We have on the 13th of September at 1:00 in Carvers, they are having a grand opening regarding the Nori Grant. They were enabled to build a shooting range and do all kinds of cool stuff. If you could drive to Carvers, check them out. Their last opening had 100 people in the small community which is outside of Round Mountain. I'm hoping to attend if nothing in my world just falls apart. Then on the 13", there is a youth track event at the OHV park. Manager Waggoner — Mountain Falls only got a development agreement to build 3500 in total. They've already built a little over half of that. On development agreements there are C C 3.Commissioner/Manager Comments (This item Cont... expiration dates on all of them. Some of those old legacy ones have a lot of years. They were done for many years but currently we do not do that anymore. We put much less expiration dates for them. So, if they don't build, they go away. Yes, they are set aside for dump functions. They're to eventually close the dump when we run out of space within 10 years and to go towards opening a new dump. They don't go in and get commingled with all the other finances.

| would like your concerns taken to Great Basin and have the same comments you have with us every two weeks with them. Because they ultimately are the ones that are holding up your development of your lots. | would honestly put some pressure on the folks who stand in your way, which is not us.

6.1, c what happened that we are off 8K in change? Alright let's go to 6.3. | was just wondering if this is the third or fourth one where there's an incline match between 10,000 and 20 some odd thousand on the other ones. Are these budgeted?

This is where we applied for three, we received 3 and this is truly what we consider an in-kind match. We are getting reimbursed for any sort of Sheriffs Office overtime for these specialized enforcement events. When the officers are utilizing their vehicles, that is considered the match. We do get $20 per hour that they're dedicated for the program. There's not out of pocket cost; there is no funding source for the match.

Second Motion Carries 5-0 FINANCE 10.For Possible Action — Report by Stephani Elliott, regarding the budget status for the 4th Quarter of Fiscal Year 2025, for Nye County all sub-entities pursuant to NRS 354.290.

An initial glance | do want to recommend that these are preliminary numbers. Fiscal 25 is still open for the very last bit of adjusting entries, invoicing, and receivables that still have yet to post. | did a little bit of research this morning, most of the numbers still stand with the exception of some improved revenues. With the revenues | would like to state that there's been more interest in unrealized investment gains than what we budgeted. Whereas we saw that the room tax revenues actually increased a lot of anticipated revenues for both the town of Pahrump as well as Beatty. In the back up on our first page, we just have the basic revenue report as of the report date of August 10.For Possible Action — Report by Stephani Elliott Cont... 12th we were at 94% of revenue, which is about 5% less. Just checked it this morning, we are actually at 2.5 million over budget or at 104% and this is for the general fund the 10101. Go to the next page which is our general revenue excuse me general expenditure report. This is for again the general fund 10101. The preliminary expenses that we see as of this state show right around 95-96% of expenditures have been budgeted and spent as of this date and that still holds true today. On Page 3 we see a remarkable increase of impact fees which is fund 10250. As well as public improvement fees 10253. Both of those are extremely weil over budget and you can also see the year over year change. That again much more than what we saw from last year. Talks about the economy and the growth that we're seeing where we had anticipated less revenues at that time. On page 4, we do see that overall, when we look at all the other funds Nye County has only expensed just about 68.8%. We've actually spent just about 3.3% less compared to the fiscal year. | do want to also point out you can see on this same page at the very top of the revenue function on capital projects 10401, it says 172% over budget. That's really where we saw a big net proceeds and then again, we've got about $515,000 over what we had anticipated in revenues from interest and unrealized investment gain. One of the things that | noticed here is that we're only at 61% of expenditure, however you'll notice that we've expended 11% more in fiscal 25 than what we did the prior year. That means that we'll have some retained earnings, or we'll have some end of fund balance to continue operations in fiscal 26 through Town of Pahrump. Town of Beatty again you can look at the Beatty room tax, which is fund 24220, 24403 the room tax capital projects above target. Again, that's where we're seeing the room tax revenues higher than anticipated as well as interesting gains. Page 7 is for the town of Gabbs. We saw a remarkable reduction in expenditures in Gabbs. 64% lower in fiscal 25 than fiscal 24. We're only at 34% expenditures to budget. I'm hoping that some of that is due to grant funds because we've had several million dollars get funneled for major infrastructure projects there. On the revenue side, the one thing | did want to point out it looks like 23402 which is the Gabbs special capital projects. Gosh we've only gotten 1% received. When | looked at that, there's $50,000 in operating transfers that were budgeted that had not taken place at this time. So that makes sense. We didn't need the funds so that's the good thing. Finally, we come to our last page which highlights our town of Manhattan. The main thing that | saw here was on Manhattan water on the revenue side, which is fund 27502, you can see here that we're at 130% to goal as far as our budget. However, | do want to remind everybody that there was a $60,000 miscellaneous revenue increase. We had approved a budget transfer back in June from the general fund to help cover that fund at that time.

You can come into the finance office, and we can delineate each fund separately. We combine them all into one report for ease of use. We do have information available online for the separate towns and that would be under the CIP, or you can look at the final budgets if you're looking specifically for a specific town. Presentation discussion by Ben Viljoen with Nevada R, LLC. regarding reopening operating, the history of the Victory Tungsten Mine located north of Gabbs, NV. (5- minute time limit) Ben Viljoen - t'm with Nevada Round mining. Our company is family owned; there's my three sons and myself for the whole corporation it’s not big. But we have been in mining in my county for 50 years in my case. What brings me in here today is that I’m working on a water contro! pollution permit that requires you go before the county commissioners or notify the county commissioners of mining activity. I'm old school so !'m up here to talk to you one-on-one. Let you know what our plans are. Give you a face, a name, a phone number of somebody to get a hold of with questions or concerns. We're right here and easy to get a hold of. The victory mine was Nevada or Nye county's largest sheet light producer which is an ore of tungsten historically. We have purchased that property and we plan to reactivate the mine. We've got the product which will be sheet light 60 to 70% concentrate and will be sold to Kennametal in Fallon. It's kind of neat that the only 17.Presentation discussion by Ben Viljoen Cont... tungsten mine in the United States will be in Nye County and the market for this stuff is in Churchill County keeping everything close to home. We plan to start milling at about 20 tons a day. Small operation. Historically the mine ran mine and mill to 100 tons a day. It never wanted for ore; they shut down because the government dropped the support price in 1957. Never operated since that time. | think it'll be easy to achieve 100 tons a day, but we need to work our way slowly because again we're financing this out of our own pockets. At the time the mine or the mill operates 100 tons a day we will be able to take in custom ore. The ore is sheet like, is a very specific type or it doesn't take exotic milling or anything like that, so we'll be able to take in ore from all around Gabbs. There were a number of really good sheet light mines in the area. Sheet light prices are going up all the time. I'm sure you've heard about all the all the problems with China. I've talked with the Defense Department and department of logistics. They're projecting a good sheet light or tungsten market for 20 or 30 years. That should be a big shot in the arm to poor old Gabbs and us as well.

Mr. Viljoen, | have just a couple of questions. You mentioned the milling will be on your site? Ben Viljoen —- Yes. We are working on three different areas to do it. Right now, our permitting is going to be on mine site. We are looking at two other properties better suited, but NDOW makes it difficult.

You mentioned some other mines that may be interested in transporting the ore to your property to be milled as well. All those taxes will be facilitated through Nye County. Ben Viljoen — Correct. One mine is further away from Gabbs, but they're all within Nye County. They were all big producers, mine was the very best.

Thank you for revisiting and not reinventing the wheel but getting this back to par is your plan. Hope things go well through NDOW. I'm certain that the people of Gabbs and the surrounding area appreciate your endeavor.

DA, this is an item that the manager is going to be authorized to waive or not waive potentially. Is this something that because of my duty in a private capacity that | need to back out of? | have no pecuniary interest whatsoever. ADA Richardson — No, | don't see anything that precludes you from participating in this agenda item. HR Director Goldner - This was brought forward so we could come up with some ideas on saving the county some money. We used to freeze positions when people left that had large payouts and we've stopped doing that. We have been putting money in the contingency fund or absence fund.

We did this one other time, correct? HR Director Goldner - We started it when Helen came on. Then she said that she didn't ( see any big difference. She said it just wasn't necessary. We did it years ago, but | can't remember exactly what year.

In a way this is maybe a good way of saving money. When we lose people, we have to replace them. | must tell you we need more people in our department. We have frozen seventeen of our positions that were empty. We don't have enough available positions to put all of our applicants in. Right now, we are able to pick and choose based on the number of applications that we have who we're going to hire and who we're not going to hire. If we didn't have that frozen 17 positions from back in May, we would not have to be doing that. This is just going to cause us another issue in that we have applicants that want a job, and we just don't have a place to put them. Because our positions are frozen for another 90 days. We've got Amargosa, Beatty, the smaller towns, Round Mountain, who if we were to have a position open today. We've got 2 frozen positions that we can't use and if somebody comes in wanting a job in Round Mountain, what do we do.

My response to that is why there is the provision here for critical positions that the manager can override and open.

McGill - Understood but then it's going to be up to Brett whether he likes me today or not. Herminia Stumpf - On what the sheriff said, if we have those 17 positions frozen it's because our funds are tied up somewhere. If we have more efficient people behind the desk, some of those funds could be freed up to put more officers on the streets. In Round Mountain, we would definitely appreciate that. Beth Borysewich - | heard the sheriff say we have 17 frozen positions. When it comes to safety in our town, | think that he should be able to say I'm not going to freeze any positions or I'm going to unfreeze these. Because we need to keep our people safe. | cannot imagine 17 positions not being filled because of whatever reason. When it comes to safety, that should be the number one priority. | don't care about whatever else is going on in this town. Sheriff, | support you 100% getting those positions filled. Any other positions, administrative positions, you can cross train people to do other jobs, and you don't have to worry about filling those positions again. | see people sitting around doing nothing when | go into the different offices and wonder what their job is. They’re just sitting there staring off into space. | don't know if it's a break. | don't know if they're having a mental issue. Michael David Garcia - | do believe if you truly have prevailing wage, it's just spanned between the Pahrump and Nye County. Madam, if you could explain, might be a legal question, when we have a hiring freeze does that include a designation of a new position of someone who's already hired? Does that cover that in your understanding? Are we saying someone isn't going to take the role because we don't have the definition of hire. | don't see legal definitions here like the law would have that. If someone who's already on the payroll takes on additional duty, is that frozen out as well or is that not frozen HR Director Goldner - Are you talking about if they transferred to another department?

If they either transfer or if they're the same department that they're doing something new that's not under their classification. It creates at least an appearance that in a public way that they're doing something else. Like Jim Bob wiil now be the director of signing in trucks in the truck yard. Would that freeze that, or would that not freeze that? HR Director Goldner — If we're actually just giving somebody additional duties, then they could be working out of class. If we're moving somebody to an actual position, then it might not. The position they're leaving might not be frozen because they wouldn't have any payouts. It takes at least 30 to 60 days to hire somebody new off the streets.

That prevents that process. Really what this prevents is the process by which you launch an official search, right? | mean that would be a good way to see what higher means so it's not so much a reclass. If we're under an obligation to launch a search for something that's being frozen, correct? HR Director Goldner — Yes. Or somebody leaves the county completely and they've been with the county for 20 years; they have $50,000 worth of payouts.

That answers my question and seems a little vague. The issue with police and fire, | don't want anything frozen with police or fire. | think it really is just a disservice to this community. | actually support this very much, but my concern is that it just creates a backlog. | know that we have some people who are waiting to go through a police academy right now. Does it mean the sheriff has to go beg for those exemptions and how long does it take? It's my concern that that's on the table. | don't like it. | want police and fire to be free to hire these emergency positions because that's what they are. In order to support this, | would be looking for an exemption to support any position under fire and/or sheriffs office.

| need clarification please. Because as it's written under critical needs, I'd like the clarification Elona under critical needs of and for the department head or is this for critical need positions? Because there are two different things. Critical 12.For Possible Action — Discussion and deliberation to: Cont... positions need to come before the Commission. That will take care of the sheriff's concern in case somebody doesn't like him that particular day. However critical needs of the department head, which we don't get involved in, the minutiae of the department heads, as you know, that's not our role. They know the needs. If you could give clarification. HR Director Goldner - You're correct. This would be if a department head feels that one of their positions is now vacant and it's important to their department. It's critical to them that they need it filled so they would then get a hold of the county manager to see about getting it waived. This whole agenda item was never intended to affect public safety. Some positions, it probably should have said that. It was never intended to affect them because they would be considered critical.

First responders we will just put that into this category exempt from this agenda item. That helps Commissioner Bayne’s concern, my concern, and the public's concern. | have another concern. We're early in the new fiscal year and we're already considering putting a freeze throughout the rest of the year for all these departments. Where there, for whatever reason, they're down with positions. | know this will help save money. | understand the cross training. | understand working out of class. There's a certain percentage that they would have to be paid. Not as much as overtime but all these factors come into play. Is this necessary that that we consider putting a freeze for these other departments other than? If a motion is made, | would hope that we make it where first responders are exempt. Is this necessary for this item to go forward where we are so early into the new fiscal year regarding putting a freeze on and hovering over the department heads except for the first responders as sheriff and Fire Chief. Emergency Management. Manager Waggoner — Yes. We are very lean right now and it is very early in the year. It would not take much of anything happening that put us below our bottom threshold for an ending balance. That's what we are protecting. This is just one measure that's being looked at along with others. We're also in the middle of union negotiations. There's a lot of factors. Yes, | do believe this is necessary and it was my request to Elona to have this item prepared and brought to the board.

Again, hopefully the consideration was there with overtime with out of class pay. The absolute necessity of having these positions in place. That's nice that we talk about cross training. But it's tough to move somebody from point a where they're overwhelmed already and cross training them and having them move to point B to fulfill the task of somebody that's gone. Whether they're on FMLA, they quit, they've been termed. It doesn't matter. I'm confident and | hope that from what you said you've taken all these concerns into consideration. Manager Waggoner - | certainly have. In my own humble opinion, | think there's some departments that are overstaffed. There are some departments that are understaffed. Sheree Stringer Nye County Assessor - | have to agree with what Tom and Sheriff McGill said. It goes back to talking about cross training. We would all love to be able to be cross 12.For Possible Action — Discussion and deliberation to: Cont... trained in our job. In my situation, in my office to be an appraiser, you have to be licensed by the state. That does not come easily. | can't cross train somebody to be an appraiser without having a license. We're running into the situation now, the county manager just informed everyone that we are going to be building 3500 new homes. Who do you think is going to pick up that information and get it onto the tax rolls? | feel that this is not something that | would support. | think that 90 days is too long. 30 days would suffice. We should be able to realize some sort of savings within 30 days. But 90 days is too long to have a position sitting out there to try to be filled. Chief Lewis — Elona and ! did speak. We recognize that it was not going to impact fire or emergency responders. | think it's just an opportunity to clarify that in the document.

If this excludes police and fire, | appreciate that. | think that a realistic example needs to be brought up. When | retired from metro of course my pay was up there because | was the 3rd senior person in the department. But | saved up my vacation time and sick time for two years. The day | retired, | got a cash check for $110,000 which was my vacation and sick time. | realize that we need to look into the future and plan for those things because we know that all of our positions in this county are collective bargaining. ! would think many positions have that type of clause. That you get paid out some percentage of time you have stored up. This whole item is addressing to recoup that payout check when that person retires. i would think that the road department, HR, or finance, anyone in the county is going to have the same problem. Is that when one of my lieutenants retires, | need a Lieutenant. | realized that we're not included in this. You cannot just leave that position empty and not do the necessary tasks on a day-to-day basis with the people that you have because you have to pay them acting pay. You have to pay the person who is pulling up the slack for that person, overtime and things like that.

County Manager, I'm very supportive of this. Just as far as the assessor is concerned, I'm an appraiser. | can attest that it's very difficult to get that license. How would the process work under the assessor? Do you consider that an emergency? Is it waivable or how do you want to work with that? | do agree with her that that's a very hard position to fill because of that license being so difficult to get. Manager Waggoner - What nobody's sharing with you, Elona alluded to, if a person vacates, if they give a notice today, then we start advertising for it. The bargaining agreements require a minimum of 10 days, well at least the NCEA, of which 90% of the positions in the county fall under that bargaining unit outside of law enforcement or fire. 90 days isn't a ridiculous ask. It takes them at least 60 days to fill that position in most cases after going through the interview process. If they have a job, then they've got to give notice where they're working at. These 90 days people are making a big deal out of it and really isn't a big deal. You're looking at maybe an extra 2 weeks, 30 days at the most. As far as how any justification would be to consider a critical the director or department head or elected official whoever may come make the case for it. This is the easiest thing to do outside of looking at other more drastic measures, such as layoffs or 12.For Possible Action — Discussion and deliberation to: Cont... furloughs. This is something that we're trying to do early in the game to try to avoid having to take more drastic measures later.

Was the prior hiring freeze that happened in this county, was that a 90-day freeze or was that a permanent freeze? HR Director Goldner - At the time when we did it, it was 90 days.

Manager, with part of the process that you explained, of giving notice and then posting etcetera. Then it takes almost 90 days for that to happen. If there's a freeze, then these department heads won't even be abie to start the process until such freeze is perhaps lifted? Manager Waggoner - That is not the case. They can start the process; they just cannot fill the position for 90 days. That person may select their offer of employment would have to be you know for on that 90th day for them to fill it.

I'm wondering if we should build a realization matrix for our current employees. Then we know, you may have this in your toolbox, we know in that certain individual retires we're going to pay out this much. That position cannot be filled because budgetarily we've paid it out. Are we in that position to do something like that? HR Director Goldner - We could be if we don't want to do the 90 days.

| want to support the 90 days, but I'd like the commissioners to have more information after we do this. We're in this position now, it's a management decision. That's where | think we need to go with our future analyzation of our hiring practices. The numbers will be huge.

| appreciate the public comments on this item. However, the clarification is that this is taking place on the border of Nevada and California. This is a California decision. We're asking BLM, the State of Nevada state director John Raby, to support us in being the voice for not only the water source of basin 230 of Ash Meadows. 14. 13.For Possible Action — Discussion and deliberation to approve, Cont... We all went through that program with a different, Canadian company, Rovers metals that wanted to come in and drill close to Ash Meadows. This is a different situation. The situation at hand is for us to first and foremost be the voice for the Timbisha Shoshone tribe that lives on that border. About 500 members on that reservation will be impacted and absolutely affected by the water drawing of this basin. They're asking us as well for our help and support in this endeavor. Folks, we understand your feeling, the past practice. We have a great relationship with BLM. We're asking them to support us and support you in our comments to try to help us to preserve the water. Without this water, it would be a catastrophe especially for our neighbors, the Timbisha Shoshone Tribe.

Chair, | would like to see us proceed with collecting penalties and interest on the ones that we are allowed to by NRS. Treasurer Powers — | was asked to share additional measures that have been implemented that are not reflected on the staff report. our cell worksheets that we utilize for our data collection while maintaining the foundation for allocating collected tax sheets were revamped. New worksheets provide clear and concise data. Separate worksheet specifically to assess penalties was also created. The penalty worksheet is used to track, assess, and collected penalties including any communications related to the penalties related to each of the establishments. Forms were updated and made available online. Once updated, they were emailed to all establishments. All documents received by treasurers dept. are scanned and saved in the treasurer's storage drive made available for every deputy. Full disclosure and transparency is provided to the towns. Every document that crosses our desk is now shared with the towns. That includes forms, payments, and envelopes with direction to include myself in all communication with establishments if it isn’t being enforced. Email notifications are sent when penalties are assessed, and the towns are included in communications. Additional follow up with penalties is phone calls and letters, also tracked on penalties worksheet. Additional training is also in progress. The assignments and the responsibilities will be shared amongst deputies instead of one individual. Strict adherence to protocols, NRS, and ordinances that are in place and have been in place are being enforced.

This doesn’t make much sense, and | am struggling to understand what is going on here. Is this a payment, or costing taxpayers? Manager Waggoner — What this is, room taxes when they are not paid on time there are penalties. The penalties were not assessed. Question was, should we go back to these businesses that should have paid potential penalties and try to collect. Because there is a limitation on how far we can go back; two years. The DA office is double checking. There is a burden on both sides to prove when these payments were actually received or receipted. We have that information. Everybody keeps talking about a forensic audit. | don’t understand the point because we have the information we need. We have two thick binders for every single payment that came in. The penalty that was or should have been assessed. We only went within five days of the due date to figure it out.

This would authorize the county to go back and collect fees? Manager Waggoner — And put burden of proof on the business owners. There are some communities that don’t want the county to do this. Tonopah isn’t one of them. Tonopah does want the county to do this. Of the 80K there is a portion that goes to the state, the tourism, the town, and a portion that goes to the town. It's not like we are going to collect 80k and it goes into someone’s pocket. The other thing, we already spent 28K chasing this down. It is good that it identified some deficiencies within the treasurer's office that could have been prevented from getting that far out of hand. Now, with ordinance changes we're going to clean some of that up that were prevented by the last treasurer who didn’t want to move forward with them. As well as procedural changes. | am a little confused about the whole thing. We have letters and all these other things going on. All this does, and being recommended to pass, so that we may collect fees? Manger Waggoner - If there is direction from the board to pursue the collection of fees then that would be our next step. We have already changed policies and procedures to prevent that from happening again. All that is left at this point is do we go back to the businesses and try to collect these past due penalties.

So the request for audits, this is not material to any outside request or anything else? This is just action to make peace, is that generally what this is? To make it right. Is this what the effort is to be resolved? Manager Waggoner — Yes. This has been going on for months now, a lot of money and time has been spent on it. | don’t see any more answers we are going to get. We know where it originated from, and things put in place to prevent it from happening again.

I'd like to point out we did a focus audit. As the manager did say, a request for a forensic audit, that is beyond the scope of what would be done with something like this. | can’t imagine you will get anywhere from here. Except we had Treasurer Powers that implemented new procedures as she said. We have copies of that in our back up. | have brought this item forward so we can give direction to staff as to how to proceed with the results of the focus audit if you'd be interested in that motion.

We also need to know if there are state interest and a town interest in this. | don’t know how this works, government, private stuff. We probably have a duty to collect this. Manager Waggoner — No we don’t. We are the vehicle for the collection of it and then we distribute it out. We don't owe something we didn’t collect. It would be up to the state or whoever is owed this money to go try to collect from the business owner. We would try to collect it on everyone's behalf if we were to move forward.

You will evidently not be collecting any money from those who didn't pay. That is what this comes down to. Because the focused audit came up with 80K and we paid 28K to get it done. We need to recoup what was not paid during that time frame. And it can't be the full 80k because time is expiring. That's all we are doing. The implementations of the corrective action and rewrite of policy is already in place. The only question is do you want to collect the money that is due to this county that was not collected.

We did have a preconstruction meeting for the splash pad with the contractor at this point. They would like to see us move between 10-12 weeks. We would like to see them move a little bit quicker than that. Regardless, that splash pad will not be completed at the end of this summer season. There is funding set aside from donations that have been received in the amount of $5000 specifically for the shade. Great job 20. 19.Commissioner/Manager Comments (This item is limited Cont... moms out there that reaily supported the project. Mr. Martinez has indicated he would like to wait on establishing that shade structure until the splash pad has been completed. Then we have a better idea of where that needs to go. How large it needs to be and the specifics of that project.

Unfortunately | won't be able to be here for the 9/11 celebration. I've enjoyed it in the past very much. The recognition of what has happened to us in this country and how it bound us. That was the significance of that event. All Americans came together and unfortunately that's the only celebration we can get out of that. But we've come together in recognition. | won't be able to be there because I'll be in DC looking for the pelts payments. Hoping we can get those. The request for Mountain Falls letter went forward to Nevada Department of Transportation as we all know. We have to wait for those comments to come back to really know what they might determine. | don't | don't know, maybe they will find money in their fiscal coffers to take care of us. It's sad that we can't just get stuff always done faster for everybody.

Again on Mountain Falls, anything that touches Hwy. 160 you know who gets involved, NDOT, and that just slows everything down to a crawl. We have no way around them being involved, which is probably a good thing for us to have their help and input to take care of this. There was mention of a complaint or an ethics complaint filed on a colleague by a colleague. | just want to say | have never filed any ethics complaint on anybody including the guy | ran against, who | probably should have.
