Tina VonKuglin advised the board that she had obtained her business license, of her willingness to follow the rules as long as they were Constitutional, and voiced concerns that the county departments did not communicate with each other and were not business friendly. (exhibit 2) Laura Larsen spoke regarding wasteful spending and voiced her concern about money that was approved for Health and Human Services. She would like the board to into consideration what is best for the public before spending their tax dollars. Darryl Lackey states a concern that the board did not start the meeting with a prayer. He spoke regarding homelessness, health, Mexico, and a desire to do good. Lou Baker spoke concerning funding for the fairgrounds and advise a new television show called Your Opinion Matters. He would like the board to look into fund raising events. Tim Bohan non spoke regarding a bill passed by the board to Back the Blue and HOA’s trying to eliminate the use of blue lights that show support for law enforcement. Diane Southworth stated her concern regarding food pantries and seeking support for programs. She was also seeking support for the board for projects that provide affordable housing. Ron Mortinson stated he had received the invoices he had requested related to uniforms and badges. He voiced his concern that Code Enforcement is not allowed to have those items. He addressed the amount of money intended to be spent on plans and the board voted to make this sanctuary government. March 4, 2025 2. Erika Gerling — stated she hopes they have a good meeting. Kay LaPointe provided a flyer to the board regarding a cake auction for Nye Cotillion and gave an overview of their group’s program. She advised it is national reading week and encouraged the Commissioners to participate. (exhibit 3) Patricia Robb is seeking solutions for the ongoing issue of vacant lots that are unbuildable because the owners cannot obtain utilities. She asks the county to address the lack of utilities in the undeveloped areas. She offers solutions to consider. Beth Borysewich questioned which fund Health and Human services is paid through; if code compliance had taken required classes; and who is responsible to follow up on questions asked at the meetings by the citizens.

commented of the discussion at the last Commission meeting regarding a grant provided by HHS, stating the program is intended to be a resource for the Sheriffs Office and other agencies. He went on to explain how the Sheriffs Office handles interaction with undocumented persons and when and if ICE is notified. He advises the individuals from the Fast and Most program will not be responding to our calls for service. Accessor Stringer advised that her office is moving forward with the addressing in Tonopah and that it will become effective as of July 1st

I have been getting a lot of complaints about patching holes and two weeks later the hole is back again. I understood if the machines were used correctly that should never happen. Beau Goti The Dura patcher is a really great machine. It sprays down a layer of tag, which is supposed to bind the patch to the existing surface. It does a really good job. I get a lot of these calls as well. I think what it is, it’s not the patch that’s coming out. In most cases it’s just continuing outside of the patch where the road failure is already. The whole road could be failing. We can’t go in and overlay the whole road with patch material. That would be considered a chip seal or another kind of road surface reclamation. In most cases, it’s not really the patch popping out, but it is just the continuing road failures off of that patch.

So, in other words, if you pack your hole and then the hole gets bigger it looks like the patch is failing something like that Beau Gott Correct. I’ve noticed that throughout the years, and a lot of people do think that they do pop out, but we didn’t have the rain a couple weeks ago. If the patch hasn’t completely cured and dried up, there’s a chance it’s going to pop out. On another note, we do also do the cold mix patching. It does not hold up as well, but we are changing our strategies for our pothole patching. Squaring out the holes better and just doing a more quality patch rather than just a blow and go. Throw some cold mix in it and move on. We’re getting better and better as we move along

what Pahrump is experiencing for the past few weeks is what up here we have been experiencing for years. I am glad Director Boiling is still there. Your crew was here for multiple reasons, but more specifically a few meetings ago we had concerns from our senior citizens that live here in Tonopah and Round Mountain, and that visit out of Esmeralda. And their concern was the Senior Center parking lot. And so, I want to thank you and the staff as well as buildings and grounds, William Allen and his staff, for working together and addressing the situation and those concerns in the parking lot. Not brand-new parking lot, but a safer parking lot for the seniors that are March 4, 2025 9. Commissioners, last meeting there was a vote on the FAST/MOST program. I have two questions that I would like answered in an e-mail from Karyn and or DJ. If we ask for somebody’s immigration status and then if they are proven to be illegals, whether or not they’re reported to ICE. And before I would ever support this, I would need to make sure that those answers are provided. And that’s partially why this item is coming back, so there’s no doubt where we stand on it.

the left came up with something that you’re not. and we can call ourselves non sanctuary county. I support that, I’m fine with that. I just want to make a quick clarification. When you’re arrested, you’re reported to ICE, and the issue is, if you’re not arrested, we don’t know. And when there was questioning here last month, and I have a transcript right here with me questioning the program FAST/MOST program, under your prearrest diversion, would you report them to ice? The answer was I would have to talk to my supervisor to see what the appropriate course of action would be in that scenario as that has not yet occurred. So, this program has been going on for a few years it has not yet occurred that they’re reporting to ICE. So, we’ve had two things going on in the last couple of years. One we’ve been a non-sanctuary county and two, we have not reported to ICE through this program. The sheriff has nothing to do with this program. This is passed by us, we have to work with it. But he’s not passing, he doesn’t have the decision to pass or not. Then, the second part I said,” you ask for immigration status, correct?” And the program respondents said, “no we ask for where they were born as part of a checklist for reentry.” So, that’s the issue for me, it’s really not that hard. I’m sure we’ll get some circular discussions, really don’t know, and maybe about 10-15 minutes of this, but it really, that’s all you need to know. You can check the transcript. You can check the meeting minutes whenever they come out if they’re in there, you can go watch the video on the county website and that’s really it. Under your prearrest version, what that means is it doesn’t get to the sheriff. You’re diverting away from arrest. It doesn’t become a seizure by the sheriff, so to ask the sheriff hey, what happens if no one ever comes to your office? What could he possibly say? Well, I’ll tell you exactly what’s going to happen if no one ever gets into custody of my police officers, it really doesn’t make any sense for him to comment, because the whole point of the program is they never go into the custody of the police. If they did, they’d go up, they be reported to ICE and that’s always been my issue. I think that’s

this was requested by the southern Nye County search and rescue organization, which is under our umbrella. However, they are a 501-C3 organization. They have been maintaining the registration and insurance on these vehicles, which as you’re aware can be somewhat costly. And again, they’re nonprofits so they’re bound by what they’re able to get and donation. They approached me and asked if the county would be willing to accept financial and ownership responsibility for these two vehicles, meaning that the county was going to be taking over the registration and insurance. So I checked into that. This is going to be a small expense, I don’t have the backup with me but I remember seeing that it was a minor expense and according to the information I received, fleet was in favor of this.

I wanted to thank William Allen, and manager, you can relay the message, I want to thank him and his staff for making the decision, taking care of this. What I’ve never agreed with but I understand the policy, I understand the procedure is when we had our disasters in the past few years, with flooding in Pahrump and FEMA said you can’t move the trees out of the middle of the road we have to come down and we have to do this and we have to inspect and we have to assess etcetera. and it absolutely creates an unsafe road, putting all of us in danger that are driving on those roads. And we have to do it for safety first and foremost. So again, thank you William Allen and your staff for taking care of the county and the assessor’s office so quickly, thank you. 16. Report regarding the repayment of a temporary Interfund loan in the amount of $5,780,000 from the Nye County General Fund 10101 to Nye County Grants Fund 10340 pursuant to NAC 354.290 and Nye County Resolution 2024-06. Brief timeline of events leading up to this item. in October of 2024 the treasurer was made aware of late penalties that were not being assessed on various transient lodging establishments throughout Nye County. I was made aware of that, and I was also made aware of an investigation opened by the Sheriffs Office, which resulted in a request for an audit. I did receive confirmation from Lieutenant Williams on December 4th that he did put that request in. I immediately contacted our March 4, 2025 14. For Possible Action Discussion and deliberation regarding a focused audit of the mandatory tax on revenues from rental of transient lodging: imposition and collection; schedule for payment; penalty and interest for late payment for all components of Nye County to be prepared by Dan McArthur Cont... auditor Dan McArthur because we were conducting our own Nye County audit for fiscal year ending 2024. We asked the auditor if he could please focus on Nye County audits and then we would bring forward an item to address the audit for the room tax fund. We are requesting that this audit is conducted on all components of Nye County, which is Amargosa Valley town, Beatty town, Gabbs town, Manhattan town, Round Mountain Pahrump town and Tonopah town. I will say that this has a not to exceed amount which the original amount I do need to make a correction to instead of 39,800 its 29,800. We have adopted the audit and submitted it to DTAX, and now we are able to receive Dan M cArth U r. Manager Waggoner Many questions have come via e-mail, via public comment. I’m sure you’re going to hear this again. Does this audit have to do with that letter? It only does in respect that it is included. This audit wasn’t prompted by that letter. This audit was already in the works and planned prior to the letter being received by the town of Tonopah. Which didn’t get received until after I was actually appointed, so that is why we didn’t want to include as the backup because that is not the reason for this audit. It is an audit that needs to be done on this whole entire system.

Manager Waggoner That was because of the discovery that was made back in October, as stated by assistant county manager, that prompted an investigation, which then prompted a request from the Sheriffs Department of an audit.

And that’s why I believe the assistant manager gave you that timeline, so that you’ve realized that this contract that we’re looking at was what was anticipated well in advance

I am requesting this to be part of the public record. I was recently made aware of missing monies in the Town of Tonopah from actions over a four-year period of time wherein independent decisions were made at the Nye County Treasurer’s office to waive funds that rightfully beLonged to the Town of Tonopah. This happened under the previous county manager’s appointment but now the new County Manager is charged with addressing this issue. Someone is responsible for making sure that any wrongdoing is properly addressed to the Letter of the Law, and that is the sheriff and the D.A. I have requested public information from the sheriff’s department regarding this issue and am awaiting a satisfactory response. WILL the sheriff and the D.A. guarantee that a full investigation into this matter is done and prosecute aLL criminaL actions regardless of the status, emptoyment or position of anyone involved? It is in the public’s interest to know that we can trust our process to uphold the law. I am also very concerned about the processes in our county regarding the Treasurer’s office and how things are done. If it’s a matter of not knowing what to do, what is being done to assure that this Level of malfeasance or oversight isn’t being repeated on a daily basis? Is there a separate category for late fees and penalties to track these? Will these all be made available to the public without redactions? If the audit isn’t going to provide actuaL detailed information that creates a compLete roadmap for what the tax collection entailed, you are wasting our money. I want the real story as to why late fees and penalties for room tax dollars in Tonopah or ANYWHERE in Nye were arbitrarily waived.
