviewed the requirement for tourism agencies in the County to apply. She asked for clarity on the allocation for the towns. Pahrump Tourism Director Arlette Ledbetter said the other towns could use the money for any of their marketing strategies.

made a motion to amend the tourism policy to massage the language to include promotional material and visitor guides, or to increase tourism throughout the County; seconded by Commissioner Strickland; 5 yeas.

reviewed the requirements for premium pay applications noting who would administer the program needed to be changed from Health and Human Services to Finance.

made a motion to amend where it said Nye County Health and Human Services on page 20 of the back-up, under Applications for premium pay are submitted through Nye County Web-based platform, instead of Nye County Health and Human Services it would be Nye County Finance; seconded by Commissioner Carbone; 5 yeas.

said language regarding that the Nye County Comptroller or designee was the final approver and disputes would be taken to the Board of County Commissioners needed to be added.

Kelli Sater, president of The Butterfly Effect, a non-profit organization, said they would apply for funding. Diane Southworth asked how much money the County received and how was it being divided up. Staff provided her with the funding allocation contained in the back-up.

said the water issue needed to be checked, but she thought it was actually reclaimed water. As to the dust coming off the project on Tecopa Road, she pointed out that was 14 miles from here which was a long way for the dust to come.
