Commissioner Strickland

mentioned there was no school this Friday, which was also Halloween.

Commissioner Cox

spoke about a letter the Commissioners received regarding the persons for the pro tern. She thought Lorina Dellinger and Brian Kunzi had some ideas that she wanted to hear.

Commissioner Strickland

said an agenda item would be brought forward to discuss that.

Mr. Kunzi

added a lengthy discussion could not be had during this item. October 29, 2024 announcements, brief discussions of public comments, correction of factual inaccuracies, direction to staff, or topics proposed for future board meetings. Lengthy deliberation of topics not on the agenda is prohibited by the Nevada Open Meeting Law).

Commissioner Carbone

believed Mrs. Dellinger had already been given direction in a previous Board meeting.

Commissioner Strickland

said she would like to use the ranking system used before.

Commissioner Jabbour

asked if the pro tems would be at large or just for justice court B.

Mr. Kunzi

said that was an interesting question that he did not know the answer to. He would do some research to see if there was some way it could be made a general position where they could fill in with any of the courts.

Commissioner Strickland

asked Brian Kunzi to look at sections 11 .a. and 11 .b. of the contract. In section 11 .a. for liability insurance it was written out as two million/three million, and in section 11 .b. it was written out as one million/three million. She asked which one was correct.

Mr. Kunzi

believed it was one million/three million, which Lorina Dellinger validated.

Commissioner Jabbour

said he did not see the current insurance certificate in the back up to show what they already had in place and asked Contracts and Grants Manager Stephani Elliot if that was part of the existing file. He also asked if there any ICE inmates in Tonopah.

Ms. Elliott

said although she did not include the certificate of liability insurance in the back-up, she had since received it and had a copy with her. It listed $1 million/$3 million, which was the same insurance requirements Serenity had carried since the inception of the first contract. Gabby Cruz, the owner/operator of Serenity, had listed the Town of Pahrump as the additional insured. Ms. Elliott said they were waiting for a revised copy showing Nye County because she serviced both Nye County Detention Centers.

Mr. Kunzi

added they were required to provide their certificate of insurance annually.

Sheriff McGill

advised there were no ICE inmates in Tonopah.

Commissioner Jabbour

asked if Serenity had a presence in Tonopah.

Sheriff McGill

said absolutely. They were contracted to provide medical services in both facilities.

Commissioner Jabbour

asked if that was separate from what the County was required to provide for ICE. October 29, 2024 — Discussion and deliberation to: 5.a. Approve, amend and approve, or reject the Professional Services Agreement between Serenity Health dba Serenity Mental Health and Nye County in the amount of $2,150,704.80 for the purpose of providing medical services to Nye County Detention Center inmates from November 1, 2024 through December 31, 2025; 5.b. Execute the agreement; and 5.c. Fund $2,150,704.80 from 10236 Nye County Jail Fund.

Sheriff McGill

said yes and no. Serenity was required to provide medical and psychological care at a lower standard than ICE, however, since the ICE contract was in place the medical personnel were on-site at both locations at all times and they provid e the same services to the non-ICE inmates as they did to the ICE inmates. The local inmates were receiving additional services at no cost to anyone.

Commissioner Cox

asked if the administration costs were paid out of the County’s pocketbook or if grants were utilized.

Ms. Elliott

explained an additional grant had been applied for to help supplement this payment. Serenity had requested an increase in August, 2023, so Finance had been working on ways to be able to afford that increase. Unfortunately the County was denied that grant. At this point she saw no additional funding available.

Commissioner Cox

asked if the U.S. Marshal’s office was paying for any of this or if the County was taking care of their prisoners for nothing.

Ms. Elliott

said this agreement was not through the U.S. Marshal’s Office, It was a customs agreement with ICE. The County was provided revenue based on a per bed rate which could be used to offset the cost of the very expensive food service and quite a few staff members.

Commissioner Cox

felt this should go out to bid since the cost kept rising. She suggested approving it on a temporary basis as she saw a lot of things that could be eliminated as the prisoners were living better than the citizens.

Commissioner Strickland

said they could walk away if they did not have a contract. By law a contract had to be in place otherwise the jails would have to be emptied. The Board was also not at liberty to do a month-to-month based on the agenda item.

Commissioner Cox

said she had no problem extending it, but she had a problem with it overall. She would like to have it looked at and put out to bid.

made a motion to approve the professional services agreem ent between Serenity Medical Health and Nye County in the amount of $2,150,704.80 for the duration of November 1, 2024, through December 31, 2025, execute the agreement, p. said US-95 was a very dangerous road. On his way up to Beatty for Beatty Days he was following a row of cars towing cars for the car show. An individual on the opposite side of the road decided they wanted to pass a whole bunch of vehicles. They did not have enough room and forced seven other vehicles off the road. Commissioner Carbone said people needed to write to the State and tell them that. Lorina Dellinger reminded everyone the November, 2024, regular Commission meetings was not the regular schedule to accommodate Election Day and certification of the election. The first meeting would be on Thursday, November 7, 2024, the second meeting would be on Friday, November 15, 2024, and there was also a meeting set tentatively for November 21, 2024. How do you know you are getting the best price for the services without a bidding process? 2. Why is this contract over $360,000 MORE than the previous contract? Are there increases in services that have caused that amount to jump over 24%? That’s an awful lot of inflation. It appears that the FY’24 contract was appx. $1.5 million. This newest contract is for $2.15 million for a 14 month period, so we went from appx. $1 25k per month to $1 54k per month. That’s an INCREASE OF OVER $29,000 FOR EACH AND EVERY MONTH OF THIS CONTRACT. WHY? 3. The Review and Approval process shows that a “Legal Review is Required” yet it doesn’t include that a Legal Approval was Received. 4. With all contracts, there should be a disclosure of who the principals are of the Contractor to avoid any appearance of an ethics violation or conflict of interest. It doesn’t matter if they are filling cracks in the cement of a skate park or something like this. I don’t see any disclosures for this contract. How does the public know who is benefitting from such a hefty sum without knowing this information? 5. It states that the Project Manager is responsible for the supervision of those employees and agents. What steps does she take to supervise them? Is there a checks and balances for these employees/agents? How do they clock in and out? Are there prison logs showing their visits? 6. Has the County ever requested the Time and Accountability records? Was a forensic audit done of these records? Any issues from the past 5 years? Are we getting what we paid for? 7. As the Contract calls for all employees to be 1099 with specific IRS requirements as to the restrictions of a 1099 hire, has Serenity fulfilled ALL 1099 requirements in previous contracts including the responsibility to cover all insurance for the 1099 employees?
