9. CU-13-0003: Conditional Use Permit (CUP) application to allow a Propane Bottling Facility

Commissioner Koenig

refers to staff. Page 2 of 5 Steve Osborne reviews the staff report. He stated they went out 2,000 feet to reach the maximum number of parcels. There have been two letters of opposition. Staff recommends approval. Findings 1-8 have been met in this application.

Commissioner King

stated the letter from Ms. Keagy seems to speak more towards Public Works. Is this something that can be addressed in the Site Development section?

Mr. Osborne

stated it would be best to add as a condition of approval, and it would be addressed during Site Development Review.

Commissioner Carbone

asked if this has been coordinated with Public Works?

Mr. Osborne

stated yes, Public Works has provided comments and are part of the Site Development review process. Darrell Lacy states whether it’s a condition of approval or not, those issues are addressed during Site Development review process.

Commissioner Koenig

refers to the applicant. Russ Meads, Double M Construction, representing the applicant. The project has been designed to meet the requirement of the Heavy Industrial zoning district; screened from public, etc. Marty Baker, Pinnacle Propane Express, applicant.

Commissioner King

asks the applicant what type of screening are they using in South Carolina and what do you propose to use here.

Mr. Meads

stated they currently don’t use anything but at the site here they would use some type of block/block wall to screen the property from view.

Mr. Meads

stated he didn’t feel the heavy industrial zone and use did not warrant curb, gutter and sidewalk improvements, as the general public will not be accessing the industrial uses. Would like to further address the curb, gutter, sidewalk issue with Public Works, but doesn’t feel it needs to be a condition of approval and keep it in the Site Development review process.

Commissioner Hafen

asks Mr. Meads if the parking lot and loading dock will be asphalt.

Commissioner Hafen

asks Mr. Meads if the area for the propane tanks will be gravel or asphalt?

Mr. Meads

stated it’s a requirement for the tanks to be on crushed gravel.

Commissioner Carbone

asked if the curb, gutter, sidewalk costs will be a concern for the project? Have you accounted for those costs?

Mr. Meads

stated previous conversations indicated the issue could be worked out, and yes it would add additional costs they were not counting on at this time.

Mr. Lacy

stated condition of approval #9 requires a site development plan and that does require a discussion between the applicant and Public Works to reach a mutually agreeable plan of development, which would include those issues. Page 3 of 5

stated that’s why he asked – would it be better to be left to the Site Development review or a condition of approval?

Commissioner Koenig

stated if it’s a condition of approval it’s an absolute necessity, but if we leave to the Site Development review it can be decided then. Charlie Watkins stated if that requirement is left as a condition and applicant fails to do it, it gives us the opportunity to pull the CUP, but if they don’t comply they have to deal with Public Works.

Mr. Lacy

stated they cannot get a building permit for the project until the Site Development plan is approved and these issues are worked out.

Commissioner Hafen

asked the applicant if they have read the remaining conditions and do they understand and agree to them?

Mr. Meads

stated yes to both.

Commissioner King

asked what Ms. Keagy envisioned the front of it to look like.

Ms. Keagy

stated people don’t want to be looking at security chain link around the property, or things that would deter people from coming to the commercial uses across the street.

Commissioner King

stated we don’t have design guidelines for that particular area.

Ms. Keagy

agreed, stating the only protection she can see is by way of inserting conditions of approval, such as maintaining the frontage appearance along Basin.

Commissioner Carbone

asks if Ms. Keagy is talking about the subject property or other properties she wants to see something done with?

Ms. Keagy

states she is talking about the subject property, but what is done here will set a precedent for development as Basin continues.

Commissioner Carbone

points out that further east on Basin, there are several properties that have chain link fencing.

Ms. Keagy

states she’s aware of those but you can’t do anything about the grandfathered property. She’s concerned with the subject property and what’s between Highway 160 and Panorama.

Mr. Lacy

states he doesn’t see a conflict and asks applicant if he has any wording he’d like to propose.

Mr. Meads

states he’s read the code which requires screening and buffering from public view and feels they will be achieving what Ms. Keagy’s concerns are. Page 4 of 5
