What’s the best guess as to when they will start doing the overlay on Wilson Rd? Beau Gott We do cold fix overlays when the weather warms up a little bit, it helps with the bondage and the workability, so I’m going to shoot for middle of June. He makes a comment on the difference between cold fix overlays and hot fix overlays. He states the amount that we’re putting on the ground is far too much to be able to do it with hot fix, it’s just not feasible budgetarily and physically.

She notes that we must have janitorial services for these buildings because it is our responsibility to keep the areas that are occupied by our staff clean and taken care of. Her recommendation is to either go back and reduce the scope of this contract or award this contract and then renegotiate these facility leases to various third parties. April 8, 2025 15. They already have an initiative to evaluate all our leases and all our shared services contracts to make sure that those types of things are captured, re-evaluated and approved by this Commission when the time comes. It is time to renew those agreements we just want to educate the board at that point as to what it costs to provide these services, so you make an educated decision.

We don’t disagree with the public’s comment and have serious questions as to the leases. This is a formal bid process we’re here to consider a bid with a company that has given us a bid taking into consideration all these buildings and the scope. The buildings must be cleaned so when the current lease expires with the current janitorial service would this company be willing to go on a month to month. Manager Waggoner If it says in the lease for these entities that we’re to provide the cleaning service, then maybe there is no solution other than putting it back out. It could be handled in a motion as far as the reimbursement for those expenses, we pay for their utilities, but they reimburse us back for those utilities.

It wasn’t mentioned that the Cooperative Extension services on this and she didn’t know that we owned that building and West Care because it’s all the old courthouse. We’re paying money for this and without the answer I don’t see how I can vote to support money going to a nonprofit firm incidentally. The problem is that we’re sort of tied here in in a yes or a no, so, unless there can be something done without this money to nonprofits, I’d have to be a no vote on this.

The question is, do the people that do it today, do you think that they would do it month to month until we change this whole thing around to what it should be. Director Allen I’d be afraid to answer that. I don’t know the answer but don’t think she would be opposed to it. I would like to add something, that we do own these buildings and the way I look at it is the janitorial service even though it is kind of expensive with this bid is our first line of maintenance. My suggestion based upon the maintenance needs of the buildings would be let’s go ahead and move forward with this for this year and then revisit this. We want to fix it, but we can’t exclude people from our contracts, which is why they’re there. It doesn’t change the question of why we are paying but take that aside and just look at it as our first line of maintenance, that’s the reason I support it. DA Kunzi points out that there’s an interesting provision that allows for basically a 30- day notice to cancel this contract. So, if you want to address some of these things later down the road and adjust the scope of it that’s certainly something we can do under the terms of the contract. April 8, 2025 15. It does not make the board feel any better because they don’t know what the outcome of that a $10 reduction on the whole thing would be, which is nothing. DA Kunzi clarifies you can terminate the contract with a 30-day notice, so if they don’t want to change it you can terminate it.

Again my problem is a 53% increase in costs. That’s what I’m fighting against and I’m trying to figure out a way around that and if I took half of that number and offered it to the people who are doing it today would they accept that. Director Allen They haven’t tried that to get a cheaper price, so I have compared square foot by cost to what we’re doing in Pahrump and it’s comparable Samantha Tackett Within the current leases and also with the initiative that I mentioned, we do have a mechanism to charge for janitorial for those locations. In the janitorial contract that we’re discussing in this item today it shows what we would charge for, what we could charge back to those nonprofits so if we were to move forward with the current contract in discussion, we could very easily bring back the leases as discussed.

Are you saying if we approved it today, and then the decision would be to cancel at some point in time and renegotiate the whole thing? DA Kunzi With the cost of the services you must bid for it, you can’t negotiate it. So, if you were to walk away from this contract, terminate the contract to go into a new contract, you’re going to have to put it out to bid because of the cost of the services. You’re restricted in how you can do that under the NRS.

there are two issues here, 1 is this whole overall cost and the 2nd issue is this janitorial for the nonprofits. Is there a provision in the contract to assign the janitorial services to the nonprofits that are renting? Item 1 is something that the DA obviously knows, the contract, and that’s what it is my concern. Immediately is item 2, if we can motion on a condition of passing that along to nonprofits. So, we would be able to amend and approve the contract and by amending it so with the provision that we’re going to re-evaluate the potential of reducing the scope of work would that be appropriate. DA Kunzi Reimbursement isn’t changing the scope, because again its maintenance and is recommended to protect the value of our buildings. Whoever is responsible for paying, that really has nothing to do with this bid with this contractor.

so what he’s saying is we can’t add some kind of condition to this because it’s inappropriate because now we’re monkeying with a private contract. I will approve this but on the condition that it’s put here as an advisement as strong as it can be without interfering with a third-party contract and I would expect someone to take action to ensure that these nonprofits are paying in the event that they don’t have to take some kind of action.

Everybody knows my position on this, I’m a realist so when I look at things in government, I can name 100 things I hate. I don’t feel so great about Harry Reid’s vision and don’t want to be part of that. I want to be honest, and this is within the scope, this is from March 18th it says pandemic refuge center. My top concern, if it can be addressed, and if my other commissioners are willing to listen, to restrict some of the activities like drug addict treatment centers and social services.

This was never the reason to build this, whether it ever gets built or not. This was a Community Center for people to gather, similar to the Bob Rudd April 8, 2025 16. Center, except bigger and newer. A Civic Center for kids to play for people to gather to have meetings and things like that.

On the body of the agenda it reads emergency shelter so commissioners this is why it continues to come up. In Amargosa Valley, we approved as a board, $250,000 for a backup generator for when an emergency situation will occur and they need a core facility to go to just like this. Not just specifically for an emergency fallout shelter, which we need, because the Bob Ruud Center is not adequate enough. I’m not challenging those letters of support. I am challenging the 5 mentioned Pah rump something names that have nothing to do with Nye County taxpayers. If it’s going to be named something of Pahrump, I think the town board of Pahrump should be financing this and not Nye County. If the Pahrump town board is to be reseated this project would fall under their jurisdiction. If District 5, and part of 4 and 3, become incorporated as a city, this project falls within those boundaries of the proposed area. I’m not OK with this at this time.

I would like all of you to support clarity. That’s all I’m asking. I would also like to ask if Stephanie Elliott come down and explain something. There’s been a lot of discussion about what we had for a presentation back under a different board, we had a presentation due to ARPA funding if you recall, and that grant federal funding dictated that we had to have a usage that would address the emergency that we were under. Stephanie Elliot The acronym for ARPA is the American Rescue Plan Act and outlines the strict Arpa guidelines related to healthcare or public services for usage.

We were going to use ARPA funds to fund a portion of phase one but now we have replaced those funds with latch funds, so we no longer have to meet those requirements. Stephanie Elliott That is correct and there have been a lot of meetings, an allocation meeting the board at that time had chosen after many different workshops and conversations that there was a whole laundry list of different items that we could potentially use the ARPA funding for. At the end of December of 2024 all of the ARPA funding had to be obligated which means a purchase order a contract spent, or sub granted. We had awarded a bid for the design build however we had not actually Page I 20 April 8, 2025 16. Cont... awarded the contract which was recently brought before this board earlier this year so in order to secure the funds that ARPA had provided to us, we had to move and shift that money to projects that were already underway. So now we have local assistance funding which is securing the future construction and design of the Community Center and there are not those types of restrictions. You cannot build a Convention Center with the use of ARPA funds, so we were not building a Convention Center we were building a center to be able to get vaccinated and get tested COVID. The ARPA guidelines are not a part of the future build of this project and the fairgrounds itself run under some CDBG guidelines. So, the use of the facility is at the discretion of the board and how the community would like to use it.

I’m again asking for clarity so that we can actually have a name because we see that the Civic Center Community Center is not sticking. We’ve been given lists of names that potentially could be used, and ARPA pandemic center is no longer where we’re getting our funding. The only thing I see that should be removed from this list is emergency shelter.

Explains why he wishes to have these discussions in a room instead of the forum. The issue for me is really that I just don’t want it, and I feel like I’m being sort of bullied into going along with something I don’t want. The problem is that when you change names all the time and the usage, the public gets concerned. To give the maximum amount of assurance to the people is to have as strong language as possible that cannot be reversed by a majority or a deed restriction.

I think we kind of all agree on that part. We need to figure out a way, ironclad, that this thing cannot be used for anything we don’t want it to be used for.

I will apologize if you or anybody else thinks that I’m bullying you. I’m not and again I want to reiterate my position; I disagree with removing the emergency shelter from this. I am not against having a facility that could be used as an emergency shelter. We need to have designated areas for people to go to in an emergency that will be a safe haven.

When that flood a couple years back, the Red Cross was set up at the Bob Ruud Center to help people and, but nobody stayed there.

If you define what an emergency is, it becomes more palatable for people. The word emergency, especially now, doesn’t mean the same thing as it did in 1987 for example. If you really want to do things to deescalate this from opposition, just define what an emergency is. I would love to say restrict this to people who live in Nye County who have some kind of displacement for a temporary period of time. I don’t Page I 21 April 8, 2025 16. Cont... even know if you can say it can’t be used for emergency. What I’m saying is if there’s something that’s strong enough to say no drug treatment, no homeless treatments, no mental health treatments, and no nonprofits, because it’s not appropriate. I think that would solve a lot of the problem of people being upset about this. I think the majority of people who are concerned about this are not worried that it’ll be a natural disaster. They’re concerned that there’s going to be a line of homeless people trying to get drug treatments while people are playing pickleball and kids are playing on the fields. I agree that we need fields. I would love to do these things. What I don’t love is the building. We need to expressly state in there the restrictions. I would vote for the usage if it was restricted in scope that cannot be used for treatment centers of any kind.

I don’t want this to be misunderstood as my support for this, so I am concerned about that, and don’t know what I am going to do. You got my help just does not mean you have my vote. I think the people honestly don’t want it. DA Kunzi What concerns me about what is being suggested is if you start putting restrictions in there, you’re going to be limited to the restrictions you have listed. And by definition, no other restrictions would be applicable. My suggestion is that you look at the lists that is in the back up to the agenda item, indicating the uses that you’re approving and indicate that those are the only intended uses that would be permitted for this facility.

I’d like to make a motion to select the official name as the Pahrump Fairgrounds Activity Center and that the identified list of uses the for this purpose. DA Kunzi I think it’s a good motion from the standpoint if you’re identifying what the uses are if it doesn’t fit within those uses than any other activities would be excluded.

Manager Waggoner I am bringing this to the board because I think it’s a good business decision. There is a substantial savings if we were to change it into a holding facility. It will still be a place where people can be held if they get arrested until they get to see a judge, and if they’re released, they’re released. If they’re not, they would be transported down here to the Pah rump jail. As far as employees, we aren’t going to lose any of the law enforcement employees, there is a possibility that we will have some non-law enforcement employees that we will need to lay off.

I’m not in favor of this; however, I cannot defend against it when you look at the checkbooks. We have to have a holding facility at bare minimum in that area and outline the reason. The plan is that we will still have a minimum of one detention deputy in the facility 24 hours a day and seven days a week. There are going to be some complications that we’re going to have to figure out there’s a lot of moving parts to this that we’re going to have to work but again financially I can’t defend against this.

it’s very difficult and I appreciate the fact that the sheriff clearly said that that he’s not in favor but it’s tough to defend the financial side. I don’t see any numbers on the transporting of the time, the fuel, the labor and the liability of handing a prisoner off. Discusses the different food options for inmates. What is our liability going to be on the road transferring 6-hour shifts for Nye County and Highway Patrol and we’re not reimbursing them for their fuel. That leaves exposure, taking that that deputy off of their assigned area and having them transport. That’s something to be concerned about how much we are actually saving when we have those other factors to consider. Manager Waggoner you will see the reason is not over 2 million because the operating cost for that jail is actually 2.2 million a year. The reason we’ll only see 1.6 million in savings is due to some of the added expense that’s going to be added to the budget for the Pahrump jail. This eliminates the need for a food contract and for a medical contract. When someone is booked you have to perform that examination within 12 hours so that’s easy to have done on an on-call type basis, so we won’t have to have a person staffed in the jail 24/7 anymore. We’re trying to compensate for it by adding to the budget of the jail down here approximately $700,000.

We have still been doing transports back and forth between Pahrump and Tonopah detention facility. When we lost our medical contract with serenity in Tonopah, we took anybody who was on medication being housed and moved them April 8, 2025 12. Tomorrow we’re going to request some transport vehicles because if we’re going to be transporting that frequently it’s going to be a cost on our fleet. Our inmate to employee ratio is upside down so that’s another item that we’re looking at. We do have the room here in Pah rump because we no longer have the ICE.

We try to time it so that these decisions can be made before the budget, however, sometimes these contracts just don’t renew in time for the budget. We have a lot of contracts that do need review, and we have long-standing contracts that auto renew, and it does sneak up on us. Doing a cost analysis, it takes some time to actually collect historical costs to decide and make a recommendation to the board. Part of the negotiation as well, even on the revenue side, we make sure that when we renew the sheriff ‘contracts or any contracts that we’re not being hurt on the financial side we’re not using our resources and not compensated fairly. We do have rising costs and that does include salaries and benefits for our deputies’ sergeants and lieutenants, and we do input that cost in and tell our partners to pay that increase when renewal time comes.

I thought “wow” I know her too, but I was put threw hell for 2.5 years from the county for my property & license. What makes her so special that she doesn’t have to follow the rules the rest of us do? Any time that you are scrolling through any social media sites you see posts on a daily basis about new business opening here in’Pahrump. But when 1 look up their licenses 9 out of 10 do not have one. I have a List here of 11 equine types of business but only 2 of them have both licenses, yet they all advertise on social media about their business. Now I am not ‘TRYING TO T.H.ROW ANYONE -UNDER T.H.E.BUS’ what .1 -a-rn trying to -do .is push the fact that we need the procedure for a business license changed, updated, easier & quicker! With alt these businesses that are willing to work without License, CUP or even cottage licenses it should show the county we need change. But they are still up & running & none of the animals have been removed. I know if that was me violating my CUP the county would crash through my gates & shut me down immediately. The “anticipated cost” for this Janitorial Contract was based off of Last year’s contract price of $1 20,000, however an increase was anticipated due to rise in costs. This newest contract is for over $1 84000 —that’s more than an increase of 50%!!! That’s one heck of an infLationary “jump.” - Did the amount of square footage to be cleaned change? Will, they be cleaning 50% more than they did last year? But, beLieve it or not, that’s not the WORST of this proposaL. We, the taxpayers are somehow paying to have two NONPROFITS offices cleaned NO to — Abuse for $412.15 a month and the Nye Communities Coalition for $118.98 a month. That’s over $6,000 a year! Don’t these nonprofits already get grant money from Nye County to pay for their operational expenses? This amounts to double-dipping at best. How long has this gone on? This contract needs to be revisited. IF the county is giving these two nonprofits the use of county office space, are they paying for this? Again, more double-dipping. In case you aren’t foLlowing aLong, these nonprofits come to the BOCC to ask for grant money for various victim projects or needs. This grant mohey is Largely overlapping other grant money and includes perpetual overhead expenses shoved off to the various grants. So, they get grant money for overhead expenses, and then they don’t use that grant money for overhead expenses? ShouLdn’t overhead expenses such as office space rent and office space janitoriaL services be paid for by the grant money they already got? What else are these nonprofits being given at the expense of thä taxpayers? It’s bad enough that your accountabiLity for nonprofits is virtualLy nonexistent. How are you aLlowing this to happen? When federaL funds were given for this part of the project, theywere done so with the understanding of creating a Pandemic Refuge Vaccination Center. Changing the name does not relieve the responsibilities touphoLd the grant funding requirements which is why you have to continue to add “Emergency Shelter” as part of the “Planned or existing uses for the Fairgrounds.” I find it interesting that the onLy explanation for the Emergency Shelter is as “A designated space for the community to gather in case of emergencies LIKE NATURAL DISASTERS.” It doesn’t go unnoticed that you’ve chosen the one “emergency” event as a “naturaL disaster” to distract the citizens away from the actual use. Just what is a “natural disaster?” If the Governor or some other government official declares a heat wave to be a State of Emergency, does that activate the use of the Pandemic Refuge Center for homeless people? Do you need to be able to administer vaccines in a natural disaster? Wasn’t that one of the uses listed in order to get federal funding? if the county builds this facility on 40 of the acres of the BLM land they got, and if the county pLans on having a commercial kitchen in the facility, and if the county plans to offer social services, and if the county plans this faciLity to be a designated emergency (homeless) shelter, and if the Coalition wilt be the entity managing this, the only difference between this faciLity and the original proposed Coalition’s homeless shelter and soup kitchen is that WE, the taxpayers will have to pay for every aspect of it from maintenance to insurance to salaries to upkeep to law enforcement needed instead of the absurd “fundraising” the Coalition claimed they would be doing to support their own homeless shelter. No wonder they’ve been so quiet about their own project. No need to do that if they can get someone else to build it and pay for it. You might as well name it, “The Nye Coalition Transitional Housing and Soup Kitchen.” You have to pay by the letter for signage, and this name is in Line with the other long ones you are considering, plus it details the actual purpose. Exhibit 1 1 In closing, a fiscally responsibLe county wouLd not build a facility such as this that couldn’t payfor itself. And not with their own county funds in a circular fashion. This facility is expected to be open 5-7 days a weekfor extended hours. By contrast, the Bob Ruud Center is only open when it is being used. What will it cost to air condition or heat a 28,000 square foot building with high ceilings for a basketball court, especially if it is housing homeless people at random times? We aLready have facilities here that accommodate a number of the purposes you’ve listed. Other areas could be updated or improved at a teeny tiny fraction of what this is going to cost. I’m willing to bet that not one of you would say on the record that this facility wilL NOT be used for homeless peopLe. Maybe a better name for it would be “Change Orders” or “Financial Fiasco” but for me, I wiLL continue to call it what you received the funding for: A Pandemic Refuge Center. If you are so hell-bent on spending money we don’t have on a fiscally-draining project on 427 acres, why don’t you put it out as a ballot measure to see exactly what support you have? Make sure you are HONEST with every aspect about it — I’d be happy to write the dissenting opinion about why we can’t afford this. Unfortunately, we know you can’t be honest about this because you are shooting from the hip operating blindly without an actual cost analysis of all you want to build there. When the Davis-Bacon act requires the higher prevailing wages, that means more money for whoever is building it there’s always a cost associated with billing for labor. Much Like when you need a plumber and are paying $75 an hourfor his expertise, that is not what the plumber is actually making an hour. The company has to bill for operating expenses and overhead collected by bilLing more per hour for the labor. Are any of the existing parks we have that could have benefitted from improvement subject to the prevailing wages? Could we have done this for far less? Recently, a 30-acre horse-racing facilitywas sold for under $2 million. Granted, it needs a lot of work, but I’m certain it would cost less to fix this than the plans you have to suck our coffers dry. And it had water rights and wasn’t in the same disastrous flood plain that the Fairgrounds sits on. If you cared about the county, its citizens, and the struggles many have to stay afloat, you would NEVER propose something of this nature. We cannot afford it, plain and simple. There is NO support for pushing us to insolvency. The last-minute “letters of support” seemed disingenuous as the majority were form letters stating “enthusiastic support” many from builders and others who need county support. I ask that you please do your job and manage the funds you have well. That doesn’t include wasting money on things we can live without or that could improve existing facilities for far less money. Go ahead. I dare you to add a ballot measure before you spend another penny. See what your citizens want here AFTER they know the full costs and repercussions of spending the money on this instead of critical needs, plus future maintenance and additions. Public Comment Nye County Commissioners, PPLAC (Pahrump Public Land Advisory Committee) discussed and deliberated supporting the withdrawal of a substantial area of public Land in the Amargosa Valley from mineral exploration as agenda items at regularly scheduLed meetings on February 11 and March 11. The March 1 1th discussion and deliberations led to a majority vote supporting the mineraL entry withdrawaL. “It’s about the water” is a common consensus. The proposed mineral exploration jeopardizes the common aquifer serving Beatty and Amargosa Valley without adequate safeguards or plans for emergency and Long-term remediation.
