Commissioner Cox

asked in what direction Darrell Lackey should be sent and who he should be talking to that could help him. Stephani Elliott stated the question posed was whether or not she could assist Mr. Lackey in applying for a federal grant. At this time she was not employed by Mr. Lackey, and they did not offer the types of services to help other people in the community apply for grants other than the grants they were providing to the community. There had been a lot of questions regarding CDBG. She advised those were chosen by the State, not the County, and the one project going forward was approved by the State.

Commissioner Cox

asked if there was anything Ms. Elliott could do to help him.

Ms. Elliott

suggested he e-mail her again with specific questions for the type of assistance he sought.

Commissioner Blundo

clarified Mr. Lackey wanted Ms. Elliott to do the grant for him, which was not her job. If he wanted help he could talk to Paul Miller. Mr. Lackey had also been told to write a business plan and bring it to the Commissioners.

Commissioner Carbone

stated unfortunately the plan was incomplete and there was another year coming up. He had talked to a couple of people to help him and until that happened it could not go any further. Mr. Lackey would have to pay for someone to help draft it.

Ms. Elliott

said it was the CDBG office directly that stated the public service grant applications would not be considered for this year’s tranche, which was why it did not move forward.

Commissioner Blundo

addressed the GPS issue in Amargosa. He thought it was across the County with address changes and it did warrant a second look, It may be as simple as updating Google.

Commissioner Strickland

said they were meeting with staff regarding 1620 Chucker tomorrow at 1:00 p.m. and would look further into the item.

Commissioner Carbone

reminded everyone that today was the day before Pearl Harbor Day.

Commissioner Blundo

stated he applied for the Justice of the Peace position and he would recuse himself from the item.

was not present. Robert E. Thomas Ill, one of the applicants, said he applied for employment in other counties for other jobs and there had always been a ranking list. He was surprised there was not one when the job was initially advertised. He pointed out the proposed December 6, 2022 26. For Possible Action- Discussion and deliberation to approve, amend and approve or reject an EvaluationlRanking Matrix System for appointment of an individual to the Pahrump Justice of the Peace, Department B-Cont’d. list was not complete and he invited the Commissioners to ask staff to make it more complete. As to how to rank applicants, those who have watched the judicial process, but had not participated as a judge or a pro tem, did not really understand the process. There were several applicants who had investigative experience, but there were no assurances they knew how to view probable cause in a search warrant. Another item missing was determining conflicts of interest. Linda Clark did not think people needed to be recycled as there were plenty of people to apply for these positions. She felt fresh blood was needed. Leo Blundo believed the idea of a ranking system was a good premise, but he thought it was just another opportunity to buy time as it should have been done already. As to conflicts of interest, a person would not know what those were unless there was an item before them. Edward Bevilacqua stated he had been in Pah rump for about a year and a half. In that period of time he had come to see some of the challenges the Commissioners faced in getting things accomplished. The challenge here was there were people incarcerated who were being held too long as well as people being let out because there was no judge and they were trying to make room. He thought the ranking system was good, but if it would lead to further delays the Board needed to move on. Ammie Nelson said she looked at the forms in the back-up and also wondered why this was this not done before. This month was four months without a Justice of the Peace, and the clerk spoke about the cases not being heard. It was Ms. Nelson’s opinion the County was opening itself up to lawsuits by people who did not get speedy trials, did not get heard, or did not get released. She did not agree with postponing it.

Commissioner Carbone

said this process was used before with the marijuana facilities, which turned out very well. He thought the Board needed to move forward as someone needed to be put on the bench.

Commissioner Cox

understood all the applicants would come up one more time to speak to the Commissioners, after which a ranking would be made, not a decision.

Commissioner Strickland

explained the Commissioners would rank them as they came up, turn those rankings into staff, take a break, and then staff would came back with the top three, at which time the Commissioners would make a decision.

Commissioner Carbone

said he would like to have a special meeting right after the close of the applications.

Commissioner Strickland

said she would not be available as she was out of the country until December 19, 2022, and to have a meeting without her would be unfair to her constituents. Tim Bohan non agreed that it needed to be done as soon as possible, but he was a constituent in Commissioner Strickland’s district and he wanted a voice. Ammie Nelson thought all of the applicants should be notified to be sure they could appear that day. Leo Blundo said the Commissioners had an obligation and should be hearing this. He asked them to pick a date that was reasonable to them. Pat Minshall felt this should be done as soon as possible.

felt it was wrong to not wait until the new Commissioner was seated.

was concerned with what was happening with the court. There was a pro tem, but his capabilities were limited. December 6, 2022 27. advised there was a pro tem judge and there was another one who could come forward. Tim Sutton advised the Commissioners that Michael Foley just got off the bench and wanted to speak on this item if the Chair would permit him.

asked for the name of the other pro tem judge available.

Mr. Foley

stated it was Harry Gensler, but he was retired now and there was no one who could replace him.

Commissioner Strickland

made a motion to hear this item on January 3, 2023, in Pahrump and not in Tonopah; seconded by Commissioner Cox. Tim Bohannon liked the date and suggested having a back-up process should this happen again. Linda Clark thought the new Commissioner should have some say on it. Edward Bevilacqua said as a lawyer speaking on behalf of people incarcerated, not everyone was guilty because they were arrested. Taking the position that they would miss Christmas because there was no judge was not a good policy for the County. He felt the sooner the better. Darrell Lackey thought two people were needed since it was so backed up and that Bill Hockstedler and Mr. Thomas should be put in today. MarIa Ziotek said public comment should be about the date selection to keep with the agenda item. Roberta Gibbons thought the appointment should be made now. Robert E. Thomas stated if the Chair was talking about December 20, 2022, then he was all for it and asked the Commissioners to appoint someone as soon as possible. John Koenig agreed with Commissioner Strickland because with four people it could end up in a tie and then it would go to another meeting. For that reason he believed the Commissioners should stay with the motion that was on the floor. Pahrump Justice Court Administrator Alyssa Shoults stated she preferred December 20, 2022, as there were two full calendars on January 3, 2023, that they needed a judge for. If they moved forward with court on January 3, 2023, she would have to use pro tem December 6, 2022 27. Foley and he would not be able to be attend the Commission meeting, which would not be fair to him. Nichole Walters thought it should be done on December 20, 2022. Helene Williams also thought December 20, 2022, should be the date.

felt waiting until January 3, 2023, would not be a problem because the other seat would be filled, and it would give Commissioner Jabbour a few more weeks to get better. The holidays were also coming up and people were going out of town, which went back into January, 2023. She said this was justice court and most of the cases were basically traffic tickets. There were not 100 people sitting in jail because they committed murder. The District Attorney’s Office weeded a lot of them out and dismissed them or plea bargained them down. Ammie Nelson thought the date should be December 20, 2022.

Commissioner Strickland

asked if the agenda item could be written for the Board to appoint more than one judge. Tim Sutton answered no as there was currently only one vacancy. He believed it would require legislative action to create an additional position.

Ms. Zlotek

advised to conduct business under the NRS quorum three of five must be present. Here there was a recusal and an absence, so there was a quorum reduced with a recusal to four, making the majority three. There was a motion and vote, and the Board was going off the agenda item as it was completed.

made a motion to make the appointment on December 20, 2022, to Department B: seconded by Commissioner Strickland.

stated that both she and Commissioner Cox had strong feelings about representation. Pat Minshall said they heard from the clerk that Mr. Foley would not be able to be here on January 3, 2023, 50 it should be done on December 20, 2022. Helene Williams stated NRS allowed the Board the opportunity to do an emergency decision and that date could be set under an emergency tomorrow. December 6, 2022 27. Leo Blundo applauded the Commissioners for reconsidering and asked them to vote for December 20, 2022. Ammie Nelson stated that December 20, 2022, was the absolute best date to move this forward. Debra Gaylord-Thomas said this needed to be settled as soon as possible and she urged the Commissioners to vote for December 20, 2022. Diane Southworth asked if there was a possibility to have this item continued until this afternoon to get Commissioner Jabbour on the phone and resolve it then with a 3-1 vote. Darrell Lackey urged the Commissioners to set the date as December 20, 2022. Bill Hockstedler said he also supported the December 20, 2022, date. Jason Grooms asked the Board to make a decision since he might be in jail on December 16, 2022.

was present. TIMED ITEMS 6. For Possible Action- Discussion and deliberation regarding monthly statement of county treasurer pursuant to NRS 354.280 including receipts, balances in funds, money on deposit, outstanding checks, and cash on hand. Treasurer Raelyn Powers presented the reports for June, 2022 through October, 2022, and said her office was officially caught up. On the June, 2022, bank reconciliation and Treasurer’s report she was able to identify the outage of $3 million, which was directly December 6, 2022 6. For Possible Action- Discussion and deliberation regarding monthly statement of county treasurer pursuant to NRS 354.280 including receipts, balances in funds, money on deposit, outstanding checks, and cash on hand-Cont’d. related to entries. The residual amount of $300,000.00 was related to auditor entries for the FY21 closing and the auditor was researching those.

Commissioner Carbone

asked if the County had a certain amount of funds available, like $124 million, or if “County” meant the school districts and all other funds within the County.

Ms. Powers

said his definition of County was correct. Tim Bohannon commended Ms. Powers and her team for cleaning this up. He noticed the bank reconciliation portion was up through July 31, 2022, and he knew there was typically a lag of 60 days. He asked if there was any way of getting that closer with the new system. He then discussed the accounts that had significant withdrawal activity as well as the negative balance in County debt service. Darrell Lackey stated the agenda item said for possible action, including receipts, balances and funds, money on deposit, and cash on hand, but he did not hear any of those numbers. 7. Presentation by Atkins regarding the Draft Tonopah Airport Master Plan. Kara Bymers with Atkins thanked the Board for re-selecting Atkins as the airport engineers for Nye County. She also thanked them for the recent approval of task orders, one of which was the Beatty Master Plan which would kick off this week. Gavin Fahnestock from Atkins presented the Tonopah Master Plan they recently concluded. The Board was in recess until 1:30 p.m.

made a motion to rescind; seconded by Commissioner Ca rb one. Planning Director Brett Waggoner explained that when this item was before the Board it did not have ‘For Possible Action” in it, but a vote was taken and it was approved. This item was to correct that.

Commissioner Carbone

opened the public hearing. Brett Waggoner said the application for a zone change was heard before, but it was agendized incorrectly and this item was to correct that. The RPC recommended approval on November 1, 2022. Michael Selbach stated that the second item said the zone change shall go unless it expired and asked how a zone expired.

Mr. Waggoner

said the zone change itself would expire if the proposed use changed for the property or if the proposed use was sold. If it expired, the parcel would revert to its original zoning of neighborhood commercial with no action by Nye County. Sometimes a time limit was put on it, but since this was an existing use it was worded a little differently. December 6, 2022 8. felt that line item should be removed as well since the Commissioners removed the zoning expiration limit.

made a motion to approve ZCMP-22-1 1 with the amendment that special condition two be removed; seconded by Commissioner Blundo.

questioned condition three, which talked about the expiration.

explained condition three was removed last time and he did not know if it had to be removed again, but both conditions two and three should be removed.

amended her motion to approve ZCMP-22-1 1 with the amendment that special conditions two and three be removed; Commissioner Blundo amended his second; 4 yeas. 9. For Possible Action- Public Hearing- Discussion, and deliberation to adopt, amend and adopt, or relect Nye County Bill No. 2022-17: A Bill proposing to amend Nye County Code Title 17, Comprehensive Land Use Planning and Zoning, Section 17.04.920: Conditional Use Permit Procedures, by deleting Board of County Commissioners approval and adding “Reconsideration of Conditions”, and providing for the severability, constitutionality, and effective date thereof; and other matters properly relating thereto. Brett Waggoner stated this was a draft. There were instances where people requested reconsideration of conditions, but they were not on conditional use permits. This was just adding language for a procedure to follow for staff and the RPC. As far as removing the Board of County Commissioners, he explained that was just wording that was in there that was not realized because the Commissioners did not provide approvals for CUPS. It was reworded to correct that, and applicants could still appeal to the Board if they disagreed with things at the RPC level.

opened the public hearing. Ammie Nelson addressed pages two and three of the backup. She did not see anything that would require someone to notify the surrounding areas of adverse conditions. She would like to see something in it to have research done on the people already there.

assured Ms. Nelson her concerns were addressed through NRS with the noticing requirements. Any adjacent parcel 300 feet away from the property line received a notice. December 6, 2022 9. For Possible Action- Public Hearing- Discussion and deliberation to adopt, amend and adopt, or reject Bill No. 2022-18: A Bill proposing to Ament Nye County Code Title 17, Comprehensive Land Use Planning and Zoning, Section 17.04110: Definitions, by adding the definition of Planning Commission, and Section 17.04.915: Waivers and Special Exception Procedures, by changing the Planning Commission and Zoning Administrator Evidence to provide for online application verification and adding “Reconsideration of Conditions”, and providing for the severability, constitutionality, and effective date thereof; and other matter properly relating thereto. Brett Waggoner advised this item was initiated by the Nye County Planning Department in September, 2022, to update NCC 17.04.1100 to include the definition of a planning commission. It was heard by the RPC on October 12, 2022, which recommended approval.

mentioned Mesquite needed to be looked at.

advised he drove Mesquite the other day and he thought it would be one of the first roads they would scrub seal in Pahrump so the road stopped coming apart.

Commissioner Blundo

said Retread also needed to be looked at. He asked about the projected completion date for Pahrump Valley Boulevard and the total fines.

Mr. Boiling

said he could not discuss the fines. They were supposed to have all the parts for the plant that broke down by the end of the day on Thursday. They asked to pave all weekend, but there were a lot of logistics involved to have inspectors there for the weekend. They also had to meet certain temperatures to pave at all. They hoped to have most of it paved by the end of next week. Pat Minshall said the oil and sand on the mile of Farm Road in Amargosa was great and she hoped that could be continued. She advised Tamarack had trees overhanging almost to the middle of the road, which was a dangerous situation. Ammie Nelson commended the Board for taking care of Charleston Park and Leslie. As to the intersection between Red Butte and Bourbon, she did not think it was staff having trouble repairing that intersection. She saw Great Basin and their people there for a solid two weeks with their equipment. it stayed fixed when the County fixed it. She thought it was a waterline herself. She then mentioned the huge potholes on Carberry.

assumed the Chair of the Board of County Commissioners. SITTING AS THE GOVERNING BODY OF UNINCORPORATED TOWN OF PAHRUMP 12. For Possible Action- Discussion and deliberation to: 1) Approve, amend, and approve or reject the Interlocal Contract between the Nevada Department of Health and Human Services and Nye County on behalf of Pahrump Valley Fire Rescue to provide ground emergency medical transportation and ambulance services; 2) Execute the agreement; and 3) Deposit funds to 25520 Pahrump Ambulance. Fire Chief Scott Lewis explained this was a simple agreement with a term of June, 2023, to July, 2027, through the State Behavioral Health and Human Services. This December 6, 2022 12. For Possible Action- Discussion and deliberation to: 1) Approve, amend, and approve or reject the Interlocal Contract between the Nevada Department of Health and Human Services and Nye County on behalf of Pahrump Valley Fire Rescue to provide ground emergency medical transportation and ambulance services; 2) Execute the agreement; and 3) Deposit funds to 25520 Pahrump Ambulance-Cont’d. would give a certain percentage based on rules outlined in the contract for EMS in the communities.

made a motion to approve the interlocal contract between the Nevada Department of Health and Human Services and Nye County on behalf of the Pahrump Valley Fire Rescue to provide ground emergency medical transportation and ambulance services, execute the agreement, and deposit funds into 25520 Pahrump Ambulance Fund; seconded by Commissioner Strickland. Ammie Nelson thanked Chief Lewis for all the hard work he provided to the community.

mentioned how he felt about the PVFR transporting to Las Vegas and asked Chief Lewis to continue to look for ways to utilize partners in the community.

Commissioner Cox

asked why the County needed an interlocal agreement. Chief Lewis explained it would guarantee additional funding through the Medicaid program. It did not affect the service level. It affected the recoup of the money for the services provided under Medicaid.

Commissioner Carbone

moved to appoint Charles Ballew to the Pahrump Tourism Advisory Committee for a four-year term expiring January, 2027; seconded by

asked for an explanation on item 14 as it added up to around $130,000.00. Stephani Elliott explained this was the allocated amount from the State. The State was willing to help the County pay for 50% of Chief Lewis’ costs when he was acting as Director of Emergency Management. The in-kind match was the other half. Essentially this would reduce the burden on the general fund.

Commissioner Strickland

asked if they were already paying that and redistributing who paid it now.

Ms. Elliott

said the County would be 100% and this grant reimbursed 50% of that. Chief Lewis advised that this was standard practice going back for decades.

Commissioner Cox

asked if this was in addition to the fire chief pay. Chief Lewis said it was based on hours worked.

Commissioner Strickland

asked why this was so expensive. Fire Chief Scott Lewis explained it was an acquisition of the appropriate equipment and then strategically placing it in areas where there were hazmat incidents. There were large risk corridors with hazardous materials going in and out of U.S. Ecology as well as the Test Site. The best way was to pre-position the trailers, one in Beatty and one in Pahrump, for the quickest response method with appropriate resources to meet those emergencies. The price included everything.

Lori Metscher, Workforce Director with Nye Communities Coalition, presented their request for funding in the amount of $82,821.64 to assist with youth protective factors. Maryan Hollis noted one phrase the presenter said was low-income youth. All of the youth were low-income and she did not think it should be based on the family income. December 6, 2022 29. Pat Minshall wanted to make sure all the programs went out to Amargosa, Beatty, Round Mountain, Tonopah, Gabbs and Manhattan. In many instances those areas had been overlooked. Ammie Nelson said there was a huge amount of homeless youth and kids in foster care that would benefit from programs like these. She was curious if it would be a County wide program like Ms. Minshall mentioned, if it would be offered to the children that were in foster care, and if some of the money would be reimbursed by the State. Tim Bohannon stated he was a strong supporter of these types of programs. He also felt this should be across the County, not just in a specific location, because he thought that would add value to all of it. He would like to see a little more definition around the low-income rule and how they would qualify. He asked if there were other professions that would also qualify for this type of program.

Commissioner Strickland

said the back-up showed that this item was directed right to Pahrump Valley High School and J.G. Johnson Elementary. She would like to see the program expanded, but this was just for those targeted schools.

Commissioner Blundo

said the youth development coach was $46,000.00 and asked

to speak a little more to the allocated operations. Stacy Smith answered that the allocated cost was the operating cost that followed every staff member. It paid for the rent, utilities, ink, paper, etc.

thought it was a lot of money to hire someone instead of helping the kids.

Ms. Smith

said the service was the delivery of working with that youth and helping them develop all the skills they could transition into college.

Commissioner Blundo

questioned the worker base and stated that 75% of all the money was going to a worker.

Commissioner Strickland

explained the program was offering the skill level for the staffer to teach the student how to get a job, how to do a resume, and be a viable part of the community. December 6, 2022 29. pointed out that they did that already and had a tremendous amount of funding from other sources.

Ms. Smith

said the Workforce paid them to deliver to 55 students in another grant. They could pass out a check, but it would not be ethical to use another grant funded source to work with these 40 youth that did not qualify.

Commissioner Cox

was concerned with the kids being marked as having mental health issues, which could affect them the rest of their lives. She thought if kids were to be taught about getting jobs then a lot of this money needed to be put toward building some kind of vocational/educational school or something that taught them a trade after they got out of high school.

Commissioner Strickland

stated that the mental health portion of this was where the funding was coming from with the ARPA allocations.

Commissioner Cox

said it did not matter. It needed to bring in a vocational center instead of marking kids.

Ms. Smith

commented that the mental health initiative came from the County document and she checked the box.

Commissioner Cox

stated it needed to be removed.

Commissioner Carbone

asked how people would be chosen to be in the class.

Ms. Smith

explained the student self-selected and signed up for the class at Pahrump Valley High School. It was an elective like home economics or shop.

Commissioner Cox

wanted this to be for people with true mental health issues, not integrated into the schools. Stephani Elliott referred to a page in the back-up that talked about mental health initiatives, expansion of assertive community treatment, and substance abuse services. The discussion here was about the wrap around support, which was developing, counseling, and skills training. She felt the program fell into the skills training.

Commissioner Blundo

agreed that the program had a great premise, but he thought school counselors filled this position. If there was a grant opportunity, he wanted the money to go the people. His biggest concern was it was costing $3.00 to get $1 .00 out December 6, 2022 29. said she felt like this was appropriate so she applied.

made a motion to reject and if they wanted to apply they could get the funding from the School Board.

wondered how the curriculum was put together.

Ms. Smith

explained the career and technical ed part was put together by the State Department of Education. Their program used some research-based model programs and used tools on how to develop a job application and a resume, dressing for success, and things of that nature.

Commissioner Carbone

said the program was not based on someone saying someone was not healthy because they had a mental problem.

Ms. Smith

said this would not be for the severely mentally ill people. This was to help people of wellness and hopefully it would prevent them from developing mental health problems in the future.

Commissioner Carbone

asked if this could be added to their workforce program.

Ms. Smith

stated the problem was they had qualified everyone they could for that program. The children in foster care and things of that nature were automatically qualified. This was for the youth that did meet those strict guidelines.

Commissioner Cox

believed they had everything Ms. Smith talked about in the Cotillion program.

Commissioner Carbone

stated the Cotillion program was the lower level of the children. The program they were asking for was for high school students.

Commissioner Blundo

reiterated that he felt the dollar amount was too high and they needed to apply to the School Board.

Ammie Nelson said the back-up showed a large amount of money spent on advertising, which she did not feel was necessary as they had grown in the past few years just from mouth to mouth. Tim Sutton advised that for the past three or four years RAM had requested $5,000.00 in funding since they saw a lot of the inmates.

Commissioner Cox

did not like labeling people with mental health initiatives and said she could support it if that was removed.

Commissioner Carbone

stated that was only in the documentation that was put together from the County based on where they get the money from.

Commissioner Cox

asked if that particular agency dealt with adult mental health initiatives when they saw patients.

Ms. Muccio

said yes, and it served the direct population the Board intended in the initial creation of mental health funds. They saw adult patients seeking care for mental health.

Commissioner Cox

asked why they went from $5,000.00 to $97,000.00.

Mr. Muccio

explained that was due to the additional costs to bring the clinics to Tonopah. This would be the first RAM clinic there.

Commissioner Cox

did not understand why RAM was not asking for this money.

Mr. Muccio

explained the RAM clinics would not happen if there was not a third-party community host group, which was the position of Nye Communities Coalition. Stacy Smith said they were allowing expense reimbursement from January 1, 2022.

asked if the reimbursements were separate and eligible on their own outside of this program, to which Stephani Elliott responded yes. December 6, 2022 30. asked if this passed if they would do another Tonopah clinic.

Mr. Muccio

said their intention was always to get a project started, incubate them, and pass them on to another group in the community to continue them. The plan for Tonopah was to get this year’s done. They were working with the local Rotary Club and based on the success of this year the understanding was to allow Tonopah and Rotary to continue moving forward on their own. Nye Communities Coalition would be there to support them if funding was available, but funding was an issue. If Tonopah could raise the funds for 2024 they would absolutely help them.

Commissioner Blundo

asked if they were receiving funds from Rotary in Tonopah and if so how much.

Mr. Muccio

stated it was not approved yet. There had been discussions and they were waiting on the Rotary’s next meeting. Their contribution at this point had been providing two of their club members to act as community liaisons to plan the logistics.

Commissioner Blundo

stated he did not like the amount and would prefer to give them $10,000.00 to seed it and see the involvement.

Mr. Muccio

cautioned if the funding was not approved the Tonopah clinic would not happen. They could not put on a clinic for $10,000.00 and there were not enough resources in Tonopah to move that forward.

asked if they could reapply.

Commissioner Carbone

said yes. The two people who voted yea could bring it back.

Mr. Muccio

stated because of the timing of the Tonopah clinic, if funding could not be established today the clinic would not happen as they would not be able to start spending on what they needed to do now. It usually took a year to plan a RAM clinic and Tonopah’s was scheduled in March, 2023. December 6, 2022 30. asked if this would help the people in the jail in Tonopah, to which Mr. Sutton responded yes. Ammie Nelson commented that Tonopah had a great need for RAM and she supported the motion.

explained they offered benefits like retirement and health insurance to get quality employees.

Commissioner Blundo

asked if the item was for one position or three.

Mr. Mills

said it was for three people spending 50% of their work on the described tasks. Ammie Nelson wanted to be sure none of this money went to ICE prisoners. She wondered if any of the money went to people who had suffered from abuse and crime. Tim Bohannon did not see a success background on this, but he liked three individuals being committed to it. He asked what the success factor was and what it would be here. In response to Ms. Nelson, Kathy McKenna advised there was money through Victims of Crime Compensation that helped with that, not something Nye Communities Coalition did, but they worked together.

made a motion to approve in the amount of $1 1 5,386.70; seconded by Commissioner Strickland.

Commissioner Cox

wanted to be sure the mental health issues was for adults only and no children were being taken into the program.

Mr. Mills

said yes and explained the program was not designed for children. He could see it expanding toward children, but the crisis response was already met through a children crisis response resource in the community.

asked when the item came back that it include the language that was voted on.

Mr. Sutton

said NRS 244.060 would apply while Commissioner Jabbour was out if there was a tie vote on any other item.

asked if they could have an item to ratify and then execute the Tonopah portion so that moved forward, to which Mr. Sutton responded yes. Ryan Muccio asked if there a possibility to assure that any funds be retroactively approved since they were at a crunch point and needed to start engaging contracts for Tonopah.

stated the County Manager was given the authority to go ahead and make the funds voted on previously available and it would be ratified on another agenda. Maryan Hollis said she was used to following Robert’s Rules so in the case of a tie the motion failed. She asked why Pahrump was bumped to the next meeting.

Mr. Sutton

said they did follow Robert’s Rules of Order, but that was trumped by NRS. Under NRS 244.060 there was a specific provision that applied in cases of a tie vote which was invoked.

Commissioner Strickland

pointed out item 34 was requesting $300,000.00 out of the same fund and asked if that meant it would be less than $37,000.00 if approved. December 6, 2022 32. Mills presented Nye Communities Coalition’s request for $37,728.02 to help reduce and prevent homelessness in Nye County by providing access to income and health care benefits.

Commissioner Cox

asked for explanation on the fringe rate.

Mr. Mills

said that was what allowed Nye Communities Coalition the ability to offer health insurance and a 3% retirement match.

Commissioner Blundo

stated he could not support this item as he supported the three individuals in the other item.

Commissioner Cox

did not like the fact that this was a paid position.

Commissioner Blundo

said he would like to see this money help the homeless, not fund someone to help the homeless. He asked how much of the funding would go to a homeless person.

Mr. Mills

explained the average benefit for someone that had work history and then became disabled was $1 ,358.00 a month. The average for supplement security income for someone that did not have work history was $841.00 a month.

Commissioner Carbone

believed people needed to be self-sustaining and that this program would help people do that.

Commissioner Blundo

asked how many people were helped in 2022.

Mr. Mills

explained that the employee working now did not start until July, 2022, and had to go through the certification process. Unfortunately, that employee had not been able to get people successfully receiving benefits yet. Mr. Mills was personally able to help two people in 2022. Darrell Lackey saw this as being devised to hire someone to get people to suck off the government. People of all types just needed a chance to come into the program he was talking about and learn how to be successful and live with a low overhead, which was what his program was. December 6, 2022 32. Linda Clark felt the County was turning into a welfare county and everyone would return to where they started once these programs ended. She thought the programs were terrible. Tim Bohannon stated he liked the idea of funding, but did not think it was a holistic approach. It was piecemeal. Dale Willis believed this program was more beneficial than other speakers had said. A program which allowed a trained specialist to help maintain their job of helping people connect with the resources to have a basic level of survival was essential in the community.

Commissioner Blundo

noted half of the position was funded by the previous item and he thought this one should be left alone at this time. They could figure it out and report back, and the Board could make a better decision with more information at that time.

Mr. Mills

clarified when he stated he had helped two individuals, that was while doing the jail in-reach and developing the systems. There was a lot more to his job than just this program. He thought it was worth noting this directly tied in to connection to medical services. In order to be determined disabled they needed current medical records showing it was irreparable. As to the ongoing payments, a couple of comments were made about what would happen when this ended. Mr. Mills advised it would be ongoing for those they helped. He also wanted to make sure people who were able to work could work, and those receiving Social Security benefits were not precluded from working. Additionally, the cost to the community for someone living on the street was often quite high and getting them ongoing income would mitigate some of those costs.

asked if the $37,728.02 was for one employee or two.

Mr. Mills

explained it was for half of the funding for one employee. There were also travel costs to take individuals to Las Vegas to continue disability review assessments. Travel to clients’ residences was also part of that as well as records requests from Social Security.

asked if they were paying their employees rent as a benefit. December 6, 2022 32. questioned this program as he believed it was done in-house and he did not understand why this was even being considered. A rough estimate of what the cost was to staff was 85% and that was way too high for him.

Commissioner Strickland

stated there was an allocated $400,000.00 out of the category of affordable housing grants so it had been taken care of already.

Ms. Becker

said a lot of this was just linking clients to services that were already existing. One of the biggest issues was transportation. When someone went into the office and got approval to go into a transitional house in Las Vegas they had no way to get there.

Commissioner Blundo

wondered if those services existed in the community already and if this was duplication of services.

Ms. Becker

did not think so and that was not what she was asking for. They wanted more outreach. Darrell Lackey thought transporting homeless people to Las Vegas and back because there was transitional housing was ridiculous to him. Las Vegas sent them here on a one-way trip on buses. People of all kinds could come to him and get busy with his program. He could not believe grant money would be used on this. December 6, 2022 33. Linda Clark believed if people were being sent to Las Vegas for housing then let Las Vegas keep them and get grants to take care of them. She thought the veterans should be the priority. Dale Willis clarified that the intention was not to send people somewhere else to get a Bandaid. It was to help people who were unaware. Tim Bohannon said he did not see a measurable component.

believed they were paying to put an employee in place.

felt the Commission was making jobs.

Ms. Becker

stated if there was more affordable housing here they would link them here, but there was a waiting list. She wanted to take people to where they could find the assistance.

said one thing the Board had been struggling with was personnel costs, and the personnel cost on this was practically non-existent. She loved the idea.

questioned if the requirements were from their organization or if they were County requirements. Kathy McKenna said they would go by the County requirements. The County would pay for one person for one year. She explained what Nevada Outreach was and did in the community. They were asking for just under $1.2 million. December 6, 2022 34. stated when they went through the allocation process he liked the program that they created as the County and he believed it worked.

Ms. Elliott

explained the Health and Human Services ARPA funding conflicted with the State funding and they could not spend both at the same time. They hoped they could get the program into the hands of community citizens that already had programs in place to get the money out to the public quicker.

Ms. McKenna

stated she needed employees as she only had two and a half people on her staff.

Commissioner Carbone

believed the original plan was to move this out as an allocation process. If they wanted to make that change they needed to go back to what they originally agreed to.

Ms. Elliott

said the policy would have to be redone.

Commissioner Strickland

said the Commissioners either had to approve this item and give them someone to do the administrative work or the Commissioners would have to do the work. It would cost money either way.

Commissioner Cox

asked if they were giving themselves wages and how that amount was determined.

Ms. McKenna

said they set the market wage. They needed to pay enough to make her employees stay. They were run by a board and the board had to approve any raises.

Commissioner Cox

asked if they only helped people who were abused.

Ms. McKenna

explained that was only the No To Abuse side. They also had a family resource center that helped anyone and everyone. Health and Human Services Director Karyn Smith clarified when they ran the other program they had an individual that worked on the program and they would put in for overtime. They had two or three different programs that covered things, and they all had different requirements. They felt it was better to give this funding to the non-profits. December 6, 2022 34. Helene Williams stated she did not know if this included veterans, but they just got a letter from Kroger’s that they would no longer accept Tn-Care. There may be veterans who would need public health assistance. Tim Bohannon noted there were some performance measurements, although it was sketchy on the numbers. He appreciated the program background, but he had concerns with sustainability.

For Possible Action- Discussion and deliberation for direction to pursue completion of the Amargosa Valley Science and Technology Park water pipeline. Natural Resources Director Lorinda Wichman said she was instructed a year ago to bring this back in a year. The tenants did not want it until there was potable water there, and the only viable tenant that had come forward wanted to mill ore there, which was a problem.

stated the money to make a pipeline was the biggest issue.

Commissioner Strickland

advised it was $3 million, but possibly more now.

Mrs. Wichman

said it was closer to $5 million now.

asked if they had reached out to Gridliance December 6, 2022 35. For Possible Action- Discussion and deliberation for direction to pursue completion of the Amargosa Valley Science and Technology Park water pipeline Cont’d.

Mrs. Wichman

said yes as well as all the solar projects and a few mining companies she thought might need office space, but they had a viable concern with the potable water and they could rent anywhere else. She suggested the Board consider selling the property with the well. The well had been drilled and tested and it was good water, but there was a mile of pipeline required, and the tanks filled with hazardous water would need to be relined or replaced. Linda Clark stated there were projects in town that needed water and money and she disagreed with spending money to fix something that was not fixable.

made a motion to direct staff to not pursue the water pipeline; seconded by Commissioner Carbone.

asked if there were any concerns. Tom Boiling said there were no concerns since there were no other bidders and the price was decent.

asked if there was updated language in this new contract.

Mr. Boiling

stated the bottom line was there was nobody else to make this material. It was put out for bid and this was the only person who bid the project. Right now they were at almost 100% purchasing value with this contractor without a contract for the material, and they could not buy more chips from them until July 1, 2023, if this was not approved.

made a motion to award Bid No. 2022-16, Tonopah Chip Screening, to Wulfenstein Construction at the prices listed on the Schedule of Items and prices within the proposal, approve the contract, and fund from 10205 Roads; seconded by Commissioner Strickland; 4 yeas.

directed staff to aggressively pursue the sale of the Amargosa Valley Science and Technology Park.

mentioned the need to identify the water rights there as well.

noted the need to also identify what was in the ground and buried there.

asked if the $12 million was allocated yet.

Mr. Sutton

explained there were two tranches of $6 million and the first one had not been received yet. Stephani Elliott advised it would be pretty lax as far as the use so it would not have the ARPA requirements. They were treating it as general revenues and after speaking with Finance a buffer for capital requests was needed. She anticipated a separate special meeting to discuss funds. She also cautioned if the property in Amargosa was purchased with grant money then the Commissioners needed to wait five years.

believed it was done in 2012.

said he would like an item on the December 20, 2022, meeting to discuss where the $12 million would go. He then reminded everyone to spay/neuter their pets on behalf of Commissioner Jabbour. December 6, 2022
