Gives an update regarding the agenda minutes. Gives a big shout out to Celeste Sandoval and Amy Dowers who helped immensely and thank you to management for understanding. DA Kunzi — | don't interrupt the meeting unless to avoid a violation of the open meeting law and | believe that's part of my duties as this attorney to keep this board out of trouble. What the public needs to understand, what a great job the animal shelter is doing, and my office has been very involved in this. | was meeting with our new executive director of the DA's association, and she was here, and we were talking, and we happen to go over to the clinic, and they had a very malnourished and sad-looking dog, but | had some treats and that woke him up and he got very friendly. At the end of the day the executive director went over and adopted that dog. The shelter is doing a great job and it's amazing to see those adoptions. | encourage the public to really think about going over there and then you can find some amazing animals that become great companions. | did my own adoption about 3 or 4 weeks ago. | want the public to really appreciate that and see what's going on over there and that's a great thing. Kristi Siegmund- It seems as if every animal that they take for walks gets adopted. We really appreciate his team in the DA’s office and the IT team and other departments within Nye County coming and taking these animals. We look forward to the next event since we still have 114 animals in our shelter righynow. | want to give a huge thank you to our veterinary community for the last month. They have banded together and helped ensure that every single one of our animals is sterilized. | also want to give a shout out to Central Nevada Hardware up in Tonopah as well as the rest of the Tonopah community, the assistance and support that come from that community and Commissioner Jabbour is incredible. | just want you and everybody else o A reminder to the rest of the community when you find an animai running at large the first call you should make is to the Animal Services, whether that's the shelter, whether that is the animal control, it all comes through that animal as running at large. Report that you have the animal and animal control officer can pick up that animal or you can bring it to the shelter, whichever is most convenient for you. Facebook is a phenomenal tool but not everybody is on Facebook, and not everybody is on each of those pages, so reporting is the fastest way to make sure that we know. We can get a photo and hopefully reunite the animal with its owner. When you microchip your animal, it is an electronic registration, so you are licensing your animal electronically with every single microchip. If the individual is 18 years of age they can absolutely come and volunteer in our shelter and yes it does count towards community service, and we would love the extra help. About Drag'n Ass Rescue and Sanctuary, they have been on our radar for over a month. We are working with our state officer as well as code compliance. About the wild horses, that fall under NDOT and Nevada Department of Wildlife’s jurisdiction animal control is always here to assist regardless of where it falls under to make sure that people and animals are protected. Scott Lewis- | want to remind everyone that the burn moratorium is in place and in effect. From the 15th through November 1° it is for everyone's safety that we don't conduct unauthorized controlled burns. The significant incidents that have occurred, | will tell you that one of those was from an unauthorized controlled burn that burned almost 15 automobiles. Also had a significant structure fire on Manse Rd., both of those were wind driven conditions, heavy fuel loads and as always during the course of those emergencies they also had to manage sub incidents that were occurring throughout the valley. Great job to everyone including Armargosa who came in and assisted at the large structure fire. Investigations are underway and the semi-truck fires that have occurred on 95 over the last several days do not involve lithium ion. Manager Waggoner- I'm speaking as a taxpayer and as a former planning director, it's not up to the taxpayers of this whole entire county to pay for the lack of due diligence in purchasing properties. There is a procedure that's spelled out in the code, for not only a code amendment to get a different zoning classification adopted, but also for the zone change process, which includes this board. As far as the fees, that isn’t something the county sponsors without an item being brought to this board asking for the fees to be waived. The county, the town of Pahrump, does not provide the utilities. They're all private companies, and you got to work with the private companies in order to find out what it would cost to provide those utilities to those parcels. | have confirmed with code compliance that there are 2 open code compliance cases currently on that Drag’ Ass Rescue and Sanctuary property so they are aware, and they are addressing it. The room tax audit that this board approved the expenditure for and that has been underway, and my understanding is nearing its completion so we will be having the results of that.

| just got back from North Carolina for anyone who cares, seeing my new great grandson. There was a comment about us fidgeting up here. if anyone thinks | fidget you're wrong. | take papers full of notes and keep slipping in the chair. | try not to make comment to anybody else, but sometimes | have to get up and walk out in the middle of the meeting because I'm 83 years old, and when | have to go, | have to go. As far as zombie lots are concerned, | have to agree with our county manager. if you don't do your due diligence things happen.

| think | too am related to someone in the DA's office, it's one of the newly adopted dogs. | want to wish everybody a good morning and safe and meaningful Memorial Day weekend. Thank the Chief for the update in regard to teamwork from Amargosa from Beatty to help and assist Pahrump and vice versa. When this board approved special apparatus for Amargosa, it was very expensive, and one of the things that | said was this is a beautiful piece of machinery that will help and assist during emergency situations and will not sit in their garage as a museum piece. | close the meetings with protect your children and conserve water and | used to say spay and neuter your pets, but | guess that was such a bad thing for me to say to people because they thought | was | was insisting or demanding. Now | say seal your driveways and chip your pets. | would like to clarify and give a little more detail on the issue on the ballot with the diesel usage fuel tax. The majority of the people said no we do not want this additional tax. There’s a fuel tax that if you have a diesel vehicle you pay that $0.05 per gallon, if you don't have a diesel vehicle you don't pay that tax. | said, as well as the other commissioners, yes, it's now before us and we can reverse what the people voted on, but we were elected by you, we respect you, and we respected the vote, whether we agreed with it or not.

I'd like to speak about the issues regarding the horses and burros. | worked with volunteers, and we strung 6 miles of fence on weekends. The only answer to this problem is to remove the animals from the valley fioor and on the other side of the fencing. We need seven of them and then we can pursue the horses being taken out from where people can get hurt and accidents can occur. The thing is they're not wild. when you put them in a fenced area and they become domesticated. This community needs to maintain wild horses for viewing and seeing how beautiful they are, but they need to be maintained by the Bureau of Land Management. It’s a big question. Because in Fallon they have eight people working just to feed and maintain those animals and six of them left, so two people that are left work for BLM to do that and the rest is being done by volunteers. As far as the discovery park Nye County doesn't own discovery park it's owned by Great Basin Water Company. | can't support putting horses in an area fenced for people to go and look at that makes them domesticated. Can we please stick with the rhetoric of their wild animals no different than deer and other wild animals that exist that get hit by cars and vehicles. We need to leave them alone, hands off, and let them remain wild. Thank you.

It was mentioned about the fidgeting and the bathroom breaks and my job is to run these meetings as efficiently as we can. So, if that means we take turns with a potty break every now and then in order so that you guys and staff do not have to sit here 14 hours a day, that's what we're going to do. Regarding the town board and my opposition to the fact that the last time we had it was an absolute joke, and it cost the county and the taxpayers a lot of money. My last comment is about Mexico and the only thing flourishing in Mexico is the cartel and crime.

| would like to say that up in the north | manage billboards and billooards work. I've heard the story from the Wolfenstein family that there was nothing to build on that side of the highway when Pahrump was being developed. You can't grow anything over there on that side, but he bought the property and put up billboards and billboards are revenue generating. We were screaming for these fireworks companies to comply year after year letter after letter about things that needed to be fenced off of property legally to comply with code and regulations. They moved and we approved them to move up on the South end of the highway and now it's before us to remove the billboard. | agree it needs to be painted it needs some freshness but it's advertising by iocal companies. These are local companies that are being advertised and here we're being asked to interfere with somebody's business, of course its revenue generating. Compared to every other billboard that has steel that looks beautiful it is like a rusty brown color that's the only difference that | see. | didn't see a state permit number which is $50 dollars annual fee. Is the intention to have every single one of these steel structures removed when they were professionally erected compared to the shabby wooden billboards that are illegally there. I'm shocked that this is before us and that you're not being allowed to keep this billboard on that property.

If we're going to have a rule, we should follow it if you're going to have a planning board that goes along with those rules follow it. Some of the issues with the community is that you see people who come up here and they're able to sort of maneuver things. Certain people can maneuver things and you're thinking yourself there is no way | would be able to do that. For all of us who can't afford attorneys to come up and try to change rules | just can't go along with this. | have to be a no on this item, I'm for following rules, I'm not for going around rules. I've been told by staff that this is a buyer who willingly bought a property that they had noticed, and it was likely that they're going to have to remove a billboard.

We recently heard from one of the other billboards that's on the same side of the street with his commercial development and we said no that billboard has to go. We cannot be recognized as a rural route for sightseeing until we get rid of these billboards. If they go away, we get recognized so I've got to not support this.

There's been a lot of reference to a rule | just want to make clear that there is no hard and fast rule on this because if there was, you'd end up in the same position that the city of North Las Vegas ended up in. The master plan, does it eliminates those potential legal issues? What happens is that you don't create rules you create these, the standards, and we see if there are standards that could be met. I've gone through the master plan is there's certain ways that you can go about and look at things on a case- by-case basis, so you don't create the hard and fast rule that leads to liability.

It's not hooked up to the Internet in any way and can't be compromised. | love that the clerk can print ballots if she runs out, no problem you don't have to print preprinted ballots whoever shows up gets a ballot with their district information on it. At the time that they show up to vote they insert their card and off they go it was amazing.

The tabulator, you insert your ballot, it tabulates your ballot and there's just one SD card in the machine. It can be programmed for early voting or Election Day so you're just removing the one SD card at the end of the day and taking that back. So if someone wanted to look at it, they would have that ability to do so for whatever reason and we would end up with the ballots back. So afterwards, if we do need to go back and audit for any reason, we still have all the paper ballots. We will no longer have to worry about the three-to-four-hour adjudication process. A lot of people do not know how to fill in a bubble and we then have to try to discern, and if they cross it out wrong one time that vote doesn't count. If you knew how many votes, we didn't count this last election because we couldn't read it.

This is conforming with the president's directive, it is paper ballots the only difference is that they're automatically printed at the time of the vote and then you walk it over and you can look and make sure who you voted for and then it goes in there. There’s no alternative, this is like the only thing that's available at this time and we have to legally comply with the president's directive.

What I'm curious about and concerned about is the reliability that if there's one machine and that one machine is jammed and goes down is there going to be training for our county clerk and staff or IT somebody that's going to be standing by just in case otherwise the line will be out the door.

If this tabulation machine should go down, we simply turn it off unlock the back and now we can drop ballots. Once everything is fixed, we'll go right back to tabulating but we will still hold on to them and keep them separate from the ones that are already tabulated. We do have contingencies and backups, and those ballots will go back to central count to be tabulated. On elections, they send us our own people, we have a dedicated person that comes to Nye County. We've always used them, they've always come out, they're always a phone call away, but again, there are contingencies should the tabulator go down. The biggest thing that's getting ready to come is the ballot marking device is the actual the printers that we're going to need.

Inquires if the remaining applicants can be eliminated. ACM Delinger replies -Yes, and she advises the board the Steven Johnson has not received a letter from the Department of Indigent Defense Services on his qualifying categories. She cannot issue a contract without knowing what those categories are; it is a regulation to have the categories identified. The current contracts are due to expire June 30, 2025. The case load study that was performed by the state indicated the county needs 12 contracts. She wil! be working with a program coordinator to assign equally the case load, dependent on qualifications. The attorneys need to have as many of the categories as possible. The state has a program called Legal Server, that is where the attorneys put in their case load, notes, and closed cases; it needs to be updated so a real case load can be determined. The nonindigent cases need to be removed from the scope of the public defenders. But she cannot do that until we know what the case load is, and that is what she is working with the program administrator for.

we don't eliminate Mr. Johnson, since this is time sensitive, and inquires if it would be appropriate to move this to the second meeting in June. AMC Dellinger-Replies that she would like the state to relook at the number of attorneys that we do need, but she believes that some appointments can be made today; we have 9, including the 3 that were just appointed, we can appoint 6, with 1 for the Tonopah contract. Karen Hanks-Outlines her qualifications; she was here 5 months ago, and the board approved her contract. Since then, she has been qualified for felony cat B and below, and gross misdemeanors. So was able to do 2 trials; she thoroughly enjoyed this job, and helping the people in Pahrump, that's why she is asking to renew; she is looking at office space if her contract is renewed. Thomas Gibson-Outlines his qualifications; he has been around for a long time and he is here today; he has had nearly 70 jury trials; he is capital qualified; he practiced in Federal, District, Circuit and Court of Appeals; he has done everything from Justice Court through the Supreme Court; he has never argued before the Supreme Court. McGill addresses the Board-He is bringing this forward to close the Sheriff's Office, not the sally port. He plans to change the open hours in Tonopah from Monday through Thursday and close on Fridays. This will be in line with the Courts, Treasurer's Office, Admin, and other county offices. This will allow them to extend 4 hours earlier and later Monday through Thursday, which will accommodate some people who have to come in before 8:00 or after 5:00.

This is an agreement that they have elected to potentially enter into with ICE, which allows deputies in the jail to be trained in an 8-hour online course in the immigration database. Those specially trained deputies will be able to access the ICE database, check the person’s name, identify if they are in the country illegally, and then we will contact ICE.

Responds, it looks like ICE has 48 hours to pick them up, so we would have to house and feed them for 48 hours before they are detained by ICE. So, it makes sense to her that they go as quickly away from our cost and overhead. She likes the fact that we can access the database. She believes this was a directive from the president.

DA Kunzi - Wants to emphasize that this is a huge asset to be able to use the ICE database to identify who they are; it will be helpful for our law enforcement efforts to know who we are actually dealing with.

So, they are trying to find someone who will come in and recycle it under contract. And pay the county for it, but the price for recycling is very low right now. The pile in Tonopah is twice the size it was 3-4 years ago.

Utilities Superintendent Darrin Tuck - stating the county did not receive any bids on this project. Director Bolling believes it was the engineer's estimate, versus what the private companies were experiencing for costs, the engineer's estimate is more in line with what he believes; however, they have additional costs and bonding of the project. The location and unknowns are the biggest factors.

Sheriff McGill

speaks on factual inaccuracies in response to comments made by Miss. Williams, who is a member of Nye County and Pahrump’s Facebook page. He states that she comments on every post, every page, telling the same story. The Sheriff defends District Attorney Kunzie regarding the numerous arrests that the DA must address each year and the enforcement of not releasing records on open cases. Miss. Williams has requested records on open cases, and she has been referred to the process numerous times. In defense of Deputy Beard, he was due to retire during an internal affairs investigation, and that could not be prevented. The Sheriff acknowledges that some officers have retired in lieu of termination for felony charges and were able to receive their pensions, including Captain Boruchowitz. The Sheriff denies any knowledge of the Mexican Government opening a criminal case to be investigated in the United States; he does not believe that they would have any jurisdiction, nor any international community, or whatever Miss. Williams refers to. He claims she has done the same thing in Indiana.

reminds the public that this Thursday at 10:00 am, the BOCC will be discussing budgets and directs staff to put together the 4" of July fireworks program and place it on the agenda for approval. She inquires why they are doing RFQ's and not going through the bidding process any jonger, stating that no one is bidding on our projects. Further, she reminds the public that calling in is not guaranteed; the county does experience technical difficulties before and during meetings, preventing the public's ability to participate; she hopes the public appreciates that the service is available, because other counties do not.

states that several months to a year ago, Commissioner Carbone had asked for an audit of our Public Administrator, who was also PA for Douglas County. However, he does not believe an audit was ever conducted. Douglas County terminated it and made it an in-house position. So, he would like some insight into that. Manager Waggoner - responds, he will send Commissioner Boskovich the code section / State law that dictates an audit request for the previous year. The request must be made by March 1* for the previous calendar year, and he will inquire as to the response time. He will follow up with Douglas County as well. He adds that this may be the last fireworks event at Petrack Park due to a contractor building some houses on residential lots, so that needs to be taken into consideration in the planning efforts. The only other real viable space under county or town control would be the fairgrounds property. So, we may need to start looking at making accommodations there to host the fireworks show for next year.

I have listened to the whispers regarding the protocol of the county commissioners’ meetings. I heard speeches regarding childish behavior among the commissioners. I was even subjected to that behavior at the last meeting when a commissioner jumped out of her chair to sice the sheriff on me over my statement. So I decided to do what I do best & do some research. Have you ever heard of the Nevada county commissioner handbook. Ifyou haven't you should really look it up & read it. On Page 8 “Dillion’s Rule and the Authority of the Counties in Nevada” Very interesting read about the commissioners being entirely subjected to the will of the state legislature. On Page 10 Nevada’s Code of Ethical Standards “A public office is a public trust and shall be held for the sole benefits of the people” Also on Page 10 Nevada Open Meeting Law “all public bodies exist to aid in the conduct of the people business” The more I read the more I realized they work for us, the people! They answer to our government, they are not the last say im these-chambers. Did you know you can file a complaint against any commission for their behavior & conduct in these chambers through the State of Nevada Commission on Ethics? I didn’t but I do now! I read a few of those complaints filed in the past against some of our own commissioners. In your own BOCC Rules of Procedure updated in 2023 during a board meeting commissioners should remain in the chambers at all the times unless an emergency or illness occurs. I have seen on countless occasions members get up out of their chairs & -~waik-out. Ihave seen-a former commission run around these chambers in her bare feet & that same person left a meeting to bully a private citizen. I have seen commissioners argue among themselves. As an employee of the state of Nevada voted in by the people, we need to start holding these positions to a higher standard. Their decisions should be based on what the people of Nye County want not what someone wants to leave as their legacy. You want to leave a legacy then donate the money to build it or better yet build it yourself, Don’t use funds for your legacy that-can be used for better things that Nye County as a whole wants.
