said she would like to see John O’Brien’s item on the next meeting agenda. Also, she would like to see the ordinance that Priscilla Lane turned in on that agenda. She thought respect was lacking within the school districts, teachers, personnel, and higher ups that had a new way of life they were trying to shove down everyone’s throats. Commissioner Cox stated the bickering needed to stop and the kids needed to be put first.

Commissioner Boskovich

asked staff to help him find out the number of known commercial kennel and special animal permits there were and if they were all current with CUPs. Second, he believed a cap was needed to limit the amount of those licenses at any one time similar to the cap on the amount of fireworks stores. As to tiny homes, the option three that the Board chose he thought was the least intrusive of them all. He did not want to see the County full of them, but he did not want to see the County’s land trashed because of the way they were living on it. Lastly, Commissioner Boskovich asked if money was ever gotten for Amargosa for their electronic sign.

Commissioner Carbone

talked about Prairie Fire. It was a great presentation and he did a little bit of shooting and walking around. He talked with them about their plans and if everything worked out it would be a great destination and should help the economy of the town and the County. Dan Weeks, general manager of the Nye County Water District (NCWD), gave a report on the activities of the NCWD and the challenges it faced.

advised Desert Research had an existing model and he had been told it was the best model created yet for the basin.

asked when would it be available because Commissioner Strickland and he had discussed at length how to determine how much water there actually was.

Mr. Weeks

believed the model he talked about was the best they had, although it was not complete. It needed to be calibrated to the measurements Mr. Klinke had gathered and that would give some real answers.

Commissioner Boskovich

asked if the people on the NCWD were in favor of a building moratorium because he had heard talk.

Mr. Weeks

said absolutely not. They were trying to find the best real number to maximize the growth potential without damaging the aquifer. He did not think there was anyone on the board trying to zero out development.

Commissioner Boskovich

said he appreciated the NCWD’s offer to be more involved in planning, but he trusted the existing departments. They were there for a reason and good at what they did.

Commissioner Cox

asked Mr. Weeks if the NCWD was working with or in contact with Great Basin trying to determine how much water there was.

said there was a meeting with DWR to determine that, but Great Basin had been a participant in some of those conversations.

Commissioner Cox

said she would like to see a moratorium until how much was available was determined. She said she would like the NCWD to work with Great Basin and the statistics they had collected over the year. MarIa Zlotek cautioned this discussion was getting off the agenda item as it was limited to announcements or topics/issues proposed for future workshops/agendas.

Commissioner Cox

said she would love to have a workshop, which Commissioner Strickland agreed with. Planning Director Brett Waggoner said if there was a future agenda item for a workshop he did not think approaching it as a mandate from the Board was the right way to get that done as far as involvement of the NCWD. He thought it would be more appropriate to go through Code amendments. May 2, 2023 3. In response to Commissioner Boskovich’s question about the Amargosa Valley electric sign, Contracts and Grants Manager Stephani Elliott said she reached out to a member of the audience in November, 2022, to submit a budget or project idea. She reconnected with an Amargosa Valley Town Board member to try to get an application forward. Ms. Elliott said they were just waiting for that future agenda item to allocate funds through the ARPA program.

pointed out subsistence farming was marked through and asked if that was what was accidentally put in there. In the previous version in blue it said for the raising, growing of trees and bush crops and field crops for commercial and household use. She asked if that was exactly word for word what was in there before. said yes. What happened was when staff came up with subsistence farming they had to come up with a definition, and that had the keeping of livestock and stuff in it. With the proposed amendment it would put it right back to the way it was when adopted before.

Commissioner Jabbour

said this would allow for field crops whether commercial and/or household use.

Mr. Waggoner

explained subsistence farming purely made it to where someone could have animals and field crops for household use, not necessarily commercial use other than in a couple of the zoning districts that could be done with a CUP. All this was really doing now was removing the livestock portion, and it would not have subsistence farming in there.

said she received a lot of phone calls as to why striping was not done after the roads were done. She asked for confirmation from Mr. Gott that the County did not stripe until the project was accepted as complete.

said they had recently gotten a new striper and gone through some training on it. The plan was to stripe in Amargosa this week and once that was done they could move on with future striping projects.

said Commissioner Strickland was talking about Pahrump Valley Boulevard.

explained Pahrump Valley Blvd was not finished enough until the beginning of April, 2023. As soon as they were done with Farm Road they would move to Pahrump Valley Boulevard. Pat Minshall said Farm Road was completed over a year ago and they had been waiting for the striping. Three times the middle of the road had been marked, but it seemed Wulfenstein never finished the fogging of the road, which they did last Thursday, and the center of the road would need to be remarked again. She wondered if they were derelict in their other projects. Ms. Minshall also wondered where the durapatcher was as that was the only thing that had taken care of the potholes. said this item was documenting an agreement between the Nye County Sheriff’s Office (NCSO) and the Duckwater Tribal Office. The only change was that they May 2, 2023 17. For Possible Action Discussion and deliberation to: 1) Approve, amend and approve, or reject a Memorandum of Agreement between Duckwater Shoshone Tribe and Nye County for the purpose of providing emergency support services to either party of law enforcement for back-up response, radio communication, cross-commissioning to ensure prosecution, and coroner services. In-Kind services will be provided by each government entity; and 2) Execute the agreement-Cont’d. requested they be deputized by the NCSO as deputy coroners because if an individual living on the tribal land passed away unattended they had to wait a significant amount of time for a deputy to arrive. Their undersheriff was a retired chief from another agency who was well adept at the coroner’s duties. This was a written agreement to assist each other in times of need, be it manpower or emergency services.

said since Nevada Silver Trails was mentioned in the application he disclosed he was the vice-chair of tourism for Nevada Silver Trails. He then asked how many communities within the County had applied for the tourism grant through ARPA. Stephani Elliott said just two so far, but she was expecting another application from Amargosa for their electronic billboard. She had also worked a little bit with the Town of Pahrump and Arlette Ledbetter. There was $55,000.00 left in tourism at this time.

asked where they were getting the historical data from. Joni Eastley from Tonopah Main Street said she used a number of different sources, such as newspapers.com, Tonopah.com, a lot of research at the Central Nevada Museum, and the Clerk’s Office had been tremendously helpful in pulling inquests from the early days.

confirmed with Ms. Elliott the funds for tourism were available and asked if Arlette Ledbetter turned anything in.

said no, but there had been several conversations. Arlette Led better said their main project for Pahrump was still pending a proposal, which was to move the fireworks launch site in the fairgrounds to the area it would live permanently.

Update on the 2023 Nevada Legislative Session including Nye County priorities, impacts to counties and actions that counties are required to take pursuant to new legislation. Tim Sutton advised both AB41 9, Assemblyman Hafen’s bill to remove tax abatements for solar companies located in Nevada that sold all power to California, and SB268, to present a ballot question about directing the fire marshal to govern regulations that would cover fireworks statewide, died. All bills reported on last time were still alive. SB354, which would require a Justice of the Peace to pass the MPRE, was amended to rather than taking the MPRE the requirement was that a Justice of the Peace must at the time of his/her election or 18 months after taking the oath pass an exam prescribed by the Nevada Supreme Court. The new bills Mr. Sutton discussed were AB86, related to the proper treatment of animals; AB12I, requiring operators of county jails to notify family and friends of inmates suffering from critical medical conditions; and AB277, establishing a separate category or licensure for a medical facility, a rural community hospital. AB31, which would make Juneteenth a legal holiday, had failed, but ABI41, which did the exact same thing, would probably pass. Mr. Sutton asked the Commissioners to pass on to him or Lorina Dellinger any bills they heard about.

Commissioner Carbone

mentioned AB303, a bill to allow people who could not afford based on their financial status to pay for towing of vehicles. He asked Mr. Sutton to coordinate with the Sheriff’s Office and talk about some of the bills affecting them.

Commissioner Strickland

asked if SB21, the population cap, and SJR4 regarding Yucca Mountain had died.

Mr. Sutton

believed SB21 was still alive and SJR4 died, but he would verify. May 2, 2023 21. For Possible Action Discussion and deliberation to: 1) Approve, amend and approve, or reject the Lease Agreement between Central Nevada Racing Association and Nye County for the purpose of leasing for a portion of property located at the Tonopah Airport for the purpose of Vehicular Races; 2) Execute the Lease Agreement; and 3) Deposit funds into Fund 10209 Airport. Lorina Dellinger said Nye County had been in a lease agreement since the early I 980s and this was the third renewal. Shannon Stringer, speaking on behalf of the Central Nevada Racing Association, asked the Board to renew the lease agreement. The association operated under the name Tonopah Speedway and was now the sole dirt track in Nye County. They hosted racers from six years old to nearly 80 in seven different classes. For this upcoming year they had secured their IMCA license and combining that with their new promoter they expected to have one of their biggest, most successful seasons in many years. Tonopah Speedway was run 100% by volunteers and all funds were returned to the races and track in the form of maintenance, racer payout, and trophies. There were more racers every season bringing their families and supporting the local restaurants and hotels. Mrs. Stringer stated the speedway was a huge asset as it provided fun family friendly entertainment.

Commissioner Boskovich

felt it was important to have this in Tonopah so the Board needed to help them.

Commissioner Carbone

asked how many times a year was there actual racing. James Thibodeaux, president of the association, said they worked with other rural tracks to schedule two-day weekends and not to conflict with other tracks to lessen the travel. There was racing once a month from May until September. Joyce Barishman said she knew they were paying $12.00 a year to the County and asked if that was enough money. They charged $50.00 for each racer a day, and they had pit fees of $20.00 for members and $25.00 for non-members. She asked the Board to reconsider the lease rate. Ammie Nelson stated her support of this item and felt it brought a lot of money into the County.

Commissioner Strickland

encouraged a like and kind organization to do the same at the Pahrump Fairgrounds where an area had been set aside for an oval track.

Commissioner Carbone

explained the process was a pipeline that came out of Utah and went up to the Robinson Mine in White Pine County, so no, but it would eventually tie in to the Green Link North.

suggested doing a MOU, have it appraised to establish value, and then sell it as was being done with two other parcels. May 2, 2023 27. For Possible Action Discussion and deliberation to consider North American Silver Corporation’s Affidavit and Petition for Sale that would allow North American Silver Corporation to purchase a Nye County Owned patented mining claim known as the Constitution Mining Claim, Mineral Survey No. 1424 in the Philadelphia Mining District, Assessor’s Parcel No. 000-258-70-Cont’d. Lorina Dellinger explained patented mining claims fell under a different NRS for sale, so the procedures for County-owned property did not have to be followed and it could be sold to the petitioner. If the item proceeded she would have to check with the Treasurer about the value of it.

Commissioner Strickland

asked how a fair and equitable price would be determined if an appraisal did not need to be done.

Mrs. Dellinger

was not sure she could answer that on an actual claim.

Mrs. Wichman

said the petitioner was looking for the Board’s approval to sell this, and that would set the path of finding out what would need to be done. There was no history of any taxes or back taxes on it, and it was not issued an APN number until she started looking into. If the Board wanted to sell the parcel, Mrs. Wichman would like to pursue the due diligence with the District Attorney’s Office to determine procedures and with the Assistant County Manager on how to establish the value.

Commissioner Carbone

asked if the director could be directed to work on this item and come back with a plan. MarIa Zlotek advised the Board could always give direction to staff, however, the catch here was the item was written specifically as discussion and deliberation. Action could be taken regarding the petition, and the motion could order the Nye County Treasurer to sell this property and then come back with the additional agenda items that may be needed, or take no action.

Mrs. Wichman

stated the petitioner followed NRS properly. She had to put it on the agenda, but without direction from the Board she did not want to tie up everyone’s time if the Board chose to not put it back on the tax rolls by selling it. Michelle Nelson said she had been working with Mrs. Wichman and Mrs. Dellinger on this project. The petition in the back-up had blanks in it that would need to be filled in before it could move forward. NRS 517.460 was specific that the amount of taxes, costs, and penalties were stated in the petition and in this case it was not.

Mrs. Wichman

reiterated this parcel had never been on the tax roll so there was no way to establish a history of paid or back taxes. She asked for direction from the Board to pursue this with the intent of selling it. She would then have to work the District Attorney’s Office to determine how to do that as the Treasurer’s Office told her there was May 2, 2023 27. For Possible Action Discussion and deliberation to consider North American Silver Corporation’s Affidavit and Petition for Sale that would allow North American Silver Corporation to purchase a Nye County Owned patented mining claim known as the Constitution Mining Claim, Mineral Survey No. 1424 in the Philadelphia Mining District, Assessor’s Parcel No. 000-258-70-Cont’d. nothing owed against the property. It would then come back to the Board for final approval. Neal Jones asked that his statement be included in the minutes. He asked the Commissioners to deny the request due to the misleading and inaccurate information contained in the agenda item. It referenced a mining claim in the Philadelphia Mining District and stated it was associated with APN 000-258-70. The Nevada Division of Minerals and the Nevada Bureau of Mines and Geology locate this mining claim in the Belmont Mining District. The agenda item did not mention this claim was within the area of the County known as Belmont. The County failed to provide any documentation to show exactly where the Philadelphia Mining District was or where this mining claim was located. Belmont was listed in the National Registry of Historic Places and the County was being asked to sell a mining claim to allow mining in this historic area. A check of the County Assessor’s Web site for information related to the APN given in the agenda item provided zero results. A check of the County Recorder’s Web site also produced zero results, as did a search for the mineral survey. State law required this information to be shown in the official records of the County. There was no mention in the agenda item that this mining claim must be sold to the highest bidder at auction nor the amount of tax, penalties or costs associated with the claim or parcel. Mr. Jones stated the public had not been provided with the necessary information to be able to be clearly informed regarding this agenda item. The public had been misled by false and inaccurate information presented in the agenda item, as had the Board. The Board was being asked to take this action on this agenda item, but was not provided with the proper and true information needed to make that decision. Additionally, the Board was required by County Code to consult with the Belmont Advisory Board on items related to Belmont on the Board’s agenda so the Belmont Advisory Board could perform their duty and be the liaison between the Board and the residents of Belmont. That had not occurred. For these reasons Mr. Jones asked the Board to deny the request.

thought the gentleman who spoke made a lot of sense and what he said would be worth checking into. She liked to see these items go in front of the boards in the different areas and felt the same courtesy should be extended to the Belmont board. She thought it needed to be investigated more before a decision was made to pass it off to someone.

said she spoke with several of the residents there, one of who happened to be the chairman of the Belmont Town Board. To her knowledge it had not been placed on their agenda for them to consider, but she also spoke with those who would be neighbors to that area. Even though this was the Belmont Mining District, the historic documents showed this as the Philadelphia Mining District. The petitioner was following the NRS so he would have had no indication to take it before the board. Mrs. Wichman stated if the Board approved this she would take it before the Belmont Advisory Board.

Commissioner Cox

said she would like to have the person presenting this appear in front of the Board and would like this delayed until that happened.

Commissioner Strickland

said she would support this item only because the Board was considering it, which gave direction to pursue it as there was not enough information at the moment.

Ms. Merritt

said the facility was in dire need of an investment of resources. It did not support many of the revenue generating events that typically used fairgrounds in the County nor was it safe enough to hold events. The advisory board along with the May 2, 2023 26. Presentation by Nye County Parks and Recreation Advisory Board members, Tim Bohannon and Holly Merritt to address future needs of the Carvers Arena and Recreation Center proposed in multiple phases over several years-Cont’d. residents of Smoky Valley were willing to work with the County over the next couple of years to rebuild this asset in the north.

said she was willing to support whatever they needed to have.

Commissioner Strickland

expressed how proud she was of this advisory board and said funds needed to be found to make this happen.

asked if they would be eligible to submit an application for tourism money through ARPA. Stephani Elliott said yes as they would be considered a sub-entity of the County.

asked if they could use the $55,000.00 left.

said yes as it had not been requested yet and she would send them the application they would need to submit.

said she would like an agenda item for the NCWD instead of a workshop to answer questions and bring the public into the forum.
