9. CU-13-0007: Conditional Use Permit (CUP) application to allow Special Condition Animals

Commissioner Hafen

asked based on the vague letter from the applicant, is he asking for a continuation or withdrawal.

Ms. Lee

replied that she made contact with the applicant and via email he requested a continuation of this application.

Commissioner King

motions to continue CU-13-0007 to July 10, 2013 this would be the last extension, Commissioner Earl seconds.

motions to deny CU-13-0007 based upon the finding as shown on page 2 of the staff report, Commissioner McCall seconds.

10. Zoning Ordinance Text Amendment: Discussion, deliberation and possible decision to

Commissioner Hafen

asked of the changes to 13.A.3 would not allow a gas station, it would just allow a convenience store, and an RV park would have to come before the RPC for approval of a CUP before they could start construction?

Mr. Osborne

replied that is correct to both.

Commissioner Goode

asked is this change only for the convenience store or will this also affect the number of RV spaces allowed?

Commissioner Koenig

replied this is only for the convenience store. This has nothing to do with any particular application. The current Code requires 5 acres for an RV park and 10 acres if you want a convenience store in there. This is just saying you have to have 5 acres for an RV park and you can have a convenience store without a waiver.

Commissioner Goode

asked why this 10 acre requirement was part of the code.

Commissioner Koenig

didn’t know and asked staff if they knew why this requirement was in the code.

Commissioner McCall

asked was there an original reason why the 10 acre requirement was added to the code, or was it just an arbitrary number.

Mr. Osborne

replied that he didn’t know what the original reason was why 10 acres was the minimum requirement.

Commissioner King

asks if the RV parks that are less than 5 acres that are grandfathered, would they now be allowed to have a convenience store?

Mr. Osborne

stated that if they are grandfathered, they would need to apply for a Conditional Use Permit before they could add any building or structure, so it would have to come before the RPC for approval.

Commissioner King

clarified if these RV parks would now be allowed to add a convenience store if they wanted to, if this amendment is approved.

Mr. Osborne

stated they would be allowed to apply for the Conditional Use Permit.

Commissioner Borasky

asked if an RV park would have to have adequate parking and how would you base the number of spaces needed?

Mr. Osborne

replied yes, they would be required to have an adequate number of parking spaces and that number is determined by the standards in the code for a convenience store. This is typically based on the square footage of the store.

Commissioner Koenig

reminded Mr. Hollis that this is not specific to any project, this is an amendment to the code itself. Page 4 of 6

stated he’s aware of that and he supports the text amendment.

11. Discussion, deliberation and possible decision concerning a request from The Episcopal Diocese

Commissioner Koenig

states the church is basically asking for a zone change so they don’t have to do it; asked if staff has any comments. Steve Osborne stated staff doesn’t have any comments, but someone from the church said they would be here to address this item, but doesn’t see anyone here from the church.

Commissioner Koenig

states he sees no reason to do this. They aren’t planning on building anything. According to the letter, they just want to put a fence up and clean the property up. Where the church is existing is zoned Neighborhood Commercial. The zoning on the additional lot allows for a church and he doesn’t see any compelling reason to rezone this property.

Commissioner Hafen

asked for clarification that the current zoning of the property is RE-1 and this zone allows for a church.

Mr. Osborne

stated that is correct.

Commissioner Hafen

said there’s no need for us to do anything, they can go ahead and build a church tomorrow if they wanted, after they get a site development plan approved.

Mr. Osborne

stated that is correct.

Commissioner Borasky

asked staff if there was a reason the church wants to go to Neighborhood Commercial.

Mr. Osborne

stated the existing church is zoned Neighborhood Commercial and they talked of expanding. This is the lot adjacent to the existing church, so they may have wanted to be the same.

Commissioner Borasky

verified the existing church site is Neighborhood Commercial.

Mr. Osborne

stated that is correct.

Commissioner Koenig

stated that church is grandfathered in.

Commissioner Borasky

just wanted clarification if the church had plans for doing something with that adjacent lot.

Commissioner Koenig

said the church states they have no plans at this time. Page 5 of 6
