There is a slide that we want to have up while the departments come up. We wanted to get to that slide quickly and then we could go back. If there are questions, then we can reopen and go to the details. The tentative budget right now does not have any of these impacts

There was additional backup that she would like recognized. She wanted to add the $5 million from GridLiance and $1.8 million excess proceeds to the projected unallocated resources. These are in addition to the 5.78, the 400 and 1.6. These funds will be something that the commissioners could be looking to allocate in the future.

Only problem is once you allocate it you can’t use it. We shouldn’t allocate the $5 million. We need money in the bank so we can operate.

The reason it’s not on that slide is that slide is titled for capital purchases. We’re not sure that we want to make that commitment to take that $5 million of Grid Liance money and allocate it to capital purchases until we know that it is an available cash balance. Will be talking about ending fund balance and the need to maintain at least a $5.8 million cash reserve. Must figure out what sources of funding is going to remain in the general fund to make that cash float happen. Right now, we do ApriL 9, 2025 6. 10:00 a.m. For Possible Action Presentation, discussion and deliberation to — — adopt or amend and adopt the Tentative Budget for Fiscal Year 2025-2026 for Nye County. Cont. not have complete solutions for maintaining that and growing it to the $8 million that it should be, which is two months’ worth of expenditures.

We met with our Wells Fargo account executive and asked them to get us more cash flow. The Treasurer was included in that meeting. We have investments but they are not allowing us to keep cash flow so that is what we are working on next.

Over the course of the year we are going to lose $5.4 million as our current operating.

Correct, as it stands. That is a conservative figure. There is a $1 million contingency. If we are good and disciplined, we will not use that contingency and will add to our pending fund balance, but it is there if something should happen that is not anticipated. We can budget up to 3% per D-Tax of contingency. That $1 million only represents 2% so it’s not even the max amount that we could set aside.

it’s not really clear to me what our beginning fund balance on this is and what we project our ending will be. Helen Bae for the general fund, we are looking at, for the town of Pahrump, the ending fund balance is expected to be 3.042 million, beginning fund balance is on page 7; 2,443,976. This is the town of Pahrump, if you have any questions. In the future we will have slides, now that I have a Town of Pahrump financial manager, Jennifer Fanning. We do expect to put more analysis and presentations forward pertaining to town of Pahrump funds. It’s just that our Nye County general fund overlaps everything, and we do want to have equal attention and diligence towards the budget and status for town of Pahrump. for now, you know Jennifer just started and we’re doing this together, but she will take a greater role in answering questions and greater detail for these funds. The ending fund balance is on page 8 3.042. total is ending fund balance plus available. The town of Pahrump, as you can see the ending fund balance is a healthy ending fund balance for the general budget. It represents way more than the 4% that D-tax recommends you not go under. Jennifer and I looked at this and we went over just general indicators of the health of a general fund, and I will say that the towns in general, as you are going to see Beatty, Gabbs, Manhattan and all the other towns, when we look at their general fund, they are all very healthy. except for Manhattan, because Manhattan just historically received very little tax revenue in general, and their population has dropped from 146 people to 66. There are some implications to that, but we do have the town of Manhattan budget as part of the agenda. April 9, 2025 7. This one has a beginning fund balance we talked about; it has an ending fund balance we talked about, and this is proceeds of just under 600,000. so not a loss like with Nye County, which had a loss of 5.4. This is a gain of almost 600 so I just wanted to point that out to everyone.

I actually have other information from the Beatty Town Advisory Board, that they’re meeting to review this tentative budget won’t occur until the 14th of April. That’s next week, so they haven’t had ample time to go over this and they’ve requested that if we vote on anything today in regard to the Beatty budget, that ApriL 9, 2025 11. For Possible Action Discussion and deliberation to adopt or amend and adopt the Tentative Budget for Fiscal Year 2025-2026 for Town of Beatty. it’s absolutely tentative, as there will be adjustments coming down the road after their meeting. Helen Bae so I do want to say that the tentative really is tentative. The numbers can change, and they do oftentimes. The final numbers will change from tentative to final and the board actually only has to sign off on the final. There is no sign off on the tentative. This is a drill that we must submit what we have no matter what it is to D-Tax so they can actually take a review of it and make sure that the proper form has been taking place. It’s more of a preliminary review by the state, to make sure that we are on track, we are meeting our schedule, and we are scheduling our final budget meeting, and it’s something where they’re wanting to confirm that. we have communicated to all of the advisory boards, to the towns as well as the water district and northern Nye, because we do prepare the budget on their behalf and submit it, and we do say that things can change then we will be taking all adjustments as they come along all the way up to the 20th of may or whenever their scheduled final hearing is, because the district boards can set their own final hearing date. We are in constant communication with them to make sure that we are meeting our deadlines and statutory requirements.

so I see where we have revenue increase of 775,000 which is pretty significant given our revenues only 730 in 2024. Do we know why? Helen Bae the property tax has increased for some of the towns and some of the districts and actually it is based on assessed value. So, the assessed value actually drives the increases, and it’s not usually even tied to population. I’ve seen population go down; however, the property tax goes up because the assessed valuation has gone up. so, there is not that much of a correlation between population and but it is based on assessed value and it is a D-Tax estimate. Sometimes that actually doesn’t come true either, and we could receive above or slightly below that number.

We just wanted to present this so that we could get the job duties more in line with what is actually being done by Tammy Engel in her position, and to bring her a little bit more in line with her responsibilities. I understand every single thing we do up here, it has to give adequate notice so that people have notice. I don’t know that this is something that obviously the DA can rule on. but I don’t know if this is going to be a failure of notice to anyone. DA Kunzi right I mean it talks about the addition which I think is fairly open-ended and I think as long as you’re taking action with regards specifically to this and I certainly agree with miss Richardson that the money that you’re seeing as far as the increase, is largely due to the hearing master, which is an addition so there’s certainly no issue about you taking action on it adding a hearing master. They’re asking that you add a hearing master but the reclassing she’s referring to is the other positions. Whitney Richardson we currently have a part-time secretary position that is not filled and that’s just a basic legal secretary. We’re looking to make this position a JEA which is a judicial executive assistant. I did clarify with Elona about that when I sent the justification forms and it does say reclassification for our current open position in our justification forms.

Whitney, please, so the court hearing master, do we have one now, here in Pahrump? Whitney Richardson we do not. We have hearing masters in Beatty and Tonopah, but we do not have one in Pahrump.

Here in Tonopah, I believe the justice of the peace, Jennifer Klapper serves as the hearing master. Do we have that position here in Pahrump with any of the JP’s? And could you tell us what the hearing master does? Whitney Richardson To my knowledge, not here in Pahrump. So, the hearing master basically hears cases that don’t necessarily need to go before the judge because their workload is just astronomical. The legislative session recently appointed new District Court judges to several of the districts, but we were not included in that. We just wanted to be proactive with the knowledge that we will probably be needing a judge within the next few years, a third District Court judge, so we wanted to get a hearing master to help with those workloads. but they just hear cases that don’t necessarily have to go before a judge, like divorces and things like that. DA Kunzi this affects my department as well and I will say that as Mr. Richardson indicated, Douglas County and Elko County, who are counties of our same size, basically very similar court case loads, are adding a third District Court judge. I’m afraid we are heading in that direction. Obviously, the difference between what is being proposed here and adding a District Court judge is very significant. What a hearing master does is many cases and in particular some of the other areas like divorces, Apri 9, 2025 21. For Possible Action Discussion and deliberation to: a. Cont... probates, things of that nature, what you can do is a hearing master basically sits in and hears everything just like a judge would and then they make a recommendation. It’s supposed to be signed off by a judge, but all of the hard work is not being taken up by the District Court judges. It’s being done by the hearing masters. This will help tremendously in cutting into the back log of cases that we have, particularly our criminal cases. Our judges are jammed. I mean this is a busy district, and I recognize there is a fiscal impact here, but this will increase the efficiency of the court. It’s going to make things move a whole lot smoother. so that we can actually have the judges doing the jury trials and you know those types of things that have to be done, particularly in criminal cases. They’ll have more time to be able to do more cases and so I just want to point out that, again from my perspective, this is something that I think we ought to consider as a stopgap to being forced to hire another District Court judge.

I appreciate you giving us that information Mr. DA and saying that however, my next question is, when you say we’re moving in the direction of potentially hiring a third District Court judge, which would be state funded, what’s the criteria for that. Because I’m in favor of let’s get that third judge. Let’s stop fooling around and get that judge in place. DA Kunzi here’s the other issue that you have to consider. You’re going to have to find another courtroom, you’re going to have to find facilities for a new judge. We don’t have the physical space to add another District Court judge so there are a lot of implications for the county, for us to put in another District Court judge. I don’t disagree with you, you’re absolutely correct in that the salary of the court judge is paid for by the state, but everything else is paid for by the county. But for me the bigger question is physically, where would we put another District Court judge, and what are the resources to do that.

I was just going to ask controller if we can afford this. You have no idea; I just did the numbers on this and these three positions if you add them up are 251,000 not 235,000 according to our backup. Helen Bae I don’t see the CPI in the backup however, the backup that does have the impact for those positions that we just talked about they’re all in there. And outside of the hearing master, just the reclassing and giving up the part time for the two additions that would be a fiscal impact of $14,914.00 and that’s not the with the CPI increase. The CPI increases amount to $29,070 so with the existing positions and the reclass excluding the hearing master, the net impact is going to be $43,984. which has the 9.5% increase with bailiffs. We can’t afford the hearing master. Our overall budget is tentative, we’re already looking at, for judicial function, a 17% increase over previous years, so it is an area of concern. There has been some fiscal impact with the split and there’s been some positions that have been needed as a result of that of that reorg, and we accept that that happens. But in this case the hearing master is completely new. It’s a new paradigm that we’re considering, so I kind of would like to see that separated out and not used as the in the same context of budget, because that definitely was not budgeted for, even in the tentative.

So, Whitney, the hearing master position, what are their qualifications, what’s the criteria for a hearing master please? Whitney Richardson Judge Wanker sent me a job description that I emailed to Elona. A licensed attorney with at least 10 years of practice.

so, that’s the criteria for a judicial judge to be able to run an election. 10 years of being an attorney. So would it be unreasonable Mr. DA and Whitney and my colleagues here. Of course, I was too young at the time, but they had night court series at one time, so is that out of the question for two courtrooms? If we needed two more there would be 4 District Court judges. Is that a possibility? Da Kunzi you can’t dictate the time for when the courts run their calendar. There is that autonomy, so no you have to be careful of that. You know again we can’t control how the court operates, and you know I think what the court is doing in this particular instance is really in conformity with the way the Supreme Court has ordered anybody to deal with these types of issues to deal with the judiciary. We can’t control the judiciary, their function. We do have authority to block budgetary measures that we don’t have the capabilities of providing, but we just have to be careful with that, and we’re going to have to definitely be able to prove that, because the outcome of denying these things is going to create a petition to the Supreme Court. We may get an order from the Supreme Court making us do this.

my constituency goes to court and they have needs in the - - court. I don’t have any dog in this race, I don’t care, but I have met every DA, her, I’ve met with the judge, I’ve talked to people about all these things. My concern is that a vote no on this is a vote to create longer lines and longer wait times to put more stress on the legal operations of the county, so it just concerns me. I am pro public safety and all these things, I do believe the DA needs more office support, I believe that the courts need more support from us. I don’t know why we wait until we’re reprimanded by other agencies before we act. It’s embarrassing, it’s weird. I’ve never seen another body embrace that as much as I have seen here in the past, so I’d like to turn the page on that, but as far as the actual cost, we just spent $94,000 on the guy to fix machines in the in the motor pool. I think a vote no on this or a vote no on that division is a vote against efficiency in the court system and I think it’s bad for people who have to use the court system.

the BNG person for 94,000 was out of a different budget. This budget is Nye County and that was town of Pahrump, so my question of the Comptroller is can we use town of Pahrump money to fund this? Why not, this is a function that’s done for the town of Pahrump not for the greater Nye County. Because what we’re looking at is we’re losing $5.5 million in Nye County this year, looking at our beginning balance and our ending balance. In the town of Pahrump, with what we’ve spent just now, we’re ahead 500,000, so at any point if we can shift this to the town of Pahrump then we can afford it, otherwise we can’t. DA Kunzi actually from a legal standpoint, it is Nye County. The one concern I have and just devil’s advocate here what’s your ending fund balance? for the county it’s 5.5 Helen Bae can I just add that I did mention before that we had set aside $1,000,000 in contingency, and that does happen some years. we do dip into contingency because we do have extra personnel costs, it usually is as a result of CBA’s and negotiations and things that come up such as retro pay for the NC MEA, so if we take it to that I just know that in order for us to maintain our ending fund balance of 5.8, that does not include the contingency so you would just be basically lowering your contingency amount and using some of that for the known position. Manager Waggoner -so would this be a representative position that this hearing officer is one question and secondly, is there a reason why it couldn’t be a contracted employee instead of a one that receives benefits and PERS and everything else that ends up costing us forever. You control their budget, not their function, so if the judges want to create this hearing master position, it’s not really our position to be able to tell them how to do that. It’s just whether or not you’ve gotten financial capabilities to pay for it. So again, the fine line that we run into is that we can’t control the court operations, how they operate, only what we pay for without controlling how the court operates.

I support this, taking care of law enforcement and courts. As we increase court and police activity, funds do come from this. My concern is that you have so many people who come from other places. We don’t have enough of everything here, and when you have that then you can pay for some of the things that we need, but right now there’s a need, so all I’m doing is just expressing support overall for law enforcement, for courts, for staffing. I don’t think we have enough staffing and all these areas. So, I would really like to improve with law enforcement patrols, courts staffing and making sure that we can prevent terrible crimes happening in our community. People are suffering, there’s crime out there, so I’d be all for this

We’d love to say yes and of course when we first started this morning I said let’s just say yes. Is there anything that the judge mentioned in his presentation, any position at all, that you can still effectively function without, to help us with the budget? Or is everything absolutely necessary to move forward. Alisa Shoults I’m honestly going to say 100%. Everything that we need is what we need. My staff is definitely overworked. Everybody’s got piles on their desk, the civil clerk’s mail, she’s out for a week, the mail that she comes back to is at least as tall as this lectern right here, and that’s one week’s worth of mail. That doesn’t count the electronic filings that come in through E-Flex, so I would definitely say the reclassifications 100% we need, and I would definitely need support staff for her. Realistically yes, we need all the positions that we’re asking for. Could we make it work? I mean we’ve been making it work for the last 23 years that I’ve been here, but realistically the numbers are going to keep growing, the crime rate in the town keeps growing. The duties that everybody is doing are just going to keep getting worse.

I appreciate your candid answer. I mean what happens if crime does go down miraculously, what are we going to do? DA Kunzi What’s interesting about their numbers is that one of the policy changes I made was that previously they had always wanted us to file when we had a misdemeanor on a felony, to file 2 separate cases, and to their dismay I’ve said no. We’re not doing that; we’re filing one case because it’s usually related. So, the reality is there a number that they’re citing is actually an understatement given the fact that some of their previous numbers would have been basically 2 complaints that are now being done by 1 complaint. So, it is kind of an indication of the loads that have increased over the last couple of years and unfortunately, it’s not getting any slower.

Thank you commissioner, I appreciate that. And yes, I’m well aware of their workload and what they do on a daily basis. Many times, because they’re behind in a secure area, the general public doesn’t realize what their workload actually is, and as I had mentioned previously on another item, our judge that’s standing here before us actually serves as the court hearing master as well as her other responsibilities. This is a great burden on the judge and her staff and the bailiff in Tonopah, so I certainly appreciate that. I’ll make a motion to approve as written.

Comptroller, can this come out of Pahrump Town only? Helen Bae Pahrump town covers 60% of staff costs and services supplies. One thing we did for this budget that wasn’t done prior was clean up Kristi’s budget. Because she had budgets in three different places from the legacy structure of having animal control and animal shelter and then on the Pahrump side she had animal shelter. In consolidating, it became obvious that we when we moved animal control from Sheriffs Office we actually did not correctly do the costing to charge 60% to the Pahrump animal control officer, so there was a savings realized instantaneously that we had not previously considered. This is why our tentative budget for Animal Services is about $300,000 less than what we have been charging to the Nye County side. We already ApriL 9, 2025 22. For Possible Action Discussion and deliberation to: a. Approve or reject eliminating the Part-time Animal Control Officer position and reallocating funds to one Animal Services Office Assistant. and two Kennel Assistants; and b. Fund 40% from 10101 General Fund and 60% from 25101 Town of Pahrump, General Fund. Cont... have instant savings through our recognition of this administrative error. Her request has a $60,000 impact to the Nye County general fund, but as I mentioned we have already dropped down to 300,000 so she’s fine.

Why did we reinstate it if we couldn’t find something for that board to work with in the north at the Carvers Arena? I don’t know what that number is, but we’ve been saying yes, they’ve been pleading with us. Yes, they received the grant and that’s wonderful. I’m certain that they are still in search of other grants. But we’re obligated to find something to help and assist with. In it, itstatedthatPersorinetcosts make up about80% of totaLgeneralfund expenses, and in the next flscalyear which starts in JuLy 2025, those costs wilt increase by about 8.2% between saLaries and benefits. The increases are the result of rapidly rising mandated retirementsystem contributions, new collective bargaining agreements and the county’s updated pay structure. Employee saLaries aren’t the only part of personnel costs that are ratcheting up pressure on the county’s finances. The Nevada PERS Retirement board in December notified the county of increases to county-paid retirement costs that will have a net impact of $5- $6 million annually for Washoe County. Has this happened here? For those of you keeping score, Washoe County’s contributions for regular employees will increase by more than 3% to 36.75%, and contributions for police and fire empLoyees will increase by 8.75% up to 58.75%. In the case of police and fire, it would cost the county nearly $60,000 in PERS contributions annually for someone making a $100,000 salary. These are staggering and significant increases to PERS. It’s unsustainable to have the benefits for employees exceed the pay by such a large percentage. In essence, by the time an employee retires from ajob and starts receiving their retirement benefits, and then that emp’oyee is replaced by a new employee receiving even higher benefits and pay, the cost for each job positiOn is putting counties in Nevada in a no-win situation from their budgetary needs. Nye County has personnel costs of about 63% of the budget. Welt over half of the revenues go to personnel costs. In some cases, “reclassifying” staff in order to increase pay seems to circumvent the pay steps in a category. In short, it’s an easy way to get a raise that the county may not be able to afford, especially in the future. In looking at the various department needs and requests ahead, I hope you are paying close attention to the future costs of adding staff, incl.uding a potentially unsustainable retirement fund. Exhibit 1 We can understand the need for additional employees in certain cases, but each addition comes with a current cost AND a future cost.
