, Mr. Ghost, thank you very much fer making an effort to help with your donations to alleviate the overpopulation at the local shelter. Anyone who owns animals knows how much they give and how little they ask in return. Now with conditional use permits, we have made it even harder for the small rescuers that just want to help. Believe me it's physical, emotionally, and financially taxing. A great Roman historian Tacitus once said, “The more corrupt the state, the more numerous the laws.” We were at the top of the food chain people, but we turn a blind eye to animals whose only fault in life was being born. Catherine Lilly - As a longtime resident of Crystal, NV, | wanted to bring up the racing issues that we've been having out there. | support the racers. | support using our desert in this manner as long as it's supervised, cleaned up, and repairs are done to the berm. We had a flood 20 years ago out there that put a foot of water in our building out there. We still are cleaning up from that. I'd like to see that berm fixed as soon as possible. Last year we had a power outage when one of the racers hit the power line out there and took down four poles. We were out of power for 16 hours and there's a lot of seniors in town. There's a lot of seniors over in Amargosa that also lost their power. There was no way for us to (I don't think that was the BITD though) but there was nothing anything for us out there to help these seniors that had no air conditioning. Ironically, my parents made their money on racing and off-road racing. , when Darrell Lacey was actually the at the time was the planning director, we talked about issues in regard to what we call the zombie lots today. We thought we had some good plans to put in place, just never happened. Hopefully, we will go back and revisit some of those things that we talked about. | know John you were very well aware of those, and you really wanted to do some of them. It'd be nice to get back into that again. Daryll Lackey - Frank Carbone was just talking about how people have good ideas, but nothing gets done. Good ideas, fair requests; People come up and they have sensible, sounding requests until they find out they’ve fallen on deaf ears. You're Republicans. You're loyal to the Republican/Democrat system of the Illuminati that controls our country. Nothing will ever get done for honest people. You're going to move yourselves ahead financially and | can see it in your faces when people talk, nothing's going to ever get done, because of you. Because you're loyal to the Republican or Democrat, doesn’t matter. | was a Republican for the Ron Paul! Revolution, and we took it. TV didn't transmit it to the world. It's not possible for the Republican Party to correct itself from the bottom. It is run from the top. People say, “Well what else can we vote for? Well, nobody on TV is going to tell you the alternatives to get away from it. Mexico voted out the two-party system two presidents ago. Why do you think it's so hard? They're putting them in cages now. That's how evil they are. Because of the likes of you. You enable it, you encourage it. Now there’s punishment against homelessness. While the criminals made people homeless. The criminals behind our government, our Republicans, and Democrats made people homeless. Thomas Jefferson said if the Republicans/Democrat, if you allow central bankers to own or control our money, your grandchildren will be homeless. Ya'll don’t care about your grandchildren. You think you got them tucked away. You think you got them safe from the system. You hide from the ugly. | don't feel sorry for you. Karma is an interesting thing. I'm not going to stop thinking of different ways to affect the change that needs to be made. Diane Southworth - It's community outreach time. I've got some numbers from the food pantry in June. We had 7765 individuals and 1183 households that got assistance. In July, 75 hundred 7581 individuals 1222 households. We don't know how many are in the households, but it's got to be at least 2. | figured about 10,000 a month that are getting aid if not more. We have our game night on Wednesday nights, and it is for 14- to 22-year-olds. It's no alcohol, no drugs, no cigarettes, and they get them off of their phones and playing games. That's kind of a good thing for teenagers. Then we had someone from mine space, which is a holistic approach to mental health, so that's something that can be considered. I've got a list of when our next meetings are. I've got something called Myspace and i'm not quite sure what they do but they seem like an interesting group. | have a booklet on alternative methods of pain management. I've got a list of resources for various different things that we have available in this town and of course the usual with helping with the diabetics’ self-management that starts (I don’t have a starting date). Linda Clark - It's like we've got a lot of round people today. | really wish that we could work a little bit better with our community. Listen to them. Understand them. Pay attention to them and try to help understand how you guys are affecting our lives. If you go out and talk to a lot of peopie in this community and listen to them, you'll find out that you are wrong, not us. A lot of people are hurting. They feel like they've been left behind and that you guys don't care. | totally agree. | haven't seen anything in the five years that I've been here that f could write and compiain about or to brag about. Maybe you have a list, but it may not be the list that we want. You don't listen to our wants or needs, and you go with what you want. It's not right. It's our homes and some of our lives are being really upset by some of the decisions that you guys are making. | think you need to pay attention to what you just do and the decisions that you're making. Remember, we don't need gas stations on every corner. What the hell for? There's a lot of things that you have approved. You keep teiling me we can't tell people what to do with their land, but you don't have to change codes and all that kind of stuff to make it easy for people to put in these things, so that people lived there first and that's their backyard. Their front yard and it's not yours. You obviously know that, so you don't really care. Tom Waters - Our town board committee is on track. To get the question, we established the Pahrump town board on the ballot. However, we're still in the early stages and still have a lot that needs to be done. Each step requires a lot of support from the Pahrump community. Many questions have been answered. But some confusion remains. The town board committee will host a roundtable on KVM TV, and this will be on the 8th of September, it's on a Monday (don't have the time yet). You can please submit questions or concerns to be answered to the group's Facebook page which is a Pahrump town board committee or via e- mail at townmail@mail.com. The goal of the committee is to get the question on the ballot, to reestablish the Pahrump town board so that residents can vote yes or no. Signatures of voters are required to place the question on the ballot. If the signature quota via the petition is not met, the question is not placed on the ballot. There will be no vote and no town board. Please sign the petition to allow the Pahrump residents either to vote yes or no in November 2026 for the town board. They get a chance to vote, and they're not just told something by someone else. At this point, there are no town board candidates. The committee members are not candidates. Anyone who would like to be a candidate for the five-person nonpartisan Pahrump town board with campaign and run to be elected at the same time the question to implement the town board form of government is placed on the ballot. Every Pahrump voter is eligible to run for one of the town board positions. Petitions will let you know the different locations where you can sign the petitions. The Pahrump town board committee is still looking for members. You can contact the team leader Beth Borysewich through Facebook or e-mail if you're interested in being on that committee. Cont... Mary Rose Parkman - | am the community outreach and coalition manager at NYC communities’ coalition. | wanted to bring an awareness of a few things that we have coming up. As you're probably familiar, every October we help coordinate along with a lot of volunteers the remote area medical program. We are very proud and grateful that the organization is coming to Pahrump for its 10th year. It's very unusual for remote area medical to come beyond one year to a community so it's a testimony of the needs of the community. As well, has over 1500 volunteer hours that come and help on those two dates. That is October 4th and 5". You can come to our website for more information at nyecc.org. We're very grateful for our community for all of the participants, the community partners, the community members families, and the school district that came out to our over 15th year of doing backpacks and our back-to-school program. This year we had 1300 backpacks distributed across our service area which is Nye, Licoln, and Esmeralda County. We had 55 members of the community come to the high school on July 26th and we're looking forward to doing it again next year. Tammy Pitman - August 5", Tom waters stated that the town of Pahrump board would not be responsible or could not raise taxes. That's not the whole story. Since 2009, NCRS requires all town budgets to be approved by the board of county commissioners. As it was historically, it would make recommendations to the board of county commissioners. The board of county commissioners would rubber stamp it. That has been going forth even with the other town boards that come to the county. Three of the last four years of the town of Pahrump was in existence the board recommended to increase the property taxes of citizens. In those four years, property taxes went from .19 per thousand and ended up at .43 per thousand. That's over double and the board of county commissioners approved every increase. The property taxes went down after the TOP board went out of existence. Wasn't that interesting the very next year our property taxes went down. The other thing is we talk about getting it on the ballot to vote, well if you don't sign the ballot that's also a vote. Tara Logue - | want to commend the board of county commissioners for all your efforts in allowing the people to have pubiic comment time during your board meetings. | find that along with many seniors this opportunity is really important when you have circumstances that prevent you from standing in line and participating in person. | noted by the way that | believe a new format for the agenda that | cannot (and it might be on my end as a technical problem) and I've notified the technology department there at the county: That the agenda did not appear side by side with the view of the board and the room. | just wanted to let you know | was having that issue. But | also want to say thank you for your patience, for your interest, in letting the public be in front of you. Don Meighan - | was at the Tonopah meeting a few weeks back and we were talking about landfills. I've got some information for you. | told you that | did a little bit of looking. As far as I've got different parks from Carvers, Hadley, Tonopah, Beatty, and Pahrump. I'll start out with my own. My total tax increase from last year was 25.9%. My landfill increase was 99%. And the percentage of landfill to the total tax bill was 61.3%. Hadley it was 21.8, 101% increase in landfill, 38.3. Tonopah was 35.7 a 121% and 42.3. Beatty was 27.8 123% increase in landfill 7 2.GENERAL PUBLIC COMMENT (Up to three-minute time limit per person) Public comment will be for all matters off the agenda. Cont... and 48.5% in landfill over total bill. Yet in Pahrump, it was an increase of 14.6% which is half of what the rest of them were. An increase in the total landfill is 129 which was consistent with that and then the total landfil! over bill was 14.2% once again. Now, some inconsistencies that | found within our neighborhood, we have a little motel that has two different locations, on two different parcels. One of them had a decrease in taxes of 1.9%, a decrease in their landfill bill of 35.7% but their landfill bill still represented 15.25% coming from landfill. Now their sister, which is roughly, | don't know a quarter mile down the road, they had a 26.1% as opposed to 1.9% decrease. They had 600% increase in their landfill and a 23.7% percent of their landfill to total bill. There’s another park out there that has about 40 units in it. They're still paying $35. They didn't get any assessment. They've only been there for about 8 years so it's not like they're new. | found a couple of private individuals that I've talked to that had some issues with it and one being my daughter. She had a 26 1/2 percent increase in her taxes so, it's not just businesses. She had a 250% increase in her landfill assessment and a 23.57 for the landfill to total bill. Then there's another individual that lives out there that had 106% increase in his overall property taxes with a 444% increase in landfilt last year to this year with 33.8% being landfilled. Another issue is the first day that the county took over, it was supposed to be the 1st of July, but it was the 1st of August they weren't open and when our only cop that we have down there called down to the county to find out what was going on. He got laughed at. He was posting this on Facebook but since we've been going there, they haven't been charging this. Herman Lewis - | take great amusement at listening to the people that want to put a new town board together. I'd like everybody to remember the last one. If I'm not mistaken, ! think the people of Nye County and Pahrump particularly rose up and tried to arrest them. There was Don Cox and bill Carnes and all the people that were involved with that. Every time you start putting more levels of government involved and you put a bunch of liberal progressive, mentally ill Democrats out there. (I like some Democrats out there; | like Bobby Kennedy Junior). But if you put these levels of government in, you're going to get such a nightmare. | remember when they tried to put together Harvey Clickin world and the whole amusement park. Everybody, please come to your senses. We don't need another town board. Our commissioners are doing a great job. Toni Hoverman - Sheriff, | voted for you, and | want to say thank you again for driving down my street today. | know where some of my property tax dollars are going when | see them at work. Whenever | see you guys drive by if I’m out, I'll hand you Gatorade or bottled water. | appreciate seeing you. The scum comes and goes on my street, sadly. The tweakers are there. | got my new property tax bill. It's $1895.52. | have a double wide on an acre on the South end of town. However, in relationship to my property tax bill, | think there's enough money that I'm paying for some paint. For the lines to be painted on homestead and the 160. tn consideration of all the construction and the various gas stations and all the new stuff that's going up, | think the stripes should be painted. All the paint has faded and sometimes it's a real challenge just trying to turn left. | don't know why we can't have that as ongoing maintenance in this town. It's a safety hazard not having the paint current and updated. We could use some dots on the road too. It would really be nice considering we're going to get a burger place and another gas station and more traffic on that corner that we don't need that you all voted on. | hope and | pray every night that this yoyo head who wants to have the in 8 2.GENERAL PUBLIC COMMENT (Up to three-minute time limit per person) Public comment will be for all matters off the agenda. This off-road track you guys are building with all these grants across the street, no one's talking about liability insurance. Why as soon as I'm sure as I'm standing here looking at you, the first kid that's hit killed or maimed on that off road thing you guys are all going to be sued. For the elect to remind each and every one of y'all the constitution doesn't protect itself. | basically come to y'all just because my father writes my natural rights have been denied. | assure you whether in this lifetime or next! will deny you in front of my father. Let's rise above it. | know a lot of y'all think codes and statues are logged but they aren't. There's plenty of case law that supports that and y'all are in the delusion you know maybe if we can just bring our sites up a little bit and focus on God's trust we can get there. I'll protest against each and every one of y'all per se crime. It's not a civil matter. The constitution doesn't protect itself. You do not have jurisdiction and authority to supersede the First Amendment protected rights. Do y'all even know what the open meeting laws are for. It's for us. The constitution is meant to restrain y'all. Have you read it? Do you know article 1 section 10? Is there any constitutional standing in your appointments in the JP? What about fifth District Judge Lane? You got Kirk video trafficking children through the school. You got Henderson yesterday the police in the schools. In Henderson you have a teacher taking naked photos of a disabled child. That's a misdemeanor? Are you kidding me? Eddie Jim- | want to back those ladies up on this off-road racing. It's pretty well true what they're saying. Garbage, all that stuff. I've been fighting this issue since the first time the first race came through. They're right. You can't get to your property until the race is over. This goes on all day. If you tell them you have to get to your property, they tell you we have the authority to have you arrested. You cannot go until this race is over. These race monitors are disrespectful, and | don't know who gave them the power to threaten you like that. Helene Williams- It's an honor to stand in the room with the American flag looking at how beautiful it is when it stands to honor the people. And to read in God we trust, it's aiso an honor for me as a citizen of the United States to support as a republican the president of the United States. Whom has signed a petition that if you burn the American flag, you will spend a year in jail. No changes whatscever. One four year and | support him 100% with that decision. Tim Bohannom- | went by the offices on Friday and saw everything was shut down. This was roughly about 2:30-3 o'clock in the afternoon. It would be helpful to know if the offices are going to be on a non-holiday weekend. this was at the administration building in Pahrump. Are we losing hours? Tammy Engel - With the state security incident that happened, | wanted to share with the commissioners and the public what services we can process in the Sheriffs Office record division and what services we are not able to facilitate at this time. We will continue to process liquor work cards, brothel work cards, offender registrations, felon registrations, and we are still accepting civil paperwork from the courts. We will be able to serve that paperwork. We're accepting public records requests. Some of those services that | mentioned, the work cards and the registrations, we will just have to delay the background checks on those. But those are cards that we issue out of our office. That's our thing so we can do that. Then there are services that are not ours like Nye County School District employees, we will not be able to process anything for them. We cannot process CCW applications, whether they're initial applications or renewals. Healthcare employees, we cannot process those applications or any Department of Education applications that come in. We cannot do any fingerprinting. Everything is through the state. A lot of our work in the Sheriff's Office is done through state portals and different state websites. | just wanted to fill you in and let you know that we are open, and we are there but we are limited in process. | was hoping this would help the public if anybody's listening and maybe keep them from being too frustrated and they'll know ahead of time. Kristi Siegmund- In response to Jason Mann; To clear up a few things that were not quite accurate. He was correct, there is no clinic at the shelter at this moment but that is not for the lack of trying. Nationally we're seeing a shortage of veterinarians. We don't experience it just only here in Pahrump or in Nevada but throughout the country as well. We are what the country calls veterinarian poor and we must do our best with what we must work with. Also, animal control officers, he mentioned we only have one. We have 3 here in Pahrump and one up in Tonopah. When these animal control officers have their days off, there are days that sometimes we only have one animal control officer. We have a very large county and so that is a lot for one person. But when we do have everybody here, we don't just have one, we do have a few. The costs in Las Vegas versus the cost in Pahrump, | don't know the personal costs as every veterinarian charges differently. What | can tell you is that the shelter pricing in Las Vegas is the same as the shelter pricing here in Pahrump. The veterinarians that we use in Pahrump are always putting their clients in the town first and we are at the mercy of their schedule. Which is why we use some of the facilities in Las Vegas to help us with our spay and neuter. As you all know, | am a huge proponent of supporting local. So, all of our emergencies and regular care do go through our local veterinarians based on the schedule availability that they have. To sum up Jason’s comment, | did a quick Google search and saw that as of 2024 we have 56,000 people in the county of Nye. We have nine people in Animal Services. My experience is when you have a single point, this is typically not a single point of solution, it is a single point of failure. | asked the community to continue to be part of the solution and these animal owners to continue to hold themselves accountable and responsible for the animals which they have. Together is how we're going to solve a lot of these challenges that we currently face. Some statistics that | did ring today | haven't given you statistics recently. Over the last 45 days we have seen 173 placements. What we have also seen is 254 impounds. That is 198 strays and 56 confiscations. And those confiscations 10 3.Commissioner/Manager Comments Cont... can be policed in nature, they could be protective custody, a person goes to the hospital or whatever the case may be, and only 48 returns to owners. We're seeing a decrease in animals returning to their owners which increases the number of animals that we have in our shelter to care for every single day. We have 3 animals coming in for everyone going out. We're still on that negative on that to reverse data that we want to turn around. Currently we have 142 animals in the shelter and over 70% of them are available for adoption. This month is still our clear shelters event through the generous sponsorship of Bruce Jabbour. Our fees are waived. We have one more week through this Saturday to help us clear the shelter. We invite all of the community to come down and take a look at those animals that we do have available. Cats dogs, big, small, everywhere in between. Come on down and take a look at them. A couple of statistics about animal control just to give people some idea, our animal control officers have issued 34 citations in the last month and 26 warnings. They have completed 913 calls, almost 1000 calls. | just shared with you how many officers we have so again it goes back to rallying together as a community to find a solution that is helpful for everyone. The owners of animals again please take responsibility. Help us out because if you can contain them on your properties, a lot of the challenges that we currently face will go away. Then the last piece that | have is this Saturday August 30th we are hosting a first ever adoption and vendor event. We have 7 different local vendors coming to our shelter to set up tables. We have a food truck coming to also celebrate not only our three-year anniversary but hopefully a really wonderful last day of our clear shelters. Between 10:00 and 4:00, come down to the shelter and help us celebrate this event. Manager Waggoner- | want to address one question in regard to the follow up on the room tax audit on the findings and the corrective actions. There is going to be an item on the September 3rd agenda where we will be doing our presentation on that.

Mr. Chairman | was late today because it's very hard for me to drive by a shopping cart without picking it up and moving it. | did want to mention; | do drive my district pretty regularly and the park has always been a crime problem going far beyond before anyone up here believes. | believe that the Sheriffs Department is doing a great job of whatever they're doing. Whatever they're doing is noticeable. | understand the Sheriff is juggling a budget that in my opinion is not enough to take care of everyone here. It's hard to do that, to allocate the resources in the right places. | want to give credit where it's due.

The plans for the shelter clinic were to get that done using in-house labor. Unfortunately, until we get some of the animals out of the shelter because right now, they're in that room and there's no other place to put them. Again, we need people to come down and adopt the animals. And people have to stop taking animals and letting them run free because they don't care about their own animals. This is a horrible situation. I'd like to look at Frank and say you should have made the shelter bigger, but that's not the answer. You make it bigger to just be more animals in there. You can't win this one. | love animals and it just breaks my heart to go in that place. But we're working on the back to get that done with the runs and all of that stuff. Part of the deal was to fix that and make a clinic out of it. | had a vet lined up but now that's gone away because we can't do it. We don't have the room. I'd like to ask staff to follow up with BITD and see what we can do with this. If they were denied a permit with BLM because of their lack of clean up at one point. Maybe BLM needs to take a hard look right now of what we got out there.

Commissioner Boskovich

This has been probably the longest public comment session since I've been here. But regarding the zombie lots or the utility challenged lots, nobody would like to see these lots built out more than | would. It helps everybody but it is not something that we can afford, nor would | ever vote to put it on the backs of any taxpayer in Nye County. There needs to be some other solution that doesn't do that. The Purple Heart ceremony, all five of us commissioners were there. it was a really cool thing. Not to mention everybody else, pretty much within the county, was there. The last thing | want to mention is, | try as best | can to let people speak. Whether it's you know on topic, not on topic, my goal is to let people say whatever the heck they want to say. It's got to be you within reason.

Sheriff McGill

We received this application and reviewed it, and everything was in order. | spoke with the area command Lieutenant for the Beatty/Tonopah area and asked him if we needed to provide deputies on overtime. He said no. He was of the opinion that we were going to be able to handle any staffing needs based on regular duty hours. Our recommendation is that it be approved.

Ginger Simpson/Alina McGough- this is the first time for Pahrump doing a poker run for ATV's and off-road vehicles. This is something that is done all over the state, the United States. Beatty is huge, Tonopah has done it, and | believe this is their third year. They had over 200 13 9, 8.10:00 a.m. — For Possible Action — Public Hearing, discussion Cont... people. Virginia City does it. Goldfield does it. Mina does it and so does Dyer. Dyer has been doing it for 13 years. We have these trails, areas and no one even does this. We thought it's going to bring a lot of attention to Pahrump that we have more to offer besides live PD. it'll bring so much to the town. We have so many off-road trails that haven't been visited. People go up in the Mountain Springs, Wheelers pass. It's not just your ATV's. It’s your dirt bikes, quads, jeeps. Things like that, we really want to bring these clubs together. Bring more people together and benefit our community by bringing people from out of state and out of town to benefit our town.

The fall festival is one of the biggest public events in our county. In the past, this event has been secured by deputies and has worked because deputies bring training, authority, and resources to handle whatever may come up. In recent years that coverage has been reduced or replaced by private security. This year we were told deputies would be budgeted back in but once again part of that money is being diverted to pay for a security company. The question is if the county already has money to set aside for public safety, why not keep that funding in-house and fully staffed deputies for the event? Why rely on security who at best walk around and look visible but in reality, cannot enforce laws, cannot investigate crimes, and cannot make arrests? When something serious happens, they call deputies. That means taxpayers are paying twice for security who can't do the job and for deputies who have to respond anyways. It also creates delays in response and gives public faise sense of safety. Now | want it to be clear we aren't against the use of security at these events. If there was a controlled closed access event with metal detectors and gates that need manning security would make sense. But the fall festival is an open public event that is exactly the type of environment we're sworn deputies should be the backbone of safety. On top of that our collective bargaining agreement exists to ensure that law enforcement duties stay with law enforcement personnel. By outsourcing public safety work to a private firm, the county is undermining that agreement and bypassing its own employees. On behalf of the association, we urge you to reconsider this pian, keeping the funds where they belong supporting deputies who are trained, 14 9.10:00 a.m. — For Possible Action — Public Hearing, discussion Cont... accountable, and sworn to protect this community. It's smarter, it's safer and it's the best for tax dollars.

Since | took office in 2023, my philosophy has always been that everybody gets treated the same regardless of who you are. | looked at special events and planned events and applied that philosophy to those times. When people put on a special event requiring a permit from this board, part of the process is for my office to review the plan and determine the need for law enforcement. The times when we do provide deputies, we charge the promoter of the event for the overtime because we should not have to foot that bill. The promoter can recoup those costs through the fees charge for booth rentals. Also, if it weren't for the event being there, we would not have to provide deputies on overtime in the 1st place. This year | presented our staffing plan to the administration, and i was advised that the town would be hiring private security to staff the fall festival as well. The staffing plan that we came up with was to provide what | believe to be the appropriate number of personnel during the days and evenings. We cannot rely on deputies who are on regular patrol to respond to the park for calls. They may or may not be available. During any given shift we are fully staffed and Pahrump with up to five deputies on day shift. We can't take the deputies off the street for issues at the park, and we can't rely on having enough deputies available for the park for an incident. This year the decision was made to hire private security officers who have no law enforcement authority. | was contacted by the administration and told to cut our cost from $6000 to $2500. Then subsequently asked to add 2 deputies to Friday night. This forced a cut by 16 men hours and two deputies from what | believe to be the appropriate staffing level. This is taking money out of the pockets of our personnel and giving it to people who can't do what is necessary. They have no law enforcement authority. | am not against this in the way of being a visible deterrent. That is a very good thing. But criminals know the private security officers cannot arrest them. When a problem comes to their attention the most, they can do is stabilize the situation and call 911 and we will respond. However, we don't know if the deputies on the street will be available to respond in a timely manner. Last year at fall festival, security personnel contacted an autistic young man who had lost his family. They didn't notify us and sent him on his way. After quite some time of deputies looking around the park and the surrounding streets for approximately 2 hours. He made his way home on foot. That was when we responded to the home and found that he was okay. This should never have happened. | realized that our payroll is a long, large expense but you get what you pay for. Yeah because this is something that | personally have never heard of, When | was commissioner before, | don't think we did this. | think everyone here knows how | feel about private security because it's come up before and | was vehemently against it. Our cops get paid to do a job, they work here, they live here, we pay them to do what they do, and they do it well. If it's going to cost us more money to have them at your function, we need to come back and take another look at whatever says you're going to hire private security. Because | don't think we should be doing it. | think we can still approve the license, but we need to get back and discuss whether you're going to hire private security or not. Courtney Kenney - We aiready have a signed contract with code 4 security that includes Brett Wagner's signature and the vendor. We have already paid them. That contract went through DA approval. It went through Brett Wagner's signature for county manager. We went through all of those levels. The reason why we went to source code 4 security was because we did have an issue unfortunately with the Sheriff's Office a couple of years back. Before we brought code 4 on, we were told at the time, by Captain Harry Means, that Sheriffs Office would be there. But if an issue came up outside of the festival those deputies would have to then leave the festival to go and assess an issue if one came up. Our issue is if deputies cannot stay at the festival where we need them the whole time that does have the issue of public being safe. Not only that, but employees being also safe. | myself personally had a fight break out right in front of me that had knives. | ran over to the Sheriffs Office booth, there were no deputies, they were gone. Safety is at risk because this fight broke out. We didn't have deputies there. | do understand what the commissioners are saying but it is true that the safety of the public and us employees that are doing this event does come first. That was a big issue that we had. So, we went with private security because everything they provide. They provide a giant command RV, they have the whole area set up, lost and found, they have drones...

You already have a contract signed. We are obligated to use that security firm. | think this board would be satisfied if we used also a combination of our deputies. Have you also got a contract with the deputies like you normally would? Jimmy Martinez - We have a contract. They send us an invoice, we pay it, no issues.

Now you're talking the security. | asked about the Sheriff. Jimmy Martinez - Yeah, we've been going back and forth with emails with Brad and Joe McGill about paying costs for the sheriffs and the debt. The contract that we have now is only two days, it's a four-day event. What are we supposed to do, protect ourselves for the two days? Just like Joe says, we get what we pay for. We want to make sure the community is safe. We're having issues at the park; it's a big event so we want to make sure everybody's covered.

Three weeks ahead of the event | think is the wrong time to be trying to rehash this issue. | think moving forward if we want to provide extra funds for the sheriff to provide deputies for this, moving forward next year and for other events or whatever then that's probably the direction up to the board. But probably the direction that we should go. | think 3 weeks ahead of this particular event, we're pretty much screwed. We need to figure out how to provide additional support he can.

That deputy responded from the park. We are giving clear directions to the deputies assigned to fall festival this year who will not leave the park. If they do, they're going to regret it. The amount that we initially provided for the staffing level that we were initially asking for was $5900. No? Manager Waggoner - It was $6400 but the problem was it was only coverage for Friday and Saturday.

Very little of it is overtime funding. It’s shift adjusting and switching their short day from Tuesday to Friday.

Follow up for the acting Comptroller. Can you find us the money te cover this? James Mcare - The original cost plan we put together was for three days which was for the Friday, Saturday, and Sunday. Friday there were going to be two deputies. Saturday there were multiple shifts to be starting as early as 2:00. Sergeant with the second shift coming in with a Sergeant plus 4 which would amplify our time between 6:00 and 10:00. The coverage will go till 2:00 AM and then we were providing a cover shift officer on Sunday who was on regular time because we were going to be able to manage that staffing on the street. So, Sunday was being taken care of on regular time. We did not plan for Thursday. Working off of HR's official overtime rates and our shift differentiai, we need the total cost for that original plan was $5926.82.

Does that leave us vulnerable on Thursday, or do you feel okay for coverage so that people feel protected?

Based on my experience in all these past events, Thursday is set up day and people are working. It is much less of a volume of people attending and then again on Sunday also it's packed up.

Government is supposed to provide a tranquil and quiet life and dignity for those who are under their care. When | think of Petrick Park between the hours of 10:00 PM and 5:00 AM, there is nothing quiet, tranquil, or dignified. Anyone who does wander in, for example at 1:00AM, will be faced with a pitch-black field surrounded by drug users and dangerous people. | know this because I've driven by many different hours of the day just about daily. 3 stabbings have occurred there, one on August 4", on August 1°, and on June 28. Until we're able to properly patrol that park, until this board is able to properly fund for sheriff to keep the parts safe, we are doing a disservice to those who we are tasked in my opinion by God to protect. | know this again because | drive by, | look, and | see these things. I'm told there’s a plan for permanent solution. For permanently closing the park by 23 14.For Possible Action — Discussion and debate Cont... ordinance and I'm fine with that. But since no one has let me know about any details, it is the commissioner who represents that district where the park is. | cannot sit here and wait for someone to do something. Something must be done. If there's some kind of stalling or some problem with that, I'm willing to throw something together or write an ordinance by tomorrow afterncon. This immediate closure is necessary. Serves a compelling government purpose. It's narrowly tailored to serve that purpose and that would survive just about any time place and manner First Amendment challenge. Of course anyone who has expressed permission to use the park and what this means is we as governments say you can use the park on any specific day either in writing or orally events, ball games, teams, rentals anything like that anytime anyone says you can use the park for any reason of course and obviously or anything like this closure will not have a time that the park closes to them. The park will never close to anyone with permission to be there unless of course it's written into their contract. If | make a motion on this it will include language that any group or poor person with permission will be unaffected by this closure and it will be for a period of three months.

Tell us all that you have to have that in order to get grants. For us to fund this and is surprised that after he doesn't do it in two months, he's going to lose the bid. Shame. You know that's just too bad. You don't, you're not willing to do the work to get the money.

He is correct, it was not included in the bid package. At the time our grants team was not aware there was recent monitoring by the state Nevada Division Cc Environmental Protection. We have since found that they are requiring it going forward. There have been some definite changes in administration. And before we decided to issue 32 21.For Possible Action — Discussion and deliberation to: Cont... a notice to proceed, we wanted to ensure that we had all of our ducks in a row. And that we were going to be able to pay them and | also want to point out that in the signed contract, the county does have the right at any time to terminate the contract without cause with 30 days’ notice. That's exactly what we're looking at doing. We're at a point where we don't have the capacity to be able to pay them without this grant funding. We've already escalated this. We tried to get a waiver, we tried to get an exception, we have a written documented proof from the state the reasons why they will only reimburse if somebody has the sam.gov registration. You know definitely apologize about the oversight on our part and the non-knowledge we do know now going forward. And we are definitely taking steps to prevent this in the future.

There's a registration process. There are other businesses that they do have under their umbrella. They're very familiar with that process and have been able to provide registrations for other subsidiaries of the company, just not the one that we entered into the contract with. There's a website called sam.gov and it's a process to be able to enroll. The county has a sam.gov registration if you are doing business and you want to have a federal contract; you must also have that registration in place as well. There's some certifying information that you need to include, your physical address, your tax ID number, there’s a cage number that would also be issued so there are a few steps to follow to get that number. | do show that there was an ID assigned we did some due diligence prior to the award of the contract. An ID had been assigned a couple of years ago. It just never has become an active registration. We have triple checked the next bidder in line; The Viking painting LLC has an active registration. We have proof that that registration is in good standing until next year of 2026. Aaron Tuck - Manager, that concerns me. They apply to a sam.gov registration and have not been able to get one. That’s a concern.

Biggest problem of course is this board knows we received a very nice grant. We wouldn't have never anticipated being able to do this work Gabbs without the grant. Issued through the state, yes. It was funding from the federal government to the state of Nevada and then the state of Nevada has sub granted to Nye County.

There were definitely terms and conditions to foilow the code of federal regulations 200 which is part of grants. It was our understanding that only Nye County at the time had to maintain the sam.gov registration.

I'm talking about, are they generally the same as the ARPA requirements by the federal government? Are there additional state requirements that you're saying or is this just an ARPA Grant? Comptrolier Elliott - tt is the same Federal ARPA Grant and will be looked at the same way as the Nye County Grant.

In the event that everyone moves out of Gabbs and we don't need a tank anymore, what do we do with this money? Where would this money go?

This money through ARPA is only allocated and can only be used for these purposes. We are bound. We should have completed the project by October.

With the allocation is such that when you say allocated, that means different things to everyone up here. When you say allocated, is that something we do, and we send to the federal government or is that something that we just made a decision on ourselves?

That is something that the state authorized to Nye County.

We told the state we're going to allocate this for this water tank, correct?

We had submitted an application, and the state approved the application obligating the funds to Nye County.

In the event that we don't need it for some reason, what would happen to those funds? We would have to and another water tank or would we have to be bound by this? By the state not the federal government, right the state? Is that your understanding?

The state would take the funds back. It's my understanding they would have to return the funds to the federal government. Aaron Tuck - Our original grant was 3.8 million, they pulled back 2.6. We were kind of worried about this 1.2 million that was left. We're on a timeline on this.

What was the controversy over the hauling of that you were saying as far as you never heard someone. You were saying you don't understand why someone is hauling concrete materials that belong to us. Would you expand on that so that | understand it. Tom Bolling - In early 2000s, they started putting the hauling price or request for a hauling price, how much it would cost for the material to be delivered to our road yard into these bid packages just in case there was ever a tie. Just so happened that that year that they put it in there, was a tie. They went to the secondary which is kind of like a tie breaker.

My brother lived over there and he was pointing out all of the additional things that the county had to do after Wulfenstein did their job. He said Wulfenstein rarely did the whole job with their bids. He said the county needs to pay attention to the details in their bid compared to other bids. Because they'll leave out things like on homestead doing the rock for flooding, doing the ditching for flooding, and those would be extra costs. | haven't seen the backup on this, but | do see the difference in Morales Construction. I've never heard of a problem with him not finishing the job that he bids for. | hope that the commissioners don't go just on a name, that they you know go on the reputation of the bidder. 100 tons were what was brought up and so realistically Wulfenstein Construction you buy 100 tons at the plant it's $465. Wulfenstein Aggregates $475. Only a $10 difference. Then if you decide you're going to have it delivered, going from the construction company for $2465 and the Aggregates Company $1550.

I'm mixed up between the per ton FOB plant and the per ton FOB road yard. Again, what's my total cost for 100 tons with Wulfenstein Construction and Morales construction?

The old Wulfenstein company is $465. The new Wulfenstein company is $475.

That would be $585. Tom Bolling - We thought of what Mr. Knowles thought of as well. Is how far are we going to haul this. What are we going to do with this whenever we get it. The probiem we're not building a road like basin that we would be putting this on. Or getting a whole bunch and putting it at one location because at that point we would definitely take truck time, which place it would come and that was part of our vetting process. Whenever we got the bids since we're only using type 2 currently to fix roads, to fix shouldering, as needed for chip sealing purposes, who knows how much we're actually going to use. If you wanted the difference between Morales and the next lowest is $1.10. If you were to get 3000 tons, that's $3300 difference worth the cost. Then we'll probably use pretty close to about 3000 tons for the year.

I'd like to make a disclosure that | broker water rights and have no pecuniary interest in this. Aaron Tuck - There was a proposed well public works in the past years ago and we've done nothing up there. There’re one or two residents we have no reason to have a well. The water rights are on BLM property. The state is now pressuring us if we don't prove something. We have until the 14th to respond. We recommend just withdrawing the permit rather than them taking it from us.

| would like to give directions to staff. ] hope this will help. We have a fencing problem at Petrick Park. It's become very apparent over and over. When we do host a nice event, we can't control that event. | think it would help if we would go do the research. I'd like to request that the staff look into the cost of fencing the park appropriately. And perhaps taking those, there's funds in the top town of Pahrump fund 25252. The title of that fund is Pahrump Parks impact fee. There's $593,000 in that fund. Perhaps we can find it in our hearts to make it a safer place at Petrick Park. Perhaps that step will give us the ability to block people out like we can at other places. Can we touch that fund Comptroller?

| have already sent Jennifer Fanning, our finance director, for town of Pahrump to be on the lookout for quotes. We'll have to take a look. That was part of the comment that | wanted to make. On the July 15th board meeting, we did pass and approve the capital improvement plan for town of Pahrump. We can take a look at that funding and see if it's already been earmarked for something but that would include the commenters’ question. What happened with the fairgrounds? The information what was budgeted and what we need to stick to is already made available and it's also on the finance web pages.
