Brian, I have a question for you. I have heard that there is a threat of a class action suit by the zombie lot folks against Nye County. DA Kunzi- We shouldn’t be talking about this during public comment. It should just be public comment. Laura Stewart- A couple of months ago I was reading the editorial in the Pah rump Valley Times, and it talked about all the migrants that are infiltrating Pahrump from Oregon, California, and Washington. At first, I didn’t think much about it because we were leaving August 5, 2025 to go out of town to my granddaughter’s graduation back east. The vitriol started getting so bad I’m thinking wait a minute I’m not a migrant how dare you call me a migrant. Then when I started heating up, I thought, you know if somebody decides that they want to stop me for something and question me, I thought maybe the migrant thing would come up. I stopped by the Sheriffs Office, and somebody was nice and called me but of course I don’t think they understood my whole concept of the migrant thing. I think people need to realize that it’s people like me and my husband that come in and pay our property taxes; we don’t have vacant cars on the lots that we’re not paying our insurance on; that we’re not paying our registration on that would fund the county and fund Pahrump. The only real people that are not migrants are the Paiutes and Shoshones If you look at it that way, you’re calling me a migrant, and you are too. The tone needs to tone down. People can’t get upset just because we’re from Oregon. I’ve lived in North Dakota, Oregon, New York, and Missouri. I’ve had great jobs that have taken me all over the world and lived in these places. It’s just been within the last couple of months, I would have saved the article, but I didn’t think it would get to this point where people are getting angry with everybody. I think everyone needs to calm down, tone it down. Yes, I’m from Oregon. Yes, I’ve lived in California. Yes, I’ve lived in New York. Yes, I’ve lived in Missouri. Yes, I’ve lived in Hawaii. But I pay my taxes. I value my citizenship and that’s why I live here. I value Pahrump from the history of my family when they came here in 1952. Loraine Gilbert- Good morning commissioners. At this point many of us feel like we’ve already said everything that needs to be said. Yet here we are again. Month after month we’ve come forward with research, solutions, facts, and even contacts and resources. We’ve done phone calls, digging, writing, and coordination. Work that frankly should have been your responsibility to help us bring an end to this nightmare solution. But the fact of the matter remains that nothing has been initiated by this body, and the core issue still remains untouched. We continue to be brushed off, delayed, and misdirected with excuses instead of solutions. It feels as if we, your constituents, are having to jump through hoops and perform acrobatics not because progress is being made but it’s easier just to keep us busy, instead of taking meaningful action. Meanwhile families who have owned property in this valley for some decades are still barred from being able to use that property. The simplest and most direct solution has always been from the very beginning a zoning change. I just got my tax bill. I can only use my lot to have a picnic and stargaze. If I did that at National Park every month that cost would be less than my taxes. So again, the simplest and most direct solution is a zoning change. Not another study. Not another deferral. Not another layer of red tape, but a zoning change. Other counties have used zoning adjustments as a tool to address similar situations. Here we see selective responses. Some questions do get answered, others are avoided, some suggestions are entertained, such as Mr. Conan did. We are put aside month, after month, after month. The result is the same. More delays, more frustrations, and no resolution. Every day that this drags on, it affects real people, real lives, in this county. Your constituents. We don’t need more stall tactics. We don’t need more shifting of responsibility. What we need is zoning. A boat. A decision. A zoning change that allows landowners to responsibly use their property while infrastructure slowly catches up. Commissioners, you do have the authority to make it happen. August 5, 2025 Tina Bond-Klugin It’s been brought to my attention by several people, groups and news stories that Southwest Wild have taken upon themselves to stop traffic when horses and burros are near roadway. They talk about it in an article I attached and sent to you guys but it’s also on the group’s Facebook page. They have even advertised that if people see the horses near the roadway, call them, they will come down and stop traffic to help the horses across the road. I’m not sure what state, town, county, or authority has allowed this to happen. I am a former traffic control technician from Hwy. technology Southern Nevada, paving Craven construction Las Vegas, paving and premier traffic control with the training for these types of work. This group does not have the training nor the equipment, let alone the authority to put lives in danger to stop traffic to allow for a donkey or horse to cross the roadway. This rescue group is getting out of hand with the things that they think they have the authority to do or say to the public. Please don’t misunderstand me, I was part of the original group red pose before Victoria came in and took it over. I want to protect the horses and Burros just as much as everyone else does. I have time and time again taken water to Wheelers Pass trough when it was broken. I’ve helped with fixing the horses fence last year. I want to do it the right way and the legal way. I don’t believe in putting them in a sanctuary, holding them to 100 acres that is not keeping them wild. Can you say something about this group interfering in traffic before someone ends up killed including themselves or worse sued for being a traffic control technician? When I wanted to shut down a roadway, let’s say for example the 15, I cannot take that first lane until 9:00 PM. I could not take the other two or three until 11:00 PM. You need a traffic control plan to close a highway, roadway, or street even in emergency situations. If there’s an accident, the first phone call besides the police and ambulance must be to NDOT. They’re the only ones that have the authority to close the roadway. These women are taking it upon themselves to put the town of Pahrump’s citizens in danger anytime they try to stop traffic at 55 miles an hour just to help a horse or a Burrow across the street. Every state that I have lived in has its own issues with different animals on the roadways. My first deer that I hit, I was probably about 16 years old. The second animal I hit was a pheasant which took off the whole front of my vehicle. Now I don’t want to see any horses or Burros hit but I also don’t want to have some woman standing there in the middle of the road screaming and hollering trying to get traffic to stop just so she can help a burro or horse cross the roadway. We need to do something before something dangerous happens to anyone in and around that one 160 or 372 which seem to be targeting the most. Linda Clark- First thing I want to say is I think we need to change our master plan. I think it’s been a long time since you’ve done anything on it. I’ve only been here five years, so I haven’t really tracked it but from what I’m seeing in the community and desires of our community we’re not meeting the needs. Second thing I read this week and I’m going to quote someone but I’m not going to name their name if you want to know I’ll tell you after the meeting because I’m not going to say it right now. There’s a couple of people that want to run for office here which is a good thing, I suppose. It depends on who they are and what their policies are. But one of the things one of them said was that we need more community engagement and 1100% agree. You guys don’t listen to anything we say, you may listen, your ears are perked up but that’s about as far as it goes. We need to listen August 5, 2025 to more of the feedback. I already have a whole bunch of it today. I’m going to follow up a little bit with what Beth said, we need to pay attention to what the people are saying here. We’re paying taxes, we own our homes, we’re taking good care of our homes, we show up here try to support our public servants and as far as I’m concerned, we’re more of a servant than some of you. We need more transparency. We don’t know most of the time what the hell you guys are doing. I’m sorry if that offends somebody because I use the word hell but it’s in the Bible, so I think it’s okay. Anyway, why can’t we pay attention to what the public request wants, our needs, and instead of you guys just going ahead and doing what you want and thinking that we’re going to agree with it? Most of us haven’t and it doesn’t seem to make any sense. I know a couple of you are up for office, if I was you and your seats, I’d be afraid. You’ve made a lot of people mad in this community and deservingly. We’ve had a lot of things happen this year that haven’t made a lot of people happy and a lot of it has to do with public servants. I am going to stay later If I can stay here on the full time of your meeting today. But that’s one of the things that I have a major concern with is this is my home. I moved here because of the environment, the mountains, everything else. The people are wonderful, most of them know we have a lot of influx from people that we don’t probably want here. Jody Reddington- I’m the owner of a property out in Calvada Meadows. I just received my property tax bill, paid my taxes and noticed that there are a lot of resources that my tax dollars have funded. Yet because of this repeated request with the zoning change that isn’t happening I’m unable to develop that land and participate in any of the benefits that my tax dollars contribute to. From a previous meeting it was stated that you’re open to receiving information on the alternative utilities and options that would support this zone change. It’s my understanding that that information has been provided although I do not know if you’ve received that information. If you provide a name and address, I’d be happy to send more information as well but if this information is then provided and you receive it, I’m at a loss as to why this zoning change just simply isn’t moving forward. Having to stay stagnant and just kick the can down the road is just mind boggling and ridiculous. It’s been proven to be successful in other places. I’ll be happy to put something together and send it. I just don’t know where to send it.

Richard Goldstein- This Thursday is Purple Heart Day, August 7th• We will be holding a Purple Heart ceremony at the Veterans Memorial Chief Tecopa cemetery at 6:00 PM on Thursday. I invite everybody to come out. It’s a very interesting ceremony. Supposedly we’re having some kind of surprise at this event that Doctor Waters won’t tell us about. I’d like to see, hopefully we’ll see all you commissioners out there to attend. That’s 6:00 PM on the 7th which is Thursday at the Veterans Memorial of the Chief to Tecopa Cemetery. The second thing I have is Sheriff McGill, Red Butte Ave. or Red Butte Street is two lane road. Very narrow. I see absolutely no reason for your deputies and the fire department to run code on that street at 80 miles an hour. Somebody is going to get killed. They come down that street for some reason they use it as a thoroughfare and the speed they’re using is just ridiculous. Please tell your deputies to slow down. August 5, 2025 Amy Nelson- Good morning commissioners. I went down and paid the tax bill this morning and I was going to speak on these issues before, but now you know it must be said. I’m not sure who’s the Republican and who’s a Democrat on that board. Democrats want more taxes; they want more government. Republicans are just the opposite. The only ones that I’ve seen in the last year, anyway, it seems to be Republicans commissioner Boskovich and our new commissioner Bain. The rest of you, I have my doubts. I have a special assessed tax for $43, on top of having to pay when I go to the dump, on top of what I must pay when they pick up my trash. It’s ridiculous the amounts that are thrown in. People look at it, well it’s not a tax. Yes, it is. Anything that you put on us, on our property tax, or anything else that we’re going to use, that’s a tax against us. If you don’t think that we are aware of it, think twice because people are going to remember this come time for the election. Those of you that are up for election should think twice and reduce government. Get rid of some of the boards, get rid of some of the ways that you have. Bring in a DOGE and clean up this department and all the boards. When I moved here and my mother was here back in the I 980s and 1990s you could count on one hand how many boards there were in this town or this county. Now you can’t even name them. It’s getting out of line and people are watching. I’m sure there’s going to be a lot of people running for office and this time they might make a change. I don’t know each year I keep saying that and each year I keep seeing the same thing happen. Anyway, it’s really gut wrenching to keep hope and to look forward to new people and see it just repeats itself year after year and get worse. I hope it changes soon. Tom Waters- I’ve been asked many times about the status and what’s going on with this initiative to reinstate the Pahrump Town Board. Today I’d like to give you an update on where we are. From the town board committee is on track to get the question we established the Pahrump Town Board on the ballot. However, we’re still in the early stages and a lot still needs to be done. Each step will require a lot of support from the Pahrump community. We have some dates and times that everybody needs to remember, the 11th of August is a Monday. Next meeting of the Pahrump Town Board committee, it’s a private meeting. We’re still looking for members and if anyone is interested in being a member of this committee they can contact me, Doctor Waters, and my number is 702- 379-3449. Then on the 20th of August, which is a Wednesday at 11:00AM, there are five members of the committee who will be at the Nye County Clerk’s office to initiate the petitions. On the 22nd of August, it’s a Friday, town hall meeting at Nye Communities Coalition to answer questions for the community. It’s going to be starting at 5:30 PM and we’re telling everyone come out and get your questions answered. We will let you know the difference between the different locations where you can sign the petitions and please understand that businesses that allow petitions to be signed on their property are not endorsing the town board. They’re only agreeing that the residents should be allowed to vote. And please remember, the town board has no authority to increase taxes. Anyone who says otherwise is either misinformed or purposely misleading. September 25 through 28 is the fall festival. The Pahrump Town Board committee booth is for information, petition signing, and donations. We need your help with expenses as we endeavor to reestablish the Pahrump Town Board. Donations, the Pahrump Town Board committee is not classified as a nonprofit organization by the standards of the IRS. Therefore, your August 5, 2025 donation is not tax deductible, but we thank anyone that contributes for your generous support. That’s all I have for the update on the committee to reestablish the Pahrump town board. I would like to say a comment was made about the Purple Heart Day ceremony. We do have a surprise during the ceremony it’s an event that has never happened before and will never happen again. If you’re there, you’ll see it. If you’re not there, you’re going to miss a treat. A once in a lifetime event that’s what Richard Goldstein was talking about. It’s a surprise which we’re encouraging everyone to come out to the Purple Heart Day ceremony on Thursday August 7th at 6:00 PM. Diane Southworth-. I have some concerns about what’s going to be happening in the future here in Pahrump. With the cuts that are being made to snap and the fact that the food banks are getting cut off from the amount of food that they’re getting and that’ll put more people in harm’s way. I don’t know what we’re going to be able to do about it other than we’re going to have to get together and decide how we want to work on this. As people it cut on snap or some of the other programs that are there then there are going to be more people that are going to need more help. We might find ourselves in a more homeless situation than we have now, It’s something to consider. Most people do not want to be homeless. There are some out there that do usually because they have some mental issues. I think that we should really look at addressing how we can help the people of Pahrump. I would also like to see us get over the idea that this is just a rural community. 47,000 people in the community don’t make it rural. There will always be parts of Nye County and in Pahrump that will be rural because they’ve gotten bigger lots, etcetera and they can do that. That’s wonderful, good for them, but you must start by considering what the whole town needs and not just a section of it. Tom Santanastasio- I moved into Pahrump in June of 21. I purchased property in March 2020. I also purchased 12 paper zombie lots and I’ve sold four of them. I still have 8 of them. I did pay my taxes yesterday under protest because of all this that I’m hearing about the zombie lots and they’re not buildable. I do notice on my bills here that I see capital projects. I don’t know what that is. Special capital projects, my county airport: Why are we paying for an airport? I don’t know. Also, what is the procedure for delinquent property taxes before they go on to auction? As I see it, my taxes are 103 dollars. I’ve paid $3000 for a zombie lot. Why did I pay so much? Because of the taxes, interest delinquent charges, and everything else. How long does it take you people to get this thing to auction? I’m not happy with the procedure and the people that paid $25,000 per lot are getting nothing for their property. They lose their property. What efforts are being made to give them back their money? The overages that you have that go into the general fund? What do you do with that money? I’d like to know. Don Meighan I am the owner of Carver Smoky Valley RV out in Round Mountain. I’d like to have a conversation (that isn’t going to happen obviously) regarding this landfill thing. I found Nye County Resolution 2017-66 that gave the formula for which you guys were calculating our landfill fees at where they were done at $30 per parcel and then $15.00 for each additional unit. Last year for 2024, my taxes for the landfill were $1830. This year they went to $3640.00. I had an increase of $1800. I guess my question is, was there some other ordinance that was passed that I’ve been unable to find that would explain why it’s doubled? August 5, 2025 Debra Strickland- Pardon me, we don’t answer questions. It’s your time to speak, Sir. Don Meighan- I spoke with Bruce the other day and he suggested that I come to the meeting because I want answers. Who do I talk to, to get answers? Because everybody that I call, it’s not their job and there’s no explanation for this. I’ve spent two days looking for the information online and it’s not readily available. The same amount that you’re charging for every lot or every parcel you’re charging me for every lot that I have within my RV park. According to the statute, that’s not the way it’s supposed to be. So, if somebody who can answer my questions for me is listening, would you please contact me on 775-482-4441 so we can have that conversation so I can understand what is going on. I mean I’ll be the first to admit, this is the first County Commission Meeting that I’ve ever attended, and I think I need to come more because I’m understanding a lot more. A lot of these people down at Pah rump that feel like they’re the redheaded stepchild, that’s how we feel up here. Only we’re looking at the Pahrump people as you know the people that are on the other side of the equation. If they have got the same problems down there that we have here, it’s just that there’s a little bit of time in between them. So, are we going to have zombie lots up here in Round Mountain with our population of 2500 people. What is a zombie lot? We have no idea up here. But it doesn’t sound like the Commission has done a very good job of managing Pahrump, and you’re just giving us an indication of what we have in store for us. That’s unacceptable. I encourage myself and everybody else out there to become much more involved and aware of what’s going on in our county. The people are still in control. Tammy Pittman- So responding to Miss Southworth, there are at least two food pantries in town that don’t depend on government monies or food. Park Community Church is one of them. People can come twice a month. I think that the call to alarm is a little bit premature. Michael David Garcia- Hope everything’s going wonderful, but it sure feels like we’re on a lifeline trying to save Tonopah up there. Anyhow, I just as we go through all this Purple Heart ceremony, I just wish everybody would realize all the blood, sweat, and tears; all the sacrifices that families had to make just to give us that First Amendment. And for some of us to be unclear about all powers inherent to the people is very alarming. Like I say, we’re not the only county that suffers this. We’re just in last place in academia. I have a question. I don’t understand when it comes to stuff that’s in 1983 how these DA’s and judges can think their tax exempt from a subsection 1985. It’s implausible to think 1985 wasn’t processed through these courts. And for y’all to back down and not say anything just because, I think each one of every one of y’all constitutional oath is subject to the DA’s laptop’s discretionary opinions. I would like to know what person is telling our commissioners to sit down, shut up, and sit still. You know the great thing about North Carolina was Billy Graham and Billy Graham said famously it doesn’t matter what you think about the Bible so you give a shortchange on the constitution and the Bill of Rights will prevail. I am a father. I live here. I’ve never taken to a microphone until I’ve seen child abuse in the cover up. Epstein, Diddy, there’s a lot of realtors playing in there and a lot of this could be avoided. I remember we had people in chambers about trafficking children, but you know what we didn’t have in there when we had the Lieutenant governor? We August 5, 2025 didn’t have any victims. We didn’t have anybody who knows what it feels like to be trafficked. You know we were still born on the 14th amendment and a lot of y’all don’t get it. You talk about jurisdiction, authority, children being abused in the closet by our SOR or SRO and deputies. We go right across the mountain, and they prosecute for that. Do you see what happens to their badges when they do deprivation under the law? They have a DA sometimes or a grand jury that will step up. You know this DA is nothing but plausible deniability. He’s practiced Chevron and it’s crazy he doesn’t know what’s going on. It’s a whole different linguistic. We’re dealing with God’s trust. Maybe we can’t save the constitution, but I’ll be damned if I’m going to be serving 2 masters. I serve one. I come here in good faith. I gave you all the outlines for Berkowitz. I showed you all the judges that were helping them out. Both DA’s, the last one at present, participated in his porno’s doggy styles. Y’all need to figure it out. Sherry Stringer Nye County Assessor- I’d like to read an e-mail that my chief deputy assessor wrote to one of the commissioners that requested information regarding his mobile home and how it was taxed. So, I’m just going to read exactly what he wrote to that commissioner. There are two things to consider here, and people get usually confused, value and tax liability. The taxable value of your home fiscal year 24-25 was $97,046, the taxable value for 25-26 is $106,119. Assessor value residences at replacement cost new, less depreciation like the way the insurance company would value it through. They wouldn’t depreciate it. Every year the value of the structure is recalculated using statutorily mandated Marshall swift factors. In our last ratio study the state pointed out that we were using the site-built housing local multiplier for converted mobile homes instead of the multiplier for manufactured housing. The use of manufactured home multipliers is the cause of the value increase. However, this is an increase in value for economic reasons beyond the taxpayers’ control and so resulting in a tax liability increase capped at 3% per year on primary residences. There’s no cap on value increases. Whatever the market indicates will be the value. There is a cap on the amount of taxes that can be built. The difference is your general abatement. This is the reason for the 9% increase in taxable value of residential structures. While they only saw a 3% increase on your bill. Thank you and that was written by Justin Zimmerman, my chief deputy assessor. I have two zombie lots. I don’t complain about them. It costs me $52 a year. By the time you take out the special assessments, it’s $8 is what I’m paying in taxes. That funds everything that we do here in Nye County. So please think about that when you come up here and you talk about your zombie lots. I understand nobody wants to pay taxes on something that they can’t use. So, and just remember, take those special assessments away from there and you’re truly only paying a couple of dollars on your properties.

I’d like to start with, and no offense to anybody, but there is no definition of zombie lot. If you look up zombie lot, it’s in the cartoons, it’s a zombie, it’s a movie. Unbuildable lot, more appropriate and we are trying to figure that out. I will move on at the suggestion of the DA. We hear you, you folks, that have these lots that are out August 5, 2025 3.Commissioner/Manager Comments Cont... there that were purchased during a lot sales, tax sales, etcetera very inexpensively. It’s unfortunate but we will try to get through that and figure out a solution. The Purple Heart Ceremony: I’ve seen some postings announcing that it’s at 7:00 PM and as Doctor Waters and Richard Goldstein have mentioned, Purple Heart Ceremony is at 6:00 PM at the Chief Tecopa Armed Forces section of the cemetery. Last year there was standing room only. Every year it has grown out of respect for the fallen soldiers and those that are still with us to honor their service and their Purple Heart. They are a recipient, it’s very important that they see us there. I will be there, and I hope to see many of you there. Moving on to flags: Flags that we fly in our yards, or the commercial property really should be priority. If they’re ragged, please remove them. If you’re not able to replace it right away with a new one that’s better than having a disgraceful and unacceptable flag that’s flying and representing our country.

Same thing, we’ll give you a contact number for who you can talk to about the landfill. I just wanted to point out that everybody’s talked about the taxes due: Your first quarter taxes are due 8/18 so we appreciate you coming forward and getting that done.

I wanted to let anyone know who’s in my district or even if you’re not in my district, you want to email me that’s fine. I do respond. Sometimes my emails get blocked, and I don’t know why. It’s not me doing it. It’s our system. You can always text me; it’s on the government website county phone, I check that. It is always better to do that than to go through public comments. Because public comment is designed to specifically air your concerns, It’s a due process thing. It’s not a talk show or anything where we go back and forth and hang out. It’s much more effective to email or call and I will steer you in the right direction.

I’m super excited to go to the Purple Heart thing on Thursday. I try to go every year and it’s usually blazing hot. It’s worth that to go be part of that. The other thing was we had another stabbing I believe yesterday or the day before in Petrack Park which is really disturbing. Something we’ve got to get something done on that. The flag that is just a shred at the nugget needs to be removed. Is it fixed? It was there flying, the shred of a flag, for I don’t know how long, and it was really a disgrace. I’m happy to hear that that’s done. I was drinking a cup of coffee this morning. I sat at the park at Ian Deutch, and I’m going to tell you that park looks amazing. It is in great shape. You guys are doing an amazing job over there and I appreciate that. Christy Siegmund, Animal Manger Services- Just a couple of announcements: The first is our clear the shelter event is officially on. It is the entire month of August, $20 adoption fee. It is sponsored by NBC and Telemundo. We’ve had a couple press releases and things out there. We have 70 dogs, over 10 cats, please come down to the shelter if you’re looking for a new animal. Adoption fees are only $20.00 for the entire month. The next thing I want to talk about is dog bites. Unfortunately, we have had an increase of them and those increase of dog bites is primarily related to dogs running at large. Our animal August 5, 2025 3.CommissionerlManaqer Comments Cont... control officers have written numerous citations and unfortunately it just seems that these owners don’t seem to care. That concerns us on a lot of levels. Animals are our companions whether you have them for business, whether you have them for service animal to help you through this crazy scary world, or whether they’re your fur babies. The four-legged creatures that you have as your children with fur or feathers or whatever your choice is, it is our job as humans, as companions, as responsible parties for these animals to care for them. The law says that we need to at minimum make sure they have food, water, and shelter. I would argue that shelter is more than just wind and rain. It is also sheltering protection from the elements that is also a society driven human related thing. It is protection from everything. Letting your animals run at large, letting them leave your property, not only is it against the law but it is an incredible danger to that animal and to others. Please, we have got to do better. I also have Sheriff McGill with me. Mariah Court, it is in the news. It is something that is being talked about a lot and we would like to bring some clarity.

McGill- Last Thursday, everybody’s probably aware, but maybe not, we made an arrest at the Drag’n Ass rescue and that individual was charged with 19 counts of misdemeanor animal abuse or neglect. The court ordered that the individual be prohibited from feeding, watering, and caring for the animals. There was a total of 102 animals on the property. I believe three dogs were taken on that day to the animal shelter where they could receive additional treatment. There has been a lot of activity, a lot of public concern, and reference to this issue. I would like to discuss an alternative that we may be able to is a good idea that came up yesterday. Because Animal Services are responsible per the court order for the feeding and watering of these animals and this is all the way across town. It takes about an hour to two, twice a day to take care of all these animals and the feeding. So, we’ve gotten some with the with the advice of Mr. Kunzi yesterday we’ve gotten some volunteers involved to assist Animal Services in that task. Somebody came up with a good idea yesterday that I want to talk about. We are proceeding appropriately with this case. People may not like it but there are only so many things that we can do, only so many resources that we have. We are doing the best we can with what we have available to us, anything else?

When you say shelters more than sun and rain as you know there are people who have their animals out without anything other than sun and rain. Are you suggesting something to be done regarding that situation? Manager Siegmund Are you talking specifically about livestock and horses?

No, I’m talking about animals. What you said and sun and rain being their only shelter. Manager Siegmund What I meant by that, right now we must follow the laws, and the laws are that we are to as animal control look at do, they have clean water, do they have food, do they have shelter? When you look at shelter it is defined as the protection from the elements. As the laws stand right now that is what we follow because we must follow the laws. I was simply just trying to give a different perspective of protection of the elements. That definition also being a human element and by letting animals run at large, by letting them run through the street, run onto other people’s properties, as the owner you are no longer protecting your animal from those additional elements.

I agree. I don’t want any misunderstanding that disagree with what you’re saying. I had a constituent (or not), he reached out to me yesterday. And said that there was someone outside in the park and the dog was running in the street and he called both you guys and frustrated for whatever reason, I don’t know. I don’t know exactly what was said, so I’m not going to say anything else, but it sounds to me like perhaps the problem is a legislative problem and not an enforcement problem. I am not one to try to legislate here from where we are and have this weird conversation with a bunch of people but try to write something and then air it out for people to be able to weigh in on it. That’s why we have this hearing process. I suppose my question is because, I do like to ask before I go and charge off do anything I wouldn’t mind other people assisting: Do you see an opportunity to change some of the laws to specifically address animals of all kind, being not having the shelter that you would say is appropriate would that help, is that something that you would? Manager Siegmund Absolutely and is being worked on right now. Title 6 is working on having additional amendments to protect these animals.

Do you know how long that would take? Only because I know that the last time, they changed animals it took like a year to get through. McGill- I do want to add in case this becomes controversial. One of the horses at this rescue that the Animal Services is caring for, yesterday afternoon it was discovered that she was very ill. We tried to contact a local vet. Unable to reach him, we contacted Desert Pines. Christy, my wife, my truck and horse trailer took her into the vet last night. She is still there. Still being treated. I don’t know what the outcome is going to be, but they got back at 10:30 last night so that’s the commitment that Christy has to this necessity. Also chair, I wanted to address yes, the stabbing yesterday. It was minor injuries. The victim refused medical treatment, and the suspect was located and taken into custody within minutes of the initial call and was arrested for felony charges.

I just wanted to throw some numbers out there. Last year voter registration was at 8264. This year as of August 1st we’re at 9940. So, this number is going up. I please urge all people in Nye county to go to registertovote.nv.gov and check your registration. Every time you go to the DMV, they make sure that you are registered and sometimes the parties are changed. Please double-check your registration for me. Manager Waggoner- To answer Miss Clark’s question regarding the master plan update; That was done back in 2023. It was about a three-year process. Many meetings through the Planning Commission and then eventually came to the board and were adopted. Another thing is with the short-term rental ordinance that was adopted, Sam can answer how many, but I think it was somewhere around 150 notices were sent out to property owners that do currently advertise Airbnb. That they were identified on our software, we urge them in this notice to get legal. We’ve given a 90-day grace period for that to happen. We will not start enforcing it until 90 days after the date it went effective. Current law under code requires a business owner to remove graffiti and the penalty is handled in court this proposed law will make a change to this procedure and give us and the sheriff more resources to fight and stop graffiti that’s growing all over our community. Here’s a summary of what this law would do if passed first take the penalty out of the courts and give the county the ability to remedy graffiti directly and swiftly and if necessary, take civil, not criminal action against the property owner to recover the cost. Second, set up a reward of up to $1000, so that people who are doing the graffiti risk being turned in by their friends in order to get the other reward. A reward system is voluntary this law would just allow us to do it if we chose to. It would be directed by us or the sheriff, as it’s written. This is all something we would decide if this passes. That is paid into by violators of the law and of course can be funded in any way anything else is funded and again this reward system is optional we may or may not exercise it. It just gives us the ability to do it. Third it gives us the option of whether or not to collect a fee after cleaning graffiti there is no automatic process so we may decide to take action not current law provides no such option this means if we decide not to civilly take action against the property owner after cleaning their graffiti we may do this at our own cost. We could use grant money or whatever money we wanted to do. The current process is to require the property owner to do it. Lastly it defines this crime as a misdemeanor, and I don’t I don’t know if that I’ve been looking for a lot of laws I don’t know if it already is it might I don’t I think there may be some malicious mischief or something in the state law I don’t I don’t know. Regardless of that it does not limit the fee based on property destruction value which I believe state law has a tiered system and that just eliminates that. Here this is just a misdemeanor I believe means up to a fine of up to $1000 so we can have a higher fine even if the property damage is not as much, I believe that’s the case from what I read. It’s because we are that tired of graffiti in this community and I’d like to make this, I hope all of us want to make this a priority of removing graffiti, it’s unacceptable, it’s been growing all over community recently that I’ve seen and I urge my colleagues for passage of this item. If they spray paint on your dog, they spray paint your livestock, etcetera, I think they need to be penalized. I would ask you to caution, just consider please.

I think that there’s some confusion here and Mr. Kunzi if you could help me out here. The discussion about astray I think is related to the definition of a previous portion of this overall ordinance and I’m concerned that if we remove astray from this is amendment that we’re going to lose that definition altogether in the entire bill. I think that because astray is here it’s not relating to this portion and if you would look that the item is saying to add this portion to title 9 but astray has relevance in other portions of title 9. I’m concerned about removing that because once we remove that we lose it forever without going through another amendment and I don’t think it would be right to remove it. Amy Nelson Years ago I heard definitions of what we call graffiti Kay LaPoint was right on track. Some of this graffiti is not art, some are, and it’s usually done by what they call tagging, done by different gang members and they identify themselves with certain things that they spray paint on people’s property they claim as their own area. I think people should know what tagging is and find out the tags that local gangs we’re using so they know who’s responsible for the graffiti and go after those people. And not fine the owner or the victim, which is already said, for something that they possibly can’t afford to get rid of. So, the person that might have a structure and I’m not talking about Walmart, who should clean up their own business. But the homeowners around there can be victims too. There’s a home down the street on Charleston Park and David that was full of graffiti or tagging and I don’t know if it’s ever been cleaned up, I’ve not noticed. But be careful of the definitions and maybe you might include the word tagging because it’s very important to identify certain gang members with that with that phrase. Michael David Garcia Boy it’s pretty tough to see the separation of powers it feels like all three branches have a grip on this and feels kind of remedial that remind you that codes and statues are not law, let’s try to stick it to the constitution, when it comes to jurisdiction and authority when it comes to freaking property rights again. I just don’t understand that overreach and if we really cared about graffiti, we should put a fine on the graffiti that comes to accountability and responsibility when it comes to your Commission. So, there’s plenty of that and I know a lot of perpetrators, so you know let me know if there’s ever a bounty on that. I’d be more than willing to step up for y’all you know uncontested draw, your own wrong side of defense, so let’s stand in there and let’s recognize the flow of how we’re doing things. The only thing I wanted to say was as you as you were probably going to state Commissioner Bayne, is that we already discussed not removing that, even though the Sheriff brought it up again.

is correct. Well, there’s just a couple of quick things. Designee, for example, is just a word we use so that we’re not restricting ourselves to the actual actor that’s common it doesn’t mean we’re going to saddle anyone specifically and there’s no secret agenda to make anyone do more work. Right now, the current law is criminal, so if you have graffiti, we can go to code, open a case, you get a criminal summons, you must pay for it yourself, there’s no other way to do it. That’s why Commissioner Boskovich and I were hand painting at Patriot Pawn. I felt bad for these people. I didn’t want them to pay for it, so we stood out there and did it in the sun. So, the other thing that the other thing I would say is that this amendment has been dropped, so the sheriffs concern has been dropped. One of the things that I didn’t want to get into here, but it’s something I would like to do with this proposal and it’s written such to do this again moving out of the criminal arena, moving into civil, it gives us more options. If we can’t use grant funds and remedy this, maybe we can use charitable. I’ve had people offer to give me money for just what we did at the Patriot Pawn. I think that would be a nice thing to do if you want to stop graffiti. This gives us the ability to remove property owners from being considered criminals and move it into a civil area for mediation. I would like to see a situation where we use grant funds to cover this when someone has been victimized. The current system as it is now criminal and I don’t like that. That’s why this came forward.

In regard to what you were referring to, NRS 244.3694, where it’s designee on page two of eight, its designee may order an owner of non-residential property within the county to cover or remove graffiti. Is that what you were referring to? Don Meigan I wasn’t necessarily specifically referring to anything, because I wasn’t aware of it, I’m looking at this strictly from the principal standpoint. I’m the owner of a piece of property somebody comes in and vandalizes my property and the County has the right to come in and fine me because I didn’t clean it up.

I mean I’m just going to start code violating people with graffiti and I’m trying to prevent that with this law. Because then they’re going to definitely be penalized and they’re going to show up in court and maybe have to pay attorney’s fees. Right now, it’s the law, it’s not an NRS, it’s our code enforcement. This gives us the opportunity to be more humanitarian. It is law, it’s the owners singular job to remedy this right now and they’re going to have to pay and if this code rewrite goes through, that the people requested they’re going to have to pay the cost for all of the notices and the cost for the guy to go in the truck and the cost for the person to write the ticket and so the owners going to not only have to remove the graffiti, but they all this administrative costs and that’s the only thing we can do. That’s the only law that’s in the books right now. This allows us to do more to remedy and to catch that and to even burden the cost. So, we can use grant funding, we can use charitable funding, we can use our own resources.

I understand that, my concern is like the three commissioners up north. How do we do this without burdening the victim?

You’d have to remove the current law to do this without burdening. Right now, if we go down there and turn someone in, they get a summons to go to court, they sit there in court, they pay an attorney, they’d be held liable for all those damages. It’s just like if someone had 14 trucks upside down in their yard, that’s not something the counties pay for and that’s just the law. I’m not defending the law I’m just telling you right now it’s a criminal law it’s a misdemeanor.

So I’m looking on page 5 and I’ll go down to D, and it says, provide the cost of covering or removing the graffiti, a lien upon the non-residential property. So, we’re going to put a lien on this guy’s property. I don’t get it. I think maybe this needs to go back.

It would just be withdrawn which is fine and we will start turning things into code, but right now we just tell them they have to fix it. The reason why other cities in America do this is because we have a cheaper way of remediating. So, we can use the current law and create criminals out of victims.

My point of contention is not where the funding is coming from, I’m not okay with the victims being considered the criminals as written here in this bill.

If there is some way we can leave this legislatively open enough to say that we can fund it from a different source, so that we don’t do the same thing our current law is, for some reason we’re more comfortable I think that’s great. The way it’s written, it is our discretion, we may or may not. So administratively, it’s an option. Right now, it’s not an option. DA Kunzi I don’t know what law you’re referring to that makes it where owner is responsible for the county to go in and makes this a criminal act. I don’t know what law you’re talking about so possibly County Manager can explain to us how the code enforcement process works. Magner Waggoner Graffiti is defined as nuisance in the property maintenance code that’s adopted by the County when you violate any section of our Nye County code. it is deemed a misdemeanor.

McGill So this item is being brought to you simply as a matter of cost savings for the Search and Rescue organization they are 501-C3 they are not budgeted by the county they get donations. Part of our budget does go to them but not a lot. We were approached with the insurance increase of the second vehicle, the Rexall, and they asked if we could request that these items be turned over to the financial responsibility of the county and the Sheriffs Office rather than of the organization, so that they would no longer have to pay the registration and insurance. The vehicles have always been maintained by Nye County because they are under the umbrella of the Sheriffs Office. So, the August 5, 2025 21.For Possible Action — Discussion and deliberation to: maintenance is not going to be anything different; it’s just the insurance and registration for these two vehicles. The first vehicle being the truck, the chevy, that’s just an excess vehicle that they no longer really have practical use for it however it is still a good vehicle so we can do something with that. We need to decide on a funding source for the $5800. Acting Comptroller Elliott I did review the existing budget that’s been allocated for fiscal 2026 just in 10101. I had not seen that potentially 10607 could also be used. They are on a very tight budget when it comes to the Sheriffs Department, we budgeted just over $12,800 for fiscal 2026 and we spent $12,800 in fiscal 2025. So that doesn’t leave a lot of wiggle room out of their budget. I would need to go back to our finance team, review some additional funding sources and I have not had that time to review 10607, our Risk Management fund typically we use that for claims.

We’ve exhausted the ARPA funding. However, I was just going to recommend some LATCF that has been set aside for new vehicles. I know that in our last tranche of vehicles we didn’t use 100% of the funding for that, so it may be possible. I don’t have the exact numbers. We’re only talking about $6000 just to get these vehicles back on the road. I know that we will be able to budget in the future if the board decides that. We’d like to go ahead and take these under the Nye County wing we can budget for the insurance costs. We need to look into whether that insurance is going to be under Nye County or is that insurance maintained under Search and Rescue. We want to make sure that we’re legally approved of that respect, but that is a possibility. If we’d like to look into that, it could come out of that local assistance and Tribal Consistency funding. Administrative Manager Tackett So, as far as the Risk Management funding for the insurance the 10607, Risk Management can fund this. That was more of an identification of an unanticipated cost, that is not built into the existing approved budget. But it can support that now and moving forward. It’s more like that cost and impact to equipment services, within the Public Works Department. Public Works Director Tom Boiling The current vehicle tranche that he has, we haven’t completed the vehicles yet. That’s why that hasn’t been completely exhausted. For more than 50 years we’ve had rural housing has been involved and evolved into a full spectrum housing finance agency committed to meeting the needs of rural Nevadans through homeownership, rental assistance, and housing development. The impact has been vast since the program started in 2006; we’ve assisted about 11,000 Nevada home buyers since 2006 with over $2.5 billion in affordable mortgages and $47 million in tax savings, and another 1300 renters assisted, annually throughout rural Nevada. We’ve also invested $169 million in affordable housing development. Hickey Rural Rocks is our current campaign to get the message out about our programs; it’s still Home at Last. In particular the bond caps that we receive have gone to create the tax credits available through the Home at Last program. More recently, our launch pad single family program, we have been able to expand that bond cap.

My concern would be what you call the AB540 rehabilitation affordable housing deed restricted. In Massachusetts they call chapter 30B that’s the rule; Chicago had something similar. HUD came in in 1960s and they built these high-rise Cabrini Green housing projects that destroyed the place. So, we create something called a qualified poor, if you’re poor but you’re not qualified poor, you may not live there. Then there’s attainable housing account, which is what I think you’re looking for us to put into. I’m reading here from a group called Nevada Policy that would go toward things like loans for builders, rebates and buying land. We’re going to give this to builders and it’s an election year. the Governor would like some donations from builders and that’s my concern, Is that more important than taking care of the people here? Hickey as to the AB540, you know that’s outside of the purview of this program. The bond cap that’s transferred to Nevada Rural Housing through this process of reaching out to local communities and counties is specifically for our single-family home ownership programs. Which again is our mortgage credit certificate program which provides federal tax credits to home buyers, as well as interest rate, that’s hopefully lower than market because of those tax-exempt bonds that we’re able to offer. through them through the misery and

I deliberately left this open and somewhat vague so that there would be public participation by the other fellow commissioners on what they thought about this. I have lost track of how many stabbings have gone out and down at Petrick park. keeping our lights on until 9:00 or 10:00 PM may cost money, but the price tag of the loss of life, the danger, I don’t know what that is. I know it’s an inconvenience to allocate funding for this, but it’s also an inconvenience that people can’t use their park. So, these are the things that I’m weighing and as the commissioner that represents that park, I do feel the need to try things and to at least ask about possible solutions. A resident asked me about this, not leaving lights on for safety. I think it’s a good enough idea to put up here for a vote. I guess what I would say, I think possibly having some kind of a trial period where we look at Petrick park for a finite period that’s set up here, seeing if that’s something there’s an appetite for here on the board, something like 2 months, so that we can monitor and see if people will really go to the park with the lights on. My concern is that we put the lights on, and people still don’t go to the park and then we’re just paying all this money for lights, and no one is still at the park because they don’t want to go there. That is my genuine concern. Public Comment: Linda Clark now if I recall, this is the same park we’re putting the splash pad in at, is that right? No. we’re still going to have kids hanging out there, probably unsupervised minors, after hours. Lights would be nice for the other people that are trying to enjoy them, especially in the summertime. I wouldn’t take my kids to a park unless there was lighting, but anyway we should have lights. It makes no sense not to have lights in a park. and I don’t care what hours it is. I don’t know what time we try to close the parks or are there hours. So what type of environment are you expecting to have there after 10 o’clock, 5:00, 4:00, after the lights go out, what time are you going to set the lights for? it’s a lot of issues and people would probably like to know that so if they’re going to go to the park, what time are those lights going to go off and who’s going to supervise all that and the people hanging out there? thank you Aimee Nelson I’m not quite sure how lights are going to make a difference. People aren’t going to that park because of the homeless population there. I’m not sure who did the stabbing and who was the victim, but I’m curious to know, was that a homeless person that attacked another homeless person? Or a homeless person that attacked a person trying to use the park. You know to me; lights would just give them more view of what they’re going to do. it doesn’t stop anybody from committing a crime, especially if there’s mental illness involved. I think the curfew on the park, since there’s that kind of an issue, would be more effective, especially in the area where the teenagers play basketball, for the life of me I don’t know why a teenager is out past 9:00 playing basketball anyway when school sessions are in, but they are. It may be a deterrent for them coming around and hanging out at the park and under these conditions. I don’t know. Thank you. Kay LaPointe couple of things to think about. Why do we not have park hours? Every place I’ve ever lived had park hours and they can vary but it can be from dawn to 10:00 PM or dawn till 11:00 PM. Guaranteed, anything that is from 11:00 to 6:00 AM that’s going on in the park is no good. most of our parks, I even went out to Simkins so I could talk with some kind of a like I’ve seen this in person, but a lot of them have gates, lock them. lock things up so people can’t go inside. Skate parks all over the nation are locked when they’re not in use and many have monitors. If you establish hours, that gives Sheriff McGill the ability to go in and say it’s after hours you need to leave and disperse anything that’s going on, and that includes the homeless. That’s how you get homeless people out of the parks. but I will say lights in some perimeter areas might be a good idea and I know that’s expensive so why don’t we look at solar lights. Just some things to think about, but parks need to be monitored and gating them somewhat and having established hours so that law enforcement can then enforce, that is a way to start. Beth Borysewich first of all, I think that our town needs to start looking into the use of cameras and a camera monitoring center at the Police Department would be an excellent thing for them to have. This way we could see anybody that is doing anything wrong in the park, we can monitor, and we can make sure that we see everybody, setting and keeping the lights on, set up a time schedule for the park to close, maybe 10:00 during the week 11:30 or 12:00 on the weekends, that would be a good thing. But having the lights on will reduce the county’s liability for having safe places. I mean it’s your responsibility to ensure that the people in the town are safe, whether they’re stupid or not, it’s still your responsibility when it comes down to insurance. I do like the idea of solar light. I think it’s a great idea. And if we do lock the parks, I don’t know if you can do that at Petrick, but anybody is caught in there after the gates are locked, instead of just giving them a citation we could get them for trespassing, because they literally broke into a park that was locked. I’m just reiterating that I think that we need to keep the lights on and we should set a curfew for the kids under the age of 19, which means 1 8-year-olds included, because once they reach 18, you go out and you have the time of your life, because you’re now kind of an adult. Thanks Suzy Hertz I just wanted to say thank you lan for taking this issue up, and I look at it from the perspective of we who want to enjoy the parks and use the parks, to have lighting so that we can do so. i see it from that standpoint as opposed to the negativity of let’s catch whoever we can. There are some issues that obviously exist and do come up, and the lighting will be beneficial to help us keep things safe. But I’d hope we’d look at this from a positive standpoint that this is our community, these are facilities that we citizens would like to enjoy and use, and I think that this even a test of a couple of months or whatever to see how that helps is a really good thing. They have nowhere to practice. so, I’m asking to have reasonable hours at the park that my children, my boys, even though there’s five it’s considered a team, are able to practice in a safe place and a well-lit place. I can’t speak on the crime, because I’m not law enforcement, I don’t know if it’s going to change, but I would feel safer as a female to walk that park if was lit and not dark. I also think, hearing other people’s conversations, there’s already a curfew in place for under 18. If you follow the curfew, then those students and kids shouldn’t be at the park in the 1st place. Then the Sheriffs Department can enforce the law. So, I’m asking all of you guys to think about all people, because we can’t use the park because we work all day. I am hoping to remind the Commission that we do have a field allocation process for a reason. the sports organizations that come onto our fields, the reason why they follow the field allocation process, is so they can get their lights on. They’re also required to be insured when they’re on town property, pay their fees, provide a security deposit, and that is the process that they have to follow. My only concern is whether we leave the lights on for all of this time until 10 or 11:00 at night, that you’re going to invite other sports organizations to come onto our fields because the lights are on. You could have sports organizations on our fields that are not insured. If there’s a liability, that is the town’s liability because they are not insured. Then you have the groups that do follow the right process. They follow the process that they know that they have to, but then if they see other groups that are not, why are they going to continue following the correct process that is in place, that is there for reason. I think it is a huge thing that should be discussed. Thank you. Tim Bohannon as the park and rec guy, you know reasonable times for a curfew absolutely. looking at the sheriff, from a management standpoint what can we effectively manage. Are cameras doable? If they are, maybe look at it, but there’s a cost to it. From an uncle that has nephews that are in town, that are 6 foot 5, 6 foot three and range from 17 to 23, access to the Petrick Park for playing basketball is a really good thing. If you’re there from 5:30 6:00 at night you’re looking up at the sun. Later at night is nice, too late at night you have to manage that. Typically, my understanding is 10:00 has been the cut off for the lights, and that hasn’t been an issue. first of all, personally I am 100% in favor of this. I think it’s a good idea. My advice to anybody is light up your area like the surface of the sun and it does act as a deterrent. I understand that this is going to be an expense, I realized that. However, I just want to make note, a few weeks ago I pulled statistics for the movies in the park, and I pulled stats for all those nights, for five weeks. There were more extra patrols at Ian Deutch Park than there were calls for service on those nights. Just for the record. Secondly the stabbing yesterday happened at 4:45 PM, broad daylight, the stabbing that we had last year at Petrick park, right in the same immediate area, was broad daylight. So, make out what you what you will.

I wanted to address some other things people brought up and address the concerns of the town people. I take the county car; I drive my district quite often. It’s not uncommon and just yesterday, I saw something very interesting. I saw a minivan with lights on, and I’m looking at what this person is doing, and I noticed they had lights on kids on swings. and I just thought oh boy, I mean this is it is this kind of what we’re talking. I am ignorant of what lights on even mean, but I saw that, and I just wanted to pass that along. It was about 9:00. I’m just saying, this did happen. I am aware of the cost, and I don’t want to assert something that’s going to be a big problem and that’s why I maybe suggested possibly a 2-month trial to see how this goes. Maybe just at Petrick Park. An ordinance possibly could be drafted to prevent the problem of the field allocation. You cannot, as an organized team that otherwise plays as a team, engage in any other organized activities. We can look into that, if that is something that would help. As far as the Sheriff’s Department and speaking with people over there, and I do have the confidence in the leadership of Joe McGill and the under-Sheriff Cory Fowls and speaking with them about these issues. We just need to help them do what they do. I know there are cameras there now and they’re probably old. 720P cameras that you can’t really make up, probably not as good as this camera. We had thought about 4K cameras where the bathrooms are. I had thought about cameras up as well, but I would say that I’ve thought about acting on those recommendations and closing the park. We actually spoke with one of the other deputies about that as well. These are all things that we can do. I suppose that for right now, if the board would be willing to give this at least a temporary 2-month run, we can see if we can explore these other options, to see if they’re better. And if we close down the park early, does that eliminate the need for lights? If people don’t go down there anyway, does that eliminate the need for lights? Mr. Martinez, one of my questions is, could we have and do we have dedicated lighting of the perimeter of the park or parks as proposed? Jimmy Martinez we have field lighting and then we have security lighting that’s at night that lights up bathrooms and buildings and some park areas.

I’m not quite sure commissioner Bayne’s proposal. I get the temporary and that’s wonderful. I understand the concept. I’m not sure what the proposed time is. I heard Courtney loud and clear, and I know that that you can reiterate. My main concern about this is if we force people, organized teams, to fill out a form and they pay to be on the field, and I know that was a little contentious because with the maintenance and more staff etcetera, we had to raise the rates for the parks. So, if we give other teams that are unorganized a free opportunity, I guarantee there will be fights in the park. I don’t care if it’s lit all the way through or it’s or it’s daytime, there will absolutely be fights in the park, because we’re forcing organized teams to pay, to turn on the lights, but if we have the lights turned on... I think we really need to consider this. There is a curfew, NRS curfew that’s for 18 and under, it’s not for adults and that’s why county clerk and I have been going back and forth, and it’s taken quite a long time, and she’s don’t forget a staff of two now 2 1/2, and so we are working on park hours. Along with the lighting, we think this will complement the concept. I thank the sheriff for clarifying, because I have in my notes, I distinctly remember, he said there were minor injuries with the stabbing in the park most recently. the one last year, it was in the daytime, and I believe they were homeless, a year ago, it was a female and there were other people, and they got into it. It was daytime activity. I’m sorry, I can’t buy into the if we put up lights, it will stop crime. It’ll deter crime because they’ll just go where it’s dark and they’ll take care of business. So, I don’t think that’s the real solution. But know that I’ll certainly consider the temporary fix, and this is going to cost per amp to light up the park. I’ve seen the power bills; they’re triple what normal household incur during the month.

I was listening to miss Stephanie Lopez. She stated that her boys are between 18 and 23, so they’re not affected by the curfew at 10:00 apparently. We have field allocation forms that say you can allocate till 9:15 and being that we could potentially have fights, I’m not sure that the answer for miss Lopez isn’t to have a field allocation form where she’s able to pay the $25 per month, per field. so, $25.00 and a security deposit get additional insured for the town of Pahrump, and she can have lights on till 10, is that correct Jimmy Martinez? How late are the lights on currently? Jimmy Martinez the way it goes, we usually go till 9:15, but if we have a large group, say like little league, we’ll have 400 kids, we will extend that to 10 to accommodate their practice times and everything. So, we work with each organization to accommodate with and how long we keep the lights on.

Perfect solution for that particular need. I think that would be smart just because of the potential for arguing with those that are paying not paying. She’s got 5 people like she says, practically a team herself. Manager Waggoner what are the park hours? Jimmy Martinez -from what I was told, when I started 20 years ago, it was from my manager at the time, was midnight to six, but I don’t know if there’s anything out there that’s actually states it or not. We go to pretty much 11 with some organizations, unless it’s like a special event that needs overnight lighting, stuff like that, but we tried to close down because our custodian is done at 10:30, and that’s when our bathrooms get locked up to prevent vandalism, and all buildings are checked and cleaned and stuff like that. Hours are posted, I believe so, I would have to double check, but they are posted. Manager Waggoner in googling Petrick park, it says hours are 6:00 AM to 11:00 PM. I definitely think we need hours posted for one thing, regardless of the lighting.

my concerns are simply this. It’s roughly $2700 a month to extend these lights to 2 hours a night. We just turned down a funding thing for the guys in orange, which we can’t talk about, but for roughly the same amount of money. That’s a concern. Number 2, Petrick Park has no fence around it. So how the heck do we close that park, which has been a problem. I think this entire board’s been trying to figure out how to deal with the problem. And then, I definitely believe we need to have a closed period of time in these parks, where they’re closed. I did not know until today that there is all night long security lights. So, when the big lights are off, the security lights are still on, which is what I was told from dusk till dawn. And roughly, how much light do they provide in the area and are they at Petrick as well? Jimmy Martinez Petrick doesn’t have them, they have them mostly on our buildings and Deutsch has it on the front section of the parking lot. Simpkins has it on the front section of the parking lot, and it lights up that section and, in the front, as well.

I don’t really know exactly what the answer is because it’s a tough one for me. Second Motion carries 5-0 SITTING AS THE NYE COUNTY BOARD OF HIGHWAY COMMISSIONERS - CHAIR JABBOUR 9.For Possible Action Discussion and deliberation regarding the General Road Report by the Public Works Director on General Road Maintenance, Gravel Road Maintenance, Asphalt Patching, Weed Mowing, and direction regarding public works projects. Beau Gott public works has received 325 maintenance requests since the beginning of the year, averaging 41 per month. in July of 2024, we received 73 maintenance requests for potholes alone, which is down to 23 this July. There are still plenty of potholes out there but between the dry weather and the chip seal program we seem to be making some progress. in the Northern District gravel Rd. maintenance is hindered due to staff shortage. We are moving the operators around to repair the roads and more needed maintenance rather than being able to stay on our schedule. we are working on training new hires and to fill open positions to help with this, but these both take some time, so we will do what we can. The crews are crack sealing and patching in Tonopah and in Carvers for preparation of chip seal coming up in the next four to six weeks. The central district is also concentrating on chip seal prep, which includes hauling chips from Pahrump to Amargosa and Beatty and finishing up with final patchwork. We plan on sending the chip seal crew to this area in two weeks. We’re really pleased with how last year’s chips seal is holding up in Beatty and in Amargosa and look forward to adding them to that. Here in the Southern District, the patching and chip seal crews are plugging right along. We set a high goal of self-performing 34 miles of chip sealing in Pahrump this year, which is still obtainable. We have 14 miles of chip seal completed in front so far this year. With school starting tomorrow, we have also had crews out timing the school zones and cleaning up the sidewalks to provide safe travel for the kids. Public works are days away from implementing our new work order system. This program allows us to take maintenance requests and turn them into work orders. The road department supervisors and leads will have access to this through a cell phone or tablet, which is compatible with our GIS web browser. Quickly thank you to Emily Beard, the counties GIS administrator, for all your help with this. the public will still be able to put in maintenance requests through the county’s website. The request will be reviewed and put in as a work order by the road department. Another plus will be that when the work order is closed out an e-mail will be automatically sent to the requester stating that the work has been completed. The other morning, I had to take a one of our guys that used to work for me to Reno for surgery and when I left, I noticed that the county guys were over Shoshone market. this was roughly 8:00. By the time I went to the dump, went and got Dennis, and did our running around, and we came back the guys that from the county were still at Shoshone market, so, I watched him again yesterday, and it was a similar situation. Again, this morning, our county workers are spending like 2 hours a day in the beginning of the day sitting in Shoshone’s parking lot. where I live is roughly .8 miles. I don’t know what they were doing before but in 3 1/2 days we’re done .3 miles, both sides of the road, and the other .5 miles they did one side of the road. So, we’ve almost done .8 miles in three days. Now I don’t know if that’s good or bad, but I do know that we’re paying these guys. I know that we’re on limited time because they have to drive out from Tonopah, but they’re spending two hours in Shoshone market’s parking lot in the morning, and I would just think that that time would be better spent doing the job that they were there to do. I have one question will us civilians be able to go on the computer’s website and see where our request is in the work order sequence after it’s been changed to a work order Cheryl Butler- Adams I’m representing a long-established residential community that has been waiting for over a year for road maintenance, specifically since July 21st,2024, when I put my work order online. Work order and repeated follow ups, we are still on the list. I’ve reviewed the general report every meeting that you guys have and I never seen it never seems to address the old unsolved maintenance request. that never seems to be tracked. so over the course of the 12 months, my case that I’ve put in on the on 2024 has never shown up on your report. The format as presented gives the illusion of consistent progress, but it omits ongoing failures like ours. That’s misleading to the public and it should be unacceptable to taxpayers. Our subdivision is 18 years old. We pay our taxes. The county has already earned $1 .5 million in the new development that’s coming for their park in revenue from our communities. We will be making millions more and more from developments when they finish building the 291 homes here. Yet we are treated as though we are just merely optional. I can assure you that having painted red curbs is not an option. We are starting to have people park their car overnight in the red areas. I have called the Sheriffs Office to come out and ticket those people, as they are breaking the law, and they will not. Meanwhile, according to the current report the entire neighborhoods in Pahrump such as Tip Top, Augusta, and Margarita Street, are being chip sealed in just one month. Pothole patching, crack seals, and tree rules, are actively scheduled across Tonopah, Amargosa and Smoky Valley. The staffing shortage is repeatedly cited in the report, but that hasn’t stopped work elsewhere, only ours seems to be indefinitely delayed. So, I asked the board how long-term unsolved maintenance cases are being tracked and August 5, 2025 9.For Possible Action — Discussion and deliberation regarding the General Road Report Cont... prioritized. Why aren’t these cases transparency document and the general report that we see every meeting? And what recourse does the community have when the system designed to serve us simply fails to do so? At this point, we’re asking ourselves, do we need to fund our own maintenance and bill the county back? Because right now it feels like we’re not considered part of the road department’s concern.

Opening up the Nye County licensing and liquor board and this is a hearing to show cause on the short branch saloon. Samantha background, thank you. Samantha Tackett As identified in our staff report, renewal notices for at least the first quarter of fiscal year 26 were sent out to our licensees in the month of May. Towards the deadline, the due date, June 30th staff work to call licensees to remind them to pay. We made attempts to contact this licensee via phone multiple times, and the numbers that were available to us online and in our system are no longer in service. So, we had no choice but to report them as unpaid at the time of our annual required renewal report of payments to the board on July 15th, On July 15th the board did vote to not renew, they voted for non-renewal of this license, we had not received any contact from the licensee, no payments. We sent them a notice letting them know on July 15th their license would be considered for non-renewal, revocation, or suspension due to lack of payment. They did not appear at that meeting nor made an attempt to call in or contact the department. After that meeting and after that board vote, I issued a notice of hearing to show cause that was posted at the place of business by chair Sheriff McGill. and still no response and still has been received. The business is operating, though there was discussion at one point that there was a fire and they were not operating, but they are operating. As far as I know, after that notice was posted, they have not ceased operation of the activities of a liquor license.

Now I may be mistaken, but I was told that Miss Bragg passed away and that may be why there’s been no response because it’s in her name, this information going to her. the day that I was there, it was about a 70/30 in my mind about whether they were operational or not. 70 against. There was an open window that looked like a dining area, but there was nobody around. Pounded on the doors yelled through the open window, nothing. Samantha Tackett we have your notice that was posted, and you did see people there; still no attempt to contact or remedy. Also, the notice that we sent notifying them of the July 15th agenda item and the lack of payment, was sent via certified mail and was picked up at the post office. So, there’s activity there, somebody is receiving mail and notifications, but there’s no attempt to contact or to even say whether or not they are serving liquor, and it matters to them. Manager Waggoner I can tell you, looking at the GIS, there is no roof to that building. You can see right into the bar from anal picture.

if you look at your back up, that is the dining room area that I mentioned, the left side of the building which would be the east side of the building, does look like it is completely collapsed from damage. The name was Kathleen Bragg. and it still does show her as the owner of the property, along with the Johnson Gott. DA Kunzi I just was puzzled by this one. The license was not renewed, so I don’t know if there’s a license that needs to be revoked. They don’t have a license. So that’s what puzzled me about this item. I think it’s been clarified that if they have not paid for the license, the license has expired. There isn’t a license to actually revoke. I think the bigger question to come out of this is whether or not someone’s actually trying to operate, and I guess my suggestion is that we look into that before this board takes any further action.

in our PSST spending plan, we presented our plan which is attached. It’s titled fiscal year 26 PSST spending plan. That is a 1-page document that shows the recurring costs of several items that we fund through our PSST. At the time, we weren’t planning on making any purchases. However, since the original presentation, there is an item we would like to purchase, which is a used RV, which we would use as a mobile command post. It would be used to respond more quickly, more efficiently, and more effectively to emergencies, major crime scenes, and critical incidents. The mobile command serves as a mobile operations hub allowing staff to coordinate, communicate, and make decisions, real time, directly from the scene. Whether it’s large-scale crime scene, natural disaster, missing person, or active shooter situation, immediate access to resources and command infrastructure can mean the difference between containment and crisis. Outfitting the vehicle with a full suite of crime scene supplies, evidence collection kits, lighting, forensic tools, protective gear, and documentation systems, ensures that investigators can make scenes and can process scenes thoroughly and professionally without delay. This leads to faster case resolution and better evidence preservation. The command post can be equipped with secure radio satellite and broadband communication systems ensuring continuous connectivity, even in remote areas ordering infrastructure failure. integrated video feeds, mapping software, and data access allow for coordinated multi-agency responses and strategic decision making. Having a secure climate controlled and well-equipped base at the scene gives officers a safe place to regroup, debrief, and plan. it also provides A centralized location for communication liaison efforts, media briefings, and victim and witness support, reinforcing public trust and transparency. While this would be investment, the long-term return is clear, reduce response times, improved evidence handling, better coordination, and potentially save lives, are all priceless. The mobile command post is not just about equipment, it’s about capability, readiness, and leadership at the point of need. With the mobile command post, the Sheriffs Office sends a clear message to the community that we are prepared, professional and committed to protecting and serving our community at the highest level. I will make note that law enforcement agencies all over the country have these vehicles in one form or another. When the search was going on in Idaho, for an individual, couple of months ago, I remember seeing on the national news a big one-ton pickup truck with a big box trailer that said mobile command on the side of the big box trailer. This would allow us to store everything that we need for major crime scenes. everything that we need for long term crime scenes. It provides a place for our deputies when they were on a 12-hour evidence seeing. It’s got a restroom in it, obviously it’s an RV. I don’t know any of you, but I don’t want my deputies being caught on video relieving themselves after a long crime scene and they can’t go inside the building to do it. The purpose is clear, the intent is clear, the cost; we went shopping at site at Trudeau RV lot and we found and selected a 2024 24-foot class BRV. that is their advertisement that they had on their website. The 79 we put here is our price, no taxes, because we are tax exempt. And they gave us a discount. I do want to point something out. in having conversation with Helen Bae before her departure, we discussed having this funded by all the communities PSST funds. I will tell you this, 90% of our crime occurs in Pahrump, because this is the major population hub. So, 90% of our crime scenes are here. Sometimes, we do go for major scenes in other places. We obviously could do that. I would intend to take it to Jim Butler days for the weekend up there, and Beatty days, and Amargosa Days, for the world’s shortest parade. i really think that it is more appropriate that the Pahrump PSST fund it, rather than the other communities. Stephani Elliot Just a little bit of review that I did on this. We’ve already approved the fiscal 26 PSST back on April 9th which did not include this purchase. Along with that, we’ve already submitted to D-tax the capital improvement plan, which has been accepted by the board recently. So, looking at the approved capital budget of 300,000, we’ve already got a contract in place that is going to assume about 283,000 of that. There’s only 15,000 approximately left available to be able to absorb in this additional capital purchase. We would also need to take a look to see with D-Tax if we would be able to amend the CIP budget.

We were denied for the CIP, that’s why we want PSST to fund it. Stephani Elliot The fund 25234 is included in the town of Pahrump indebtedness and capital improvement plan that was already submitted to D-Tax, so if anything, perhaps making the motion to approve, because I love this project, I think this is definitely something that you need, for perhaps contingent upon approval through D-Tax. The Sheriffs Department submits budgetary request to the board, which then reviews and approves the county budget, including departmental allocations, while the county government in general and the Sheriff’s Department specifically is funded through a combination of sources such as sales taxes and other revenues, there is no indication anywhere that I can find, that the purchase of an RV is mandated or should be requested of the Pahrump PSST for the Nye County Sheriffs Office. the Sheriffs Office wants to purchase an RV for 79,897, to be taken from the Pahrump PSST. These are collected taxes. These are the taxes that our town pay for. They could be used to hire peace officers, and park officers actually as well. the Sheriffs Department does not fall under the preview of the town of Pahrump. I don’t believe this should even have been put on the agenda. I think that maybe Beth and miss Pitman were both talking about the search and rescue RV that they are donating. Regardless, for instance the search and rescue RV that they have that they’re donating, I don’t like to borrow your car. I don’t like to borrow your drill. If I’m borrowing your command post to go on our scene, that means that you have to drive it, because nobody in our department has a Class A driver’s license. Can I get people certified to drive a vehicle with airbrakes? Absolutely. but then they quit and go to another agency, or they retire or whatever. How about I have a vehicle where you have to have a Class C driver’s license just like everybody in this room. It’s no different, it’s like driving a van. I assumed that you did that since I wasn’t involved in the purchasing part of that. anything over $1 00,000 you have to either go out to bid or have a state cooperative purchasing program, which is what I discussed with you. used vehicles, they don’t have state cooperative purchasing programs. That’s my suggestion for this. He has the autonomy to alter that. I don’t know the technicalities, but I trust him. This is not a perfect solution, nothing is. We’ve tried using excuses to stop crime here in Pahrump for a very long time, it hasn’t been working very well. So, let’s instead try extra patrols. I urge my colleagues to passage so that we can do something to make our parks and shopping areas just a little bit safer.

that that’s the issue. Our deputies that are on regular duty, day, night, whatever, don’t have the luxury of spending two hours patrolling Petrick park to McDonald’s and back. So, I have to put a guy there. so, the 35,000 is their regular pay plus the overtime.

It’s going to vary on who the individual is that’s working, but it’s going to be somewhere in that ballpark. Stephani Elliot I think it may also be appropriate to state that during the fiscal 26 budget, the board did approve just over $523,000 in overtime budget for the entire Nye County Sheriffs Department. With that being said, in fiscal 25 we barely exceeded just over 100% of 625,000 in overtime, so that is just for regular overtime needs of the sheriffs department. There is funding budgeted specifically for the department and the overtime needs, however, any additional you would be better at understanding whether or not there’s any wiggle room this year for that.

it was $200 for three hours for two people? Manager Waggoner -l was saying right now, we’re assigning 2 deputies on Saturday nights for movies in the park at Ian Deutch Park for three hour. 3 hours of overtime. so three hours each, it costs us $500.00 for those two deputies.

So, 250 a person. here’s what I have for numbers. I even threw that up to $100.00 an hour just for fun, and I got 350 hours for 35,000. That gives us 14 weekends of funding, if we have one person just on one weekend night for example. or obviously, I’m not going to try to micromanage him, even if we have the ability to, I’m not going to do that because it’s his authority, and so I’m just throwing that out as an answer for the commission.

There’s local assistance and tribal consistency fund that may be able to be used. We really ran a very tight budget. If you all remember, we had a very fancy spreadsheet, got it down to about 3.8. we’ve spent another 400,000 on that. we’re at 3.4 million ending fund balance. This wouldn’t necessarily be considered an emergency at this time, so the funding is limited, unless there’s possibly ways where the department may be able to cut expenses.

Stephani Elliot We do not. Finance, even after talking to the county management, we do not recommend dipping into the reserve fund balance. It’s already at critical levels and there’s some unexpected expenditures that we do need to account for on that. Honestly, the only thing that I can recommend is the local assistance and tribal consistency funding, or we can wing it and see if perhaps we have some unfilled positions that may be able to cover that overtime, but that’s dangerous.

We took her position, decreased it down to an account clerk, and then the other person that took over the deputy assessor doing title transfer was brought in at a much lower rate. She started at a step 1, the person who left was a step 8, so a much lower rate. That’s why I’m looking to go full time. I asked Elona if there was any way we could bump her up to like 30 hours, no benefits, apparently the county doesn’t do that so here I am. As a private person, I don’t have the luxury of all these benefits that state employees seem to get. Hell, I don’t even have health insurance. But with that being said, the biggest issue here is availability of services. I came down last Friday to file a fictitious name because my bank said that they wouldn’t deposit my checks because they were in carvers RV instead of being smoky valley enterprise, it’s manpower issue. When I looked up the statute it says that they have to be open and then it gives a condition for satellite offices. but it appears that Tonopah has become the satellite office and you know we got the test site that works pretty much Monday through Thursday, we got the mine that is either 7 on 7 off and then they leave and they live somewhere else or they’re Monday through Thursday, and when you come down here to do something on Friday the only day you got off, there’s nobody there because they’re closed. so that their people can be there Monday through Thursday. So, I see this as being the same thing whether it’s the clerk’s office, the assessor’s office, the justice court, all of them are the same thing. Our government services are not available to us because of staffing issues, and that’s exactly what you guys are talking about here, It’s going to cost $38,000 more to have a full-time person than two-part times. It should be the other way around. Director Boiling OK so we did originally advertise for secretary two. We didn’t get any responses that seem to be able to do what we were asking them to do. We had a lot of people from McDonald’s apply, but that’s you know that’s a lot of teaching. We’re hoping to get the account secretary position approved, however there are a lot of discrepancies in the numbers that are in the backup. On the first page, it says that the increase in budget would be $24,427. Well, that is if that person decides to elect to take the family plan whenever they choose their insurance, which adds $21,000 to the budget for that person. If you look at the last page where HR comments, the original increased budget approximate was $25,240 which after she went from the family plan down to the individual plan it went down to $3,156. That tells you there’s a huge difference between the budget that we had because the secretary 2 that we had was only on the individual plan. but they have to budget whenever they have new positions for the family plan. now what happens if that person chooses the individual plan? what happens if that secretary 2 that we had before got married now that she has a husband and kids and now, she opts to increase her plan to the family plan in the middle of the year? well they have to allow her and now it’s unbudgeted, so there’s the big difference there. you’re comparing apples and oranges here. Our actual increase for one person on an individual plan is only $3200, it’s not 24,000. I just wanted to give you guys a little bit of math as that part of it. The reason why we want to use or utilize an account secretary is because they will be able to do accounts receivable, they will be able to do accounts payable. They will be able to do everything that we need this person to do in order to complement the secretaries we already have in our office, the old one could not do that. She could bill people, but she couldn’t receive payments. that leaves one person in our office they can do that other than the financial manager, which has her plate full of a whole bunch of other stuff. Public Comment: Ammie Nelson I’m not really happy with this department, especially when they helped to go in and take money after the people voted not to. Why isn’t that a centralized function where we have one accounts receivable area and leverage that for each of the areas or departments that we need that. Is there any give back from other areas within the budget to compensate for this. I hate this and I’m not suggesting this, taking it from providing for roads. I’m not suggesting that. I’m asking if there’s other givebacks or other efficiencies that could be brought in to save up to that number and be able to be able to cover. As far as the benefit component is concerned, the benefit component is what it has been negotiated to be. It’s you know big jump from being an individual to a family plan, and I would hate to be part of the hiring decision to have the person that is best qualified to be able to do the job. We don’t want to have that if we can avoid that. We want to be able to have a neutral economic impact. If there’s givebacks fantastic, if there’s givebacks that are not hurting the roads or the public, that’s important. but there’s also a way to consolidate the function, please consider that. Linda Clark I understand his issues, but again, we don’t have the money. From what I understand, this person that can’t do the work isn’t classified to do the higher work, so now he has to get someone that’s classified to do more work or do what they need. Maybe we’re not hiring properly. Second of all, maybe we just need to discriminate and not pick anybody that has a family. I’m not saying we need to do that, but it seems like we’ve solved the problem, and we wouldn’t have to spend all this extra money that we don’t have. Beth Borysewich The word family should not have come up with this request at all. It’s discriminatory what’s happening. Is the administrative secretary the regular secretary to an accounting secretary? What grades are those? Are you replacing one with the other, the same grade or the same salary? I mean what is the reason that you need to do this other than you want to have somebody that doesn’t have a family in your office. That’s a little ridiculous, number one, it’s discriminatory, and for that reason, I would just throw this out and burn it and stomp it into the ground. We don’t have the money. You’ve already said that four times today. Why can’t the rest of the people get that idea? Don Meighan just a possibility, maybe we should learn something from Walmart. They have lots of employees and they pay very little in benefits. I know that might not be a really popular situation, but it might give us what we need body wise in order to have the people necessary to have the offices open. My taxes went up 17% this year. my revenue didn’t. but yet we’re paying these county employees, and it doesn’t matter if it’s county or federal or state, they’re paid, and their benefit package is much better than anything that we can get privately. At what point should we be looking for the benefit of the constituent rather than the benefit of the public employee, because the public employee, last time I checked was supposed to be a servant of the public, not the master of the public, and it just seems like that’s more the direction that we seem to be going. So maybe the answer is a lot of part time people. That’s the way I had to run my businesses. I had to have multiple part time people because I couldn’t afford to pay the benefits. The reason we would like this contingent upon FAA approval is we haven’t been awarded the grant just yet. that should be coming, fingers crossed, within the next 60 days. However, before the FAA proceeds with a grant award, they do require that the board has approved the potential contract so that we’re they have locked into the pricing, and that is also justification for the FAA board to award that grant

if I remember correctly, we pay the money out and then we get the money back minus like 16% is that correct Stephani Elliot Typically, it’s 93.75 and 6 1/4, Nye county in the past has been responsible for 6% of any outlay, and that’s typically comes from our 10401 as well, which is our capital fund, and most recently in the last two fiscal years we’ve actually been charging that to the 10209-airport fund. going forward at least for these three particular grants, any match would be coming out of grants, 10340 through the local assistance and tribal consistency funding. You’ve already approved the contracts and the task orders with Atkins Realise, who is our environmental consultant for all three airports. They are actually the ones that helped us go out to bid back in April to secure the quotes and the responses so that we could apply for the grants. Cody McKee there is also the opportunity for Nevada Department of Transportation aviation division, they have a schedule A where they do assist counties with their match funds as long as that fund is sustained, for example, the 2024 project list that we turned in, that was put on their schedule A they were matching 4.83% of the required match, which left us with just under a percent and half of our own match money. just for some context that could apply moving forward into 2025 when we update that list.

I can’t vote because I actually have to leave here when the meetings over and go to a resident who had a bullet fly through their house, which happened in the South side Chicago one time I was there 10 years ago, I haven’t seen that since then, we can’t find $35,000 for police patrols at a park or there’s been 3 stabbings and a shooting in the last 30 days, I don’t see how I can face my constituents and the constituent I’m going to go to now in about half hour hopefully and tell them that we had 60,000 plus for improvements in airport, we don’t have $35,000 out of $1.7 million sitting there. and another $1 million sitting there. So, if we want to hoard millions of dollars that’s the prerogative of this board. Nothing against anybody here, I would have voted for all this stuff if we got the 35,000 for the patrols and the lights with this. and i would have also voted for all the staffing that we need, I really would have. The facts are that we have 60 minutes, 60, one hour, to get a critical patient flight for life and that’s the priority of having this airport. yeah, just throw it in the trash as I’m speaking but this is about saving lives. You continue to talk about stabbings and shootings: there were two stabbings in the park in the last year and a half. minor injuries on the last one. Let’s be realistic and not exaggerate with hyperbole. This is about saving lives this airport. It’s very important. We have deliveries from FedEx and UPS. planes land here for fuel. We don’t have mail delivery service, everybody’s forced to go to the post office. It’s unbelievable in today’s day and age that we’re living here in Nye County, the county seat, and we have no mail delivery, but please when you state your facts, commissioner state your facts realistically, of what’s really going on here. you say you would have voted but you didn’t. you didn’t vote for those things. OK and if you don’t want to vote for this, please don’t compare apples to oranges, because as was mentioned before, that’s exactly what’s happened here, and I’m offended by your comment.

My sister’s had to use flight for life from Tonopah, my niece has had to use flight for life, so this runway is essential, and I do support it. Thank you Tim Bohannon the value of what this does, as we heard from Miss Nelson, is pretty high. Life, safety, are equally important in the park. However, we have a rural area that doesn’t have as much access to safety services. What I’m puzzled by is why this wasn’t already in the budget. and that’s something that really shouldn’t be happening. There should be better plans to make sure we have them. So, what is the give back? What is the offset? for this what value do we get financially or physically to offset this cost? those are the kind of things I’m looking for I’m not hearing them yet, thank you. Beth Borysewich of it maybe I’m confused, and I just don’t understand you know airport and road maintenance, but this is talking about resealed taxiway A, and award 189,900 to see our contracting. However, in the previous #25 it says to replace taxiway A, and I don’t know what MITL stands for. So, I’m just wondering why 26 and 25, I don’t get it, so somebody could explain it that would help a lot. Now, back to 25, MITL those are your landing lights, those are your runway lights, and I’ve landed on air strips where I didn’t have lights. It’s a very unnerving situation to say the least. Now fortunately, I’ve never landed at Tonopah when I haven’t had the lights work, but if that situation did exist here, you don’t have enough fuel to get to another airport because there’s not another one close enough before you start running into fuel issues. Tamie Pitman earlier this morning, when we were still not comatose, Mr. Waters stated the town of Pah rump board was not responsible and could not raise taxes, but there is a caveat. Since 2009, that’s the truth, because Nevada regulation requires all town budgets to be approved by the board of county commissioners. However, the town of Pahrump board did make and would make recommendations to the board of county commissioners, and the board of county commissioners pretty much rubber stamps what they recommend. In three of the last four years the town of Pahrump board was in existence, they recommended an increase, three of the four times. The property taxes of citizens went up from .19 cent per thousand and ended up at .43 cents per thousand. that’s over twice in four years. And yes, the BOCC approved those increases every time, so don’t believe everything they tell you. Linda Clark My comments are this board today, and I agree with Tim, we did have some good things, but we had more bad things than we did good. I don’t mean the items themselves. I mean the procedures. It was a little disappointing and boring, and we spent a lot of time talking about money we don’t have, whether we can do this or whether we can do that, but it was excessive today. Maybe you just had all the wrong things on this agenda. It took a lot of time, it’s 5:00 and it’s a long day. The other thing is we’re talking about things we can’t afford. I think airports are important, especially for the emergency services like Jabbour is talking about. We definitely have to have access to medical care, and we need the access for our Police Department and our Fire Department. Those are good things that nobody wants to spend that money, but we have to. but we have a lot of other things in this community we don’t have to spend the money on. The fairgrounds is one of them. You know I don’t like it, and I think it’s a waste of money at this time. Maybe 10 years from now, when this community has grown with all the houses you want to put here, maybe then we will have the money for it, and maybe people will appreciate it more. I know the people that Mountain Falls aren’t appreciating it, and it’s more I think of a health and a noise issue than anything. I will tell you offhand, I have a husband who has asthma and needs a breathing machine once in a while. He’s had to use this machine three times this week already because of all the dust blowing around. If you think the fairgrounds is not going to blow dust around, after they get all the roads and stuff fixed over there, yes it will be. I saw the guy out in the field today, right behind the Badlands, he was spraying water down with a hose. It wasn’t one of the big machines, it was a water hose. The dust this week has been really bad. So, if Deborah wants to put this project in our neighborhood when we know we don’t have the money and most of the people don’t want it, and then she sits up here and says we don’t have the money for this income, or for this department. There’s good feedback that’s provided, good legislation that’s provided, but sometimes it takes a little bit more effort, a little bit more thoroughness and completeness to get a really good product. Sometimes one and done just doesn’t cut it, but collaboration does. Thank you Amy Nelson I think Linda has a lot to say about this fairgrounds. We have a lot of people that are against it. I know we had a town board and Harley Culkin was the chair and came up with the idea. It was laughed at and called Wally world, but nobody’s in favor of a fair ground unless they’re a commissioner, I think. I don’t know anybody that’s in favor of it. The other couple of things I want to bring up again is a moratorium on building. We don’t have the water. Stop approving housing. and then lastly, we got to ban sharia law plain and simple. may I explain chair? if it’s an agenda item, we don’t get to talk about it except for during the agenda item. This isn’t just open any discussion, it’s discussion of matters that we have control over. We don’t have control of federal government, the world policies, and anything that is not agendized. So, the graffiti thing is off the table till we hear it again. Don Meighan new experience and it’s been a good one. I look forward to it. I think I’m going to go to the one in Tonopah, so I can see everybody else in person. When I came down, I had a lot of reservations. I live in northern Nye County. I’m about as remote as you can get and I’m glad to see that we have three, possibly four, but definitely not five commissioners in this county. Thank you Vanessa Fernandez I am vice president of the 501-C3 nonprofit southwestern wild. and we feel it’s necessary to address the recent comment made by an individual who has repeatedly spread false accusations targeting various nonprofits rescues and local businesses, in regard to Southwestern Wilds and our work. Let us be clear. Our only mission is the safety and well-being of both the wild horses and burros, as well as the people in our community. We are actively building and maintaining strong relationships with NDOT, the Nye County Sheriffs Office, our county officials, among others to ensure collaborative and lawful action in response to wildlife concern. To clarify one specific claim, the road is not being shut down. When we respond to a wild horse or burro in the roadway it is because the situation qualifies as an imminent hazard under Nevada law. That allows for immediate action to prevent serious harm. There’s not always time to wait for an official agency response, and in those moments concerned citizens and not just members of Southwestern wild stepped in to help. This is not about overstepping, it’s about doing the right thing to protect lives. We remain committed to working transparently, lawfully, and in service of both animals and the community. We invite anyone with concerns to reach out to us directly, for facts and the conversation rooted in truth. Tom Boiling as an individual, just a little training for those of you that don’t know. Whenever you go to crack sealing, you have to allow the crack seal to warm up for a couple hours. While you’re doing that, you could be out cleaning out the cracks that kind of stuff. So, if you guys ever see that happening, that’s because they’re waiting for the crack to seal to warm up. Beth Borysewich I got a couple of things that are in absolutely no order whatsoever. Having to do with code enforcement, a couple years ago I put in a complaint about the area across 160 from my house that I can see on a daily basis. I had to identify an address. So, code enforcement is continuously going out, checking out the address, finding issues, and that’s about it that I know of. I have talked to Commissioner Koenig, and he said that they’re working on some sort of document because this is the area I’m talking about. It’s Simpkins Rd. down to 160, 160 north to Harris farm, and up Harris farm over to the mountains base, and then across the base all the way over to Simpkins. that’s a huge ass area; I don’t know how many acres it is. But anyway, there are cars, there’s buses, there’s trucks. There are all kinds of weird buildings out there there’s one house that was just a nice house all of a sudden, it’s got all this aluminum stuff attached around it. My question is, is how code enforcement is going to go out and check out this entire area, which I’ve asked a couple times, and get it cleaned up. I don’t want to look at all that. I don’t want to see lights at night. There never were lights before. It was dark. I want to know about that. Also, there used to be a fair and festival committee. I think it was called fair and festival, and I think that it was disbanded by one of the board meetings, and that’s when commissioner Strickland took over the fairgrounds and everything having to do with the fairgrounds. I want to know why it was disbanded. And I want to know why it is that commissioner Strickland is the one that is now taking over, instead of this committee that was doing an excellent job that I could see from all of the old videos, crack sealing; you say you can put that crack sealing stuff on the ground, you have to wait for it to heat up. as I’ve been saying, I don’t care if it’s good for the environment, we’re in the middle of almost nowhere. California is sitting here suffocating us all the time, use tar. Get it done, let it last 10 years and don’t sit there and waste money waiting for the other crack seal to step up and warm up. I’m very pleased to see the commissioners actually have a discussion and listening to some of the townspeople so kudos to you guys on that. I just want to take a couple moments to explain some of the activity today, because of me. I’ve been doing this a long time, I’m not trying to pull rank, I’m just saying that my perspective is 1 where I’ve had the benefit of watching many people, mayors and state senators and city councilors, and people were very old when I first got in, so I have a little bit of a different perspective. My learning through all this has been to do things in a certain way, and that is fierce advocacy and disclosure. I know that doesn’t always work with other people, and they may not like that, and that’s who I am. I sort of gave up having a harmonious existence on that when 18 of my large campaign signs were painted with vulgarities when I was running. I sort of understood what I was gefting myself into. I will give my opinion in a way that maybe other people won’t. It’s not intended to offend anybody; I don’t take any of this stuff personally. I never have; I never will. As I get older it’s even less so it’s kind of interesting. My priority right now is the crime in my district, because those are the people who put me here, those are the people I answer to. I don’t want to get into the at large versus district representation debate that we seem to struggle with here, but my priority is that. just to clear up, stabbing Petrick park yesterday, August 1st there’s a stabbing at Petrick park, June 28th there’s a stabbing at Petrick. so, there’s been 3 in roughly the last month and then of course the shooting at the other park. Those are the things that I have to fight for, and I will do anything I can that is ethical and legal and within my power to fight for those things in any way. I have been blessed with whatever talents I’ve been blessed with, and that’s who I am and that’s why I do what I do so I appreciate that Mr. Chairman.

the question I asked earlier, I think the answer was that on the airport money, there was allocated about $818,000 left, using the 6% number, about 85,000 of that today, which leaves about $733,000. What happens to that money that it was allocated to the airport but now apparently is not needed for the airport. does it get saved for forever or does it go back in the Kitty. Stephani Elliot those funds are going to be spent. It is possible, as Mr. Cody Mckee had explained, that we may get a refund through a state of Nevada program, and we have not received that funding yet. So, at this time those are spent funds that are going to be utilized to meet our match. The other intention of the $1 million outlay that was originally approved just for airport maintenance contracts, items of that nature, that $1 million, was intended to keep rolling to assist the airport in its operationsHowever, at this time we are not expecting that to be replenished until we actually start receiving the refunds from the state. because

I think there’s money out there that’s been allocated to stuff that we’re never going to use, where it stays allocated and we can’t get our hands on it because it’s “allocated” to something else. Linda, as a reminder, the fires out of Utah and the Nevada test range has overwhelmed Southern Nevada and worked its way up, and that may be why your husband has had such a hard time breathing. Because of the smoke, the heavy, heavy smoke, you couldn’t even see the neighbor’s house for a few days. As a reminder, if you’re not able to at Thursday evening at 6:00 PM at the Chief Tecopa cemetery, the military service area for the Purple Heart ceremony. It’s a very special ceremony, and many of you that come here to these meetings attend and you’re so appreciated. everybody’s appreciated of who’s in attendance for honoring all of these soldiers fallen and the ones that are still with us. And I’d like to know, I’m certain that Christy Sigmund is no longer in chambers, but does anybody know if we’ve had any adoptions today? Because I need to budget for those 72 dogs that may be adopted today, there might have been a run on dogs. Thank you

In regard to the Purple Heart; at the same time, at 5:30 the Pahrump OHV committee meets in the veterans’ building inside. So, it might get confusing for those in attendance. We’re going to have a little sign, so if you start entering the veterans’ building, then there is a meeting about the OHV part going on at the same time as the Purple Heart, but I certainly will balance and get between the two of them and get to see all of you. The next thing I’d like to say is thank you all for your work today. It’s a lot, it’s not easy, it takes a lot out of us and so everybody did a great job and the community, we really appreciate you.
