was present. Diane Southworth expressed her concerns with states’ rights and the way things were going in the country. She reminded everyone to live by the golden rule do unto others as you would have them do unto you. Laura Larsen thanked the Sheriff for pulling over one of the trucks that was taking water to the solar farms. She then talked about the need to protect bordering states from what she considered an invasion and asked the Commissioners to do what they were supposed to do. David Michael Garcia talked about how ordinances, statutes, and whatever else was professed to be law was not true law; fathers’ rights; 5B354; his arrest at a School Board meeting while speaking about parental alienation; the videos he had of deputies having unintended, unaccompanied, and uninvited sessions with minors; and how he follows the Bill of Rights which only gave him ten rules.

noted all the rain accumulation, especially in Pahrump, and the need for it.

advised the employees there was a group of people present today to help them with some supplemental insurance.

reminded everyone that on February 10, 2024, there would be a fundraiser for the Cotillion for Success, a cake auction, from 6:00 p.m. to 9:00 p.m. at Nye Communities Coalition, 1020 E. Wilson Road. Fire Chief Scott Lewis extended his thanks to the Commissioners. He had an emergency during the previous meeting in Pahrump and was unable to discuss the fire prevention trailer donated from Las Vegas Fire/Rescue, which was in top notch condition, well equipped, and had every amenity to teach the children fire prevention messages.

asked Mr. Koenig what he thought the issue with Amargosa was.

Mr. Koenig

said there seemed to be a problem with Amargosa with things from Pahrump, but that could just be his perception. He did not understand the problem.

Commissioner Jabbour

asked Mr. Koenig to send him a summary of what he had been trying to present to Amargosa and the next time he was at their meeting he would help promote that. They always mentioned they were neglected and forgotten about and that was not the case. He was disappointed to hear there was no interest or participation and Pahrump Valley Public Transportation was still going there.

opened the public hearing. Ashley Hanley, speaking for Vegas Productions, stated they were interested in having their Jordan World Circus event as they had in the past. It was brought to their attention that there may be over 1,000 attendees, which was why they were applying for an outdoor festival license.

said staff did an amazing job reaching out to the Pahrump Arena Advisory Committee and the animals were good to come to town. February 6, 2024 - — — deliberation to issue an Outdoor Festival License to Vegas Productions, Inc. for the Jordan World Circus to be held March 12, 2024, at McCullough Rodeo Arena at 150 N. Highway 160, Pahrump, NV. Brian Kunzi advised Nevada had a rather obscure statute dealing with dangerous animals. For anything classified as a dangerous animal the owner must ensure there was no human contact with the animal. One of the animals listed in the statute was elephants and he knew this event offered elephant rides. It was a criminal provision and allowed for the seizing of the animals, but the County was not equipped for that.

Mr. Kunzi

said if this permit was issued it must be issued with a provision that there was no contact between the humans and the elephants.

made a motion to approve the outdoor festival license to Vegas Productions, Inc., for the Jordan World Circus to be held March 12, 2024, at the McCulloch arena with the exception of no elephant rides or contact with elephants; seconded by Commissioner Cox; 5 yeas. COUNTY MANAGER

advised Ms. Grubb she was off subject. This item was specifically for the Service Dogs for Veterans Program.

wondered if her dog would be eligible for this program. February 6, 2024 - — Program Funding Application from Tynia Dickson with Sassy Trainers for the Personally Trained Service Dogs (PTSD), Service Dogs for Veterans Program in the amount of $20000.00 to be funded from 10210, Veteran Services Department. Tom Waters said Ms. Dickson could train a dog for whatever the person needed assistance with. Ms. Dickson was also part of the Veterans Finance Committee and made recommendations for other things for the veterans. She made a recommendation for that committee to support the service dogs and they agreed this was something that they could stand behind.

made a motion to approve the funding application for the Sassy Trainer’s personally trained service dogs in the amount of $20,000.00 and fund from 10210 Veterans Services Department; seconded by Commissioner Carbone.

asked the Comptroller to keep an eye on that account.

assumed the Chair of the Board of Highway Commissioners. 8. For Possible Action Discussion and deliberation regarding the General Road Report by the Public Works Director on General Road Maintenance, Gravel Road Maintenance, Asphalt Patching, Weed Mowing, and direction regarding public works projects. Assistant Public Works Director Beau Gott provided an update on the activities of the crews and the projects. Erika Gerling said the potholes in Beatty were so bad it was hard for people to walk on the streets. Gordon Cox asked if anything was going to be done about the flooding that happened along Blagg Road.

said Pocahontas from Saddle West down Dandelion to the park needed to be done as it had huge, deep holes in it. Unicorn and the side streets off of Unicorn could also use some patching.

mentioned how the Commissioners got phone calls from people about the roads. He asked Mr. Gott to carve out some time for Huckleberry and Zephyr, which he addressed last year, as it turned into a pond when it rained. February 6, 2024 8. Cont’d. thanked Public Works for reaching out to the public on the Winery project. Regarding the bar ditch work off of Corral off of Margarita, he said someone complained it had turned into a mud swamp in front of her house and she could not get in or out of her driveway and he asked that someone take a look at that. Also, west on Thousandaire about two miles from the Lakeside Casino were a lot of potholes and Commissioner Boskovich asked for those to be put on the radar.

hoped the public understood that they had to be somewhat patient about the potholes because of all the other work the road crews had been doing. He said the possibility of patching roads and then doing some surface covering that might hold it together for another five to ten years was being looked at.

noted the only way the roads could be repaired was through taxes and grants. She asked the public if they were willing to pay some money for the roads on their taxes or did they want to forget the taxes and deal with the roads as they were. 9. They met last week and discussed dissolving and becoming either a special interest group or an ad hoc group because they were not a public body by definition. wanted to know why money was being given back to people all the time on their taxes as well as why so many mistakes were being made. Brian Kunzi explained part of the process was the assessment was completed based on the information the Assessor’s Office had. The taxpayer then had an opportunity to basically appeal if they could present information and prove a legitimate reason to have their assessment changed. There was a statute that provided for this process and it was not something randomly done. It was all triggered by the taxpayer actually filing an appeal of what the assessment was and each situation was unique.

Commissioner Cox

did not understand why they were over-assessed in the first place. Chief Deputy Assessor Justin Zimmerman said there were a million different scenarios that could lead to a correction, but most of these were changes to the tax cap. The statute allowed the taxpayer to submit their property tax cap claim form up to a year after taxes had been billed. The Assessor’s Office then had to go backwards and correct that tax cap once the form was submitted. Treasurer Raelyn Powers stated the District Attorney was spot on with his explanation.

asked if it was in the Board’s purview to do an audit on this activity. Tim Sutton said it was and was specifically provided for in the Code. Approve, amend and approve, or relect a site rental agreement with the Board of Regents of the Nevada System of Higher Education on Behalf of the Desert Research Institute (DRI) for the purpose of maintaining and operating a remotely controlled cloud seeding generator and weather station on county property located at Assessor’s Parcel Number 047-041-02, 7401 E. Manse Rd., Pahrump, NV; and 15.b. Determine if lease back payments from 2018 to 2023 in the amount of $38,244.00 should be charged or waived. Tim Sutton said item 15.b. could proceed, but for item 15.a. the District Attorney advised a site rental agreement was not the appropriate mechanism for this and would like to bring this forward at a later date in the form of an interlocal agreement.

made a motion to waive the fees in the amount of $38,244.00 for 2018 to 2023; seconded by Commissioner Jabbour. Samantha Tackett explained the Board approved a lease in September, 2018. Shortly after that staff was advised the lease was no longer necessary as the property would not be used, and an audit in 2022 found fees had not been charged. Some backtracking was done and it was learned the County was advised that in 2018 and reached out to DRI. DRI was also advised in 2018 the fees would be waived. The lease then expired in September, 2023. The request was whether or not the Board wanted to charge the fees, but Ms. Tackett supported the motion to waive.

mentioned the trafficking program presented by the Soroptimist. Human trafficking was everywhere and awareness needed to stay up.

wondered what the plan was to help the young people and protect them from human trafficking.

said all the Commissioners could do was work on the County and report it if someone gave a signal. The District Attorney and Sheriff were the main pieces of the wheel. Tamie Pitman said she had seen signs in bathrooms with a number to call if someone was being trafficked and she thought that could be done here. Tim Bohannon said there was a national hotline for human trafficking as well as the signals. The public should also be educated as much as possible.
