stated he will in the future be getting with the Chairman to provide information on additional training for RPC members. b. Capital Improvements Plan Advisory Committee - John Koenig Next meeting will be February 18 at 2 pm. c. Director’s Report Darrell Lacy stated there will be an OML training in the next month for the RPC members that missed the previous training. d. Chairman’s Comments None.

stated he has a conflict as his mother will be speaking on item #8.

reviewed his staff report. Staff is recommending approval subject to the conditions of approval. Page 2 of 6

asked if VEA and the applicant have met, does that eliminate condition of approval #3.

Mr. Osborne

stated he believes so, but we could ask the applicant. Allen Schrimpf, Jim Scott with the Nye County Sheriff’s office.

Mr. Scott

stated the land is the Public Safety multipurpose training center. A portion of the property has been designated for the sheriff department, where a range could go. The current process is that employees have to travel to Beatty or Mercury in order to obtain training that is required annually. The maintenance on the dirt berms is cheap but effective. They will have a range master and range safety officer and approximately 5 employees per event. All controlled by the Sheriff’s office.

Commissioner Koenig

asked if this will be open anytime an officer will need it.

Mr. Scott

stated yes, it would be a scheduled event that would require a Range Master and Range Safety Officer to control the event.

Commissioner Koenig

asked if they would be shooting long rifles and pistols.

Mr. Scott

stated the long rifles would be limited to the M16 but limited to the 223 caliber.

Mr. Schrimpf

stated no 50 cal.

Commissioner Koenig

asked if the back stop is just sand.

Mr. Scott

stated sand and dirt. 44 foot base and gradually decreases to the 22 foot mark.

Commissioner King

asked how often they will be sifting and getting the lead out.

Mr. Schrimpf

stated the range in Red Rock Canyon has been there 35 years and haven’t extracted any lead out of there yet. We are looking at over 20 years before it will have to be taken out.

Commissioner King

stated he is worried about the rain runoff and the lead seeping into the drinking water.

Mr. Schrimpf

stated the lead will stay within the berm the lead won’t completely dissolve and go into the drinking water.

Mr. Scott

stated the extraction could happen yearly or every two years, the Sheriff hasn’t made a decision yet though.

Commissioner King

asked if there will be lighting.

Mr. Scott

stated at this time it hasn’t been addressed.

Commissioner Clark

asked if the Sheriff’s office will be in charge of the operation of the training at all times.

Commissioner King

asked if they are required to have an environmental impact study.

Mr. Lacy

stated no, this is not federally owned land, it is not required.

Commissioner King

stated he is still concerned with the lead.

Mr. Schrimpf

stated what lead does go in there is very minimal. Page 3 of 6

stated sifting will take place but they don’t have a time, if it will be yearly or every two years.

Commissioner Hafen

asked Mr. Sutton if there is a way to limit this to Nye County Sheriff’s department only, no outside agencies can use it.

Mr. Sutton

stated yes, although it is limited to the land and it is subject to the conditions and if they are violated it would trigger this boards ability to revoke.

Commissioner Hafen

stated we could add a condition as long as it is amenable to the applicant that only Nye County Sheriff’s deputies and officers can use the facility no matter who owns the property.

Commissioner Hafen

asked the applicant if they would be amenable to the condition.

Mr. Schrimpf

stated the only thing anticipated is if Metro comes over to help with training, to have hundreds of people there.

Mr. Lacy

stated the Sherriff’s office does conduct joint exercises with other entities. It would be a little restrictive to only Nye County deputies use it.

Commissioner Hafen

asked the applicants if they have read and understood the conditions of approval.

Commissioner Hafen

asked if they would be amenable to adding conditions of approval that there is a 20’ berm in the back and 15’ berm on the sides, and no shooting outside the berm area.

asked if there is a well on the property.

Mr. Lacy

stated not a drinking well but a monitoring well.

Commissioner Hafen

asked if a condition can be added to test for lead on an annual basis.

Commissioner Hafen

asked that they get a baseline before they start. Public comment opened at 6:31 pm. Rebecca Oscarson, Jeff Holley, VEA. They have concerns with the project because they have transmission lines and distribution right where they want to put the range. They would like a 30 day continuance of the application to do further research. They did make them aware that if there was damage to the lines they would be held responsible for the costs.

Mr. Scott

stated they have meet with VEA and discussed their concerns. The Sheriff is aware they would foot the bill, if it did happen it would be negligence.

Commissioner Hafen

asked if they have a time frame to have this completed.

Mr. Scott

stated they currently 30 days behind, they are required to do two firearm qualifications bi- annually according to state regulations. They are recycling a lot of the dirt, and the cost is minimal. Page 4 of 6

Commissioner Adams

asked Mrs. Oscarson what is on the table as far as mitigation.

Mrs. Oscarson

stated they would like 30 days because they would like the engineering staff to review this, if there is an outage the cost of the repair isn’t just the issue, they have an obligation to the members to always look out for their members.

Commissioner Koenig

asked if those lines are back up lines.

Commissioner Koenig

asked what would happen if those back up lines are shot.

Mrs. Oscarson

deferred to Mr. Holley who is a VEA engineer.

Commissioner Borasky

stated he met with VEA a year ago to discuss this, the Sheriff was there, two representatives for VEA also. There was some loss of communication, this could have been worked out between then and now.

Mr. Holley

stated yes redundancy is gained by that line, if you lose the redundancy you go back to where you started before the line went in.

Commissioner Koenig

stated so if that line gets shot down we would still have power, but if another line went down we would have no power.

Commissioner King

asked if there could be some sort of Kevlar sleeve that could be put on the line to protect the line.

Mr. Holley

stated he doesn’t see that being realistic.

Mr. Schrimpf

stated the lines are behind the range, there won’t be any ricochet issue.

Mr. Scott

stated one of the short meetings they had yesterday they will make sure all rounds are accounted for, if one isn’t they would coordinate with VEA. They will also include a sign at the site.

Commissioner Koenig

stated special condition #3 is in no way to allow VEA to hold you hostage and continue this project for eternity.

Commissioner Hafen

motioned to continue to the next meeting. Seconded by Commissioner Clark.

Mr. Osborne

stated staff will be bringing back the report for a study on the River plate area with recommendations.

Commissioner Koenig

stated Title 6 has changed, those changes that were made may impact Title 17 zoning requirements. Staff will bring back recommendations for changes that need to be made.
