has been going around finding homeless camps where fires have been taking place. Why not put the drone to use in scouting across the desert areas to see what is going on? The fires are a concern because a lot of times we get a lot of wind. Carolene Logue The situation of people needing to live out in the desert without a street address and without shelter, that is a systemic problem that is not being addressed. We have a system that doesn’t allow people to even find a remediation for their situation when they’re trying to survive. The system doesn’t give anybody an opportunity to find a job. If they don’t have a street address, the system doesn’t allow people to even find something that would give them an identity. The system is what is causing people not to be able to find a residence or place that they can receive mail to show they are a resident of Nye County. They can’t really do anything except try to survive, if they don’t have help within the system. The system is making them fodder for people to denigrate individuals that have become subjects of a system that doesn’t care about what happens to them. We need to be more humane, diligent how we care about the people. Brett Perchetti There are properties in Tonopah that have abandoned houses on them. They have people that own those properties that are cleaning them up or in the process of cleaning them up. Because of your new policy on the dump, it’s harder for us to now dispose ofthat cleaned up material. It causes an issue for people trying to improve some ofthese damaged properties in Tonopah. You’ve decided to cost accounting more money by charging it to the dump and hiring new employees. I don’t see how the increase in what the cost of employees is going to cost you is going to be supplemented by what you get from charging atthe dump. All these properties in Tonopah that are in the process of being cleaned up, it’s hard for me to figure out why there’s a public nuisance filed against them.

I came up with an ideal program to end homelessness, poverty, and people that don’t have an address. Bring them to me, let me have that spot up there by the helicopter landing pad. I’ll straighten them out, get them back into life again, give them a reason, a function, a tool. You’re not respected and you promise everything. Everybody says you’re here to represent us but once you get elected, that’s different. Each of you, all the problems that you made, all your money buddies, all your dirty dealings under the table. Nye County is one of the most corrupt counties in the United States. Rich Bushart There will be a Charlie Kirk Memorial, October 14th at 5:30 PM. Held outside our chamber’s doors and the Calvada Eye. Charlie Kirk was an amazing American and is deserving to be remembered. Michael David Garcia — I want to remind everybody what it looks like without a First Amendment. We have these policies and regulations that control it all. I’ve been talking to everyone about USC violations for the last five years and the county clerk said that I spoke about USC. I’ve never mentioned any kind of USC and for that to be tagged to what you did to my FirstAmendment, that was an emolument violation. Mr. Ian, you seconded the motion to ban my First Amendment. How do I refuse to give up the phone when you cut it off before you object then I don’t have a chance to respond. Let’s talk about jurisdiction, an originaljurisdiction, and due process. What about open meeting violations, you’re impairing my right to contract. You’re paying these public officials, these deputies, DAs, and the judges to violate our rights. The purpose of government has one job, to protect individual rights. Own up when you voted to ban my First Amendment, unconstitutionally, with that DA. Odds are, you’re going to get probation. That was last administration. Maybe we have some judges that understand the masters of an alternative 95% dispute resolution. Laurie McLaughlan I heard thatthe main meeting was here in Tonopah. What a beautiful drive. I wanted to come and thank Valley Electric for being gracious with their donation. I’m a newer resident of Pahrump and Nye County. I also wanted to thank the board for giving me the opportunity to be a volunteer at the Pahrump OHV park. Renee Jones I’d like to offer services today for counselling and addiction. We’re right here in the Calvada Eye. We’re a methadone and abuse treatment clinic. I would like to go working in tandem with Commissioner Bayne. He’s always posting about the homeless and all sorts of things for addiction. I don’t believe we should be posting some of these people’s pictures as this is some of the worst times of their lives. Let’s work to fix these things, we have a lot of solutions for this. We’re an umbrella clinic that helps them get jobs, addiction therapy, and also helps them get their children’s rights back. Ron Mortinson Thank you for responding to my public records concerning the money collected at the dump for tipping fees. It’s been $7,077 of what I’ve seen so far. I intend to keep track of that to find out how much you actually collected towards the 10 million you’re trying to gather. You guys should be trying to be more business friendly. One more company decided they don’t want to do business here. Kelli Sater You approved my festival license for the Pahrump Chili Cook off. It will be March 20th through the 22nd This year, we’re featuring some new things and adding a dog fashion show. It’s going to be Disney themed for heroes and villains. We have the Hot Ones challenge coming back and this time they have come out with an even hotter sauce. We’re doing our car motorcycle show since the car show had a huge turnout. We had almost I 00 cars show up, making it biggerthan I expected. I’m open to any assistance with that and we are benefiting from 3 different organizations. We’re doing bikers against bullying, the Pahrump Theater Company and the PDOP and we’ll be donating to all three organizations for their help. Tony Holm —I want to give you the opportunity to tell us about what’s going on with Samsung and their desire to bring a solar generating station. My understanding is you met with Samsung about four months ago. The most disturbing part of that meeting is when one of the commissioners looked at the Samsung executive, the lobbyist, and another commissioner; if they want to do business here, they need to open their checkbooks. Samsung was a bit taken aback by that. The entire county, particularly the citizens of Pahrump, have expressed an unwillingness to have any solar generating fields in our desert. I’m not trying to cast aspersions on anybody but there’s been a lot of talk about commissioners doing drugs and things like that. This really is not aimed at one specific person, but it could benefit my question and the answer to that question could benefit that commissioner or commissioners. There might be some drug use going on here. I would like every commissioner to submit to a drug test. Tom Santanastasio — There are 50,000 residential lots, commercial is 3499 and something called other. Is this the paper zombie lots we’re talking about? Why did I pay $6000 for a lot? Now we see that there’s 20 lots coming up for auction by bid for assets. The taxes on one parcel go back to 2000. Another one is 2001 three of them are 2002. , Why are we waiting so long to collect the taxes? Did the receiver of taxes know of this and how many more lots are in rears. I plan to write to the Governor and ask them to have a separate order made ofthe records over here, so we can find out why this is happening. And everyone that’s responsible should be terminated. Anything that’s in arrears of five years or more should be removed from the tax rolls and held in zombie land; until the town can provide roads, electricity, water, sewer and the other amenities that were paying for and not getting the use of. I’d like a transcript of this, of my comments sent to the Governor. I know that at one auction, I did purchase a lot and then at the following auction, that same lot that I purchased was put back on the rolls. I did note that some lots that were not sold at the previous auction were added to the next auction. This tells me that people are starting to realize what’s going on with these zombie lots. The vacant lots that I have, the taxes are unreal. 5IPage 7th October 2025, Page 6 Patricia Robb With everything you’re dealing with, the homelessness, the landfill, those are tough issues. The easiest of all of these issues is what used to be called the zombie lot issue. For those that don’t know what a zombie lot is, they are known as utility challenged lots. They are zoned VR which is very restrictive and it’s a smaller lot that does not allow well and septic. There are thousands of people that cannot use their lots. Many ofthem still hold on to that hope and promise they’ll use their own land. Continually, they are denied that right. This is unlawful, it’s unconstitutional, and it’s also a violation of the 5th amendment. The easiest of all your problems is to simply change the zoning. I know you want to blame it on infrastructure. It is not an infrastructure problem; it is a zoning problem. I am glad that the water district has formed a committee to start next week. The concern of the aquifer, if they’re looking at a community well which is going to deplete the aquifer more; this could cause even more backfire with citizens here. These utility challenged lots, by changing the zoning to allow alternative utilities does not impact anyone else. It does not cost anyone. Their taxes will raise, not everyone else’s taxes. Why don’t you simply change the zoning? You have that power. There is no state law denying you that right. Frank Krahmer —I’d like to point out that I have been a customer of Great Basin since 2008. I feel the company has done a good job until 2023. In 2023, they sent a letter to everybody stating that they were going to temporarily be sending bills two weeks apart. Then they assured us that no one would be over-billed. When I started receiving the bills, the first in May and it included the monthly fees. Then the second bill, in May also, includes monthly fees. I felt that it was a mistake of the company. The first call I made, the woman argued and told me a run around story about looking at meter reading dates. Each additional call, I found that they were avoiding the situation and not addressing it. I started looking for other possibilities and everybody told me to go to the Public Utility Commission. I talked to them numerous times and they assured me that they would look into it. It came up at the end of 2023; they told me that I should write a written complaint. I wrote the written complaint detailing the two monthly bills in the month of May. Then, they gave the utility company about a year to respond to my complaint. The utility company created a calendar; I have right here. They took the second bill in the month of May, and they moved it to June. They moved June over to July, July to August and when they got to the end, they created a 13th month. They admitted charging 13 monthly fees that year but blatantly denied charging two in the month of May. The Utility Commission refuses to do anything. At the time, I thought this was an error. It was premeditated. They knew exactly what they were doing. They created the problem and then they charged the people for the problem.

For the record, I received a $718 water bill. That is usually $250 and haven’t gotten to the bottom of that one yet.

That’s too bad. Too many of those. Fire Chief Lewis- Nye County Emergency Management, we had another mountain rescue over the weekend, on Ophir Canyon. It is in the Round Mountain area, where a hunter suffered a fractured leg, had to be rescued by helicopter. Under the direction of Fire Chief Jerry Yeager, the crews did a great job. Emergency Management worked with the State in getting the allocated resources flowing to that area and all worked out well. That hunter was subsequently flown to trauma.

I had a nice conversation with one of our deputies and then I turned around and went through Amargosa. I made it here with 10 minutes to spare. We have a team out there riding the trails right now. Janie Reeves has taken the initiative to take a group from the Nevada Outdoor Recreation Board to create our new trails maps. This is the beginnings of a draft map. It’ll tell you how to participate on the trails within Nevada safely and talk about Carpenter Canyon Level Summit, Elk meadows, and Wheeler Pass. On top of that, they will have a trails map that’Il be handy dandy. It’s exciting because we have people come to Pahrump, Tonopah, Beatty, looking for outdoor recreation with their side by sides, and jeeps. We’re going to actually have a map to go along with that. Congratulations Janie Reeve. DA Kunzi — Sometimes we take for granted where we live. We had to go through Amargosa today. I had the most unbelievable sight driving past Ash Meadows. It was such a beautiful drive, and it always drives me crazy when people talk about how ugly it is out here. We have such beautiful valleys, the area is gorgeous, and we don’t do enough to mark what a great place we live. Manager Waggoner -To address a couple of things; There’s information sent to commissioners and posted online by a constituent claiming that I don’t answer questions when questions are brought up. I actually do but one of them was brought up in public comment in regard to Samsung. First of all, anybody can come talk to the county about anything. lfthey’re proposing a business or a development, it doesn’t mean it’s approved. Doesn’t mean anything other than they’re trying to find out what the process is to begin that journey if they wish to move forward. There has been no applications made. There has not been any approvals given at this point. Obviously, if it was to proceed to that point, it would be brought to a meeting and put on an agenda along with the development agreement. It would be full disclosure.

I am looking forward to seeing the July, August comparable. Treasurer Powers Next meeting, we will have June, July, and August reports. As of the close ofAugust 2025, and everything begins to align. It makes more sense when we have those 3 reports together and we’re able to follow those numbers much closer.

How does that work, Samantha Tackett? Compensation to the Sheriffs Department is already in place for this particular event, correct? Or that needs negotiated with wrecking ball entertainment? Sam Tackett It will be listed as a condition of approval by this. Prior to the event, the event coordinator will work with the sheriffs department to secure coverage and pay for that coverage.

Motion to approve the outdoor festival license to Wrecking Ball Entertainment. For the event to be held February 1 3th through the I 5th 2026 at Petrack Park with a condition of that approval that they work with the Sheriffs Department on the fees necessary to provide for additional security.

What I’d like to do, we can work with IT, is that when the e-mail comes in, there is an automatic automated generated response acknowledging their concern. They know that we’ve received it. I don’t expect a phone call to 87 people. You’ll never get off the phone, and you won’t be able to get out in the field. But something that acknowledges their concern has been received, and it’s going to be placed on a prioritization list. Is that something we can work to get? Beau Gott It is already in the process of our new software program called Brightly Software. We’re in the process of implementing it right now. It already has that feature. When you submit your request, you will get a return e-mail saying that your request is in there. Upon completion of your request, you will also get an e-mail stating that your request has been fulfilled. We should be on board completely within the next couple of months.

It’s currently in grant application. We’re trying to hold off but we have to do something before winter.

I need to make a disclosure. I am a licensed septic tank installer with the state of Nevada. I have no pecuniary interest in this and if you’d allow, I’d like to speak to the item when ready, Sir. Sam Tackett My office handles the Town of Pahrump business licensing and the new short term rental registrations. The bill went into effect in August. We currently are in our 90-day process to bring everybody into compliance. We are having some growing pains. Both for them and us. We’re trying to work things out. One of the major topics that we are running into is we are asking for a letter to identify specs that aren’t a requirement or don’t exist in the State of Nevada. Also obtaining the services of a licensed or certified engineer to provide a stamp that is extremely a hardship for our applicants. It’s very expensive, ranging from several $100 or more. The requirement doesn’t exist in Nevada. Septic certifications are done by the number of rooms in a home for residential, not by the number of people. We’re asking for something or what was written into the code doesn’t really exist. We want that variance to make this easier for our registrants, for staff, for Town of Pahrump, code enforcement, and Nye County Planning. It is one of many variances and or amendments that we’re going to be requesting in the future. This is one of the first steps. Manager Waggoner The concern is the septic and functioning condition, and that it’s not in need of service. That’s why we feel that either of these other two options would be completely viable.

I asked that we all meet. We got together, we met with staff, manager, and we reevaluated this particular requirement. We weren’t really getting what we needed. Which is what Manager Waggoner is stating, not something that’s normally a 14Page 7th October 2025, Page 115 11. It seemed much more functional that for this need, that a septic tank gets dug up, looked at, see if it’s functioning properly, and make a statement to that. That didn’t take an engineer, that actually takes a septic tank pumper, which we have several in town. The engineering fee is way more. You can get your tank pumped at the same time and do it still for less than the engineering. That seemed a viable alternative. All we’re trying to do is the health and safety portion of this. We want to make sure that when people go into a home, they’re going to stay. They have the ability for the septic tank to be able to support them for health and safety reasons.

Good Point. Maybe staff can look into that. Manager Waggoner If it was legal and actually applied for a permit, it would be looked into. That’s not the case with what she said.

What if we know they’re not legal though, are they being addressed? Manager Waggoner That’s why there’s a cease and desist hanging on the wall. Suzy Hertz I have to admit; I didn’t do my homework and read the backup for it. The way that it’s written here, it sounds to me as ifwhat you’re saying is that everybody in this town has to now supply of viability of their septic system? Or is it for upcoming properties or transfer of properties through sales or whatever. It’s a little confusing, at least from my standpoint. I would be terribly concerned if it was something that we have to do as existing residents. Particularly if you looked at this, that there would be some attention paid to the age of a property and there are a lot of new homes that have been built in this community. And that turnover before septic’s are in need of being serviced.

I will address that after public comment is over. Liz Provenza-Neth I received notification in August about the short-term rentals. These B&B’s serve a purpose for us. There’s been many times where I’ve had people stay at a 15Page October 7th, 2025, Page 16 11. For Possible Action Discussion and deliberation to Cont... B&B. My parents’ home, what’s next door to me and after my parents passed, my sister and I wanted to keep the family home. This was a way to do that and made it affordable with the mortgage and all of the expenses on the home. I’ve had people come and stay that have had people go to Vegas on these big events; where we have the races, the racetrack, fares, and everything that they’ve had to go to Vegas and come early in the morning. We only have so many houses. We do serve a purpose. We also hire people locally and these people that we bring in actually serve the community. I look forward to working with Sam on this. This ordinance is extremely restrictive. There’s a lot of things, for instance, the septic, we actually use less time in homes than it would be if it was managed. I’ve been a property manager here since 1989 and that’s the otherthing too is, there was no restrictions in the NRS for me to be able to manage homes and to have them. There is work to be done on the licensing, what we need to do for each property. I can manage 365 homes with no restrictions on the septic or how many people I put in them and have one license to do that. I look forward to working on some ofthe ordinances. Dwight Lilly I looked in the backup; there was a need to protect the health and safety of people here in Nye County. I wonder how many people really understand how a septic system actually works. They’re an evaporative system and we live in the desert. Has there ever been a case of somebody complaining that there was a problem with sewage water running out of a septic system, because there was more than the number of people that had been addressed from when the original building permit was issued, and the original subject was approved. I doubt there ever has been an issue with a septic system failing in Pahrump. Because this is an evaporative system, it’s not a system that a lot of people think that water runs out because there are too many people using the septic system. Why is this even being brought up? We have people with numerous RV’s parked on their property with one septic system that was originally licensed. This is a silly issue right here that seems to be putting a restriction on people that’s unnecessary. lfsomebody can come forward with the fact that somebody has been renting out a room to somebody temporarily and therefore the septic system failed, I would like to know about it. This is the stupidest item that I’ve ever seen brought up her; restricting people’s private property rights to rent out rooms. I hope you reject this outright. Mike Maxwell I submitted my paperwork for the old ordinance. I too faced the issue with trying to find out exactly what I needed to do for the septic approval. I did engage a professional engineer in town. I submitted to them a copy of my approved septic system plan. What I received back for my $550 is a very simplistic formula that gave me what you guys wanted in the first place. I agree with the previous person about the fact that the septic systems around here seldom fail in the first place. I’d like to offer an alternative solution to this; this formula is something that’s simply based on the capacity of the tank itself. I needed to pay $550 to find out what this formula was. It’s a no brainer to do this. I’d like to propose that as an additional solution. If we now have to change that to an inspection for several people; when I had my septic system pumped when I bought my property, I had a riser put in, and total cost on that was over $900. Which is more than what I paid for this certification. In several people’s cases, while it seems like it would be simple to have a septic system inspection, they actually have to open the tank up to do 16Page October 7th 2025, Page 117 11 For Possible Action Discussion and deliberation to Cont... . — that. Most people don’t have a riser on and then have to dig it up. Who knows how far deep it is. Linda Clark All these zombie homes that we have around here, that want to get operative, how are they going to work this out? Each of them are going to have their own little septic tank. Can they share with a neighbor? I imagine you’re going to try to help some of these people but then they’re going to have all these extra costs that are going to be involved. If a person lives here, and another here wanting to share a septic system, Can they do that? Are you going to tax them individually? We have these people that want all these little, tiny homes in our community, how’s that going to work? Is it going to be like a Mobile Home Park? You’re going to have one septic tank and everybody’s going to share? Mark Vinci Commissioner Boskovich, I spoke with you on the phone back in August. I’d like to expand this; septic is one issue; the whole ordinance has a number of issues with overburdensome and constitutionality. I’m hoping it was out of laziness of adopting an ordinance from South of us. My proposal to you is a solution. We have many of our hosts, many of these short-term rentals have already met. We have a group of people that are willing to work with the town and develop an ordinance that does what the town needs. That is business friendly and for the people that will be occupying and visiting our town. We’re willing to meet rather rapidly so this can be put in place. I ask that the Commissioners put a hold on the passing or making it official until we can work out the nuances of the order. For example, a summary of five pages I put in with Al, the legal problems with the ordinance. If you went through section by section, which I did. I can email that to you. It does come across with an overbearing number of issues. Leadership can never please everyone. The fact that you’re open to working with the community and the community needs to come together. If you are willing to work with the committee of host, we can make it beneficial that this can become a gold standard across the country. It’s not community oriented. Not only is it unfair to be treated like that for running the small business. We don’t make a lot of money doing this. I would request that we be able to meet with the town or a town manager. Then we can come together and work through the ordinance to rewrite it with more financial sense and be beneficial for everybody.

The ordinance has passed. But it can definitely be worked or reworked as needed. Tim Bohannon The key is, where do we want to incentivize as a county? Do we want to incentive more bed and breakfast, more rentals, or do we not. Then from a burdensome documentation tax perspective, being through that and make that decision accordingly. Beth Borysewich This is what happens when we get an ordinance from another town or city. You think that it’s going to fit everything here, ending up as more work for staff, police, and Commissioners to adjust it. This should have been done a long time ago. We should not adopt or even look at ordinances from other towns or cities. I fully support what the Colonel is saying. I want to frame this, so we don’t go off the rails. This is an item that allows us to; have a variance from this one law that we passed for the provision and that requires a septic system to have some kind of an engineering certificate presented. Is that correct? Manager Waggoner That’s correct.

That’s all we’re doing here? My concern is that people think this is a vote for something else or we can destroy the whole law and start over. We’re not allowed to do that to this particular provision. Academically here, all we can do is have a variance or not. This variance would be specifically for someone going through this process now. What is it they have to get instead of this engineering certificate? Manager Waggoner It’s called a septic installer or a septic service company. You have them come out and then inspect the septic to make sure that it’s not full and that it’s not failing. Yes, septic’s do fail. It’s not as uncommon as people think. If they’re not maintained, they fail. That’s why most escrow companies require a septic inspection, like we are. And have the septic service to make sure it’s in working order before the sale.

Peterson — On the Hospital Vehicle Track Advisory Committee for the Commission. What I see here is a lot of kids and they don’t have much to do. When I was growing up, the only thing that really saved me from getting in trouble was playing sports. If there’s not enough room for the kids to play sports, different kinds of classes, and yoga classes; which is really a good idea to develop. This whole project has been on the back burner for a long time, the case for growth can be made. The good name of VEA and they’re offering to help with the electricity, is a great thing for the community. Michelle Chappel I myself sit on the Pah rump Arena Advisory Committee. We’ve been involved in different aspects of contemplating the fairgrounds. All of that is going to be a 23 I P a g e October 7th 2025, Page 24 moot point ifwe don’t have infrastructure. So, valley electric bringing money in and saying, we’re going to bring infrastructure will be the beginning of getting this stuff done. We all know we need things in Pahrump. We need things to do, that is the biggest complaint I hear from the community. There’s nothing for people to do. Not only kids, how about seniors. My mom says it would be nice to be able to go to some classes and not have to rent the whole Community Center. Folks say that’s my money, well, it’s my money too. VEA used my money, sold transmission lines, I do not see my Community Center that they provided yet. So, take my money at the VEA and let’s put some infrastructure in. I want a covered/indoor arena for bigger events, people to spend their money here. We can’t belong to an organizing committee if we don’t have infrastructure. There’s been a well put in and won’t run without power. Instead of complaining, be part of the solution. If you want to know where Valley Electric is going to get the money, then you need to be sitting at a Valley Electric meeting. Not complaining to the town board. Roy Mankins I represent three schools of thought. I have lived in Pahrump since I 954. My family has probably paid over $1 ,000,000 in property taxes. We have helped create the parks to give the kids something to do. This park fulfills many objectives. The kids desperately need something to do with a safe place to do it. It will bring many new opportunities and will bring millions of dollars to our town. It’s going to cost but it will be paid for many times over. The Mountain Falls people have parks, everything they wanted, and they’re a little self-contained community. I can tell you for a fact, if we have a 400- acre recreational facility beside them, it’s going to increase the property values. Where they got the thought that this was going to depress pricing, it wouldn’t. Tim Bohannon I live in Mountain Falls and am very active. I’m very interested in making sure that that there are things to do in Pahrump. The hotel revenue that can be generated from this as people have said, is very large from a living standpoint in Mountain Falls. I want to make sure from the land standpoint that that land can actually be built on effectively. From a funding standpoint, this is a start. It’s a foundational start, but what’s next. From an overall perspective, making sure that we have activities in this town and something to do that are positive for the community, this is it. Ann Weaver I am a coach, mom of five, and a previous board member for Little League and rec league. This season we have 700 kids sharing the four fields at Ian Deutch Park. Over 500 of those are sharing fields 3 and 4, and 377 of those 500 are using baseball outfields for soccer practice and games. It’s a safety concern for our kids and these numbers don’t even include the kids not playing a sport this season. Pahrump is growing, the HOA communities, Mountain Falls, Burston Ranch and they all have kids. So many, that Floyd Elementary is over capacity. The kids in our communities need this. Sports is a positive outlet for many of them, and if we don’t have that, they’ll find other ways to entertain themselves. Joe Burzzinski Commissioners should go ahead and vote to approve this. I want to commend the commissioners for going after Valley Electric and keeping the heat on, so they live up to their earlier promises. I’ve travelled through the county, Round Mountain, 24 I P a g e October7t”, 2025, Page25 Tonopah, Beatty, and they have very nice community centers. Plus, we need to have things for the kids to do. If you let kids in sports or other activities in a classroom environment, they don’t do bad things. Dwight Lilly Definition of words is key here. This is listed as a vaccine and emergency homeless shelter according to the grant money that was given for the Civic Center. But I keep hearing the word “Civic Center come up. Civic Center is not a vaccine center. If you allow all of this to go forward under the current definitions, then the ACLU will be here suing Nye County. They will make sure the homeless people are able to use the emergency homeless center so that the grant money was placed out to fund. It says fairgrounds. This is not a sports complex. The BLM and Federal Government gave land here. Is this some type of bait and switch where you ask for funding, and you asked for a parcel of land for the people of the United States to do one thing. Then you turn around and bait switch doing something else with it. I haven’t even heard our District Attorney weigh in on this. I would hate to be facing the Federal Government down the line saying you are not living up to the grant terms that you were given. You are not living up to the BLM land that you were given for the specific purpose of a fairgrounds. I agree with the people here, we need to have something for the kids. Do it legally. As far as Valley Electric, Deborah Strickland was there, as was I, they’re both groups of people at Valley Electric when the directors at that time said, no we’re not giving the $5 million of the grant money to the county to build a Civic Center. Then again it was twisted around that a grant was applied for. The Comptroller was sitting right there and called it the vaccine and emergency homeless center. Lesa Wald We are a sports family. I am a board member of the group Pete Opt which is Pahrump Disability Outreach Program. I am also a coach for Special Olympics. We need this facility. I support the VEA line extension and the fairgrounds.

I am going to stop your time. Chair, if you indulge me. We are having a lot of outbursts. We can’t do that. We can’t clap, stomp our feet, and we can’t be talking in the audience. Because every time you do that, we stop listening. You want us to hear you, and I can’t do it if I’m constantly, “what are they saying over there.” It’s called decorum. Maryan Hollis I totally agree that there’s probably a need for more sports complexes. If the coaches and staff had read the memorandum of understanding, this $1 ,000,000 is going to go towards supplying electricity to the well, the OHV, and to whatever the Civic Center/pandemic center/refuge center there will be. There’s not $1 .00 in that report that will go to the fields. I wonder where that money will come from. Where will the money come from for the Civic Center itself that is estimated as of last year at $1 8 million. I did a timeline going back 28 years. Until 2019, there wasn’t any action being taken until the VEA met with a legacy committee. There was a committee, a legacy committee, made- up of staff, VEA, and the nonprofit coalition. Unfortunately, there was no normal citizen on there. There hasn’t been any person on any committee here to talk about the fairgrounds. The agreement was made in September 2019. Then in the same month, VEA withdrew. 25Page October 7th, 2025, Page 26 Because Commissbner Strickland, then Commissioner Blundo, then Commissioner Koenig said, “We don’t want it next to the VEA site because of parking.” If that’s not a simple issue to remedy, I don’t know what it is. It’s clear where the votes are going to go on this and who’s going to vote for it because they pulled it last time. Then County Manager considered it a bait and switch. Was there some inclination thatthere might have been a lawsuit to get this done? I have a quote, in March 20th of 2023 it was a Q&A put out by Mr. Allen, the project manager. He said quote, “Currently the VEA is working with the county on providing service for the entire site. We are on the talk to provide the power calculation to them and are currently working to provide that.” I’d like to know what that calculation is. Linda Clark I’m not for this at all. I’d like to see a YMCA with gyms. If you need fields, put them someplace else. We have plenty of land in here and I’m sure BLM will give you some more land. I have searched and I haven’t found one child, one adult, that does harness racing. I know you have off-road. We see them all the time up and down 160 stirring up dust. Tell me how this is an advantage to all the kids that want to play sports. I can’t find any that want to do some of this. There’s a few adults that maybe want to do this pickleball. We’ll never have enough courts for the number of people that want to do it. Tell me where all the people are, the children that are going to be filling all these fields. Mountain Falls is probably 98% seniors. When we build the other 5000 homes down there, we’ll probably get a few kids. We don’t have the schools, we don’t have the infrastructure, we don’t have medical services, or fire department. The Sheriff Department is overworked already. When we have an injury or something else going on down there, I love to see all these people rushing over there to help all these kids that got injured. I suppose that you wantto build all this before we get all ofthat. Is the Sheriff going to bring down a Sherift’s Department over there and have an outpost over here. How about the fireman, they’re going to build an outpost over there close to us? Tony HoIm Like most people in the room, I received an email from Commissioner Strickland to come down and support the fairgrounds. I want to say, I support the fairgrounds. I also support having more soccer fields in town, even though the average age in Pahrump is 53. I know there are children here because they roll up on my property all the time trying to damage something. They do need something to do. You shouldn’t be taking money from yEA. It’s a member owned cooperative, and they almost went bankrupt a couple times, once recently. $1 million represents about $50 from everyone that’s using electricity in in this town, about 22 businesses and homes. Most of the residents are struggling to afford the most recent rate hikes related to perhaps 100 grid lines coming in. There’ll be a lot of communities complaining about the impact of solar fields and building the infrastructure to support them. VEA should not be a charity giving money to the community, it’s a Co-op. I don’t know how that’s not understandable. The most incoherent part of the resolution that’s before you is in effect making it look like a contract to perform work that should have been done by Siemens. We’ve taken out a bond measure which if we’re going to build a fairground properly, we need a bond measure rather than launching into something without any idea of what the end costs are. It’s a guarantee of bankruptcy and you will probably see that this winter even without this. 26 I P a g e October 7th 2025, Page 27 It’s about $7.4 million on this bond; you still owe over 6,000,000 for work Siemens was supposed to do for you to put in the infrastructure in the county for solar. Which would have been a great thing if they actually did the work that we contracted them to do and without this bond measure. It would have saved us about 500,000 annually. For whatever reason, we’re not taking them to court for non-deliverance even though they delayed the deliverables multiple times. I’d like to point to is, who wrote this resolution? Was it Gridliance? I know it wasn’t anybody in the county. Michael David Garcia I really think when it comes to this agenda item that, we really need to be looking at the bait and switch that keeps coming up. That there’s possibly a good shutdown coming. A shutdown on federal, state, and county may be the remedy. We’ve seen how you reappropriate and reclassify wages and shuffle these grant monies. I’m all for the kids. I mean obviously we’re dealing with last place academia here. Especially when it comes with due process. When it comes to decorum, I find that there’s a little 2 tier there also. Because there’s plenty of video in the last five years that shows you all having conversations amongst yourselves while we’re speaking. Also, getting up and going to the bathroom is completely disrespecting. We can hold public comment when the DA is not looking at magazines. Or you actually pay attention to what we’re saying. The decorum should go both ways. Mary Kay Radcliffe I am confused. Today, you are only voting on the infrastructure and Valley Electric has donated the money. Who’s putting the infrastructure in? The early 2000’s, the BLM had donated this fairgrounds to the town of Pahrump. Today when you’re voting, are you voting as Nye County Commissioners or are you voting as town business since we don’t have the town board right now? Ed Goedhart I speak to support this. It’s long past time for the town size to grow and start to get involved with making these projects. Even though it’s in my age group, I may not personally use it. I applaud your efforts. I know you’ll have some challenges but when we have people coming to the table offering donations and money in kind; now is the time to do it. It’s never going to get cheaper. The longer we put it off, the more it will cost us. We have a lot of new folks moving into the valley. We need to provide the pertinent facilities that come with the growing population and community. Tom Boiling -To improve our perspective on this; according to the census from 2020 about 45,000 people that live in Pahrump. That’s almost 19,000 households. In those households, 14.2% of those have children under the age of 18. That was in 2020. If we fast forward to five years later, you’re probably more like 20,000 households with 15%, roughly 3000 kids. That’s if they only have one kid per household. She spoke about hundreds of kids fighting over 4 fields. Hundreds of kids, not thousands. When I was growing up, I had a dirt bike. The OHV park is giving the kids a place to ride. That’s not out destroying the desert, kicking up dust around everybody’s houses, and not just the people that live in conglomerated areas. The more fields we build, the more kids come. This is no longer the retirement community. There’s many people that drive over that mountain every day that have kids that families live here. This is a place for them to be 27 I P a g e October7th, 2025, Page28 able to expand, to grow, so their kids can have something to do besides sitting in their house and playing video games. These kids need a place to play safely. I applaud VEA for their support. Sheree Stringer I’ve been a resident here for 50 years. I know exactly what Tommy’s talking about. Coming out here as a teenager, there was nothing to do except we rode our bikes, rode horses, took rides out into the mountains. Those were the things that we did for activity because there weren’t a lot of parks here. I totally agree with this. Close Public Comment Jimmy Martinez I want to state that I understand it’s the fairgrounds and it is going to be a fairgrounds. As everybody knows, couple weeks ago, we had the Pahrump fall festival at Petrick Park is temporarily turned into a fairground. We need this to pull away from Petrick and create our fairgrounds. We can hardly hold about 30 to 50,000 people. If anybody’s been there on a Saturday, you’re touching shoulder to shoulder. I’ve been here 20 years, and we only have one new park. As of right now, we only have Petrack, Simkins, and lan Deutch Park that hold sports fields. Petrack becomes a fairgrounds during events. There are over 12 events during the year that we hold. Darrin Tuck Utility Superintendent. Back in 2022, we got grant funds to upgrade and upgrade the existing well out there. It was engineered for soccer fields. Anything beyond that is not adequate. We had to turn the monitoring there into a production and put in a 27,000-gallon tank, pumping station, for the purpose of the soccer fields. Anything we do out there, we need that second well. It’s crucial for anything else we do such as; facilities and a playground. 3000 feet of power line is crucial to start up the well that is under right now. We have to have power for that well. No powerline, no well.

I am absolutely 100% supporting of providing more and additional soccer fields, ball fields, and pickleball courts. We need to stuff. If their families have nothing to do, that’s one of the biggest complaints that I’ve heard from doctors who don’t want to come out here. Their spouses are like what are we/kids going to do there. They’re not wrong. This stuff is absolutely necessary. I’m not supporting necessarily a civic center, that’s not what I’m even after right now. I want ball fields, pickleball courts, and things like that.

I want to say that it’s nice to have a meeting to hear that we’re giving people what they want. There are some people there that say they don’t want it 28Page October 7th, 2025, Page 29 and that’s fine. There’s always going to be the plus and the minus but normally all we hear is the negative. We usually are giving other people what they want because of the people who aren’t at our meetings. Because they don’t come to our meetings and today, they did. I heard them and what they want. I knew what they wanted before that because I’ve been saying soccer fields, ball fields, pickleball courts, I want something for the kids to do. I’ve been saying it over and over. Finally, we’re going to have the opportunity to maybe do some of that.

Lots of information. This is very confusing for the public, for the residents, for us because on the first page after the body of the agenda, the second paragraph it clearly reads, the development of the Pahrump Civic Center. This is where it’s very confusing for the public. The last time something was on the agenda for the fairgrounds, it was the well. That well, through Darren’s hard work and his staff for two years they’ve been working on that. Without power, we don’t have the water. There’s a lot of talk about fairgrounds, facility, Civic Center, and yes, I want to thank the VEA for stepping up and realizing. That yes, of course going back into the history, former executive committee but that former executive committee is bound by whatever they did and said. Thank you for stepping up, acknowledging, working with us, and graciously wanting to do this whether it’s monetary. Facility is different than field. Different than fairgrounds. Different than soccer fields and OHV. I’m in support of getting these other fields throughout Pahrump to be brought up to par to have ball fields, so these kids aren’t physically and literally stepping all over each other. Another concern, it doesn’t end with this $1 ,000,000, it doesn’t end with building the facility, of not necessarily a building but the fairgrounds. To put it in different fields we have maintenance, staffing costs, equipment costs, power utility costs, maintenance and repair, and it doesn’t end here. This is again, where it’s confusing for the people. I don’t think anybody that said they were in objection to this, is in objection to putting together a ball field or something for our children. The other thing that’s not been mentioned, is safety first. If there’s an emergency situation on On the other side of the fairgrounds, the proposed area for fairgrounds is Mountain Falls. These wells will hopefully and adequately help with a fire and emergency situation if one may rise. Across the street is the Raceway. There are three fire hydrants supplied by a well. The highway would have to be closed if there was an emergency at the fairgrounds. I haven’t heard or seen anything in the back up in regard to an emergency situation. That the fire department would be able to hook up to both wells because they are certainly not going to drop a hose and a line into the pond over at Mountain Falls. With the other aspects of the well was funded by a grant, the power now is going to be funded by yEA. It’s very clear that we don’t have the money to build what everybody is calling a facility right now. Yes, that $18 million is probably going to grow. We don’t have that money but that’s not really what we’re talking about. The way it’s written is very confusing and we have to stop confusing our items and the public as to what we’re trying to accomplish. The end goal is to provide for not just the children, the middle-aged, the seniors, everybody. To get out there and participate somehow some way. The revenue projected, to be generated, are going to get the money to fund this project in its entirety, if we were to move forward with some type of building and facility. Linda mentioned the YMCA. Why wouldn’t YMCA, boys club, or any of those organizations not be allowed in such a facility 29Page October7t, 2025, Page3O that we’re planning on building once we find where the money is. Tournaments, we build it, they’ll come. Again, we have to have the seed money to build and yes, we’ll even get tournaments coming out of California. Because it’ll be less expensive for them to travel with fuel, food, room accommodations, et cetera to travel to Pahrump, Nye County then to stay in their state because of the astronomical costs that they’re charged on their fields. It makes sense. We need to put together a plan, a budget projection, ROl, etcetera, and we don’t have any of that. Right now, we’re talking about a power line to supply the water specifically for OHV, the soccer fields, and ball fields. Is that correct?

I hope many of you understood what he said. With some of the things that are going on here with this particular piece of land, Jack Kemp used to say a rising tide lifts all boats. It reminds me of how we’re growing here. It may not be applicable to supply side economics but here in this town we have these needs. One of the things that many people don’t realize is that in recent weeks, I’ve been really pushing to try to use these fairgrounds in a way to start with ball fields. Moving even the arena that we have up there. Having a pool that people can actually use and not worry about being stabbed at. There’s some very practical things we need to look at and that is there is a fairgrounds fund with a bunch of money in it. We have a developer that’s interested in some of the land that we have. If we do want a TJ Maxx, Chili’s, and we do want these things, it appears to me that the only way we can do that is by relocating some of these amenities. Someone who’s here and has a humbling task of being 20% ofthe government that it possibly reforms a community where there’s people who lived here for so long; I have done my due diligence if and talk to people who’ve been here a really long time. I do notlikethe language ofthe Civic Center. Because ofallthis, the Civic Center has been called and I’m not going to read it all, but I have it. It makes me very concerned because we have documents going back years about what the Civic Center is and people who have said what the Civic Center is. Our current finance person, I have quotes from people who describe what this Civic Center is like. I understand that don’t believe what you read, believe what we’re telling you, but that doesn’t work for me. Now I’ve got this problem and it’s interesting, there’s two sides to the coin. We’ve got people who are willing to shut down the government, for example because they don’t want to vote on something that’s destructive. Then you had President Reagan who was willing to go along with things that he saw as destructive because in his words, he wears the white hat. One of the reasons why we wear a white hat. I really want to see a safe park, safe ball fields, and more ball fields. I’m conflicted with the word Civic Center. We don’t have a whip office. I can’t call the whip and say how many votes do we have on this. There’s three votes right now at least for this to pass. What I’d likely do is wait for my vote until the end. Ideally, if it was me, I would want to remove the language that discusses the Civic Center in here. I mean it’s possible to contract law to remove it and counter offer it. That’s what I would ask in order to vote for this. I’m not going to vote at all until I which direction this is going. I don’t know that I’m willing to be the person responsible for killing this. We have this open meeting, it’s kind of funny people who say they’re for free speech like the open meeting law. It kills free speech really, to me and it’s never been challenged by the way. I am very 30 P a g e October 7th 2025, Page 131 supportive of moving this forward. I would like to move, and I know it’s off topic. I’m not trying to do that; I do want to move this forward. The reason why it’s not off topic is because it’s very important for people to understand the rationale and the reasoning behind what we’re doing today. I want to see this infrastructure down there. My problem is the reference of the Civic Center. I know that’s a separate vote, but it still gives me tremendous pause. That’s not possible to remove that, is that correct? Of course, I’m scared to death to change the MOU in any fashion because ofthe commitment that valley electric has already done by going to their board. I’ll read that history to you. When the chair is ready to give me time, I wantto say, you guys are having this discussion, but I want you to think; does the word Civic Center scare you so bad that you would want to lose the $1 000,000 infrastructure agreement that we have in front of us?

This document says the parties agree to cooperate in good faith with the Civic Center moving forward. The problem with this contract, that we do not move forward with the Civic Center, is that a present of a minor breach? Manager Waggoner No. It says in the first paragraph the possibility of a Civic Center like commissioner Boskovich said. The Civic Center would be something that this board would have to vote on. Obviously. it would be a substantial amount of money to ever bring it to fruition. The priority that we’ve discussed with valley electric has been a possible new arena, soccer fields, finish the OHV park, the lighting, and all of that stuff. The Civic Center if it was ever to move forward, again will be a very substantial cost. Which would have to come much later.

Three commissioners have stated that we are uncomfortable with the verbiage of Pahrump Civic Center and hopefully the CEO of VEA Robbie, is still on the line. lfyou don’t mind, I’d like to get him on the line and ask ifhe has heard hopefully all ofthe public comment, all ofthe public concerns, all of our concerns as commissioners representing our constituents for this project, and I’d like to hear from him. Where I don’t think that we’re at risk at all in changing the verbiage. Robby Hamlin CEO of yEA. I have been listening. I inherited that language whenever we first started the MOU as far as involving Civic Center. Valley’s intent is not to specify what specifically goes on the land down there that we’re looking. If the Commission sees fit to want to make them change to arena, facility, or something along that line, Valley does not have an objection to that. Intent is to make a commitment and contribute to the community and install the infrastructure. What ends up going down there is more of a county Commission decision town of proposition. We’re here to provide the infrastructure. We’re perfectly good with making a tweak to that language.

DA Kunzi I honestly would suggest, the smartest thing to do and given particularly what VA’s indicating is the generic nature of what they’re doing is; I would recommend using the word fairground. I’d like to address some ofthe concerns about what does a fairground mean. People are overreading this. , he had asked if I’d been working along on this. I thought I would say that a lot of you haven’t been here through this whole entire process. I feel blessed that you’re here today. You may not have had the vision or even living here at the time that we started this. You might know the history that in I 999, BLM gave us 427.24 through a patent, that’s now your fairgrounds property. September 6th of 2016, there was an article in the Pahrump Valley Times that talked about an upcoming vote of the people. The article read there would be a $5,000,000 donation from the buyers to Valley Electrics charitable foundation. The value of the land that the proposed facility would be built on would also be donated. That article was talking about a vote that we would take. Then I came into office in 2019, and I began working on this. I began working on how to get those monies for our community. Not knowing how to get that done, the only thing that I knew what to do was to reach out to our staff and we began the task in. September 2 0th, 2019, there was another article that was talking about the letter of intent that the Nye County commissioners has given the thumbs up to a letter of intent for Valley Electric Association outlining the cooperative desire to make good on promises made to the community about donating 5 million plus necessary land, to construct a new Community Center. That’s where these words are coming from; Community Center, Civic Center. They’ve been embedded in this project for a very long time. That happened in September 2019. Next thing to do is, I directed staff to come up with the conceptual drawing what would this look like if we had a Community Center. We did it. We brought it together and at the time came before the board of county commissioners July 28th, 2020. That agenda item read at the time on September 17th 2019, the board of county commissioners authorized county manager to accept the donation of $5,000,000 to construct a Community Center. Over the past six months county staff has expanded upon the discussion and committee outreach done by Valley Electric’s formal legacy committee. Staff has worked with Valley Electric board of directors, Valley Electric executives team, and staff contractors, as well as other professionals to create the proposed Community Center plans included in the backup. That was the article that came out in September of 2020. By July 26th 2020, that was all submitted to us and then we went forward and submitted those to valley electric. We went to Valley Electric not once, but twice with those drawings and from July to September. By September 4th, Valley Electric had rejected those plans. They did not have the money. We get that as a county, don’t we. They sold the transmission lines, butthey no longer had the money. In May 2lstto 2024 Gridaliance development agreement gave us the opportunity to receive that $5,000,000 that was promised. We outlined a development agreement that said Gridaliance will give us the $5,000,000 that Valley Electric was unable to give us, and we got that money. That $5,000,000 is still sitting in our coffers from Gridaliance. In 2024, we began again asking Valley Electric for support at the fairgrounds, this memorandum is the result of that. This has been my push. I asked if promises were made, were promises kept. I believe this MOU is the final payment to the people. The people, the members, agreed to sell the transmissions lines and they, each member, received a check for $579 as promised. I would like to ask Serena to bring up the map please of what we’re talking about here. This drawing shows that we have in the bottom quadrant, you’ll see where we have a 33 P a g e October 7th 2025, Page 34 group of eight soccer fields. You’ll see where we have embedded, already have that fence. It’s fenced, that’s where you’re shooting offfireworks. That checkerboard rightthere, that’s where you’re parking when you do that. Down below is where our current water and power is. What we’re proposing here is to take power from that location up to the corner, even closer than this show near the OHV park. That’s going to give power to the OHV park and the well that’s sitting there and that’s going to give us redundancy that we need to be able to always have water available for the soccer field. This power goes right by the soccer fields. This is the cream of the crop, we are right there, we are in the moment, and we have the ability to do this. This is the first time we’re really going to make an impact because we’ve already got I well. We’ve already got the septic systems in there. We can set up those temporary facilities. Valley Electric has been cooperating with us, knowing how hard it is also for them to come up with the money. What you want to read within the body of this document that they put before us is, they say under contributions to special use permit offset fees, they say Valley Electric has contributed Gridliance West, the amount of $1 million. When we got our five, a million of it came from Valley Electric. They were doing the best they could to make good on their promises. They also say within this document that they’re going to give additional aid and construction of $1 ,000,000 to us. It also says there’s a mutual benefit to be recognized because Valley Electric is going to help us by giving us competitive electric utility rates for these buildings and infrastructures. It goes on to say, the Valley Electric is happy to help us implement energy efficiency measures such, solar energy, battery backup system, and other energy efficient measures. This is a beautiful thing. This is making community and it’s Valley Electric that’s getting it done. It’s through these commissioners that, I know we’re going to support this, because the language is the only thing that they were concerned with.

I am required to disclose that my involvement with Pahrump Valley Public Transportation as the president/chairman of the board, could create a conflict of interest. I conclude in consultation with council that a reasonable person in my situation would not be materially affected by this relationship because this is not a clear case with a disqualifying conflict of interest. I’m going to participate and vote in this matter. I received no money from that organization. Eric Whalen Pahrump Valley Public Transportation receives funding from the Nevada Department of Veteran Services. This funding is for our VETrans program. This program provides free transportation to our local veterans for medical and pharmacy purposes. The funding that we receive is $50,000 from NDVS for a year. That’s to cover salaries for; drivers, admin, office supplies, office space, phones, etcetera. One of the primary ones is insurances. That’s 243,000 for six vehicles for a year. These two properties; they’re side-by-side properties in the Fish Lake Valley area. These two properties were seized as a result of a drug arrest. The way that the process is, I honestly at this point I’m not sure if we even can give these properties away. Because the proceeds of any forfeiture, drug forfeiture, has to go into our drug forfeiture account. Which is then turned around and used for drug investigations. I’m not sure that this is the case that we cannot do this. I was thinking that if for instance each of these two properties would, in good condition, sell for $25,000, and we could sell them for $5000 each as is. Then that would be $10,000 in our coffers that we don’t have otherwise. I reached out to a realtor who has put me in touch with a realtor in the Fish 411 P a g e October 7th 2025, Page 142 16. We’ve had this property for approximately 20 plus years. That was seized from Esmeralda County because as you said, drug seizure, drug bust, and Nye County took possession of this property. Esmeralda County has informed me that they have lost over the last 20 years approximately $1 7,000 off of their tax roll. In part of the backup, on the body, the NRS 277.053, clearly reads that this conveyance could be without charge. To be given back to the rightful owner of Esmeralda County.

We’re being asked to consider putting it up for sale, holding on to it for a little longer, longer than the 20 plus years that we’ve already sat on it. And possibly getting $5000 from them. This is insult to injury as far as Esmeralda County is concerned. Again, our neighbor. We work with them, you work with them, I work with them, our DA works with them, we all work with our neighboring counties. I’m not sure why we’re even debating this after 20 years.

I’m not trying to be provocative. I want to announce that I don’t know the proper procedure if it’s not my district. I very much care about the respecting the boundaries of the district but is there anything that can be done. Can you answer, with an open area, with people who are occupying an area that keeps setting it on fire and it’s a homeless camp; Is there anything that could be done to restrict access to that area?
