said a couple weeks ago, there's a lot of good ideas, and lot of great ideas. The pamphiet today, seeing those things on there, one of them says that it would be legal to have permitted living. We could live, we could have our permission to live as humans. But the extra taxes on property, you feel some of the benefit from that. You guys are going to get paid forever for the rest of your lives. After you're done with your term you have your hero, San Marino 9 1/2 terms. That's a lot of money for every term that you served, not really serving us, but here we are voting for you again. Tina Bond-Kuglin - I’m here today regarding the Pahrump regional Planning Commission meeting on September 10th, 2025. At that meeting, there was a discussion at the very beginning about the number of animals people can have on their property regarding boarding facilities, rescues, and shelters. Your board stated that they have no control and no say over how many animals people can have. When a boarding facility was doing their presentation, she decided to tell the facility that fifteen horses was too much but then approved it. Last month, two other boarding facilities were doing their presentation. The first one only wanted 4 of her personal horses and 1 border. Again, the board talked her into 7. The second boarding facility of the night got approved for 20 horses. When | did my presentation in February, that same board member asked how many horses | wanted to board. | shut her down. | wasn't going to allow the board nor the building department to put any stipulations on how many horses | board or what | do on my boarding facility. Two years back, another boarding facility was approved for 15 horses by the board even though she only asked for 10. To have the board in one breath state that they have nothing to do with the number of animals people have, they sure do have a lot to say about it. I've sat here during anima! shelters and rescue presentations including one gentleman that already had a rescue for elderly dogs and was trying to open a second one on 40 acres. That same board wanted to restrict him to 30 dogs on 40 acres. Last month, the young lady was here getting a CUP for a shelter that was housed in a commercial building. Your board talked about the restrictions they wanted to put on her facility. If your board states in an open public forum that they have nothing to do with the number of animals at a boarding facility, a rescue in an animal shelter, then why do they waste so much time talking about it. Do they actually know what they're doing? Someone with a 30-year background in different fields of construction would be a better fit. Somebody that worked with all 5 building departments in the Las Vegas NV area would be much better suited for that position. Diane Southworth - There's trick or treat being done on October 30th at the Maryland Gallivan complex which is on 16250 N highway from 3-5. | have a list here of all the food pantry schedules that I'll be giving to you. I've got a resource for if you need a ride. We also need volunteers for the remote area medical coming back to town. They'll have dental care, vision care, medical care, and general support on October 4" and 5th at the front Valley High School. We have game night again. This is suicide prevention awareness month, be aware of that and all the problems that we could have there. We have a group that does a monthly luncheon for homeless outreach from 12:50. It's at the Methodist Church on the 3rd Wednesday every year, every month. Molly Valdez - There’s 36.8 billion acres on this earth and we own 1/4 acre of one of those acres. We can't use the property and it's frustrating that there's no solutions or looking at alternative solutions. | know that tiny houses have been discouraged because people don't like their look. Recently driving through Pahrump there's plenty of properties that are not upheld or maintained. When you go down to record the deed when you purchase the lot, the planning department could literally look up the jot number right then and there to let you know these details. Instead, they refer you to the utility companies and have you go through the motions of filling out the paperwork. It's going to cost you the individual hundreds of thousands of dollars for water or sewer. Even though you know there's other homes you can see the hookups are close. | know that alternative utilities have been shut down. If we're doing it responsibly, | don't see why that shouldn't be considered. Tom Waters - An update on the Pahrump Town Board committee. We're on track to get the ballot question to reestablish the Pahrump Town Board on the ballot so residents of Pahrump can vote yes or no in November 2026. We're collecting petition signatures, and we've made a lot of progress. We fully expect the declaration of success very soon. The 22nd next Monday, the Town Board committee will host a roundtable on KPVM TV. Please submit questions or concerns to be answered to the group’s Facebook page, Pahrump Town Board committee, or via e-mail at townmail@mail.com. The goal of the committee is to get the question to reestablish the Pahrump Town Board on the ballot. Please sign the petition. The Town Board committee members are not candidates, and many people still confuse that. Ron Mortinson — Mr. Waggoner here said that yes, the monies are in fact being set aside for dumping fees. | went ahead and submitted a public records request asking exactly how much of that money has been set aside. It’s my consideration that if monies are being taken as a tipping fee at the dump and set aside for this $10 million expansion, that there's a dollar amount attached to the money that's being set aside. I'd like to be able to keep track of how much has been set aside on a regular basis. Then | know what progress has been made in terms of saving up to $10 million. Tony Holm — I'd like to thank everyone for the 9/11 ceremonies. This was a very important thing for me. I've lost me of my colleagues at the Pentagon and one of them was a young lady that | was mentoring and she was a very wonderful person. They had just finished the renovations at the Navy command center and that entire wing or section. As it turns out just as | was walking out the door and passing by the TVs in my office, | saw what happened to the Trade Center and | knew instantly who did it and what was going on. That changed my life for perhaps 20 years, taking me to four different continents to get the people that were responsible for that. | know there are a lot of veterans and other people who've experienced what I've experienced close up. Those ceremonies that you have been conducting are awesome and I'm grateful for it. Everybody in Mountain Falls, | presume, or at least in my neighborhood received this. A lot of my neighbors were very upset because this was taped to the side of their homes. We've had a chronic problem lately in Mountain Falls where just two weeks ago our mailboxes were broken into and all the mail stolen. Which is not good because as you know Mountain Falls, but it is a primary source of property tax. We need to take care of that neighborhood and in this case, this was put on my property even though | have three do not trespass signs. It pretty much lets every burglar know that the people that leave these on their property are not home. Whoever did this didn't think it through, and they don't need to be punished. Just fix it. Ammie Nelson — Everyone is really shocked over the assassination of Charlie Kirk. It makes a person reflect on things that are happening with our youth in school. Charlie Kirk spoke about the indoctrination in our schools many times. Shortly before he was assassinated, | received an article from one of the publications here about indoctrination. There was a study in 1971 at Stanford that took male students and set them up in groups and one group worked prisoners and one group were guards. Within two weeks, they had to stop the study because the guards who were unsupervised became sadistic. The program couldn't continue. You can imagine that carrying an antifa flag or having a gay rights flag and no American flag insight, what that's teaching our children. We have to put a stop to that, and we have to let our children know about free freedom of speech. That's where we have to start in this community, with the adults. We need to start to praying and turn our lives to god. Thomas Asintansao - | see back in the 1800s, that our ancestors lived in the cabin that was 12 by 16. That's 192 square feet. Tiny homes average of 400 square feet. The benefits to property owners, unlocking the use of their land for living, not just taxing, increases equity and property value, makes property taxes feel fair by providing real use, reduces desperation sales and tax default auctions. Benefits to county government; expands the property tax base over time, reduces complaints and code violations from unpermitted living, shows leadership and responsiveness to landowners, does not require any public infrastructure investment. Environmental benefits; promotes substantial solutions like composting toilets and solar, prevents groundwater contamination from failed or legal septic’s, protection to desert habitat with low impact structures. Community benefits: opens a path to affordable housing using land already owned, supports veterans, senior, and low income landlords, encourages legal and safe home setting, reduces homelessness and squatting. Practical and legal benefits; acknowledges that traditional utilities will never reach many lots, avoid future lawsuits for regulatory takings or deception, aligns with Nevada's state board 150 and off grid housing trends, enables partnerships for grant funded pilot programs. Risk reduction; brings off grid users into safe permitted systems, improves emergency response by recognizing new dwellings, prevents legal disputes over unusable tax land. Michael David Garcia - We can try to get through and recognize a lot of the same problems are redundant when it comes to county, state, and federal. I'd like to point out it'd be a good thing for the Pahrump Town Board to recognize that we would have access to an e-mail. Let me tell you something, | don't need a collective place to see the mistrust in that first queue. That party is contaminated. I've seen everybody sit there and watch somebody's right be deprived. Not report it, not say anything, not do anything. It's really a dishonor to your oath and justice for all. | wish you would just omit that out of the pledge because until you can recognize it, it's kind of hard to defend civil rights violations. All of you have been continuously open meeting violations against me. In Mountain Falls, they may now be allowed to screw in blue light bulbs showing their support for law enforcement. | know that it's against their CC and R's, this came up the past few years. Perhaps now they may reconsider. I'd like to address for the record, Sam Merlino, our former county clerk of many years who served this county and the people well. She was elected by the people throughout the entire county for that position for the many years. It was a great showing at the Carvers Arena and north of Round Mountain. It definitely showed their colors in the recreation specifically having skeet shooting. They did a demonstration with the youth and then they did it with the adults. Their goal is to get that arena back on the map because people throughout the state are looking to come to Carvers Nye County Nevada to do their skeet shooting tournaments. It was very impressive and our grant team through Interim

You see people who come up and say that the government needs to stop telling people what to do with their land. Then other groups of peopie come up and say you need to tell people not to use their land for this purpose. If you watch from the outside and you're truly objective it doesn't make any sense but unfortunately that's the struggle with having to do the job up here. There's a little bit of truth to both things that we regulate and we also, we're not able to regulate in certain areas as far as what to do with land. With people who have these unimproved land, I've been in real estate for a long time. I'm not sure which is a more miserable existence by the way being in real estate or being in politics. This land is valued less because it doesn’t have improvement. | think maybe some of the resistance of some people who are concerned that they say well | have land that's only worth $10,000 and | want to be able to put a house here and | can't because there's no utilities. | don't think it would be fair to take taxpayer money and raise taxes on everyone here. | took a vow not to raise taxes at all. In order to now do something that was not there before, | think that's probably has been the resistance. When | said | want to preserve western values and traditional culture, that's what | meant. If there's a group of people who want to do something with land that's not improved in a way where there's utilities, the only statutory remedy, | believe, it's called a special Improvement District. They do this in Las Vegas. The downside, it's basically a special assessment and everyone will want to pool together and pay for these improvements, it’s extraordinarily expensive. | mean we're about to cancel something on the agenda because $5000 for these people who volunteer their time to go and search for people in the woods. So, we're concerned about the $5000. The idea that we have $10 million or $30 million to go ahead and put streets, sidewalks, and electricity, is probably not possible. | believe that government has something to do with it. I'm sure that our county manager knows it very well. If anybody in or out of my district wants to be pointed in the right direction on how to do something, I’m happy to help. I’m not promising an endorsement of it.

Pahrump Valley Public Transportation at the end of today will be shutting down. We hope we'll be back in service on Monday, but our insurance runs out at the end of today. It’s a $61,000 bill. It's $250,000 a year for insurance for our vehicles.

| approached the Nye County Water District Governing Board liaison and asked them to form a working group. The applications are available at the Nye County Water District Governing board, location at 2340 Calvada Blvd. 6. They're talking about having their first meeting October 14'". We do not have enough applications yet to form the working group. Regarding the zombie lots or utility challenge lots, as everyone knows, | am pro development and pro responsible growth. | would love nothing more than to provide more housing units for people who want them and need them. But | will never put any burden of raising taxes on anybody. It's not something I’m going to do. We have kind of a separate issue here where part of the problem | have with the homeless that we have living on the hill or in the park is; They just sort of dig a hole in the ground and use that as their toilet. Which is not good for the environment at all and should not be allowed anywhere. It's kind of another issue where if my next-door neighbor is interested in doing a composting toilet, as long as it is sanitary and acceptable, | have no issue with any of that. I’m not going to put the burden of raising anybody's taxes on anyone else. It is absolutely Great Basin’s issue that it costs what it costs to run the lines where they are. It's not that we're against it or at least I'm not, it's just I’m not going to put the burden of raising taxes on anyone. Yesterday, all five of us Commissioners actually got to go to Our Place Coffee Shop when Governor Lombardo was here. During his kickoff event, he spent quite a bit of time discussing affordable housing in Nevada. We have a real problem in the state where we don't have affordable housing. Kristi Siegmund - We had 106 adoptions last month out of our shelters. We also had 22 transfers, which meant 128 animals found forever homes. We still have 110 dogs and 66 cats in our shelters. To follow up with something positive, we were accepted to participate in the empty the shelters event which will be October 1st to October 15". We have 3 high volume spay and neuter days set up for our animals. While we have 10 cats and almost 50 dogs available now, | hope that by the time October 1st and this event rolls around we will see almost double that for the event. That's pretty exciting as well thank you to those who came to our vendor event and adoption event on August 30. We were able to adopt out every single cat that we had available that day. I’m also happy to report that the local vendors and I will continue to participate in these events the last Saturday of every month. I’m sure many have followed the news on the large animal case that was on Mariah Court. Amassive thank you to the community, to the Sheriff's Office, and to the sheriff's auxiliary unit. With all of their support in the organization from Southwestern Wilds, we were able to move 160 animals within 48 hours. To foster homes, to places that they can maintain, and be safe, be cared for while the duration of this ongoing case occurs.

The numbers that you gave Kristi on the adoptions, 40 dogs. That's very impressive and | think only two were returned but then re adopted which is amazing. That leaves 66 cats. It’s amazing two weeks into the new month, it's unlikely that they're going to come back. We have to do a different campaign to help clear the shelter. When we say clear the shelter it's not just to empty the shelter. We are working with our auditors on the Siemens bond. We're going to go through with the fine-tooth comb to get those remaining entries entered into Eden. Public Comment Maryan Hollis - The entrance to the site of 70 homes will be from the Mountain Falls Bivd., which appears to be a short distance from the intersection of the Parkway with a limited line of sight. That increased traffic will then dump out onto 160. Detainee letter does not answer to whether or not the access will be adequate in size. The staff report, public works will be working with the developer on the county roads traffic issue up to the intersection of 160 then what? It becomes NDOT and their funding is not ready to address that situation. How do you assume that without the development agreement and tentative map? Has any resident been asked? The quality and vision of what current owners expected when investing here has been undermined and disregarded. The county administrator of Anderson County in South Carolina recognized the need to review planning practices as the unincorporated area exploded with development. They imposed a 90-day moratorium on ail residential development. Isn't that us, unincorporated, exploding developments, your constituent’s opposition, or have you even asked us? These developments do not reflect the health, safety, and wellness of the community as outlined in the master plan. You can consider a freeze, a moratorium for the development until at least the water district presents their water study in July of 26. Please read the letters submitted by RPC from our Sheriffs Department, our Fire and Rescue, and our school departments. The developer acts without permission to install even more billboards, signage, and has just recently placed two very large double-sided billboards on the sidewalks at the handicap ramps. The signage is duplicated and does not have correct contact information. Richmond homes is not new to this industry, and this demonstrates their disregard for respecting our codes. Remember it's not in your backyard, it's in ours. They’re going to put it in this Pahrump home finding center. They're going to put up, over on 160, on the corner where we already have a traffic problem and put in a walkway. That's going to go through the street into Mountain Falls and cross over someplace over to the models. When they've got all these signs, a big balloon over our neighborhood, dirt and dust everywhere and we're going to promote this as a home center. Our streets and mess we've had, water running down the gutters, sand blowing everywhere, and it is just a start. They're not finished with that section of the development across the street. They're going to build another one and we're going to be living in hell for several months. Beth Borysewich - Realtors are not telling home buyers that there's going to be a fairgrounds out there in their backyard. | spoke with a person on the water district board, and they had said that they do not believe we have enough water. They say that we are probably going to run out around 2030. People keep saying the water is allocated. When Las Vegas went out and they built all these homes and now they're punishing the residents by saying conserve, reduce the size of your pools, don't water your lawn. We need to be better than that. I'm offended by this developer coming in and saying that he wants to make it a Pahrump home finder. Those signs are pretty huge, and they're filled with rocks, and they move around with the wind. Then they impede people getting on the sidewalks that might be disabled. We're not going to have water. Ammie Nelson - | know that our water table is low. We don't replenish enough water to make a difference. | imagine that the Commissioners, with everything that they have to do in this community, just see taxes. | can see where it might sway their opinion, but you might listen to the people who live out there and have been saying for a very long time, they don't want any more building. All the tax money comes in, but our water table goes down. Tony Holm ~ | tried to think of a way to maybe meet the expectations of all sides. The best thing that | could recommend is | believe constructive, given the level of opposition. Perhaps the board would entertain the notion of delaying the decisions specifically on this to see if there is a way to meet the expectations of the residents. | certainly don't want to see the developer fail. | know that there's an expectation that there is a certain number of homes they're going to build and that's fine as long as they comply with the county code. Particularly on the test issue, which is getting really crazy. Talk to the residents to try and build support for what's going on rather than just marching forward. Close Public Comment

That's actually why, net, this is better overall for the density out there. Because we're going to incorporate these properties into an existing development agreement with no new additional units, more land, and same number of units.

Is this on the opposite of 160 from Mountain Falls? Mark Fiorentino — No it’s on the same side. It's a misunderstanding. The walkway, they do not need to cross Mountain Falls Parkway. The walkway is between the home finding center and the model homes all on the same side of Mountain Falls Parkway.

We had the original development agreement, and these homes are within that same development agreement.

Yes. That development agreement has a number. The total number of homes they can build, and they're locked into that. Unless they come back and try to get it changed. Mark Fiorentino — To be clear, this is the first step to adding them into the development agreement. You will get a separate item in front of you, roughly in a month. We're working out the details to actually add it into the development. But to do that, you have to zone it specific plan first.

The opportunity was in the last public comment for any new projects to be provided. CDBG would require that direction come from you, awarding the application or the potential for eligibility. At this time, none of the public proposed a new infrastructure project for eligibility. We do have the four projects. Stephanie Urga - | wanted to reiterate, this is just to see if these projects are even eligible. We aren't even at the application stage yet and also just want to make it clear to the public, this is not money that is given to us. We are applying for it to the Nevada governor's office of economic development. Also, these notices do get posted in Beatty, Tonopah, Pahrump, and it's online.

If the well goes down, the fields don’t get watered. Phase 2 is drilling the well. Second well is going in right now. Stage 3 what we're talking about now, is tying the two wells together for future infrastructure.

Ron Tuylor Search & Rescue - The 2004 Chevy was going to be a swap out with the Sheriffs Department for a vehicle that is more practical for us. There would be a 1 to 1 swap on that, and it still would be in addition to the fleet of the county. The vehicles are, we use all the time, and the cost of the $5500 is an onboarding cost estimated by building and maintenance; tires, brakes, and an airline replacement on the command vehicle. Then it would just be a recurring cost of insurance and registration. Director Bolling - The sheriff is approved for $60,000 worth of expenditures to purchase vehicles for the Sheriffs Department. That money was to be used to purchase three vehicles for his detectives. There's only one vehicle that has been purchased using those funds. The other two vehicles, we're still trying to see if we can purchase them, if they're still available. There was a little bit of funding left over after the purchase or the price of purchasing the second two vehicles from out of that $60,000. | don't think it was enough to cover the expenditures we're talking about. If you were to approve it out of that 60,000, we could find the other two vehicles that are short.

Because of its size, there's a county organization that overseas checks against fraud. We're a small county and we don't have that same thing. | am talking about services that feed off of federal payments and then they get busted, and you see them on the Department of Justice website. There's a kind of another buffer against that in the way of another infrastructure in Clark and can identify red flags. We are small and the system is easier to cheat. Health Officer Dr. Griffith - | don't think that that necessarily relates to what we're dealing with here today, | am aware of what you're talking about as far as, it's more specifically for Medicaid in the larger cities of Nevada called an MCO. Where instead of Medicaid directly handling the expenses, they then sub it out to a Blue Cross Blue shield, a silver summit that in turn instead of letting it just be more of a PPO, it becomes an HMO under them. The only part that would matter today is we talked about access to insurance and telehealth on January 1, 2026. We will no longer have Nevada Medicaid, the blue card, like you're referencing. If they take their household and put it in their truck, that's two separate things. Then we can tell the difference between the two as long as they don’t put it in the trailer with the green waste. We don't want you to have the household with the green waste. We don’t want you to have a green waste with the household.

Las Vegas, you show them your bill, that you pay your taxes on your bill, and you're free to dump whatever you need. The 1st and the 3rd is a great time, that way you know people can plan on not just rushing for the first. They can also plan for the third. It's a good deal but | would also say on your next agenda go a little bit further. It's very clear that the additional fees that came about was a mistake. I’m witnessing large amounts of trash now and you might even want to consider for next year's budget that we need people to go out there and clean it. My acre, when the weeds grew really fast, |] would pay somebody to take my trash. If they had to take some of their stuff or if they picked up my neighbors to help them out, you're talking about multiple trips and people can't afford it. I'm not going to pay. | can see why people are dumping their stuff other places. As far as waste, computer parts are low level waste and cannot be anywhere in Clark County. They have to be put on the curb, and they have to be picked up specially. They cannot be put into the landfill. They are low level waste just like a cell phone with a battery. Matt Sadler — This measure today is the bare bones minimum of what needs to be done by this board, to rectify that abomination of a vote that occurred about the tipping fees in the landfill, and the money that we residents have to pay now. How about 30 days out of the month we do this and then we also make it lenient on the regular folks, to have reasonable dump usage again. Even the couple of you that actually tried to stop it, we expect you to fight harder for us. Please articulate a good argument against this and sway that extra vote to come the right way for the people. It would have been the right thing to do. Herman Lewis - I’ve been intending on filing a formal complaint. We've been doing 3 or 4 dump runs with a 4 by 8, three foot side trailer, 3-4 days a week. Every day is a different amount for the exact same green waste of mostly pine needles and trimmed branches. The thing that’s the most upsetting, the people that are giving the invoice are rude. We're going to start videoing them so we can know who exactly they are. I've got all the receipts. One day it’s $4.00, the next day it’s $24.00 for the exact same load. The people are absolutely disrespectful. It’s different people all the time and they're basically saying if you don't like it, don’t come to the dump. You have to get a handle on both the behavior of these workers and get something more consistent. My worker picked up a couple pieces of cellophane wrapper, the guy wanted to completely rewrite the dump run because there were two pieces of trash. It can’t be $20 one day and $4.00 the next. The tipping fees, the scales, etcetera, there was a presentation that was given and there was a lot of information that was not clear. This is not just the landfill in Pahrump. It’s Tonopah, Round Mountain and getting a hold on this is a first step. | appreciate public works, Tom Bolling, and Bo Gott of presenting this and getting this in front of everybody as a first step. It's not over. | am having meetings with everybody involved because it will be fixed, and it will be a win situation. | can assure the people that are listening, people in chambers, if you know of anybody that's dumping in the desert or on the side of the road in retaliation to, that is not the answer. The answer is to pick up the phone and to speak to every one of us to say, these are the concerns. We regroup as we are now and we're fixing if as a first step this. I'll leave it to you as far as making any type of adjustments. You have more of a magnitude coming to the landfills and it's all relative in Pahrump versus the other two. The one day a month, it'll be backed up because everybody will wait till the 1st of the month.

| would like to mention that contracting with Nye County is not the quickest and simplest process. We have had boots on the ground on the splash pad project for over 2 years. Nye County has executed our half of the contract, but it takes 2 to tango. We are still looking at the timeline and have not received a fully executed contract. We have completed a site assessment, or an on-site preconstruction meeting. The developers have actually provided a plan that is under review by Manager Martinez. Which we have not approved yet. We are moving in the right direction and I’m just very thankful that we do have the staff that's in place. Even our contract administrator, Honey Strozzi, that's been coordinating, ensuring that Nye County is entering into a contract that's legally bound. We're getting the required certifications, insurances, and bonds that are normally required with the contract to ensure that this is done correctly.

It's kind of like they move in and then want the gate shut behind them. It's just not a real reasonable way to operate. Growth is inevitable.

Compliance shall be verified through: © Owner seif-certification each year, including photographs and a brief maintenance log confirming that water, power, and wastewater systems are operational; and o County inspection only if required by a credible complaint, visible evidence of system failure, or as part of the renewal of any required operating permit. © The County shall not require routine in-person inspections when self-certification ts completed, unless otherwise mandated by state law. F. Construction Standards 1. Tiny Homes — Built to IRC Appendix Q or equivalent third-party certified standards; permanently affixed to foundation; wheels and axles removed, o Off-grid renewable energy systems (solar, wind, battery storage) Permanent Foundation — A continuous perimeter foundation or engineered slab anchored per IRC standards, with wheels/axles removed if originally built as a movable unit. Primary Dwelling — The sole residential structure on a lot, not dependent on any other dwelling for occupancy rights. Possible Exception - Homes up to five hundred (500) square feet may be considered under this section if they meet all other requirements and receive approval through the variance process. C. Applicability 1, This section applies to all legally platted lots 8,000 sq. ft. or larger located within areas currently zoned VR (Village Residential) that are proposed for reclassification to “Super Conservation Lot” (SCL) designation, and may be extended to other zoning districts permitting single-family residential use {f specifically adopted by ordinance in the future. Lots under 8,000 sq. ft. may be considered if setbacks, utility placement, and all health/safety requirements can be met. The provisions of this section shall supersede any requirement for connection to public utilities where such utilities are unavailable or cannot be economically extended due to GBWC tariff boundaries or similar service restrictions. Lot Survey: A boundary survey by a Nevada-licensed land surveyor shall be completed and filed with the County prior to placement of the dwelling to confirm property lines and setbacks. D. Permitted Use 1. A tiny home or container home meeting the standards herein shall be permitted as the primary dwelling on qualifying lots. No secondary “main house” shall be required for occupancy. Placement and permitting shall be allowed whether or not the lot is served by public utilities, provided an Alternative Utility Plan is approved under subsection E. E. Permit Requirements for Alternative Utilities 1, Alternative Utility Plan — Prior to issuance of a residential building permit, the property owner shall submit an Alternative Utility Pian Including: o Description and engineering/design details of each system © For composting or incinerator toliet systems, daily potable water capacity may be reduced, provided minimum safe drinking water supply is maintained and approved by the Bullding Official. tne GBRS Proposed Ordinance Language (For Nye County Code — New Section under Title 17 Zoning} Section X: Tiny Homes and Container Homes as Primary Dwellings with Alternative Utility Systems A. Purpose & intent The purpose of this section is to provide a legal pathway for property owners to reside on their own lots, including those located in areas where public infrastructure (water, sewer, electric) does not exist and is unlikely to be extended due to utility service area restrictions or economic infeasibility. This section authorizes the placement of tiny homes and container homes as primary dwellings, supported by approved alternative utility systems, while ensuring compliance with health, safety, and environmental standards. oO intent Note: VR (Village Residential) zoning districts have been selected as the initial focus of this section due to the high number of small lots within GBWC tariff areas where public water, sewer, and electric service are unavailable and unlikely to be extended. These conditions have rendered thousands of parcels effectively unusable under current zoning and utility requirements. Reclassifying such lots to the Super Conservation Lot (SCL) designation will provide a legal pathway for responsible, self-sustaining residential use with approved alternative utility systems. While this ordinance initially applies to VR- zoned lots, it may be extended to other zoning districts permitting single-family residential use through future amendments if conditions warrant similar relief designation, and may be extended to other zoning districts permitting single-family residential use if specifically adopted by ordinance in the future. B. Definitions 1. Tiny Home — A detached single-family dwelting 400 square feet or less in floor area measured at the main floor level only, excluding loft space, built in compliance with IRC Appendix Q for tiny houses and placed on a permanent foundation. Loft areas designed for sleeping or storage shall not be included in the 400 sq. ft. calculation, in accordance with IRC Appendix Q, Any dwelling exceeding 400 sq. ft. shall not be considered a Tiny Home under this section and may only be approved through the varlance process or applicable zoning standards, Container Home — A dwelling built primarily from steel intermodal containers, meeting all applicable IRC or IEBC requirements for single-family residences. They are required to obtain a state business license prior to applying for their CUP or town of Pahrump License. When | purchased my ranch in 2018 | had a dream to open a boarding facility that worked with special needs individuals. When! posted on social media that | was thinking of boarding, the horse women came out of the woodwork to tell me everything | must do. So, when I started researching all the boarding facilities here not one of the 151 found was properly licensed. Some had state business licenses that were expired or revoked but none had their CUP or Town of Pahrump license. Now | know these places were told by a former board member | threw them under the bus with the county & the building department but that wasn’t my intention in the beginning. It was my intention to show the county how many places were willing to operate illegally because their process is so long as proven with this applicant. It has been 6 months since she received her state business license. | have been fighting since August 2024 to change the process for getting a conditional use permit & a town of Pahrump business license. It took this county almost 6 months to grant me a CUP & then my Town of Pahrump business license. It took the state of Nevada 1 day to give me my business license, my LLC, and my EIN number. Nye county is the largest county in Nevada, 2" largest in the United States but the Town of Pahrump is the only part of Nye County that requires a boarding facility license & CUP. This process for most businesses needs to be streamlined & there is no reason for a boarding facility license to take 6 months. The Town of Pahrump needs more legally licensed boarding facilities. Beyond the fact that the town is growing, there are many different types of boarding facilities. Mine is self-care, overnights, week to week, month to month & day boarding. Others you must be part of the dressage club style of riding in-order to board. Some are full boarding facilities & accept all styles of riding. We even have some that are animal rescues but board to supplement their income for the rescue. Some are brokers, buying & selling horses, (which should be required to have a broker’s license) offering boarding to their clients, others are horse trainers Qwhich should be licensed) offering boarding to their clients. There is a growing need for horse boarding facilities here in Pahrump. But we must make sure the ones that are already operating & advertising are legally licensed w/state, county, & the Town. Again, my statement tonight was in support & in favor of this facilities to be Exhibit 9/16/2025 Good morning I am here today regarding the Pahrump Regional Planning Commission meeting on Sept 10, 2025. At that meeting there was a discussion in the very beginning about the number of animals people can have on their property regarding boarding facilities, rescues, & shelters. Your board stated, “they have no control & no say over how many animals people can have.” Yet when a boarding facility was doing their presentation, the lady that must always have the last word in decided she was going to tell this facility that 15 horses was way too much but then approved it. Last month 2 other boarding facility were doing their presentation, the 1* one only wanted her 4 personal horses & 1 boarder yet again that board talked her into 7 horses. The 2™ boarding facility of the night got approved for 20 horses. When I did my presentation in Feb that same board member asked about how many horses I wanted to board & I shut her down. I wasn’t going to allow that board, nor the building department to put any stipulations on how many I board or what I do at my boarding facility. 2 years back another boarding facility was approved for 15 horses by that board even though she only asked for 10. To have that board in one breath state, they have nothing to do with the number of animals people can have, they sure do have a lot to say about it. On another note, if anyone allows that board or the building department to set those limits on their business I guess they deserve it. | have sat here during animal shelters & rescues presentations, including one gentleman that already has a rescue for elderly dogs & was trying open a second one on 40 acres & that same board wanted to restrict him to 30 dogs, 30 dogs on 40 acres. Again, last month a young lady was here getting a CUP for a shelter that was housed in a commercial building ,yet again your board talked about the restriction they wanted to put on her facility. If your board states in an open public forum that they have nothing to do with the numbers of animals at boarding facilities, rescue, or animal shelters then why do they waste so much time talking about it? Do they actually know what they are doing. Maybe it’s time we change those that sit on that board. Maybe someone with a 30-year background in different fields of construction would be a better fit.
