Pete Yarbrough I understand public comment is not a Q&A, but I am placing these legal questions on record and expect a written response as required by Nevada Law. Question 10, Nevada Revised Statute 269.530 requires a petition signed by 3/5ths of taxable property owners in towns under 100,000 before a planning district can be created. Pahrump’s planning district began around 1997, and zoning rules were soon enforced thereafter. Did the county ever collect the required 3/5ths petition of all property owners at that time. Question 11, if no such petitions were ever filed then planning and zoning authority, under the law, is not valid. Can you show proof of this petition exists and was filed with the County Clerk as required? Question 12, Nye County Resolution 2001-29 is cited as justification for many planning decisions yet lines 10 and 11 appear to limit jurisdiction. I’m requesting those lines be made available to the public either by reading them aloud or publishing them clearly so we can all understand where the Planning Department’s authority begins and ends. Question 13, jurisdiction is key to enforcement. Can you show a current map defining the exact areas the Planning Authority covers? Question 14, a planning district imposed without legal processes, such as missing petitions or misapplied statutes, risk being invalid. How do you ensure legal compliance with zoning enforcement in Pahrump? Question 15, VR zoning designation is being used to deny permits but was originally meant for fully serviced residential land. Who approved the zoning for lots with no infrastructure and on what legal basis? Question 16, if these lots were never eligible for development under the current zoning without services, why did the county allow their sale, taxation, and continued marketing to the public for decades? Question 17, the county has been aware of the zombie lot issue for years. Why isn’t there a long-term solution such as zoning overlay, zone change, or alternative utility systems pilot area ever been proposed and implemented? Thank you. Nevada’s constitution guarantees inalienable rights to life, liberty, and property. How does denying the use of lawfully purchased land respect these fundamental rights? Nevada counties, including Nye, are granted the power to fix zoning problems under NRS 278.250. Doing nothing to fix the zombie lot problem is not a matter of law, it’s a matter of choice. Why is that choice continuing when solutions like super conservation lots have been presented? Zombie lot owners aren’t asking for freebies, they’re asking for a legal path to use the land they already own. Why does the county continue to block that path? SB-i 50 now requires counties, like Nye, with fewer than 100,000 people to adopt zoning and allow tiny homes. That means the county now has a clear legal direction to make changes. Will you commit to initiating a zoning amendment that creates a legal path for small lots and bring these landowners some relief? Hundreds of zombie lots will be headed to tax sale and in most cases the county benefits far more than if the owner simply paid their three years of property taxes. When these lots sell for $3000 to $5000 it’s substantially more than the few $100 owed, even with penalties and interest. The county may cite the costs of staff, mailings, follow-ups, but when no one claims the overage within a year, the county wins even more. The lots are sold at auction with no mention of being unbuildable. When buyers find out later, they’re told it’s their due diligence. How is this not a conflict of interest and who really benefits from keeping these lots stuck in a broken system? State agencies say it’s not their issue, county staff blames the State, and year after year nothing changes. Who is going to take responsibility to fix this land use failure? These aren’t just zombie lots, they represent forgotten people, failed policies. Will you act now to fix what prior administrations allowed to spiral out of control? The State gave you the power, your code shows the path, SB-iSO gives you the push. What’s stopping you from finally doing what’s right for thousands of landowners in Nye County? (See exhibit 3) Gerald Butler I’m not here to insult anybody. I’m not here to get personal. Apparently, people understand that when you get personal with them, they will get personal back it. A lot of feelings get hurt but this isn’t a position for feelings. This is a position of thought, fairness, and justice. I’ve been doing a lot of research lately because we’re having a lot of issues. I’ve been reading from many numerous county websites, we are unincorporated. The county is limited on their jurisdictions based on NRS 269. The other issues are as I’m looking at these county websites they’re using incorporated township policies for coding compliance. They’re using a 30-day notice policy. Two, I was reading the NRS 2001-29 and read they’re using a metropolitan area code to enforce it. They’re not abiding by the metropolitan code. NRS 171.17751 says only peace officers can issue misdemeanor citations in the state of Nevada. If you read NRS 269, the county is limited, and certain things must be filed by petition. Because you guys didn’t adopt the unincorporated township code and enacted the town in 1987 with only 5 signature petitions, anything the town did at that time is illegitimate and unlawful. Anything rebutting to the state constitution is unlawful and can’t be enforced. NRS June 17, 2025 197.200 says you guys are taking away people’s rights and tenancy of their own property. Section C&D, these things need to be looked at. I’m informing people of what the law states. When I go to court, I’m seeing people try to argue logic and losing when they’re in the right, is wrong. They just didn’t know how to word it or how to legally present themselves. I’m doing my best to help them. I shouldn’t have. You guys are voted in based on their trust in you to do the right thing for them, to be fair and to follow the laws, and to hold yourselves to the same standards that you hold them to. I’ve come across a lot of citations that aren’t even being signed. NRS 171.1773 said the citations must be signed or it’s unenforceable. We go to court, you say that no, that’s not the case and then they just keep processing. Did you realize that Nye County is the number one county in the state for appeals and overturns. These are the things that you guys have to look at and the problem is that nobody knows how to file proper lawsuits or writs. When they figure it out, it’s all going to come crashing down like a mountain. Jaquline Cashmere I just want you to know Rural Development is open and ready to do business. That’s an agenda item. You have to wait until item 16. Beth Borysewich Last year I brought up this glove factory that wanted to come here and heard that it hadn’t gone to planning. It had only been presented here and then that was it. Now they have done a second groundbreaking without having any permits to be out there. What is going on? We don’t want this glove factory. They use acid and other products that are very caustic. You can inhale it, and it can burn your lungs. I’m concerned about anything like that because if it gets into the groundwater, it will be going downhill to the South because they’re up by the dump. That means that everybody from the dump all the way down could potentially have groundwater that could kill them. You know this is going back to the thing as with Medi waste. We need to look at the companies that are coming in here, look at all the things that they’re saying and research them. I’ve been researching and I have a lot of documents on the glove factory. The other thing is zoning. I have no idea how many people sat on what June 17, 2025 committee to do our master plan. I have no idea how long it took, how much of our county money it took, but you guys said a master plan and you said this is going to be this. At every single Commission meeting there are three or four requests to change the zoning and to change the master plan. You say something and then you go and change it. Every two weeks there is somebody new that wants to make it a village residential, a commercial or they want to make it so you can build a home. It just goes around, and no one can keep track of what’s going on. Those are two things that I’m delving into lately and you’ll hear about other things from me. You guys have a good day. Dwight Lilly I want to thank Commissioner Bayne for bringing forth, at the last meeting, a request for the county to fund our law enforcement and our fire department agencies to try to retain people. I was told by the Comptroller comments that the grant fund was down to $750,000. I’m not in favor of grants because that adds to my national debt, which is at $36 trillion and growing. If I’m going to have grant funding, I want it to apply to retain Joe McGill’s employees and help them add more people. I don’t want my wife accosted at the Walmart parking lot anymore by a drugged out crazy person trying to steal her purse. Which brings me up to the second point I want to talk about. I want an ordinance passed by Pahrump that all businesses that have set number of people visiting the business must provide security to wander the general area and parking lots to keep down threats of being attacked in broad daylight. I don’t think that’s an unreasonable request to have an ordinance like that. The second thing I want to bring up is the vote for the town board and to vote for fairground. I live in a town that has around 50,000 people and I heard a comment on a TV program the other day that this is a county government at work and every two weeks there’s one item on here for the town of Pahrump. I didn’t believe it until I picked up today’s agenda. I think it’s reasonable to look at the governance of Pah rump in a different way right now, some years after the town board was suspended and gotten rid of. You guys claim you’re the town board, but you don’t have more than one item on the agenda for two weeks to discuss town of Pahrump. We used to meet at night for hours talking about the town of Pahrump. We have situations here that need addressed as a town, not a county. The next item I want to address here is an issue that it took place in the parking lot out here at the Nugget and in front of it the other day, No Kings. If you go to nokings.org you’ll find out their group is against the United States Army, against patriotism. They think our president is a king because he wants to enforce law. They think that the government’s cutting medical costs but in fact they’re cutting medical expenditures to people that are illegally collecting expenditures. If you go to the nokings.org website, you can see the lies being spread. Tina Von Kuglin We have quite a few rescues in Pahrump. From dogs and cats to horses and burros, and all animals in between but what we don’t have is any type of standard rules or regulations. Not all rescues are treated the same by the building department, code compliance, animal control or even BLM. One rescue almost had to put in landscaping in the middle of the desert. They don’t all have a Town of Pahrump license or conditional use permit and yes there are ways to be exempt from state or local business license, but it’s not an automatic exemption, and it doesn’t mean rescues June 17, 2025 don’t have to follow ordinances that are put in place by their state, city, town or local government. There are a few rescues that have taken it upon themselves to search for animals and keep them when they can’t find the owners. There are rescues that think it’s their job to round up the wild horses or burros when they see fit. There are rescues that are approved fosters by animal control but what was the vetting process, if any at all? If they were vetted properly then why wasn’t a conditional use permit applied for? Why didn’t they know she wasn’t properly licensed in the Town of Pahrump, even though she holds 2 state licenses? We have another rescue that is in the process of moving to Pahrump from Goldfield. This rescue was asked to help with the vast situation and now is being harassed and bullied on social media by the rescue that caused the bad situation. This rescue also costs a farrier his state job. This same rescue just got all her animals back that were removed from her rescue. This is what I mean by no rules and regulations put in place that all rescues, regardless of the type of animals they have, should have to follow. If we had something in place, animal control or BLM wouldn’t have been allowed to bring those sick burros into Pahrump, jeopardizing our equine community. We have another rescue, already established in Las Vegas and Pahrump, that is trying to open another one on 40 acres. This is amazing and I hope he succeeds but in a backdoor deal he may be turning the 40 acres over to a rescue that wants to put our wild horses on it. This is just another example of why we should put some regulations into place that rescues have to follow. These rescues should all be under the same procedure and be treated the same no matter who they know on the county board or the sheriff’s department. Thank you, have a great meeting. I’m sorry I could not join you today. Darrell Lackey A lot of people had questions here today and I got the answers because you guys don’t. It comes down to money. Zombie properties, they’re only like $75 a year but you take something where somebody sold their house in California, they came out here and built. That’s a lot more tax dollars every year. A lot of you got side gigs, or this is your side gig, in all the building things. You’ve got your front money and your side money and you’re not going to get anything by helping people that are not coming into town with all their money. They’re not going to be able to pay the $80,000 building permits and things like that. Where’s your money and taking care of people that don’t have a lot of money, which is where your money comes from. That would be ridiculous for you people to allow poor people to live here. I also want to address Mr. Dwight Lilly. Mr. Lilly was talking about his wife in the parking lots. People don’t have a way to make a living. I have a program. I would love to get these people that have time on their hands and teach them how to be functional and how to be valuable again in life because our education system didn’t teach them how to be valuable. They taught them to buy things with payments. Our education system was invented by the Kennedys and the Rockefellers because they don’t want a country full of thinkers, they want a country full of workers. Later, they broke up the family unit you know with the women’s Lib and everything. Get women in the workplace, now the state has a better chance to raise the children. If a child stays home, they can’t stay home and take care of mom and dad like they do in other countries. They’re losers if they don’t get out on their own, buy their own June 17, 2025 Tupperware and their own dishwasher in their own roof and their own. Everyone must have their own things otherwise the economy suffers. Again, you’re back to money. My zombie lot that I had was $76 a year. How are y’all going to flop around in the money with that kind of income. You have to get the ones with the big walls. You’ve already oversold their water. Now you have more developments coming in with people that aren’t from here, people that want a small house. They don’t waste a lot of water, out there washing their car in the driveway. They may not even have a car. We got so much water, and it’s replenished every year. That’s what one of your magazines says. I read the whole article. We have to wait for that item. I apologize. Butler-Adams Let me ask this one question. My question is I don’t know why the county can’t incentivize developers that come into Nye County to provide them tax break if they hire, I’m just going to go throw out a number, 25% of the residents must come from Pahrump or Nye County. You have people who are coming in to develop houses. I haven’t seen apartments in the three years that I’ve been here. I’ve seen other businesses come here and develop here but I just wanted to put that out there that maybe you do your residence justice if you allow them because they’re all looking for work. They’re on Facebook pages and they’re looking for work. I just don’t understand a county with 55,000, who is about to generate a 1.5 in this housing development alone, can’t put their voice behind their money and muscle and say GOP if you come in here, we want to see you hire here. Not just the businesses. I’m talking about the John and the Jane does. We want to see you physically hire and we will provide you with an incentive or a tax break or however that goes. That’s what I wanted to say on that topic. Maryanne Hollis Two car accidents within one week on the stretch of 160 between Manson and Mountain Falls. When is someone going to recommend an enforced traffic remediation by way of lights, signage, reducing the speed limit. Studies that are referenced in the 2006 agreement following a revision in 2003, another revision in 2017, that was based on only 847 homes. Signal warrant analysis for the three intersections is expected to have worse levels of service as predicted by the 2030 build out. In that report, in a three-year period the Mountain Falls egress reported two accidents. 2 over 3 years and now 2 just within one week. In the revision, mention is made again of a completed traffic study, where can I find that? Four years later the biannual compliance report, in 2021, section 61, again states an updated traffic impact analysis has been June 17, 2025 completed and approved. Where can I find that one? A discussion before the RPC in October 24 had no resolution or direction. Please, someone take the initiative to discuss remediation measures from NDOT, the county, and the developer before the additional traffic from the 2 new developments just inside the entrance to Mountain Falls creates even more dangerous conditions. NDOT has admitted that they have no funding to complete work on the corridor at this location, widening 160 or a roundabout and thus the finger pointing for responsibility begins. What if my back wheels are on county roads and the front wheels are on N DOT? It happens every day at the Mountain Falls exit, who’s responsible? Doing nothing but talking is not an option. I hear it from Mr. Bowling every time it is questioned. Discussions are underway. I am also waiting on the traffic study for the King Corner gas station that was promised to me in January, however yesterday I was told that the study had just started. I look forward to this traffic study at the Bank of America site for another gas station but what comes first the study or shovels in the ground. You seem hell bent on growth with little concern for public safety. Can someone tell me what is being developed at the intersection of the Mountain Falls boulevard and Mountain Falls parkway that the farm is at the rear of? Michael Garica I’d like to wish everybody a happy Father’s Day and hopefully our founding fathers aren’t rolling over in their graves too much when they find out that unelected bureaucrats can rewrite the linguistics of the 1st amendment. What he is saying is constitutional sound. It’s gone to the Supreme Court, as far as the forum. You can’t just walk into a public building, just take it over and talk about anything. It’s not just statute; it has been tested at the highest court. That is true, whether people like it or not. Tynia Dickson We had our 8th graduation this past Friday. We graduated 4 service dog teams and recognized four beginner teams, one of which is a veteran and that was very successful that graduation. I only have two programs left so you’ll have to arm wrestle each other for them maybe. I had to put some drama in there somewhere but who can I give them to. Can I approach the bench? Tom Waters I am here to talk about the reestablishment of the Pahrump town board. That’s something that we’re going to continue talking about. That’s something that you can handle as well. I want to thank everybody that came to the town hall meeting on May 23rd. We had a lot of pros, a lot of cons and one of the things that I’m interested in is getting it on the ballot so that the people of Pahrump can vote yes or no. If they want to reestablish the Pahrump town board, they vote yes. If they don’t, they vote no. We have quite a few people that are saying we don’t want a town board, and we don’t want anybody else to vote on it and I’m saying why are they afraid of allowing people to vote? I will never understand that. What I’d like to do is to put it on and make it an agenda item for the Board of County Commissioners so that you can vote on it first before the people have a chance to even look at it. What I want you to do, and I’ll probably make this a written request to make it an agenda item so you can vote yes or no to place it on the ballot. If you do that then the people don’t have to do a petition to do it. If you vote no or if you fail to do it, then the people can go ahead and do a petition, but we’d much rather have the County Commissioner step in and make a decision on it, one way or the other. But the main thing is to let the people have a decision about whether they want their local government. We’ve already heard some people say that the things that are talked about for the town of Pahrump are very minuscule compared to the things talking about with the county. I’ve stated over and over that you are County Commissioners, and you do an awesome job for the county because you have such a vast responsibility, but you’re not town commissioners for the town of Pahrump. We need somebody that can focus just on the needs of the people of the town of Pahrump and the town itself. We June 17, 2025 have needs that people can focus on and that way you can focus on the county which is what we would want you to do. The main thing is I would like to have it on as an agenda item either July 1st or July 15th and I’ll go ahead and submit the proper paperwork to make that happen and hopefully you’ll support me in that. Again, all I want is for the people to be able to vote yes or no. We want to reestablish the Pahrump Town Board. How it happens, it’s up to all of us to make it happen. Thank you for listening and let’s move forward with the Pah rump town board. Steven Pace I’m a veteran and I kind of represent a few veterans that have a lot of time like me to listen to things and the concern that we have is we can’t get down here to come to these meetings. It’s very hard and a lot of times we’re cut off from being able to question things, money spent, things like that. I was in this county before there was a Pahrump. I brought my parents to live here. I just want to make sure that we have a voice. That everything that comes before this board we can know, and we can ask questions. It’s what we elected you for. A lot of times I see you rolling your eyes and it makes me sad. I fought for this country. I fought for freedom. Also, I ask that you let us, the people who elected you, know everything we need to know. Thank you.

Thank you for your service, sir. I just want to remind you that the Tonopah Chambers are open for these meeting and we have the first meeting there. Kaye LaPointe I wanted to bring a picture and a thank you card to Commissioner Jabbour, see I told you I’d catch up with you, for being the MC at our Nye Cotillion this year at JG Johnson. He did a great job. One quick story I’ll tell you, he also came to our cake auction, so when he was at the ceremony on May 10th one of the kids came up and go “Oh yeah, I remember you. You were at the cake auction.” Kids do notice and kids were privileged to meet him and to see that people from higher government are participating in what they do. If you missed it, I think I sent all of you but, if you missed the May 14th edition of the PV times, we had a full-page article there on the front page and I encourage you to read that because that was probably the best coverage we’ve ever had and the most truthful. Sometimes people just come and write stuff and don’t ask any questions. I’d encourage you to read that. One other quick thank you would be to Commissioner Bayne for what I’ve seen him doing in the community, for cleaning up lots and trash, and as we become a bedroom community in Nye to Clark County those things are important. It shows pride in your community and that’s one of the things we try to teach in Cotillion so thank you very much. Tim Doyle I was calling to talk about the glove factory and speak in support of the glove factory and especially when we live here in the community that is growing and growing fast but it’s hard for local wages to keep up. I just wanted to speak about the glove factory, which is projected over 10 years, to bring over 300 jobs with an average wage of $29.00 an hour. Also, 65% of those jobs are projected to bring health insurance. The estimated tax revenue from the glove factory over 10 years is over $5,000,000 and the payroll supported over 10 years over $180 million. I just, as a local June 17, 2025 business owner, wanted to support the building of the manufacturing facility and wanted to say thank you to the County Board for supporting the project, and to the Governor’s office who has issued a report on this and is supporting it as the Governor’s office of economic development. I’d just like to thank the Governor for supporting the Alka Products glove manufacturing facility and the County Commissioners for bringing those jobs to Pah rump.

Tiny homes are allowed. I have one of these zombie lots, so you basically are stuck with a compost toilet thing, and all of this stuff that is not allowed here. So being in the same boat that you’re in, I feel for you, and I offered at the last meeting to work with you and talk with you and try to figure out a way that we can do something, without affecting the tax rates of anybody in this county, because that would also not be fair. I know at least one of you is a realtor, and in real estate, disclosure, disclosure, disclosure, disclosure, disclosure, disclosure, somebody signs something somewhere indicating that they understand there may not be services to this property. I know this. The last fiasco we had with the town board cost hundreds of thousands if not millions of dollars to get out of. If you want your taxes to go up, hire a separate town manager, and all of the staff that goes with that. Separate from what we already have covered under the budget we have. I’m not interested in raising anybody’s taxes, if that’s really what you want to do, I say get the signatures, get it on the ballot, and let the June 17, 2025 people decide. I’m not interested or supportive of this board putting it on any agenda, but that’s just my opinion and that’s all I have, thank you.

The lifeguards told me that the line started forming at 8:30 in the morning. They did not start the registration until 11 AM. We had 180 children sign up and we were able to offer free swim lessons to 98 children. Yesterday, we also had an additional 41 children that paid for swim lessons. The town would just like to thank the Southern Nevada chapter international code council for their donation. I did provide them with those numbers, so we’re hopeful that maybe next year we could possibly get more money out of them. The pool hours have changed to accommodate the swim lessons. Miss Fanning, thank you again for promoting this and getting the initial grant for the toddlers for the swim lessons. And I apologize because now I have I asked you to get more grant money for more swim lessons. It is very important for the toddlers to learn how to swim. But first and foremost, to swim versus sliding on the splash pad, which I’m not opposed to, I just feel that they need to learn how to swim first. Thank you, we need to help find money because I believe your lifeguards may have been overwhelmed, and your staff, so thank you and thank them for doing what they did, and their patience. Christy Siegmund I do have a couple positive things but a couple reminders that maybe are not so positive either. We did have 59 placements in May, so that was 59 animals that went to wonderful homes. the paintings, if you haven’t seen them come in., they’re even more completed than they were before. They bring such joy and smiles to everyone who walks in the lobby of the shelter. We now have a coordinator who stepped up to volunteer, to gather up volunteers, so we have a volunteer coordinator, to help us really build an enrichment program for these animals, we’ve already taken some really big steps with walking and baths and nail trims and grooming, but this is really going to help having someone help me kind of wrangle all of our volunteers together and really truly create a robust program. here’s some of the negatives, and I hate to say negative, so here’s the areas of opportunity that I am asking the community to help with. We had 105 dogs come into the shelter in May; only 26 of them were reclaimed. So, I June 17, 2025 plead to the community, if your animal gets out, come and pick it up. It’s more than likely here at the shelter and we will be more than happy to work with you to make sure it gets back home. of those animals that came in, so many of them were sick, so many of them were ill, and it’s such a heartbreaking thing for all of us. these sicknesses and these illnesses could have been prevented with annual vaccines, so I plead to the community, please vaccinate your animals. You can even go to tractor supply, and you can buy them and do them yourself. the rabies is the only one required to be given by a DM, and if you want to go to a veterinarian to get these vaccines done, a lot of them hold clinics where they’re only 15 or $20 each and if you need resources please come and see us. We have a lot of resources that can help. We really have to curb this before it becomes something that is much greater than what it is already. Thank you.

Should we decide we want to do that. So again it’s 2 two parts to this it’s $150,000 which will provide outdoor running area for dogs. A lot of these dogs are sitting there, and I don’t know if some of these dogs will ever be adopted. I don’t know, I’ve just been told it’s a tragic situation and I couldn’t just sit here and not do something about it. First off, I’m going to say that if it was a different funding source my feelings would be slightly different. I have talked with Christy, and I have talked with Brett on the operating room. We feel we can do that with labor in house. the minimal cost we think we have stuff to coat the floor, we need the panels to put on the walls, we have people I believe that work for us that know how to put panels up on walls. So, we think we can do that room for very little cost. As far as the outside goes, I am in discussion with 2 fence companies, one company that’s going to supply us with pea gravel and at the same time a level in the whole site. and maybe do some fencing so I think I can probably get maybe get it done for really cheap. Now I’m going to read something that I wrote at the beginning of this and it’s probably not going to go over well, and I don’t care because I’m tired. This agenda item, while appealing to the general public for its connection to animals, is absolutely not appealing to anyone who values the fiscal stability of this county. Numerous attempts to spend all of our only financial buffer will probably lead to the steps that were taken a few years ago, when the county had to borrow money to pay the bills. I ran on a platform with fiscal responsibility, and spending money on feel good things when there is not enough money to rationally do so is poor management, that’s the only word I have for it. I have noticed that with projects over $100,000, we do have procurement laws, and it’s been a pattern that I’ve noticed that when we estimate, unless we know for sure that this is going to be in house and there will be savings on the labor, we have had sticker shock with quotes coming in way above our budget going in. it would be prudent to actually have realistic quotes from vendors and the time period, because supplies actually fluctuate in price, and factor in labor there have been examples such as splash pad, that has come in when we go out to actually purchase way above the $200,000 that we had budgeted for. Even in our CIP, I would be cautious about reserving amount of money that we’re not quite sure it would cover. I would want to maybe collect more information and possibly get the quotes and make sure that the project is completely priced out, along with the labor. I know that the BNG director has a long list already of building improvements. He has like 60 buildings throughout the county, and they’re on a schedule with five years, six years June 17, 2025 16. one of the reasons the vet room was not completed is because vets that we heard from in the past, they wanted a room suited for their needs, not our needs. So, to put a plan together for that particular room, I think a veterinarian that’s going to be under consideration should be consulted to see what their needs are and what they would want as part of the plan. there’s no doubt that our buildings and grounds director, he is all over this county, not just here in Pahrump he’s all over the county and his staff are all over the county and you have he has so many projects, but he doesn’t give up, he doesn’t stop. and he prioritizes, and I will say this that to hold the money in an account, and I understand that we’re looking for a plan, and I commend the commissioner for bringing this forward, because we’re talking about lives, we’re talking about animals, dogs and cats’ lives, that were part of somebody’s families at one point. They escaped, they were let out, they were abandoned, whatever the case may be, and so I’m not sure how much time we have to wait to allow them to live under the conditions that they’re living in and that would be catastrophic for us to just ignore this project.

this is a commercial piece of property. It has to have a site development plan. We came to do what the public has to do. That’s a big deal. I commend Commissioner Koenig, because well let me express something else that’s between 25 and $45,000 to do a site development plan, unless we can get someone to volunteer that does those, and we can ask. That’s where we need to start. If we’re going to touch the project with site development plan; we can do a grading plan, that’s the only thing we can do without having the site development plan. We can grade the lot and put gravel down. First step is sure that’s it. So, I do hear the comptroller when she did say, and she may not recognize what she was saying. anytime you’re dealing with over $100,000 you’re in a procurement law, and you have to go out to bid. We don’t get to do volunteers. We’re at a catch 22. We need to take some steps. We need to have idea from a group of people that can draw on a piece of draft paper what they imagine they want. Then we can start planning, but we can’t just throw $200,000 at something and expect to be able to get anything done. We don’t have a plan. We won’t see if you tune into C-SPAN, you won’t see someone with blueprints up there for a building, waving them around. It’s just not how it is done up here. some people suggested setting aside money. That’s what this is. That’s what an appropriation is. not to get into a remedial discussion on what we do up here every day, but we make decisions. Thankfully, bureaucrats don’t make these decisions, people who elect to make these decisions. spoke with staff, not contractors, not experts, and staff said Well I believe $150,000 to do this, now that was based on discussions with people, they may or may not know what they’re talking about. It’s hard to say, but what we could do with that money is, once appropriated, you then change the scope of it. Whatever it is now, you know 10 lanes, 12 lanes, 5, whatever it is, there’s at least provide some relief for these dogs that are in cages. we’re in no kill shelters, so that means that we don’t dispose of animals. Those dogs are in those cages and while this board is playing offense, this board I have 0 confidence in anyone on this board, is going to be able to do something like this that they haven’t already done in the last five years, or how many years they’ve had this building. All of a sudden everyone has a bunch of ideas. That’s fantastic, but it doesn’t work for me. I would like to appropriate money, and it appropriates up to the amount, so if for some reason there’s something smaller that gets done, we could come back and we could cut that. That happens all the time. We borrowed money from this LATCF fund before. This doesn’t even take out from that over taxation fund. All this does is spend $200,000 out of $1 .7 million sitting in a federal grant fund that’s relatively unrestricted. I’ll take what I can get for these animals. So, I would make a motion on both and see what happens and then let if anyone wants to modify that I’m completely fine with that 20% of your June 17, 2025 government so I can’t make these decisions. We’re reminded of a familiar commentary we don’t need more police and police don’t need more funding. But today I probably put forward funding to make products safer and stand with our sheriff against bad people who come to Pahrump to do bad things in addition to a normal crime we cannot be a dumping ground for illegal aliens, and my concern is that Nevada is being targeted for such a thing. There’s nothing to prohibit this command vehicle from being used to assist ICE in reading our county of dangerous illegal aliens and I hope it will although that’s the sheriffs discretion. Mr. Chairman if money in the bank account stop crime, we would have a lot less crime here in Pahrump and if excuses from bureaucrats and elected officials stop crime we might have the safest community in America. We have a and rescue and one belonging to the Sheriffs Office that nobody can the state Class A motor home that was given to my predecessor many years ago from e it has air brakes and and it requires a special license endorsement to drive it. Becaus that to the best of my knowledge, we have one person in our department who has that’s probab ly why the state license endorsement to drive it. Secondly it is dilapidated, gave it to us and didn’t sell it to us. So that being said, my goal is to buy a class C from 17. First of ask. volunteers if they’re going to be sitting on a crime scene for six hours, that’s a big They’re leaving their family for six hours not to get paid and just drive a vehicle there June 17, 2025 and back, that’s a big ask. Secondly the fire department’s incident command van is a Mercedes Sprinter Van. Yes, that is practical, but again in order for us to use that as our incident command vehicle we’re going to have to have fire department bring it to us and stay with it for those six hours if it’s a fire incident and they bring it out, that’s their that’s their choice to do. But I don’t like borrowing people’s stuff, it’s absolutely Nye County stuff, but it’s assigned to the fire department, it’s assigned to search and rescue. And search and rescue put a lot of work into their command vehicle and a lot of money. Chief Lewis brought his command vehicle up to Tonopah for the search and recovery of the pilot. My idea for this is number one we are going to have it for major crime scenes, long drawn-out investigations, fatal traffic accidents those tend to take quite a bit of time, Fall Festival, Jim Butler Days, 4th of July Parade. We bring our vehicles out for those things, right? We would again my predecessor used that big white Class A that we have that is partially functional, we need to sell it, take the parts off of it, we need to take the radio out of it, we need to take the computer out of it, and put it into this new one. We’ll have communications, we’ll have computer access, we’ll have Internet access, will have everything. I believe the search and rescue have transferred the vehicle over to the County. Samantha Tackett- I’m currently working with public works and equipment services to find out how much it would cost us on an annual basis because our departments and equipment services and funding is already very, very, strained so we want to understand what the financial impact of taking on these vehicles simply to be able to pay for them for search and rescue we want to know what that’s going to be. The problem it there is a lot of crime in this town and so you know we have close to $3,000,000 sitting around. Would $200,000 make a difference? I mean I believe in taking a chance on people and seeing what they can do, that’s what I do, I don’t micromanage, I don’t want to see plans, I know I’m never going to know as much as this guy knows about law enforcement. So, the issue that I have, is are we just going to go backwards or are we going to move forward and try to address these issues and figure out a plan to do it? My question is when I look at this and I see there’s two and maybe the county manager would know because he’s very knowledgeable about this kind of thing. The question is, if you don’t know, it’s okay, there are two areas that sort of mirror each other. Do you know or is this residential turned into commercial? It just seems odd that they’re identical sort of setups, one of them has commercial, and one of them has residential. It’s not the final but it’s probably close to the one it’s going to look like. It’s going to be state-of-the-art as every one of his properties are. I’ve been to a few of his builds. I’ve been to so many projects. They are state-of-the-art. There’s no other explanation I can say. Any further questions. Rene Morales This is going to be state-of-the-art. We need more storage in this community. Number one, we have a lot of storage facilities, but this is so secure you have a wall all the way around. It’s going to be paved. We’re proposing to put an 8-foot wall in the back of this property for noise compliance, neighbors. It is going to have lighting all the way around but it’s going to comply with every rule and regulation that the city and the state require of storage facility. It will only have hours of operation from 7:00 to 5:00 Monday through Saturday and something that is going to be nicer than what it is right now.

Mr. McArthur we only have 3 pages. Your report, your findings, your math. Is there more that you want this Commission to see? Dan McArthur No it’s just this page right here, the last page you have. So basically, we’ve gone in, and we have obtained documentation from the treasurer’s office to examine all the room tax reports for the 4-year period ending December 31, 2024. We were tasked with an examination to determine the reports that were delinquent and whether the penalties related to being delinquent with filing were assessed or not. You have a summary here by town. We looked at each individual town, we looked at the ordinance to see when they were supposed to be received, to see what the penalty was if they were not received timely. We examined if there had been a delinquent filing, if the penalty had been assessed and if it had been collected or not. This summary that we have here, as you can clearly see, is the numbers from 21 through 24. I’m just going to go across the bottom of the page here with you where all the towns are combined. You can see in 2021 the delinquencies that were incurred that were unassessed or $3073. In 22 was $5700. I’m going around the numbers here. In 2023 it was $33,000. In 2024 it’s $44,000. That means that the documentation we looked at indicated that it was not received timely. Based on that we checked and made sure the calculation for what the penalty would be for not filing timely was calculated, and whether that amount of money was requested from the hotel, motel, or the entity would be charging room taxes. These are amounts that appear, based on the information and documentation we looked at, had not been assessed the penalty and it had not been collected. For those who have penalty had been assessed and paid. That is not reported on this worksheet right here. Just to add some additional information that’s not on here, just some questions that came up to us, just to give you an idea, I’m going to go to what I’d call occurrence; how many times this happened. In total, for the 2021 year, there were 34 occurrences. 2022 there were 33. In 2023 there were 81. In 2024 there were 115. When you look at this 21. I can’t provide you with an explanation why those occurrences took place, why they increased in those two years. The procedures that we did on this were called agreed upon procedures, so specific items that we listed that we would go and examine. So, it’s clear as part of this we didn’t go to any of the individual room tax licensees and discuss any of this with them and do any confirmation or correspondence with them. This is all based on information that exists inside the county, inside the county’s documentation. That’s the overall look at it. I could go into more June 17, 2025 detail if you have questions but those are the items I will present to you today based on the request of the work we were to do.

Jabbour’s District 1, one has to wonder just what was going on. As a taxpaying citizen I’m sick and tired of the lack of prosecution when wrongdoing is discovered. Someone made the decision to waive these fees without the authority to do so, going against Nye County ordinance 94-01. What’s the point in having an ordinance if you don’t prosecute violations? The bigger questions remain unanswered. Who will pay these past due amounts, which should be occurring at the rates listed in the ordinance. Will there be demand letter sent to each and every establishment that received the special treatment? Will any of them be willing to shed light on just how they manage to avoid paying these fees and penalties? If the hotels owning these late fees refused to pay the amount, will there be restitution by all those involved? Someone needs to submit the funds of these amounts due. Which hotel properties receive favorable treatment? How often were these fees waived in the four-year period of time? Why isn’t there a list of the Nye County hotel establishments that owe money included in this audit? Is there some reason to hide their name? Why should any hotel establishments in Nye County bother paying their room taxes on time when it appears that if you have in or know someone you can skate on submitting these revenues? How is that fair to the ones who faithfully pay their taxes on time and are paid any late fees and penalties if they were late? Will the DA and Sheriff guarantee that a full investigation takes place and prosecute all criminal actions regardless of his status, 21. Commissioner Jabbour is no stranger to the hotel industry and how it functions, especially regarding the collection of room taxes. I’m sure he wants to get to the bottom of it. One has to wonder in a small town, like Tonopah, in an industry that claims around 10 hotel properties, that it was common knowledge that it was easy to get the late fees and penalties waived when you didn’t submit your room tax dollars on time. Regardless of who was complicit, ignorant or June 17, 2025 looking the other way, these establishments knew they were getting away with something or receiving a benefit that was not legal to get. It’s time to pay the piper, or in this case the various towns that are desperate for this revenue. Taxes cannot be waived at the flick of the hand. I call on the DA to take a stand on this item, actions have consequences and being viewed as someone easy on certain criminals isn’t exactly ringing endorsement for another term for anyone. Maryan Hollis The numbers in this report are disturbing. They’re on an increase every single year. Who was in charge of overseeing this? Who is responsible for allowing this to happen? And why on earth would there not be a list of the hotels, or residences, or boarding rooms whatever is included in this report why isn’t there a list of those here — — so we can see how many times they were given the pass? Because that’s what it was, it was a pass. And why aren’t the numbers for the repaid loans in this report? Why not? How many lodgings are included in this report? I absolutely agree with the previous speaker that there needs to be a full investigation and a prosecution and restitution of some sort. Because if this went on for four years, thank God somebody had the wherewithal to forward this for investigation to this level. I don’t know what a “focused audit” is. It doesn’t look like it passes the sniff test for a forensic audit, because those things that are missing would have probably been in there. I think this is an insufficient report. There’s a lot of information missing, and I do agree that some type of investigation and punishment be meted out. This was, this happened in the county — overseen by county officials and it was let go for this long. How long could anything else be going on that we don’t know about? I’m not even going to go there. What I’m going to deal with is what’s in front of me now, and this needs a thorough investigation with much more data than this gentleman has provided today. Frank Carbone Just a little bit of clarification listening to some of the numbers that — — was quoted, as far as time frame is concerned, you have a couple different people who were running the Treasurer’s Office, and different policies and procedures were put in place. When John Prudhont was there, they had a different process as far as how they wanted to see these things come in. And then it changed when Raelyn took over. So, there is some confusion in those numbers because of those issues. The other thing is, is you need the data. You need to know what the processes are who’s responsible at the bottom, to the top. The information has to come to the Comptroller, and has to be passed on by somebody, and somebody is probably the top person it’s probably the, I would imagine, is the Treasurer, right? So, I mean, there is a ... If you can do an investigation, you got to investigate top to bottom, or bottom to top however you want 21. You know we should be looking at our policies and June 17, 2025 procedures. Are they really there? And who is actually responsible at the end? Is it the employees? Or is it the management of the organization? I know when I was a They ... called me a team leader, and they used to call them vice presidents, but they call them team leaders now, the company that was left. And you’re responsible no matter if that person down here did it, you’re still responsible to make sure, however it got done, got done correctly. So, at the top, somebody’s got to be responsible. You guys as well as I was, at one time are responsible for everything, no matter what happens at this end. So just a little tidbit there. Thank you. Tim Bohannon Give a little background of me. CPA, done over 65 manufacturing audits, over a hundred banking audits including a lot of depth around that and also — — including some 132 audits as well. So, I do have some background in this field. Couple things that come to mind: One, I didn’t see any metrics. Meaning, how many, how late were things? Was it one day? Was it 90 days? What was the average? What was going on with the mean of that? I didn’t see anything about the number of room differences. Tonopah has more rooms than Pahrump. Pahrump has more rooms than Beatty. Beatty has more rooms than Amargosa Valley, for example. making sure there’s a weight on that as well, from an analysis standpoint. Number three, how much was collected from the areas? Now, I do appreciate the list of the late fees of what’s missed, what needs to happen. But what I didn’t hear was: what policies, procedures, were being audited against as well. I know it’s a focused audit, but part of being a focused audit is having policies and procedures that you measure against and that’s a given. I kind of lay on what Ms. Hollis said, you know, there’s not a lot of detail or not enough detail. Probably more detail would be useful on this and provide more insight. But, you know, if we’re going to get better then what are the policies, procedures, and the handling of cash, collections, and then postings? All of that is part and parcel. Thank you. Michael David Garcia Hope all is going well, but what interesting times, you know what I mean? Kudos to whoever recognized this first. And, you know, beyond the lack of scope, you know, and lack of accountability and responsibility, I’m kind of curious to figure out what the correct percentage that Pahrump needs to be paying Nye County, you know, above and beyond 16%, to make sure that, you know, there’s an even playing field, as well as Tonopah, you know what I mean? Part of the responsibility and picking of the board matters, you know, in the town. I would assume you would assume responsibility for that as well. So, once we get past the smoke, you know, I think it’s a good thing that we can all come together and start, you know, realizing the difference between a one and a zero. Everybody needs June 17, 2025 something, and there’s no answers here from this audit. This is what we talked about earlier audits should, we should be more aware of what goes on. How did they get away with doing this? I had business before, and I never allowed people to pay. Was anybody ever confronted with this? Who could allow these to go by? I’m sorry if I’m not clear in what the procedure is, but it’s just, it amazes me that that much money can be shifted around by employees or who. Those are the questions that I have. I agree with every single public commenter that came up. Absolutely, you are correct. And if we go back four years, when Treasurer Prudhont, John Prudhont who, those of you who remember, was in charge well, he instructed — — a letter to go out. A letter to go out to the merchants. And I received many, many calls from angry and upset merchants that were told they were late that were late due to the NRS of when their payments were due and the data needed to be reported. And I was on the phone with the Treasurer, Prudhont, and asking him procedures, policies, etc., and who is responsible, ultimately. And I asked, “Who processes this paperwork — this information in Tonopah?” Because on the room tax sheet that the merchants fill out, it has the address of Tonopah. He said, “Nobody processes in Tonopah. It’s all done in Pahrump.” And I said, “Do you think maybe we could add the address of Pahrump, so these merchants aren’t late and being charged a late fee and penalty?” And I believe he added it to the sheet. And I asked him again, “When do you consider the payment and worksheet the room tax sheet late?” And his answer was, “As soon — — as my Deputy Treasurer inputs it into the system is when we accept it as being received.” And my response was, “Sorry, that’s not a good answer. That’s incorrect.” Why would we be any different than the IRS, for example? If it’s postmarked the 15th, it’s accepted, regardless of when they process that mail. But he disagreed. But I’ll move on. On March 4th, 2025, a public commenter said who’s here in chambers, as a matter of fact “I’m not exactly sure what happened, but this is not an employee issue; this is a managerial issue.” When the Commission voted on March 4th (and I did recuse myself due as a possible conflict), the Terms of Engagement letter Sir, Mr. McArthur — — on the second page, the Terms of Engagement letter actually is longer than the agendized item today. Then, on the second page of that letter in the middle of the letter the engagement letter, it clearly reads that: “We will confirm management’s responsibility for the filing and payment of licensees’ monthly room tax return. “And I didn’t see or hear any of this in the presentation. And that’s part of what this Commission agreed to, as far as the audit. Deputy l’s responsibility you know we have 21. (10-minute time limit) cont... June 17, 2025 a tier system: Deputy I, II, Ill they have different responsibilities, job duties, and functions. The Deputy l’s responsibility is to pick up and drop off fleet. “Fleet” is the mail that comes down to and from Pahrump and Beatty, Amargosa, Monday through Thursday. They deliver fleet. They are also responsible for the incoming mail: to be opened, worked, and distributed accordingly according to an email that I have from the Treasurer, clearly explaining their duties in regard to mail. I also have a document signed by the Treasurer admitting that fleet had been received for over two weeks and was in Pahrump before it was processed. But yet, the mail that was processed was late. So, who’s ultimately responsible? It’s not the past, present, or future Deputy il’s responsibility. Treasurer Il’s responsibility they’re merely data collectors, putting the information together. It’s the Chief Deputy and the Treasurer that are ultimately responsible, because that’s who the information is forwarded to. And so, I’ll ask: are they using a matrix? Did you discover any type of matrix during the audit as in the RACI matrix of who’s Responsible, Accountable, Consulted, and Informed? it didn’t sound like they have any type of matrix. And what’s the process once the room tax information is received by the Chief Deputy or the Treasurer? For both, it’s to review, to approve, to sign off, and submit for accuracy to the Finance Department for posting. And the State gets their information once it’s confirmed. And the townships receive their portion and percentage the larger amount. So, is this wrongdoing and misconduct of a public official? And as I prefaced with in the very beginning, I agree with each and every public commenters, because there should be an investigation a full investigation. A full audit. An audit that we asked for four years ago and it never happened. We, as the Commission, asked for it four years ago when the Treasurer, Prudhont, abruptly abandoned this county and the people the taxpayers. We asked for a full audit. It never came. So, is this a case of government, through penalties and interest, trying to take more of what’s not theirs? I don’t know. But that will come through, and that information will be provided through a full investigation. I want to thank you for listening to my information. I was in favor of this audit from the onset. But again, I recused myself due to a possible conflict. But there’s no conflict at this time none whatsoever.

I feel like I just watched a trailer for a movie I have no interest in watching. That’s kind of what’s going on in my head. I don’t really even fully grasp what is going on here not for lack of intelligence, but for lack of having the whole picture. There’s an audit that was done; we want an investigation. Normally, in a situation like this, you go to a County Attorney and County Attorney will probably argue with the DA about it but we, unfortunately, don’t have that luxury. We don’t have a County Attorney — we have a DA, who owes a duty to being DA, and then owes a duty to us. Which, in my personal opinion and people disagree with is a conflict. So, that being said, I — — don’t know who this investigation would do, if you wanted it. I’m fine with investigation. I don’t know is it a task force? I have a lot of concerns with this. Back in September of 2024, Commissioner Jabbour suggested that I make a disclosure about an item I — didn’t understand the necessity at that point. I’m stunned that there’s not a disclosure made by Commissioner Jabbour on this. All of these waivers are in District 1, and these waivers were granted by someone very close to the Commissioner. I’m stunned that we’re sitting here. I want a full investigation. I want to know who did this, who authorized it, and whether or not disciplinary action has been taken against the person who’s done this. That’s all I’ve got. DA Kunzi First understand that this is the first time we’ve seen these numbers. We asked to see the numbers and we got those today. This is the first sight in this process.

, I am the County Attorney. I am the District Attorney. That’s how Nevada has set it up. There is no conflict. I represent the County. I represent the people of the County. And I will be responsible for any prosecutions that may be necessary. So, again — there absolutely is no conflict. I think it’s important that we do a full and complete investigation of this, because there are a lot of issues here that have kind of been touched on. But it’s one of these things where one of the issues that I saw very early on in this whole process was this question about late fees. And there was an opinion that came out prior to my administration that basically said: Late fees are late fees, and it’s automatic, and they can’t be waived. Well, that is an incorrect statement of the law — because if the late fee, and this applies to the IRS, it applies to everybody, If the payment was not done, beyond the control of the taxpayer, they cannot be charged a penalty. That’s a very common principle of law. And no one’s ever tried to dive into that to find out what that is. And I know one example, that actually came to me, was on the day the tax was due, the individual’s financial manager quit, and the individual actually called in and said, “I can’t get it in,” because they didn’t have the capabilities of doing it. As long as it’s beyond the control of the taxpayer, we can’t charge a delinquent fee. There’s a lot to this that we have to dig into, the whole idea that, “If it’s not paid ...“ And now I’m hearing, really for the first time, the fact that some of these might have been paid, but then they’ve been sitting in a bag at the Treasurer’s Office waiting to be processed how are you determining when those were actually collected? How can we charge penalties? And we will do that. Again, understand there’s a lot of nuance here. And it does deserve a full and complete evaluation. And I can work with Mr. McArthur and plug in everything that we need to do from the accounting side of what I need to see and we will work together to do this. Because I certainly won’t be able to do this without his assistance. But it is something that I will do. And we are taking this seriously. And I don’t disagree because we don’t know who’s really responsible here. Was it the clerk intaking it? What oversight was done through the Treasurer’s Office? It is something we have to take seriously. Let’s please not jump to conclusions about who’s responsible for what. We don’t know. And that’s why we think we need to do the investigation. You voted for it. And Mr. Chair, if you don’t mind yes, — — Pahrump is on this list. Part of Pahrump is District 1, and the majority of these motel- hotels lie within Nye County through District 1. Now, Manhattan, if you look at this list — I’m not sure why Manhattan is even on the list. When Manhattan and Round Mountain — I know there’s only a six-room motel in Manhattan but Round Mountain and Manhattan fall within each other’s ordinances, and they don’t have a due date. So, if there’s no due date, there’s no late penalty. I’m not sure why they’re even on this list. Even though the money was very short. The Amargosa, Beatty, Gabbs, and Tonopah have a due date of the 15th of the month. Pahrump has until the 30th of the month. We have the 15th, we have the 30th, and we have no due date. And there’s no consistency with these hotel-motels. And it’s not just hotel-motels it’s also RV parks. And yes, one of the commenters said that I’m well aware of room tax, and I’m well-versed in what happened and so, I agree that yes, the majority of these are in my district. It’s a very large district it’s the largest district, territorial district, in the United States. But I hope that that’s what you’re meaning by “everything on the list.” Everything within the County that falls under room tax is on this list, processed by the same person or persons — whoever it’s assigned to. Absolutely. And just to clarify Commissioners, and to the — — public is I asked specifically, because of on March 4th I recused myself: would I need to recuse myself now? And Legal’s answer was, “No” I did not have to recuse myself and I would be able to speak on this. I just wanted to give clarification. I’m not sure why you’re ... I’m stunned at these numbers, but I know why some of these numbers exist. If you go back to 2021, we’re talking just coming out of, and during and coming out of, COVID, where some areas had no mail service. We had people driving up to Tonopah to hand-deliver their information and their checks so they wouldn’t be deemed late. We had mail service issues, we had fleet issues, we had personnel issues. And please let’s not forget that coming up next month, we’ll be well within another month and a half — — we’ll be receiving our tax payments that are due. And you’re now extremely busy — everybody is, during those months. So, if you have any questions, I’ll be happy to answer them. Because I’ve been involved in this since Treasurer Prudhont was on board and professionally arguing with him over the Beatty issues and Tonopah issues. The Tonopah general manager of the Mizpah Hotel which, a property very dear to my heart, that I oversaw the renovation and reopened as the general manager called and said, “You should be thanking me, and [kissing], for opening up another hotel across the street,” the Belvada “instead, you’re telling me that I failed to submit documentation — — for rooms tax?” Well, I’m sorry. You know the rules, Mr. General Manager rooms tax was due. He was wrong in that respect. It goes on and on and on. I’ll be happy to give you all of the documentation that I have, Mr. DA, for this investigation, if you choose to have it. Because the majority of this is not generated by me this is from the County. So Mr. District Attorney, just my two cents in this whole thing is: we need you to figure out where it went wrong. My discussions earlier today with Lorina — we know there’s a problem. It could be here, it could be here, it could be there ... it could be all of them. We don’t know, because the process sucks. If processes are bad, things like this happen whether people want them to or not. But it’s going to get worse, because now we have bed-and-breakfasts, and all the homes around here, that now have to also pay bed taxes. So, it needs to get fixed pretty rapidly but, I think, it’s probably going to take a little bit of time. And the fact that they stamp an envelope with the date they got it, and then they take something out of it whether they stamp that also or not does it stay with it? I don’t know. All of that gets lost in the funds. So, please let us know what you find.

I’ve been in this business, in law enforcement, over 30 years. Right. And what I’ve learned is: you can never assume anything. You have to go in with, basically, a blank mind of what is there. Because I do feel that if people owe these penalties, they should pay. And the only way we can pay Tonopah is if we can collect. So And ... Tonopah is already knocking at the door. Dan McArthur Just to clear a couple things up OK? I heard the word “forensics — — audit.” I was not engaged to do a forensics audit. Had I been engaged to do a forensics audit, it would be far different than this. I was engaged to do an agreed-upon procedures audit. If you look at the letter that I submitted, it shows six items on here — specific procedures that were in the original engagement letter of what I was going to do. OK. So, everybody knows all those in the audience, all those listening this is not — — a forensics audit. This is just a start at saying: Here’s where the numbers are. Because I’m not law enforcement. I don’t do those kind of investigations, and that, obviously, would be turned over to the District Attorney. Just so that’s clear: this is not a forensics audit.

I appreciate your comments on that. Part of the reason this is an issue is because I’ve had six calls since this damn agenda was posted accusing me of covering something up. And they’re saying that because there’s no backup, there’s no list of properties, there’s no nothing. So, I’m fielding these calls, and I don’t ... know what the hell to tell these people. I feel the same way. So, we do need the answers, and that’s what the DA has agreed to do and I’m satisfied with that. Dan McArthur As auditors, generally, you’re not going to see an auditor unless it’s a — — forensics audit list detail names of individuals that may be examined. So, one of the reasons you do not see hotel names here is for that purpose. We weren’t necessarily engaged to list a bunch of hotels here. Generally, review it as unless I’ve had the opportunity to go to each one of those hotels and discuss with them our findings and get their input back to me on it you’re never going to see me put their name in there. Because they never had a chance to respond to the findings, which then would take it to the District Attorney level. So that everybody understands that it’s not to hide things. It’s just the process that we go through here. Nobody’s hiding anything here. This is just an initial report here. Just one ...a couple other things. One of the issues is that the room tax ordinances that exist indicate that as Commissioner Jabbour said the room tax — — has to arrive by the 15th of the month. A lot of people are used to it has to be stamped by the 15th of the month, or the 30th because we’re so used to taxes and other things in our lives. This requires it to be in the hands of the Treasurer’s Office by the 15th. How June 17, 2025 do you document that? So, those are some of the issues that will be continued to look at by the District Attorney. I just wanted to clear some of those issues up because I can see the questions. Because I’m sure this is not the tremendous amount of detail everybody expected but there’s still a ways to go with this. Thank you. SHERIFF 18. this item has been brought to you because the Duckwater Shoshone Tribe has no facility for housing arrestees. Traditionally they have always used outside of their confines, and they’ve been using Nye County Sheriffs Office facilities for years because basically we’re closest to them. It’s my understanding that for many years there was no fee to house inmates and the representatives behind me will clarify that a little bit for you. We have it we had been charging since I took over but what happened was that the government has cut funding for a lot of things. The Bureau of Indian affairs is no longer a thing, it is no longer in existence or barely, and so at this point in time they’re tribe has no funding to provide to pay for the housing of their inmates. Currently I believe we have 4 inmates in our custody of their sentencing and so we need some solution for this whether it be to waive the charge that we have been charging. Or what are we going to do?

I think before sheriff McGill came on board, the former sheriff was approached by the Yomba tribe asking for there to be an MOU for housing any arrestees into the Tonopah jail; and that MOU is revised; and that’s why they started charging; and I want to say that that may be the very reason why it went over to The Duckwater side. That was prior to Sheriff McGill coming on board. This is almost $80,000 and for the $127.84 that equals 614 inmates if I did my math correctly. I didn’t realize we had that many problems coming out of Duckwater, so I think the math is incorrect.

I got to be honest I don’t know where that total number came from, I think that came from finance or I’m not sure where. I find it hard to believe that number is correct. There is a background that needs to be aware of, but I will let them clarify. June 17, 2025 Police Chief Jamie Lucas I am the Police Chief of the Duckwater Shoshone Tribe come July I’ll be the Chief of police there for four years now. It’s been a lovely community to live in. They’ve got great people but just like with any community we do have some bad apples that do come in. So again, I just want to thank each and every one of y’alI for giving the Duckwater Shoshoni tribe the opportunity to personally be here and talk to y’all about this this humbly request. Just to give you a little bit of background when Sheriff McGill was elected, Sheriff McGill and I met and entered into a MOU with each other, allowing the tribal police officers and the county deputies to be crossed deputized to assist with each other’s public safety needs. The Sheriffs Deputies allowed 18. We’ve answered many calls on behalf of the Sheriffs Department to serve the citizens of Nye County and that’s the great thing about what Sheriff McGill has given the Duckwater tribe is allowing us to trade off those services and work with one another so that we can continue to protect the communities that we serve and the best manner that we can. I think we can all agree that law enforcement not just in Nye County but across the nation are hurting; calls for service continue to rise; law enforcement continues to have to do more with less. We understood that I understood that 32 years ago when I first got sworn in as a police officer. But the need to continue to protect the communities from the very individuals that constitute the criminal element is a need. With that being said in August of 2024, BI and Congress cut our funding and facility availability.

I guarantee you have not had that many arrests that we are at $78,000 since August of 2024. Hear that Chair that that amount is incorrect. I’m not sure we can continue with this item. I’m sorry but we don’t have a DA here, this is a problem.

I’m being assured that number is accurate, again that could be based on the fact that while we were at lunch we were talking about the fact that in past inmates from the Duckwater tribe would spend a day or two in our facility and then go to a federal BIA facility; so it was very short term now they no longer have access to that BIA facility; and we do have inmates that are sentenced to tribal time that is being spent in our facility; so there are longer term now than they used to be and that could be why this number is as large as it is. Manager Waggoner- looking at the invoice, one month is $1 1,500., another month is $14,000, so it would not take that long to get to that amount.

Unfortunately, this past year and a half we’ve had an increase in crime with meth and with people that are being placed on probation that has violated repeatedly. So do we continue to allow these people to victimize Duckwater reservation and with our limited resources I just don’t know what the answer is, we can do our best. 18. it’s paying for inmates for 10 months; so that explains something; so, we’re basically housing people because they can’t participate in open society that’s not our job. Manager Waggoner Just to clarify there was $50,000 in invoices just from mid-2024 to February 2025; then you get to the $11,500 invoice and then the $14,000 invoice. That is why we suggested this come to the Board so you guys can decide.

so do they go to trial at some point, or do they just sit in our jail? Police Chief Lucas- Once the arrest is made, within 72 hours our Tribal Judge sets bond and depending on what charge it is they normally are released on OR, given a trial date and in some cases, they are put on conditions of release. While they’re out on those conditions of release, they’ve also violated the conditions of those releases, so it’s just a vicious cycle of what we’re having to deal with. It’s nothing new law enforcements had to deal with this I’m sure the DA can speak to that. You and trust an individual with their word, but their actions speak. So just to clarify I believe our Vice Chair was wanting to make sure that although that these are natives they’re not all tribal from our tribe, they do come on the reservation and they are treated under our tribal courts; we’ve also had nonnatives that have violated NRS’s that we have arrested because of the cross deputization and that’s been submitted to the DA’s Office for prosecution.

I just want to say for the record, MOU that we have with other agencies whether it be Esmeralda County, we are housing their inmates Duckwater, Yomba require that if that individual is released from our facility, they respond. They pick up that individual, they take them back to their jurisdiction where they are then released. So, for the public’s edification, they’re not being released into Pahrump.

and Chief two things; they are not handcuffed when they are returned to the reservation and are the crimes being committed outside the reservation. Police Chief Lucas- I cannot answer if there are crimes being committed outside the reservation, I can only speak on what has happened on the reservation and either being non-native or even native that being either part of Duckwater Shoshone tribal enrolled members or other tribal members from other reservations that come visit. I cannot honestly give you the number on that.

I think you understand where I am coming from. If they are walking off the reservation and they end up in Railroad Valley, it’s back in Nye County and then you’re arresting them and then contacting the sheriff. I’m just looking for a guesstimate, is any of that occurring or is it all on the reservation? Police Chief Lucas- I cannot answer that because we have not had a reported call. Now if we were to get a call where the Sheriff says Jamie my units are in Pahrump, you’re the closest unit, we have something in Railroad Valley would you respond, and we ended up finding a tribal member and arresting them for NRS violations then yes it would be off reservation.

I think I can clarify that for you, if they are in our facility for tribal court then the offense occurred on tribal land. I think you’re asking are they were committing crimes outside or are they walking away and I think Chief Lucas did not understand June 17, 2025 what you were saying. These are crimes committed on tribal land, gone through tribal court and because they many of these occurrences have been sentenced to do county time, this is where they go. All the transports are conducted by the tribe, but it takes them away from patrol for hours. Chief Lucas- it is just me and one other officer. I don’t believe we have had an incident where a tribal inmate was released from the detention center where they didn’t have family or someone pick them up. We don’t have a homeless or issue of them walking out of your out of the Sheriff’s jail into the county and having nowhere to go; they do have loved ones and relatives that do go and pick them up. Anette George Vice Chairwoman for Duckwater just for a little brief history, back in at the end of 1983 starting of 1984 my sister Wanda George was the quarter Shoshoni tribes first law enforcement officer tribal, and she brought the inmates down to the Tonopah jail back then and I just talked to her, and she said that we never did get 18. All of these years and I’ve worked for our tribe now for 40 years and we’ve never seen a bill from Nye County. Also, we’ve never had long term inmates, and we’ve never had a high crime, but in recent years we’ve had, like Pahrump, visitors that come in and then you see occasional crime and arrest. Debra O’Neil Chairwoman for Duckwater I was able to get on the agenda. I believe as a leader we want to work with our local entities although a lot of our business schools into White Pine County when our officers are taken out of the area to respond to your Sheriff, our one resource is gone and the other resource isn’t there; They’re not even in the area, so it’s scary but he informs me I’m off to Tonopah, now Pahrump, 5 hours one way. It takes that resource from our community; and not being charged before; and with the cuts across the board, not just our tribe, but across the Nation it’s had an effect on us. We have not seen a bill since last fall or summer, so when our Finance Manager met with me before we left yesterday, she said we got one bill for an invoice for 14 and 11 and I said let’s pay that. But no comparison to how many hours our officers or our Chief of Police are off, it is five hours and five hours back or staying in Vegas, whatever it may take. There are costs associated with that. There’s not 4 in custody, there should be 3 right now, and two of the three is not from our reservation. We will take them back to their reservation. Our contract is up with our judges, our prosecutors who’s now finally doing due diligence and are making sure these guys are paying for what they’re doing, many of them are repeat offenders. Our tribal council has the authority to exclude people from our reservation, we are like a small little country and those that are not from Duckwater will be asked to leave. We don’t want to have to come and talk to you guys again to ask for this, but we normally do not have that many people incarcerated. June 17, 2025

O’Neill, I have a question please through your tribal court whose sentencing these people, whether they’re visiting from another tribal reservation or they’re from your reservation, do they have the authority to sentence them to community service in Nye County to pay off the debt of what is being proposed to be waived? Police Chief Lucas- I do see where you are headed with that, and yes, the tribal judge does have that authority, but unfortunately if we have a first time or second time offender, but pretty much all of them are repeated offenders being out on bond or on probation. We do not have a jail.

also, I also want to say where is that individual going to stay during the six months, that it’s going to take him to fulfill his community service?

I don’t think I can go along with this; we have guys in the fire department; we don’t have money for their bonus; the police, we have to tell them they we have no money for their bonus; there’s dogs cages; we don’t have money for their 18. I understand that we didn’t know what else to do. We want to be good neighbors for the Duckwater tribe, for the Yomba tribe, and for Esmeralda County. Where do we go from here? That’s our problem. Manager Waggoner this doesn’t even include the last months or this months or next month’s invoice. The biggest concern is we’re already looking at in our future item an $800,000 deficit.

Chief you realize we defer to the Comptroller to remind us of our financial situation, healthy or not ,and we’re already in a deficit in regards to the jail fund; and that’s where this would go to; so we’re already in the negative; it’s not that we have money in there to say yes we’ll do this; and I’m speaking because the motion hasn’t been made and a vote isn’t being taken at this time. I’m speaking as one Commissioner we’re in the negative and so we can’t give what we don’t have. Police Chief Lucas- I do understand, unfortunately I’m going to have to release repeat dangerous individuals back into a community, it’d be Nye County or back into Duckwater. what we are doing today is not correcting their bad behavior, it’s not rehabilitating them, because obviously it’s proven that whatever we’re doing we’re housing them, they’re an inmate in the jail, they’re in the general population, they’re being fed, they’re given clean clothes, and a bed to sleep in, but they’re not being rehabilitated. So, of course, when they get out, they’re going to be a repeat offender. Police Chief Lucas- I understand that our court has tried alternatives, offered services and unfortunately just with a few bad apples that are now in custody that didn’t take, and I don’t know how long it’s going to do that. But I do know that if we try to do offer some value and that is we might not have the resources to pay for the inmates there. But the Police Department is post certified, we are cross deputized, and we are willing to take calls on that end, so that the Sheriff doesn’t have to release his men or women in law enforcement from Pahrump, Tonopah or anybody anywhere else of those resources. Because they’re limited to him too, and we don’t mind taking the calls for the Sheriffs Department.

I will say based on the MOU they do respond to calls on our behalf, actually frequently it’s not uncommon that they will respond to Gabs for a call that we would be responding to, but they get their they are able to get there before us or in the extreme north, but we’re still going. Right now, the medical late fees say that you just pay one late fee, but the adult uses you’re paying every month that’s past due, so we want to just make consistent. the other part is after 90 days if you still haven’t paid, the adult use fees say that you have a show cause hearing and a possible suspension or revocation of the license, but the medical fees say that it’s an automatic suspension of the license so we want to change that to say that it’s a show cause hearing and possible suspension or revocation, just to make them both the same.

within 10101, we do a balancing. the function 1st and then between functions. We have several functions within our 10101 general fund, and there are departments that are over budget, there are departments under budget, and this is just the movement. The net impact of this is 0, except for when we’re pulling contingency of $860,000, that is leaving our general fund and going into the jail fund and Manhattan water enterprise fund. You can approve these, because the contingency has to be released first before it can be used for its purpose. It’s just the procedure that we can release the contingency to be used somewhere else. This needs to happen separately as its own budget transfer item, before the actual movement of the cash takes place to wherever it’s going, whether it’s internally or externally, we have placed it on here because that contingency is part of our general fund. The board has to approve releasing that contingency. That is in the backup. It will be page 8 of 8, and that June 17, 2025 contingency, as you can see the middle column, it holds the revisions that we are proposing to this budget. You will see the contingency that started out with 946,936 contingency, is somewhere in the middle of that table by itself. You see the negative $860,000 leaving, which leaves contingency at 86,936.

With our lost revenue from not doing ice since November last year, there’s a shortage of cash. We did not anticipate that happening, and so we actually thought we were going to get raised revenue and so we did not budget enough for a transfer from our general fund. Now we’re having to make up for that by transferring what we didn’t budget for because we thought that we would get more ice revenue, and we didn’t, and so we tried to offset that by closing Tonopah, we didn’t close it until officially until May. This should stabilize and this is to get us over in in the green for the end of this year, which is the end of this month, so this is to cover the deficit for this fiscal year. June 17, 2025

This is the cash deficit amount for the Lakeview golf course. We have been operating for several years with a net operating income of negative, which is allowed by NRS because it is an enterprise type fund. Normally, that’s not allowed either, but because it’s an enterprise fund but the rule is that we must have a positive cash balance for that enterprise fund, and so our goal here is to at least break even. After several years, about five years, we have dipped into the negative. Not by the amount of 60,000 that we are projecting a little bit of a buffer to hold them through working capital for the next several months. Since this fund actually gets room tax from Pahrump a percentage but primarily is funded by its own operations of you know green fees and rentals. We are currently working on cost saving measures, and we’re taking a detailed look at the financials to see if we can gain some efficiencies and make some adjustments to improve the bottom line for this for this account.

a few of my questions have been answered because we’ve been mentioning they and them, and I’m now to assume fully that this is the management company that’s running the golf course is that correct. for years now, we’ve been augmenting them in this group. They’ve been running in the red. They stood before us the last four years stating that they are professionals in this business, and they have 40 other golf courses across the nation that are in the black. My question to them was, well then what’s wrong with our model, why aren’t we in the black. But we consistently and continuously run in the red and we continue to augment this golf course. This came before the Commission three years ago for consideration to sell the golf course, and I will tell you that I was opposed to that at the time because we were under a contract with the management group and promised to give them an opportunity to prove themselves to get this golf course in the black. I agree with some of the commenters that it’s time to really hold them accountable financially and either they’re going to step up and do what they need to do because they are for profit they are in the black this corporation that’s running 40 other golf courses in the black, but we as the 24. For Possible Action Discussion and deliberation to adopt, amend and adopt, or reject Nye County Resolution No. 2025-16: Cont... county continue to help and assist them and basically bail them out when we don’t have the money to continue to do this. So, I cannot support this at this time, and I hope that it comes before us soon, as I’m not quite sure when their contract is up to come before us to decide whether we’re going to keep it or to sell it.

This item is required to be passed; we have to be in the positive per NRS for this fund like it or not. I think the other question about whether to sell it or do whatever with it is another agenda item, and I do want to point out that when we June 17, 2025 consider any major decision like that, I do think that we have to discuss what the capital renewal plan is. because our management company is not responsible for that. room tax is not enough currently to cover the true expenses that would truly be needed to take this building into the next five years. So we are at that point, but I do think that that is a capital improvement planning process that has to take place and then we can truly see how much that’s going to cost, and then the board can decide whether or not to fund that. Our management contract has been renewed for the next 5 years, so it has been renewed, but they are not responsible for capital renewal type development.

l just want to restate that we need to redistribute our room tax. Manager Waggoner this is essentially a park. We have several different things that are collected for every single house that gets built in this town, our impact fees for parks, so I think there is a possible funding source. We are being very scrutinized on this company, and the expenditures, on their marketing plans. I’m on the job and I would be very surprised if we’re looking at this again come this time next year, because it will change one way or the other.

another Enterprise fund, this is necessary to put it back in the positive, because currently it is in the negative in cash. the amount that we are June 17, 2025 transferring from our general fund is enough to carry them through to next year as well. So, we don’t have to do this again, this is occurring because there’s not enough in the Manhaffan general fund to actually make that transfer within their own entity, and with a population that’s declining 66 people on the census that was budgeted, and it was down from 145 people, so it’s a small town and their water fund is a utility that does not receipt in enough charge for service, so we must actually supplement this to bring them into compliance with NRS.

The other thing to consider, is they gave 30 days’ notice. After that it falls on the director until we figure this out. and I believe that the next item that was pulled will have to be able to get some numbers from HR etcetera what it’s really going to cost us. plus, as of July 1st the new program that we all voted on and approved included Round Mountain, so there will be some revenue generated coming in. Director BoIling- we’re already seeing revenue from that program which hasn’t even started yet, because of the haulers licenses that the haulers are having to purchase in order to be able to continue doing work after July 1s1• so we’re already seeing the revenue generated, the cost to pay the contractor for that landfill the 17,000 a month was included in those increases that we voted in in January. ultimately the cost for the landfill itself, the whole thing is already covered by what we projected to intake based on our revenues that we’re going to have. So, it’s not going to be anything that we haven’t already planned for anything that we haven’t already started generating funds.

Jurisdiction is key to enforcement. Can you show a current map defining where the exact areas your planning authority covers? 14. A planning district imposed without the legal process, such as missing petitions or misapplied statutes, risks being invalid. How do you ensure legal compliance with zoning enforcement in Pahrump? 15. The VR zoning designation is being used to deny permits, but was originally meant for fully serviced residential land. Who approved this zoning for lots with no infrastructure, and on what legal basis? 16. If these lots were never eligible for development under the current zoning without services, Why did the County allow their sale, taxation, and continued marketing to the public for decades? 17. The County has been aware of the zombie lot issue for years. Why hasn’t a long-term solution, such as a zoning overlay, zone change, or alternative utility systems pilot area ever been proposed and implemented? Hundreds of zombie lots will be headed to tax sale and in most cases, the County benefits far more than if the owner simply paid their 3-years of property taxes. When these lots sell for $3-$5,000, it’s substantially more than the few hundred dollars owed, even with penalties and interest. The County may cite the costs of staff, mailings, and follow-ups, but when no one claims the overage within a year — which is usually the case the County wins even more. Nevertheless, the lots are sold at auction with no mention being unbuildable. When buyers find out later, they’re told it’s their due diligence. So, how is this not a conflict of interest? And who really benefits from keeping these lots stuck in a broken system? 23. State agencies say it’s not their issue. County staff blame the state. And year after year nothing changes. So, who Is finally going to take responsibility to fix this land use failure? 23. These aren’t just zombie lots they represent forgotten people and failed policies.
