There were some things that I would like to. point out that might help with the general public. I'm not sure I'd like to, I would appreciate the DA when the opportunity is warranted to him to talk to Mr. Winterhawk about his comments please. But for me for now, there was a question in regards to when the regional water study would be done and I did get a comment, thank you very much Mr. Dan Wink's manager of the Nye County Water District Governing Board, he was. board. District, sorry, he did respond. He said that Desert Research Institute should be done with Basin 162 model update before June 2027. It did take more time than they anticipated, but their Nye County Water District Governing Board has been working on that, and that model's actual readings from wells that have been monitored for years. The other thing that I'm disappointed in as far as a further study is that the state engineer was granted money from DWR, Division of Water Resources, was granted money to do a thorough look at the complete state and every basin and they have not got here. So it's disappointing and so we wait for DWR to do that. That is all I had and thank you.

Orchard Soak Ridge is no longer in business. There is not a plant on site. It's been verified by the state. It's been verified by Nye County Code Enforcement. Last time they visited the property was on May 21st. The state was out there on May 19th and watched the destruction of what was left and observed them, you know, they had gotten permission from the state to move some of the product to another facility somewhere in Nevada. I don't know where. It's not here in Pahrump. And then um the other thing I wanted to uh there was a comment made about selective enforcement and

You could drive around or there was an offer to drive around code compliance and show them 100 properties worse off, blah, blah, blah. I mean, I could drive down Basin and show you 100 properties that would be a typical code compliance case. But code compliance does not do selective enforcement. They only respond to complaints that are made. No, they don't, Dwight. But thank you. I've worked there a little bit, like eight years. Anyway, they do not do selective enforcement. They only respond to complaints once they are turned in. So anybody who has 100 properties they feel are in bad shape, turn them in.

Second thing is the recycle location. Walmart did cease allowing the CNS to put the recycle bins there because they got some construction projects going on. I've been working with CNS to provide them a location on actually town property. It's going to be, which should be in operation here very soon. We're just working out the property use agreement so we know who's liable for what. But it is going to be located right next to the Tourism Office. In between the Tourism Office, there's a dirt lot there. We're going to throw down some grindings or something to cut down the dust.

Morning, Sheriff Joe McGill. A few things. First of all, when you mentioned the recycle at Walmart, when I was driving home from work last night, I noticed a large pile of debris right in the corner of the parking lot where the containers used to sit. Unfortunately, if you are caught doing that, that's going to be a littering citation. And that is not cheap, yeah. So do not drop off your stuff where the recycling used to be. Secondly, somebody, I wanted to respond, somebody asked in the public comment if an investigation was being undertaken in reference to the recent death at the jail. Absolutely 100% yes, an investigation is ongoing. And the third thing I wanted to bring up was I'm not sure if the commissioners are aware, but we got our budget numbers over the last couple of weeks, and it ain't pretty. Our jail budget is $343,000 roughly. However, our medical contract for the jail is $1.4 million. So we're all, and that does not

Good morning Commissioner Scott Lewis, Town of Prump Fire Chief, L-E-W-I-S. I hold in my hand what was the culprit for igniting a house fire in Mountain Falls two Fridays ago. This was a witness ignition source where it said some household furniture was extended to the interior of the dwelling. Thank goodness the occupant was right in the immediate area was uninjured.

was able to call 9-1-1 and take all the necessary steps to ensure their safety as well but I want to remind our public to please be super careful this is a multi line battery pack it does not plug into a wall outlet it is simply freestanding and you charge it the same way you would charge your other household appliances but within seconds this particular device exploded it ignited a sectional couch that which then extended And then to the other areas of the. the living room so if anybody would like to see it we have it up here available and if there's any questions about it we're simply here to answer them as well two other things real quick we are vigorously enforcing with the sheriff's office unauthorized control burns and there are citations being issued unless there's proof that it was unintentional but anything that is simply ignited with the intent of burning no matter what the hours of the day are and And against the burn moratorium, we will be citing you. And there was comments made during a public comment about a defensible space issue that's been in play for over 20 years. It's Promptown Ordinance number 45. And so it addresses all the concerns that that particular person had. Thank you.

Christy Sigmund, S-I-E-G-M-U-N-D, Manager Animal Services. So a couple statistics today and just some thoughts. We have had a lot of calls in the shelter for animal control dispatch for feral cats. These cats are sometimes not actually feral. People think of feral as mean and scratch and bite and nasty. Feral can also just mean unowned. It can mean that it is a community cat. And so I actually like that term a lot better.

a lot better. It's a cat that is unowned. It is a community colony. We currently have 104 cats in the shelter, and that's after I drove 25 into Vegas on Sunday to be spayed and neutered. So we had to pause the TNR program. When tails closed, we tried our very hardest to pick it up. We TNR approximately 50 to 60 cats a month.

month, but we are seeing such a spike this season and we're just not able to keep up. Space is an issue. So while we have a lot of people that are very upset with us that we are not trapping, I don't have anywhere for them to go and I want everybody to be as healthy and as safe as possible. Dogs. We have more dogs in our community than we have homes, and we're really starting to see that in the shelters. We want to maintain.

a no-kill status at the shelter, as I spoke about the other day. We want to save as many as we can, but there is some reality, I think, that needs to be heard, and that is not all dogs are adoptable. And when you say that and you think that, it's not that we are anti-dog. It's not that we are anti-animal. It is that we are a realist. We are addressing a situation. And saying we're not going to ignore the reality because if a dog has bites, if it has repeatedly shown dangerous behavior or concerning behavior, if it requires constant management to keep people and other animals safe, then we need to be honest about that. And just because a trainer or a rescue worker, a volunteer, myself, an experienced handler can handle that dog, it doesn't mean that the average person or family can. And to me, public safety matters. To me, children matter. To me, other pets matter. And the people that are walking their dogs or delivering mail or out in the neighborhood, all of these people matter. And so what worries me is we're starting to see more bites, more attacks, more stories than what you guys ever see in the news or what I ever come up and talk about. It's hard on the heart and sometimes emotion comes out. that is very uncontrolled, as we saw in the last time I came up here and spoke. But eventually this is going to affect everybody. And so I just want to be very honest. I want to use this platform to educate. that we unfortunately do have situations where we have to make some hard decisions and hard calls and it's not that we don't love these animals it is that in my position in my team we are health and public safety just as much as we are animal services So we want to create a safe and successful outcome for all these animals, and that really truly is our goal. And sometimes that means rehabilitation, sometimes that means management, sometimes that means training, and sometimes that means we have to make hard decisions. In our shelter right now, for statistics, we have 224 animals in that building. That is a lot. And to give you an idea, that's 104, sorry, 118 dogs and the building is built with 82 kennels, so you can do that math, and 104 cats and two bunnies, one of which that just had babies. So if you're looking for bunnies, come and see me. In May, we took in 137 animals. And we only had 24 of them return to owner and 28 adoptions. It was the lowest month that we have had since I've been here. In April, we took in 169. with 61 adoptions and 25 return to owners. So we are seeing month over month over 100 animals staying in our shelter. I'm very blessed for the relationships that I have in the community partners, as well as the no-kill rescues in multiple states around us, because that is the only way that we are able to breathe and stay afloat at the moment. Another person generously came forward and is sponsoring adoptions for the rest of this month. So please, let's help increase that adoption number of 28 from last month to be more this month and come in and see the kiddos that we have. We truly, truly have some phenomenal dogs and cats, including some kittens that we just got spayed and neutered and are on our floor available for adoption. Thank you.

Good morning, commissioners. Raylan Powers, P-O-W-E-R-S, treasurer for Nye County. Just a quick follow-up update on the room tax penalty collections that I had provided a couple of months ago. A couple of points of clarification. First and foremost, the final tally was not $88,000. The final tally was $71,148.58. Thank you for your attention. The second point of clarification is that money does not belong entirely to the town of Pahrump. There are four towns involved in this collection effort. The town of Tonopah, their collection effort was $56,550. So as you can see, the majority of that collection actually belongs to the town of Tonopah.

Pahrump is $5,753. Beatty was $5,989. Armagosa was $2,811. From the last update, we have increased our percentage from 74% to 79% collected. There are still a few entities that we are actively working with. The final update will hopefully be in the next few months. And hopefully it will be to make all of the towns whole. It's important to also note that these revenues collected belong to the towns as well as the state of Nevada and not Nye County. And that is the only update I have for the commissioners. Thank

I just want to address the sheriff budget for a second. I know that sometimes what will happen is we'll talk up here and there's a lot going on and then we'll get clarification on what that means and it can be really confusing. But just to clarify, when we went over the budget as far as the sheriff's budget, because I had one person ask me this the other day, I don't know why, but what had happened was we used the promise of indigent money and LATCF money to match exactly whatever we were taking out of that jail fund. So the hope is that there can be savings there, but the expectation has to be that there cannot be because we don't know. So what we had done is we had done it this way because it was permissible. And otherwise, my concern is that this board would take away more deputy positions, to be honest with you. That is always my concern. So ironically, in order to save deputy positions, this was done. But again, as it is laid out. These funds are designed to match dollar per dollar whatever was cut out. So you take something half of something over here and then you take half of you know take it and put it over here. So they really it's a at the end of the day it's there's no change in the way that the available money for the jail budget. There's a change in the budgeting but not available money and that's it gets confusing up here because you have to deal with all these people with all these different rules and sometimes they're not as clear. um to a layman is as we like, but I just wanted to clear that up. This month we are presenting April bank reconciliation and treasurer's report. Something to note on the treasurer's report is this does reflect the auditor's adjusting and closing entries on the treasurer's report. Those amounts can be identified in the column labeled trial balance, roll forward, fiscal year 25. There is still a small amount noted under our miscellaneous category, $1,169.73. These reports and the final adjusting and closing entries are being currently reviewed by our auditors. There is a potential that there may be additional entries for fiscal year 25. But at this time, we have definitely cleared out the majority of those miscellaneous items and are simply waiting for the final review by our auditors. We did unfortunately experience a small decrease in our market value again. Heads up about May, we also experienced an additional decrease in the market value. On the positive side, our interest that we're earning in our sweep account as well as the interest that we're earning in our Wells Fargo and multi-bank securities is definitely increased from last fiscal year. I'm positive the interest will continue to increase through May and June. Other than that, Commissioners, I don't have anything else specifically to report on the bank reconciliation or Treasurer's report. Do we have any questions?

Good morning. Beth Bourysdewich, b o r y s e w I c h. I am so totally against this. I understand that these people already have an agreement, and they can go out and start building houses right now. But this amendment to the agreement is making it so that this developer gets all kinds of special treatment, puts off for over fourteen years any changes to the development standard, community impacts, or future growth of the town. The water supply, they say that they have or will get all of the water rights. However, for 5,160 units plus the commercial development, they say they could put a hotel, they can put casinos, they can put all kinds of stuff out there, Recreational facilities, helipads, and heliports out there. What about the water for all of that? We do not have the water to to handle an additional 10,000 potentially new citizens in the town of Prominent. All water that is should be allocated should now be stopped and nothing be spent at all or used. In the future, the infrastructure, we're gonna have such an issue. Already, the sheriff just said he's over budget. He doesn't have enough people. We don't have enough deputies. What is gonna happen when we get an additional 10,000 people out there in the Southeast part of town, and there's three or four or five police cars out there handling a big whatever might go on, and they need to come north. We're not gonna get any kind of help for hours and hours. These developers are coming in here with all dollar signs in their eyes, not caring about the people of the town of Pahrump. They don't care that we're running out of water. They don't care that we don't have enough people, hospitals, anything to support new people. They just see dollar signs. Now what happens when the water is not available and it was understated? Who's gonna get sued? It's not gonna be the town. It's gonna be the people who built these developments. You might wanna think about that. The town of Pahrump does not need any more citizens at this point except for support staff. Once we get the support staff up, then I would say go at it. But right now, every developer, in my opinion, should be ashamed that they wanna come in and take the water that we already are suffering and losing and just willy nilly go ahead and build another development. reading what's on this paper that you have an opportunity to reject it. And if that's the case, I mean, I think it's irresponsible, irrational to adopt or amend and adopt. We don't even have a current water study, and you wanna, this builder wants to put in 5,100 more homes. That's that seems crazy. I mean, that's that seems like a a this the sweetest deal for them and a sucker's deal for us. And I don't wanna be made a sucker. I don't none of these people should be made suckers. Water should be at the top of everything. And if we don't even have a current study, there's no way that a development like this should be built or given the green light to build. It should be rejected. Studies this from what I've researched, this twenty year old development agreement didn't even have a water study. How does that affect the 11,000 plus well owners currently in Nevada? Again, if the water disappears and our wells go dry, all of our properties become worthless. The developers made their money. They're long gone, and we're left like suckers standing here with nothing. It's just wrong, irrational, irresponsible. It should be rejected.

We're not totally against development, but this is not the place to put high density homes. We are already stressed. Our aquifers stressed. Your fire budget, your sheriff's budget are stressed. The school budget is stressed, and and the hospital is is is not big enough for this many more people. So please slow down and do not let these developers do this to our beloved valley. Thank you.

At the very least, you should defer any decisions of any type of development whatsoever until at least six months after we actually have the water report in hand because it's gonna take more than five minutes for you to digest it and understand what the ramifications of it will be even though we have an idea of what we're looking at in terms of limited water resources. But I absolutely hope that you will reject this. It's not practical. It's not realistic. There's no gain for this town to add more population. And if you're looking at a tax base for that population, you know, it pales in comparison to the already shortages that we have for services here as it is. So we need to be looking at how to live within our budget that we currently have, provide the services that are necessary for the residents here, be that fire, police, emergency, and water, and deny this. What I'd like to demand all of you do sitting up there on the commission is bring in a report that shows the data of our involvement, meaning Nye County and the money that Nye County has given to DRI Desert Research Industries with a full compilation of what benefit has been achieved since day one that money has been being given to that agency. And I want that complete with water reports and everything to come with it. And if and if they're just trying to get it in under the wire just to save a few bucks, they need to take another thought coming. And I counted 42 amendments or inserts that were not in the original. And I only found two new ones and two of a questionable status because they had been redlined and then they were highlighted. So I didn't know what that meant. So, commissioner Strickland, I ask you for this for two reasons. First of all, it's your district. And secondly, I was in the room when you said you were gonna get on the phone and call John to get his ass up here and address these because this is not what the county wanted. So my question to you or actually my comment because maybe you comment, is does that satisfy you? Two diff two changes out of all of those amendments. I call your attention to page four of 23, section d. The county intent to provide for public services, public uses, urban infrastructure, and public improvements to promote the health, safety, and general welfare of the county to achieve goals and purposes, authorizing development agreements should they be enacted. That was the county intent. Following that is the owner intent. Word salad. Nothing concrete in there. Nothing about public safety. Nothing about environment. And the only mention of water is under the acknowledgment of uncertainties. And it said reads, among such circumstances are the unavailability of water or other limited natural resources, air and water quality, and similar conditions. If that's not enough to say no to this, it flies in the face of what the county wanted. The amendments are all in their favor. Has not been approved by it. There's a lot of language we put in there that has been removed and we don't know why. Public works primary concern is that proposed revisions reduce the developer's responsibility to mitigate those impacts while limiting the county's ability to fund and construct infrastructure required to serve the project. We public works strongly opposes opposes the proposed impact fee credit language, especially in the transportation portion of it, because it states that the proposed language would allow credits against impact fees for off-site improvements that are not included on the county's adopted capital improvement plans and would not otherwise qualify for reimbursement under the county ordinance six zero six. K? Moving on to drainage. The drainage impact fees have been completely removed from this development agreement. And that is $21,900,000.

Thank you, Mr. Chairman and Commissioners. Mark Fiorentino. I represent Adavan, which is the owner of this property and also the applicant. With your permission, I intend to kinda just do a very brief high level overview and summary of what this development agreement does and doesn't do. Frankly, a lot of what you just heard I think is based on misinformation because some of it is frankly just utterly false. But, and then at the end, I can answer any questions you have with respect to any of the specific concerns that have been raised that you want me to address that I didn't otherwise get to or to specific language. So I think it's important to remember the starting point and this answers one of the questions that was raised by your constituents is this, there is an existing development agreement in place. We are not starting from scratch here. The answer to the question, could we develop today? The answer is yes. If you rejected this, there's an existing development agreement in place that allows for the development of 5,160 units. These are not new units. They have been contemplated by you and your planning documents and water planning and everything for plus or minus twenty years. It's very important to recognize what so I'm going to repeat what I just said. This does not authorize any new units. These units are already been approved. And that's significant, I think, and I hope. Because among other things, we are adding acreage to this development but not adding any new units. So overall, in fact, we are reducing the density that would otherwise be allowed in this area because we're spreading the same number of units across larger tract of land. And I would argue that we are, and I think it's true to some extent also reducing the impact if you compare to what's in front of you today to what is currently on the books. Because by adding this land but not adding any other new units, again, you're spreading the impact across if you assume this land, if we didn't add it to this agreement, is gonna be developed by something, with something under your code, it would require additional water and additional other services. The the agreement, I don't know how anybody could have read the agreement and said there are only two changes, because it's just simply not true. The amendment provides, substantial benefits to the community, many of which, if not most of which, you would not get if you forced us to develop under the, the current agreement. And that's how we got here today. So, yes, public works didn't get everything they ask for in the language. The developer didn't get anywhere near it, everything they ask for in the language. But to try to balance a a agreement on what needs to be done and what we can do is where we tried to get in what's in front of you today. So just just a few highlights. The first is this if this project gets built, and we hope that it will, provides significant economic benefit to the county. It's about a $2,000,000,000 project, if it gets and when it gets, fully developed. $2,000,000,000 in additional development, which of course, drives revenues for you, significant revenues for you including property tax revenues. It also provides some diversity I think in the housing mix that you would otherwise get. Again, if the goal is to compare what's currently on the books to what we're presenting to you today. This, these amendments contemplate a mix of a large national developer in Shea Homes, with other developers including Touchstone who are are local. Jay intends to build a product and a model that they have used very successfully in other areas of the country. It's called Margaritaville model. It is an age restricted community. That provides benefits to the county that are not currently available under the development agreement. Again, would submit to you. First of all, with Shay developing the majority of units as age restricted, we're minimizing impacts on things like schools and park and rec services because the older citizens don't need those same services that younger folks do. And Shay is talking about a plus or minus $70,000,000 development of its own recreational facilities within the community. You add that with Touchstone who is planning to develop more entry level, more affordable units. And so you've you get some benefit from creating that diversity that you would not otherwise get under the current development agreement or you wouldn't be required to get. These new units, particularly the Margarita homes, they're these are marketed to a particular different demographic, at least if the experience is the same as it has been in other areas of the country, who will spend money in Pahrump when they they get here. So they're driving sales tax revenue. They're deriving, the need for more and, more diverse commercial services, which in and of then when it gets developed, divides more, commercial or more tax revenue. And, and this demographic also drives need for more office and medical services and space that you don't, the market here is currently not driving at a rate that's seeing it developed anyway. Again, because of the age restriction on the motor, we're minimizing certain impacts like the schools and, and recreation. Very, very significant. This agreement requires us to develop under the current standards and codes, which are substantially different than they were twenty years ago and substantially more protective of the county and your interest. If you reject this and we move forward under the original development agreement, we're under twenty year old standards that don't provide those same protections. This agreement requires us to upgrade the drainage studies that were done when this project was originally approved. Again, whether the folks want to accept it or not, that's significant. Mr. Bowling is right. Those studies are in the process. They have not been signed off. There's no risk to you that they won't get signed off because the agreement requires them to be signed off before we can, proceed with maps and construction. Significantly though in those studies, we are utilizing the data that the county has developed to update the entire, flood control data and flood control facilities in that area. It's outdated. Again, if we don't agree to this amendment, we're using data that's old and building to old flood control standards. Specifically, are designing and constructing flood control facilities for standards and FEMA maps that don't yet exist but will exist sometime in the future. That's substantially more expensive for a developer to do than if we developed under today's rule. But more importantly for the community, it provides substantial benefits and this at least partially addresses mister Bolling's concerns because we anticipate when we when the approved drainage study, because we're using the new data, is going to require us not to only manage our own flows, but to manage the flows in a way that protects the downstream properties, which we would otherwise have no legal obligation to do. And they're being designed so not only do they have built in capacity to handle off-site flows, but they're being designed to capture the storm water and recharge it back into the groundwater basin. So it's a net positive to the groundwater basin the way we're designing the, the flood control infrastructure. We're having to do exactly the same thing with the traffic studies. So this agreement requires us to update the traffic studies that were done a long time ago. One of the things that's new, I think you have it. I apologize for that the backup had the older version of exhibit e, but I think it's important for the community to understand what we're doing. The development agreement requires us to build improvements at nine different regional. Now I don't I take mister Bolling's word that only three of them are currently on your your capital improvement plan, frankly, should all be. They're all regional improvements that, are impacted by development in that entire region and that the improvements we're making will benefit the entire region. But this is very important. We're committing in our agreement to do improvements at nine different intersections even though those improvements go beyond what our impacts would be. Normally, you do is you do a traffic study and it says that this intersection based on everything that's happening in this area needs x. And you, mister Fiorantino, your developer client is responsible for 10% of the x because you're putting 10% of the cars at x. We're going significantly beyond that. We're taking nine different intersections in which we're doing all of the improvements entirely at our cost even though many of the need for those impacts are coming from projects that are already developed and projects that are already on the books. We're going to take the responsibility for building those improvements. So yes, we insisted on if we're going to do that, that we get credit against the impact fees because we are going above and beyond what we would otherwise required to be to do. This also I think it was missus Thomas who asked for this and the agreement specifically requires it. She said, you know, you should make them pay impact fees. And somebody else said the whole reason they're here is to avoid paying impact fees. It's false. The agreement requires us to pay impact fees. So, with respect to parks, we're agreeing again to a certain extent to go above and beyond. This agreement requires us to give you half of $1,000,000 upfront. Everybody else in the community would pay as they go. So the agreement with respect to parks and recreation requires us to pay half 1,000,000 upfront. And then at the 951st unit, we start catching up and paying. We pay $547 a unit going forward after that. It's the same thing with the Sheriff and Police Services. The current agreement does not require us to pay a penny. The amended agreement requires us to pay $2.00 $9 a unit. It's the same thing with the fire. Current agreement requires us to pay a penny. This agreement requires us to pay $254 per unit as we go. So there are significant benefits to the county in, and significant risk to the county in rejecting this amendment and allowing us to go forward under the old agreement. Now, of course, there's benefit to the developer in this agreement and and why they would be willing to go above and beyond. The two most significant things, this is just my interpretation, but I can answer any questions you have on any of them. What does the developer really get back out of this? They get an extension of the agreement so they have more time to actually do the development. And they get some expedited reviews, which is important. I think it's important to everybody. It's important to develop that once they start marketing a project like Margarita where they're doing a, if not regional, a national marketing campaign that they can deliver homes at the rate that people are ready to buy. I'm going to get to the water. And so it's important to us, but I submit it's also important to the county. The quicker we build the homes, the quicker you can rely on the tax revenue to help support your community needs. And the quicker we can build the homes and finish building the homes, the less inconvenience and impact you have on the community because of construction. So it was important for us to shorten up the timelines. One of the amendments that we made between when this was introduced and today, which again is important and it relates directly back to the citizens concern that your that it's on your staff may not be able to actually process the the in the timeline we wanted. And even if they could, it would be unfair to make them do it. So we took that out actually. And now what the agreement requires is we have to pay the entire cost of the review of our improvement plans and subdivision maps. So we outs we are required to outsource them and we are required to pay 100% of the cost. And then the at the end of that process, the the way the agreement is written, we have to select a consultant that is acceptable to the county. And that consultant just steps in the shoes of your staff. They would do the same reviews against the same set of rules and issue a certificate of compliance. They issue a certificate of compliance, we can go forward. They don't, we can't. There's, there's no risk to the county. All we did was address the concern, a legitimate concern that they're overwhelmed, your staff, and, and they needed some help with the resources. So it's also important I think to understand the water situation. It's a legitimate concern. But the development of this project is is not, should not, and is not related to the larger regional study you're you're doing. This water was acquired and dedicated to the utility years ago specifically for this use. This is not a project where you were coming before you and saying, we'll figure the water out. Now I understand that there's some language in the agreement that makes that confusing. Right? Because again, it was written twenty years ago. That is not the case where we are today. And there is the paragraph that was read to you is not the only provision on water in the agreement. There is another provision that expressly says we must have water rights before we can file subdivision maps or develop. That's bootstraps above what the law requires anyway. We couldn't develop we couldn't record a map unless someone certified that we had the water. But to directly address the concerns, we are not coming forward with a project that we got to go find water rights for. The water rights have been acquired, they're permitted, and they have been dedicated to the utility specifically for this project years ago. Two other things and then I'll be happy to answer questions. So I do want to repeat for the record that there is we substituted exhibit e that's very important that the record reflects the updated version of exhibit e because it reflects everything, that I just told you with regarding to the traffic improvements, which is a significant benefit the county would get if you approve the agreement. The second thing is, in the last few days, we've heard some concerns about, buffering around the edges of this project, in particular with respect to height. The standards would allow stories of structures above two stories in portions of this community. And the concern was we need to limit that around the edges where we might impact people who are not in the community. So I would read into the record a proposed change that we would make to Exhibit C because it's Exhibit C that governs the height of structures. And it would read structures constructed on any parcel that shares a property line with a parcel located outside the boundaries of the common interest community shall not exceed two stories. So in other words, wherever we are immediately adjacent to somebody outside, we will we won't do any more than your code currently allows. So I know these aren't easy decisions. And it took us quite a while and a quite amount of energy on a a good portion of well, almost her whole staff to work through these issues and try to come up with something that works for everybody. I think that's, we've accomplished that and we've got that in front of you today. But I would be happy to answer any questions that you have or address additional concerns. Thank you, sir.

And we've gone over this, and this is not a new project. And I appreciate you finally clarifying the water issue that you've had the water and it's been dedicated to this project from long ago. So that really shouldn't be an issue. I do, however, have some issues, sir, with some of the information, especially from the public works director not being satisfied in approving this agreement as written currently. I don't believe he said to reject this, but he's not satisfied with the way it's written. And it appears that the credits and I understand going through this that you were awarded credits, and there are no drainage impact fees that are associated with this. And so when you say, Councillor, that there's no legal obligation to take care of the water flow, but you're going to take care of the water flow If the project moves forward, when the project moves forward and there are water flow issues and there's no legal obligation, who will have to do that? We may have to do that without the impact fees in place. And then we, as in who, would be the taxpayers of Pahrump and Nye County. So Exhibit C that you mentioned, and I appreciate that because although the northern part of Pahrump is my district, but I'm county commissioner, And I received calls and concerns over the ordinance of what it allows as far as a two story height. And that two story concerns me. And I please allow me to elaborate on this. The single story homes that border the perimeter of this said project are already existing property owners. They're already existing Parumpians, we'll say, that have no choice to come in and say, Oh, there's a single story here, there's a two story here, there's a three story there. This is the home that I want to purchase, and this is in regards to your project. So I would respectfully request to consider that anything bordering the preexisting homeowners as good neighbors is that there would only be a single story dwelling allowed that borders that common wall, we'll say, that common property line. And inside, after that, facing the other directions, if there are two story, three story, whatever is part of your infrastructure design, that's up to the people that come in. It's marketed that way. It's sold that way, it's understood that way because right now it's not fair to the preexisting homeowners that may have a two story overlooking their property, their home, and it is absolutely and would be an infringement of their privacy even though there may be a common wall. So that does concern me. Again, counsel, I would respectfully request to please consider that only in the perimeter that borders the preexisting property owners.

Yeah, just a couple of things. That's a tough one. We've we've discussed it. Let me start with first again, the the drainage. I I understand the commissioner's concern. I understand mister Boling's concern. That was part of the back and forth, that we we spent a lot of time going back and forth over the drainage, specifically. So, and I may have misspoke slightly, Commissioner. I I didn't mean to say that. Let me say repeat what I meant to say, which is with respect to the drainage, we expect our drainage study, and this is the protection for you and for mister Bolling because he has to sign off on the drainage study. It's currently pending, to require us to do improvements that we would not otherwise have to do to mitigate just our project. We are going to upside the facilities and we're going to design them in a way that protects downstream properties and and provide some recharge benefit to the groundwater. That's a trade off in our opinion. That's worthy of not also having to pay the mitigation fees, the impact fees for projects that are elsewhere. It may not be an exact trade off, but that was the that's the explanation of the trade off is we're going to do more than we would require just for our community in exchange for not having to pay those particular fees. Also, part of the trade off, although I guess you could argue they're apples and oranges, is we're going way above what we're responsible for doing in the traffic improvements. So we're spending significantly more on traffic improvements than we would whether we pay the impact fee or not. And that that should be part of the equation when you're considering whether what we gave you is a reasonable solution to those things. The two stories, commissioner, I I I wish I could just accept that on the record. We've been back and forth over it. The the problem with it is today as we sit here and the time lapse between today and when we might build those units, other development might have happened in between there. So it's very hard to commit to single story to single story because we don't know where all of the single stories will be either in our community or elsewhere. I guess the best commitment I gave you is we came a long way by saying we won't do anything more than what your code requires. So if this development agreement went away and we just developed under the existing zoning regulations, there'd be no requirement that we limit them to two, to single stories. But both of the proposed developers here, Touchstone and Shay, have been pretty cooperative in working with neighbors so far to get to this point. The neighbors, particularly to the south in our Artesia, We've got other work to do with them because we have to coordinate the ending of the streets over there that they did they didn't fully develop that we're gonna have to develop for them certain cul de sacs and turnarounds. So we're gonna be having some ongoing conversations with them that that hopefully can lead to them working that out amongst themselves without having a broad restriction that could have impacts that we can't completely determine today as we sit here. I understand that doesn't get you exactly what you wanted, but that's the best answer I have standing here.

That's all I'm asking, counselors, to please take back, bring it back, voice my concern because I know that the neighbors of that immediate area will be so appreciative that there are only single homes, single homes on the backside of their common wall.

I've largely reserved my comments about the process of development for a long time, and it seems appropriate now. And I am not doing this to pick on anyone or this developer at all. But there are two issues for me. There's a larger issue of the process, and then there's a more there are more specific issues that I can get to that may be easier to digest. The the larger issue, when I came into this position, I wrote this little kind of throwaway thing. A few people in this room got it called Interlopers and Gatekeepers. And the way I see it is people will see commissioners coming in, and they're sort of interlopers. A lot of the staff are seen as gatekeepers. And it's it's because of the term limits, whether you like them or not. You're here for twelve years, and I think I've said this here before where I left. Mike Madigan was the speaker of the house in Illinois. When I was born, I believe he was in the in the state house. Now I'm not saying that should be the case. Well, actually, I think he left ten years ago. But I'm not saying people should serve forty years. But you know that the staff is not running Illinois. You know that the staff is not running Massachusetts. And you know the staff is not running in a place where there are no terminologies. But here, you tend to have staff that has a heavy hand in these things. Whether good or bad, well intentioned or not, that is a fact. I grew up you know, even though I did grew up in cities, I also grew up in Storrs, Connecticut, which I think the gentleman here probably knows, back when like, I haven't been there a long time. But there were I watched the place sort of change, and I spoke with someone recently who said it's very different now. All those woods that I was in constantly, they're now houses. And Coralville, Iowa, you know, I grew up there when I was a boy. So I've watched these things. And when I when I ran for this position, I said I wanted to preserve our traditional values and our Western culture. And and what I meant by that was what we are. We are a Western culture. And if you look at the things that I do, I'm very concerned with bringing urban things, urban ideology into this community. And so I will I will oppose that at any chance. But as far as the larger issue of the process that I'm talking about, why I did that, it's not to zing any staff. What it is is I tend to get sort of a shoulder shrug kind of obligatory meeting where I feel like and this may not be the case. It's just the way I feel. I feel like there are some kind of side deals or something's already been ironed out between a developer and someone else. I don't know if it's someone up here. I don't know if it's someone on staff. I don't know. But I kind of always feel whenever I meet anyone, it's sort of an obligatory, you know, I'll give the guy an hour. You got any questions? Hey. Great. And I feel like commissioner Jabbour I don't speak for commissioner Jabbour, but we've spoken about things. And sometimes I think it feels like I don't know if it's just the two of us. I don't know. But it's an interesting dynamic given perspective of what has happened recently. And so I'm gonna just set that aside for now, and and I'm gonna go into the the specific issue of which there are a few, and I have the same concerns with commissioner Jabbour, four story, three story. I've been on record. I really like one story. I know that people can't make money with certain things, but I believe that oh, maybe I'm wrong about that. I believe I I know who the developer is in one of these. I thought they were I know they're predominantly single story. I know that. But they're probably smaller lot sizes. There are issues here. One of them being the traffic con it's pretty much brought to my attention. It's not just me sitting in a room, but people have brought this to my attention. I'm trying to figure out what the best place to start is. But there has been utility issues, which I don't know much about. And again, I've been told about. As far as infrastructure, there's been sort of phase in and when we put infrastructure into place. And the concern is that if we put a thousand homes or 2,000 homes somewhere, but we we rely on our public works and no offense to the public works, but if we rely on public works to fix streets, I mean, this is the same group of people who said, hey. I know you gave us a million dollars last year. We thought about it for a year, and, yeah, we decided to give money back because we don't wanna fix the So now we we have to rely on these people to fix streets, and they won't let us outsource. Go up, oh, no. No. It's a bad idea. You don't wanna outsource. Well, you don't want the streets fixed. You really just wanna take the money back and forget about the whole thing. And now here comes you. We want to put a couple thousand new homes down there. You can see the dilemma. You don't have to be a engineer to see the problem. There's no like a traffic impact thing that I've seen or been taught told about. There's no need for plants or trees or anything like beautification. I don't like the four units. Someone told me four story or three story around the perimeter. Again, I'm not trying to bankrupt anybody, but these are my concerns with specific. And then on top of that, you have a public works director that that has to be worked with on this who just said he opposes it. Now whether it's true that he shouldn't be opposing it or not isn't really the point. I've said this before. Even people that that don't like me or documented don't like me on staff, you cannot set them up for failure. This is not I'm not an agent of chaos up here. So you've got to have people working together. I don't care how you feel about me. But if you can't get on the same page as the other party in something, then I don't know how I can do that. I don't know how I can force someone into a position like that. It looks looking at the contract, things like condemnation for off-site right away. We're talking about eminent domain. County must assist with eminent domain. We're talking about a clause where it says that consultant will issue the county a certification, and the certification will confirm compliance with the applicable rules. And then they're deemed approved based on what the consultant says. And again, nobody has been more frustrated with certain things, especially having to do public works as I. But having that in here is just it reminds me of when I say you're in a relationship and you don't trust the other person. Well, you're not in a relationship. You're already basically divorced. Why why make this happen? If it if it doesn't work to the point where there's so little trust, when I read this contract, it's filled with things where you just don't see a trust. And I don't blame the developer at all because I have same issues. Anybody watching this has seen I have had problems here with trust, people not trusting me for whatever reason, and and the feeling's mutual. But again, as not an agent of chaos, I don't know how I could sign off on something like this. I I would prefer that some kind of just other than a shoulder shrug kind of obligatory and hang your head and throw something like, oh, look at this. And tell me what this is. If you have any questions, let me know. And there's like a 700 page document. It happens a lot, Webb here. When you get elected, this is what people sometimes do. And so I don't know, and I don't want to be incendiary or cause attacks from anybody over here on this side of the table. I really am trying very hard not to do that. But I understand there are certain people who have taken a lead on certain things like development, and I might not trust the judgment of the person taking the lead. And I know maybe from the outside you see five commissioners. Well, three of them, I don't need their votes. So that's fine if you don't need their votes, but I'm pretty sure that whatever this is, my vote is needed. I I I feel that. I'm not trying to kill anything. I don't know the DA smartly left the room a couple minutes ago. Was gonna ask about the whether or not with this old development agreement, I just don't even know what that means. And if you wanna address that, I'd love to hear it. What what does that mean if we go back to the old development agreement? I mean, like, I have to believe there's a reason why you're standing here and your client's paying you to stand here and talk to us. Otherwise, you just go to the old agreement. I'm assuming you get something out of this new agreement. What is it you get? Or why don't why not just proceed and just not even sit here and talk to us?

And they get the ability to have the normal review process expedited a little so they can move faster to sell homes. Those are the two primary benefits. Commissioner, I will take responsibility. It's me who is responsible for making sure you fully understand the agreement and got your questions answered. And to the extent I didn't up to this point, I will take responsibility for that. But I will tell you it has nothing to do with the lack of trust how we got here and where we're at. It was a process of us working back and forth together with a combination of town manager and your planning department and the public works department and the commissioners, certain things the community wanted and needed, like expedited construction of traffic improvements that you might otherwise not get ever if this project doesn't get done, and upgraded drainage facilities to help recharge water back into the basin. So there was a lot of back and forth. And so where we stand today is my clients are not completely happy with it. They didn't get everything they want. Nobody in the room is completely happy with it. I accept it with you, but it's a compromised solution on the various different issues that we had to address. It is important to the developers as you move forward and try to build a project of this size to have some flexibility in the height of the the structures they can build, in particular with some of the, condominium units that they are planning. So that's why we asked for some relief to allow taller than two story structures. It is also reasonable, however, for the community to say, you you gotta put them in a way where they won't impact somebody who is already existing, which is why I offered the language today to to make it clear that we're we're we border projects or parcels that are outside the community. We won't do those taller structures. In fact, we won't do anything more than your code currently allows. So there's, the the process that got us here had nothing to do with lack of trust. And you're absolutely right though. For this project to be successful going forward, the the language is only as good as the words on the paper. You're gonna we're gonna have to continue to work with you and the entire commission and your staff every step of the way to to execute this. So

And you say, well, we're working really hard with everybody on this, and we think everybody agrees. They don't agree because the guy is sitting right there, and he said he doesn't like it. So it's just it's it's troubling to me to the point where if I could, I I would I would like to see just some kind of discussion on this. I wish I could just sit in the corner and figure out and come back, but maybe there's just some way and that doesn't mean come up, you know, with six boxes. Here you go. Here's six boxes. Yeah. Read this. You know, just some way to look at the things that are pertinent. You know, these questions people have because I'm telling you I've had prominent these aren't people who to someone in the supermarket, these are prominent people who have, like, seemingly minor issues. And if you already have the green light, it makes sense to try to get some of these things resolved. And it's not a a killing of anything, but it's also I just don't wanna roll over and and and deny something that could help us preserve our rural community in favor of a potential more dense a potential more urban one. That's something I'm very, very, very concerned on. And I haven't been that vocal up here, but now that we have this regime change, you're probably gonna hear me be more vocal because I think that that's the direction we're going. We don't wanna stop things from happening. I don't. But that doesn't mean we have to pile these little mountains mountains edge sort of things where you have 3,000 square foot lots and there's someone coming later that's gonna do that. And that those are concerning to me. So maybe if there's a way to do that, that's my comment, not necessarily a question.

We had four meetings in December before I took off. It's like, hey. We're gonna throw these meeting. They passed a law. They passed all these it was just crazy to watch, and it's not right. Again, it doesn't matter how I feel about the people, but it's not right. If you're coming in in January, all these things are happening. All these major issues are are being decided in November, then late December. I think there was, like, a December 20 meeting or something in twenty twenty twenty twenty four. I I would love to have the input of the incoming commissioners on something like this, especially since the person representing this district is an incoming commissioner. So those are my concerns. And this is the I see that. Debatable thing that, Public Works wanted is he said that there's only three of these items that are there's nine. There's nine that we're getting, but they're in the immediate area of the subdivision where the highest growth is and not all over the valley. So these are not on your your common list for improvements from our public works director. Secondly, the public works director didn't like that nor did he like the fact that the drainage was being the money wasn't going straight into the coffers of public works for them to make the drainage, improvements. We're gonna ask the developer to do those drainage improvements now and with the subdivision instead of just collecting money to be done in the future. And he's gonna they are gonna be spending a great deal more than $20,000,000 to be able to do what they need to do. They will have rapid infiltration basins. And so there's a lot being gained here, and that's where it's been frustrating listening to the debate because, yes, we all heard all this. All of you were consulted about this, but unfortunately, your exhibit eight did come to you incorrectly.

But commissioner, so there's two things going on here with exhibit e. And again, to the extent that you didn't have the revised version, I will take full responsibility for that. So, exhibit e requires us to do nine different intersections. What's different be primarily different between what, you have today and the last time, we talked is we substantially collapsed the timelines for when we would have to build the infrastructure. So you, to answer your question, the developer is responsible for building those intersections, including the some of the improvements are required, for example, retiming the signals. You asked specifically about that. This requires us to take responsibility for that. It's not that public works has no role to play in it because they have to approve the traffic study that will will confirm these improvements. And the it's a related discussion. Who's going to review those studies and improvements? Again, that was the compromise back and forth. It's important to us that we can move quicker than your staff might otherwise be able to do. And including the public members said, it's unfair for you to ask us to do that and you not pay for it. That the other revision is we're going to outsource the reviews. And commissioner, you and I specifically talked about this, outsourcing the reviews So that basically you're having the you're taking a qualified group of professionals who the who the county has to approve the consultant and just substituting them for your staff. So they'll do the reviews and conform that everything we submit complies to your rules. When it comes to the height, Commissioner, I wonder if you and Commissioner Jabbour and others who are concerned would consider something slightly different, at least for now with respect to the height, which is to limit the single story along the southern border of this project, which is where Artesia is, which is where we understood the primary concern is and where we know the existing homes are. So it addresses our concern of not knowing what's what, you know, six months from now. And we know what Shay's plans are there. So we know today we could commit without any problems on our side to single story only along that property line along the southern border of this project. And if we would hope that that would be acceptable.

respectfully. I'd like to ask the board to set a different time and date than what has been um recommended to us by staff. The reason is that each board member, each one of us as board members met with the developer. As an example myself and Koenig met with the developer on the 8th, so that's just seven days ago. I realize that the developer worked closely with all of staff but really we haven't had any real feet on the ground on this one. The developer has met all the standard plans of development but nothing extra. They've tried to set up an additional meetings with us and have not got it done. And so the extras that I'm talking about as an example is that Pleasant Valley gave us an extra $4,000 per household per rooftop for Kellogg Park, specifically for Kellogg Park because there are impacts in that area they were not providing enough. parks uh in within their development. So we need we can ask for more than the standard and as I did with Pleasant Valley and I got, with your help board. But I respectfully request a new date so the commissioners can have discussions just as we did earlier with evidence item number seven. I don't think we're prepared, and frankly, I've heard comments from Commissioner Bain that he doesn't feel like he's in the loop enough on this

Marianne Hollis, H-O-L-L-I-S. I am again requesting an update on the splash pad. I didn't hear anyone say that they would address this with Mr. Martinez. My emails to him responded with generic, unrelated information. I have addressed my concerns with Mr. Wagner, including now the security of the site, which is only with a twist tie. Nobody seems to care about that. Just nobody seems to care. The other issue I have is when applicants are coming forward, such as the Ativan attorney and Russell Meade's at the last meeting. they suggest that and you agree to that the public speak first. We don't know what's in their head what they're going to say so what we say may be outdated, might be mocked, I don't know, but until they've spoken it doesn't really give what we may want to say any more credibility or weight. So I think it's sort of a manipulation that we get up and speak. And what really bothered me with this attorney was that he misrepresented my data. And I will be happy to sit down with anybody and point out the 42 amendments that he says is now really just two. It just made no sense. But again. Time-wise, the splash pad has got to be addressed. It's a disgrace. Thank you.

On April 6, 2026, the county manager wrote that public works and the district attorney's office were preparing an agenda item under our two-year right-away training and 2014 MOU matter for the June 16th BOCC meeting. The June 16th agenda does not contain that item. I sent a written follow-up yesterday requesting confirmation of the current status and which office, if any, is handling the matter. I have not received a written confirmation from District 5 or the District Attorney's Office. I am placing this on the record today so the timeline is complete. Thank you.
