Point of order on the consent calendar, we can’t approve something if we are not here, it’s 13.2, I don’t know if we really want to move that; but I can’t vote on this I guess whatever reason; so, I won’t vote on that, unless you pull it out of the consent calendar.

At the Planning Commission meeting and item came up dealt with the cost of insuring your home etcetera in the Town of Pahrump and a gentleman said that generally your insurance is going to go up maybe by 30 some odd percent. According to him it’s because there are so many tumbleweeds etcetera laying around this town that can cause a fire and so I’m advising you to make your tumbleweeds go away maybe our insurance rates will go down. They wanted me to give direction to staff to clean all that up, but I don’t know how we can go on other people’s property and clear tumbleweeds up. So, I’m asking you to do it yourself. I’m a guilty one I’m going to burn so when you see a whole bunch of smoke on (inaudible) that would be me. That’s all I got, thank you.

I just want to tell everyone the Clerk’s Office has moved, we are officially over here at 2100 Walt Williams, right behind the chambers. Anything non-court related, marriage licenses, fictitious firm names, just want to come and chat; this is where we’re at. Thank you. Chief Scott Lewis and Captain Means We are here to tell you that the Sheriffs Office and the agencies that I just mentioned received a Certificate of Appreciation from a Special Ops Military Group that has been conducting exercises here very detailed and on things that we can’t talk about in 24 and 25. But it involved our agencies and we were greatly proud to help support them and they stopped in just to see us right before the meeting and gave us both these presentations so nice yeah it’s very cool and we really appreciate it. Kristi Siegmund, Manager of Animal Services It was actually really nice to have a volunteer come up and talk today. I thought that was really great. And to Helen, she said $500,000. So, my big announcement today is if you haven’t seen or heard already, we are closed to the public on Sundays temporarily, that has come with a lot of understanding but also a lot of backlash as well and some frustration. So just to put out there the reasons why we closed on Sunday when we had chosen to open seven days a week. We had anywhere between 40 and 60 less animals than we currently have in the shelter. In my 65 to 70 hours that I work, it can only go so far too so we did make the decision to close temporarily on Sundays. When we do get more staff and more volunteers, we will readjust and so I want to let the community know that this isn’t a permanent thing, it’s temporary so that we can get through. So, be part of the solution I’ve said that before but I’m going to continue to say be part of the solution come, and volunteer come in and help out because you can and you will make a difference Bridget has made a difference tremendously in the last week that she’s been with us other people can make a really big difference too. So, thank you.

Kristi Siegmund Yes, 100% and I do apologize so part of being closed to the public is so that the person who normally sits up front and greets the people that come in can be the extra body in the back to help care for these animals. We are still there seven days a week caring for the animals. Our animal control is still there seven days a week to help with the community’s needs from 7:00 AM to 5:00 PM and the dispatcher is still there to help support the animal control officers as well. Tonopah operates on an appointment only, so we do have both Christy Pope as well as a kennel tech that is there taking care of the animals in the shelter seven days a week.

Perhaps we should rethink the operation plan for the Pahrump, for the kennel here and Pahrump then if they’re able to operate by appointment only maybe we should consider that and let there be less strain on the system for consideration you are the department head. My problem here now is that what I’m hearing you say is completely different than what the agenda item says, and I don’t know how to make a motion or how to vote on something that’s not really on the agenda. DA Kunzi- that is also a concern about that; I had started discussions with counsel for the court to try to resolve some of these financial matters. It is something we need to clean up; I think this was premature and I would like to continue his discussions with the counsel for the court as far as to arrange this; the issue is yes, its court funds, but the funds come to the county which is required to manage them for the court, that does not mean we control the court; but still responsible for making sure they were audited and doing things properly; we cannot give up that type of responsibility.

For the record, I just want to share that as part of the backup it clearly reads that the 5th Judicial Court has officially separated from Nye County. However, if there is the separation then when this does come back, I would hope that part of the plan is that the court applies for the for your own dedicated EIN number and not have the counties FIN number. Especially where there has been the separation of the buildings, physically of the staff. As the DA said, with the court funds and the county being able to monitor there’s the checks and balances and that’s why this was basically put into place. Whitney Richardson- We do have Todd Greer on the line to answer any questions as well. We have explored other avenues as far as the specialty courts go to get that bank account and because the 5th Judicial does have the MOU in place, it is our specialty court, we did want that county oversight for recording purposes that’s why we want to use the county FIN for the drug court fund. We’re just looking to change the names for March 18, 2025 18. I would like to know if the other rural counties have separate bank accounts under their control for their District Courts. Whitney Richardson- I am not sure what the counties do, I know Justice Courts have their own accounts; looking to do what Justice Court did so we can do the same thing, so we can make those deposits and run our department.

We do have separate bank accounts existing such as she mentioned justice court. We do have separate bank accounts existing. They are for petty cash purposes. Every external bank account, even with our EIN has a specific purpose to receipt in not make any disbursements, receipt in with the public and make change. we do not pay invoices from that bank account, we do control that centrally with our own bank account. It exists because of the collections from the public for court fines, all sorts of fines and fees and collection with the public that we do

Whitney Richardson- I don’t know what the other counties are doing. other courts have split from their counties as well, to my knowledge, those are just direct splits and I’m sure the DA would know better than I would as far as. To my knowledge, the 8th Judicial District Court, they are completely split off there a different entity. We have an MOU so we haven’t done any legislative split, and I could be completely wrong, but that is just to my understanding that say I’m sure that they have their own separate bank accounts and things like that and their own oversight. We’re still looking for county oversight, we just want to be able to make change, to deposit our money into the bank accounts and just be able to operate in that way.

Can I add that when we do migrate, we are looking into bringing all of these functions, including point of sale systems, into our main accounting system. because it is extra redundant work to constantly take a Ledger monthly and bring it into our system and record it. It’s basically double bookkeeping. We are trying to eliminate that as much as possible.

Let me just add, it looks to me like this might sort of be out of our hands. I don’t know if this is necessary. if it’s a legal issue, you’d have to defer to council. If council says that they don’t want this because of some legal reason, I guess you’d have to change the law to change it. I recommend we just don’t do anything.

Days ago or yesterday I believe my only just want to make a point first of all that I this table you have up here is March 5th that I did not vote on that and it is important for me because there’s stuff in there that I would not have voted on but I want to make it clear because people will look at that and think that we’re all harmoniously agreeing on all this stuff I would not have voted for that pandemic Refuge Center Civic Center. And my question is it’s a question pardon me, yeah, I’m exercising my freedom of speech, that is not what we exercise my freedom of speech, give this to the fire department I would rather give this to police this is eligible for roads. I call the workshop an election. So, it says discussion well we can’t discuss it. I think that people like to see this, and I can’t wait for people to see this, thank you. Thank you Stephani for giving us the update. Obviously, we are maneuvering through this and be compliant. What is the deadline for the allocation and puffing all of this money into motion? Stephani Elliott- So, the great news is the local assistance funding was not provided an expiration date. The word of caution is that there is a new federal administration that was looking at items of this nature; we have already received this funding, so at this point there are doubts that they could request it back. However, I am required to do an annual report to the US Treasury indicating how much is obligated and how much was spent. So right now, anything with the word grant is on the table. But for right now there is not an expiration date, so we still have the funding available. The benefit of this grant is it is pre-funded; we received the money up front. You’ll see it reported on our statements as deferred grant revenue, any other grant you have to spend the money and ask for reimbursement, we have the money in the bank.

First I am going to interduce the item. This is my fault because I was at a meeting and Scott gave a presentation and there were other presentations made around the country about this. Scott’s presentation shows what Nye County did and I was proud of why Nye County did, and I wanted him to present, so you can see what we were doing. Chief Scott Lewis and Patrick Lazenby gave a presentation with graphs and photographs of the missing aircraft.

I would like to put together a written resolution thanking everyone involved. Chief Lewis- One last thing, those guys that came down, they are TV stars. They have been on A&E, they do the Disicle Brother’s TV show, they are on the internet, they are on YouTube about everything. They were so humble, so professional and so willing just to drop everything and he took on the entire cost of the mission, an estimated $70,000.00. You cannot say enough about the desire to help on their part. March 18, 2025 11. 10:00 a.m. Discussion regarding directing staff, in coordination with the Fire Chief, to assess issues regarding retention and recruitment and report back to the BOCC with its analysis and recommendations. I put this on calendar; the reason was not for any profound discussion or anything other than just to recognize my observations and I’ve been in a lot of places where I’ve seen hostile situations you’ve seen some today, as a matter of fact, so certainly no stranger to that. And I will say that it’s spending some time with the firemen down there and spend some time with the Fire Chief I don’t really think they’re that far apart you know there’s sort of a history where there’s some issues I just genuinely would like to try to see what we can do to do a better job of funding and recognizing our firemen we are and I don’t want to speak to the numbers and everything the Fire Chief put together a very well thought out couple pages about it. But we are under staffing and there are things that I would like everyone to want to do for our fire department and I did talk about this for you know almost a year now about fire and police and so I just see this as a first step to really just trying to show you Chief and your men that the community cares and that we are going to make this a priority and I hope that my colleagues will make this a priority because that’s what I want and I’ll just leave it at that I don’t want to go on but that that’s the reason why this was brought up and so for me it’s a starting point thank you. Chief Lewis- Commissioners, it’s difficult when we are criticized, most of the time it is just ill information and incomplete communication. In many cases where we have people who will be present, it took this amount of time and all those things. There is a learning process with everything that we do. As Commissioner Bayne mentioned, staffing, location of facilities, all those things come into play. So, what can we do better, collectively to insure we have our best possession and provide the best service possible, commiserate with the public’s expectations of us. I think sometime that’s where we faIl short. We think internally too much, and we need to think externally. But we need the support from everyone in order to complete those objectives. You know we have this initiative to support the blue, maybe something like support the red. That shows everyone that we do care. It’s not just when you call 911 and need the fire service that you are actually thinking about them. We have been prepared long before that and if you do have questions about response times or anything along those lines we have an open-door communication that you can come in and ask those questions, we’ll give you a straight up answer. The answers are very simple in most cases weather or not people want to embrace them, that’s another situation, but that’s a personal choice.

We have a very large list of responsibilities to be liaisons to many entities throughout the county. Our role is not to tell these committees and entities what to do, it’s only to guide them, just as we are guided by the DA. We have one Pahrump Public Library District, and we had a resignation so early on I did not think a meeting was held. Because they had been closed to renovations that are going to uplift and very eye friendly, so I’m curious as to why there had been a resignation so early? According to the list it was the only one that commissioner was the primary for.

for an answer as to why he has zero. Chair has 3, Jabbour has 11, Koenig has 4 and I have 14? I would say besides our secondary we are giving our time to help each of these Boards, and I do not know why, I would like to hear a reason as to why there was a resignation from the Library Board from Commissioner Bayne without a meeting and what was the reasoning for not wanting to do this job? Why should it fall on any of the rest of us to do the job when Commissioner Bayne has not even one other primary?

Well a lot of these liaisons and possessions took a lot of time, the one that I am on takes a lot of time, but it’s great, I wouldn’t change it. I think people do things for whatever their reasons are but need to figure out how to resolve it and move forward. Administrative Manager Tackett- I just wanted to bring to light, we only had the Library District as a liaison position starting in about 2020, it wasn’t always on the liaison list. They are pretty autonomous, they are their own district, they hold their own funds.

I have no problems serving on these, the ones that I had ranked. We had a ranking system, many of you don’t realize that. We’ll kind of rank what we want, and I went to Administration, and I said I can do these. Library Board is a no, I actually wrote down no on there and then for whatever reason we we’ll never know that some of the people to my right wanted to put me in the Library Board. But I’m perfectly willing to take any of these other positions. I always have been open to that and so I was told that there were other people who wanted all these other roles so there’s your answer.

The reason why this was all set up and Commissioner Koenig can probably recall quite a bit of that, because he was in the middle of that and that was the reason why a liaison actually got put in place. Believe it or not you don’t really need a liaison. I think you were pretty much on the mark with that there’s no need for it. The only thing was is that at the point in time it was just starting, the DA was actually coming to the meetings himself to try to see if things settled, and I think that having a liaison is probably not a really requirement. I think based on all the conversations you’ve had, making sure Michelle is there or yourself is there, I think there’s plenty of information that comes out from these guys to make sure things are on the mark. I’ve discussed this once before, when I was a commissioner, saying I didn’t believe it was required but I will go ahead and follow through until the end, so again I think you guys are right on the mark thank you. I Representative position for the Pahrump Library District Board for 2025. Cont... previously, so they didn’t really understand the open meeting law requirements. We’ve actually worked with them very well and I do think they are operating the way they’re supposed to be operating. There are still contentious meetings at times, but you know that happens. But I do believe that the board is, from my perspective, operating legally. And we have an attorney there for every meeting. Ginny Okawa- I do attend most of the library meetings. I do think it’s important to have a liaison there. I don’t know if I agree with DA Kunzi as far as the meetings being contentious. If they are contentious, I feel it’s because of the current chair, he treats a lot of us with disdain. We go there and we try to be very respeciful. He looks down his nose at us a lot and he makes comments. I appreciate DA Kunzi, you did attend in the beginning, now we have Michelle Nelson there. I think it’s very important that she’s there, she is very helpful. Chair Shewalter needs a lot of help as far as conducting meetings according to open meeting law and assistant DA Nelson is extremely helpful in that. It’s just I would say it’s important that we have a member of the Commission here as a liaison and please reconsider. Thank you. Tim Bohannon The meetings I’ve been to, or have observed, there is a little tension in the room. A good example is one of the understandings of the library was going to be closed for a very short period of time, and that’s not really how it was sold during the meeting. So, you know if there is a liaison paying attention to that kind of issues and concerns is appropriate. However, from a function standpoint, they have a functioning financial reporting process that seems to be working. The board, from the standpoint of being present is there. I’m just talking about the function itself. So, from a liaison standpoint, from what my observance was with Frank being liaison, there was a little bit that could be said but not a whole lot. They pretty much have it from what I could see. Thank you. Linda Clark- I personally have been to a couple of different meetings, not at the library, but some of our other groups. There’s always commotion over something or someone. The board for the library is not any different as long as there’s not any small children involved. What’s the difference between having a person who’s considered a liaison or just an advisory? We have a lot of smart, bright bulbs in this town that probably could do a better job than a liaison, and they’re nonpartisan. Why can’t we do that? I don’t understand why we have to have a liaison for everything. You guys are up here with pages and pages of stuff that you have to work on. Why do we need a liaison? Let’s just get a person that’s advisory and maybe we can move them out once in a while and change them around, we don’t have to have the same person. And you don’t get all the blame for it; you can blame it on that person and see how long they last. That’s my opinion, thank you. March 18, 2025 Matt Morris I am a current member of the library board. I’ve had Frank, our ex commissioner, he was there every time. It’s one time a month, but Frank was always there giving points to those new board members. He was very helpful in pointing out procedure and I’ve grown from having that input from him. So, I appreciate the liaison and any one of your board members here would be welcome there, and it would be a good opportunity for you to have your finger on the pulse of the community, what the community is doing, and be more aware of that particular entity, thank you. Helene Williams Explains the difference between the library board and water district governing board. The chair for the library board being replaced would be a good idea because of some of the things that went on during the meeting. I’m here to separate the fact that the water district governing board is very different and we have legal counsel because we needed good council that understood the water laws. Michael David Garcia We’re looking at reporting the violations there are numerous open meeting laws that happen in this Commission as well as other boards. They’re not being reported so we do need compliance in that end. Diane Franke-We do need a liaison. Michelle had to tell Mr. Shewalter what he was doing was incorrect. There was foul language, and they are recorded to see all the eye rolls, sneering, lip curling, and cussing. Ann Underdahl While there was a liaison there were at least two instances where suits were filed against the library chair for swearing at people and violating open meeting laws. His personal opinion of the of the past president of the American Library Association called to take our library out of the ALA because he did not like her personal politics. Books have been relocated from the youth section into other areas because they felt that they were possibly inappropriate. I’m not considering that the decision on how a book is classified as done by the Library of Congress not by our individual librarians. Currently they’re supposed to be visual, so he finally agreed to keep the zoom regardless of the problems that he felt it was creating. For a chair to be removed the board itself has to remove him and at this point that’s not going to happen. Having the liaison there is like having mom at the playground, kids tend to play a little better. I would recommend that we continue to have a liaison. DA Kunzi Ginny is not the issue she is one of the politest individuals but there are. People in that meeting that have caused contention, I’ve witnessed it myself. Don’t suggest that this is 1 sided, my goal is to see the public become more respectful. There’s issues on both sides that need to be addressed. I don’t know if a liaison fixes these issues. This isn’t a 1-sided battle at the library district and there’s some very inappropriate conduct coming from the public that really needs to be checked as well.

But then they forget that Pahrump is a small town when there at work or at events running off at the mouth about other people or things that maybe going on in their offices. They don’t realize who knows who, who may like someone better than they like you. Gossip & lies always come to Light, maybe the next day or it might take a year, but it always comes out. So to call me uneducated & talk about my affidavit of fact & to say it’s not legal because I didn’t use a lawyer really shows how that common core education does not work in this town. Most people know you don’t need a lawyer for anything, I got a divorce without a lawyer, I got full custody of my child without a lawyer, I put my home in a trust without a Lawyer, Did my estate planning documents & last will. & testament without a lawyer. I started many businesses without lawyers. I have 3 different contracts regarding my ranch, that I did on my own, I did have 2 lawyers look at them & both said they would hold up in court. In-fact a county commissioner has used the same affidavit of fact, that I served on the county in her own business practice, so she knows its legaL, especially when you don’t respond in the legally alotted time frame. If I am forced to retain a lawyer to collect on that affidavit of fact bill that the county agreed on when they didn’t respond there will be a few more zeros added to it. You do have 73 million sitting in a cash account. It may be difficult to put a lien on the building & planning departments itself but lawyers can defiantly go after personal property & private businesses of alt involved & especially those that are not employees. I would love to teach anyone that has been having the same issues I have been having with the county on how to go about stopping the countys BS. Just imagine if everyone having to deal with the county knew they could stand up for themselves, knew they could stop the harassment, knew they could ask for a trial when given code compliance citations. More people need to stand up & stop the bullying. Our county codes, rules, regulations are written off CA code from 2000 when the new county at the time hired a CA company to write them. Its time we focus on changing those codes, rules, regulations & get with the 21st century in all aspects of our county. Exhibit 1
