I’ve been here 27 years and those who have been here and lived through our last town board debacle know how expensive that was for the taxpayers of Nye County. Secondly, Michelle Fiore is an elected official. We have nothing to do with whether she is or is not on the bench. We did not remove her from the bench. Again, she is elected. Nor can we replace her on the bench. That is up to the Judicial Ethics Commission. The next item is halfway houses. The legislature and the governor have required Nye County, in the last several years, to allow halfway houses here. What that means is that a halfway house gets funding from the government or however they get it per person. The people they house can come from all over the place. When a person breaks the rules of the halfway house, they will put them on the street. Not back to where they came from but on our street. This is not an issue of having a problem with homeless, this is an issue of the problem growing in a large way, so we need to try to figure some way on that. The last thing is roughly 50 years ago Preferred Equities Corporation came into Nye County, deceived everybody by selling land that had zero infrastructure and the cost to provide infrastructure or water or sewer to any of these lots has been upwards of $500,000 on a quarter acre lot. | would love to see people be able to use their land that they own and pay taxes on. The trick is going to be to find out how to cover the massive costs of the infrastructure where it needs to be. Samantha Tackett- There was a request for a presentation to be provided during the commissioners/managers’ comments. Advised that the presentation will be limited to a verbal presentation and we will not be able to show any slides as requested. Chief Lewis- | want to remind everyone that beginning May 15" the burn moratorium will be in effect in the town of Pahrump. We've recently had some fires that occurred at the hands of others, and we are taking that seriously and are going to vigorously enforce the laws and the PTOs that are applicable to these illegal unauthorized burns. The slide presentation was going to show 3 slides of a recent fire that resulted in an arrest. The RP was able to give a great description that led the Sheriffs Office to the suspect in a quick nature. Reminder that we're going to be vigorously enforcing our PTO on unauthorized controlled burn no matter where they are in the valley. Comptroller- We have set our final budget-hearing for May 22"4, The notice will be published in the Pahrump Valley times this Friday as required by state. It will be in chambers, and this is where we will hear the final budgets for Nye County, Town of Pahrump, Beatty and Gabbs, as well as the Pahrump Pool District. Christy Siegmund- Thanks to the county manager and assistant county manager for supporting to me and my team in an emergency that | had. The team was amazing, and | give kudos to them as well. | was proud that they ali stepped up in a very stressful time. | want to remind everybody about the Bissel Empty the Shelter event. We have 10 days left. It ends on May 15. We have already seen 10 adoptions. We have 70 dogs and 11 cats available for adoption in our shelter. If you are looking for a new family member please come down to the shelter and see what we have. We are seeing an uptick in coyotes, bobcats and mountain lions. If you see one, please contact the Nevada Department of Wildlife. Animal Control is happy to assist in making sure that people and animals are safe but that is their jurisdiction. It is their call on how they are going to handie that situation because that is wildlife.

Direction to staff to fix the timing on the traffic lignt at Homestead. Director Bolling- We had that signal retimed to NDOTs current standard timing. We are more than happy to have an engineering fire redevelop the timing sequence. We will have to go to NDOT for approval of that and then we will be able to retime it.

You were copied on the email with from NDOT to Nye County. They are putting it on Nye County to take care of this, even though 160 and Homestead is the state highway. Let's try to get this taken care of as quickly as possible. | think we already have NDOTs approval. Director Bolling- According to the email she explains that we are required to do the signal timing for these intersections and are still required to follow their standards. She is giving us her approval for it, but we will want to get with them after development of the timing to get their approval for it.

8. For Possible Action — Discussion and deliberation to approve a Retail Liquor

This is an application for a retail liquor license in Beatty. We completed a background investigation on all individuals involved. There was some criminal history that was old and should be in your backup. In my review of the application, it was my recommendation to approve the license.

presented Nye County Proclamation P2025-05: A Proclamation Honoring the Recovery Effort of the Missing Pilot and Aircraft in Nye County.

presented each first responder with a copy of the proclamation and thanked them for going above and beyond during the recovery effort. For Possible Action — Discussion and deliberation to appoint a person from the panel of substitute justices of the peace pursuant to NRS 4.340 as a justice of the peace to attend to his or her official duties from the following list_of persons: Michael Foley, Eric Murphy, and Philip Bovee. A temporary vacancy from absence, disability or other cause must not be filled by another justice of the peace or a substitute justice of the peace for more than 30 days at any one time.

This is ordinance will stop camping on public lands and public areas. It will allow us to clean up camps, tents and garbage in public areas. This ordinance will stop the obstruction of sidewalks and public areas with camping gear, personal belongings and people setting up to sleep in public areas. | have copied this from the Clark County code where it was enacted after the Supreme Court of the United States made it permissible for local jurisdictions to ban camping in public places. Our District Attorney’s office has gone over this and made some revisions. | urge my colleagues on this board for passage.

As some members of the public have said this has been going on forever and it's probably going to keep going on forever unfortunately. One of the problems | think we have, and the Sheriff spoke on it a few meetings ago, if the guy's laid out on the sidewalk in front of Albertsons and you call the police of because you want the guy to get moved, he really doesn't have anything to move them for. This will allow that to happen. Hopefully they will treat it gently and not jail everybody that is lying on the sidewalk because that will end up costing money, but we need a way to be able to legally tell this guy you can't lie there anymore. And | know he'll get up from in front of Albertsons and move to Walmart or go the other way and it's just a jumping game, but we must do something, and | think this will help and it's worth a try. I'd like to make a motion to adopt.

Thank you Commissioner Bayne for bringing this forward. | don't disagree with Ms. Borysewich, however, the reason why they are there is not on the agenda. If we went to pages 5 and 6 of what the commissioner has put together as back up, | have one concern that | would appreciate his consideration for a change. Under Board of County Commissioners Minutes — 05/06/2025 Page 14 of 36 9. 10:00 a.m. — For Possible Action — Public Hearing, discussion and deliberation to adopt, amend and adopt, or reject Town of Pahrump Bill No. 2025-01: Cont... enforcement 25-5 on page 6, at the top, under number 2, directing the person engaged in prohibited conduct that they have 24 hours to vacate the location, | am opposed to. | believe that if law enforcement is called to a scene and they are engaged in conversation with somebody or plural they need to move immediately, not 24 hours later, where the deputies have to, and it would probably be a different deputy or plural, return to the same scene for the same situation. | based this on whether there was any trespassing under NRS 207.200, under the trespass law, they must leave the premises. If they return, at that time is when law enforcement would be able to take action for them violating the trespass law. This was my only change for consideration is that it's done immediately and not 24 hours later.

| would like to ask if the DA would be willing to answer if it would be permissible to strike section 25-5 A2 if he saw any legal concerns. DA Kunzi - My concern is that the way this is written, they have to be put on notice that they're in violation. | think the suggestion from the commissioner as far as you want them to move immediately, if they don't move immediately, then they would be in violation but without some type of time period in there you're not going to be able to define that they're in violation.

Could you shorten it to three hours, four hours or a one-hour time period?

Direct the person engaged in the prohibited conduct that they need to vacate the location immediately. DA Kunzi - That unfortunately is too ambiguous. Criminal provisions need to be very specific. You said need.

| have some simple changes. Let's go to page 4. The word tarps, under temporary shelter, is has been used twice. We only need it once. It's clerical. We're on page 4, the top of the page says personal property means an item that is, within the body, mid-page, it says temporary shelter meaning tents, tarps, huts, lean-tos, tarps, Board of County Commissioners Minutes — 05/06/2025 Page 15 of 36 9. 10:00 a.m. — For Possible Action — Public Hearing, discussion and deliberation to adopt, amend and adopt, or reject Town of Pahrump Bill No. 2025-01: Cont... cardboard boxes. We need to eliminate one of the tarps. Just above 25.3 camping prohibits temporary shelter. Finally, this one's kind of different, as you know we are conducting a joint meeting as the governing body of the Unincorporated Town of Pahrump and we're looking at a document that is a Pahrump town ordinance so within the body of this, on Page Six, it says under B-4, the conduct is in conformity with the conditions of a permit issued by the Town of Pahrump. Then it says, again, under section 25-3 camping B, should the special events camp or temporary shelter violate any terms set forward by the permit issued by the Town of Pahrump, then it says under page 4 25-3 camping under B exceptions under 2, the Board may issue a special events permit and if you turn to the definitions of Board, which is on Page 3, under definitions, it says Board means the Nye County Board of County Commissioners. | believe that is incorrect. Board would need to be the Unincorporated Town of Pahrump. That is my suggestion.

25-2 under definitions is the only thing that | see that needs to change to be consistent. Under the definition of board means the Nye County Board of County Commissioners, when in fact it should read the Unincorporated Town of Pahrump or just the Town of Pahrump. County Manager- | think that the way it is written is correct because | think it's referring to an event that would allow camping in the park, which event permits are issued by the county commissioners.

OK so then our inconsistency would be this. The inconsistency would be on page 4, which | read, that said the Board shall issue a special events permit. You would be correct, the board would be issuing the special events permit, being the Board of County Commissioners, but then in two other spaces it says by the permit issued by the Town. So, do you need to change one or the other?

It would be a simple fix to define board the Nye County Board of County Commissioners. Acting as.

Mr. DA, would it be acceptable to change the language to anytime it refers to Board that the Board will be either the Town Board or the County Board, whichever is permissible in the current circumstance? DA Kunzi - We would need to incorporate that into the definition of board then.

Samantha Tackett- | was hoping that Commissioner Strickland could identify the sections and subsections where she's referring to the town as issuing a permit because we might be talking about two separate things here. One is that permitted overnight camping, such as an event like the Pow Wow or others, where the town would issue a permit to camp there as well as the county issuing an outdoor festival permit. So, there's two different things we might be talking about here.

| so agree Sam and then once again I'll state, | would like to see the change the Nye County Board of County Commissioners acting as the governing Unincorporated Town of Pahrump, or should that be an or because see, they are both acting at the same time whether it be the Board of County Commissioners and a large event permit or the Town of Pahrump and a small events permit. DA Kunzi- That's why |'m recommending that just leave it the board means the Nye County Board of County Commissioners or the board, the Town Board.

Here's another reason for this and | put a little bit when writing this. | always look to the future. Someone could change that rule so, in five years someone could decide that some other entity is going to issue these. If we write it as such, as the DA recommended, then we're covering ourselves in the event that something else changes. This is why our state laws are sloppy because they'll change one thing, and they won't change it somewhere else. | think that if we do that, | believe, and as long as the commissioners find that acceptable, we could just change the definitions to be whichever is applicable, either Town Board, County Board, or | would even put or other government entity which with the authority. That's what | would do.

You could just put or. You could just put applicable board and let them figure it out. If Tom succeeds with what he’s trying to do, you're going have a different board issuing permits than what we have today.

So Samantha Tackett, DA and chair or commissioner, would we be satisfied that the DAs office could clean this up to our satisfaction and take into consideration all things that have been discussed at this point? DA Kunzi- No, you need to vote on it. We need to have clarity.

Specifically we would say you know County Commission and. Would that satisfy Sam? DA Kunzi- | would not say and. | would say or. So, you know, basically say Nye County Board of County Commissioners or the Town of Pahrump. These changes need to be incorporated in a motion. DA Kunzi- Could | make one comment? | just want to make sure that everybody's clear that, | understand that, and of course this comes from Nye County, | mean from Clark County, but | just want to make sure that they're clear here on the enforcement part. It talks about citations or arrests that may be issued by an authorized person. When you look at the definition of an authorized person it includes people who are not peace officers. They cannot arrest anybody.

Can you direct us to that please? DA Kunzi- It's on page 6. It would be section 25 5 subparagraph 3 talks about that so if this person leaves then they can issue a citation. It says arrest or citation pursuant to this chapter. When you look back at the authorized officer on Page 3 definition 25.2 says an authorized officer means any peace officer, fire inspector, code compliance officer, or other officers, inspectors and employees. The only people there who have the right to arrest somebody would be the Sheriff's Office, a peace officer. I'm a little concerned about the language that talks about that anybody, you know authorized person, can issue a citation or an arrest. We need to be very clear that that's not giving a grant to people that don't have the powers of a peace officer and I'm afraid that some people may think that they might have that authority. I'm not sure how we really fix it but that is a concern of mine.

So how would you incorporate that into the commissioner's motion when he's ready? Manager Waggoner- | think what's being implied is that a code compliance, or park Ranger, or whatever has the authority to do one of these things. | don't think it's saying that the authorized person has all the authorities. It has a peace officer in there and it has other individuals, but | don't necessarily think it's giving permission for any of those, in that definition, to be able to carry out all of these different options here, meaning the arrest, the citation and all that. | don't know how you would clean that up. Here's my suggestion, is what we do is add to the 25-5 3 as authorized by law.

With all due respect that may be defeating the purpose. If we can go back to 25-2, under definitions, Mr. DA would it be acceptable to put authorized, under definition, authorized officer means peace officer. We end it there and we keep not striking #3 as suggested.

Yes. Well, if you do that, | mean a police officer is charged with the enforcement of the town, so it really is unnecessary. Unless they're a category 3 peace officer and then they're in a jail somewhere but peace officer would do that.

Only because on page 6 under number 25-5 number 3, that refers back to the peace officer issuing the citation or arrest and it's very clear.

We can read those changes. | believe we have to read them. Let me do them if you're okay with that Commissioner. I'm sorry, is it okay to do them because | think they want to read in. You want to read Mr. DA? Thank you. Motion move to approve item 9 as amended by 1: striking 25-5-A2, number 2: changing the definitions so that the Board means either a Town Board or County Board, number 3: striking 25-5 A3, and number 4: under 25-2 definitions strike all of the positions after peace officer, leaving peace officer intact, and then pick back up at charged with enforcement through to the end of that sentence.

| agree with you. | struck that whole section so it is, | would say, implied. It's just like any other crime. If that's acceptable to the Commissioner. | just took that entire section out so there's no question about any prohibition on peace officers. And that is part of the motion.

Mr. DA please before | amend my second. Mr. DA, by striking that information we know what we're talking about right now but once it's cleaned up and that number 2 is eliminated, | don't think that it's very clear for peace officers that they realize they have the authority to state that the individual or individuals must vacate immediately. DA Kunzi- | agree with you Commissioner because again | think you need to have something that's very definitive as defining what the violation is.

I'll amend my amendment to number 2 which was 25-5 A. I'm sorry. My number one that | had said: 25-5 A2 instead of striking we're going to remove 24 and 24 hours and replace with, remove that, and then vacate the location and then add the word immediately after it. Award Bid No. TOP 2025-01 to Double M Construction in the amount of $3,584,791.05, Rafael Construction in the amount of $3,393,177.00, Shaw- Lundquist Associates in the amount of $2,720,614.00, or Top Rank Builders in the amount of $1,810,510.00; c. Approve or amend and approve the contract with selected bidder; d. Fund to 25235 PSST and 25401 Pahrump Capital at the discretion of the Comptroller; or e. Reject bids and provide direction to staff on how to proceed with the project. Scott Lewis, Fire Chief Town of Pahrump - Jimmy and | will be Co presenting from each of our other respective locations. Honey is unavailable to us today, she is out, and so Jimmy, if you don't mind, I'll take the lead. commissioners in front of you is TOP 2025-01, is the Kellogg fire station #3 and expansion project, which adds an apparatus Bay which is identical to that of station #4, which was completed at Bella Vista and Barney. The town of Pahrump currently owns the steel building. This is for erecting and providing the utilities and other things as described in the specs that were presented by Jimmy and his group as part of the town of Pahrump buildings and grounds. We respectfully request that the fire station #3 project be awarded today. it would be located on the South end of the town of Pahrump, at the intersection of Kellogg and Squaw Valley. The current facility is undersized for its current use. This is a project that's been underway for several years. This is a project that is extremely important to our expansion model program, including Board of County Commissioners Minutes — 05/06/2025 Page 21 of 36 10. For Possible Action — Discussion and deliberation to: a. Discuss the proposals received for Bid No. TOP 2025-01 Kellogg Fire Station No. 3; Cont... placing the right equipment and right apparatus in the right facilities in order to have a better response for our south citizens. The award time is sensitive due to the potential rising cost to operational and equipment placement and the bid requirements. The process has been completed, the attorney review process has been completed, the funds are available, we're requesting award of the bid.

| certainly appreciate these groups coming in and they're obviously qualified bidders, but | have a concern that our bidder that is about to be awarded is significantly lower than the other. If we're all good and respectful, | would also add to be amended please, with no change orders. This is significantly lower than the than the other bidders and | really don't want to see any change orders come through.

| would just like to make a comment on that. if you read through the narrative, it says the bid from Top Rank builder. It was bid from the scope given and the other bidders bid outside of the scope, adding items not requested, which is the reason for the additional cost.

That's great and then for the record, on the record, | appreciate that commissioner reading that. So, if any change orders come through, I'll bring that up

roads in Nye County or bad and in need of repair. we have millions of dollars in a fund that can be used for Rd. repair. This item just allocates $1 million out of this fund for road. repair. This item does not raise taxes; this item only goes towards fixing our roads with money we already have that is unused. There is also a specific area of road in front of the library that I've been told of, that the cost approximately $20,000 to fix, and | would hope that some of this could go towards that.

Without hiring people. Director Bolling - we would not be able to hire people using the $1,000,000. It’s just a onetime infusion of dollars; we have to have rollover dollars in order to be able to hire people. The road report you saw earlier today, all of the roads that we have been fixing and are what we plan on doing this calendar year that will definitely go towards that portion of it, to help with that portion of it. Some of the dollars we would need to accomplish what we want to accomplish with the chip seal program; we're going to have to go to slurry seals and other kind of maintenance program. Engineering for the replacement and redoing roadways is one of the shortfalls that we're having currently. We either dedicate money towards maintenance or we dedicate money towards engineering to be able to redo the roads. Either way we still have to have money. After | read the item, because | just learned about this last week, it kind of hit me in the face. We will definitely put the money to good use, and it will go towards the roads pretty much 100%,

so this is the big discussion. We've always talked about how we need more money for roads. | get that. but normally we have a plan, we don't just throw a figure out there. This normally would go through the RTC to make a determination where the money would be spent, and | don't see that action has taken place. You say you've got a list, and | appreciate that. RTC board members, that's the job. Are you telling me now that you're going to go by that list? Because | need specifics. | don't want to just throw $1,000,000 at the road department when we don't have a plan. Which one are you going to execute with this money? in most places in government what happens is you have a department head, and you pass a law, and you appropriate money. Because we share an executive role here, it clouds things a little bit, and people have kind of the heavy hand that they want to micromanage. I’m not a micromanager. | trust the department head. So, from my perspective, as a legislator, you say we're going to give $1,000,000 to this person we trust. We paid a lot of money to do his job, and he has a team of people and a staff and that's all he does. | don't believe anyone up here could possibly come up with a plan that's better than this man who's a department head who's been doing this professionally. if you want to do the job, maybe whoever wants to do the job could become the department head. I'd say we have virtually no plans of expanding, or taking extra money that's sitting unused and put it towards things that people desperately want and need in this community. If there's one thing I've heard more than anything else in the three months I've been here, it's the roads and the infrastructure. | haven't always agreed with this department but just give him the tools that he needs to be successful. to sit up here and grill him and look for a perfect plan, that never going happen. we're never going to get a perfect plan, so we can do nothing and be frozen, sitting there and waiting to spend it on something else, or we can just give the man the money and let him do his job.

we did not. There are patrol cars and then there are detective cars. This is a $60,000 appropriation for detective cars for the Sheriffs Office. Our detectives drive cars with very high mileage, they're incapable of keeping up with criminals should they have to engage them. | have visited our mechanics here in the county and watched them at the time | walked in there, about 6 or 7 police cars sitting there being worked on. | have spoken with our detectives about this. Both tell the same story that the new they need new cars and cars that are dependable. Another concern is that when criminals know that detectives have specific cars or the cars that can't keep up well, they won't accommodate and be successful criminals. The $60,000 | believe is modest appropriation will allow detectives to literally, if they want, of course it's a sheriffs discretion, going they could according to the controller go on just to go on CarMax and just purchase cars so there’s no bureaucracy or red tape that needs to be done. They could purchase one or two cars or whatever they want to purchase. So, | urge passage so that our detectives can finally have the equipment they need to properly fight crime.

so when this was presented to me, maybe that item fell through, we were talking about the administration cars that are carpool cars. And to be honest $60,000 | think would go a lot further than going out and buying cars. My response when it was presented to me was, as long as the cars are worth having, I'd love to have it because more than likely the carpool cars that are here at admin, they although they may have a couple of years on them, they probably don't have a lot of miles on them.

As a small business owner that owns family practice, mental health, and a chiropractic group all in Pahrump, | think it's important to note that in the last five years we saw 83,000 family practice visits under our direction and 19,634 behavioral health visits. All of this is done through showing up a long time ago and starting a small business. As a lot of people know, family practice keeps on having reimbursements decreased, and getting providers to rural areas is very difficult. Over the past eight years I've spent hundreds of thousands of dollars getting recruiters to bring providers to Pahrump to serve the community, because | do love practicing in Nye County. | think it's important to note that last year we had approximately 47 employees, 90% of them lived in Pahrump at the time of providing service for the community. There’s been a decision to approve Vista medical, and my opinion is just that we do the same research that we did for the liquor license and the people. Vista Medical has a history in other states of not following through and following the rules, and | just think that this contract is very big. It brings the opportunity to maintain providers in the community that live in the community and going away from groups that are going to try and bring other people in to give us services. often whenever it comes to the healthcare | feel like we're just kind of missing that boat, that there's a lot of us that are smaller groups that are really trying hard to stay in Pahrump. We don't get paid an extra for having to be in a smaller community. We're here because we want to be. Thank you all for your hard work. | know | feel passionate about this one item and how much work went into it for me. | don't know is the individual Mohammed Irfan Mirza here in the audience, or no? he's not in the audience. | had some concerns, and I'll bring them up. these are lawsuits this man has been involved in the last nine years. His licensed to practice medicine in Arizona, California and New Jersey is currently suspended. | was going to ask where he went to medical school. | believe it's Pakistan, not that that matters but it is important to understand who people are giving these contracts to. | was also going to ask, | guess | wouldn't show if | was him either, about his praise on probation. looks like he has supervisors and | and my concern is now we're bringing in the supervisors. | don't know how that affects the contract, because | believe he has he consigned signed a consent agreement that said in order to maintain here, and | don't know, but the question is, does he have these supervisors that are mandatory. That’s a concern | have testimony here from a 2016 divorce proceeding Mr. Mirza, where he says at one point that he sees up to 12 to 15 patients a day and then later on admitted to seeing three dozen patients a day. Now | don't know how you can confuse that but it’s concerning me. | also want to read into the record here, and this is all public documents, this is a divorce proceeding 2016 California he says, and this is in his testimony, people in my practice people there who will read the contracts, they will tell me that there is nothing objectionable or object. They are a local group that's providing the medical services. Again, yes, they are licensed to practice in Nevada.

You then have the complaints from the state of Nevada filed August 24th, 2018. the complaint resulted in a settlement where | believe, he's not here to answer, | believe he said, “Look, | will make sure these people supervise my work. That’s what | believe. | unfortunately have a lot of experience all kinds of people in my office handled by the same sorts of people as far as licensure issues, and it's not an automatic. It’s a separate hearing. All 1 can say is that seven years ago suspended license Arizona, suspended license in New Jersey, suspended license. | mean if we can't find a Dr who hasn't had her license suspended in the last 10 years, | think we need to do a better job looking, that's just my opinion.

When the first complaint was made against me to code compliance in 2022, | was told the reports are made anonymous. When | had my trial & pointed out to the judge that | had a constitutional right to confront my accuser, that Mark did not produce. That was part of the reason the judge told code compliance to fix the situation. Now that | have been trying to get this county to change our codes & procedure they have no problem telling everyone that I filed the complaints. | am okay with that | have my big girl panties on &| can handle the backlash. But it does show that the building department is just as corrupt as our county commissioners. The reason i make this statement is 1 have filed complaints against 5 businesses but one of those businesses because of who their friends are, doesn’t have to follow the same rules as the others, even though they are the same type of business. {do uicerstaid that some rescues if they fite certain paperwork & certificates don’t need a town of Pahrump Business ticense. But not having a Conditional Use Permit especially when holding or housing animals on their property is absurd, not fair & defiantly not equal. We have another one of those businesses telling everyone how much Mark loves her & that she has done nothing wrong & it’s all my fault what she is going through right now. If this is true | plan on giving those screen shots to my friend, my family, my vet that she murdered, to his lawyer who is pursuing charges against her. | have already filled a thumb drive with all her statements, screenshots, w2, tax returns & anything else that was forward to me about her. In my statement to that lawyer, 1 did name our building, code compliance, planning commission, county commissioners along w/our sheriff's department as people who had hand in this tragedy & they should be held accountable. | Know she is applying for her town -of Panrump ticense & C.U-P -but i strongly feel that should be put on hold while she is under investigation for his murder.
