There’s the public meetings act, which I believe is unconstitutional because it chills free speech. A citizen could talk to all five of us, go back and figure out what to do with them. We can’t speak amongst ourselves. The reality is that thousands of people have elected each one of us, but we are now shackled from being able to speak to each other. If someone comes up with something for public comment and it goes into a deliberation, the problem is that it hasn’t been noticed. There’s a due process notice that has to go out, so people at home are aware. What we’re doing is we’re depriving people of their due process when there is a discussion not noticed. The DA does a lot of work you don’t see, putting effort into making sure these are all correct. I think it’s a garbage law designed to shackle elected officials in a place where staff is extremely powerful because of term limits. The state model is set so that we all are not able to speak on certain things up here without these interruptions and these awkward conversations. We can’t answer and ifwe do, we’re violating another constitutional right. I don’tthink that we’ve done a very good job articulating the reason why we are forbidden by State Law from sitting up and hearing or having a back and forth. This forum has turned into a way to politically campaign. It doesn’t work and it’s not helping the case if that’s what you’re intending to do. There is a group that’s been formed by the Water Board to address zombie lots. Until that board comes up with a solution, not much is going to happen. According to what I’ve been told, Great Basin will not allow alternatives. That comes directly from the Water Board. At the next meeting, I’m going to ask him to tell you in person what he told me, “Great Basin will not allow it.” In my district, there are probably I 5 court cases right now on people that are sitting over there in trailers and motorhomes. I’m going out tomorrow morning with code compliance and a cop. Most of them are not in the condition that the $35,000 we approved will allow us to haul away because people are living in them. We’re going to work on it and it’s going to take time. We’re not going to do 100 or more court cases because the people refused to move. They’ve been fined twice, and they owe about $12k in fines they can’t afford.

The Tonopah High School football team, Muckers, representing Tonopah and Nye County, deserve applause. Thanks to everybody that participated whether they were a player, giving them Gatorade or water, and the coaches. The principal and the community from the North were there as well as people from Pahrump going to Bishop Gorman and showing the support for these players. Tonopah did not take state but there’s always next year.

A commenter said she has a property on the north side where she’s concerned about flooding. Currently, in regard to the retention basins, there is major work that’s being done on acquiring funds to do so. The Nye County Water District Governing board has contacted Beck Engineering, and they have a contract for that. Public Works has mapping for that. This has been ongoing and we’re aware of the problem. We would love to find grants to help us build retention and detention basins. It would be wonderful for retaining that water where it could be moved back through our valley floor and help with our water table.

I hope everybody had a good Thanksgiving. My family and I met in Tahoe. It was a lot of fun. Manager Waggoner Again, the path forward for a zone change has been explained. The application and approval process has been explained. This group that is asking the taxpayers of this county to foot the bill, they haven’t been willing to foot their own bill to get the process started. Beau Gott Public Works has received 605 maintenance requests since the beginning of this year, averaging 55 per month. Last month, we received 76 requests. That’s a bit more than normal, due to the recent surge of the wet weather. The majority of the requests continue to be for potholes. Since the last couple offloods, we have had a lot of washouts to repair, along with a lot of debris left on the road to remove. In the Northern District, gravel road maintenance continues in the outlying areas. The greater operators have been bouncing around quite a bit to take care of washouts and hazards throughout Northern Nye County, and we’ll continue with their routes when they can. In Tonopah, crews have been patching and doing some sign work. In the central district, the crews have been cleaning up after the rains and will be moving on to patching, gravel road maintenance, and some sign work. In the Southern District, the Pahrump crew is still concentrating on flood repair. After getting everything passable and opened up from the first flood, we got hit again. We had to start all over removing debris from the roads and fixing driveways that we’re washed out. Flood repair will continue as we have a lot of ditch work, culvert cleaning, gravel road maintenance, and street sweeping. We also have multiple pothole patching crews out daily; in the forms of cold mix and our dura patchers.

How are doing on the crack sealing? Beau Gott We’re doing well. Our order of crack seal came in last week and we have to disperse that to the different districts. It’s more of a cold weather application. We can’t do it when it’s wet. We’ll be concentrating on potholes right now. Around January is when we roll into the seal.

All the cracks we have are now wet, so we are already in trouble. Will you take a look at Leslie and Glen Cove to repair the big potholes? Beau Gott Every time it rains, we come up with this same scenario where our cold mix isn’t holding up. We have what’s called hydro patch; it’s made for patching in wet weather. We use it as much as we can but it’s very expensive and you can only do so much with what you have. What we’re doing when these potholes are blowing out is a cool mix repair where we blow all the wet water out. We take a propane torch to dry it out as much as we can and patch the hole because it’s a hazard. It’s not the best way to fix it but it’s the only way to fix it at that time for what we can do. That intersection is pretty rough. We’ll have to go in there and do a chip seal repair over the top of it but it’s not the only intersection. They’re all over the place and we have to pick the worst ones and do those first before we move on.

If we could take a peek at Darrall Ct off of Margarita. The other one is, 941 Gypsy out North. I’m not exactly sure what the issue is with that one, but I think it had to do with when it flooded. A street sign has been down for two years, and I’ll text thatto you.

It was all hands on deck on the roads clearing up the debris and getting the floodwaters taken care of. Two weeks later, we got hit again. I don’t think the winter season is over. 500, the rule of thumb and even in Pahrump you’re hitting 300. By the time they set it, it’s not adhering properly. I really don’t want you wasting time, money, payroll, the staff’s time with that because it’s the taxpayers’ dollars and then you’re right back at it again a few weeks later. Even the ones that aren’t getting out there, they’re feeling the residual when the equipment comes back and there’s a lot of wear and tear. There are a lot of intricacies involved, and I can only ask the public, the Commission, and the admin to be patient with Beau. The rule of thumb is to make the ingress egress on these roads passable and as safe as possible. Beau Gott The Barney section from 372 was a section that we did a scrub seal on. One of the roads that would blow out with a little bit of rain with hundreds of potholes alongside with Wilson and Thousandaire. I was worried about how they were going to hold up and they all held up. The scrub seal is working.

The facts are that the union relied on a pay study to set salaries that members voted on with that pay study being offered or aware of. There’s probably a presumption, although not a legal one, but presuming the pay study is reliable. Now we have some up here, the Captain, and the Sheriffs Office says there are serious flaws. It’s been admitted that we need to go back and fix this. Everybody has an opinion on what went wrong and why it happened. The sticking point here is, does the union care that they relied on this information. If the union does not care that they used flawed information to vote on, that’s their issue not ours. Perhaps the first way to handle this is to take the offer from the attorney representing the union to have a private negotiation on what they intend to do to fix the problem of the pay study. We have dispatchers who are intending to quit, who we need here in this community, who pick up the phone, and they do a lot of work. I don’t want to ignore these people and I’m afraid that that’s what we’re collectively doing. There is no doubt in my mind that the Nye County staff could fill this room with excuses on why something can’t be done. I hope that’s not what we’re going to hear today.

Seems somewhat unfair to me to address an issue that is already in the process of being addressed but has not been implemented yet. Without addressing it for everybody would be my concern. I don’t want to see any of our people go elsewhere if we can avoid that.

I think that is the point, having this go back to the union. I think it’s chaotic and destructive for us to reach the hand of government in and say well we’re going to quote on quote fix this one position. There was some bad information the union was given. That’s why we wanted what’s called a limited scope reopening of negotiations. That is something that we received consent from the union to have a limited scope. All it does is limit the scope of the negotiations to all of the pay for everybody. That they can take a look at what was done perhaps erroneously, perhaps not. If the union is not interested, then we won’t do it. If we don’t ask, no one will ask. I want this pay study to be looked at, perhaps set aside, maybe get our money, and find out if this company ever did a pay study. I want those members to see accurate information. I don’t feel like those members were given accurate information. I’m actually pretty pro union when it comes to most things in matters like this. DA Kunzi This might help the direction ofwhere the discussion should go. Originally, we were talking about reopening the negotiations and council for the association righifully pointed out that that may not be what we want to do. If we reopen negotiations, that opens up everything. What they’re willing to do is have informal discussions with us regarding this issue with the pay studies. That would be my recommendation that we go on a more informal basis of having discussions to figure out exactly what issues there are. That we can bring that back and that way we can put together a plan or a solution that would resolve everybody’s issues with regards to what seems to be problems with the application of the wage study.

I agree. If we could find language and maybe the DA could offer that in doing whatever is informal negotiations to figure out what to do. DA Kunzi I recommend not using the word negotiations. I think it’s authorizing informal discussions with the association with regards to this issue.

This is a very important agenda item. We asked the dispatchers to be patient, that we’re trying to figure this out. We know that their CBA is trying to figure it out. When we say that the members voted for this, the majority of the members voted for this contract. It’s unlikely that the dispatchers voted for this knowing that the pay study did not include them. I know that I mentioned at one of the meetings that it sure did seem like the dispatchers for whatever reason were sacrificed or overlooked through the negotiations prior to us coming here today. I agree with the DA, with the other commissioner, and especially if there are options being worked on right now. Yes, the union attorney has been very much involved with this and trying to correct it. Again, we’re being cautioned that just last year, we were asked to reopen a particular contract and were advised not to do that because we would be setting precedents. We really need to be careful with this before making a decision. What I’m hearing is potentially that we allow this particular item to die today rather than vote on it. Let the negotiations continue, the informal negotiations, Mr. DA. DA Kunzi I am concerned about talking about informal negotiations. There’s no such thing as informal negotiations. When you talk about negotiations, you’re talking about negotiations. I think what this agenda item was designed is to give staff direction on how we should proceed with this. My suggestion is to not make any reference to negotiations at all. But to actually have an informal discussion with the association so that we can weed out all of the issues that may be presented. That we can then come back to the board with a more formalized plan of how we can move forward.

At this time, should we have more information about the cost? Manager Waggoner I know this has been done for many years. I don’t think anybody’s has anything against the intent of it. But, when I saw this item come forward, I saw the amount of $50k. Which is supposed to be inclusive of any salaries and benefits. I don’t think we have anybody in this county, one singular employee, that unless they’re possibly a part time, that benefits and salary $50k would cover this. I did reach out to HR because I wanted to see what this actually costs the county to provide this service. What it came up with was a total of $304,625. I wanted to bring that to the attention. I wanted to make sure you’re informed that this is a substantial hit to the budget of the Sheriffs Department by providing this service.

The alternative is that we don’t have deputies in the schools. I don’t think there’s anybody here that wants that.

In the past there have been grants that have been applied and received under the school district. They were not eligible to apply for the grant this year because of restrictions of the grant. We were not eligible to apply for the grant because it couldn’t be applied for by the law enforcement. It had to be applied for by the schools. That being the case, this is a necessity. I would rather have a deputy in every school all day if we could. We can’t do that, we don’t have the manpower or the money. My preference would be that it’s funded by the school’s budget but if they don’t have it, they don’t have it. We can’t not have cops in schools in today’s day and age. I would hate for this to fail and then something happens at one of our schools that we could have prevented. We’ve been doing this for 20 years in one way or another in Nye County. If it comes to the point where we have to provide more deputies and more money; first of all, we don’t have the available positions because a lot of our positions have been frozen, and we don’t have the money to do that anyway. This will augment, offset some of the costs of providing the service to the school district and it will give us the safety and security of having at least some deputies available to the schools.

Is it possible that the school district has become used to us funding this and hasn’t really looked at sharpening their own pencils in a ways to help at least offset some more of the cost of this?

If one entity takes on responsibility for whatever task it is, then sooner or later it becomes that entities responsibility. If that’s the case here and the school district budget needs to be drastically increased in order to pay for this fully, I can’t help that. I know that at this point, we need to do something.

No doubt that since the beginning of the year things have transpired and not in a positive way in some of the schools. When you say the deputies and schools as plural, are we talking throughout Nye County?

Are their services like this being provided in the North or is it only within this valley floor?

It is predominantly here in Pahrump. We don’t have anybody assigned in the schools in the North or Central. The answer to that is yes, it is only here in Pahrump.

In a perfect world, if this is approved, for example, you assign a couple of deputies to the schools. There are many schools in Pah rump and there are also many schools outside of Pahrump. This will be a deterrent for the students and or infiltration to the schools because of the presence of the deputies. We don’t live in a perfect world. I know it reads $50k for six more months until the end of the school year. It’s two deputies not just at school. It’s overtime at sporting events.

Right. During the school day, the need for a deputy at any school varies based on the needs. An elementary school doesn’t have fights and knives coming into class, generally. But it does happen. When you’re dealing with 7 year olds fighting or you’re dealing with 18 year olds fighting, there is a big difference. We have a deputy assigned to the high school. We have a deputy assigned to the middle school. We used to have a third deputy that would roam the elementary schools. We had a deputy who did not want to do the schools anymore and we did not replace that third. Now the middle school deputy has to roam the middle school and the elementary schools in Pahrump. The third deputy also used to go to the North one day a week ,and would spot schools. We no longer have that third deputy, so we no longer have that luxury.

Because they are not certified peace officers, they cannot make arrest.

The contract will terminate in June. $50k for services not including overtime. I’m taking that out of the conversation. We’ve been doing this for 20 some odd years, maybe losing money. They do it for another six months, I don’t have a problem with it. The next time they come, we want to get back to school board and say we have a problem with it. Please renew your budget or look at your budget to try and get this better.

stated that there are no SRO’s outside of Pahrump. If you really want to approve SRO’s, then maybe fund it through The Town of Pahrump to cover the cost. The attachment specifically says, the SRO shall provide law enforcement services to all schools within the school district during the agreed upon hours. We all know that we won’t get one in Tonopah. The county should not be footing this bill. The school district has the best grants person and if she didn’t apply for the grants, then that’s on them. I cannot fire Lieutenants. They’re covered under contract until they retire and the county has to continue to pay their pension. The deputies in the North do routinely patrol of the schools when they’re not assigned. They go into the schools and solve problems. The SRO’s here in Pahrump, they are not to only stand there and be a gun if somebody tries to assault the school. They are taking care of problems, minor fights, and drugs found. The national average for law enforcement to population is 2.5 officers per thousand. Our average is 1.57 per thousand. The budget report for the first quarter of fiscal 26; July, August, and September are preliminary figures. In general, the very first page is our revenue report. Revenues for 2026 haven’t kept pace with our prior year receipts. You can see down at the bottom, we’re down 12% compared to this same time last year. We would like to see 25% marks on those. We do see some are higher, lower, or right on track. 25% of the quarter has elapsed and we’d like to see our revenues tracking at that same pace. That’s not exactly how revenues always come into the county or get posted. We would like to watch this closer especially during the current quarter; this would be second quarter by the end of the year. We should be around 50% of revenues received or at least getting closer to that. Our expenditure report, in the middle of the page, you see under general government total health. We have created a new department function which is now called Animal Services. The numbers are very skewed on this. What’s happened is animal shelter and animal control functions were combined into one. The expenditures are less than what we had spent in the prior.

How long will we have to carry that excess fund before we can collapse it?

It’s the same fund, all general fund 10101. This was a separate department function; administration, comptroller office instead of having two.

Correct. Fund 10204, land sale costs, very skewed numbers there. That’s because this fund was actually reactivated in fiscal 26. There were no numbers in the prior year that you can see for revenues or expenditures and now that we’re actually 18Page December 2nd 2025, Page19 12. Down at the very bottom of fund I 0380 for resilient Nevada; funds that we’ve received through the state about the opioid crisis and the opioid use disorder support prevention plan put in place by our director Karyn Smith is being implemented. We’ve received revenues a few years ago, that has started to taper off for now, but you’ll see a major increase in expenditures because we now have an employee that’s working on implementing programs. Page 5,6,7, and 8; those are separate pages specifically for the towns. We do get quite a few comments or questions regarding town funds, and it’s all in black and white right here. It includes those specific town expenditures, revenues, and the beginning cash balances for each of those funds.

There are a few things I’d like the board to consider when looking at these figures; We’re 25% in, I’m going to ask if you couldn’t add in the future in the margin, at the top it says, budget collected, balance percent received. If you would have plugged in 25% there, my life would be easier when doing this. What’s interesting to me budgetarily is, there is a lot of backload instead of front load when it comes to managing the county budget. That it’s really hard to look at this and say how can we be down 12%. It’s easy, we have federal and local taxes that we won’t realize until probably the very last week of the year. Same with consolidated tax going through the roof as soon as everybody gets done buying their Christmas goodies. We look bad in that we’re down 12% but you’re going to see that go up with notthis next report butthe following one.

I noticed reduced interest being credited to revenues, reduced market gains, and then internal functions that we have in accounting for operating transfers. Where in prior years, you see those transfers supporting funding and revenues. Those happen by the end of September. Under miscellaneous, we have 3.6 million. Do we know what’s in the miscellaneous?

Mostly we use that for misc. overhead. A lot of times we do utilize that for our inter fund transfers, and publications in advertisements. Sam Tackett Misc. overhead is our fund that pays for all of our unfunded mandates from the state and all the bills that we pay to keep our state and government services running. This serves miscellaneous overhead for items that impact or benefit all departments. It’s also our postage for the entire county. There is an interfund transfer to risk management to help cover premium and operation costs. We also have a few contracts in there that supply services to the entire county. There’s a lot offunding in there that provides services to our outlying communities.

The keyword and where majority of the money goes is the state unfunded mandates. That’s what I wanted to hear. Page 3, 10248 the drug court proceeds, they’re up 82%. Is that correct?

That does look right to me because we’ve spent $52k compared to $28k the same time last year in fiscal 25. A lot of our drug court facilitators were still grant funded that expired September 30th• We may see increases in employees based on that.

Item 10247, district court improvement, is up 2500%. Is that a correct number?

In the prior year, there was under $1600 that had been expensed. This year there’s been $41 ,000 expensed. When we reviewed, our budget analysts found that there was actually fiscal 26 capital improvement plans that are now being implemented both IN 247 and 246 above facility assessments. We do have some increased capital outlay in fiscal 26 that we did not see at this same time last year. The price is actually going down. We do see this on a frequent basis coming from the State. Our IT department, in the effort of public safety, leases site space. That way we can have our public communications and our emergency responses are within timely manners. This is actually a reduction of 15k, and budgeted funding is available.

Fact of the matter is, this debris, trash, garbage that NDOT, BLM and nonprofits are picking up around Nye county is all of our trash. When we’re talking about the Sheriffs in the school; Nye County doesn’t have any money, and apparently the school board doesn’t have any money. We gave raises to a bunch of people, that’s going to cost us money. Fuel, food, electricity; everything is going up. Except we’re not getting any more money coming in and that’s our problem. We’ve taken steps to hopefully make that number get bigger in the fairly near future by changing what we get for new homes when they build them. The Sheriff said we need more cops, that we can’t afford. How do we afford more stuff without getting people upset with the word that starts with a T, because we haven’t gone for taxes.

They began the Service Dog Program in November 2018. By February 2019 I knew Sid would not make it through the program. Kent made the difficult decision to release Sid. I arranged to send Sid to a Diabetic Alert Dog Program in California. I found Emma at a Veterans Service Dog Program in New Orleans. She was too calm for their Diabetic Alert Dog Program. I encouraged Kent to consider her as his partner and the rest as they say is history. They completed the PTSD Veterans Service Dog Program in April 2019. Some families have resorted to driving their kids to Vegas for their sporting practices and games. The practice field competition in Pahrump is fierce and I’ve been told from parents with daughters, that the girls get the worst schedules. 20 + years = 20 years is a generation I 20 classes of graduates, over 5000 kids have graduated since the land was ‘gifted’. We have 5 parks in town ofwhich at least 3; Simpkins, Ian Deitch, and Kellogg all have adjacent undeveloped land (the others may too)l,And, the TOP recently bought an additionai8 acres adjacent to Kellogg Park for $80,000. The TOP has $2,000,000 just sitting in an account to upgrade that park! It is MUCH more cost effective to add ball fields to existing parks where roads, drainage, parking, lighting, water, sewer, and restroom facilities already exist than creating them from nothing, in an area that is baren and quite possibly riddled with our famous ‘poof’ dirt. Since 2016 TOP has been awarded $2,228,928 in grants to improve the gifted ‘fairgrounds’ property. All they have to show is 2 holes in the ground. Now they are asking for more grant money to connect the two holes in the ground. It .has been 9 years since the initial grant money was awarded. Not one field been built! An OHV (piles of dirt pushed into place to form a track) serves a handful of kids while hundreds of Pahrump kids play on teams that have to fight for practice time. IF we actually cared about our kids, we would have put in additional ball fields at our existing parks long ago! Twenty years of inaction speaks volumes and frankly, says otherwise.
