stated she provided staff with some minor typographical changes.

motioned to approve the minutes from the August 15" meeting with changes submitted to staff. Seconded by Commissioner Bennett.
Mr. Waggoner
stated total applications received was 159, and 124 have been processed. Building permits were SFR was 48, MH was 31 and total permits were up 45 from last month to 243 for all permits. Code Enforcement — there was 42 new complaints, and they were able to close out 16 for the month. Previous items heard by the RPC — Bill 2018-09 Building Separation, Bill 2018-07 Manufactured Homes were both approved by the BOCC, Bill 2018-15 ARES Development Agreement was approved August
21. CU-2018-00050 and ZC-2018-000023 previously heard by the RPC. The ZC was recommended

will be abstaining from item 9A, his family rents sign space to the applicant.

will be abstaining from item 9a, his insulation company has a contract with Mtn. Falls. For Possible Action — WV-2018-000069 (This item is continued from the August 15, 2018 RPC meeting): Public hearing, discussion, and deliberation on an application for a Waiver from NCC 17.04.740 (Landscaping), to allow a reduction of the required side and rear landscaping in conjunction with the development of a marijuana cultivation and production facility, located at 1340 W. Highway 372. Assessor Parcel Number 036-381-02. Evelyn Tooley, Trustee, Tooley Family Trust — Property Owner. GWGA, LLC — Applicant. Sandra Tiffany — Agent. The applicant is not completely asking to waive all of the landscaping requirements, they still need the waiver because they are proposing to not have the living shrubs. Based on the proposed changes by the applicant staff is recommending approval of the application. Sandra Tiffany, applicant, stated she has supplied a new rendering and there are trees already existing on the property next door, she will also do an evaporative pond.

asked the applicant if they have read and understood the special conditions of approval.
Commissioner Duryea
stated the trees she put along 372 and west side look good. However, the vast majority of the east side is vacant on the neighboring property, though your rendering shows more existing.

stated it is half way down and stated yes the architect did put in a few more shrubs then what is actually there.

Mr. Osborne
reviewed his staff report and stated there are special circumstances involved. The property is zoned GC which allows for off premise signs, the property is located on a major section line road, other commercial uses in the vicinity and the sign is temporary. The particular use won’t result in damage to adjacent properties in the vicinity. Staff is recommending approval. There is one change to condition #5, the CUP should be deleted from that condition. Carlos Ramos, and Joe Melaragno with Motivational Systems. They are here to request a temporary waiver for an off-premise sign for William Lyon Homes Ovation Project in Mt. Falls. The sign will be on the SW corner of Homestead and Zolin.
Commissioner Bennett
asked why they needed three support columns instead of two.
Mr. Ramos
stated it is for engineering, The International Building Code for an 8’ x 16’ signs needs three support columns.
Commissioner Duryea
asked how long is temporary? The letter states until all homes are sold. There are subdivision in this town that haven’t been sold in years.
Mr. Ramos
stated the typical time the signs are up about 2 years. This is specifically for a project and not the Mt. Falls whole community.

(CB) Cheryl Beeman reviewed her staff report and stated looking at the location and existing development staff finds sufficient justification to recommend approval of both applications. The property to the North is developed as an existing mini storage and is paved and fenced, there are fire water tanks and no water or sewer on the property at this time. She reached out to the B & S department to find what the requirements were for water and sewer connection is for certain commercial development and had not received an answer by the time of the meeting. NCC doesn’t have a requirement that they must have water and sewer to operate. If approved the next step would be Site Development Review. The statement in the conditions of approval regarding BLM disposal land is not relevant to this item and needs to be stricken.

stated the question to B & S can be addressed at the Site Development Plan review stage and which is addressed in the conditions of approval.
Commissioner Lee
asked if the existing access on the existing facility off Homestead will be the access point for the expansion.
Mr. Wallin
stated they would like to use the existing access.
Commissioner Lee
asked if they will be leaving the properties as two separate properties.
Mr. Wallin

motioned to recommend approval of the applications to the BOCC. Seconded by
Ms. Beeman
reviewed her staff report, stating NCC was recently amended by Ord 530 which established a requirement that accessory uses are only allowed only prior to the insulations of the principal residence only when building permit is issued for the principal residence. This application was received August 18" and is improved with water, septic and electric hook up. We received a letter of support from the neighboring property owner the letter stating there is no objection of the accessory building and for the RV to be located part time while preparing to build as long as there is water, power and sewer and for no longer than 2 years with no extensions. Staff is recommending denial of the application based on the findings. Donald Dial, applicant stated the building he is going to build will be built by a retired licensed contractor. He has intentions of building on his property but as of today he has a few years of traveling before he does that. He stated he is here for maybe | or 2 weeks a month.

asked if his RV when he is here living connected to the water system?
Commissioner Lee
asked if there is a reason why he can’t apply for the TUP?
Mr. Dial
stated no, he isn’t here more than a week most of the time.
Commissioner Lee
asked if he was advised of the TUP when he applied for the waiver
Commissioner Koenig
stated according to the backup temporary seasonal use shall not exceed 180 consecutive days per calendar year. He doesn’t believe he needs a TUP.
Mr. Waggoner
stated that does contradict the TUP wording. The TUP comes into play if the RV is there over two weeks and allows for 120 days.
Ms. Beeman
stated she believed they needed a waiver before they could approve a TUP.
Mr. Waggoner
stated because he wanted more than 120 days in one calendar year they felt a waiver would be required before the TUP process.
Commissioner Hafen
asked if the applicant will plan on staying over the 120 days a year. Page 5 of 6 11.
Mr. Dial
stated if one month he is here one week and then the next he is here two weeks he doesn’t know how many days he would be here. There might be months he is here for over a month or a month and a half.
Commissioner Hafen
stated the waiver runs with the land, staff is recommending denial because in 5 or 10 years you may or may not be living there or build a house. The waiver runs with the land and someone may or may not park there RV there and use it permanently, that was part of staffs reasoning for denial. If you get a TUP and are only here for less than 120 calendar days, the waiver wouldn’t be needed.
Commissioner Fowler
stated they are losing sight of the accessory building we just established this and it was for good reason.
Mr. Dial
stated he came in to Planning in March and asked for a permit to put in a garage, staff told him an ordinance had passed last year that he couldn’t do a building without a permanent structure.
Commissioner Fowler
motioned to deny WV-2018-000072 based on findings. Seconded by Commissioner Duryea.

stated Mr. Dial may appeal the application to the BOCC.

stated we may be looking at December if he can get a date from Mr. Lacy.
