I wanted to request something, as there is going to be a removal of an agenda item. I wanted to entertain moving those motions, to suspend the rules to move temporarily to item 4. So that anyone can speak on that item, anyone may speak at public comment, otherwise they will not have an opportunity to.

Thank you very much for that, Sir. I would like to follow up on that, please, from the DA, Christy, or somebody. Pat Leming- I am the founder and Executive Director of Never Forgotten Animal Society. The reason I’m here today is to try to give an update on what we’ve been able to accomplish in the seven years that we have been rescuing animals in Nye County. As of November 4, 2025, we have been in existence for seven years. As of the end of December 2025, it was our honor to be able to help over 7000 animals in that period of time. In 2025 alone, we did over 1000 animals that came through our facility in various ways from surrenders, to abandonments, to neglect, to abuse, to you name it. We were able to help over 1000 animals last year, and we are on projection to do that again in 2026. I think today’s the 6th, and we have taken in 28 animals since the first of the year. 3IPage January6th, 2026, Page4 2. GENERAL PUBLIC COMMENT (Up to three-minute time limit per person) Cont... We have had to turn away over 30 animals in that time frame. What our services entail is not just adoptions of dogs and cats. We’ve done hedgehogs, fish, turtles, geese, goats, and the only thing I haven’t handled yet is a horse. But we have many facilities in town that can do that for me. It’s been our honor to be able to help the community in such fashion, and we have a low-cost spaying and neutering program, which has been phenomenal. We have been able to assist low-income people with spaying and neutering their animals to the degree of almost 300 last year alone. We have a program in which if you have an unwanted litter of kittens or puppies, if you turn in the entire litter to us, we will fix mom for free and turn her back to you. Because we know this starts to close this down, we want to be part of the solution, not part of the problem. In those seven years that we’ve been able to do this, we have encountered countless obstacles, and one of the obstaclesthatwe’re up againstis county regulation. Nye County is stilla rural community; however, what I’ve seen developed here is that we are developing a Clark County attitude. The regulations and obstructions that are being imposed on the rural community are extreme. For instance, I had a trailer on Bella Vista that was movable; it had banners on it that said we adopt cats, kittens, and puppies. It had pictures of kittens and puppies on it. I was forced to take that down. Andrea Robb-Grulli The trust that I had gave $489,000 to the seniors of Tonopah from Bruce Larson. You would imagine the donor with that much money would dress in a suit, drive a fancy car, and maybe smoke a cigar, but that was not Bruce Larson. Bruce never wore a suit but instead dressed in Levi’s and coveralls most of his life. His one luxury was his last vehicle, and he was proud that he drove it at 80 miles an hour everywhere. Life was never easy for Bruce. He was born I 00 years ago with a severe birth defect. He told me at one of our long conversations that his grandfather raised him for his first years because of his defect, and his mother was so traumatized. As a teenager, he was in a jalopy accident, and his face was caught between the fender and the tire, causing even more facial damage. But his facial damage didn’t define Bruce. Just out of high school, he entered UNR and studied to be an electrical engineer. He spent years as a very successful miner on his own properties. He subdivided 40 acres in Smoky Valley and established his five-acre homestead there. Over the years, he built several homes for himself. His last employment was as a special photographer at the Nevada test site. Bruce was my neighbor when I was 19, and we were friends until his death. He loved to talk about politics and the economy in Tonopah. When I moved to Reno, I would have an unexpected visit from Bruce that would end with dinner with my family. In 1985, Bruce came to me with tears in his eyes and asked me if I would take care of his mother if he should die before she did. His fears never materialized. In 1995, Bruce drew up his will with me as his trustee, and he also gave me his Power ofAttorney. Bruce spent his last days in a rest home in Sparks. It was difficult for him to accept the rules, and he was very unhappy. I was with him for the last hour of his life, and now I am giving the seniors of Tonopah his savings. This poor man, knowing they would be well spent by Timaree, helped to make life more enjoyable for the seniors of Tonopah. The money is to be spent entirely in Tonopah; in his will, he’s specifically stated that it was for Northern Nevada seniors. I have delivered the check to Timaree. GENERAL PUBLIC COMMENT (Up to three-minute time limit per person) Cont... $207,000 for the four vans and the one small bus, and I hope that the seniors of Tonopah enjoy it for many years to come. Linda Clark I am here to talk about the same thing I did the last time. When are we going to get a budget for the fairgrounds? If you are paying someone the amount of money we are, don’t you think they should get their you-know-what in gear and get some answers to us? It is not fair to the community; you owe us an explanation of all the millions of dollars you want to spend on this park. My request is that you get that stuff, and then you have an agenda hearing with the community for us to give our opinion, and then we get to vote on it. Because it’s not fair for 55,000 people from the town of Pahrump, for which this park was donated to, to have to rely on the five of you to give us an answer for the amount of money you want to spend. Beth Borysewich- Happy New Year, everybody. Let’s hope that this is a very active year and getting things done here in Nye County. I’m calling because there are so many questions that have been raised by residents this past year, and we don’t get answers. I don’t understand why we don’t get answers, but we don’t. One is how are we doing on the recovery of the 88,000 in room tax that we’ve lost? What actions are being taken against anybody? Is there any legal action that’s being taken? I’d like to get this taken care of because you know money is money, I don’t care if it’s $0.88 or 88,000. We need to know why we did not collect it and the functions of the people who were handling this. I’d also like to know why the accounting department uses an Excel spreadsheet to track this instead of some sort of computer program. Patricia Robb- I’m not really prepared for research; my mother passed away just before New Year’s, so I’ve been dealing with a lot there. You pretty much know everything I’ve already said, anyway. Alot of research has been done. I do wantto kind ofgo back over things because in the last meeting I did ask what you have done. You mentioned the water district committee, which is great. I am glad to hear it. I really hope to come up with a solution, perhaps a community well, in some of these areas. I don’t know what they’re going to come up with. I’m concerned about all of the properties involved by what happened decades ago and how it’s affecting our community and how it’s hurting those owners. I would like to ask about pilot areas. Have you ever considered designating a certain area as a pilot to test out these things that we’ve been talking about? The change from zoning from OU to VR was a fatal flaw. It totally made these lots unusable, it’s blocked them out, it’s selfish to leave it that way, and it’s unjustifiable. The Army Corps of Engineers. I’ve brought that up several times; they can help with infrastructure for sewer in areas where there is no sewer or not allowed to have septic. I don’t think anybody has ever really followed up with them or a congressman because every time I ask, I never hear anything about that. Once the zoning is corrected then the proper steps would be in place to ensure that adherence to international residential code for permanent tiny homes and approvals through MC EPA and NDEP as well as the water authority would all be part of the regulations within the zoning and we cannot say what the state will or will not since there has never been an application for anything such as that. GENERAL PUBLIC COMMENT (Up to three-minute time limit per person) Cont... that does not fight the aquifer, reality is sewer infrastructure, which the Army Corps of Engineers could help with external funding sources, areas where water already exists, but sewers do not. That will help some owners. So, I don’t have a whole lot to say this time. I would like to read what some of these owners have told me personally, without saying their names; we bought them in 1988, nothing has changed, looking forward to help getting this area developed. Michael David Garcia- I’m just doing a follow-up call. If y’all could send any kind of rule that you want. Specifically, I like to acknowledge our First Amendment fire, the 14th Amendment fire, and every county and every state’s parental rights. Why don’t we do some comparables of how long it takes for first responders when it comes to the traffic of unalienable rights? Do we need to bring up Captain Obvious? He was an asset for y’all. The system isn’t broken; it was working perfectly fine for y’all. We need to preserve the record, preserve the book. I like to acknowledge where would I be without God’s trust. Where would I be without God? From all these parents without children, all these children that had our parents’ traffic and probate court, all these attorneys and judges are on notice. Chevron is gone, we’ve got 44,000 Administrative Judges in robes wearing abuse, and y’all have nothing to say. What about civil liabilities? Can we talk about that, or would you prefer to talk about criminal responsibility, Mr. DA, Mr. Sheriff? Once I read that Nevada had the right to travel, a fundamental capital right that was before Terry versus Ohio. Another rule, another ordinance, another statute, that is not free from government regulation. Y’all need to break check yourself. You got paid constitutional wages, and y’all cookies up there are only one through ten, a bare minimum standard of the Bill of Rights. You do not grant any of our rights. They are not done through your concession. Every one of y’all are cowards, and you spit on the graves of our veterans, everything that they fought for y’all give it away through NGO through money. You sell the soul of this country. Do we really need to take care of civil accountability, or do you want to handle criminal accountability? Each and every one of y’all should be looking at the right image. How long does it take to respond? Is my connection broken? Can you hear me? Do you know who it is, who has original jurisdiction? Can you do due process? You are listening to your thoughts, act like it. Are you a field hand or are you a house hand? We don’t need to meet down at the river to get this straight. Civil liability or do you want criminal countability Mr. DA? How would you like to be served? Diane Southworth I hope everyone here had a good holiday, had a great time, and learned a lot about being compassionate and loving our Lord. I have a mantra that I use all the time, if helping people is wrong. I don’t want to be right, and I’ll stick with that. I am concerned that we’re not doing enough to help people in this community. We don’t even have a list of how many actual homeless people there are or how many people need help. When I hear about grants and how they’re just wasting money, I know for a fact that anytime someone gets a grant, they have to give back all of the information and tell them where every penny is spent, and that it cannot be abused, or they’ll never get another one. Also, if someone is in trouble and they’re trying to get better, and we help them through these grants, and they said the average cost for the year is about $18,000 sounds like a lot of money. Sounds to me like you’re better off trying to get some of these people off the streets. I have talked to some people who have gone through some of these programs, and they are so happy that they are on the straighter path and that they’re working and they’re able to pay their rent and they’re not having the problems that they were having. So, when you consider these programs, look at them from an overall view. I’ve lived in this country for 25 years, and I know what a compassionate, caring county this can be, and I think we need to get back to it. Thank you. Tammy Pittman I’d like to talk about zoning ordinances. There seems to be a sore lack of respect for people. Friday, my neighbors got notices, on Friday, when planning is closed, that they had to have responses by Tuesday for a piece of property that’s over 80 acres being rezoned in our neighborhood. So, one of my neighbors went to the planning department and asked for a copy of the plan that was submitted for the rezoning, and he was told oh we can’t give that to you until three days before the meeting, which was over 10 days away. Well, we’re very lucky that by accident something was not warned in the paper, so therefore that meeting is now in February, but still, they won’t hand out what the plan is so that we can even make knowledgeable responses. How can we respond to something that we don’t know what it is? It’s unacceptable that citizens’ feedback cannot be worth a nickel if you don’t have solid information. So really what you’re telling us is you don’t care what we say. Also, about Sober Homiez, I helped run a food pantry, and it has very finite resources, as in money. We’re seeing a 30% increase in people coming to the food pantry. Our cupboards are bare as of yesterday; we serve 98 people. Sixty is usually our normal, so we’re seeing way more. We can’t afford to have people come from another county, come here and support them; we need to support our people. Tina Bond-Kuglin One of the clear signs of poor leadership is when the person who speaks up becomes the problem. When an employee, volunteer, concerned citizens, or community leader raises concerns about inappropriate, unsafe, and unprofessional behavior that is enabled as difficult, negative, or the issue, leadership has failed. That caused concern; the focus shifts to silencing the messenger. This is dangerous. It discourages accountability, reinforces this toxic behavior, and teaches teams that speaking up comes at a cost. Over time, people stopped reporting issues, trust erodes and dysfunction becomes normalized. Strong leaders don’t punish honestly; they investigate concerns, separate the person from the problem, and address the behavior at the root. Healthy cultures are built when employees, volunteers, citizens, and community leaders feel safe to speak out without fear of retaliation. Organizations get this right now, just avoid harm, engage strong performance when voices are valued instead of dismissed, and everyone wins. I’ve spoken at many of these meetings, and I wear those labels, negative, difficult, and issues as a badge of honor. I read this statement after an incident of retaliation that happened on Friday, January 2nd, at Lake View Golf Course, where I was ambushed when my group of six was leaving. Southwestern Wilds, Victoria, and Stephen Balint, Vanessa, and Jeff Fernandez waited behind the front door as I was leaving, verbally assaulting me and my group. They followed us to our vehicle, and yes, I have a few choice words for the worst little wh*rehouse in Pahrump. Jeff Fernandez took it even further, telling me he was going to beat my as* and shoot me where I stand. He 7Page January6th, 2026, Page8 2. GENERAL PUBLIC COMMENT (Up to three-minute time limit per person) Cont... even reached into the small of his back for a weapon. Being a resident of Pahrump and in fear for my life, I have no one to call for help, you see the poor leadership I am talking about is Nye County. Both the BOCC and the Sheriff’s Department support this group, and they continue to allow the bad behavior to affect law-abiding citizens. This group has stolen horse trailers from elderly women, trespass on private property and stole a horse, captured and killed an injured horse wild horse that BLM told them to leave alone, they even duked the Silver Tappers out of 9k, they got away with not having a conditional use permit like other rescues, they used the Sheriff’s Office as an escort service and their database to run background checks on people they don’t like. Enough is enough. We need strong leadership that’s not corrupt or in someone’s pocket. The reason I’m not there today is that I’m in fear for my life after having that man pull a gun on me. If anyone is ever feeling threatened, they should call the police. Marianne Hollis I just want to reaffirm Miss Pittman’s concern about the limited time that the public has to research and make a credible argument about an agenda item when they come up to the mic. I had an issue on Friday, after the agenda came out on Thursday, and the whole county is shut down. So, I lost a day there, then of course I lost the weekend. Unfortunately, I had to bother the commissioner, and I want to publicly acknowledge that Commissioner Boskovich supported transparency and increased the backup information for the agenda item, which I was concerned about. Which I came to the courthouse about, as it happened, I ran into Mr. Koenig. But why does it have to happen like that? The county is closing down on Friday and just leaving Monday for us to scramble for facts, it just it’s not productive, it’s frustrating, but I will always make the effort as Miss Pittman does to find out the answers and to do more research so that we don’t come up here and look like we don’t know what we’re talking about. I want to thank you, Mr. Boskovich, for making it public, but maybe something can be done about allowing the public to have more time to research the backup, and in this case, getting in more backup, which was great. So hopefully, there can be something done about that. 40 38 Jodi Reddington I am speaking today to again requestthatthis board add to the agenda for the rezoning of Village Residential lots. It is time to review land usability and infrastructure solutions to update the zoning on VR lots to allow for responsible off-grid living. You’ve heard an abundance of solutions over the past year that will implement a positive path forward that alleviates the requirement of millions in new Public Utilities and restores the landowners’ right to use their land for the purpose intended. The United States is a country of progress, innovation, and opportunity. This board is ignoring this issue, yet allowing the county to continue to collect property taxes and reselling the loss to options that are in default is a complete contradiction to your responsibility in the role you serve. Change will happen because the current situation is not sustainable or good for anyone. So why prolong the inevitable? Establish a sound and viable plan now; you are paralyzing progress and development for the present and future. I hope you seriously 8Page January6th, 2026, Page9 2. Thank you for this consideration and thank you for your time. Darryl Lackey I’m going to talk about things I’m wondering. The other day I’m at my friend’s house, and he goes, you know, the commissioner meetings we be able to sit here in the living room and watch you, go up there and talk and see the stuff you say. But we can’t do that anymore. I guess some years ago, that disappeared from TV. So that’s one of the things I’m wondering about, how come that’s not on TV for people that don’t want to come down here but want to see what’s going. Oddly enough, they blame me for it and the things I say. They’re blaming me for you guys hiding and not being on TV anymore. My friends are blaming me for it. So anyway, let’s wonder about something else, the last speaker. It closed down on Friday, so now there’s a four-day work week for the county people. So, did their pay drop 1/5? Oh no, the pay stayed the same, but now they get three-day weekends, every weekend a three-day weekend, except for the holidays, now they get a four-day weekend. That’s one of the things I’m wondering. I’m wondering about lots of stuff, 3 minutes okay, 3 minutes. I wonder about things like I wonder about what if you were to pick a team of people that are actually effective people, not people that ride off the efforts of others like yourselves, but effective people that pull things off and you told these people together and said hey let’s do something about these zombie lots, the homeless problem, all that sort of thing. I bet that it could be wrapped up simply. I bet it could, but you’d have to get effective people, not people who ride on the efforts of others, not people who do less and less every time you look at them. But people do more and more. I wondered about lots of stuff every day, but it just goes by. I drive through town, and I see people walking across the field with a tarp and a sleeping bag under their arm, and that’s sad. But you don’t understand sadness, because you’re selfish, you just think about yourselves. I wonder all the time about things. I’m wondering how I can bring this out differently, to maybe cause an effect. I’ll just keep wondering. Helene Williams I’d like to speak on item number 17. Mr. Bayne, thank you for the opportunity to be able to speak to that right now this morning. I’d like the community and the people in this room to know, time and time again over the last 10 years, I’ve set the meeting after meeting and watched hundreds of thousands of dollars donated in the community without any priority for anything specific. To be accused of what we were accused of in the letter in the agenda item is an embarrassment as a resident, and I’m angry because that letter made a statement that is not true. I would recommend that the person who made that statement buy a full-page ad in the newspaper and apologize to the people in Nye County. We, the people, have put the commissioners on a task to do the right thing for animals and children, and we do that constantly here, and it’s I’m sorry, but it’s an absolute pure embarrassment to read that article and that agenda item. It was disgusting, thank you. Vicky Balint I’m actually going to speak on two different subjects. The first one is, I would like to make a public announcement regarding New Hope. We’ll be having an additional 9IPage January 6th, 2026, Page 10 2. GENERAL PUBLIC COMMENT (Up to three-minute time limit per person) Cont... food bank on January 24th from 8:30 to 12:30. This is going to be somewhat of a special outreach effort from Three Square. So, we invite everybody to come participate, and to find out what the qualifiers are, you can contact New Hope directly. The second item is in regard to an earlier public comment made by an individual. That, since April, which was the one and only time I met her, she was revoked from an event that we were offering under Southwestern Wilds. The reason why she was revoked was due to her negative, slanderous, and libelous comments to other vendors who were participating in this event. This has continued, her attacks on me personally, my family, and our organization for the last six months. As to the incident that happened on Friday, this individual was the aggressor, and we have filed a TPO. I have turned the other cheek multiple times and I apologize for having an issue like this brought before the commissioners with everything that you all have to be dealing with. This is a personal vendetta for somebody that is extremely, I have to be careful how I handle this obvious for legal issues, that this individual has a vendetta against Nye County and due to the probably the relationships that I have and my husband and I have built over the last 30 years between Rotary Chamber, Elks and trying to make this community better and stronger in the volunteer base. This individual has no idea what it has taken. Our reputation is extremely important, and our level of integrity with which we proceed in our day-to-day lives and our business is of utmost importance. I will be dealing with this directly. I am done with the accusations and the lies. Again, I apologize that this has to come to this type of platform when it shouldn’t. Individuals should not, it’s not okay to lie, to fabricate, to slander others, because they have good, solid business relationships with our county government, whether it be state or federal. This individual has to be stopped. So again, I have decided notto turn the other cheek anymore. Thank you. Molly Valdez I hope everyone had a wonderful holiday. It’s such a nice time to kick back and relax and watch movies with family and friends. That being said, I watched a couple of movies that I wanted to recommend to all of you, which seem to have some similarities to these zombie lot sites, or maybe we should call them dirt lots. So, the two movies are Erin Brockovich classic, and Rango. I don’t know anyone else who is out here actively looking for solutions, but we will find them. I feel a little like Erin Brockovich, and it’s going to be a sweet victory when we find that compromise and solutions so that we can use these lots that we’ve purchased. The other movie is Rango, it’s animated, so you could watch it with your younger family, and I was just going to read a synopsis of the key point that I kind of found interesting and saw a parallel to. Rango is a chameleon with a flair for the dramatic. He lives a sheltered life in a terrarium until it falls out of a car, leaving him stranded in the Mojave Desert. He meets an armadillo named Roadkill, and after a series of misadventures, finds his way through a town of dirt, a community of desert animals struggling with drought. Shall we say lack thereof infrastructure, sewer, and water to survive, and impress the town folk, Rango pretends to be a tough seasoned outlaw, taking the name Rango from a bottle of Durango tequila. His supposed bravery and accidental killing of a hawk leave the town appointing him Sheriff, tasking him with solving the mystery of the missing water supply. Rango discovers the waters being controlled by the corrupt Mayor tortoise and is outlawed gang being led by Rattlesnake s Jake, who are stealing it for their own gain. After being exposed to fraud, Rango 1OPage January 6th, 2026, Page11 2. GENERAL PUBLIC COMMENT (Up to three-minute time limit per person) Cont... encounters the mythical spirit of the West. The challenge is to find his own story and identity. Rango uses his wit with the help of the townspeople and the symbolic showdown with Jake to expose the mayor, restore the water, and finally become the hero he pretended to be, learning that true heroism comes from actions and not just stories. The end is the townspeople celebrating, their water shooting everywhere, and everybody’s happy. I am just looking forward to that collaboration where we can have utilities for all. Thank you. 3. I want to give some clarification on a previous comment made by Ms. Kuglin. Yes, I received the phone call on my work phone, I believe it was on Friday evening, from Mr. Balint, saying that there was an incident that took place. Many people in this room, I think, probably have either my work phone number or my personal phone number, and I’ve received calls from the chair and from the county manager, commissioners, and other people in the room. I don’t give any personal preferential treatment to anyone. I think that more often than not, if I receive a call for assistance from someone, I tell that person come in on Monday and file a report, call dispatch, and we’ll send the unit, whatever. So, no special treatment was given to Ms. Balint or Mr. Balint. We did receive a comment from Ms. Kuglin several months ago that an individual and our department conducted a background check, I believe, on her. We investigated that the alleged perpetrator does not have criminal access to our computer system, and he does not have Spillman or NCIC access. We did an offline search on Ms. Kuglin to see if anything had been queried on her name, and nothing was queried. We disproved that allegation, and since she wants to air dirty laundry in a public forum, I’ll respond to it that way, thank you. Under Sheriff Fowles I just wanted to update everybody, this morning we saw off 7-new recruits to the Nevada Post Academy in Carson City. Our staffing is full; on paper, we have no more open positions to fill. We currently have 1 .5 police officers per thousand residents in Nye County. We know that the County and the commission support public safety, and we are looking forward to working closely with the County in the future to increase our staffing numbers. Thank you. had asked about follow-up. Mr. Small and Ms. Small had sent in videos and photos ofthese dogs that are constantly running in their neighborhood, and

also has those videos and the emails. The unfortunate part of the video that shows their animals were brutally attacked is that identifying those dogs were the ones that live at that particular address is very difficult. The owners of the dogs that were running at large; we do have accurate evidence and have served running at large 11 Page January6th, 2026, Page12 3. CommissionerlManaqer Comments Cont... citations, and an animal attack on another station. But as far as justice for the death and the brutal murder of his animals, the video is just not that clear, and that’s the unfortunate part about this situation. I will say that I have requested a meeting as soon as the DA’s office has available time to talk about how we can hold people accountable. We are receiving an incredible number of dogs running at large. It is just more than we’ve ever had before; it is truly getting out of hand. It is over the top, and it is getting out of control, so I have requested a meeting with the DA to learn if our animal control officers are doing something incorrectly, not to see these citations through, and if there’s something that we could be doing more or doing better so that we can hold these people accountable. Knowledge is the battle, and I want to work with the DA to ensure that we are doing things the way they need them done so that we can make sure that these people are held accountable for their actions or their animals’ actions. And there are other questions too, I want to speak with them. There seems to be an idea that if I just avoid it, then I don’t have to deal with it, but that can’t be the case. Avoidance is not going to be the answer. I’m not going to accept that as the answer, and that is another question I want to speak with the DA about, and how we can address it. So, the community knows, if they are struggling, as I drive by and we all drive by, we see fences, we see gates that are not up to standard to keep an animal contained. We have resources, and we have volunteers and people and organizations within this community that are willing to help fix those. So just ask, call me, my numbers are out there, I will help connect you with the resources to get you the assistance and the hands that you need. I have some Incredible stats. We are in a new year. In 2025, we saw over 1600 intakes, 1609 were the number of animals that we took into the Nye CountyAnimal Shelter. We saw 819 placements, so we’re at a 50%, which is pretty good because those intakes are also inclusive of protective custody; they’re inclusive of confiscation, so other things other than just animals running at large, although I will say the majority were strays. But we were able to get out quite a few into loving homes, which was amazing. We also renewed our no-kill status for the second year in a row. We have a 94% save rate, which is incredible. We’re very proud of that number. I have to publicly thank the team, the community ofvolunteers, our veterinarians, and everybody who goes into making these numbers possible, because it truly takes a village and we have a pretty incredible village here. So, I have to say thank you to everybody. We also saw in 2015 the creation of our volunteer program. We saw the beginnings of our backyard remodel, which we’re hoping to finish up this month. Again, this wouldn’t be possible without the community we have dogs being walked, we have dogs outside, we have created a whole playroom and an interaction room within the shelter, so that we can create some play groups. I have to thank our Nye County Departments for allowing our doggy day out. Once a month, every department rotates and takes a dog in for a day; we call them pawsistance. It’s not only great for the animals, but I think it’s great for the people as well. Really exciting things, and we’re going to take that momentum into 2026. You’ll see some exciting things this year as well. A couple of reminders or heads up for the community, we are seeing a coyote increase within our town, they are acting not like regular coyotes, the way they run in packs, they’re much larger, the way they break off into smaller groups, so just a reminder please for those who have animals keep them safe keep them inside especially smaller animals. I am working with the Department of Wildlife, and we’ve had a lot of discussions on how we can help 12 I Pa g e January6th, 2026, Page13 3. CommissionerlManager Comments Cont... keep these under control, but I just want to make sure that people are aware that we are seeing that increase. We have a bobcat that is active in Wilson Ranch and two mountain lions that are active, one in the south and one in the northwest. We can take measures to keep everybody safe.

I would like to try to clear up some information that’s on the Internet that is false. It tends to blame the software that we use to do the whole restructuring of what salaries are in Nye County. The software was purchased in 2010 and has been used every year since 2010. There has never been a problem with that software. One problem with software, and all software has this problem, is that if you put garbage in, you get garbage out. We identified the problem as an employee putting in the wrong numbers. It generated wrong numbers at the other end. It’s not the software’s problem. I just wanted the whole community to know that we spent a lot of money in 2010, and it works just fine.

With this many people in chambers here in Tonopah and Pahrump, I would like to acknowledge Bruce Larson and Ace & Andrea GruIli, who were here, and they had to go back to the Reno area. Their item, which I didn’t realize in the public comment, would be extended to them this morning. Their item is #31 and they , weren’t able to stay, but we certainly appreciate their efforts and their huge and significant donation to the county, for the seniors especially in the northern part of Nye County. I get that, but I did want to point out specifically for Ms. Pittman that item that was continued for the Regional Planning Commission I was contacted by Mr. O’Brien who I went to and discussed it, followed up with Director Osborne, the 80 acres is going to be VR 20, and so, there had been a mistake in the way that was portrayed. You’ll be a lot happier with that agenda item when it comes forward. There’s no commercial within the body, that I can see. But let’s keep an eye on it, so you should be happy with that. Taking care of our biggest issues throughout Nye County is mostly roads and how they’ve been neglected over the years. Normally, what keeps us from increasing speeds is if you have side streets with no acceleration lanes, and if a car is going at a high rate of speed, then that car that just merged onto that one direction may have difficulties trying to catch up with speed. But we could certainly look into it. I will discuss it with our traffic operations team and do the best we can to help.

The Congressional District awarded the monies; it’s been 40 years that Duck Water has been screaming at the different commissions, and we change, we change every 4 years, 8 years, 12 years, and so it’s been a long time. When you mention it’s how the children go to school, it’s the only way they go to school, which is Poke Summit Road. So, I appreciate the cooperation. There’s the snow belt that we are responsible for plowing. White Pine is supposed to be responsible for plowing that road. Eureka does a greatjob of plowing its site once it hits that county line. I appreciate you saying that there’s cooperation and collaboration between the county and NDOT working together. I know that they’ll get into the fine details of releasing the monies because it’s an expensive task and endeavor, and we need this taken care of. Well, there’s a lot of questions. Darren was the one who acquired this grant. I asked him if he I sent him over the grant, and I said, “Would you take a look at this?” And he said, “You know what? I have a program already built for a different grant, but this, I could just slide this in and rewrite this a little bit. It won’t take me over an hour, maybe 2, to get her submitted.” I said, “You’re kidding.” You did. How much of that money did you get in the long run? Darren Tuck So originally, thisARPAgrantwas for 3.8 million. Itturned outthatthe State pulled back, due to legislative action. They pulled back 2.6 of that. They left us with 1.2 million. So, this is part of that project.

In 2022, we had it in our CIP to buy that, and we don’t normally go out to bid for such oddities. The need to proceed was accelerated due to an accident blah blah blah. That says it all right there. . . . ,“ DA Kunzi I just wanted to comment that, with regard to some of the public comment, that we are taking every effort to work on getting us reimbursed for the cause of damage that was done to the truck. So that is not being ignored; it is being pursued, and we are certainly working with Admin to make sure that we can get reimbursed for whatever we can get from that individual insurance company. I know a lot of good attorneys in my office, so we’ve been handling a lot of litigation in-house, so we don’t have to go outside. So, yes, we are working on this.

And so, if we didn’t have the food and facilities and the staff, we wouldn’t need these vehicles but we do, and so they overlap. And it’s not just for Tonopah. It’s for all of Nye County and surrounding communities that rely on us for the food and the transit services especially for their — medical appointments because, as we all full know, we don’t have adequate medical care, a facility, here in this area. So, this is just so welcomed by Andrea Ms. Robb-Grulli — — family, and being the executrix of the estate and helping Bruce Larson with his wishes. Here’s a perfect example of a Nye County long-term Nye County resident giving back — — to the community but not just this community; it’s really for the county. And we certainly appreciate Timaree everything that you do and that you worked with Andrea specifically. And I hope that we’re able to acknowledge, somehow, some way, Andrea in doing this. Those positions at the time they were frozen at the discretion of the County Manger they could be reallocated to us. We have no positions that are not frozen but have applicants and nowhere to put them. Any applicants we have right now are either going to have to turn them away or let them go to other agencies. Since our population is increasing our manpower needs to increase so we’re asking that six positions be unfrozen. One of those six positions is a detention supervisor Sergeant we currently have 4 shifts and three sergeants, so we have an acting Sergeant on one shift. That is just not conducive there needs to be oversight, supervision and somebody of a higher level of authority. Acting positions don’t work well if you were an acting supervisor once you’re done being the acting supervisor you got to go back and work with those people side by side. We’re asking for six positions so that way we can continue accepting applications, placing people in jobs and increasing our staffing. I’ve never seen it were we have to turn people away and I don’t want to do that. We’ve been scraping all over the country trying to get people to apply for our jobs, it’s been argued and it’s been brought up many times that we had empty positions that were vacant for long periods of time. For Possible Action — Discussion and deliberation to approve, amend Cont... positions were frozen as a result of the two freezes that took place. One freeze because the second freeze incidentally was exempting law enforcement and fire, but first freeze didn’t. How about we just change that ruling and exempt sheriff and fire again.

What you just explained if we were to move forward with unfreezing these six positions, we’re more applicants than positions open. I believe this is a good problem to have but we have to act on it fast otherwise we won’t have that flexibility at our fingertips. By unfreezing these six positions we still have 9 remaining existing positions that were frozen originally. I’m in favor of unfreezing these six and once these are filled that you come back and we unfreeze the others if necessary.

The Sheriffs Office budget is running overextending at this point with these six positions depending on the timing of when these positions are filled it will add $406,000 excluding overtime. That does not include any training or any other expenses that will be needed. If these are new positions or new equipment can be purchased under PSST. Keep in mind the audit needs to be finished.

I don’t understand why an audit would have anything to do with the PSST funding because the PSST is dedicated money to the Sheriffs Office for these stated purposes. The fact that we are a little bit above budget as you stated is that considering the fiscal error that was made by the previous comptroller and not accounting for our benefits and wages. Have we already fixed that or are we going to fix that because I still have not heard of results on that. We are $1 000,000 over budget because of that accounting error which was not our fault.

I realize it’s not your fault but it’s money just like you got so much money in the checkbook that you are paying. Ifwe’re $1,000,000 short somethings got to give somewhere. They are looking at ways to recover or not recover but save money elsewhere to cover the costs of that coverage for sure.

These Sergeant positions you would you promote someone from within for those so that would leave an opening in that area. The end of the fiscal year is coming up pretty soon and you don’t have people right now for these positions that they leave behind. If we opened it up today, you’d have 6 open positions because you’re promoting a deputy to a Sergeant how long does it typically take to get someone once you say we have positions open to fill that position. 42 I P a g e January6th, 2026, Page43 24. If we post it now, we could have 6 credible applicants tomorrow we could have to wait four months there’s just no telling. Nick has them for four months and then after he’s done with the background that person goes to the next available Academy. If it was patrol it would be the July Academy, if it’s detention we can put them in place on the same day. They become on the payroll the day they start the Academy or they start work. We could hire a detention deputy put them to work, put them in field training and when we have 3 or 4 to hold an Academy we hold the Academy in house for detention.

I don’t know the numbers I don’t know at what point we have what faith we have in any numbers around here honestly just seems to always have problems with numbers. There’s that problem but we also have crime problem around here and some people don’t seem to be concerned. I’m very concerned and I feel as ifthere’s three paths one we deny everything the second would be to approve any position that would not be funded until July and the third would be to just approve all the positions. I only suggest that in the event that there is anyone up here that’s concerned about this because if you go with option two you wouldn’t draw any real money until the next fiscal quarter. If you promoted a deputy to a Sergeant, there’s whatever that difference, but we still are leaving behind an open space that’s not going to be filled as a deputy until the Academy lE the next fiscal year. I’m inclined to approve this because I don’t think you’re going to get any real money until spent by this board until the next fiscal year. Sherriff McGill You are correct if we promote a Sergeant in detention whenever that promotion takes effect is going to be the increase in his pay. lfwe hire 2 detention deputies and put them to work right away that would be two salaries and benefits that are going to be increasing immediately. The majority of these six are not going to actually hit your pocketbook until July. I would caution that accepting applications without guaranteed job positions available is going to discourage some applicants because they’re going to go somewhere else. If you make this effective in the next fiscal year but still effective now it will get people by the next fiscal year.

I’m supportive of fundraising all the money right now but I’m just saying in the event that someone is struggling with that up here I wanted to offer that as an option.

I think that we’re safe to take somewhat of a risk of accepting applications because they’re going to apply with us like they’re also going to apply with these other agencies and nobody’s going to call them tomorrow unless they have the approval and they have these open positions. I’m in favor of this and of course this will help with next year’s budget. This will help with streamlining and diminishing somewhat of the overtime issue aspect of your budget as well. Sherriff McGill We have applications, but I just want to make sure that you understand that for every two applicants you might get 1 qualified applicant maybe even 3 to one. I’m very happy with the people and ready to go but again we need to keep up with our population. I do want to remind you of what undersheriff brought up earlier the population ratio we are at I .5 officers per thousand residents we should be at 2.5 per thousand.

I think that is one of the variables and this is as far as the hiring freeze; I believe it should continue into the next fiscal year if for some reason we have to choose between office clerks or something and peace officers. I would if it’s implied or if it’s direct, I think that we should consider a continuation of hiring freeze until such time as we can provide people with a safe place to live with adequate peace officers. Corey Fowles I just want to clarify a couple of things the Sheriff’s Office is not over budget for the year as of November 30th, we’ve used 37% of our general fund surplus supplies and payroll benefits and the jail has used 43%. As of November 30th, it’s significantly underage 39.22% of our total annual budget and as of November we are 50% into the year. So, for five months it is at 41 .66% so under budget by that 4%. I wanted to clarify that the Sherriff’s office is not over budget like the comptroller said. We do have 3 applicants in backgrounds with no open positions, one of which admittedly probably only one will be viable, there’s also a dispatcher that is considering becoming a patrol deputy again. Applicants roll in continuously and as they do some make it some don’t.

I think the most interesting thing that came out of this was that you told us that it takes like four months to get the background and you’re right there into another fiscal year. You’ve got 2 Sergeant positions according to this list of 6 that would be filled right away. It’s going to cost you about $70,000 for those two positions have that since you’re halfway through the fiscal year so that’s doable as far as our $1,000,000 deficit. That’s the one thing I do see that drives me closer to believing this should be done because it’s going to take us that long to get them background and trained. We do have a gap and a deficit with our overall budget and that’s my concern. Even if the sheriff comes in 5% under or is on budget, we still have other areas that were underfunded in general. We are waiting for our audit to finish so that we can send our audited financial statements 2D tax to be accepted. Once the 2D tax is accepted our audited financial statements we will be able to roll our year end balances and then start on our next budget year. Sherriff McGill I want to let you all know we had a dispatcher resign 2 weeks ago and we had another one this morning that is going to the Nevada Highway Patrol because we don’t have an in-house patrol Academy. It costs us a lot less to go to Carson City and incentives don’t work and the day after they quit it happens.

7 cadets on the way to The Academy this morning this is great movement. Out of those 7 cadets when they graduate and they are street worthy you have under the proposal for the six positions three of those will be for the north if this doesn’t move forward or how many of those 7 will potentially be assigned to the north. Sherriff McGill Although we have 7 starting the Academy a general rule of thumb is 50 to 60% pass so figure we’re going to get 4 out of that. In order to get the applicants, we have started advertising for Tonopah deputy for Round Mountain deputy Pahrump deputy, each of these seven are Pah rump applicants. We are full in Tonopah in the north area with the exception of Round Mountain that’s a difficult position to fill. We’ve got 3 deputies for Beatty and Armargosa plus a Sergeant. We do have one applicant who is slated to go 46 I P a g e January6th, 2026, Page47 24. One of those 7 is going to Armargosa and the rest are coming to Pahrump. Provided they make it through the Academy for four months and then six months of field training. I want to reiterate to you personally Tonopah is staffed better than it’s been in a decade.

I’m not referring just to Tonopah it’s you have in writing here the allotment the compendium for Tonopah, Round Mountain and Beatty. I was honing in on those areas knowing of the staffing levels. When we say the north we’re not just talking about Tonopah and Round Mountain we have other outlying areas that need law enforcement and first responders. I know that the Tonopah takes the burden and they are doing the patrolling and it’s a day shift just driving around and exposing themselves and we appreciate that. These 7 while they’re in Academy are paid so this will impact on our budget. Do we have money for the seven that are in the Academy, we’re not going to take it away, we’re going to have to find that money, but can we afford that money. Those people that are in the Academy now are budgeted positions.

No expenses that have come through with them so those are going to be 7 increases in positions that are going to be charged to your budget your expenses going forward. That’s a higher expense than your department right now so it’s going to increase by the seven. They were budgeted but there’s no expenses that have been coming through yet so now expenses are going to go up. I know overall we are in a deficit which means now I have more positions that are going to add to my deficit. The sheriff is part ofthe general fund.

Commissioner Strickland

Well of course his budget was set with these positions in mind. They’re really bad here, you’ll see that they’ll spend a whole bunch when the budget first comes out as all the departments do and it’s really hard to watch. We need to get at that. Sherriff McGill If we need to buy 25,000 realms of 223 ammunition we know we have to because we got to send people the academies and so we buy in bulk when we can.

We are below our national standard here which I believe is 2.5 officers per thousand residents our ratios is I .5 officers. Safety is concerned because these will not affect the current year budget only for the next fiscal year and because we could like this fiscal year freeze other positions. I would like to motion to unfreeze the Beatty deputy, Round Mountain deputy and the Pahrump deputy and the other Pahrump deputy because these positions will not be funded from this budget they would be funded from the next fiscal year budget. We would have to find a way and if that means freezing other positions, I’m fine with that because we’re doing that now. The Sergeant positions I have a feeling that’s not going to have the support. I spoke with the attorney for the developer in the Winery area and some people were confused or I think there was some intentional confusion so let’s clear that up. County manager tells me when we go through the process of development like the one in the Winery there’s a development of a bunch of big parcels. I’m told they’re looking for single family homes, no apartments and to get their comments in writing. What does that mean to get your comments in writing by acts of the day. Because it’s confusion on public comment and we have different kinds of public comments and something went out that said get this in writing by this date. Manager Waggoner The public notices do give you a period to submit written comments if you want. If somebody submits a written comment even on the morning of the meeting, we will forward it to the commissioners. Yes, it’s a deadline because we have to do that for the NRS, but we will accept comments and then also it’s a notice that they can attend the meeting and make comment in person. Those notices go out for a zone change will notice the meeting date for the Planning Commission and then it’ll also notice the date that’s going to be in but there but nothing for a regular board of county commissioners for written comment. If they want to submit a written comment even between the time it was in front of the Planning Commission before it goes to the board of county commissioners, we will still update the backup.

We have e-mail so no one’s going to turn away your comment if you e-mail that, I just want people to understand that you e-mail me I’m going to look at your comment. It is kind of funny because most people who go up and say you know you guys aren’t listening, I’ve emailed back and forth with that person about a dozen times. I understand that’s the key to that the game but just to make it clear if someone emails obviously, they’ll reach us, if someone drops off a comment that will be distributed here. We’ve got obviously that the notice we think they can still call into the meeting they could still show up at the meeting. I just want to make it clear that that’s what it is in case there is genuine confusion over it but there is that ability to do so. This particular development is just like my understanding I have been in real estate for 30 years I still don’t have this part that I don’t understand as well as others. The zone change comes first so they’re looking for something called special zoning, so they don’t have to worry about lot sizes I’m told by the developers’ attorney. Commissioner/Manager Comments Cont... this body approves it; its still not approved as a project so they can’t just go, we’re going to put a casino there. I know there will be a lot of people who sometimes I think they’re going to fight with somewhere and that happens all the time around here. They are looking for zoning, they’re saying they want residential and the reason why they don’t want to keep zoning is because they don’t know what the lot sizes are. I’ve been on record and I don’t like tiny lot sizes because it puts a burden on our fire, that’s a discussion that would happen here at a later date. For this particular development there’s a February meeting for the Planning board and probably March with this board. After those two meetings then there will be a discussion on what they’re going to put there. Then we could say we only want to see single family residentials there we don’t want to see a gas station or something like that. That would be a discussion for a later time am I correct? Manager Waggoner That is correct that is step one it will give them what the information that are going to need and then begin the mapping process. If they go under a certain size lot under 20,000 square foot lot, it will trigger the requirement for development agreement.

I just want to reiterate that specific development I heard from the developer’s attorney they are planning residential, so they do not have any apartments or commercial planned. They are looking for a zoning change we will have a chance to look at it and say if it is safe and that discussion comes after.

I received a text from the public and I am not going to say who it Is from, but I am going to read it. It’s hard for the public to see the county exerting energy, time and money into worrying about OHP tracks and not prioritizing public safety that’s the way it comes off public perception.

I’m absorbing what the commissioner just read. There are different aspects ofthe country, safety is I and outside entertainment is another. You can’t stay confined to our homes and worrying about 1 aspect of living in the county. I’m a little surprised that but that’s their opinion and that’s my response to whoever wrote that. I’m going to address 2 of the callers one of the callers sounds like the speeches that we get is a home role-playing session regarding past shameful behavior at the school. We have to listen to that but it’s role-playing and that’s all that is. As for purchasing flags from the Dollar General and I absolutely agree 250th anniversary for our freedom here in the best country in the world by far. We’re also going to be celebrating the 150th anniversary in Belmont, our second county seat. I’ll caution you please don’t buy Dollar General flags American flags they’re made in China. Always buy American flags that is part of the etiquette. Marianne Hollis oftentimes has valuable information for the public for us, coming to these meetings she’s absolutely right and we must follow the etiquette.
