For Possible Action – TM-2017-000007 (Continued from May 10, 2017 RPC meeting): Tentative Map application for a subdivision containing 145 residential lots on approximately 33.34 acres gross, located within the Mountain Falls Master Planned Community, Planning Area 8. Mountain Falls LLC and Mountain Falls Golf Course LLC – Property Owner/Applicant. Taney Engineering – Agent. AP#’s 045-021-57, 58 & 61. b. For Possible Action – WV-2017-000043 (Continued from May 10, 2017 RPC meeting): 1. Waiver from the street design standards to allow for a 28-foot private street section where 29-ft. is the standard. 2. Waiver from the subdivision street entry design standards to allow for a 29-foot private street standard where 59-ft. is the standard. 3. Waiver from the front Residential Low setback design standard to allow for a 10- foot front building setback where 15-ft is the minimum. (Side Entry Garage) 4. Waiver from the rear Residential Low setback design standard to allow for a 10- foot rear building setback where 20-ft is the minimum. (These items are Final Action by the Pahrump Regional Planning Commission unless appealed to the Board of County Commissioners, or otherwise announced.) (CB) Cheryl Beeman reviewed her staff report. She would like to remove condition #1 on the waiver, PW would like to reserve the right to comment at a later date as improvement plans come in. There is conflicting language from the developer, they refer to design standards, design guidelines or the DA. We need to make sure we are all discussing the same items. PW has provided comments questioning design guidelines, they haven’t seen any or were they aware that there were any approved, because for the most part there aren’t any design guidelines. There are Page 2 of 7 design standards and standard designs in the DA. Condition #28 she believes has been resolved and can be deleted.

asked for clarification that they delete waiver condition #1.

asked for explanation on what the design guidelines that are being approved through staff. Brad Nelson, William Lyon Homes stated from a design standpoint they have a DA that has design standards which are street designs and designs for the community. He is unsure if the guidelines have been approved by Nye County, they are mainly an internal architectural design work of the master plan. It is referred to in the DA and mimics the DA from any of the design criteria. The document of design guidelines is an internal document to make sure they are adhering to the architectural design guidelines. There is an out piece in Planning Area 8, because it is on the bottom side of Mt. Falls Parkway it isn’t included, they will bring back a map in the future that will be a residential based map. They agree with all the conditions of approval with the exception of item #23 and asked PW to address the concerns with PW. Cody McKee stated the tentative map has been reviewed and has been through the technical review stage he isn’t aware that there is another review happening but reviews that happen through multiple departments can take some time and have conflicting comments that can change things with other departments that they might have to reweigh in on. This comment is to just insure that they can comment on something that they may need to review.

Mr. Nelson

stated they understand it is a tentative map but has them concerned is that the condition is open ended. He asked if it is normal mapping issues or will they have to come back with another TM, or navigate through the FM.

Mr. McKee

stated they wouldn’t have to come back to the RPC. This is staff review that may be finalized at this time but want to make sure it is technically sound and correct.

Commissioner Hafen

asked if there are still redlines outstanding that still need to be addressed.

Ms. Beeman

stated the map is still under review.

Mr. Nelson

stated if there are issues they are ready to address them now.

Commissioner Hafen

stated they are removing condition #28 per staff, and the design issues have been addressed. He believes everything has been addressed by PW.

Mr. McKee

stated yes. Item #23 that they are referring to is language they have used before, it is a general comment that they use to confirm that the TM is technically correct.

Mr. Nelson

stated they will agree to that.

Commissioner Hafen

stated for the record, there are a lot of waiver requests and they are the same requests. Would it be better to amend the DA to incorporate all the changes instead of every TM requesting waivers?

Mr. Nelson

stated they will look at that moving forward. They are pretty far into the AQ and have only one left, they are only targeted to the AQ areas. Page 3 of 7

11. Hunter Franklin and Chaise Taylor – Property Owners/Applicants. AP# 044-161-06. (This

reviewed his staff report stating the property is zoned NC and allows for body art with a CUP. There are a few issues with the site, there are ADA parking requirements that haven’t been met, the parking lot is gravel. There are signage installed on the property that doesn’t meet NCC. There are conditions of approval that address those issues. Staff is recommending approval of the application.

Commissioner Hafen

asked for clarification on the ADA requirements, that there would be a minimum of 2” of asphalt and two spaces.

Mr. Osborne

stated there would be a minimum of 1 space and it wouldn’t necessarily be 2’ asphalt but a durable smooth surface.

stated concrete or asphalt.

asked if the surrounding properties are residential.

Commissioner Hafen

asked if the RDR master plan designation allows for NC.

Mr. Osborne

stated officially it needs a master plan amendment and asked Mr. Sutton to review. Hunter Franklin, applicant stated they also do art and music lessons but can do those outside the property. They have a plan in regards to parking. He was unaware of the paving.

stated ADA requirements are to have a hard surface.

Mr. Franklin

stated they are okay with that, but were unaware. They aren’t sure what the mandatory limits are for the signs.

Commissioner Hafen

stated that it is in the back up, Planning can explain that.

Commissioner Hafen

asked if they have read and understood the conditions of approval and are amenable to them.

Mr. Sutton

requested a break to review the Master Plan verbiage in the code.

Commissioner Hafen

stated the addition of condition #11 that a Master Plan Amendment needs to be cone on the property, and directed staff to bring back a MP amendment.

Commissioner Koenig

asked if they were adding condition that the CUP be approved if they get a MP amendment or to approve and they are directing staff to do a MP amendment.

Commissioner Hafen

stated the approval to meet the findings is that the condition has to be an approval of the MP Amendment.

Commissioner Koenig

stated even if the CUP is approved they have to wait for the approval of the MP amendment.

Commissioner Hafen

stated correct, and that can take 60 days.

motioned to approve CU-2017-000036. Seconded by Commissioner Clark.

asked if they have approached Building and Safety.

stated his question he sent is was about the separation between buildings. It isn’t building code per Mr. Cammaratta. It has been discussed that Planning reduce the separation to 5 feet within the code.

asked if they are amenable to add condition #3 that a building permit is to be pulled or a waiver from Building and Safety on the need for a permit.

Mr. Hibdon

stated there will be a permit pulled regardless. It is over 200 Sq. Ft and a permit is required.
