Commissioner Cox

read a letter into the record from Michele Fiore at her request regarding her case because Ms. Fiore was appealing the verdict. Commissioner Cox November 7, 2024 announcements, brief discussions of public comments, correction of factual inaccuracies, direction to staff, or topics proposed for future board meetings. Lengthy deliberation of topics not on the agenda is prohibited by the Nevada Open Meeting Law). stated the issues people were angry at the Commissioners for, like the solar, the homeless, and Med i-Waste, were never approved by them. As to the solar fields, she pointed out none of them were in Nye County because the County placed a moratorium on them months ago. They were in Clark County and the people should attend the Clark County Planning Board and Commission meetings to express their concerns.

Commissioner Jabbour

said he had seen some snippets of the BLM workshop and heard it said twice that the Nye County Commissioners had nothing to do with the project. He hoped the UNR Extension Program could get additional funding so they could splinter off outside of Pahrump and Tonopah. He was glad to hear someone was in Amargosa.

Commissioner Carbone

said there was also a lithium fire on US-95. The Commissioners and the fire department worked together to evaluate new materials that met all environmental requirements and the fire department was able to put the lithium fire out within minutes. He said U.S. Ecology needed to be evaluated as they had several fires they had not told the County about. Commissioner Carbone said there would be an agenda item to discuss ways to fix the roads. As to solar, he advised Nye County put together a very pointed letter to the Clark County Board of County Commissioners requesting an audience and still had not been able to get on the agenda. Commissioner Carbone then announced a Veteran’s Day ceremony would be held at the Chief Tecopa Cemetery starting at 10:00 a.m. on Veteran’s Day.

Commissioner Boskovich

said the way the federal government sat today required the County to entertain and provide solar locations. He felt the location probably mattered more than the actual solar. He did not think solar farms should be located around anyone. He said the County did not have the infrastructure to support homeless people. He noted that just in the last several years the homeless population had increased exponentially and if a shelter was brought into Pahrump it would be over.

Commissioner Boskovich

stated he would do everything he could to oppose it unless something happened to change his mind.

Commissioner Strickland

advised the Pahrump Public Lands Advisory Committee would have an agenda item regarding solar which should be coming to the Board as well. She encouraged the public to attend that meeting when the agenda was published. The item would ask the Board to hear an item that read “certain parcels to be zoned as open space per the NCC and the designation of a south side recreational management area to preserve Pahrump’s rural western quality of life, including Pahrump’s viewscape and outdoor recreation opportunities.” November 7, 2024 announcements, brief discussions of public comments, correction of factual inaccuracies, direction to staff, or topics proposed for future board meetings. She said they never ran out of ballots and the counting would continue until November 12, 2024. She thanked everyone who assisted her during the election.

Mr. Jabbour

expressed his appreciation to the Clerk’s Office staff. Assessor Sheree Stringer advised her office sent out 4,638 personal exemption notices renewals. If someone was a veteran and new to the County she asked them to stop by the office with their DD-214, their Nevada driver’s license, and any award letter that was worth 60% or more in disability. If someone was blind and they had a letter from their optometrist/ophthalmologist stating that they should bring that in as they were entitled to an exemption through the County, as well as widows and widowers. Mrs. Stringer asked the public to be sure to open any correspondence from the County as they needed to be returned. Contracts and Grants Manager Stephani Elliott said the third and final Community Development Block Grant meeting was scheduled for November 15, 2024. At that meeting the projects that were eligible would be discussed and ranked. The projects would then go forward for a full application. There would also be a brief presentation of the Pahrump Fairgrounds project on that date. Public Communications Manager Arnold Knightly said he had been working to dispute some of the things that had been put out in the media. The Clerk’s Office received 174 same day registrations and people were told that was what was slowing the process down and causing two and a half hour delays, not the paper ballots. Also, the Clerk’s Office never ran out of paper ballots. Samantha Tackett said the next meeting of the Pahrump Public Lands Advisory Committee would be November 14, 2024, at 5:00 p.m. at the Veterans Memorial Building.

asked if the owner was working with the Planning Department.

said the owner had done nothing to bring the property into compliance, and there had been no communication until after she posted the property with the abatement notice.

Ms. Ryhal

said yes, but he did not have help or the resources. She reached out to a couple of people who might be able to help him, but had not been able to accommodate it yet. Bradley Richardson explained the Board needed to determine if there was a public nuisance, which was the threshold issue. Once the determination of a nuisance was made, the next step was to set a date for abatement. If not abated, then the District Attorney’s Office could be requested to begin a court proceeding. The Board would also authorize staff to seek to have a lien placed on the property for the cost of the abatement.

Ms. Ryhal

stated there was no sanitation, no running water, and a structure the property owner built and lived in. There were several other wooden things on the property as well as propane stoves and a shower the property owner built. He brought water onto the property, and said he took his waste to another location and put it in a trash can. The photographs in the back-up showed other stuff stored on the property.

Commissioner Jabbour

wondered what would be a reasonable time as this had been going on since December, 2021. He wanted to hear from the property owner because there were some concerns about where things were going. The property owner could be using a private or public trash can to dump his hazardous waste in. Richard Saindon, the property owner, explained he set up a desert research station on the property and found the space-time continuum. Three years went by with no one saying anything about it. He said he wanted to sell the property, but he would need some help moving because he did not have a car.

Commissioner Strickland

asked Mr. Saindon if he had another place to live because this property was out of compliance and human waste could not be contained in an unsanitary way.

Mr. Richardson

advised he checked the notes on the justice court case for the criminal citation. Mr. Saindon’s condition was acknowledged by the court and the decision was November 7, 2024 7.a. Declare 980 S. asked Mr. Saindon if he was a veteran.

said he served from 1974-1 977.

Commissioner Strickland

asked again if Mr. Saindon had any place else to go where he could do his work and be housed.

Mr. Saindon

said he would move to Amargosa Valley or someplace like that where there were no buildings codes. He asked why he could not stay on the property for the next two months.

Commissioner Strickland

asked what Mr. Saindon’s plan was should the timeline be granted.

Mr. Saindon

explained he could take stuff apart and hire someone to help him move it. He would also sell them the property if they helped him.

Commissioner Carbone

said the biggest concern the Commissioners had was Mr. Saindon being homeless because the Board could declare the property a nuisance and there would not be anything on the property for him to live in.

pointed out he had been the property for seven years and asked why he could not have two months. Pat Minshall said while Amargosa did not have requirements for permits, etc., and there were some places that were way out of compliance, that was not what the citizens of Amargosa wanted. Property Owner(s): Richard Saindon. Melody Keith thought enough time had been given. There were too many properties like this in Pahrump. She thought Mr. Saindon should sell the property and as a veteran hoped he could find some assistance in Pahrump.

Commissioner Strickland

opened and closed the public hearing. Scott Whittemore, appearing on behalf of Grid Liance West, talked about the many opportunities to be heard on this particular project. He believed this was their 1 5th public meeting in relation to it. Bob Sweetin said one of the key regulatory compliance components that his client had to deal with here was related to the special use permit offset fee in the Memorandum of Final Action. Based on discussions with Mr. Waggoner, Mr. Sweetin asked if the Commission could include direction to staff to include in the Memorandum of Final Action the $5 million special use permit offset fee. Mr. Sweetin anticipated that would be paid after today’s action before that memorandum was issued.

Commissioner Strickland

asked if the paperwork had been finished, to which Mr. Sweetin responded it had been.

Mr. Waggoner

noted there were no specific fees stated.

Mr. Whittemore

explained that was something they just started wrestling with, but they would retract the request and move forward with the SUP. He said they would do their job and come back with detail rather than trying to do this on the fly.

Direct staff to utilize the abatement procedures to abate the hazard by removing or causing the removal of the hazardous conditions; and B.c. Apply a special assessment against the real property in the amount of the total cost of the abatement. Assessor’s Parcel Number: 039-212-09. Location: 1680 5. Blagg Road, Pahrump, NV. Property Owner(s): Angeligue Marie Villegas. Code Enforcement Officer Susan Ryhal said this property had multiple abandoned recreational vehicles in various stages of disrepair. There was also an old single-wide mobile home on the property in various stages of disrepair. She explained this case was opened originally in April, 2018, on a citizen complaint and two additional complaints had been receive since then. The property owner was issued a citation in April, 2021. It went through the court process where the property owner failed to appear and was arrested. It went to bench trial eventually with another failure to appear. Ms. Ryhal said they had not had any communication with the owner since the property was posted with abatement notice on October 7, 2024, and that was the last action taken.

Commissioner Boskovich

said he got a lot of calls and communication from people who were very frustrated this had been allowed to go on this long. He said people should not come here and think they could destroy their neighbor’s property values because that was all they wanted to do.

Commissioner Carbone

said this was something a prior Commissioner wanted to do something about as well. He asked Bradley Richardson if there was anything the Board needed to be aware of.

Mr. Richardson

said the issue was not resolved. As to the representation there was a bench trial, he was still trying to find that in his notes, but the property owner was rather contentious in front of the court.

Ms. Ryhal

advised the owner failed to appear and was still at warrant.

Mr. Waggoner

said in the beginning stages of this the property owner was living on the property, but he did know if she was now. He advised there were no sanitation facilities or water or power to the property. Jeannine Yeager said she could see the property from her backyard. The abandoned vehicles had been there for at least ten years. When she moved there a woman was living in the Winnebago RV. Ms. Yeager had seen that woman come out of the RV with an orange five-gallon Home Depot bucket and a small shovel to bury her waste in the November 7, 2024 8. Property Owner(s): Angeligue Marie Villegas. dirt next to the RV since there was no water, no electricity, and no sewer on the property. Ms. Yeager said she had not seen the woman for several months and some neighbors told her they heard that she had passed away. She said her concern was there may be propane or gasoline in the tanks of the vehicles which could erupt if there was ever a fire. She said besides being an eyesore and reducing the value of the surrounding homes, they had also been told by their exterminator service that there were rats populating in those vehicles and the rats were coming over the fence into the neighboring properties. Ms. Yeager said she put out rat bait and had found four dead rats in her backyard. They had also damaged her car’s engine, and her disabled neighbors across the street had rats building nests under their house. They had eaten the insulation and damaged the vents for their heating ducts. Heather Freeman said she was glad this issue was finally on the agenda. She said people a couple of blocks away were also experiencing a rat issue. Melody Keith wished the Commissioners would take a more aggressive stance with property owners that continued to defy all attempts to clean up their properties because it was getting out of hand. Carolene Logue said properties like this one were a long-standing issue in the community. Monitoring was needed to achieve compliance with the various regulations.

advised per the Code a certain period of time to come into compliance was needed. He recommended no more than 15 days as it had not happened.

Mr. Richardson

advised 15 days was more than enough as the property had not been in compliance for years, a willful ignorance of the criminal compliance issue.

Commissioner Boskovich

amended his motion to declare 1680 S. Blagg Road, Pahrump, Nevada, a public nuisance consisting of hazards such as unsafe and unpermitted mobile homes, storage of recreation vehicles and unregistered, wrecked, or dismantled motor vehicles, junk and debris, all of which posed a public health and safety hazard, direct staff to utilize the abatement procedures to abate the hazard by removing or causing the removal of the hazardous conditions by November 30, 2024, and apply a special assessment against the real property in the amount of the total cost of the abatement, APN 039-212-09, 1680 S. noted the property owner was not present and may not even be aware of this as she may be dead. She asked if the decision would be posted on the property so she could not say she was not notified.

Mr. Richardson

explained if the abatement proceeding in district court went forward best efforts had to be used to notify the property owner, which could include publication in the Pahrump Valley Times as well as personal service. All efforts as prescribed by NRS would be followed.

Mr. Waggoner

advised all notifications were mailed and posted on the property for today’s hearing as well as all of the notices of violations and citations.

made a motion to set a date and time for item 14 as December 3, 2024, at 10:00 am. in Tonopah; for item 15 as December 3, 2024, at 10:00 a.m. in Tonopah; for item 16 as November 21, 2024, in Pahrump at 10:00 a.m.; and for item 17 as November 21, 2024, at 10:00 a.m. in Pahrump; seconded by Commissioner Boskovich; 4 yeas.

said he appreciated public comment and the people who were engaged and participated in the meetings. However, he would really appreciate if the people would pay attention to what exactly was said. He asked the Clerk to read back what he said this morning.

read Commissioner Jabbour’s earlier comments where he stated Nye County had nothing to do with the project at this point.

Commissioner Strickland

addressed the comment about a County employee voting on it last week. She stated Tim Sutton was no longer the County Manager. He was now a private individual with a law practice. If he was one of the two people who voted then that was also something the Commissioners were not privy to or had control over.

Commissioner Cox

thought the misconception was due to the name Nye County Community Coalition. She explained that was its own organization and had nothing to do with the County, although the County had helped them when they had asked.

Commissioner Jabbour

clarified the organization was now called Nye Communities Coalition, not Nye County.

Commissioner Carbone

asked the County Manager to put together a number of all of the organizations that were taking care of people whatever the issue was. He knew of at least seven besides the churches. Commissioner Carbone referred to the comments made about justice court, which the Board did have a certain amount of authority over. He wanted to understand what the issue was and figure out if there was anything the Commissioners could do about it.

Commissioner Cox

asked for an update on the progress being made with sending out advertisements for a new County Manager. Lorina Dellinger said nothing has been sent out, but she had been preparing an agenda item. She was directed in September, 2024, to bring back an item that defined the actions that could be taken based on the discussions held that day. She would bring back an item for further direction from the Board. Regarding the nuisance properties, Commissioner Boskovich apologized to everyone who lived in Nye County as they should not take years and years to resolve. He would like to find a way to streamline and expedite the process. He said he talked to several business owners in Las Vegas who would like to do business in Nye, but they felt like _____________day November 7, 2024 20. said the County’s processes were swift, concise, and clear. It was everyone else outside of the County because the County did not have a utility. Brett Waggoner agreed the County did not have a utility, which was a huge part of the process. The other thing the County dealt with was being regulated by NDEP because of the size of the population. He then stated there had been no applications submitted for a homeless shelter, not even for a location, but there was a process it would have to go through if an application was submitted. Mr. Waggoner said he was on the list of advisors because he wanted to stay informed as it moved forward.

Commissioner Boskovich

implored everyone to drive by a shelter in Las Vegas.

The homeless shelter and soup kitchen industry that is beating a path to Nye County will be devastating to our citizens and community. For those who don’t know, only TWO members voted for this project out of the THREE members present: Stacy Smith, the person promoting the project (who had NO prepared presentation and would receive monetary benefits), and Tim Sutton, who tried to leave without voting then threw his support (representing the COUNTY) to the Homeless shelter. The project that we COULD have had, came from the Chamber and was professionally presented by Jenney Sartin. It was for a Pahrump Valley Innovation Center a 3-story building with a business conference center, a small business incubator that would connect businesses in the community, have loan information, and provide temporary space for businesses while looking for permanent space or building. It would also have worked with UNLV to provide work-force training for mid-level jobs such as engineers, IT techs, etc., modeling it after the Harry Reid Technical Center on the UNLV campus. Are you hearing what we missed out on? What the COUNTY tossed aside to throw support to the homeless shelter and soup kitchen? Just what IS the mission of this Board? I have seen countless opportunities wasted that would have elevated our town but are replaced with yet another project that brings harm or a black eye to Pahrump. ATTACHMENT I Page 1 of 3 Who are you representing the actual 45O0O+ citizens, or the minority special interests that aren’t promoting the actual peace, safety, and prosperity of the majority but certainly are benefitting from your actions? There are individuals who actually want to INVEST in our community in a positive way. A K-12 charter school, hotels, conference centers, etc. Good paying jobs and opportunities. What is this BOARD doing to make this the kind of town that it really could be? Do you think that supporting Medical Waste dumping and a 40-acre Homeless shelter and soup kitchen accomplishes that? Have you completely lost touch with what you are expected to do for the citizens here? Once federal dollars are used to build a shelter, we would be required by law to accept overflow from other shelters; Colorado, Utah, Idaho, California... Regardless of funding source, rural shelters fail because rural areas lack the infrastructure of urban areas; jobs, affordable housing, mental health care, substance abuse care... just to name a few. made the comment that the COUNTY had nothing to do with the homeless shelter, that it wasn’t a COUNTY project, of which I will argue, “NOT YET.” I’d like to point out that a COUNTY EMPLOYEE who was given an MOU to be involved with the Rural Planners Network the group that put forth the Homeless Shelter project VOTED IN FAVOR OF THIS HOMELESS SHELTER PROJECT instead of the proposal that would have been a wonderful opportunity for Pahrump. He was ONE of only TWO member votes and as a COUNTY EMPLOYEE voting in FAVOR of this, that certainly gives the appearance of COUNTY INVOLVEMENT. The COUNTY will have to approve the facility if and when it comes before the BOCC again, that is involvement by the COUNTY. The purpose of bringing up the many issues that this project will inevitably create is to give you the FAIR NOTICE WARNING that there will be repercussions and fiscal responsibilities on the COUNTY should the BOCC approve this, and we are giving you notice that we will certainly point this out to any attorney that needs this information to get restitution for anyone harmed by this project. Please do your homework I’d be happy to share all of the research done that indicates that this project will turn our town into another dumping ground this time for infectious diseases, gangs, sexual predators, and homeless and illegal immigrants from all over the world. Just as I wouldn’t leave my door unlocked, nor should the COUNTY leave the door wide open to accept this heinous idea. We are proactively asking the COUNTY to be very careful and understand that this is will have much more of a detrimental affect to our town because it is a 4 ACRE project, with multiple aspects to it and it’s open to noncitizens and other people that aren’t from Nye County.
